00:00:56.000And listen, far be it from me to somehow come to the defense of Cornell University, one of the worst colleges in America, a Bastion of wild left philosophy.
00:01:06.000But I do think that we should actually delve into the details of the case that is now exploding across the American political spectrum.
00:01:14.000The case we're talking about at Cornell University, no one has actually been prosecuted for rape.
00:01:19.000In fact, the woman in question filed a police report, and it turned out that the details of the police report did not amount to anything like rape.
00:01:26.000But here is the thing the left has no moral language when it comes to bad things happening with consent, they only have politics forever.
00:01:49.000She was 20 back in 2024 when all of this happened.
00:01:54.000And she was involved in sexual activity with a multiplicity of men on the night of October 19th, 2024, and into the morning of October 20th, 2024.
00:02:03.000Well, we'll get into the details of what allegedly happened on that night in just a second.
00:02:07.000Apparently, three weeks later, she went to the Cornell University PD.
00:02:34.000And then just a couple of days ago, on September 28th, the DA announced she was going to reopen a criminal investigation based on public pressure.
00:03:02.000But there's a difference between doing bad things consensually and rape.
00:03:07.000But we live in a society that doesn't have any words to condemn immoral action that is consensual in nature.
00:03:14.000And so we talk about rape when rape is actually not the thing that is in evidence.
00:03:18.000So, in this particular case, there's literally no evidence other than the revised testimony of this woman in a civil suit that the men did anything illegal under New York law.0.99
00:03:26.000There's lots of evidence that they're scumbags.0.96
00:03:27.000There is no evidence of actual rape other than what she is saying now, two years later.0.99
00:03:41.000Having sex with a highly intoxicated woman, not knowing her, not being in a relationship with her, not caring about her, treating her as an object.
00:03:48.000With multiple men participating, the word for that is evil.0.97
00:03:54.000And they would be scorned in any normal society by any decent community.
00:03:58.000That is not the same thing as illegal.
00:04:00.000It's a meaningful distinction because the left is now trying to claim that these men not being prosecuted is an indictment of the supposed American patriarchy that has somehow, as AOC says, insinuated itself into Cornell University.
00:04:13.000Okay, I want to start again with the timeline here so we know what we're talking about.
00:04:16.000So let's start with what she originally complained back in November of 2024 when she went to the PD.
00:04:23.000So the DA summarized that six page complaint at the time.
00:04:26.000Apparently, this Jane Doe went to a fraud house called Kai Phi on October 19th, 2024.
00:04:32.000To see a man she had been texting during the preceding week.
00:04:35.000In her complaint, she characterized herself as being about five out of 10 intoxicated when she arrived.
00:04:40.000And according to the DA, who again is describing her statement, she did not describe herself as incapacitated or unable to control her behavior at that point.
00:04:49.000So this guy who she'd been texting proposed a threesome.
00:04:51.000Now, again, at this point, you have a lot of scummy behavior, a lot of scummy behavior.0.95
00:05:06.000Okay, so that's where we are in the story.
00:05:07.000According to the statement, her friend asked whether she would be interested in having a threesome with another frat member, and then she said yes, which again, that's called consent.0.98
00:05:15.000And now, again, the guy's a scumbag, and she's engaging in some pretty bad behavior here, according to her own complaint, but that's not illegal.0.97
00:05:23.000The statement, by the way, reportedly described her as being, quote, pretty okay with having this threesome.0.98
00:05:29.000So the DA, because his job is to enforce the law to prosecute crime, characterized this as an affirmative indication of consent.
00:05:36.000Which, when you say you're pretty okay with a thing, that is affirmative indication of consent.
00:05:42.000Now, again, this is the problem for the left.
00:05:44.000I have no problem morally condemning everything that's happened so far in this story.
00:05:48.000I can say these men should not have asked for or participated in this consensual sexual encounter because they are violating something basic about manhood the protection and defense of women.1.00
00:06:31.000She apparently voluntarily took ketamine.
