The Ben Shapiro Show - Republicans POUNCE! | Ep. 701

00:00:00.000 The media settle on a backup narrative after their Covington hit goes awry, Mitch McConnell takes steps to end the government shutdown, and the millennial fresh faces arrive on the scene!

00:00:09.000 Yay! 0.99

00:00:09.000 I'm Ben Shapiro. 0.99

00:01:44.000 I've been using Ring myself for years, and there's a reason for that.

00:01:48.000 Ring.com slash Ben.

00:01:49.000 Go check them out right now.

00:01:51.000 Okay, so...

00:01:52.000 The Covington story, the Covington Catholic High School story that blew up the media over the weekend has completely imploded in on the media because it turns out that these kids from Covington Catholic High School really didn't do anything wrong.

00:02:03.000 There's not a lot of evidence they did anything wrong.

00:02:05.000 They were standing there, to recap the story, they were standing there after the March for Life, some of them were wearing MAGA hats, which apparently is now a crime in the United States, and we're supposed to know that MAGA hats are innately offensive and triggering to people, the MAGA hats.

00:02:18.000 Ooh, triggering.

00:02:20.000 And they were standing there, after the March for Life, and they started being harassed by the black Hebrew Israelites, a bunch of cult members, who are mostly known for being ignored on the New York subways.

00:02:28.000 And then, a Native American guy walked up into the middle of the group, banging a drum, stood face-to-face with a guy named Nick Sandman, who's apparently 17 years old, goes to Covington Catholic High, and Nick Sandman just stood there, kind of awkwardly, And this was enough cause for people to lose their ever-loving minds.

00:02:44.000 Well, Nick Sandman appeared on the Today Show this morning with Savannah Guthrie.

00:02:47.000 It is amazing to watch the media attempt to twist their way out of this by trying to cast aspersions on the 17-year-olds whose great sin was standing there on his feet in a public place at one of the most visited places in America, not moving, with a mild smile on his face, trying to diffuse the situation.

00:03:03.000 He's the bad guy.

00:03:04.000 Why? 0.97

00:03:04.000 Because one, he wore a MAGA hat, and two, because he's a white religious kid. 0.97

00:03:08.000 So here's Savannah Guthrie trying to make that case. 1.00

00:03:10.000 Do you feel from this experience that you owe anybody an apology?

00:03:16.000 Do you see your own fault in any way?

00:03:22.000 As far as standing there, I had every right to do so.

00:03:29.000 My position is that I was not disrespectful to Mr. Phillips.

00:03:33.000 I respect him.

00:03:34.000 I'd like to talk to him.

00:03:36.000 I mean, in hindsight, I wish we could have walked away and avoided the whole thing.

00:03:41.000 Okay, this is insanity.

00:03:42.000 This is insanity.

00:03:43.000 Sandman is obviously scared, right?

00:03:45.000 He's obviously a little bit deer-in-the-headlights right there because he's got the entire national news media on his case, in his face, specifically because he committed the grave, terrible sin of standing in a place, not doing a thing.

00:04:00.000 And then it continued along these lines, this Today Show interview.

00:04:04.000 You know, she was asked, he was asked then about wearing a MAGA hat.

00:04:07.000 This is clip 13.

00:04:08.000 He was asked specifically about wearing a MAGA hat, right?

00:04:11.000 Maybe that was the problem.

00:04:12.000 The problem wasn't that he was standing there doing nothing.

00:04:14.000 The problem is that he was wearing a hat.

00:04:16.000 And that hat makes people angry.

00:04:18.000 And because he was wearing an angry-making hat, a hat that makes folks lose their minds, probably it's his fault because he was wearing the hat.

00:04:25.000 Bad, bad kid wearing a hat.

00:04:27.000 You know, you gotta be careful of the hats you wear.

00:04:28.000 That, that red, that red hat's basically like a KKK hood.

00:04:31.000 Except that it's not.

00:04:32.000 In any way.

00:04:33.000 Here's Savannah Guthrie trying to make that point. 1.00

00:04:35.000 You think if you weren't wearing that hat, this might not have happened or it might have been different?

00:04:42.000 That's possible, but I would have to assume what Mr. Phillips was thinking, and I'd rather let him speak for why he came up to us.

00:04:50.000 The conflict has caught the president's attention.

00:04:53.000 He tweeted that Sandman and his classmates were treated unfairly and have become symbols of fake news.

00:04:58.000 Okay, and Trump is, of course, correct about that.

00:05:00.000 I do love that Savannah Guthrie is asking about the evils of the hat.

00:05:03.000 The evils, evils of the hat.

00:05:04.000 Now, what's amazing is that this has become what people have focused in on, is the evils of the hat.

00:05:09.000 I'm not kidding you. 1.00

00:05:10.000 Ruth Graham over at Slate, which is another one of these media repositories for leftist stupidity. 1.00

00:05:17.000 She writes a piece today and the title is The Magatines Aren't Innocent Victims. 0.99

00:05:22.000 And I love this.

00:05:23.000 The incident at the Lincoln Memorial was more complicated than it initially seemed.

00:05:27.000 It's the reverse of what you made it out to be, guys.

00:05:30.000 Like, the precise reverse.

00:05:31.000 The people who are offending here were not the kids.

00:05:34.000 It was the Black Hebrew Israelites and Nick Phillips, or Nathan Phillips, who walked into the crowd in an attempt to draw attention and then lied about the situation repeatedly.

00:05:45.000 But I love this.

00:05:46.000 New footage, according to Ruth Graham, doesn't exonerate the kids in the red caps.

00:05:50.000 And I love that.

00:05:51.000 What they say is that the MAGA hats themselves were the problem.

00:05:55.000 Right?

00:05:55.000 She says, none of this might have mattered, and the clip certainly would not have gone viral, if Sandman and many of his peers were not wearing red Make America Great Again hats.

00:06:04.000 Racked reported in 2017 that the hats would become popular souvenirs among white teenage boys visiting Washington, in part because they invite instant attention, instant discomfort, easy transgression.

00:06:15.000 Boston Globe columnist Renee Graham wrote last summer about seeing more than a dozen white teenage boys in MAGA hats at the National Museum of African American History and Culture.

00:06:23.000 Clearly, this was meant as a provocation, she wrote.

00:06:26.000 I'm inclined to believe that Sandman, too, is smart enough to understand that the MAGA hat is not a symbol of peace and reconciliation, especially when the bill of that hat is inches from the nose of a Native American. 0.99

00:06:37.000 The Native American guy walked up to Nick Sandman.

00:06:40.000 If we are now going to assume what's in the head of everyone who wears a MAGA hat... And by the way, if you want everyone in a MAGA hat to think like Ruth Graham is suggesting they think, keep doing this stuff.

00:06:49.000 Really, if you want everybody who wears a MAGA hat to think of it as a symbol of the resistance, all you have to do is keep maligning everyone who voted for Trump as a secret racist, who is racist for standing there and having a face.

