00:01:37.000So far, so far, earlier this week, we very bluntly and clearly said, I don't know if Greg Abbott has what it takes to continue to secure the southern border of Texas.
00:01:47.000And to be clear, Governor Abbott is being very, very crafty.
00:01:50.000The U.S. Supreme Court in spirit, not necessarily in the text, said that Texas, securing the border, that Border Patrol can come in and cut the wire.
00:02:00.000But Governor Abbott is thinking like a very effective lawyer, looking for loopholes and weaknesses.
00:02:09.000The Supreme Court technically did not order saying that Texas can't do anything.
00:02:14.000It just says that the Border Patrol can go and cut the wire.
00:02:18.000And they gave the Biden administration permission to do something.
00:02:22.000So the Biden administration was hoping that Greg Abbott wouldn't actually read this decision and would just basically vacate from the border.
00:02:32.000Now, I want to just get down to the technical essence here.
00:02:35.000Border Patrol is allowed to go cut razor wire and never said that Texas is not allowed to add more razor wire or add more National Guard troops or continue to do what they're doing.
00:03:35.000He's not outright defying the Supreme Court, but he's certainly pushing back against the essence and the spirit of what the Supreme Court has been issuing.
00:03:45.000The Biden administration, though, is blinking because we're in an election year.
00:03:51.000And Mayorkas and Joe Biden say, oh boy, do we really want footage of Border Patrol cutting razor wire and allowing illegals to come in?
00:04:03.000But now that 12% of the American people approve Joe Biden's handling of the border, Greg Abbott is basically begging for the optics of Joe Biden to bring in the federal government.
00:04:16.000Greg Abbott is being rather prudent here.
00:06:46.000And that is because the Biden administration has really truly abdicated its responsibility to secure the border and enforce the laws.
00:06:56.000Texas very simply is securing the border.
00:06:59.000And so we put up the razor wire that we're talking about, Bill, and we put up all these barricades that actually have denied illegal entry.
00:07:07.000And as you pointed out also in that screen, there are criminals coming across our border.
00:07:11.000Texas has a right as a state to stop criminals from coming into our state.
00:07:19.000And Joe Biden actually does have an option here.
00:07:22.000Joe Biden's option is to enforce the laws of the United States and stop this illegal entry.
00:08:42.000It doesn't say you can't have the razor wire there.
00:08:46.000It says that there is federal supremacy over that.
00:08:49.000Again, that is a little bit murkier legally than I want to get into because a state should be able to say to the federal government, we're being invaded.
00:08:58.000Stop getting in the way of us doing our job.
00:09:00.000That's essentially what the struggle is there.
00:09:02.000However, Biden has yet to call the bluff.
00:09:05.000Biden has the Supreme Court green lighting the elimination of the razor wire.
00:09:30.000Now, Biden says, well, maybe tomorrow I want every citizen journalist out there, and I hope we have cameras live streaming Joe Biden deploying.

00:15:29.000The executive branch in the United States has a constitutional duty to enforce federal laws protecting states, including immigration laws on the books right now, Governor Abbott writes.
00:15:38.000President Biden has refused to enforce those laws and has even violated them.
00:15:43.000The result is that he has smashed records for illegal immigration.
00:15:47.000Despite having been put on notice in a series of letters, let me pause here.
00:15:51.000Let me tell you why I like Greg Abbott saying this.
00:15:54.000He's putting the ball in Biden's court.
00:15:59.000They read this and they want to side with who is more reasonable.
00:16:03.000They don't want the person that is overreacting.
00:16:05.000They don't want the person that is emotional.
00:16:08.000And so Governor Abbott says, Despite having been put on notice in a series of letters, one of which I delivered to him by hand, President Biden has ignored Texas's demand that he perform his constitutional duties.
00:16:22.000So basically, Governor Abbott is reminding you and reminding the person that is reading this that might not be into politics.
00:16:30.000Wow, he delivered a letter by hand to the president and still being ignored.
00:16:34.000He is coming across as the more reasonable person in this dispute.
00:16:38.000He writes, President Biden has violated his oath to faithfully execute immigration laws enacted by Congress.
00:16:44.000Instead of prosecuting immigrants for the federal crime of illegal entry, Biden has sent his lawyers in the federal courts to sue Texas for taking action to secure the border.
00:16:58.000And Paxton being liberated is a big part of this.
00:17:01.000Biden has instructed his agencies to ignore federal statutes that mandate the detention of illegal immigrants.
00:17:06.000The effect is to illegally allow them on mosque parole into the United States.
00:17:11.000And I'm going to keep going into this letter because it isn't as much about Abbott as it is you being the tip of the spear, leading public opinion and him mirroring it back to you.
