00:01:37.000 So far, so far, earlier this week, we very bluntly and clearly said, I don't know if Greg Abbott has what it takes to continue to secure the southern border of Texas.
00:01:47.000 And to be clear, Governor Abbott is being very, very crafty.
00:01:50.000 The U.S. Supreme Court in spirit, not necessarily in the text, said that Texas, securing the border, that Border Patrol can come in and cut the wire.
00:02:00.000 But Governor Abbott is thinking like a very effective lawyer, looking for loopholes and weaknesses.
00:02:09.000 The Supreme Court technically did not order saying that Texas can't do anything.
00:02:14.000 It just says that the Border Patrol can go and cut the wire.
00:02:18.000 And they gave the Biden administration permission to do something.
00:02:21.000 That's totally different.
00:02:22.000 So the Biden administration was hoping that Greg Abbott wouldn't actually read this decision and would just basically vacate from the border.
00:02:32.000 Now, I want to just get down to the technical essence here.
00:02:35.000 Border Patrol is allowed to go cut razor wire and never said that Texas is not allowed to add more razor wire or add more National Guard troops or continue to do what they're doing.

00:02:47.000 It was a two-sentence statement and it still is pending the Fifth Circuit Court.
00:02:53.000 And Greg Abbott is seizing on this.
00:02:56.000 He is seizing on it to his great credit.
00:02:59.000 He very easily could have backed off, but he read the decision.
00:03:02.000 He said, this is a little murky.
00:03:03.000 It's a little uncertain.
00:03:05.000 And the Biden administration currently is blinking.
00:03:10.000 They are blinking because of Donald Trump.
00:03:13.000 They're blinking because of this next election.
00:03:15.000 And Greg Abbott is calling their bluff.
00:03:17.000 Here's what Greg Abbott has done: he's adding more wire.
00:03:22.000 He's adding more reinforcements on the border.
00:03:24.000 He's adding more people, National Guardsmen, saying that we have the right to repel invasion.
00:03:29.000 Now, he's a lawyer.
00:03:30.000 He knows what he's doing here.
00:03:32.000 And he's playing with fire.
00:03:33.000 It's a little bit risky.
00:03:35.000 He's not outright defying the Supreme Court, but he's certainly pushing back against the essence and the spirit of what the Supreme Court has been issuing.
00:03:45.000 The Biden administration, though, is blinking because we're in an election year.
00:03:51.000 And Mayorkas and Joe Biden say, oh boy, do we really want footage of Border Patrol cutting razor wire and allowing illegals to come in?

00:04:03.000 But now that 12% of the American people approve Joe Biden's handling of the border, Greg Abbott is basically begging for the optics of Joe Biden to bring in the federal government.
00:04:16.000 Greg Abbott is being rather prudent here.
00:04:18.000 He's not escalating this all at once.
00:04:20.000 It's a little here, a little here.
00:04:22.000 You force Biden to be the one acting in a crazy, irrational manner.
00:04:26.000 You want to be the cooler head in the room.
00:04:29.000 You want to be the more reasonable person.
00:04:32.000 The Supreme Court gave Biden permission to do something.
00:04:35.000 The Supreme Court said, go ahead, Biden, you can go in and cut razor wire.
00:04:40.000 But Biden hasn't done it.
00:04:42.000 We're here on Thursday, and Biden hasn't deployed federal agents to go cut razor wire.

