00:09:08.020 Well, now it turns out, Mike, the Supreme Court will be getting a bite at the apple on the Trump cases.

00:09:20.740 Well, there's a lot going on.
00:09:22.720 So the Supreme Court is trying to decide whether they're going to take Jack Smith's January 6th case,
00:09:30.240 this unprecedented indictment by Biden Special Counsel Jack Smith against President Trump for the non-crime
00:09:36.840 of objecting to a presidential election, which is allowed by the Electoral Count Act of 1887.
00:09:42.720 Twisting arms politically is allowed by the First Amendment.
00:09:45.060 If this were a crime, Democrats would be in prison for objecting to Republican wins in 1968, 2000, 2004, and 2016.
00:09:52.940 We don't see Al Gore and John Kerry and Hillary Clinton in prison after they objected, right?
00:09:57.920 So what the Supreme Court is looking at deciding is what we've been saying all along,
00:10:02.960 which is what President Trump did on January 6th was either protected by the First Amendment,
00:10:08.360 if he's acting within his personal capacity, or if he's acting within his presidential capacity,
00:10:13.320 it's covered by presidential immunity.
00:10:16.140 And presidential immunity means you can't charge a government official for what they're doing in their official capacity
00:10:22.880 and under Supreme Court precedent, the outer perimeter of their official capacity.
00:10:27.200 And Jack Smith has charged President Trump essentially for ordering his vice president not to certify the election.
00:10:33.860 Well, you can't do that in your personal capacity.
00:10:36.340 A private citizen Trump can't order the vice president to do anything.
00:10:41.240 He can only do that as the president of the United States.
00:10:43.920 And the president has a constitutional duty to take care that the laws are faithfully executed.
00:10:49.400 So the Supreme Court may hear this.
00:10:52.040 Jack Smith is trying to bypass the D.C. Circuit Court of Appeals
00:10:55.860 because Jack Smith is trying to interfere in the 2024 election.
00:11:00.180 Jack Smith desperately wants President Trump sitting in a courtroom starting on March 4th, 2024,
00:11:07.900 for several months, six or seven months,
00:11:09.980 and then have him in the D.C. courtroom with D.C. Obama Judge Tanya Shutkin
00:11:15.000 and railroading him and interfering with the presidential election before the election,
00:11:19.360 and then throw him in prison for the rest of his life after the election.
00:11:23.060 And I hope the Supreme Court understands that they cannot go along with this blatant Democrat lawfare
00:11:29.820 and election interference.
00:11:30.860 The Democrats waited 30 months to bring these bogus charges against President Trump.
00:11:35.860 They stacked these trials in March and March and May and August clearly to interfere with the election.
00:11:43.220 There's no reason that these trials cannot happen after the election,
00:11:47.500 other than Democrats are waging lawfare and election interference,
00:11:51.680 to take out Trump through the legal process because they know that President Trump is going to beat President Biden
00:11:58.540 like a drum on November 5th, 2024.
00:12:01.760 Well, and Mike, that's the thing, right?
00:12:03.760 Because if these things get pushed back, right?
00:12:06.260 And people understand that, and I said this on Charlie Kirk this morning in the previous hour,
00:12:10.720 but if people understand, it's not like a movie, right?
00:12:15.300 Most of what happens in one of these cases actually takes place before you reach the trial phase.
00:12:22.120 Your pretrial motions, your discovery, your witness lists over and over.
00:12:27.300 There's so much that happens.
00:12:28.740 If all of that gets shifted to the right, as we would say in the military, so it gets postponed,
00:12:33.140 it sets off a chain reaction.
00:12:34.760 Now your trial date isn't even going to be until after the election, Trump wins.
00:12:38.680 All of this stuff could be declared moot because you can't do any of this to the President of the United States.
00:12:43.360 And it also, by the way, takes away the central argument of the never-Trumpers
00:12:47.540 who have been saying we need to move past Trump because of these cases.
00:12:50.980 Guess what?
00:12:51.700 The cases have now been moved past the election.
00:12:54.160 Well, assuming or basically reanalyzing and assessing that this Supreme Court,
00:12:59.820 because it is an originalist Supreme Court, really, by the way,
00:13:03.340 and thanks to your personal work, Mike Davis, of getting these originalist jurists and Trump picks up on the court.
00:13:11.940 Yeah, let's just look at this, Jack.
