00:05:40.000 What branch of government is supreme and has the most potential power, but only if we honor it?
00:05:54.000 What branch of government has power, but only if people respect that power?
00:06:02.000 Meaning, they don't have the ability to enforce it.
00:06:08.000 In 1832, there was a famous Supreme Court decision.
00:06:14.000 It was Wooster versus Georgia, a landmark case in which the United States Supreme Court vacated the conviction of Samuel Wooster and held that the Georgia criminal statute that prohibited non-Native Americans from being present on Native American lands without a license from the state was unconstitutional.
00:06:36.000 Now, the president at the time was Andrew Jackson.
00:06:40.000 Andrew Jackson completely and fundamentally disagreed at this decision.
00:06:45.000 Andrew Jackson famously then said something that is very provocative and exposed a vulnerability in the American constitutional system.
00:06:59.000 You see, on this program, we talk about the positives and the benefits of the American constitutional system.
00:07:05.000 There is one vulnerability, and it only gets exposed if a president decides to be flippant and almost tyrannical.
00:07:16.000 Andrew Jackson looked at this decision, and he famously said, well, let Marshall send his army.
00:07:23.000 So John Marshall was the Supreme Court justice, the Chief Justice of the Supreme Court of the United States.
00:07:30.000 And what he meant by that is, make Marshall enforce this.
00:07:35.000 So what if the Supreme Court rules?
00:07:37.000 What's their enforcement capability?
00:07:40.000 What is their ability to actually make the law that they issue, the guidance they issue, enforceable?
00:07:47.000 You see, Article 1 and Article 2, the legislative and the executive branch, they have enforcement abilities.
00:07:55.000 They have checks and balances, impeachment proceedings, for example, appointments, executive control.
00:08:03.000 Each branch can check each other.
00:08:07.000 Yet the Supreme Court is only as good as the full faith and trust and confidence that we have in the U.S. Supreme Court.
00:08:18.000 The Supreme Court is only the Supreme Court if we decide to honor what it says.
00:08:27.000 If the Supreme Court were to rule, for example, on Brown versus the Board of Education, if the Supreme Court ruled on Roe versus Wade or the Supreme Court ruled on any significant court decision, and half the country said, we're not going to honor that, we're deciding we don't like that decision, the constitutional republic we enjoy will start to fall apart.
00:08:54.000 Now, on the federal level, federal agents are supposed to follow guidance from the Supreme Court.
00:09:00.000 Judges are supposed to follow guidance from the U.S. Supreme Court.
00:09:03.000 And that tradition has generally been followed.
00:09:09.000 But what happens when a president like Andrew Jackson turns to John Marshall and says, send your army, enforce it.
00:09:17.000 Come on, what's the big deal?
00:09:19.000 It's not like you're the president.
00:09:21.000 You're just the suggestion court, not the Supreme Court.
00:09:26.000 Well, in the last 24 hours, Joe Biden has pulled an Andrew Jackson.
00:09:32.000 Joe Biden has turned to John Roberts and said, John Roberts, send your army.
00:09:38.000 What are you going to do?
00:09:40.000 The U.S. Supreme Court ruled that the guidance on evictions, such as the evictions from people that are not paying their rent, can expire on July 31st, and it's going to require legislative and congressional action to renew or extend that moratorium on evictions.
00:10:04.000 So what happened is Congress decided to go on a break.
00:10:07.000 Congress just went home, which left this big opening.
00:10:12.000 Left an opening where the U.S. Supreme Court, Article 3, said, hey, this thing's going to expire, and you need to do your job.
00:10:24.000 Article 1 went home and didn't do their job.
00:10:27.000 That's the legislative branch.
00:10:30.000 So then Article 2, Joe Biden, decided to do something that is an impeachable offense.
00:10:39.000 Let me say that again.
00:10:41.000 It is an impeachable offense.
00:10:43.000 In fact, what Joe Biden did and is doing right now is constitutionally worse than anything they ever accused Donald Trump of.
00:10:56.000 And almost no one in the media is covering this.
00:10:59.000 So Joe Biden saw that the Supreme Court had a certain ruling about evictions and moratoriums.
00:11:07.000 The correct branch to solve this, the legislative branch, went home.
00:11:10.000 And what did Joe Biden do?
00:11:13.000 Joe Biden announced yesterday, I'm sorry, on Tuesday afternoon, that the Center for Disease Control issued a new order imposing a moratorium on certain evictions.
00:11:26.000 The CDC's new order is substantially similar to previous eviction moratoriums that expired at the end of July, but with one exception.
00:11:35.000 So what does that mean?
00:11:38.000 This means that Joe Biden can issue an executive order confiscating all your weapons and he doesn't care what the Supreme Court has to say about it.
00:11:46.000 What's this?
00:11:48.000 Let Roberts send his army.
00:11:52.000 Make Kavanaugh enforce, make Amy Coney Barrett enforce it.
00:11:57.000 What Joe Biden has just done and his administration is they have just said that we do not have three equal branches of government.
00:12:05.000 And they say, well, it's a crisis.
00:12:06.000 It's public health.
00:12:07.000 There's people that need help from eviction moratoriums.
00:12:10.000 That's not the way this works.
00:12:12.000 Congress, go do your job.
00:12:14.000 Go fix it.
00:12:15.000 It's not a priority to Congress.
00:12:15.000 They're not.
00:12:17.000 And it's outside of the constitutional authority and purview of the executive branch of the United States.
00:12:23.000 I cannot emphasize enough how unprecedented this is.
00:12:26.000 To have a president ignore what the U.S. Supreme Court has said and do it anyway.
00:12:32.000 So what's the Supreme Court going to do?
00:12:34.000 They're going to issue another ruling.
00:12:35.000 Joe Biden will just ignore it.
00:12:38.000 The Supreme Court will say, don't do that.
00:12:39.000 And Joe Biden will say, what's your enforcement capacity?
00:12:42.000 You don't have handcuffs.
00:12:44.000 You write papers.
00:12:46.000 Joe Biden will basically look at Article 3 and say, that's funny.
00:12:49.000 The Supreme Court is just a bunch of suggestions.
00:12:52.000 Donald Trump never did anything close to this.
00:12:54.000 When the Supreme Court spoke, Donald Trump always followed their guidance.
00:13:00.000 When circuit court judges spoke, Donald Trump followed those guidance.
00:13:05.000 Remember the travel ban?
00:13:07.000 Remember the emergency use of funds for the wall?
00:13:13.000 Joe Biden, in broad daylight, with the cover of the media, in a very technical and albeit wonky and kind of under the radar way, has just done the most blatant, unconstitutional measure via executive order of a president.
00:13:40.000 I would say sense FDR, because FDR did some really wacky and tyrannical things, and that's probably right.
00:13:47.000 Definitely Woodrow Wilson or FDR.
00:13:53.000 This is impeachable.
00:13:55.000 And yet Republicans are talking about negotiating infrastructure.
00:13:59.000 Republicans are like, yeah, let's go negotiate infrastructure with the Democrats.
00:14:02.000 While Joe Biden is ignoring and defying the U.S. Supreme Court, the kind of attitude that Andrew Jackson had towards the Supreme Court never materialized.
00:14:13.000 But guess where that attitude did end up manifesting?
00:14:17.000 Ended up manifesting in the Civil War.
00:14:21.000 It ended up manifesting in a schism of the country.
00:14:25.000 If you don't believe that the people who interpret the laws have ultimate and supreme authority, if they're nothing more than just kind of like the New York Times editorial board, oh, that's nice.
00:14:35.000 That's a nice opinion.
00:14:36.000 They're nothing more than just a bunch of talk show hosts on CNN where they have that big 95-person panel and they're all saying the same thing.
00:14:43.000 If you think the Supreme Court is just a bunch of talking heads and not the people that issue the guidance on the laws, the country is broken.
00:14:53.000 This beautiful document, the Constitution, becomes nothing more than a bunch of suggestions and we're in chaos.
00:14:59.000 I cannot emphasize enough what Joe Biden is doing here is unprecedented and it's very disturbing.