00:06:33.000The statement, the original statement says that she remembered having taken ketamine earlier that night already.
00:06:39.000She couldn't remember exactly where or when.
00:06:41.000And then, when another man asked if she wanted to do more, according to her original complaint, she apparently thought, in substance, she'd already done ketamine.
00:06:50.000According to her own complaint, the man put a line of ketamine on his private and invited her to snort it, and then she did so voluntarily.
00:06:56.000And I have all sorts of moral language that I can use to describe this kind of behavior by both her and by the men.
00:07:01.000Within the boundaries of consent, they could consent to all of this, and I can still say consent is not the final arbiter of moral decency.
00:07:07.000Okay, now, as we'll see, she's now changed large swaths of this story in her new complaint.
00:07:14.000Okay, so back to her original complaint.
00:07:19.000After the ketamine, she says that her self described intoxication level rose to eight out of 10.
00:07:24.000And at this point, she began having difficulty remembering portions of what happened.
00:07:28.000Now, the DA's statement acknowledges that the police statement contained memory gaps, but those memory gaps were not interpreted as proof, per se, that she was unconscious or physically helpless at the time, because if she has a memory gap and there's no memory of her being raped, While unconscious or physically helpless, you don't have proof of the thing that happened.
00:07:46.000That distinction is pretty important, legally speaking.
00:07:50.000Again, here's the thing when you're talking about legal matters, you have to put on your lawyer hat.
00:07:53.000And when you are talking about moral matters, you should put on your decent person hat.
00:07:57.000But the left has no decent person hat when it comes to this sort of stuff.
00:08:00.000So they can only put on the legal hat and then misinterpret things.
00:08:07.000She engaged in sexual activity with many of them.
00:08:09.000She did not describe in the complaint what happened as a gang rape.
00:08:13.000Furthermore, in the original complaint, she says that when she said no to things, they stopped.
00:08:19.000According to the DA's description of her original complaint, Jane Doe did refuse some sexual requests.
00:08:24.000So apparently, one man woke up and wanted to participate and asked about turning the encounter into a foursome, and she said, Hell no.
00:08:31.000And she did that because it would have, not to get graphic, it would have meant that she would have had to participate in forms of sex that she did not wish to participate in.
00:08:40.000And if you know basic human biology, you'll kind of understand what we're talking about here.
00:08:46.000And again, this matters because if the entire basis of a rape charge is violation of consent, this is an example of her saying no and the men involved not taking advantage of her after that.0.97
00:08:58.000There's another man who came in and she pushed him away.
00:08:59.000Again, more evidence that she had the ability to consent or not.
00:09:03.000According to the DA, according to the DA, there was no evidence in her statement that she clearly expressed she did not consent to sexual activity that occurred.
00:09:11.000And according to her own statement, when she asked sexual activity to stop, it stopped.
00:09:15.000She didn't say she was drugged against her will.
00:09:17.000She said she arrived and voluntarily took drugs and had taken drugs beforehand.
00:09:20.000So, again, in summary, according to the DA, this is the original statement back in November of 2024.
00:09:26.000Here are all the things that she didn't say that she was drugged secretly or given ketamine, that she didn't know what she was taking, that she was incapacitated in any way, that she was unconscious.
00:09:36.000So, you know, all the predicates to an actual legal charge.
00:09:40.000She had memory gaps, but memory gaps don't actually prove rape.
00:09:42.000Lots of people have memory gaps and they weren't raped during the memory gap.
00:09:46.000The encounter ended at 5 45 a.m., apparently.
00:09:48.000That's when she decided she was tired and wanted to go to bed.
00:09:51.000She was involved in sexual activity with two men at the same time, apparently.
00:09:54.000And when she said she was done, again, they stopped.
00:09:57.000There's no allegation of force anywhere in the original complaint.
00:10:01.000Now, there is an evocative piece of evidence a text thread from about 1 40 a.m. involving members of Ki Fi who basically started texting each other saying, There's a girl here and she's giving it away.
