00:00:00.000 The Biden administration's racial equity ideology is rooted in a racist lie.
00:00:05.000 The administration continues to declare doom and gloom despite excellent news on the vaccine front, and they continue to lie about the border.
00:00:11.000 I'm Ben Shapiro.
00:00:12.000 This is the Ben Shapiro Show.

00:00:25.000 Well, we begin today with a weird story.
00:00:29.000 Apparently, the Biden's dog Major has been involved in another biting incident.
00:00:34.000 This is according to CNN.
00:00:36.000 And it's funny how they phrase this.
00:00:37.000 He's been involved in another biting incident.
00:00:39.000 I mean, couldn't you say the dog bit somebody?
00:00:42.000 Did Biden bite the dog?
00:00:45.000 Says the Biden's dog Major has been involved in another biting incident that required medical attention.
00:00:50.000 Two people with knowledge of the incident tell CNN.
00:00:53.000 So even when the dog just bites somebody, the Biden administration is like, well, it was involved in a biting incident.
00:00:59.000 Might have to cover this one up.
00:01:01.000 Apparently, Major Biden is a career-biting criminal at this point.
00:01:05.000 Meanwhile, Joe Biden's handlers continue to ensure that he doesn't have to answer any hard questions on anything.
00:01:09.000 Yesterday, he was in the middle of some sort of press session, and his handlers basically were just like, yeah, we're not going to take any more questions anymore.
00:01:16.000 more.
00:01:32.000 People are shouting questions at him.
00:01:34.000 The handlers are trying to rush people out of the room.
00:01:36.000 Yeah, you gotta stop bothering Grandpa.
00:01:38.000 It's time for his meds.
00:01:39.000 It's time for Grandpa's meds.
00:01:40.000 Okay?
00:01:40.000 He needs his time.
00:01:42.000 This is the way that the United States is now run.
00:01:45.000 The top levels of American government are run by people who are completely Non-transparent with you to the point where they will not tell you a full story about a dog biting people.
00:01:56.000 Remember, it took like two weeks to find out that Major Biden had actually bitten someone before Major Biden was shipped off to Delaware.
00:02:01.000 Now Major Biden is back and eventually just starts biting people again.
00:02:04.000 And we still don't know the full story there.
00:02:05.000 Meanwhile, Joe Biden won't answer any questions.
00:02:07.000 All of this is just a mask for a simple fact.
00:02:09.000 When it comes to the Biden administration, the Biden administration is rooted in dishonesty.
00:02:13.000 They're rooted in dishonesty in that they are not transparent with the American people, but they are also rooted in dishonesty because their fundamental ideology is just a dishonest ideology.
00:02:21.000 There's a tweet that came out not from the Biden administration, but is indicative of how the Biden administration thinks about policy.
00:02:27.000 We've talked about the equity ideology of the Biden administration before.
00:02:30.000 They've said over and over and over again that every element of this administration is going to be shot through with equity.
00:02:37.000 And equity, of course, is just a euphemism for racial preference.
00:02:40.000 Because the fact of the matter is that equality is about whether we all are being given access to individual rights protected by government and pre-existing government.
00:02:49.000 That is what equality is about.
00:02:51.000 Equity is about the idea that if two groups have unequal outcomes, this must be because of some systemic prejudice.
00:02:58.000 This must be because of something in the system that is bad.
00:03:00.000 And what this does is it removes individual responsibility.
00:03:03.000 If you live in a free system, And you are given equal rights.
00:03:07.000 Your rights are protected by the government.
00:03:09.000 Like you have the right to life, you have the right to liberty, you have the right to keep and bear arms, you have the right to freedom of the press and freedom of religion.
00:03:15.000 If all those rights are protected, and then you end up unsuccessful in a free country, Then the baseline notion for most rational people would be maybe your personal actions had something to do with your level of unsuccess.
00:03:26.000 Maybe your choices had something to do with where you ended up.
00:03:29.000 But for the left, those choices don't matter at all.
00:03:32.000 Because you have to understand that in Marxist theory, virtually all human choices are shaped by the systems in which we live.
00:03:38.000 That's why Marx suggested that all of the problems in Western society were created by capitalism.
00:03:42.000 All we would have to do is shift the systems in which we live and this would mold a brand new humanity in which everyone would be able to succeed along the lines they saw fit without regard to the kinds of choices they were making.
00:03:54.000 They would simply stop making bad choices because those bad choices are the product of the system.
00:03:58.000 Now, what this does is it removes individual responsibility from people.
00:04:01.000 Now, when you take this to the racial sphere, when you start suggesting that people are not responsible for their individual actions based on race, you sound like a white supremacist.
00:04:09.000 And the fact is that much of the ideology of wokeism, much of the ideology of equity, sounds exactly like the ideology of David Duke.
00:04:17.000 The idea that black people are incapable of making free and independent decisions and therefore any bad decision that is made by black Americans is to be attributed to the system at large.
00:04:27.000 This sounds like a removal of agency from black people that is not only inappropriate, it is racist in and of itself.
00:04:32.000 Because as it turns out, black people are the same as everyone, people of every other color.
00:04:37.000 We are all capable of making individual decisions.
00:04:40.000 And we are all responsible for the individual decisions we make.
00:04:42.000 But the left's equity ideology is rooted in that fundamental lie, which is that certain types of people in America are not responsible for their personal decisions.
00:04:49.000 So Eugene Gu, who is this Stanford trained doctor, and of course was a big He was a big pusher of COVID lockdown, a very woke guy.
00:05:01.000 He tweeted this out the other day, and I thought that this is so indicative of how so much of the left thinks, because it is mainstream left-wing thought at this point.
00:05:09.000 He tweeted out, black on Asian crimes only occur because of our system of white supremacy that strips African Americans of their economic opportunities while taking respect and dignity away from Asian Americans. Also, white people in power are experts at dividing and conquering to stay in power. So presumably he was speaking about this case that we discussed yesterday on the program in New York City, where a man beat the living hell out of an Asian woman on the street.
00:05:35.000 And it turns out that this particular man happened to be a black man.
00:05:39.000 And that, frankly, is not supremely surprising in New York City, because as it turns out, a disproportionate number of people who have been victimizing Asian American people are young black people.
00:05:49.000 So Eugene Gu's solution to this, his explanation of this, is that black people have no agency.
00:05:53.000 Black people are not capable of making decisions, you see.
