00:28:15.980that these are considered narco blockades after the execution and the assassination of Nemesio
00:28:21.180Oseguera Cermantes. A lot of the people were saying he got executed on the mission led by
00:28:25.860the federal government, but no, he died in the helicopter on the way to Mexico City. That was
00:28:31.080a big thing and a big news, and a lot of speculation were saying, was he assassinated
00:28:34.840inside of the helicopter because of the enormous extraction of information that he has, or did he
00:28:39.700die because of the confrontation? More than 25 military men from Mexico died on this confrontation.
00:28:45.240The head leader of the national defense was crying yesterday on a morning conference saying that it was a great effort from the Mexican military, but they could not accomplish this without the intelligence of the American government.
00:28:59.220That is incredible information to reaffirm that the secretary of defense said this, that it was a collaboration with intelligence of information provided by the American government.
00:29:09.500Now, what has happened on the day after, we reported on that same day when there was a narco black case, more than six vehicles that they were burned in the city of Tijuana.
00:29:17.700This violence escalated from the central parts of the country all the way to the north borders.
00:29:22.420In Tijuana alone, the city that I'm located, more than 22 incidents.
00:29:26.320Why are they considered incidents, Jack?
00:29:28.140Because they were not only burning vehicles, they were burning businesses as a sign and as a message that we still have power on these areas.
00:29:37.020and we are going to terrorize the citizens if we want to now on the next day we thought that they
00:29:42.680was going to decrease because they uh they arrested more than 20 of these agitators and
00:29:47.340these cartel members that they were burning vehicles right here in tijuana they arrested 20
00:29:51.580but they still burned three automobiles and this is the video that i'm that i was recording jack
00:29:56.740look how close they are to the border wall and this particular this picture right here right here
00:30:02.120way they burned this vehicle in front of this vehicle there's a large camera post on the
00:30:07.420american side by the u.s customs and the border agents it means that the cartel had the boldness
00:30:12.900and the audacity to burn it in front of the camera because they know that the level of extraction of
00:30:18.060information to execute and mention was provided by the american government these people are
00:30:22.400completely upset of the american government collaborating with the mexican government
00:30:26.560Now, after everything has evolved, this level of increasing of violence in these cities and in the central parts of the country, they just deployed, breaking news, they deployed 103 infantrymen on a naval vessel right now to Puerto Vallarta.
00:30:45.880In Puerto Vallarta, you have thousands of American citizens that they live there and hundreds of thousands that they vacation there.
00:30:53.160Of course, it was a huge red flag for tourism and ultimately, at the end of the day, for the Mexican government to protect not only the Mexican citizens, but also the American citizens that they are located here.

00:31:09.140Talking to our connections down there in Puerto Vallarta, they have told us that you see now the military men walking on foot on every single resort area, making sure that it's highly secure and they are in high alert, completely on high alert to protect the American citizens, to protect the resort areas.

00:40:01.440Before the court is defendant's motion to disqualify Utah County Attorney's Office, defendant argues that high-level prosecutor assigned to this case has a concurrent conflict of interest.

00:41:00.180Were you surprised that Judge Graff ruled this way, that the prosecutor was in fact,
00:41:04.840And by the way, the insinuation of bias because his daughter or one of the prosecutor's daughters were there at the trial and that's why the charges were brought and that's why the death penalty was sought.0.95

00:41:23.860And I actually appreciated when the judge ruled and he sort of chided the the defense team a bit there and pointed out that defense of victims is obviously a legitimate bias to have.