00:10:12.000Now, that text thread was not part of the original complaint because she didn't know about the text thread at the time.
00:10:17.000And the police didn't know about the text thread at the time.
00:10:20.000The question is whether this text thread is evidence of rape or whether it's just men being evil and taking advantage of a girl who's making terrible decisions.
00:10:29.000Okay, so here is what the text thread actually said.
00:11:19.000And then there are degree specific legal elements.
00:11:21.000First degree rape requires forcible compulsion, physical or direct violence or force, threats of death or physical harm, and physical helplessness.
00:11:29.000The victim is unconscious, asleep, or incapacitated to the point of unawareness.
00:11:32.000Okay, so this does not fulfill first degree.
00:11:37.000And that requires that you have to drug somebody without their consent.
00:11:39.000So if somebody took drugs and then consented, that does not fulfill second degree, which is what appears from the original complaints to have happened.
00:11:46.000Third degree requires compulsion without violence or physical force.
00:11:51.000So that would be like she says no, and then they ignore her no and keep going.
00:11:55.000Nothing in the original complaint fulfills any of these elements.
00:12:20.000It beggars the imagination that Cornell would ignore serious allegations.
00:12:25.000Of rape based on their own perspective on sort of Me Too issues.
00:12:29.000According to Cornell, they conducted a thorough Title IX investigation, which is separate from a criminal proceeding over the course of several months.
00:12:35.000During that investigation, temporary suspensions and other restrictive measures were used.
00:12:39.000After investigation and pursuant to federal law, the matter was sent to a hearing where a panel of trained faculty and staff heard evidence over multiple days.
00:12:46.000The complainant and respondents had the opportunity to testify and present evidence.
00:12:50.000At its conclusion, the hearing panel issued a range of sanctions, which included expulsions and suspensions from Cornell.
00:12:56.000None of the individuals charged were offered the opportunity to write essays as a sole consequence of their involvement.
00:13:01.000In addition, the involved fraternity chapter was closed in 2024 and remains barred from campus.
00:13:07.000And they deny that there are no consequential punishments for the people who are involved.
00:13:12.000Okay, so that's what happened back in 2024.
00:13:17.000And now she has filed a civil complaint, and her civil complaint rewrites the entire story.
00:13:22.000According to her civil complaint, again, this is the new one, she says, That she drank vodka at the Tri Delta sorority house before she went to a Tri Delta event at a bar.
00:13:33.000At the bar, the complaint says she was visibly intoxicated and had her hands marked with an X because she was under 21, but was served alcohol nevertheless.
00:13:42.000Apparently, at 10 30 to 11, according to the new complaint, she left the bar and then she stopped at another bar and then she went to the Kaifai house to see her friend.
00:13:52.000The complaint now describes her as stumbling and visibly intoxicated when she arrived.
00:13:55.000Now, again, that is different from the original complaint where she said she was five out of 10 intoxicated, but capable of.
00:14:33.000Embarrassment would cause you to make yourself more culpable two years ago, but less culpable now.
00:14:38.000The other possibility is that she is now embarrassed of behavior that she engaged in.
00:14:42.000And so she's re remembering exactly what happened in a way that is more flattering to her own sensibilities.
00:14:46.000There are a bunch of possibilities here.
00:14:48.000The bottom line is going to be very, very hard to evidence any of this at this point, which is why reopening an investigation on the basis of no new evidence is kind of insane.
00:14:57.000So now she says that she was already incapable of consenting again by like 11 30 p.m.
00:15:03.000And then she says that they pressured her into taking drugs and that they supplied her with marijuana and high proof liquor and that sexual activity began without her consent and she was groped and then she was the victim of sexual activity without her consent by multiple men.
00:15:26.000So the complaint alleges that the men gave her ketamine throughout the night and that all seven men who were involved were eventually present and participated in sexual misconduct.