00:07:01.000 That's really what they're saying now.

00:07:01.000 They're saying he was standing there.

00:07:03.000 He had a face.

00:07:04.000 His face was kind of smiling.

00:07:06.000 Very bad.

00:07:08.000 Very, very terrible.

00:07:10.000 And then, I love this.

00:07:11.000 So, Nick Sandman and his peers get absolutely savaged by the media.

00:07:15.000 They're doxxed.

00:07:16.000 Their school is cancelled.

00:07:17.000 Basketball game's cancelled.

00:07:19.000 Death threats.

00:07:20.000 The whole shebang.

00:07:21.000 And Chris Hayes from MSNBC says, you know what the problem is?

00:07:24.000 The real problem here is that these kids have privilege.

00:07:27.000 Is the privilege of being targeted by the media for wearing a hat and being human and standing on feet?

00:07:34.000 Chris Hayes writes, "The most vital privilege in American life is due process, second chances, and the grace to have your actions read charitably.

00:07:40.000 I understand why people will fight like hell to preserve it, but probably worth thinking about all the people who do not have those privileges at all." Yeah, I'm sure.

00:07:49.000 The real story here is the white privilege of the kids who had their lives basically overturned for no reason because the media decided to go after people.

00:07:56.000 I love the perception by a lot of mainstream media actors that the constant savage attacks on people who are not of the left wing, that's evidence that those people have privilege in and of themselves.

00:08:06.000 And maybe when we get it wrong, the real story is the privileges that the people that we're not attacking don't have.

00:08:12.000 The real story isn't what happened to these kids.

00:08:14.000 It's what happens to other kids that we're not talking about or targeting for destruction.

00:08:18.000 It's not a point I'm making, by the way.

00:08:20.000 Conor Friedersdorf over at The Atlantic makes that point.

00:08:22.000 He's a lot more libertarian to the left than I am.

00:08:26.000 But the constant stream of false information continues virtually unabated.

00:08:31.000 So Ilhan Omar, who is one of the fresh faces of the new Congress, fresh, fresh, fresh, so fresh, So she tweeted this out.

00:08:37.000 out she tweeted the boys were protesting a woman's right to choose and yelled it's not rape if you enjoy it number one false the kid who was caught on tape yelling that is not from covington catholic high school two she says they were taunting five black men before they surrounded phillips and led racist chants false on every single score the There is no evidence they led racist chants, nor were they taunting the people from the Black Hebrew Israelites. 0.75

00:09:01.000 The people from the Black Hebrew Israelites were calling them the F word, for gay people, and they were calling them the N word. 0.96

00:09:06.000 Okay, that's insane. 0.82

00:09:08.000 And then, I love this, Ilhan Omar says, Sandman's family hired a right-wing PR firm to write his non-apology.

00:09:14.000 What do you think they're going to do?

00:09:15.000 Now they're the center of media scrutiny.

00:09:17.000 You think maybe they're going to talk to somebody who might know PR?

00:09:20.000 Yeah, and I love that this has now become a symbol of Sandman's privilege, that he hired a PR firm to deal with the fact that he had incoming national media trying to destroy his life.

00:09:30.000 Ooh, God forbid he hires a professional when professional adults are trying to destroy him.

00:09:35.000 Let me point out that the family of Trayvon Martin also had professionals who were working with them.

00:09:39.000 In other words, whenever there is an incident at the center of American life, PR professionals are there in a heartbeat because this is legitimately what they do for a living. 0.97

00:09:47.000 That's not a rip on Trayvon's family, and it's not a rip on Nick Sandman's family, because all of this is dumb. 0.57

00:09:52.000 We continue, by the way, to promote the idea that Nathan Phillips is not a liar. 0.99

00:09:57.000 He is, in fact, a liar.

00:09:58.000 David French has a good piece over at National Review today talking about all the lies that he has told. 0.81

00:10:05.000 He falsely has stated that he served in Vietnam two times on CNN.

00:10:09.000 He said he's a Vietnam veteran twice.

00:10:11.000 That is not true. 0.92

00:10:13.000 And then he said that the black... This is seriously what he says. 0.97

00:10:17.000 He says that the kids were looking for trouble, looking for something.

00:10:21.000 He disagrees with the kids' defense that Phillips came into their space and they were getting hyped up.

00:10:25.000 He said, that's not in the least what happened, but that's exactly what happened.

00:10:28.000 He said, what I was witnessing was just hate.

00:10:31.000 Racism.

00:10:32.000 Well, hate, what I'm saying is that when these folks came there, these other folks were saying their piece, and these others, they got offended with it because they were both just expressing their own views.

00:10:40.000 And if it's racism, that's what it was, because the folks that were having their moment there, they were saying things that I don't know if I agreed with them or not, but some of it was educational.

00:10:47.000 And it was truth, and it was history about religious views and ideologies.

00:10:50.000 But these other folks, the young students, they couldn't see it.

00:10:55.000 None of that is true.

00:10:56.000 It's astounding.

00:10:57.000 The adult black Hebrew Israelites were taunting the kids relentlessly, as David French writes. 0.98

00:11:03.000 These folks are really rage-filled and hate-filled. 0.96

00:11:06.000 I mean, they're not the kind of folks you want to hang around in your spare time, which is why everyone on the New York subway ignores them.

00:11:13.000 I mean, the New York subway system.

00:11:15.000 A story for another time.

00:11:16.000 And then Philip says that he, I mean, he just spins the story completely in a false way, and we're still supposed to take him seriously as some sort of American hero.

00:11:24.000 He says, he says, I think that was the push, that we need to use our drum, use our prayer, and bring a balance, bring a calming to the situation.

00:11:31.000 That is such a lie.

00:11:32.000 He walked into the middle of a group of students banging his drum in their faces.

00:11:36.000 He said they were going to hurt them.

00:11:38.000 They were going to hurt them because they didn't like the color of their skin.

00:11:41.000 There is no indicator that these kids were going to do anything to the black Hebrew Israelites who were taunting the kids with racial slurs. 0.96

00:11:48.000 This is insane. 0.67

00:11:49.000 And then later he changes his story on CNN.

00:11:52.000 And he said that one of his people said they should go reclaim our space, which is really what this was about. 0.99

00:11:57.000 But Phillips is a liar. 0.97

00:11:59.000 He's lying to the media. 0.96

00:12:00.000 And in a second, we will show you other stories demonstrating that he has been trying to do this sort of stuff for a while here, disrupting other people's events.

00:12:09.000 We'll get to that in just a second.

00:12:11.000 First, let's talk about how you are going to send your mail this year.

00:13:22.000 Go check it out right now.

00:13:23.000 Okay, so it turns out that Nathan Phillips has a habit of trying to disrupt other people's events.

00:13:28.000 That's according to Ed Condon, Dateline, yesterday.