00:15:07.000 Oh, they're negotiating infrastructure with Joe Biden.

00:16:46.000 And such inferior courts as Congress may from time to time ordain and establish the judges, both of the Supreme and Inferior Courts, shall hold their offices during good behavior and shall at stated times receive for their services compensation, which shall not be diminished from their continuation in office.
00:17:05.000 Section two: the judicial power shall extend to all cases in law and equity arising in this Constitution, the laws of the United States and treaties made or which shall be made under their authority to all cases affecting ambassadors and other public ministers.
00:17:23.000 Continues by saying that the Supreme Court of the United States is the final decider.
00:17:32.000 It is the final arbiter.
00:17:35.000 Now, that wasn't always certain.
00:17:39.000 In fact, disputes amongst branches of government is to be expected.
00:17:47.000 In fact, judicial review was established in a very specific case called Marbury versus Madison.
00:17:56.000 And in Marbury versus Madison, it was a disagreement over a specific selection to a cabinet, I believe, in the Madison administration, which is why it got that name.
00:18:07.000 Now, actually, it was the predecessor, actually, if I'm not mistaken.
00:18:11.000 So it was Washington, Adams, Jefferson, Madison, Monroe.
00:18:16.000 So it was Jefferson who appointed this person, right?
00:18:19.000 And therefore, Madison wanted to remove him.
00:18:22.000 There was some tension over that.
00:18:23.000 But what happened is that this went up to the U.S. Supreme Court, where I believe John Jay was still the Supreme Court justice at the time.
00:18:31.000 Actually, Marshall might have been there at the time.
00:18:32.000 I don't know.
00:18:33.000 Jay was first, and then Marshall came.
00:18:35.000 And this idea of judicial review was established, which meant that the Supreme Court speaks.
00:18:44.000 It is final.
00:18:46.000 Marshall was chief.
00:18:47.000 Okay.
00:18:48.000 So John Jay was first and then John Marshall.
00:18:51.000 Marbury remains the single most important decision in American constitutional law.
00:18:56.000 And it basically said, once we rule, the conversation is over.
00:19:03.000 Now, mind you, sometimes the Supreme Court can rule incorrectly, like the Dred Scott decision.

00:19:13.000 But one of the reasons why our country has remained intact is because our leaders, whether they agree or disagree, they back down once the Supreme Court speaks.

00:19:27.000 He said, look, I've sought constitutional scholars to depend to find the best outcome.
00:19:33.000 But honestly, it's not going to pass constitutional muster.
00:19:38.000 So Joe Biden admits this is not constitutional.

00:19:43.000 But I'm going to do it anyway.

00:19:46.000 I've sought out constitutional scholars to determine what is the best possibility that would come from executive action or the CDC's judgment.