00:05:56.000 And because black people are not capable of making decisions, all of America's structures must be changed so as to make all outcomes equivalent.
00:06:06.000 Equal rights no longer matter.
00:06:07.000 We're gonna have to make decisions for you.
00:06:08.000 We're gonna have to be paternalistic.
00:06:09.000 We're gonna make decisions for you so that your outcome is equivalent to everybody else's outcome.
00:06:14.000 And if you do something wrong, we're simply going to relieve you of the responsibility.
00:06:18.000 This sounds like David Duke, except in reverse.
00:06:21.000 David Duke says that black people have no agency because black people are inferior.
00:06:24.000 The wokest say black people have no agency because black people are inferior because white people have made them inferior.
00:06:29.000 How about this?
00:06:30.000 Black people aren't inferior.
00:06:32.000 How about black people are just the same as every other individuals in American life.
00:06:36.000 They're just as responsible for their own individual decisions.
00:06:40.000 They are just as capable of success.
00:06:42.000 They are just as capable, as it turns out, of not beating up Asian-Americans on the street.
00:06:45.000 And thus, if an individual person beats up an Asian-American, no matter the race, that person should be held fully responsible for their level of hatred.
00:06:53.000 And by the way, his entire argument, Eugene Goo here, that black foundation crimes only occur because of white supremacy is utterly insane.
00:06:59.000 On its face, it's crazy.
00:07:00.000 It turns out that the man who is busted now for the attack on this Asian-American woman is named Brandon Elliott.
00:07:06.000 He's 38.
00:07:08.000 And it turns out he was arrested in 2002 for the murder of his own mother in the Bronx.
00:07:13.000 And then because of our idiotic criminal justice system, it turns out after you murder mommy, you somehow get out on parole.
00:07:18.000 I don't even know how that's possible.
00:07:19.000 How do you murder your mother?
00:07:21.000 And then you're like, 17 years later, well, I guess, you know, it's been 17 years.
00:07:24.000 I mean, I guess mom is gone for a while.
00:07:29.000 We'll let him back up.
00:07:30.000 Within a year, within a year and a half of him getting out on parole for having murdered his mother, The guy is beating up people on the streets.
00:07:40.000 What exactly does that have to do with white supremacy, exactly?
00:07:43.000 The answer is it has nothing to do with white supremacy.
00:07:46.000 But none of that matters, because people are not responsible for their own decisions so long as they are of particular races in America, particularly victimized races in America historically.
00:07:55.000 We'll get to more of this in just one second, because this is the root lie that lies at the heart of so much of the Biden administration ideology.
00:08:02.000 It is a racist lie about black people being deprived of agency.
00:08:05.000 It's the lie that Robin DiAngelo will tell you.
00:08:07.000 It's the lie that Ibram X. Kendi will tell you.
00:08:09.000 It is the lie that black people are somehow inferior and incapable of making personal decisions.
00:08:12.000 And it's idiotic, it's wrong, it's disgusting, and it is vicious toward black Americans.
00:08:17.000 We'll get to more of this in just one second.

00:09:26.000 Go to PolicyGenius.com to get started.
00:09:29.000 PolicyGenius.
00:09:29.000 When it comes to insurance, it's nice and quite important to get it right.
00:09:33.000 Okay, so.
00:09:34.000 The lie that certain people in America are incapable of personal decision-making.
00:09:39.000 We're not talking about people who have some sort of actual disability.
00:09:42.000 We are talking about simply based on your race, you are incapable of making a decision for which you can be held responsible.
00:09:47.000 This is now implicit in so much of left-wing talking points.
00:09:51.000 The most obvious place in which this is implicit, it's not even implicit, it's almost explicit, is the way the left will talk about voting.
00:09:57.000 So right now, the left's case is that any Republican attempt to create a regimen of voter ID, where we can actually verify where you are from, or to limit, in some way, early voting, this is somehow racist.
00:10:10.000 The idea, implicit here, is that somehow this is going to directly affect black people specifically.
00:10:16.000 Why?
00:10:16.000 Are black people incapable of getting a voter ID?
00:10:17.000 This is ridiculous.
00:10:19.000 It's ridiculous.
00:10:20.000 Are black people incapable of voting on the day of elections?
00:10:23.000 Of course not.
00:10:24.000 What exactly is racist about seeking better voter verification standards?
00:10:29.000 And so, based on this original lie, what you will see piled up are more lies.
00:10:35.000 The original lie is that certain people in America are not capable of making certain decisions, which is not true.
00:10:39.000 And then, rooted in that lie, you'll see lies about the policies that are being promulgated.
00:10:44.000 Stacey Abrams, of course, has been a big proponent of the idea that massive voter suppression is happening across the country.
00:10:49.000 This is simply not the case.
00:10:51.000 There is not massive voter suppression.
00:10:52.000 It's amazing.
00:10:53.000 Throughout 2020, we kept hearing that Donald Trump was saying things that were untrue about voting, about voter fraud and voter irregularity.
00:10:59.000 And I said, OK, well, he has to provide proof of voter fraud and voter irregularity if we are going to believe that.
00:11:05.000 The media agreed.
00:11:06.000 OK, but then the media would say voter suppression is widespread.
00:11:08.000 It's happening across the country.
00:11:09.000 There is no evidence of widespread voter suppression in the United States.
00:11:12.000 This is not a reality.
00:11:14.000 Black Americans overrepresent their percentage of the population in a wide variety of swing states.
00:11:20.000 When it comes to voting.
00:11:22.000 The notion that Georgia was being victimized by voter suppression is a lie.
00:11:26.000 The notion that voter suppression was taking place in 2012 or 2016 or 2020, it's not true.
00:11:33.000 But the media pushed that narrative.
00:11:35.000 Why?
00:11:36.000 Because the idea was that if they didn't get their way, it must be due to America's racist systems.
00:11:40.000 It's always the racist system that is depriving certain individuals of choice, even though in a free country, people are capable of the choice.
00:11:46.000 So you see Stacey Abrams out there suggesting that we're seeing an onslaught on voting in this country, thanks to, for example, Georgia law.
00:11:53.000 So Georgia's new law is not, it is not an onslaught on voting in this country.
00:11:58.000 Georgia's new law is actually more lax on early voting than, say, New Jersey.
00:12:02.000 Georgia's new law does not prevent people from voting.