00:13:31.000 While chanting and playing ceremonial drums, a group of Native American rights activists, reportedly led by Nathan Phillips, attempted on January 19th to enter Washington DC's Basilica of the National Shrine of the Immaculate Conception during a Saturday evening mass.

00:13:44.000 So shortly after going after these kids, he decided that he was going to disrupt a mass.

00:13:49.000 The group of 20 demonstrators was stopped by shrine security as it tried to enter the church during its 5.15 p.m.

00:13:55.000 vigil mass, according to shrine security guard on duty during the mass.

00:13:58.000 It was really upsetting, the guard told Catholic News Agency.

00:14:01.000 There were about 20 people trying to get in.

00:14:03.000 We had to lock the doors and everything.

00:14:05.000 The guard said it was a disappointment during a busy and joyful weekend for the shrine.

00:14:08.000 He said we had hundreds and hundreds of people come from all over the country here to celebrate life, to celebrate each other together.

00:14:14.000 That a protest tried to come inside during mass was really the worst.

00:14:17.000 He said, I'm grateful that nothing bad happened.

00:14:19.000 They were really angry.

00:14:20.000 Don't worry.

00:14:21.000 Nathan Phillips is not the aggressor in any of this.

00:14:23.000 He is a pure victim.

00:14:24.000 The church built itself around him.

00:14:26.000 It's amazing.

00:14:27.000 He was just standing there and boom, he was in the middle of the mass.

00:14:30.000 No idea how it happened.

00:14:31.000 He didn't try to wander into the middle of the mass with his folks at all.

00:14:34.000 What happened is he was just standing there, minding his own business, banging on his drum.

00:14:37.000 And suddenly the church magically materialized around him and right in front of him.

00:14:42.000 It was just like, like unbelievable because churches are racist, of course.

00:14:47.000 This is the way we do our news these days.

00:14:50.000 In just a second, we'll talk about more of the left's reaction to all of this, because it is indeed insane.

00:14:56.000 And then we're going to talk about why this is a national story in the first place, because we all know the real story here, why this is a national story.

00:15:02.000 So the press have been trying to spin this away because this was a big boo-boo by a large number of people in the press.

00:15:08.000 Here is how the Washington Post did it.

00:15:10.000 They're a parody of themselves.

00:15:11.000 They're a parody of themselves.

00:15:13.000 Abby Ohlheiser and Paul Farhi reporting for the Washington Post.

00:15:16.000 Now, here is the rule.

00:15:17.000 My friend Andrew Klavan has said this for a long time.

00:15:20.000 That when something, when a Republican does something bad, then the story is Republican does something bad.

00:15:27.000 When a Democrat does something bad, or a leftist does something bad, or the media do something bad, the story is Republican reaction to the bad thing.

00:15:34.000 The story is Republicans pounce.

00:15:36.000 This is a rule that you can apply to all situations in the media.

00:15:40.000 And today is no different.

00:15:41.000 Here is the headline from the Washington Post.

00:15:44.000 Okay, first of all, there should be a full-time editor whose only job is to remove the word pounced from all titles in mainstream media.

00:15:57.000 Because it's become an actual meme on the right.

00:15:59.000 Because we all know where the media are gonna go.

00:16:02.000 We didn't do anything wrong.

00:16:03.000 You just pounced.

00:16:05.000 I mean, again, listen to that headline.

00:16:06.000 The mainstream media rushed to keep up?

00:16:09.000 No, the mainstream media spread the virality.

00:16:12.000 The mainstream media made it a big story.

00:16:16.000 That headline is absurd!

00:16:17.000 But they continue to say this.

00:16:18.000 The video, taken from an Instagram account and reposted to Twitter, went viral with the caption, As the story picked up speed on social media, a Washington Post editor assigned reporters to cover it.

00:16:33.000 At about 3 p.m.

00:16:33.000 on Saturday, one reporter spoke to Phillips about what happened.

00:16:36.000 Others called the Catholic school and the local diocese, looking for a statement from someone who could represent the students in the video.

00:16:42.000 The reporters weren't aware of a critical third element in the scene, the Hebrew Israelites who had been taunting the high school boys moments before the viral video began.

00:16:51.000 At 5 p.m.

00:16:51.000 on Saturday, still unaware of the moments preceding the viral video, the Post published its first story on what would become a days-long national argument about racism, the media, and masculinity.

00:17:01.000 The headline, It Was Getting Ugly, Native American Drummer Speaks on His Encounter with MAGA Hat-Wearing Teens. 0.61

00:17:08.000 We all know where this story came from and why they were jumping to that conclusion.

00:17:12.000 And then they talk about how the breaking news made the rounds, as is typical in such breaking news situations.

00:17:19.000 Initial news accounts, which drew howls from partisans on both sides, were unable to provide all the context and facts.

00:17:25.000 The howls that were being drawn were largely the baying of the hounds in the media who were going after these kids because they happened to be wearing MAGA hats.

00:17:32.000 It took close to 48 hours for reporters in a divided America to fully grasp what had occurred, and to whom.

00:17:38.000 Like many viral outrage stories, the narrative became more complicated as more facts emerged, and more people stepped forward to talk about what they saw and experienced in that moment.

00:17:46.000 But the Covington story isn't just a run-of-the-mill incident of viral outrage.

00:17:51.000 It involved MAGA hat-wearing teens and a Native American activist.

00:17:54.000 Those who shared the video in those first 24 hours, including many conservatives, seemed to feel it was emblematic of the vitriol and racism that drives the worst of American culture.

00:18:03.000 But when new details shifted the story into more ambiguous territory, a well-oiled machine of pro-Trump personalities and sites saw an opportunity to strike.

00:18:14.000 So the only offense here, the only thing that was wrong here was the people who waited and then said that the media screwed this thing up.

00:18:21.000 Because it turns out that the media screwed this thing up.

00:18:23.000 So there's that.

00:18:25.000 Really well done media.

00:18:27.000 So no need to re-examine how you go about doing your business.

00:18:31.000 The real problem here, of course, is that people pounced on you.

00:18:35.000 I feel terrible for members.

00:18:36.000 I mean, what?

00:18:36.000 It must be so difficult to be a member of the media when you can just make excuses for your own malfeasance by saying that people pounced, pounced.

00:18:43.000 Okay, so there's that, which is great.

00:18:45.000 Meanwhile, Joy Behar basically let the cat out of the bag. 1.00

00:18:47.000 So she was on The View yesterday talking with Whoopi Goldberg, and Whoopi Goldberg was talking about the rush to judgment, and Joy Behar sort of let slip the reason why all of this happened, and we all know, we all know.

00:18:57.000 We just instantly say that's what it is based on what we see in that moment and then have to walk stuff back when it turns out we're wrong.

00:19:05.000 Why is that?

00:19:06.000 Why do we keep making the same mistake?

00:19:10.000 Because we're desperate to get Trump out of office.

