00:04:04.500So what is it? Is it political expression? Which political expression? It is true that Mr. Kirk spoke hatefully of certain groups of people.
00:04:22.160He spoke hatefully of people who don't have traditional, norm-conforming gender identities.
00:04:33.160He spoke hatefully of people who are not strictly heterosexual.
00:04:38.160He spoke hatefully of people who have sexual relationships out of marriage.
00:04:43.160And yes, it is true that the evidence from Mr. Twiggs is that he identified in a non-gender conforming way to his friends and that he was in a romantic relationship with Mr. Robinson.

00:12:16.460is essentially trying to save his life, trying to keep him off death row. And so they're saying

00:12:30.340person that killed somebody, allegedly. And you're saying that the victim who is dead,
00:12:37.780the husband the father they were full of hate it doesn't make sense but you're right Novak has
00:12:45.260been around the block a very well-known attorney in fact Tyler Robinson's team he has a veteran
00:12:52.020team of attorneys out there in Utah and that is exactly what he's doing he is using this language
00:12:57.680he is trying to make Charlie Kirk not appear as though such as the victim here to try to get the
00:13:05.740death penalty off that's why they're still going hard over this aggravated murder charge which was
00:13:11.620bound over to trial they don't want tyler robinson to go to death row in this case so if you know
00:13:18.440your client is going to be found guilty the next best thing you can do is to save his life
00:13:24.000and so this this is exactly what i'm thinking because you really when i when i read their
00:13:30.700briefing the defense briefing so so for folks who who you know are watching this on tv this
00:13:35.660is pro-form because they're all repeating things that they'd already written before in their
00:13:39.940written briefings that came out weeks or days prior to the actual hearing. Well, this statement
00:13:46.000was not included in those. But if you go back to those arguments, they're most focused on getting
00:13:53.140these aggravated charges off. So the two types, and if you understand the way the Utah system
00:13:57.780works, you can start to see the strategy here and piece through what they're doing. So what Mr.
00:14:03.280Novak is, you know, in this case, he's talking about that political motive. And it seems to me
00:14:09.720as though he's almost trying to set it up to say, oh, this isn't political. This is because, you
00:14:14.640know, if you understand the progressive left is what they always say, that nothing the progressive
00:14:17.460left says is political. What they say is just truthful. They're on the side of love. They're
00:14:23.300on the side of progress. They're on the side of the moral arc of history. They're on the side of
00:14:28.900justice and they're on the side of they remember these are true believers they actually believe
00:14:35.540that children are trans and that the drugs and the surgeries and all the rest are just um are
00:14:41.680just there to affirm that which already exists on the inside again i'm not saying what i believe