00:13:13.820 Let's look at what the Democrats are trying to do here.
00:13:16.840 Let's take Trump out of the picture and just say the President of the United States.
00:13:20.120 They brought in four unprecedented indictments of a former president and the leading presidential candidate.
00:13:27.320 And they're trying to say what President Trump did on January 6th was criminal somehow.
00:13:32.240 The only way it would be criminal on January 6th is if Trump actually incited a riot on January 6th,
00:13:38.900 which he did not do.
00:13:39.920 There's zero evidence of that or Jack Smith would have brought those charges, right?
00:13:44.740 And so the evidence does not exist.
00:13:46.300 And so what they're trying to say is that the president can face criminal prosecution
00:13:50.840 for ordering his vice president to do or do something.
00:13:54.640 Well, guess what?
00:13:55.560 That sets up a very bad precedent for future presidents and former presidents.
00:13:59.900 For example, President Obama ordered an extrajudicial drone strike
00:14:05.020 and murdered a 16-year-old American citizen abroad.
00:14:09.640 Didn't get a court order, just did it.
00:14:11.360 Just ordered a drone strike and killed an American.
00:14:13.220 He should have presidential immunity under longstanding understanding of the powers and
00:14:20.600 responsibilities and the protections of the president.
00:14:22.680 But if these Democrat prosecutors like Jack Smith and these Democrat judges like Tanya
00:14:28.840 Shutkin or these Democrat judges on the D.C.
00:14:30.960 Circuit or Democrat justices on the Supreme Court and a couple weak Republicans, if they
00:14:35.820 don't see that there's presidential immunity here, does that mean that the Trump 47 Justice
00:14:40.540 Department can charge President Obama for murdering the 16-year-old American citizen?
00:14:46.200 Do these Democrats really want to go down this path where you're destroying the presidency
00:14:51.560 and destroying our republic because they fear that they can't beat President Trump at the
00:14:56.940 ballot box?
00:14:57.540 So they just want to throw him in prison for the rest of his life, bankrupt him and disqualify

00:15:17.420 She is the congresswoman who filed the judicial ethics complaint against Manhattan Judge Arthur
00:15:23.200 Ingeron for the bogus rulings up there, the obvious partisanship against Trump for the
00:15:27.980 civil fraud case against Trump for the non-fraud of paying back sophisticated Wall Street
00:15:32.540 banks in full, as agreed on time with interest, right?
00:15:35.900 And so now she's brought a new complaint against D.C. Judge Beryl Howell, who was the chief
00:15:41.060 judge of the D.C. District Court from 2016 to 2023.
00:15:45.360 Judge Beryl Howell is a Democrat operative in a robe, and she's the one who ran, supervised
00:15:50.840 the bogus molar probe with Weissman.
00:15:53.700 She supervised Jack Smith's grand jury investigations of Trump from Mar-a-Lago on January 6th.
00:15:59.020 She's railroaded January 6th defendants.
00:16:02.340 She's forced them to stay in jail, pre-trial detention.
00:16:05.640 She is a partisan activist.
00:16:07.560 She gave a highly inappropriate political speech a couple weeks ago where she essentially
00:16:13.000 said that re-electing President Trump will bring fascism to America.
00:16:18.100 She didn't say Trump by name, but it was very clear what she was talking about.
00:16:21.580 She was up there with Biden's Deputy Attorney General, Lisa Monaco, hugging and receiving
00:16:26.340 award and having a cheerleader session, a pom-pom session, where they were praising each other
00:16:31.320 and trashing Republicans, trashing Trump supporters, citing a book, an anti-Trump screed.
00:16:38.240 And so Elise Stefanik, to her great credit, filed an ethics complaint with the D.C. Circuit
00:16:44.040 Court of Appeals because we cannot let this lawfare continue by these Democrat prosecutors
00:16:49.940 and these Democrat judges and these Democrat hellholes like D.C., New York and Atlanta,
00:16:55.560 the American people, not these partisan activists, prosecutors and judges, get to decide the next
00:17:01.080 election.
00:17:02.680 That's incredible.
00:17:03.620 Now, so this is the fact that we actually can get some accountability for this is absolutely
00:17:10.080 critical.
00:17:11.020 And I do think, though, as you say, the ultimate backstop to this will be taking it to the Supreme