00:41:42.480Yeah, I agree with you on that. It was really fascinating to see this ruling come down.
00:41:46.180I was not surprised that Judge Tony Graff ruled in favor of the Utah County Prosecutor's Office.
00:41:52.300And yes, you are correct. I believe that the defense attorney is trying to do everything they can to delay, delay, delay this trial. And this was just another effort to do that. They had tried to disqualify not just the one prosecutor whose daughter was at Utah Valley on September 10th, but tried to disqualify the entire Utah County prosecutor's office.
00:42:13.620and Judge Graff went through the list of reasons why that's absolutely not reasonable to do in
00:42:19.660this case. And I appreciated that. I thought it was very thorough the way he marked that down.
00:42:25.560He said that prosecutors have absolutely bias against the person that they are prosecuting,
00:42:32.060and that's part of their job. And that's true. Justice defense attorneys have to do everything
00:42:35.900they can to make sure that the law is applied fairly to their client. That's what lawyers do.
00:42:40.920That's the point of it. But these lawyers are going on and they are trying to delay this trial is what it looks like to me. They've brought motion after motion, trying to, you know, keep things moving at a snail's pace.
00:42:54.740One of the more interesting moments that I thought, and it was a very short hearing today, was when Judge Graff scolded the defense attorneys for apparently not prioritizing the scheduling of this case.
00:43:07.460And Graff said that it's his responsibility to make sure that everybody's constitutional rights are respected, and that includes the right to a speedy trial.
00:43:16.300and he um and also uh charlie's widow erica kirk has come in and said hey you know you should you
00:43:23.500should get on this without any undue uh without any undue delays here and um yeah so he said you
00:43:30.740really got to prioritize the scheduling in this and the defense attorneys then did have to say
00:43:34.960okay for the upcoming hearing i will clear my schedule i was supposed to be here or there but
00:43:40.020i'll try and get around it uh so i thought that was good too and it was actually one of the firmer
00:43:44.680moments that we've seen from graph in this whole trial so far or the hearings pre-trial so far
00:43:51.020yeah and there's you know this is one of the biggest um i mean he's made some motions in
00:43:55.960the past he's granted defense motions in the past by the way when it came to restricting cameras
00:44:00.400at the sally ports those entrances and exits exits for the defendant um he's he's come down
00:44:07.860you know on the he's a stickler for the rules is kind of what it seems like to me and which is kind
00:44:12.720of what you want a judge to be. Obviously, he's been very strict as well with the camera operator
00:44:17.520saying, look, I don't want you being too close to Tyler Robinson. There's concerns about lip
00:44:23.520syncing or lip reading, which I've never heard of before in a case. I remember when Kyle Rittenhouse
00:44:29.100was on trial. I mean, you could see him the entire time or Brian Koberger or any of these other
00:44:33.760defendants in cases where typically they are on camera. And so one of the first instances I've
00:44:39.680heard of that. But at the same time, he are saying, look, you guys need to prioritize this
00:44:45.640case. This is a case, which he understands. Because think of it, their argument is incoherent
00:44:51.020because on one side, they're trying to say, oh, there's so much media scrutiny. This is such a
00:44:55.520high profile case. But on the other side, they're also saying that, oh, well, you know, we've got
00:45:00.120other stuff to do. And these hearings, there's just too many of them and can't really get it
00:45:04.640the schedule we've got so which is it or is this a high priority case or not and then to your point
00:45:10.560as well erica kirk also made a motion which under utah law has this unique um this unique feature
00:45:17.920to it where victims are able to come in and invoke a sort of more strenuous right of speedy trial
00:45:25.360that they have at the state level to say i want to use whatever um whatever legal power i have
00:45:31.600as a victim and of course the uh the victim advocate for the estate of charlie kirk so
00:45:38.320because of course obviously he is not able to be there present himself because he was murdered
00:45:43.680that erica is speaking in lieu of charlie so of course she is his advocate officially by the
00:45:51.600court so that's an official standing that she has within the case and that will certainly come up
00:45:57.440if he is convicted that will come up during the death penalty phase important to know
00:46:02.800and she has invoked this right to a speedy trial under utah law that's what the judge was referring
00:46:08.640to to say look you know i've got to balance this all out and you guys are sitting here telling me
00:46:13.200that you don't have time in your in your calendar for it you know you're trying to push it off till

00:46:23.280When when, you know, Libby, we see this, that the tactics that they that they are spending time on are ridiculous.
00:46:29.540Yeah, I think that that's right. And the judge also said that he was going to hold to the May trial date for the basically the preliminary hearing in the trial to move forward.
00:46:39.720And that's I think that's that's the arraignment, right? Yeah, that's the arraignment. I'm sorry.
00:46:43.780Yeah, that's the arraignment. Yes. And that's in May. And he said that's pretty much fixed.
00:46:47.440He doesn't want to delay that at all. And so he was encouraging them to clear their calendars.
00:46:51.480He noted that March 13th is a day that he has completely free on his bench that he could spend the whole day going through all of these motions, and he urged them to make themselves available for that day.
00:47:03.560There was some discussion about whether or not that could be done via WebEx, and presumably that will be the date when we finally learn Graf's ruling on whether or not cameras will be permitted in the courtroom.
00:47:14.800We've seen limits on that, as you said, already, and that has been pretty extreme with camera crews being told to move back.
00:47:23.180There is an attorney in the room for the media representing the media's interests, and that's something really fascinating.

00:47:35.300and I think that's very fascinating to see that the media is represented to say this needs to be open, this needs to be fair,