00:17:26.000Okay, Kirk fans, I need you to stop and pay attention to this.

00:19:57.000This illegal refusal to protect states has inflicted unprecedented harm on the people all across the United States.
00:20:05.000From James Madison to Alexander Hamilton and other visionaries who wrote the U.S. Constitution, they foresaw that states should not left to be to the mercy of a lawless president who does nothing to stop external threats like cartels smuggling millions of illegals across the border.
00:20:40.000It's very well written, Governor Abbott.
00:20:42.000He says, quote, this is why the framers included both Article 4, Section 4, which promises that the federal government shall protect each state against invasion.
00:20:53.000And Article 1, Section 10, Clause 3, which acknowledges the state's sovereign interest in protecting their borders.
00:21:00.000Arizona of the United States, 567 U.S. 387419-2012, Scalia dissenting.
00:21:15.000The failure of the Biden regime to fulfill the duties from Article 4 has triggered Article 1, Section 10, Clause 3, which reserves to this state the right of self-defense.
00:21:28.000For these reasons, I've already declared an invasion under Article 1, Section 10, Clause 3, to invoke Texas's constitutional authority to defend and protect itself.
00:21:40.000That authority is the supreme law of the land and supersedes any federal statutes to the contrary.
00:21:46.000The Texas National Guard, the Texas Department of Public Safety, and other Texas personnel are acting on that authority, as well as state law to secure the Texas border.
00:21:57.000Now, mind you, Governor Abbott kind of ignores the U.S. Supreme Court in this letter, which is part of the brilliance.
00:22:03.000He doesn't defy it, but he doesn't go after the Supreme Court.
00:22:08.000He just kind of says that the government's breaking the contract and he sidesteps it because the Supreme Court decision was hardly this robust, thou shall not, you shall.
00:22:19.000And this is a theme that we're seeing from this Supreme Court, which is that the media will take the essence of a decision when in reality the decision doesn't say this.
00:22:29.000And this particular court tends to be rather more murky than people will ever give it credit for.
00:22:35.000And I'll give you an example on the abortion decision.
00:22:39.000If you go to a rank and file American, you say, hey, what did the Supreme Court say on abortion?
00:22:45.000They'll say, well, the Supreme Court said abortion can be illegal.
00:22:50.000While that's technically true, it actually just said that the states will determine abortion policy.
00:22:56.000So there's a lot of agency and there's a lot of state sovereignty that this particular court has decided on.
00:23:06.000To continue on this, Greg Abbott is exploiting this temporary weakness to build a consensus.
00:23:13.000And what is happening, and this is exactly what we recommended on our program and recommended on social media, and you guys were the ones really pushing this forward and you deserve the credit for this, is now other red state governors are voicing support for Greg Abbott.
00:23:28.000People that otherwise would not have been in the ballgame.
00:23:34.000Sarah Huckabee Sanders in Arkansas, Glenn Yunken in Virginia are voicing support and sending National Guard.
00:23:43.000Now, the left, as the left does, they say it's time to nationalize the National Guard.
00:25:25.000And the Democrats are not certain how to deal with this.
00:25:30.000In some way, in some form or fashion, the seat of the equivalent benefit is Greg Abbott using the Supreme Court issue to still put them on defense.
00:25:39.000And he's being very even-handed in this.
00:25:44.000I have been very, very critical of Greg Abbott.
00:25:48.000But what he's doing is he's building consensus, basically saying we have a moral, a traditional, and a historical, and a constitutional duty to defend our state from a foreign invasion.
00:26:02.000And Joe Biden is left with very few good options here because his political support is deteriorating and crumbling.
00:26:13.000I want to play this piece of tape here: Cut 126.
00:26:25.000Past few minutes, Jake Sherman with Punch Bowl News had this about a McConnell meeting with Republican senators.
00:26:31.000Senator McConnell told a closed meeting of Senate Republicans today that the politics of the border has flipped and cast doubt on linking Ukraine and the border.
00:26:43.000It quotes us him saying, when we started this, the border united us and Ukraine divided us.
00:26:48.000The politics on this have changed, he told his GOP colleagues.
00:26:51.000He said he referred to Donald Trump as the nominee.
00:26:54.000We don't want to do anything to undermine him, and he wants to campaign and center it on immigration.
00:27:06.000As if it's some sort of quandary that the border is some sort of burden, but it is changing the politics across the board.
00:27:14.000So, Joaquin Castro, remember where he said that demographics will turn Texas blue?
00:27:18.000He was bragging about how the great replacement will make Texas blue.