00:12:05.000 It does not prevent people from drinking water in line.
00:12:08.000 It does not prevent people from being able to obtain a ballot.
00:12:12.000 It doesn't do any of those things.
00:12:14.000 And yet the argument from the left is that it is designed to stop black people from voting because somehow black people are, what, incapable of jumping through the very basic hoop of getting an ID?
00:12:25.000 I don't think so.
00:12:25.000 Here's Stacey Abrams pushing it anyway.
00:12:29.000 To have a say in the direction of our nation, in the direction of our states, and in the direction of our communities.
00:12:35.000 And when democracy is undermined by laws that we have seen pass, not only in Georgia, but in Iowa, and laws that are under consideration in Arizona, in Texas, in New Hampshire, in Florida, in 43 states across this country, we are seeing an onslaught, an attack on democracy.
00:12:54.000 That is a lie.
00:12:55.000 It is not an attack on democracy.
00:12:56.000 It is not an onslaught.
00:12:57.000 These are very simple verification procedures.
00:13:00.000 And Democrats want to undermine all of those.
00:13:02.000 That's what the so-called For the People Act is all about, this H.R.
00:13:05.000 1.
00:13:06.000 It is all about undermining voter verification procedures.
00:13:09.000 Okay, so recognize the actual agenda, which is to loosen voting procedures so that fraud actually becomes more common, and the possibility of fraud becomes more common, and ballot harvesting, which I think is one of the most nefarious things in American voting, becomes the rule of the land.
00:13:20.000 That's the actual goal.
00:13:21.000 But in order to push that goal, they're going to continue to foster the lie that these measures are aimed at stopping black people from voting and or black people are incapable of voting if you put these conditions in place that are equally applicable to everyone.
00:13:34.000 How stupid are these lies?
00:13:35.000 They're so stupid that even the Washington Post, which is a left-wing outlet, is now fact-checking these lies.
00:13:40.000 Joe Biden suggested that the new Georgia law, quote, ends voting hours early, that it suppresses voting.
00:13:46.000 He got four Pinocchios for this because it's not true.
00:13:50.000 On Election Day in Georgia, polling places are open from 7 a.m.
00:13:53.000 to 7 p.m.
00:13:54.000 If you're in line by 7 p.m., you're allowed to cast your ballot.
00:13:56.000 Nothing in the new law changes those rules.
00:13:57.000 That didn't stop Joe Biden from going out there and saying that this initiative is, quote, un-American and sick.
00:14:03.000 He said, quote, deciding that you're going to end voting at five o'clock when working people are just getting off work.
00:14:08.000 Among the outrageous parts of this new state law, it ends voting hours early.
00:14:11.000 OK, none of this is true.
00:14:13.000 It is not true.
00:14:14.000 University of Georgia political scientist Charles Bullock says you can criticize the bill for many things.
00:14:18.000 I don't think you can criticize it for reducing the hours you can vote.
00:14:23.000 So he's just telling things that are openly untrue at this point.
00:14:27.000 The Washington Post tries to make excuses for Biden, but it's a lie anyway.
00:14:31.000 And there's an overall lie.
00:14:33.000 The overall lie, again, is that these voting verification laws are designed to prevent black people from voting.
00:14:38.000 Or that black people are incapable of fulfilling these particular promises.
00:14:42.000 This is not the case.
00:14:44.000 But again, this is the line.
00:14:46.000 We'll get to more on that lie in just one second.
00:14:49.000 First, let's talk about the fact that if you are a solid employer, you're constantly looking to upgrade your employee base.

00:15:57.000 Okay, so how prevalent?
00:15:59.000 Are these lies about Georgia's voting laws, for example?
00:16:02.000 They're so prevalent that Jemele Hill, who somehow continues to fail up.
00:16:05.000 She started off at ESPN, lost her job at ESPN.
00:16:08.000 Now she's over at The Atlantic, which is supposed to be some sort of highfalutin intellectual magazine, which of course it is not.
00:16:15.000 She has a piece titled, Sports Should Boycott Georgia.
00:16:18.000 So now, because she doesn't like the law in Georgia, because it is quote unquote supposedly racist, this means that now all sports should boycott Georgia.
00:16:30.000 The politicization of everything along the basis of these lies is pretty astonishing.
00:16:35.000 It truly is.
00:16:36.000 And the attempt to craft all of American life around the lie that laws that are equal in applicability and do not victimize black Americans, actively victimize black Americans because somehow black Americans are incapable of making basic decisions.
00:16:50.000 That lie is now being embedded in every area of American life.
00:16:54.000 It's being embedded in corporate life.
00:16:55.000 It's being embedded in sports.
00:16:57.000 It's being embedded in government.
00:16:58.000 It's being embedded in Hollywood.
00:17:00.000 It's all embedded.
00:17:01.000 People are not responsible for their own decisions because America is such a terrible racist place.
00:17:06.000 So Jamel Hills says that she now wants sports organizations to boycott the state of Georgia.
00:17:10.000 She says, in the past, major sports organizations have forced other states to reconsider infringements on their citizens' rights.
00:17:15.000 And that kind of pressure is sorely needed in Georgia now.
00:17:18.000 Last week, Georgia's Republican Governor Brian Kemp signed an election bill Joe Biden has described as Jim Crow in the 21st century, which shows you what an insane lie that is.
00:17:26.000 Jim Crow explicitly created a separate system of law for black Americans and treated them as inferior.
00:17:32.000 There's nothing in the law like that.
00:17:34.000 That's not only an overstatement, it's just an outright lie.
00:17:37.000 But, says Jamel Hill, all of corporate America should resonate to the lie.
00:17:41.000 The law imposes new voter identification requirements for absentee ballots.
00:17:44.000 Well, clearly that's racist.
00:17:45.000 I mean, you mean you have to show that you are who you say you are when you vote absentee?
00:17:49.000 If you can explain to me how that's racist, I'm willing to hear it.
00:17:52.000 Anyone?
00:17:53.000 Bueller?
00:17:54.000 Bueller?
00:17:55.000 It limits the use of ballot drop boxes.
00:17:57.000 Oh, you mean like ballot drop boxes where people could just stuff the ballot box or take ballots out of the ballot box?
00:18:02.000 Hmm.
00:18:04.000 It hands its state officials more power over local elections.
00:18:07.000 Even before the legislation passed, many voters of color in Georgia faced hours-long queues at the polls.