00:19:15.000 I think that that's the reason.

00:19:16.000 I think the press jumps the gun a lot because we just, we have so much circumstantial evidence against this guy that we basically are hoping that, you know, Cohen's got the goods and what have you.

00:19:27.000 And so it's wishful thinking.

00:19:29.000 Okay, that is a hundred percent true.

00:19:30.000 And I love that she says us.

00:19:32.000 Right, us.

00:19:33.000 Okay, because the us she's talking about, that's not just Joy Behar.

00:19:36.000 And it's not just Whoopi Goldberg.

00:19:37.000 And I love the media.

00:19:38.000 You can hear the crowd laughing and cheering because they know it's true.

00:19:41.000 In other words, if members of the mainstream media, who all think the same way that Joy Behar does, decide that these kids must be sacrificed on the altar of Get Trump, Then they'll do it.

00:19:51.000 No problem.

00:19:52.000 They have no problem with that whatsoever. 1.00

00:19:53.000 And they're continuing to promote the stupidest nonsense. 1.00

00:19:56.000 So, the worst tweet of the day yesterday came courtesy of Kathy Griffin, who, you know, after holding up a severed head of President Trump, has apparently lost her head. 1.00

00:20:06.000 Well, you know, what was left of the brains inside is gone.

00:20:08.000 So, she tweeted out a photo that was originally covered by the New York Daily News, right?

00:20:13.000 And I talked about this yesterday, in which members of the Covington Catholic High School were wearing, not blackface, but they were wearing black paint for a blackout game.

00:20:23.000 She found another photo of the Covington Catholic students, and some of them are holding up their hands in the OK motion, right?

00:20:29.000 Which is, they're not even doing that, right?

00:20:31.000 What they're really doing is they're holding up the three-point motion.

00:20:33.000 The three-point motion, for those who have never seen a basketball game.

00:20:35.000 This is a picture of a basketball game.

00:20:37.000 All these kids are going like this, for people who can see me.

00:20:40.000 All these kids are holding up their hands like this. 1.00

00:20:42.000 This is not a white power symbol in basketball, you stupid morons. 1.00

00:20:46.000 It is a three-point signal. 1.00

00:20:48.000 That is not me saying it.

00:20:49.000 I'm not a professional basketball player.

00:20:51.000 A fact to which my producers can attest.

00:20:53.000 I have a hoop outside.

00:20:54.000 I stink.

00:20:55.000 Okay? 0.99

00:20:56.000 That is a symbol for three-point motion according to white supremacists like LeBron James.

00:21:01.000 Right?

00:21:02.000 White supremacists like Stephen Curry.

00:21:03.000 Stephen Curry. 0.85

00:21:04.000 Okay.

00:21:05.000 There's Curry.

00:21:09.000 Okay, so Curry is holding up... He's a white supremacist, clearly, according to Kathy Griffin, making that exact same motion. 0.62

00:21:17.000 LeBron James has made this exact same motion.

00:21:18.000 Like, all NBA players make this motion.

00:21:21.000 There's one of the players... Who is this one?

00:21:23.000 Nick... Is this Nick Young from the Lakers?

00:21:26.000 I can't remember who this is. 0.95

00:21:27.000 In any case, a Lakers player making that same motion, clearly a white supremacist, a black guy. 0.99

00:21:33.000 They're out of their minds. 0.99

00:21:34.000 Jim Carrey, another crazed lunatic, who's decided that he's an artist, which is shocking because, honest to God, my five-year-old daughter draws better than he does. 0.98

00:21:43.000 He made a portrait of people supposedly shouting at Nathan Phillips, and then above it, it says, Baby snakes, according to Jim Carrey. 0.87

00:21:52.000 So people are just going to continue lying about this in the same way that they said, hands up, don't shoot, may not have been factually accurate, but it was morally accurate.

00:21:59.000 And that's the key.

00:22:00.000 So for the left, here is how things go.

00:22:02.000 And I've been saying this for weeks now, for years actually.

00:22:05.000 Here is how things go.

00:22:07.000 The argument is basically that if we screw up the facts, then that's okay because our narrative, our underlying narrative, is good.

00:22:14.000 And if people on the right say, well, you screwed up the facts, so this does not prove your narrative, then people on the left say, well, that's because you don't take our narrative seriously enough.

00:22:21.000 So what they'll say is, look at these racist kids.

00:22:23.000 And people on the right will go, well, those kids aren't racist.

00:22:25.000 And the left will go, you're only saying that.

00:22:28.000 The only reason you're even asking the question is because you don't take racism seriously enough.

00:22:32.000 And you say, well, the facts don't back your account.

00:22:33.000 It doesn't matter.

00:22:34.000 It doesn't matter.

00:22:35.000 Are you saying that racism doesn't exist in America?

00:22:37.000 No, I'm not saying that.

00:22:38.000 I'm saying this does not prove your case, nor have you proved your case evidentiarily.

00:22:42.000 Just because you say something doesn't make it true.

00:22:45.000 It's amazing.

00:22:45.000 There's a piece by Adam Serwer in The Atlantic kind of making the counter case saying, well, you know, people who are debunking this particular case and are now suggesting that there's not racism in America are wrong.

00:22:57.000 Well, I'm not sure who's exactly making that case, but it's it is amazing that folks on the left can't see the counter.

00:23:02.000 That is the mirror negative of that, right?

00:23:04.000 The photo negative of that argument, which is if you don't got the facts to prove your case, you don't got facts to prove your case.

00:23:10.000 And that doesn't prove your narrative.

00:23:11.000 It's pretty incredible.

00:23:12.000 Okay, in one second, I want to talk about the fresh faces, fresh, fresh, fresh faces of the new Democratic Congress.

00:23:18.000 First, let's talk about how we can make your back feel better.

00:23:21.000 So, I work out a fair bit, I know.

00:23:23.000 To look at me, you'd think mild-mannered, mild-mannered reporter for the Daily Planet.

00:23:27.000 In reality, underneath this particular coat lies the body of a Greek god.

00:23:31.000 But, along with working out come the aches and pains of being a professional athlete.

00:23:36.000 It means sometimes my neck hurts, sometimes my back hurts, and that's why I have Teeter.

00:24:43.000 Go check them out.

00:24:44.000 Make your back and neck feel better right now.

00:24:45.000 Okay, the reason, the reason that this is a national story is because of abortion.

00:24:49.000 We all know this.

00:24:50.000 There are only two reasons this is a national story.

00:24:52.000 One, the kids were wearing MAGA hats and people in the media hate Trump.

00:24:55.000 Joy Behar is not lying to you.

00:24:56.000 And two, this happened at the March for Life and people on the left are rabid about abortion.

00:25:01.000 How rabid are people on the left about abortion?

00:25:04.000 They are so rabid that the state of New York just passed a new law.

00:25:08.000 That new law is an egregious destruction of human life.