00:27:22.000And the fake Hispanic Irishman, Robert Francis Orwork, they are now demanding that Biden federalize the Texas National Guard, comparing this to Eisenhower nationalizing the Arkansas Guard during school desegregation.
00:27:35.000But Abbott is calling this bluff, and Biden is being taken off guard right now.
00:27:39.000Biden expected, this is why it's so important you play hardball against these guys.
00:27:44.000When you play strategic hardball, they don't know what to do.
00:27:47.000Biden is left with only escalation options.
00:27:51.000And Biden is an unpopular president who's already throwing people in jail.
00:27:56.000Peter Navarro, by the way, just got sentenced to four months in prison for contempt of Congress.
00:29:08.000And how come people can flow across it every single day?
00:29:11.000Hundreds and thousands of people over the course, 300,000 people in December.
00:29:15.000We're working very hard to try to fix that, Martha.
00:29:18.000That's why we need congressional action.
00:29:19.000That's why the president asked for additional funding, more than $6 billion in the supplemental to try to get border security enhanced.
00:29:26.000This is a complicated issue, and it's going to require a real team approach, not just from the executive branch, but from the legislative branch as well.
00:30:04.000We are far from a solution on the border, but the trend is our friend.
00:30:11.000We are seeing a change in the attitude, a change in the behavior, a change in the rhetoric from people that otherwise would run to the hills.
00:30:21.000They're leaning in, and you guys are to credit for that.
00:30:28.000Let's play some more pieces of tape here.
00:30:30.000And before I do, the states are going to be the ones that are going to have to solve this problem.
00:30:53.000Todd Bensman, who does a great job, we've had him on the program, he made a really, really smart point.
00:30:58.000He said the Biden administration's priority is to get as many foreigners into the country as possible as quickly as possible to not create the optics of people waiting in line.
00:31:08.000Now, in some ways, we've been a victim of our own media success because I would actually prefer those long lines than letting them in.
00:31:18.000Well, the reason that there used to be long lines is because they were doing DNA testing and they were doing background checks.
00:31:26.000Biden was so embarrassed by the long lines that he told Majorkas, just let them all in and stop doing all this DNA testing and stop doing all these background checks.
00:31:35.000So in some ways, we're a victim of our own media virality.
00:31:40.000Remember those huge drone shots that the great Bill Melusian had and that we would be talking about?
00:31:46.000Biden was so embarrassed and humiliated by them, they said the number one priority is we don't have the optics of huge lines and people congregating under the overpasses.
00:31:57.000And so because of that, they have stopped doing the stuff that was creating the lines in the first place.
00:32:03.000Like, hey, do you have whooping cough?
00:32:15.000Now, since Biden does not want the lines, because it looks bad, he just lets them all in as quickly as possible.
00:32:23.000Hopefully their fear of bad optics will help diffuse this situation tomorrow.
00:32:28.000So tomorrow, when Border Patrol goes to cut that razor wire, we need every single media outlet watch it, see it, have Texas watch it, say, okay, be my guest, cut the razor wire.
00:32:41.000And then 30 minutes later, repair it and put it back up again and make those government agents work overtime and go do it again.
00:32:49.000I love our government agents, but they don't love working overtime.
00:33:38.000And in many cases, Dana, they're seeking to evade apprehension simply because they are criminals like this Colombian man you're talking about, convicted of murder in his home country, now arrested by ICE in Newark, New Jersey.
00:34:21.000They think they could do whatever they want and they've taken advantage.
00:34:23.000We have these videos of people from Azerbaijan and Uzbekistan basically threatening, say that everyone's going to know my name, not to mention the hundreds of thousands of slaves that are coming into the country.
00:34:36.000And we use that word intentionally because they are, it is the new slave trade.
00:34:40.000They are bought and purchased by the cartel.
00:34:42.000Many of the children are here for sex slaves.
00:34:45.000And the Biden administration thinks that that's a wonderful thing.
00:34:48.000Hundreds of thousands of girls are purchased by these cartels, 12-year-old, 13-year-old, 14-year-old girls, rape trees on the southern border.
00:34:56.000If you don't know about it, you got to get educated on it.
00:34:58.000The southern border is the greatest humanitarian crisis in the modern era.
00:35:02.000It is the moral equivalent of the North Atlantic slave trade happening in our era and our time.
00:35:07.000And we have to be convinced by the bad guys, oh, we were such a bad country because we did slavery.
00:35:17.000And if you believe that, then why are you okay with the slavery happening right now in Eagle Pass and the slavery happening on the southern border?
00:35:25.000The Democrat Party has always been the party of slavery, and it continues today as they co-sponsor the great slave trade of the southern border.