00:18:11.000 By the way, voter suppression doesn't involve long lines.
00:18:16.000 Any more than long lines at Disneyland are ride suppression.
00:18:19.000 You know what voter suppression is?
00:18:20.000 Voter suppression is where you don't get to vote.
00:18:23.000 Making those weights even more arduous, the new law bans giving food and water to people in line to vote.
00:18:27.000 That's not even true.
00:18:29.000 It bans giving any gift to people in line when they are within 150 feet of the polling place.
00:18:34.000 You can bring water with you.
00:18:35.000 There are people outside who can give you water.
00:18:37.000 This is just not true.
00:18:39.000 So again, the root lie here is the one that is being pushed forward.
00:18:44.000 That's being pushed forward in every area of American life.
00:18:46.000 People are not responsible for their own actions, whether we are talking criminal behavior or whether we are talking about voting law.
00:18:52.000 People are not responsible for their own behavior so long as we can continue to forward the narrative that America is deeply racist.
00:18:56.000 This is how you end up with New York officials, for example, talking about that Asian-American woman being beaten in New York City.
00:19:02.000 We've already heard Eugene Gu blame that on white supremacy.
00:19:04.000 Here's a New York state official on Asian-American woman being beaten saying this came from Trump.
00:19:08.000 Somehow this is Trump's fault.
00:19:11.000 Asian Americans across the United States have been sounding the alarm about hate for years.
00:19:15.000 These are not new attacks, but the incidents are unrelating.
00:19:19.000 This came from Trump, that's my opinion, but it's been around.
00:19:24.000 He used the world's largest bully ford to spread racism, but he's not the only one.
00:19:33.000 And every single assault that goes unfettered, every time a door closes to a victim on the ground, it emboldens these horrible people who target Asian Americans.
00:19:45.000 Okay, that would be the borough president of Manhattan, Gail Brewer, blaming Trump for a murderer who got out on parole beating up an Asian-American woman because people don't have any agency, you see.
00:19:58.000 Agency just does not exist.
00:20:00.000 There is no agency at all.
00:20:02.000 All of this is super ugly, but again, so much of our politics is rooted in lies, and this is just another example of politics rooted in lies.
00:20:10.000 By the way, more of this politics rooted in lies When it comes to the attempt to paint America as racist and thereby to say that all non-equal outcome is due to America's white supremacy, you can see this in the Chauvin trial.
00:20:23.000 So the case that is currently being made is that if Derek Chauvin is acquitted on these murder charges.
00:20:27.000 That's because of deep and abiding American racism.
00:20:30.000 As we'll get to in a second, that is just not the case.
00:20:33.000 It's just not the case.
00:20:34.000 We'll get to that in one second.

00:21:24.000 Very often they will think, okay, well, you know what?

00:21:49.000 OK, so the case that is that is now being made again is that everything in America that we don't like is due to the systemic racism of the United States and is a data point in favor of the idea that America is systemically racist.
00:22:01.000 The latest case that's being used on this basis, of course, is the Derek Chauvin case.
00:22:06.000 This is why you see Dan Jones making the case that if there is no conviction, it is open season for cops.
00:22:13.000 Dan Jones says that if we don't convict Derek Chauvin, then cops will be able to get away with murder in broad daylight.
00:22:20.000 No, that is not what that means.
00:22:22.000 That is not what that means.
00:22:23.000 You see Jonathan Capehart saying the exact same thing.
00:22:25.000 Jonathan Capehart of the Washington Post.
00:22:27.000 Here he is making the case that he is ready for not guilty because America is racist.
00:22:31.000 Not because of the details of the case.
00:22:32.000 You don't need the details of the case.
00:22:33.000 That's irrelevant.
00:22:34.000 He's ready for not guilty because of America's history.
00:22:36.000 Everything is just evidence of American racism.
00:22:40.000 I am already prepared for a not guilty verdict.
00:22:45.000 And I, and I, you know, I hesitate to say that, but just given, given the history of this country and the history of these situations, I have to intellectually and emotionally prepare myself for that.
00:23:01.000 Okay, meanwhile, Chelsea Handler, again another member of the left, she says we shouldn't even have trials in cases like this one.
00:23:07.000 The narrative is so strong, you don't even need a trial.
00:23:10.000 Due process goes away.
00:23:11.000 So Chelsea Handler, genius that she is, she tweeted out, so pathetic that there is a trial to prove that Derek Chauvin killed George Floyd when there is video of him doing so.
00:23:18.000 Oh, that makes sense.
00:23:21.000 We shouldn't have trials anymore.
00:23:23.000 We'll just go straight to the conviction.
00:23:23.000 No more due process.
00:23:25.000 Because, after all, who needs due process when you have the narrative?
00:23:28.000 Now, here's the reality, as I've been mentioning about this case.
00:23:30.000 This is a heavy lift for prosecution.
00:23:33.000 And this is not an easy case for the prosecution.
00:23:36.000 And she doubled down on that, by the way.
00:23:37.000 She said, perhaps we skip trials when there's audio and video footage of the murder.
00:23:40.000 But there are several issues that still have to be adjudicated here.
00:23:43.000 So, for example, The prosecution has to show beyond a reasonable doubt, not by preponderance of the evidence, beyond a reasonable doubt, that Floyd's death was caused by Derek Chauvin's actions.
00:23:54.000 But the autopsy report shows that Floyd was high on fentanyl and meth at the time and had a serious heart problem, and shows that Chauvin's neck hold didn't in fact cause damage to Floyd's trachea, which means he didn't damage his airway.
00:24:05.000 Which means that while Chauvin's neck restraint could have contributed to Floyd's death by ratcheting up his blood pressure, for example, it's uncertain that it caused Floyd's death more than, say, the arrest in the first place, the excited delirium that Floyd was pretty obviously in before he was even on the ground.
00:24:19.000 That's before we even get to the charges, right?
00:24:21.000 That's just the basic causation issue.
00:24:23.000 In order to charge him with manslaughter or murder, you have to show that his actions led to Floyd's death.
00:24:27.000 And it can't just be but-for causation, right?
00:24:30.000 But-for Chauvin being there doing that, he would have lived.
00:24:33.000 It has to be that his actions actually caused the death.
00:24:35.000 There's a pretty strong medical case that that may not in fact be the case.