00:25:12.000 I mean, it's an evil law.

00:25:13.000 It's a plain out evil law.

00:25:15.000 This law basically gets rid of all restrictions on abortion.

00:25:20.000 It strips abortion from the penal code.

00:25:22.000 So, if you are a person who is pregnant and somebody hits you in the stomach and the baby dies, this strips, it strips damage to the fetus out of the penal code.

00:25:34.000 No kidding.

00:25:36.000 It's an incredible, incredible violation of the rights of the mother, obviously. 0.99

00:25:41.000 And then late-term abortions were legalized again.

00:25:44.000 The new law allows a licensed healthcare practitioner acting under the scope of their practice to perform an abortion when, according to the practitioner's reasonable and good-faith professional judgment, based on the facts of the patient's case, the patient is within 24 weeks from the commencement of pregnancy, or there is an absence of fetal viability, or, this is the key provision, Health is the key provision there.

00:26:07.000 Because protecting the life, we all agree with.

00:26:08.000 Protecting the health means, you know what? 0.93

00:26:11.000 I'd be healthier if I didn't have this nine-month-old baby right here that's about to enter my vaginal canal, cut its brains out. 1.00

00:26:15.000 And that's what this law now allows.

00:26:18.000 The measure makes late-term abortions legal at the discretion of a healthcare practitioner.

00:26:24.000 Also, so Cuomo spoke about this.

00:26:26.000 He said, we had to pass this law to protect our state.

00:26:29.000 And then he wants a constitutional amendment to protect abortion up to point of birth.

00:26:35.000 OK, when it comes to criminal cases.

00:26:37.000 When it comes to criminal cases, there is serious concern that it limits prosecutors from applying criminal charges in cases of so-called forced abortions, which can occur during domestic violence cases and when a woman loses a child during pregnancy.

00:26:49.000 So, a husband beats the living hell out of his wife and she loses the baby.

00:26:52.000 You can't prosecute him for the loss of the baby now.

00:26:56.000 Senator Kathy Young, Republican from Olean, Cattaraugus County, she says it is unconscionable to think that anyone would deprive a pregnant domestic violence victim the justice she deserves.

00:27:06.000 And then, I love this, Liz Kruger from Manhattan, Democrat, says, you have to ask the question, why would anybody actually use the abortion code to charge someone with a heinous crime?

00:27:13.000 We in the state of New York have many strict rules in our criminal code to deal with these kind of criminals.

00:27:17.000 So no big deal that the guy killed the unborn baby.

00:27:20.000 We have plenty of ways to put this guy in jail, except that it put the guy in jail for longer for committing a crime against a human being.

00:27:26.000 So New York has, I mean, it's the most radical law in the nation now.

00:27:29.000 And Governor Cuomo celebrated this.

00:27:32.000 He's delighted.

00:27:33.000 He ordered that the spire, At One World Trade Center, the Governor Mario Cuomo Bridge, the Kosciuszko Bridge, I don't know how to pronounce it, and the Alfred Smith Building in Albany all be lit pink on Tuesday night.

00:27:47.000 They should have lit it blood red in honor of the death of babies.

00:27:50.000 Here is the inside of the chamber after this thing passed.

00:27:52.000 Wild applause for the death of the unborn.

00:28:02.000 Cuomo said, The Reproductive Health Act is a historic victory for New Yorkers and for our progressive values.

00:28:06.000 In the face of a federal government intent on rolling back Roe v. Wade and women's reproductive rights, I promised that we would enact this critical legislation within the first 30 days of the new session, and we got it done.

00:28:16.000 I'm directing that New York's landmarks be lit pink to celebrate this achievement and shine a bright light forward for the rest of the nation to follow.

00:28:22.000 This act of barbarism stacks alongside acts of barbarism from the 1850s with regard to black folks. 1.00

00:28:29.000 The reduction of babies who just have not entered the vaginal canal to pieces of meat that you can easily dispense with is dehumanization.

00:28:39.000 It is pure, simple dehumanization ending in murder.

00:28:42.000 That's all this is.

00:28:44.000 Cuomo said on Tuesday, it's bittersweet.

00:28:45.000 There's bitterness because we shouldn't be here in the first place.

00:28:47.000 We should not have a federal government that is trying to roll back women's rights. 1.00

00:28:50.000 This administration defies American evolution.

00:28:54.000 American evolution?

00:28:56.000 As I said in my speech to the March for Life, it's not important that righteousness be popular, it's just important that it be righteous.

00:29:02.000 If you're evolving toward evil, well then it is our job to stand to thwart the rails of history to stop you.

00:29:09.000 Cuomo is a radical, the Democratic Party is radical, and this is insanity.

00:29:12.000 But this is the reason why they didn't want to cover the March for Life.

00:29:14.000 So they came up with any excuse they could not to cover the March for Life because they don't want the messages from the March for Life actually going viral.

00:29:21.000 They didn't want to show the section of my podcast on Friday in which I went through the actual Fetal development, stage by stage, to show you how babies in the womb are developed.

00:29:30.000 Complete with graphics.

00:29:31.000 They wouldn't show that.

00:29:32.000 Instead, they would pick out a 21-second segment of my show in which I used an analogy to talk about why you should not eugenically abort babies to prevent future crime rates from dropping.

00:29:44.000 Instead of covering what happened at the March for Life, they covered some fake, completely manufactured outrage about Nathan Phillips, who confronted a bunch of high school kids, and we somehow made the kids the villains.

00:29:53.000 That's what they will do to avoid talking about abortion, even as they pass laws that target the unborn for death. 0.83

00:30:00.000 Meanwhile, the radicals in the Democratic Party have fully taken over.

00:30:04.000 It was bugging me the other day who Alexandra Ocasio-Cortez reminded me of.

00:30:10.000 Because there was, like in the back of my mind, there was something that she reminded me of.

00:30:14.000 And then I realized what she reminds me of.

00:30:15.000 So we're going to play two clips of Alexandra Ocasio-Cortez back to back.

00:30:19.000 Or a clip of Alexandria Ocasio-Cortez and then a clip of her doppelganger. 0.89

00:30:24.000 So here she is, yesterday, talking about billionaires and ringworms with Ta-Nehisi Coates.

00:30:29.000 This is on Martin Luther King Day.

00:30:31.000 Talking about why billionaires should not exist in the United States.

00:30:33.000 And then I will play a clip of her doppelganger.

00:30:35.000 You live in a moral world that allows for billionaires.

00:30:38.000 Is that a moral outcome in and of itself?

00:30:40.000 No.

00:30:40.000 It's not.

00:30:42.000 It's not.

00:30:42.000 I don't think that necessarily means that all billionaires are immoral.

00:30:48.000 But I do think a system that allows billionaires to exist when there are parts of Alabama where people are still getting ringworm because they don't have access to public health is wrong.

00:31:03.000 OK, and then let's play her doppelganger here.