00:04:49.000 The Supreme Court did not explicitly say that Texas has no right to defend and protect itself.
00:04:55.000 And so Greg Abbott is, he's playing both sides of this.
00:04:58.000 The Democrats are the ones that are overreaching.
00:05:01.000 The Democrats are now the ones that are talking irrationally.
00:05:04.000 And Greg Abbott, he is surprising me.
00:05:07.000 I expected, I will fully acknowledge when I'm wrong.
00:05:11.000 I expected full and complete surrender from Greg Abbott.
00:05:15.000 I did not expect this sort of weaving and dodging and craftiness.
00:05:20.000 I kind of like it.
00:05:23.000 He's protecting our constitutional system, and yet he's also saying that there's nothing that prohibits Texas from putting up new wire.
00:05:32.000 He's begging Biden to give Donald Trump a campaign ad of the federal government coming in and cutting wire.
00:05:39.000 And he's basically sidestepping the essence of the Supreme Court saying, no, no, no, no, we're still in charge.
00:05:44.000 Texas can do this.
00:05:46.000 The bad guys are openly comparing this to how Eisenhower nationalized the Arkansas Guard during school desegregation.
00:05:55.000 And the key difference is that Eisenhower stepped in to protect the rights of black students.
00:06:00.000 Biden would be stepping in to enable an invasion by foreigners.
00:06:04.000 And I've been very, very critical of Greg Abbott, but he surprised me.
00:06:08.000 We have not seen the capitulation that I thought I'd see these last couple of days.
00:06:13.000 Now, has this stopped the invasion?
00:06:15.000 Is he doing enough yet?
00:06:16.000 No.
00:06:18.000 But something is changing, everybody.
00:06:20.000 Something is changing.
00:06:21.000 This is a different tone.
00:06:22.000 This is a different rhetoric.
00:06:24.000 This is a different approach than what we have seen from the traditional Republican establishment.
00:06:31.000 And I do put Greg Abbott in the establishment.
00:06:35.000 Something has changed.
00:06:37.000 There has been a profound attitude shift.

00:06:43.000 Texas is doing is just very simple.
00:06:46.000 And that is because the Biden administration has really truly abdicated its responsibility to secure the border and enforce the laws.
00:06:56.000 Texas very simply is securing the border.
00:06:59.000 And so we put up the razor wire that we're talking about, Bill, and we put up all these barricades that actually have denied illegal entry.
00:07:07.000 And as you pointed out also in that screen, there are criminals coming across our border.
00:07:11.000 Texas has a right as a state to stop criminals from coming into our state.
00:07:19.000 And Joe Biden actually does have an option here.
00:07:22.000 Joe Biden's option is to enforce the laws of the United States and stop this illegal entry.
00:07:28.000 I got to give him credit.
00:07:30.000 That's a great argument.
00:07:31.000 He's putting the burden of unreasonable behavior on Biden.
00:07:35.000 He's putting the law and the moral argument in one.
00:07:38.000 And he's right.
00:07:39.000 There is a clause that says that you can repel invasion.
00:07:44.000 And he's also not defying what the Supreme Court said.
00:07:47.000 Because look, we all know where this leads us.
00:07:49.000 This is why we, this is exactly why we played around with this the other day.
00:07:55.000 And this is exactly why the other day we said, boy, we do not take the idea of defying the Supreme Court lightly.

00:08:07.000 It says, if the federal government actually wants to come and start cutting razor wire, you can do it.
00:08:13.000 Mind you, what's important, and I missed this the other day and I want to correct the record.
00:08:18.000 It didn't say that you must cut the razor wire.
00:08:20.000 I missed it.
00:08:21.000 I'll be honest.
00:08:22.000 I've reread it.
00:08:23.000 In the spirit of all of it, having reread the decision, it felt as if the Supreme Court was saying you must remove the razor wire.
00:08:31.000 No, it said if the federal government chooses to remove the razor wire, it can.
00:08:37.000 That's still an insane decision, honestly.
00:08:40.000 But it's a big difference.
00:08:42.000 It doesn't say you can't have the razor wire there.
00:08:46.000 It says that there is federal supremacy over that.
00:08:49.000 Again, that is a little bit murkier legally than I want to get into because a state should be able to say to the federal government, we're being invaded.
00:08:58.000 Stop getting in the way of us doing our job.
00:09:00.000 That's essentially what the struggle is there.
00:09:02.000 However, Biden has yet to call the bluff.
00:09:05.000 Biden has the Supreme Court green lighting the elimination of the razor wire.