00:15:20.980If it was not deflective in any way, anybody staying behind there, whether it could be one of our Turning Point staffers or volunteers or just a student or anyone who worked at the, you know, the UVU at that university could have been walking through there.
00:21:44.980but the again the evidence is stacked it's just stacked and it's stacked in one direction and it
00:21:51.380seems to be the point where and we've got lyndon blake on from daily wire and lyndon i gotta throw
00:21:56.620it to you because it seems like even tyler robinson's own lawyers are moving beyond the
00:22:03.460question of mere guilt and into questions of mitigating factors and again that has to do with
00:22:10.140sentencing. And so, you know, possibly saying, oh, he was overcharged or shouldn't have charged
00:22:15.440him for doing it in the presence of a minor because he wasn't aware there was a minor,
00:22:19.040which I think is ridiculous. But again, this is what their focus is on. Their focus is not
00:22:23.640on the actual question of guilt, the actual question of the facts. So here's what I'll
00:22:29.920throw to you. Do you think this sort of online group of people who are convinced the same way
00:22:35.760Clancy supporters are convinced she's innocent that that Robinson was framed. Do you think this
00:22:41.260is going to have an effect on them? I honestly don't. I mean, it has been going on now for about
00:22:47.240a year, even after their preliminary hearing. It seems like the online community was trying to
00:22:52.640double down on their conspiracy theories about this case, which just like the Lindsay Clancy
00:22:58.900case, these defense attorneys, their job is to make sure their client gets off, right? If there
00:23:07.860was any type of other narrative, alibi, story, they would pursue it. That is their job. And this
00:23:17.340was a prime example yesterday in that courtroom in Utah of the defense team going, like you said,
00:23:24.660into the nitty gritty into the aggravated murder into the charges into the okay how can we get the
00:23:30.420death penalty off the table for my client instead of bringing up some alternative narrative that
00:23:36.420happened on september 10th last year in utah and a lot of these people online they claim they read
00:23:43.620the court documents and they watch the trial but i just don't think they're looking at the facts
00:23:48.740as they are. There is not this big, this is not a TV show. This is not, you know, some murder
00:23:56.100mystery dinner party. This is a real situation, a real case where there's real evidence and real
00:24:03.960facts. And you can follow it. There are cameras in the courtroom, no matter how much the defense
00:24:09.060is trying to not make that happen. That's what we spent half of yesterday arguing before we even
00:24:13.880got into the closing statements, really. But you can see it for yourself, very transparent.
00:24:20.400And in both cases, some people are just choosing to look the other way.
00:24:26.140Well, and I think that, you know, one of the reasons for this, and we talk about it in
00:24:30.400Unhuman Socialist Revolution, is that you do have this true crime brain rot that goes on out there.
00:24:36.520And you do have people who have formed these sort of parasocial relationships with members of the trial, members of the things that they're watching.
00:24:46.580It's similar to when people watch TV shows, soap operas, and they start to identify with the character or feel they actually have a relationship with that character.
00:24:54.160Oh, I've got to see what happens to – I've got to see what happens to Betty today.
00:24:57.880I've got to make sure that Betty gets out of this jam that she's caught herself in from yesterday's show.
00:25:03.040And it's it's, you know, it's sort of this, I think, individual trait that a lot of humans just have in terms of human nature.
00:25:11.120But some people clearly far more susceptible to it than others that they feel they can get inside someone's head.
00:25:16.580And it's what it's also, by the way, when you're talking about Lindsay Clancy, that people will say, oh, she was overwhelmed.
00:25:21.300She was stressed. She she was sleep deprived from working as a neonatal nurse and then taking care of the three kids.
00:25:28.240She wasn't working. She wasn't working when when all this took place.
00:25:31.760She had a nanny, but she sent the nanny away.
00:25:33.940And so, again, people are painting their own imaginary facts into the case because they feel they have this this feeling of a parasocial relationship with Lindsay, who's probably someone that they've never actually I guarantee you someone they've never actually met in reality.
00:25:53.200And then you saw that woman earlier today who was arrested and arraigned for, you know, jury intimidating intimidation.
00:26:01.040And now she's almost ecstatic in these interviews, by the way, a former nurse, which I don't want to let slip, that she's now part of the story.
00:29:12.620Well, they did deliberate all the way to their post-lunch break.
00:29:16.380They just told the judge again, we still can't come to unanimous decision.
00:29:21.520So in Massachusetts, at this point, the judge reads this dynamite charge is what it's called.
00:29:28.380And basically he's saying, OK, jury, the burden is on the Commonwealth in this case.
00:29:34.860I need you to consider the majority here.
00:29:37.720Don't go against your personal convictions, but basically go back and really see where the other side is coming from and try to come to a unanimous decision in this case.
00:29:47.680Now, here's the thing. He can't send them back for a third time. The jury has to consent to that going back again. So we are truly at a deadlock now. If they cannot come to a decision, they come back to Judge Sullivan and say, we can't get to a unanimous decision.
00:30:07.140If they don't consent to going back and trying again, then the judge will declare a mistrial.
00:30:13.340And the most likely option is we do this entire thing all over again with a new jury.
00:30:22.580So doing this all over for the new jury that walk us through the process there a little bit, because this has happened in other high profile cases.
00:30:30.200Um, do you think that the prosecution and the defense would play things differently
00:30:35.720knowing that this initial trial went to a hung jury?
00:30:39.540Yeah, I mean, that is an option, but the most common option in a murder case like this is
00:30:44.820the prosecution would take exactly what they did and retry her on the same charges. This Plymouth
00:30:51.680County district attorney, Tim Cruz, Kevin Reddington said it multiple times yesterday.
00:30:56.300he does not think that he will come to another conclusion besides doing a retrial and Reddington
00:31:02.860won't kind of open up his playbook here until you get to that point he's been asked about it a lot
00:31:07.360of times but the most common thing is there will be a new jury and they will try it again now the
00:31:12.720question is if this is a mistrial do they move this case to a different location this jury was
00:31:19.220not sequestered this is a big in my opinion failure they should have been kept away even
00:31:25.840they all said today to the judge that they have not read or heard anything about this case. They
00:31:30.500have obeyed the rules and stayed locked in, not hearing outside noise. But come on, this outside
00:31:37.060noise for this case is so obnoxiously loud. It's hard to imagine over the weekend, nothing popped
00:31:44.020up on their phone about this, or they didn't hear something. I mean, it's just, it's tough to
00:31:48.640imagine. I would think they would have to do a new location because the public is so invested
00:31:53.640in this case now, especially in that area. Well, you're exactly right. And, and, you know,
00:32:00.700these questions about, you know, sequestering a jury, it's, it's not like, you know, in, okay,
00:32:06.540say it's the 1990s, right? You know, news comes in through your TV or the newspaper,
00:32:12.620and it's, it's kind of easy to, to block news out. It's kind of easy to block out the world
00:32:17.620as it were, because you don't have notifications popping in on your phone. You don't have people
00:32:22.780sending you text messages that might have links to hopefully human events daily, but we'll see
00:32:28.240what else gets sent in these TikToks and other things. And it unfortunately, we live in a time
00:32:34.480where, look, people in a lot of these high profile cases where where there is a publicly charged
00:32:41.920atmosphere will unfortunately sometimes seep into the jury box where I was tweeting about this
00:32:48.680last night how there was a Black Panther on the O.J. Simpson jury, where a lot of people don't
00:32:53.540realize that, and he raised his fist afterwards when he was walking out of the courthouse.
00:32:57.920And this is the picture of that from one of the docudramas that came out. People don't realize
00:33:02.720there's a Black Panther on the jury. People don't realize there was a Black Lives Matter activist
00:33:06.000on the Derek Chauvin case, a podcaster, like a BLM podcaster, just lied his way onto the jury.
00:33:11.280And this adds real questions as to whether or not these juries can be truthful. And,
00:33:18.120And, you know, honestly, and Lyndon, this is something that came up on one of the live
00:33:22.940streams we were doing yesterday, is it really calls into question the, you know, the efficacy

Oh, so so Charlie was actually the offender and therefore the victim was the person who was targeted by Charlie, who was Tyler Robinson, who climbed on a route.