00:31:09.000 OK, now let me just make a point before the media gets there.

00:31:12.000 This isn't sexist because I make fun of all politicians repeatedly.

00:31:14.000 So get over yourselves.

00:31:15.000 I know as soon as you make fun of AOC, it's sexist.

00:31:18.000 It's not sexist to point out that she has exactly the same mannerisms and exactly the same political views as the lady from SNL who Seth Meyers once brought on as the as the girl from the party you didn't actually want to get into a conversation with. 1.00

00:31:31.000 Also, worth noting here, it was funny, yesterday I talked a little bit about her comments about billionaires, which are innately stupid and really ridiculous. 0.99

00:31:40.000 And her campaign manager came out and said today, clarified and said, billionaires actually, as a staffer, billionaires are actually immoral. 0.99

00:31:46.000 It's immoral to want that much money.

00:31:48.000 Because once you have enough money, you should stop wanting money.

00:31:51.000 You should stop wanting to produce goods and services for others.

00:31:53.000 Instead, you should sort of sit atop your stack of cash.

00:31:56.000 I focused in on the billionaire's comment because it was more relevant.

00:31:59.000 I will simply point out that when Alexander Ocasio-Cortez says that people are getting ringworm for lack of public health care, you get ringworm from skin-to-skin contact and from going to the gym when people haven't cleaned off the treadmill.

00:32:12.000 That's how you get ringworm. 0.99

00:32:15.000 It is not a public health crisis that is generated by poverty.

00:32:19.000 Ringworm.

00:32:20.000 Okay.

00:32:20.000 It's like, you know, the serious public health crisis in this country is cellulitis.

00:32:26.000 Cellulitis is in folliculitis.

00:34:27.000 Right now, we are the largest, fastest growing conservative podcast and radio show in the nation.

00:34:30.000 So one of the things I love most about AOC, we'll get to the tributes to her, the continued tributes to her.

00:34:42.000 It's really amazing.

00:34:44.000 One of the things I love about her most, really, is that she complains about the media more than any person I have seen since Donald Trump, frankly.

00:34:52.000 Donald Trump goes around, he goes, fake news.

00:34:54.000 But half the time, it's actually fake.

00:34:56.000 AOC complains about things that are not even fake.

00:34:58.000 It's incredible.

00:34:59.000 And the media eat it up.

00:35:00.000 She just whines about people fact-checking her.

00:35:03.000 So she says this, quote, Me, I don't think billionaires should concentrate wealth while employing people who are sleeping in cars working a zillion hours to survive. 0.96

00:35:12.000 Next day, that will be 10 Pinocchios to Ocasio.

00:35:14.000 Zillion is not a number.

00:35:16.000 And I found someone who sleeps in a tent, not a car.

00:35:19.000 One of the fact checkers over at the Washington Post, Glenn Kessler, he tweeted back, I asked you some specific questions about statistics you cited, you refused to answer, and now you're moaning about the fact that I'm asking you simple questions?

00:35:33.000 That tweet by her, that intellectually dishonest tweet, 143,000 likes because this is the world that we live in.

00:35:39.000 Here's the reality.

00:35:39.000 If the girl you don't want to talk to at a party on SNL ran for office, she'd win and she might be president.

00:35:45.000 That's where we are as a country because nothing she says is distinguishable from anything that AOC says because that's where we are.

00:35:53.000 And before people on the left again say, well, that's sexist, Donald Trump's president, he was a reality TV star who didn't know a lot of things.

00:36:00.000 Okay, so that's not me mocking AOC, that's mocking Americans, okay? 0.76

00:36:03.000 Like, America, get your bleep together, seriously. 0.61

00:36:07.000 It's really spectacular.

00:36:11.000 And then, I love this, she also started tweeting about how people are mean to her all the time, and that she's being targeted by the media, I talked about this a little bit on the radio show yesterday.

00:36:27.000 The Hill put out an article about her that said, Ocasio-Cortez, I give zero Fs about pushback from other Democrats. 0.83

00:36:34.000 And then she wrote back, I actually didn't say this.

00:36:37.000 So while I know brown women cursing drives clicks, maybe you accurately quote the entire exchange instead of manipulating people into thinking I said this sentence instead of just the word zero. 0.62

00:36:47.000 Hey, does she know how quotation marks work?

00:36:49.000 Like, this is a proper use of quotation marks in this headline.

00:36:51.000 She was asked a question, how many Fs do you give?

00:36:53.000 And she said zero.

00:36:54.000 The headline says, Ocasio-Cortez, I give, quote, zero Fs about pushback from other Democrats.

00:37:00.000 That is a perfectly accurate headline, but she's moaning about it because people are so mean to her. 1.00

00:37:06.000 You know, Trump said, I whine and I whine and I whine until I win.

00:37:09.000 And there's something to that.

00:37:10.000 Folks in politics whine until they win. 1.00

00:37:13.000 They're all victims.

00:37:14.000 Everything is rough for them.

00:37:15.000 It's really difficult to be AOC, especially when they feature you on the cover of all things, The Hollywood Reporter.

00:37:22.000 I kid you not.

00:37:23.000 AOC on the cover of The Hollywood Reporter with the headline, AOC Storms Sundance.

00:37:29.000 So some lady made a documentary about Ocasio-Cortez. 1.00

00:37:34.000 And now she's storming Sundance? 1.00

00:37:36.000 Really?

00:37:37.000 Because there's a documentary about her?

00:37:39.000 I remember my good friend Andrew Breitbart.

00:37:41.000 There were a couple of documentaries featuring him.

00:37:42.000 There was one about him called Hating Breitbart that's quite good.

00:37:44.000 I don't remember him on the cover of The Hollywood Reporter.

00:37:47.000 And he actually did something for a living.

00:37:50.000 It really is truly amazing.

00:37:51.000 But that's the nice thing about being a Democrat.

00:37:53.000 It means never having to actually be good at anything or say true things.

00:37:57.000 In fact, Axios has a piece today talking about Alexander Ocasio-Cortez's claim that we're all going to die in 12 years.

00:38:04.000 I saw a very funny, a very funny suggestion internally here is that we should put on a shirt a quote from AOC, the world will end in 12 years.

00:38:11.000 And then it should say Alexander Ocasio-Cortez for president 2032.

00:38:17.000 You get the joke?

00:38:17.000 Got it, guys?

00:38:21.000 I'm all for it.

00:38:22.000 But here's what Axios says.

00:38:25.000 The big picture.

00:38:26.000 During the past year, several scientific reports have been released that underscore the urgency of slashing emissions of greenhouse gases.

00:38:32.000 But while there were only 12 years left till 2030 when the IPCC report came out, the reality is that we have a diverse array of choices before us in terms of how soon to make emissions cuts and how significant and costly they are, top climate scientists told Axios.

00:38:46.000 Their comments were about the framing of a rigid 12-year timetable in general.

00:38:49.000 So they said, 12 years isn't the deadline.

