00:10:46.000Maybe Donald Trump had declassified documents there that they think are classified that might actually blow the top off the federal Bureau of Investigation.
00:10:54.000What if Trump had documents that they were really afraid that we're going to see the light of day?
00:11:01.000The problem with the PRA or the Presidential Records Act being the basis of this type of action is that it has not been traditionally a criminal matter.
00:11:11.000Certainly, it has not been that way for former presidents.
00:11:47.000If you would have told me 10 years ago that former presidents and members of the royal family were flying on private jets with underage women to private islands, of which was probably an intelligence operation by a foreign government to get blackmail on them, I'd say you were a conspiracy theorist.

00:12:08.000And this morning, the New York Post is now reporting that the federal magistrate in Florida, who approved this search warrant, after he left working for the U.S. Attorney's Office back in 2008, he then went into private practice and represents several associates of the disgraced financier and accused serial pedophile, Jeffrey Epstein.

00:12:37.000That's the judge that signs off on the warrant.
00:12:40.000So the precedent is that you can have the FBI show up at your home at any time when a corrupt judge signs off on it.

00:13:13.000And as a lawyer, I mean, the reason I show up on these shows is because I believe so much in the rule of law.
00:13:19.000And what it signifies to me, the news yesterday, is the Justice Department is returning to its historical position as a law enforcement agency above politics, trying to do the right thing and enforce the laws when they're violated.

00:19:58.000There are lots of questions among defense lawyers, legal experts, former and current FBI agents, wondering what went on yesterday.
00:20:06.000And the fact of the matter is, we don't have enough facts yet.
00:20:08.000I assume that the president will go to court and do a show cause and get the judge to segregate these documents and protect them for claims of privilege and other things.
00:20:21.000We've never passed an American politics, American history before, and the consequences we won't know for sure for some time.
00:20:29.000But if you look at what Democrats are saying, people like Mark Elias, they're talking about using this event as a nullification to keep President Trump from running again.
00:20:38.000So at least we know the Democrats who are often behind these things, what their motivation is.
00:21:32.000Seven years ago, this summer, this month, in fact, is when Hillary Clinton's classified emails were discovered.
00:21:39.000In that case, they didn't raid Hillary Clinton's Chappaqua home.

00:21:46.000They allowed David Kendall, Mrs. Clinton's lawyer, to take the classified information, put it on a thumb drive, put it on a safe that the FBI helped arrange for David Kendall.
00:22:08.000The office of the FBI that was involved in this raid yesterday is called the Washington Field Office.
00:22:13.000It's the one that investigates crimes from federal agencies in Washington.
00:22:16.000The National Archives is the complainant here that there are some classified documents apparently that the president took with him accidentally to Mar-a-Lago.
00:22:25.000This is the very office that one week before this raid, the Monday before last, Chuck Grassley revealed there were five or multiple whistleblowers saying that this office was infected with political bias, that there was political meddling going on, including opening a case against Donald Trump, not this case, but a different case, without the proper predicate, trying to thwart an investigation of Hunter Biden by portraying legitimate evidence as disinformation.
00:22:53.000And the allegations were so serious that the assistant special agent in charge had to be removed from the office.
00:23:00.000A week after that, while we're still trying to come to graps with the possibility that a major FBI office had political bias, that office goes out and hits one of the targets that the whistleblowers were complaining about.
00:23:15.000Now we've got to fill in the blanks about what motivated the FBI.
00:23:18.000Our first chance will be either when the president files something in court doing a show cause, or if the search warrant returns get released by the court, as they often are after a raid like this.
00:23:28.000Yeah, some people are saying, though, that this was more local and regional and not the FBI senior leadership.
00:23:33.000I find that impossible to believe, right, John?
00:23:36.000There's no way Merrick Garland did not personally sign off on this.
00:23:40.000Yeah, listen, the Attorney General guideline, this is a politically sensitive figure, right?
00:23:44.000And you're three months out from an election.
00:23:46.000This almost certainly will have gone to the Justice Department.
00:23:49.000And by the way, last night sources told me that Maine Justice approved this raid.
00:23:53.000So yes, a local judge in Florida issued the subpoena, as I understand it.
00:23:58.000But the Washington Field Office in Washington, in communication and with the blessing of the Maine Justice Department, appears to have authorized this activity.
00:24:07.000But we'll find out more over the next few days.
00:24:09.000Listen, there's a lot of facts not in evidence yet, but a lot of aberrations from normal policy, certainly from the way Hillary Clinton was treated.
00:24:16.000Let's find out what the FBI used as its excuse, and I think we'll be able to make a better judgment at that point.
00:24:24.000It's such an extraordinary, unprecedented kind of leap here.
00:24:29.000Some people say now Donald Trump should declare for president because that will keep him less likely from being indicted.
00:25:21.000This is a very extraordinary moment in history.
00:25:24.000And how the next few weeks play out, I think, will speak volumes to whether this was a political action or some legitimate legal action for which we don't know the whole story about yet.
00:25:34.000Right now, I'm leaning towards politics based on the reporting I've done today.
00:25:38.000It's just such an extraordinary intervention and the amount of force that was used.
00:25:43.000And so I want to play a piece of tape here really quick, John, for you.
00:25:50.000Let's just remind our audience: remember Chuck Schumer on Rachel Maddow's program said, you mess with the intelligence agencies, they can get back at you six ways to Sunday, play cut 46.
00:25:59.000He's taking these shots, this antagonism, he's taunting to the intelligence community.
00:26:05.000You take on the intelligence community, they have six ways from Sunday at getting back at you.
00:26:10.000So even for a practical, supposedly hard-nosed businessman, he's being really dumb to do this.
00:26:15.000What do you think the intelligence community would do if they were moving?
00:26:18.000I don't know, but from what I am told, they are very upset with how he has treated them and talked about them.
00:26:33.000Democrats have tried to weaponize the law enforcement community, the FBI, since the summer of 2016 to go after Donald Trump.
00:26:40.000So much so that whistleblowers have come forward.
00:26:44.000The one thing I saw over the last six years that was the most chilling document in my hand is the testimony of Agent William Barnett, the FBI agent who was involved in the Michael Flynn portion of the investigation.
00:26:55.000And he kept talking about watching his supervisors concoct a case when there was no evidence of any wrongdoing.
00:27:02.000He said it was like a bad game of clue.
00:27:04.000They put two people in a room and said, that's a conspiracy when there was no evidence of a conspiracy.
00:27:09.000You take that with his boss's handwritten notes, the former counterintelligence chief for the FBI, Bill Preestop, who wrote during the height of the Flynn investigation when the career agent said the law says we must shut this investigation down.
00:27:23.000The seventh floor of the FBI, Comey and McCabe, said it must go forward.
00:27:27.000And he writes on his letter, Bill Preestop writes, What is our motive here?
00:27:32.000Are we trying to get the truth or are we just trying to get somebody fired, indicted for political gain?
00:27:38.000For an FBI agent to write that in his notes tells you how much weaponization of the FBI was going on from Democrats, people like Sussman, people like Christopher Steele, the Hillary Clinton campaign.
00:27:50.000And it probably explains the smirk that Chuck Schumer has in that little segment that you just showed.
00:27:57.000John, what frustrates me is none of those people ever were properly held accountable.
00:28:00.000Peter Strzok, Lisa Page, and Durham is doing whatever Durham is doing.