00:15:38.000And again, her claim is now that she was gang raped all night long.
00:15:44.000Suffice it to say, these are two very separate fact patterns, two very, very different fact patterns.
00:15:50.000And there is going to be almost legitimately no way of determining which fact pattern is true.
00:15:56.000She did file a police report back in 2024, and nothing that she's saying now is kind of in the new police report.
00:16:02.000None of this is exculpatory for the behavior of the men, but just on a legal level, on what basis are you reopening this case?
00:16:09.000First of all, when you have DAs openly acknowledging they're reopening cases based on public pressure, that is a violation of due process of law.
00:16:16.000It should not be that if people scream outside your office long enough that you end up with a prosecution.
00:16:22.000So, the Tompkins County DA, Matthew Van Hooten, put out a press release.
00:16:26.000And here's what he said Jane Doe's sworn statement in November of 2024 did not allege that she was drugged against her will or gang raped.
00:16:32.000On the contrary, Jane Doe's statement described her participation in drug use and sexual conduct as voluntary, conscious, and consensual.
00:16:39.000My office obviously did not and could not have based our November 2024 decision on the allegations in a civil lawsuit that would not be filed until nearly two years later, right?
00:16:47.000He's saying, listen, I mean, she's making totally different allegations now.
00:16:50.000If this had been the allegation in 2024, things go very different.
00:16:54.000Furthermore, says the DA, I have never been contacted by Jane Doe's attorneys at all, not to inform me the original statement was inaccurate, not to ask me to reconsider our decision.
00:17:02.000Rather, I reached out to Jane Doe's attorneys after the lawsuit was filed to understand the discrepancy between the original statement and the lawsuit's allegations and the proper path forward.
00:17:10.000So, again, she's not attempting a new criminal charge.
00:17:13.000She's not going to the police now and saying, hey, I screwed it up the first time.
00:17:21.000She filed a civil suit that is totally 100% different than the original police complaint.
00:17:26.000And now the DA under public pressure is going to her to try to reinitiate an investigation based on public pressure.
00:17:32.000This is like a basic, basic violation of due process of law.
00:17:36.000As the DA says, there is no evidence in Jane Doe's statement indicating she clearly expressed that she did not consent to the act.
00:17:42.000According to the statement, each time Jane Doe asked to stop the sexual conduct, the sexual conduct stopped.
00:17:47.000Thus, with no evidence of a lack of consent, criminal charges simply could not be sustained.
00:17:51.000To instruct otherwise would have been to violate my prosecutorial obligations under New York state law.0.97
00:17:56.000While the behavior of certain chi fi frap members was without question disgusting and morally reprehensible, the foundation of the criminal justice system is that criminal prosecutions must be based upon evidence and not emotion.0.99
00:18:07.000And then he says, at the same time, I recognize the reality it can take years of therapy and healing for victims of sexual assault to fully process and understand what happened to them.0.99
00:18:15.000Seeking justice sometimes requires us to reconsider or reopen cases when we are provided with additional evidence.
00:18:21.000I've been asked by the community to revisit the decision, not by the alleged victim, by the community.
00:18:26.000No, This is not the way law and order works.
00:18:30.000I've been asked by the community to prosecute this thing that the victim does not even allege in criminal filings happened.
00:18:37.000I don't even know how you sustain a justice system on this basis.
00:18:39.000We'll get to more on that in just a moment.
00:18:41.000Okay, so you go normally when you are looking for cell phone coverage, you go to the store and they offer you 10 different plans.
00:19:41.000There's one thing in your individual life that you can do to game for the fact that all of us are mortal, and that is get the life insurance you need.

00:29:40.000And the systemic problem in college campuses, as well as many other institutions beyond college, too, in the workplace and whatnot, is that sexual violence rarely gets accountability.
00:30:02.000Yeah, I'm just going to point out at this point, Hassan Piker is also the same person who said, like a couple of years ago, that it's preferable that wealthy women get raped in college.0.83