00:38:52.000 Climate change isn't a cliff we fall off.

00:38:53.000 It's a slope we slide down.

00:38:55.000 That's Kate Marvel, a climate scientist at NASA.

00:38:57.000 We don't have 12 years to prevent climate change.

00:38:59.000 We have no time.

00:39:00.000 It's already here.

00:39:01.000 And even under a business-as-usual scenario, the world isn't going to end in exactly 12 years.

00:39:06.000 She says she's not wrong that decisions we make in the next decade will determine how bad climate change gets.

00:39:12.000 But, again, the world is not going to end in 12 years.

00:39:15.000 Nor is the 12-year limit the end of the world.

00:39:17.000 Like, if we don't do anything for 12 years, it's not like the world ends and then there's nothing we can do.

00:39:21.000 That's what climate scientists have been saying about this.

00:39:24.000 This is why Sarah Huckabee Sanders correctly came out and said, um, AOC on climate change?

00:39:29.000 Yeah, we're not gonna listen to her so much.

00:39:31.000 That's not a thing.

00:39:32.000 I don't think we're going to listen to her on much of anything, particularly not on matters that we're going to leave into the hands of a much, much higher authority, and certainly not listen to the freshman congresswoman on when the world may end.

00:39:49.000 We're focused on what's happening in the world right now.

00:39:52.000 We wish that Democrats like herself would engage in that conversation, help us fix some of the current problems we know exist.

00:39:59.000 But the race to the left continues apace. 0.98

00:40:01.000 One of the great things about the 2020 race is we're going to see nothing but dumb from here on in. 1.00

00:40:05.000 Really, nothing but stupid from here on in. 1.00

00:40:09.000 It's going to be amazing. 0.99

00:40:12.000 So, an example, Kristen Gillibrand, who is just delightful.

00:40:17.000 She really is.

00:40:17.000 She's a delight because, like Hillary Clinton, she's purely mechanical.

00:40:21.000 You can actually see the physical gears turning in her head when she does things.

00:40:27.000 They've not been greased.

00:40:28.000 There's no smoothness to it.

00:40:30.000 It's like she's a human being who's constantly doing the robot.

00:40:32.000 Everything she does is... It's just great.

00:40:36.000 And there's also nothing greater than watching a white person awkwardly preach to black people.

00:40:40.000 It's one of my favorite things in the entire world.

00:40:43.000 So, Kirsten Gillibrand went to the National Action Network.

00:40:46.000 Again, it is astonishing to me that Al Sharpton is still considered some sort of legitimate political influencer inside the Democratic Party. 0.97

00:40:54.000 He's an anti-Semitic piece of human debris, Al Sharpton. 0.99

00:40:57.000 He's the worst. 0.99

00:40:58.000 But Democrats continue to pay homage to him because anti-Semitism acceptable in the Democratic Party. 0.85

00:41:02.000 We all know this.

00:41:03.000 So Kirsten Gillibrand, but this was great.

00:41:05.000 Kirsten Gillibrand went to the National Action Network and she got her preach on.

00:41:09.000 It's sort of like when Hillary Clinton went down south and started talking to black audiences and suddenly she started talking like the down-home Arkansas girl we always knew she was from Park Ridge, Illinois.

00:41:20.000 Well, Kirsten Gillibrand is doing the same thing and it's just spectacular.

00:41:23.000 Watch Kristen Gilliband preach like she just watched Elmer Gantry. 1.00

00:41:27.000 We will wear the belt of truth because we know the truth.

00:41:31.000 We speak truth to power.

00:41:33.000 We will put on the bright breastplate of righteousness because we know right from wrong and we will not forget it.

00:41:44.000 We will hold that shield of faith.

00:41:46.000 As Dr. King said, faith is taking the first step.

00:41:52.000 Even when you don't see the whole staircase.

00:41:54.000 So hold on to that faith tightly.

00:41:58.000 She's the best.

00:42:00.000 Oh man, I really want her to win the nomination now. 0.99

00:42:03.000 It's so great!

00:42:04.000 I love it!

00:42:06.000 You know, there's a famous speech in which George H.W.

00:42:10.000 Bush was reading the speech off a teleprompter, and in the middle of the teleprompter, there was a stage direction, and it said something like, say with sincerity, and so he was just reading, and he goes, say with sincerity.

00:42:19.000 And like, he just continues reading.

00:42:21.000 That's Kirsten Gillibrand.

00:42:22.000 Like, on her speech, she's like, put your hand up, and she's like, And then she's like, but I want you to wave your hands around like.

00:42:32.000 The best thing ever.

00:42:34.000 Oh, I'm really looking forward to this 2020 race.

00:42:37.000 I mean, listen, it may all end in tears.

00:42:38.000 It may end with Kirsten Gillibrand being president. 0.99

00:42:40.000 But man, if we're going to buy the ticket, we may as well take the damn ride, because my goodness gracious. 0.96

00:42:45.000 Also worth noting, Kamala Harris has come out with her logo for her for her. 0.98

00:42:49.000 for her campaign.

00:42:51.000 It's awful.

00:42:52.000 It's a legit, it's a legit terrible logo.

00:42:55.000 It's done on like, it's like blue and red on orange.

00:42:59.000 It's a weird color combination.

00:43:01.000 Really, really an awful logo.

00:43:03.000 So it's gonna, there's gonna be so much fun during the presidential race.

00:43:05.000 I'm so glad that we get to cover it because you know what?

00:43:08.000 It turns out the world will not be over soon.

00:43:10.000 So that's that's really exciting stuff.

00:43:12.000 Meanwhile, the government shutdown continues apace and all the rest of it.

00:43:15.000 But the real look, the government shutdown is going to end.

00:43:18.000 The real thing that's going to stay is the radicalism of the Democratic Party.

00:43:22.000 Alexander Ocasio-Cortez's newly hired policy advisor, Dan Riffle, has some strong opinions about Bill Gates.

00:43:27.000 Here is what he tweeted.

00:43:29.000 It's it's it's pretty spectacular.

00:43:31.000 He tweeted, Every billionaire is a policy failure.

00:43:35.000 Every billionaire is a policy failure.

00:43:36.000 It's a policy failure if somebody makes too much money.

00:43:39.000 And then, he deleted his tweet in which he encouraged AOC to raise her top rate not from 70% but to 90%.

00:43:47.000 He tweeted last night, quote, Get ready for this.

00:43:52.000 Bill Gates's money hoarding makes him greedy.

00:43:55.000 But maybe he goes six for six on the other deadly sins and unbalances a good person.

00:43:59.000 Still, he's a policy failure.

00:44:01.000 The acquisition of that much wealth has bad consequences.

00:44:03.000 A moral society needs guardrails against it.

00:44:07.000 I'm gonna need for like a definition of morality that says that it is not you being greedy when you stick your hand in somebody else's pocket.