00:09:40.000 As soon as they cut the wire, 30 minutes later, Texas should go put up more because the Supreme Court didn't say you can't do that.
00:09:47.000 So the Texas agents can watch it and just say, okay, thanks, Border Patrol.

00:09:54.000 And then they'll leave and they'll put more up.
00:09:56.000 Say, you got to come back tomorrow every single day.
00:09:59.000 Make Joe Biden deploy his federal agents every day, every single day, every single day, every single day.

00:10:12.000 And Abbott has gamed this out to his credit to a certain extent.

00:10:21.000 He's coming across as a concerned governor.
00:10:24.000 I don't know if I would have saw this out of Governor Abbott a couple years ago.
00:10:28.000 I think Abbott would have said, let's just wait for the Fifth Circuit to settle it.

00:12:40.000 We have moved the Overton window and this show and Bannon's show and Jack Pesobic's show have played a big role.
00:12:50.000 And I will, I have this hypothesis that is getting, I think, being proven correct every single day, which is with the liberation of Twitter, you're going to see bolder action and more eyes opened.

00:14:16.000 Governor Greg Abbott's communications director opens up Twitter on the way to work.
00:14:21.000 Their interns are looking through Twitter.
00:14:23.000 They are consuming information from this program, from Jack Pesobic, from Matt Walsh.
00:14:29.000 They're consuming information from Dan Bongino, and then they relay it back to Governor Abbott.
00:14:33.000 And Governor Abbott says, well, where is the average conservative on this?
00:14:37.000 And they say, well, honestly, like, I've never seen such chatter and rancor and demand to secure the border.
00:14:42.000 So then Governor Abbott sees the vibe and he parallels and mirrors the vibe that you guys are communicating.
00:14:49.000 Because this letter from Governor Abbott is, it is a step up above anything I have seen him say or do.
00:14:58.000 Now, part of it, to be perfectly honest, is because the crisis is worse than ever.
00:15:02.000 Let's not get too ahead of ourselves.
00:15:04.000 Let's not get so enthusiastic.
00:15:06.000 The crisis is so bad, it necessitates this.
00:15:10.000 Is Governor Abbott doing enough?

00:15:16.000 Let me read this letter.
00:15:17.000 It's an extraordinary letter by Governor Abbott.
00:15:20.000 And it was written yesterday, viewed 37 million times.
00:15:25.000 The federal government has broken the compact between the United States and the states.
00:15:28.000 Correct.
00:15:29.000 The executive branch in the United States has a constitutional duty to enforce federal laws protecting states, including immigration laws on the books right now, Governor Abbott writes.
00:15:38.000 President Biden has refused to enforce those laws and has even violated them.
00:15:43.000 The result is that he has smashed records for illegal immigration.
00:15:47.000 Despite having been put on notice in a series of letters, let me pause here.
00:15:51.000 Let me tell you why I like Greg Abbott saying this.
00:15:54.000 He's putting the ball in Biden's court.
00:15:57.000 So it's an independent-minded person.
00:15:59.000 They read this and they want to side with who is more reasonable.
00:16:03.000 They don't want the person that is overreacting.
00:16:05.000 They don't want the person that is emotional.
00:16:08.000 And so Governor Abbott says, Despite having been put on notice in a series of letters, one of which I delivered to him by hand, President Biden has ignored Texas's demand that he perform his constitutional duties.
00:16:22.000 So basically, Governor Abbott is reminding you and reminding the person that is reading this that might not be into politics.
00:16:30.000 Wow, he delivered a letter by hand to the president and still being ignored.
00:16:34.000 He is coming across as the more reasonable person in this dispute.
00:16:38.000 He writes, President Biden has violated his oath to faithfully execute immigration laws enacted by Congress.
00:16:44.000 Instead of prosecuting immigrants for the federal crime of illegal entry, Biden has sent his lawyers in the federal courts to sue Texas for taking action to secure the border.