00:24:39.000 In a second, I'm going to explain the actual charges.
00:24:42.000 Again, the narrative here is that America is racist and anything that we don't like is due to American racism.
00:24:49.000 And this is just another example of that.
00:24:51.000 But there are very specific questions that are asked in court on these sorts of issues.
00:24:55.000 So let's talk about the charges for a moment.
00:24:58.000 There are three charges that are being brought against Derek Chauvin.
00:25:00.000 One, second degree murder.
00:25:01.000 Two, third degree murder.
00:25:02.000 And three, second degree manslaughter.
00:25:05.000 Second-degree murder is a fairly heavy lift.
00:25:09.000 It requires that the prosecution prove beyond a reasonable doubt that Chalvin unintentionally killed Floyd while intentionally committing a felony.
00:25:17.000 So the question is, did he intentionally commit a felony?
00:25:19.000 Did he believe that he was committing felony assault on George Floyd when he was holding him in a Minneapolis Police Department-approved neck hold, by the way, for 8 minutes and 46 seconds while a crowd of onlookers was yelling at him?
00:25:35.000 Now, again, it's not just, do you believe that that's true or not?
00:25:38.000 The question is, do you believe it beyond a reasonable doubt?
00:25:41.000 Reasonable doubt is a very high standard of proof.
00:25:44.000 So, a jury could easily find that this is not beyond a reasonable doubt.
00:25:48.000 Felony assault requires intentional infliction of bodily harm.
00:25:51.000 That Chalvin wanted to hurt Floyd, not just use a suppression tactic that's already been greenlit by the Minneapolis Police Department.
00:25:57.000 Is there evidence that he actively wanted to hurt Floyd there?
00:26:00.000 Or is there evidence that he was negligent?
00:26:02.000 And we'll get to negligence in a second.
00:26:04.000 Because that brings us to the manslaughter case.
00:26:05.000 Third-degree murder.
00:26:07.000 Depraved heart murder.
00:26:08.000 That one doesn't really seem to hold.
00:26:10.000 Because depraved heart murder, the legal definition, requires that you acted in a way, quote, Others, plural.
00:26:18.000 So usually, depraved heart murder is a drug dealer distributing drugs that are tainted in some way such that they will kill people.
00:26:25.000 And you distribute them to a number of people, and you know somebody's gonna die.
00:26:27.000 You didn't have specific intent to kill one direct person, but you knew that there was a good shot that somebody was going to die.
00:26:32.000 You fire a gun into a crowd.
00:26:34.000 You drop a brick off a freeway overpass onto the cars below, right?
00:26:37.000 That sort of stuff is depraved heart murder.
00:26:39.000 This has a specific alleged victim, and that means that you are really not looking at a depraved heart murder.
00:26:44.000 So third degree really shouldn't even apply.
00:26:46.000 In fact, a higher court at one point had thrown, actually the trial court originally threw out the third degree murder charge, and then it was reinstated by a higher court.
00:26:55.000 And finally, there's second degree manslaughter.
00:26:56.000 And this is the one that it is most likely that Chauvin is convicted on.
00:26:59.000 But if he's convicted of manslaughter and not of murder, do you think Jonathan Capehart is going to re-evaluate his belief in the racism of the American system?
00:27:06.000 I don't, by the way, even if Chauvin is convicted, do you think Jonathan Capehart and Van Jones are going to re-evaluate their beliefs about the racism of the American system?
00:27:14.000 Of course not.
00:27:15.000 Because it is a premise that must never be challenged.
00:27:17.000 The racism of the American system.
00:27:19.000 Because so long as there is disparate outcome, it must be the system.
00:27:24.000 And here's the thing, there will always be disparate outcomes so long as people make disparate actions.
00:27:28.000 And so that second degree manslaughter charge in the Chauvin case, it requires the prosecution prove that Chauvin acted with gross negligence.
00:27:35.000 But gross negligence would have to show that Chauvin should have known his behavior might cause Floyd's death.
00:27:41.000 And that's a hard case to prove.
00:27:44.000 Like, why would he think that that would cause Floyd's death?
00:27:48.000 To put him in a neck hold?
00:27:50.000 That is a basic suppression hold, again, approved by the Minneapolis Police Department.
00:27:53.000 You have to prove that he intended to do that.
00:27:55.000 That at the very least, he was negligent in that he knew that what he was doing could cause somebody's death.
00:28:00.000 Well, barring Floyd's underlying conditions, That really shouldn't cause your death, right?
00:28:06.000 If you don't have a serious cardiopulmonary issue to begin with, plus meth in your blood, plus fentanyl in your blood, makes it real difficult.
00:28:13.000 So here's the thing.
00:28:14.000 Chauvin could easily be convicted.
00:28:16.000 There is certainly a case for Chauvin to be convicted on second degree manslaughter lines.
00:28:19.000 Andy McCarthy has made that case over at National Review.
00:28:21.000 But if he is acquitted, that's not because of the racism of the American system.
00:28:25.000 That's because due process of law requires a very strong showing of evidence and proof.
00:28:30.000 But all the media are going to show is all the inflammatory stuff from the trial.
00:28:33.000 The media are going to pretend like any defense of Derek Chauvin by his own defense team is somehow racist in and of itself.
00:28:40.000 All they're going to show is the witnesses to what was obviously a tragedy at the very least, speaking emotionally about the issue.
00:28:50.000 So for example, one of the witnesses yesterday called the cops animals on the stand, which raised an objection.
00:28:55.000 Here's what that sounded like.
00:28:57.000 When you were watching this interaction between these three Minneapolis, four Minneapolis police officers and Mr. Floyd, were you watching a cage match at the time?
00:29:08.000 Well, I only seen two of them, the animals.
00:29:11.000 So I was watching more of a humane show.
00:29:16.000 Objection.
00:29:16.000 Okay.
00:29:17.000 What's his name?
00:29:18.000 Ken.
00:29:19.000 Ken.
00:29:20.000 Sorry about OCR.
00:29:21.000 That's okay.
00:29:22.000 Okay.
00:29:23.000 Okay.
00:29:24.000 And he suggested that he was watching a humane bleep show.
00:29:29.000 Humane bleep show.
00:29:31.000 And he said, I was not watching a sport.
00:29:34.000 Okay, all this sort of testimony is provocative, but it really is not probative.
00:29:38.000 Probative means it doesn't actually contribute to whether there's guilt here or not, right?