00:44:13.000 It is greedy when they make their money through consensual transactions.

00:44:17.000 So Bill Gates, who has made legitimately millions of lives better, is greedy.

00:44:20.000 You are not greedy for going into his pocket and stealing his wallet.

00:44:24.000 That's just you establishing moral justice in the world.

00:44:28.000 Pretty amazing.

00:44:30.000 So, going after Bill Gates to own the cons.

00:44:33.000 Well done there.

00:44:33.000 By the way, Bill Gates is a Democrat.

00:44:35.000 Bill Gates' money hoarding makes him greedy.

00:44:37.000 I also love hearing Democrats preach about the seven deadly sins.

00:44:42.000 That's one of my favorite ones.

00:44:45.000 I think the Democrats should really be the ones preaching about religious notions of sin.

00:44:49.000 Right, I want to hear them preach about lust next.

00:44:52.000 That's the one I hear, I want to hear Bill Clinton preach about lust.

00:44:55.000 I want to hear them, I want to hear them preach about sloth and envy.

00:44:58.000 You know, there is one of the, one of the seven deadly sins it turns out is envy.

00:45:02.000 Does it sound like maybe you're violating one of the seven deadly sins when you say that billionaires are inherently greedy?

00:45:06.000 And that a moral society needs guardrails against people acquiring wealth in voluntary transactions?

00:45:12.000 Might violate, maybe, one of the seven sins, envy.

00:45:16.000 All right, time for some things I like and some things I hate.

00:45:18.000 So bad news for you today, I have no things I like.

00:45:20.000 I've given up.

00:45:21.000 There are no things I like.

00:45:22.000 So let's just do some things that I hate instead.

00:45:27.000 All right, so there's a New York law that is so insane.

00:45:31.000 I'm not talking about their abortion law. 0.97

00:45:33.000 We know that New Yorkers apparently are so far to the left that they are fine with killing fully fledged human beings.

00:45:38.000 That's fine, apparently. 0.67

00:45:39.000 But so let's just get this straight. 1.00

00:45:42.000 You can kill a baby in the womb. 1.00

00:45:44.000 That is fully formed. 0.98

00:45:46.000 You cannot kill a person who breaks into your house.

00:45:49.000 This is according to an opinion piece by Sean Roman Strockage over at the New York Post.

00:45:55.000 There's a reason homeowners can rarely afford to dispense mercy on an overnight invader.

00:45:59.000 Criminal intruders tend to be the dangerous type.

00:46:01.000 What homeowners don't expect are law enforcers and prosecutors going after them for defending themselves and their loved ones.

00:46:07.000 Queens resident Joel Christopher Paul faced a home intruder threat in the early hours of July 30th, 2017.

00:46:12.000 The 27-year-old was home in Springfield Gardens with his mother, brother, and sister when someone attempted to break in.

00:46:18.000 The intruder was Shamel Chaveau, 26, who had traveled north from Maryland after being named a suspect in a shooting there 10 days earlier.

00:46:25.000 Expecting a pizza delivery, Paul's brother Michael, 16, went to the door and discovered Chauveau trying to break in.

00:46:30.000 Michael forced Chauveau to the surrounding area, and his mother called for help.

00:46:34.000 Joel, adrenaline likely surging through his veins, answered the call and brought a bat and knife to the confrontation.

00:46:39.000 By the time it was all over, Chauveau received the ultimate lesson in picking the wrong house.

00:46:43.000 He died at Jamaica Hospital after being clubbed and stabbed.

00:46:46.000 The confrontation had all the indications of a break-in gone wrong for the wanted man, and as one high-ranking police source told the Post, the response was justifiable.

00:46:54.000 Both brothers avoided arrest and remained home after the incident, but months later, Queens DA Richard Brown submitted the case to a grand jury, bringing ruin upon Joel, who has been charged with manslaughter.

00:47:05.000 Prosecutors shouldn't have targeted Joel.

00:47:06.000 The stress, expense, uncertainty facing a first-degree manslaughter charge are devastating and can lead to an unjustified plea that could result in Joel going to prison.

00:47:14.000 Part of the trouble lies with New York's retreat doctrine.

00:47:17.000 So there's something in a lot of states called the Castle Doctrine. 0.95

00:47:19.000 That is, if somebody breaks into your house, they are now in your domain and you can shoot them.

00:47:23.000 Because they're presumably there to do ill. 0.91

00:47:26.000 This does not seem like a wild assumption, by the way.

00:47:29.000 And I don't know what the law is.

00:47:31.000 I believe that there's no Castle Doctrine in the state of California, I believe.

00:47:34.000 But let's just put it this way. 0.99

00:47:35.000 You break into my house, you're getting shot in the face. 0.99

00:47:36.000 That's how that's going. 1.00

00:47:38.000 Just warning to all intruders, you break into my physical domicile, I'm going to assume you are there not to play pinochle, and I will shoot you in the face. 0.97

00:47:45.000 And this is the perspective of all Second Amendment-abiding gun owners across the United States. 0.99

00:47:49.000 You break into our houses, you get shot.

00:47:50.000 That's the way this is going.

00:47:51.000 But New York has a retreat doctrine.

00:47:54.000 The doctrine holds that Joel had a duty to run and hide if it was safe to do so. 0.97

00:47:59.000 It's an obligation Joel, like the vast majority of New Yorkers, had probably never heard of because it's asinine.

00:48:04.000 Yet it's likely the Queens DA will pursue precisely this avenue at trial since the indictment states that Joel, with intent to cause serious physical injury to Shamal Shavell, caused his death.

00:48:13.000 While most jurisdictions would have left Joel alone, the Queens DA seems to want to resurrect the city's bad old days when prosecutors developed a reputation of interpreting laws in ways that protected criminals more than they protected victims.

00:48:27.000 Okay, this is insanity.

00:48:28.000 It's a violation of the basic right to self-defense.

00:48:30.000 Government was established to protect you and your property.

00:48:33.000 It was not established to protect criminals who break into your home.

00:48:37.000 And this is not a... I mean, this should not be a racial issue.

00:48:40.000 It shouldn't be that if you're a white person defending your home, then everybody is okay with it. 0.54

00:48:44.000 And if you're a black person protecting your home, or a brown person protecting your home, then everybody is very upset about it.

00:48:49.000 This guy should be acquitted immediately.

00:48:52.000 There's no way that this person ever should have been indicted in the first place if we are getting the true story from the New York Post here. 0.84

00:48:57.000 If someone breaks into your house, you have a right, naturally given to you by God, to shoot that person in the head.

00:49:03.000 No one gets to break into your home. 0.82

00:49:05.000 This is absurd.

00:49:06.000 This is absurd.

00:49:08.000 There's something called Assumption of the Risk in tort law.

00:49:10.000 You assume the risk you're going to get shot when you accost somebody violently.

00:49:14.000 That's the way this works.

00:49:15.000 All right.