00:16:53.000 And by the way, Ken Paxton deserves a lot of credit here as well.
00:16:56.000 A lot of credit.
00:16:58.000 And Paxton being liberated is a big part of this.
00:17:01.000 Biden has instructed his agencies to ignore federal statutes that mandate the detention of illegal immigrants.
00:17:06.000 The effect is to illegally allow them on mosque parole into the United States.
00:17:11.000 And I'm going to keep going into this letter because it isn't as much about Abbott as it is you being the tip of the spear, leading public opinion and him mirroring it back to you.

00:19:22.000 Continues: By wasting taxpayer dollars to tear open Texas's border security infrastructure, Biden has enticed illegal immigrants away from the 28 legal ports of entry along this state's southern border, bridges where nobody drowns, and into dangerous waters of the Rio Grande.
00:19:40.000 Greg Abbott continues, Biden's lawless border policies, more than 6 million illegals have crossed into our southern border in just the last three years.

00:19:52.000 That is more than the population of 33 different states in this country.
00:19:57.000 This illegal refusal to protect states has inflicted unprecedented harm on the people all across the United States.
00:20:05.000 From James Madison to Alexander Hamilton and other visionaries who wrote the U.S. Constitution, they foresaw that states should not left to be to the mercy of a lawless president who does nothing to stop external threats like cartels smuggling millions of illegals across the border.

00:20:22.000 It's very smart what Abbott is doing here.
00:20:25.000 He is pointing to the founders.
00:20:28.000 He's pointing to the framers.
00:20:31.000 He's getting back to first principles.
00:20:33.000 He's getting back to the core and fundamental contract that keeps us a republic.

00:20:40.000 It's very well written, Governor Abbott.
00:20:42.000 He says, quote, this is why the framers included both Article 4, Section 4, which promises that the federal government shall protect each state against invasion.
00:20:53.000 And Article 1, Section 10, Clause 3, which acknowledges the state's sovereign interest in protecting their borders.
00:21:00.000 Arizona of the United States, 567 U.S. 387419-2012, Scalia dissenting.
00:21:07.000 That's interesting.
00:21:08.000 Scalia dissented on that?
00:21:09.000 You know what?
00:21:10.000 That's right.
00:21:10.000 That was one of his worst decisions.

00:21:13.000 I want to talk about that.
00:21:15.000 The failure of the Biden regime to fulfill the duties from Article 4 has triggered Article 1, Section 10, Clause 3, which reserves to this state the right of self-defense.
00:21:28.000 For these reasons, I've already declared an invasion under Article 1, Section 10, Clause 3, to invoke Texas's constitutional authority to defend and protect itself.
00:21:40.000 That authority is the supreme law of the land and supersedes any federal statutes to the contrary.
00:21:46.000 The Texas National Guard, the Texas Department of Public Safety, and other Texas personnel are acting on that authority, as well as state law to secure the Texas border.
00:21:57.000 Now, mind you, Governor Abbott kind of ignores the U.S. Supreme Court in this letter, which is part of the brilliance.
00:22:03.000 He doesn't defy it, but he doesn't go after the Supreme Court.
00:22:07.000 He doesn't say that they were wrong.
00:22:08.000 He just kind of says that the government's breaking the contract and he sidesteps it because the Supreme Court decision was hardly this robust, thou shall not, you shall.
00:22:19.000 And this is a theme that we're seeing from this Supreme Court, which is that the media will take the essence of a decision when in reality the decision doesn't say this.
00:22:29.000 And this particular court tends to be rather more murky than people will ever give it credit for.
00:22:35.000 And I'll give you an example on the abortion decision.

00:26:54.000 We don't want to do anything to undermine him, and he wants to campaign and center it on immigration.

00:27:06.000 As if it's some sort of quandary that the border is some sort of burden, but it is changing the politics across the board.
