00:09:12.820 conducting an illegal armed blockade. But I wanted to go, of course, just like in all these things,

00:09:18.940 what we do is we go to the legal analysis. And our favorite guy for that, he wrote the book,

00:09:24.200 The Law of Self-Defense. It's Andrew Branca from The Andrew Branca Show. He joins us now.

00:09:29.080 Andrew, how are you? I'm doing great, man. How about yourself? I'm doing well. Your commentary,

00:09:35.000 your analysis has been going hyper viral over the weekend. I want to ask. So you've been you've

00:09:41.820 looked at this case and we've seen these what I call them sort of freeze frame activists. And I've

00:09:47.260 seen you use this phrase as well going through and, you know, looking, oh, well, what about this

00:09:51.140 moment and this moment? And they take this shot and this shot. But ultimately break down what's

00:09:56.520 the problem with the legal analysis versus what people are doing in the freeze frame activism?

00:10:02.840 Well, I mean, the legal question here is simply, did the officers who fired the fatal shots,

00:10:08.300 did they have a reasonable perception of an imminent threat of death or serious bodily

00:10:12.240 harm at the valix preddy? And there's more than enough evidence to support such a reasonable

00:10:17.600 perception. And it's important to keep in mind that they don't have to prove this. A prosecutor

00:10:22.260 would have to disprove that reasonable perception beyond any reasonable doubt. And what facts do we

00:10:29.220 have here? We have the ICE officers. One of them shoves the woman and then is subject to a felony

00:10:34.720 assault, felony impeding. It's good for eight years in a federal penitentiary by Alex Preddy.

00:10:40.060 The other ICE officers, or CBP, come in to make his arrest. He's forcibly non-compliant with

00:10:46.060 arrest. They know he has a gun because they hear gun, gun, gun shouted. A gunshot goes off.

00:10:51.720 Alex Preddy, while being noncompliant, brings his hand into view with an object in his hand.

00:10:57.440 It's not clear what it is.

00:10:58.540 It might be a phone or maybe it's one of his spare magazines.

00:11:01.280 But in any case, it's an object in his strong hand.

00:11:05.760 And the officers take all that information, the totality of the circumstances, and create

00:11:11.140 a reasonable perception of an imminent threat of deadly force harm from him.

00:11:15.280 And it's important to keep in mind, they don't have to be correct about this perception.

00:11:18.900 The law of self-defense doesn't require perfect decision-making. It requires reasonable decision-making. Mistakes are permissible if they're reasonable mistakes. And reasonable simply means they're not imagining what's going on. They're applying their powers of reason to the facts before them. And of course, they're doing it in a very stressful, life-threatening, compressed time frame.

00:11:41.120 Right. And that's what I wanted to get into as well, because you see these people running this this, you know, we're freezing the frame or putting it in slow motion that but that's not how reality works.

00:11:50.640 In reality, in this situation, what these activists have done and by the way, what these agitators are doing on purpose and deliberately, they're blowing the whistles, they're getting in the street, they're getting in the way.

00:12:00.400 He's this this guy individual, this individual immediately prior to the altercation, he's seeing an arrest going on and he's beckoning cars to come forward, just interfering with things that are going on.

00:12:14.160 So he's bringing cars in.

00:12:15.960 He's establishing a roadblock.

00:12:17.360 All of these things that he's been doing.

00:12:19.320 This is not a peaceful protest or a legal observer.

00:12:22.080 He just stood on the sidewalk and said, shame, shame, shame.

00:12:24.660 OK, that's still legal.

00:12:25.540 Right.

00:12:26.000 But that's not what he was doing.

00:12:27.580 He was inserting himself into this process. And again, it's everything after that follows. And by the way, you're someone who very well understands concealed carry laws. Was this behavior lawful?

00:12:42.900 no the moment he put hands on the first cbp officer admitted a federal felony so

00:12:49.460 alex preddy was not shot for exercising his second amendment rights he was not shot for

00:12:54.080 concealed carrying he was not shot for having a care a couple of spare magazines on him

00:12:58.680 he was shot for fighting the law and the law won it really it really is as simple as that

00:13:06.180 When what is the danger, though, I guess I would say of or what do people get wrong when they get so down the rabbit hole in this sort of freeze frame, you know, you know, sort of world?

00:13:18.360 Well, there's a lot of confounding factors in these kinds of group events.

00:13:22.760 So, for example, people tend to assume that every officer knows and sees what every other officer is knowing and seeing.

00:13:28.940 They'll say, well, obviously he'd been disarmed.

00:13:31.640 The guy in the gray jacket took his pistol off him. 0.79

00:13:34.280 That appears to be true.