00:29:42.000 It doesn't go to the underlying fact pattern.
00:29:45.000 But most of the testimony that's going to be shown on late night TV and throughout the day on your 24-hour news networks is going to be the witnesses saying that they stayed up nights, for example.
00:29:53.000 That was one of the witnesses said yesterday.
00:29:56.000 It's been nights.
00:29:57.000 I stayed up apologizing and apologizing to George Floyd for not doing more and not physically interacting and Not saving his life, but it's like, it's not what I should have done.
00:30:21.000 It's what he should have done.
00:30:24.000 Okay, so, you know, obviously this sort of stuff, it would be heart-wrenching, it would be terrifying, it would be terrible, but that doesn't go to the probative value here.
00:30:31.000 What you're going to see is the most evocative emotional testimony.
00:30:34.000 You're not going to see any of the underlying fact pattern presented on national TV, because that might actually undercut the narrative that this is a straightforward case with an easy solution.
00:30:42.000 Okay, meanwhile, speaking of lies that are being told, the media continue to simply just tell lies at this point about A wide variety of topics surrounding COVID-19.
00:30:52.000 So for example, they continue to trot out the lie that Ron DeSantis lied about COVID numbers.
00:30:58.000 The people who are pushing that lie, people at the New York Times, people at Yahoo News, they are completely misreading the study upon which they are basing their coverage.
00:31:06.000 Alexander Nazarian The reporter for Yahoo News is one of the great promulgators of this.
00:31:11.000 He has a piece today.
00:31:12.000 It says, So the idea is that some 5,000 people died of COVID, and that was not reported properly.
00:31:14.000 Journal of Public Health argues Florida is undercounting the number of people who died from COVID-19 by thousands of cases, casting new doubt on claims Governor DeSantis navigated the coronavirus pandemic successfully.
00:31:24.000 So the idea is that some 5,000 people died of COVID and that was not reported properly.
00:31:29.000 But that is not correct.
00:31:31.000 That is not actually right.
00:31:32.000 In fact, the notion that COVID-19 is responsible for all or most of these excess deaths is in question.
00:31:39.000 A lot of people died in excess because they stayed at home for other reasons.
00:31:43.000 They had a heart attack at home, for example.
00:31:45.000 In fact, the number of excess deaths, state by state, not reported as COVID, is fairly consistent across the states.
00:31:52.000 Lauren Rawson, statistician at the National Center for Health Statistics at the Centers for Disease Control and Prevention, who's analyzed excess deaths, told Yahoo News she saw nothing exceptionally suspicious in the state's excess death numbers.
00:32:02.000 Said Florida doesn't stand out to me.
00:32:05.000 Other critics describe Florida as neither a glowing success nor an unmitigated disaster, but rather a state that has handled the pandemic with some successes and some failures.
00:32:12.000 But they are trying to manufacture a headline suggesting that Ron DeSantis openly lied about the numbers of COVID deaths the way that Andrew Cuomo lied about the number of people who died in nursing homes.
00:32:20.000 That isn't true.
00:32:22.000 That isn't true.
00:32:23.000 But the media are pushing untruths about COVID.
00:32:26.000 Throughout, they've been pushing untruths about COVID for a long time, and now they're pushing untruths about the direness of the situation and the number of people who have died in red states, for example, of COVID.
00:32:36.000 The Biden administration is pushing obvious lies now about the situation regarding COVID.
00:32:41.000 The reality of the situation in the United States is that COVID is on the wane.
00:32:45.000 We all know that COVID is on the wane.
00:32:47.000 COVID is on the wane because the vaccinations are very high and because it has already burned its way through most major parts of the United States.
00:32:54.000 I'm looking at the COVID numbers today in the United States.
00:32:57.000 There has not been a significant escalation in the daily new cases of COVID nationwide since approximately, let's see, February 23rd.
00:33:07.000 It's been stable since then.
00:33:08.000 So today there are about 62,000 new cases of COVID diagnosed in the United States.
00:33:13.000 At the height, there were something like 266,000 new cases of COVID diagnosed like January 6th.
00:33:18.000 300,000 cases diagnosed January 8th.
00:33:24.000 We are at the lowest levels that we have been at of new COVID diagnoses in the United States since essentially October.
00:33:31.000 And by the way, the levels of increase are completely stagnant.
00:33:35.000 There is no national level of increase.
00:33:37.000 It's increasing in certain areas.
00:33:38.000 It is not increasing nationally.
00:33:40.000 The number of active cases in the United States has actually been declining since approximately the middle of January, the end of January, according to worldometers.com.
00:33:49.000 And yet we are being told that we're still in the middle of a crisis because the more the Biden administration can push the idea there's a crisis, the more they can push forward spending plans, the more they can push forward all of their big government rejiggering of the economy, the more they can push forward the idea of vaccine passports.
00:34:02.000 And the thing about vaccine passports, they're relatively unnecessary when the pandemic is over.
00:34:07.000 You don't need them once the pandemic is over.
00:34:10.000 And these vaccines are so unbelievably effective.
00:34:11.000 I mean, they're miraculously effective.
00:34:13.000 They're so unbelievably effective.
00:34:15.000 That, particularly if you've already been vaccinated, you really do not have to worry at that point.
00:34:20.000 As Dr. Marty Makary of Johns Hopkins University said, once you're a month out from your first vaccine and two weeks out from your final vaccine, go about your daily life, you're fine.
00:34:29.000 Meanwhile, the Biden administration continues to push panic.
00:34:32.000 That is a lie.
00:34:32.000 Again, it's dishonesty all the way up and down.
00:34:35.000 Policy after policy, it's dishonesty.
00:34:36.000 The root ideology of the administration is a lie.
00:34:39.000 The equity lie.
00:34:40.000 But it's not just that lie.
00:34:41.000 They're telling lies about COVID in order to achieve their purposes.
00:34:43.000 They're telling lies about the border in order to achieve their purpose.
00:34:46.000 We'll get to more of that in just one second.

00:34:56.000 Like, you don't know anything about HR.
00:34:57.000 Then you start running a business and you realize you can run really fast into a lot of liability if you haven't taken care of your HR issues.
00:35:03.000 Wrongful termination suits, minimum wage requirements, labor regulations.
00:35:06.000 HR manager salaries are not cheap.

00:37:00.000 So the Biden lies are not relegated to the area of race or voting policy.