00:13:35.620 by the way, it doesn't mean he doesn't have another weapon, but certainly that weapon was

00:13:38.760 taken off him. That doesn't mean the other officers saw that or know that. They're not

00:13:43.440 aware of that. Every officer has a different perspective. They're looking from different

00:13:48.020 angles. Their vision is obscured in different ways. They're hearing different things, and

00:13:52.340 they're not hearing things over the screech of these whistles, by the way. Very difficult to

00:13:57.500 communicate. So each officer is making an independent decision. There's no collective

00:14:02.420 base of knowledge that they're all sharing in the instant. And that's all the law requires is they

00:14:08.380 have to make their use of force decisions based on what they personally are aware of, not what

00:14:13.500 some fellow officer might be aware of. Right. It's amazing to me because there's so many times that

00:14:18.080 I feel like, and you've come on the program or, or other times in the past where it's like,

00:14:23.040 you have to have the same conversation over and over and over, because if you're violently

00:14:27.040 resisting arrest, even if you've been disarmed once with one handgun, they already know you had

00:14:33.260 a handgun. They don't know if you've got another gun. They don't know if you have a knife. They

00:14:37.700 don't know if you have some other implement of a weapon that you can use. They have no idea.

00:14:43.500 So if you are in one of those situations, God forbid, let's say you find yourself in one,

00:14:48.040 just, hey man, hands on the ground, hands behind your back, hands where you can see them. Don't

00:14:52.300 go near the belt line. This is really basic stuff, which I feel like has to be said over and over and

00:14:58.620 over. And people want to play freeze frame armchair activist, but that's not the real world. And by

00:15:04.820 the way, if he had wanted to fight to fight this from a legal rights perspective, and had wanted

00:15:10.640 to say, hey, I'm concealed carry, you're doing something wrong. Couldn't he have done that in

00:15:14.300 court? Well, that's where you do it. That's how you don't get killed in fighting law enforcement

00:15:19.920 in this way. I mean, think about what law enforcement knew here, right? Indisputable

00:15:23.980 facts. They saw him impede another officer by contact. That's a forcible felony and a law

00:15:30.820 enforcement officer. So he's not a peaceful observer. He's just committed a forcible felony.

00:15:36.380 They know or discover that he's got a gun on his person, meaning he's a person who carries weapons

00:15:41.600 on him. They know he's noncompliant with arrest. He's fighting their lawful arrest. They know his

00:15:47.040 hand comes into view with a black object in his hand while they have him at gunpoint after a gun

00:15:52.460 shot's gone off while they're hearing gun gun gun being shouted that is going to get you shot by the

00:15:58.000 police 999 times out of a thousand it really is um i wonder though you did mention the shot that

00:16:05.400 went off i know there's this sort of uh controversy regarding this specific weapons platform and a lot

00:16:11.480 of questions about negligent discharge i i don't really personally have any opinion one way or the

00:16:16.900 other. I think it's hard to tell. Do you have any opinion on having viewed this as to whether or

00:16:21.280 not there was a negligent discharge or some kind of round fired by that firearm? I just can't tell.

00:16:28.100 So people keep sending me images and saying, hey, you can see it here. I look at the images. I don't

00:16:33.680 see any indication of the gun. I don't see recoil. I don't see muzzle blast. I don't see an impact on

00:16:38.860 the street. I don't see the slide moving. Now, it's possible all that happened and it just wasn't

00:16:44.320 caught in the video frames right a video is not continuous it's frame by frame by frame so it

00:16:49.600 could have happened but it doesn't matter it doesn't matter because if the officer who actually

00:16:55.420 fired the shot at lx pretty not this initial shot if he'd heard gun gun gun and the gunshot goes off

00:17:02.680 feet away it would be reasonable for him to believe this is now a gunfight and i have to

00:17:07.620 neutralize this threat um he's he doesn't have to know the exact mechanism it could have been a car

00:17:13.560 backfiring it would have been the same thing is this is this a similar legal dynamic going back

00:17:17.880 when you and i talked so much about the kyle rittenhouse case that first shot that was done

00:17:23.020 while kyle rittenhouse is not looking the first shot actually was targeted in the air at but

00:17:28.320 not directly at kyle but from his perspective he hears a gunshot behind him from a mob that's

00:17:34.520 chasing him right shots are being fired right it would be reasonable for him right a reasonable

00:17:39.680 reasonable shots are being fired a reasonable no it's a horrific situation and yet again one that

00:17:46.060 was completely avoidable if we we actually remember something and that's called the personal

00:17:52.220 responsibility of alex preddy the behavior the actions and the decisions of alex preddy which

00:17:58.660 by the way his parents apparently had warned him about not doing they said don't do this don't

00:18:05.080 engage which sounds to me like they knew their son was a hothead they know and you know they keep

00:18:09.240 acting like he was some kid. He was 37. He's a grown man. That's almost old enough to be

00:18:13.040 retired from the military. You can retire at 38 with a pension, or at least you used to be able

00:18:16.340 to. And so, I mean, he's a grown man. He's fully capable of making his own decisions.

They're going out and these swarm tactics that they have.