00:37:11.000 They are also just absolutely evident in pretty much every area of the Biden administration policy.
00:37:17.000 So for example, on COVID.
00:37:18.000 So the reality is that we are on the way when it comes to COVID.
00:37:21.000 And yet we have Rochelle Walensky, the head of the CSE, warning of the CDC, warning of doom!
00:37:26.000 Now here's the weird thing.
00:37:29.000 Walensky also acknowledges that, by the way, we are doing a good job vaccinating, and not only are we doing a good job vaccinating across the country, once you're vaccinated, you're done.
00:37:38.000 Once you're vaccinated, we're not worried about you carrying the virus.
00:37:41.000 This thing has an extraordinarily high success rate, particularly the Pfizer and Moderna vaccines have like well over a 90% success rate when it comes to preventing serious disease and like a 99% success rate in preventing death.
00:37:54.000 Here's Walensky saying two things that make no sense back to back.
00:37:57.000 She said yesterday that their data suggests the vaccinated don't carry the virus.
00:38:01.000 That's kind of good news because we were told you have to wear a mask forever.
00:38:04.000 Here she was basically explaining that you don't have to wear a mask forever once you're vaccinated.
00:38:08.000 We can kind of almost see the end.
00:38:10.000 We're vaccinating so very fast.
00:38:13.000 Our data from the CDC today suggests, you know, that vaccinated people do not carry the virus, don't get sick, and that it's not just in the clinical trials, but it's also in real-world data.
00:38:27.000 Okay, so, that's good news, right?
00:38:29.000 Literally the day before, she was warning of DOOM!
00:38:33.000 There she was.
00:38:35.000 And I'm going to reflect on the recurring feeling I have of impending doom.
00:38:39.000 We have so much to look forward to, so much promise and potential of where we are, and so much reason for hope.
00:38:47.000 But right now I'm scared.
00:38:48.000 So I'm speaking today not necessarily as your CDC director, not only as your CDC director, but as a wife, as a mother, as a daughter, to ask you to just please hold on a little while longer.
00:39:01.000 I so badly want to be done.
00:39:03.000 I know you all so badly want to be done.
00:39:05.000 We are just almost there, but not quite yet.
00:39:09.000 Okay, they just want control.
00:39:11.000 She's saying, once you're vaccinated, you're good to go.
00:39:14.000 And you still got Joe Biden out there being like, you wear a mask, guys, wear a mask.
00:39:21.000 Here he was a couple of days ago talking about how it's patriotic to mask.
00:39:25.000 Even after you're vaccinated, apparently, you should still keep masking for no reason at all.
00:39:28.000 Here's Joe Biden pushing it.
00:39:30.000 Each of us has to do our part.
00:39:31.000 We have an obligation, a patriotic obligation.
00:39:35.000 Wash your hands.
00:39:37.000 Stay socially distanced.
00:39:40.000 Wear a mask as recommended by the CDC.
00:39:44.000 And get vaccinated.
00:39:45.000 As I do my part to accelerate the vaccine distribution and vaccinations, I need the American people to do their part as well.
00:39:53.000 Mask up.
00:39:55.000 Mask up.
00:39:56.000 It's a patriotic duty.
00:39:58.000 It's the only way we ever get back to normal.
00:40:04.000 Okay, that was true like a year ago.
00:40:06.000 Now with the vaccines, that is not true.
00:40:09.000 You know what would be useful?
00:40:11.000 What would be useful is for Biden to take off his mask at this point.
00:40:11.000 Honest to God.
00:40:14.000 He's been vaccinated.
00:40:15.000 For him to say, listen, you want to get back to regular life with no mask?
00:40:19.000 Take off the mask if you're vaccinated.
00:40:21.000 If you're not vaccinated, you should wear a mask because you can still transmit the disease and receive the disease.
00:40:25.000 But once you're vaccinated, you're good to go.
00:40:27.000 But he's not doing that.
00:40:28.000 It's all confused messaging out of the White House.
00:40:30.000 In fact, Biden is now saying he wants states to reinstate their mask mandates.
00:40:34.000 Okay, and those mask mandates are going to apply to people whether they are vaccinated or not.
00:40:38.000 Which again, makes no scientific sense.
00:40:40.000 Here was Joe Biden pushing states to reinstate mask mandates, which by the way, weren't effective in the first place.
00:40:43.000 I'll show you in a second.
00:40:45.000 I'm reiterating my call for every governor, mayor, and local leader to maintain and reinstate the mask mandate.
00:40:52.000 Please, this is not politics.
00:40:56.000 Reinstate the mandate if you let it down.
00:40:59.000 And businesses require masks as well.
00:41:02.000 The failure to take this virus seriously, precisely what got us in this mess in the first place, risks more cases and more deaths.
00:41:14.000 I mean, you don't want to risk more desks, guys.
00:41:16.000 Desks are very, very, very dangerous, according to Joe Biden.
00:41:18.000 That guy is not with it.
00:41:19.000 Hey, by the way, remember that time that Joe Biden suggested that if you didn't want a mask mandate, it's because you were a Neanderthal?
00:41:24.000 So Texas got rid of its mask mandate.
00:41:26.000 Florida hasn't had a statewide mask mandate ever.
00:41:29.000 And those are not the states where this stuff is surging.
00:41:32.000 Here is a chart from yesterday that demonstrates the difference between the so-called Neanderthal states and the science states.
00:41:39.000 So this would be Mississippi and Texas lifting their masks.
00:41:43.000 The ones that are Neanderthal thinking.
00:41:45.000 What you have seen is a radical decrease in new cases diagnosed per day beginning just a few weeks ago.
00:41:52.000 In fact, right after they lifted their mask mandate, look at that!
00:41:55.000 Boom!
00:41:56.000 And then, there's the science state.
00:41:56.000 It drops.
00:41:59.000 Michigan, New Jersey, New York, they have statewide mask mandates.
00:42:01.000 And, um, they've increased their rates.
00:42:04.000 So those mask mandates, not useful.
00:42:06.000 Meanwhile, Anthony Fauci continues to tell parents their kids shouldn't play together without masks.
00:42:06.000 Not useful.
00:42:11.000 This has been stupid for a long time.
00:42:14.000 Three-year-olds playing together at the park is not the risk of COVID.
00:42:17.000 That is not the risk of COVID.
00:42:18.000 Kids have not been spreading this thing at the same rate as adults.
00:42:21.000 Even when kids do spread it, apparently the disease does not have as serious an impact as before.
00:42:28.000 The goal here is to just to prolong this thing.
00:42:30.000 It's pretty obviously from the Biden administration just to prolong this thing.
00:42:33.000 We are at the very end of this.
00:42:34.000 We all know it.
00:42:35.000 The economy is back open.
00:42:36.000 Flights are like 90% full at this point.
00:42:39.000 We're back in the swingin' mode.
00:42:40.000 But Joe Biden wants another $2 trillion infrastructure package.
00:42:43.000 And so baby, baby's gotta, baby's gotta pay the rent somehow.
00:42:46.000 And the way baby's gonna pay the rent is by telling you that COVID is never going to end.
00:42:49.000 Here's Anthony Fauci warning parents about kids playing together without masks.
00:42:53.000 The children can clearly wind up getting infected.
00:42:56.000 When we talk about what you can do when you're vaccinated, you can certainly have members of a family, if the adults are vaccinated, and you're in the home with your child, you don't need to wear a mask and you can have physical contact.
00:43:09.000 When the children go out into the community, you want them to continue to wear masks when they're interacting with groups from multiple households.
00:43:19.000 Again, the notion that small children are a vector for transmission here is completely unproven at this point.
00:43:25.000 Like, really, really unproven.
00:43:27.000 But, again, everything's hilarious to the Biden administration.
00:43:30.000 Truth has no part of this.
00:43:31.000 Kamala Harris openly laughs now.
00:43:33.000 The joker laugh is becoming more and more a dominant part of her personality.
00:43:38.000 It's very weird.
00:43:39.000 She was discussing in a speech the other day, parents being unable to send their kids to school in the middle of the pandemic, and she just started laughing about it.
00:43:47.000 I mean, this really is like Joaquin Phoenix, pathological, can't-help-the-laughter stuff.
00:43:51.000 Here's Kamala Harris, the Vice President of the United States, apparently suffering from the same condition as Joaquin Phoenix's Joker.
00:43:58.000 Very weird stuff.
00:44:00.000 More people are seeing that, yeah, affordable childcare is a big deal.
00:44:10.000 more parents are seeing the value of educators when they had to bring in kids and say we're not paying them nearly enough.
00:44:20.000 Did somebody say something funny? Like I don't...
00:44:35.000 Honestly, I don't understand what's going on.
00:44:36.000 What is going on?
00:44:37.000 We have a leader of the free world who is not a sentient human, and his vice president is a person who breaks into cackling bouts of laughter for no reason at all.
00:44:46.000 And these are the people you want to give more power?
00:44:48.000 These morons?
00:44:49.000 These people?
00:44:50.000 What?
00:44:51.000 Why?
00:44:51.000 What?
00:44:52.000 Why would you give them the power to spend trillions of your dollars?
00:44:54.000 Those dollars aren't coming from nowhere.
00:44:55.000 They're coming from you, in the future.
00:44:58.000 Why would you do that?
00:44:59.000 Like, what are you doing?
00:45:01.000 This is crazy!
00:45:02.000 You've got a bunch of morons in charge that give these people more power.
00:45:06.000 They're telling you lies day after day after day.
00:45:08.000 Your media are facilitating those lies day after day after day.
00:45:10.000 The same people who are saying follow the science, by the way.
00:45:12.000 I would be remiss if I didn't note this, okay?
00:45:14.000 The same people in the media who are saying, follow Tuh-science.
00:45:17.000 Not the science, Tuh-science.
00:45:19.000 Tuh-science is politics masquerading in science.
00:45:21.000 Follow Tuh-science.
00:45:22.000 Here is a paragraph from CNN.
00:45:23.000 I'm not, I have to read this verbatim.
00:45:25.000 You ready?
00:45:26.000 This is about these bills that prevent biological men from competing with biological women in sports.
00:45:33.000 That's what these bills do.
00:45:34.000 Here is CNN, the most trusted name in news, with James Earl Jones' voice.
00:45:40.000 Quote, it's not possible to know a person's gender identity at birth, and there is no consensus criteria for assigning sex at birth.
00:45:48.000 Does that sound like science to you?
00:45:55.000 Does it?
00:45:58.000 What?
00:45:59.000 What?
00:46:00.000 There is no consensus criteria for assigning sex at birth.
00:46:05.000 I can think of a few of them, like consensus criteria.
00:46:08.000 In fact, medical professionals do it all the time.
00:46:10.000 In fact, small children do it all the time.
00:46:12.000 Believe it or not, my four-year-old son, he can, with like 98% accuracy, identify the sex of the people he is talking to.
00:46:18.000 It's amazing!
00:46:19.000 Like, either he's clairvoyant or there are objective identifiers of sex.
00:46:24.000 It's incredible!
00:46:25.000 But this is CNN.
00:46:26.000 That is just dropped right into a story without even like a quote-unquote experts say.
00:46:31.000 It's just unreal.
00:46:32.000 These are the people you should trust with the science.
00:46:34.000 They're 100% trustworthy.
00:46:36.000 On every level, they're 100% trustworthy.
00:46:39.000 And by the way, they're trustworthy on the border as well, where apparently, according to one border patrol agent, we are now at over 700% of our capacity.
00:46:47.000 The border is being completely overridden.
00:46:50.000 And it overrun.
00:46:51.000 The good news is that our Democratic friends just continue to lie about it.
00:46:54.000 That's exciting stuff.
00:46:56.000 Alexandra Ocasio-Cortez said today, she finally commented on the border situation, like she finally did it.
00:47:01.000 And you know what she said?
00:47:02.000 She said, quote, this is not a surge.
00:47:05.000 These are children and they are not insurgents.
00:47:08.000 Yes, that was the take from AOC.
00:47:10.000 That it's not a surge because they're not insurgents, despite the fact that that doesn't have to do with anything.
00:47:17.000 Yep, the dishonesty, the dishonesty.
00:47:18.000 But definitely trust them.
00:47:19.000 Definitely trust these people with your life, your future, your family.
00:47:22.000 They know better than you.
00:47:23.000 Probably should give them more power.
00:47:24.000 Alrighty, we'll be back here later today with additional hours of The Ben Shapiro Show.
00:47:28.000 This week, Michael Mowles will be guest hosting.
