00:01:52.000 Merrick Garland gets grilled.

00:01:54.000 The Craven Attorney General has lost his legitimacy, his integrity, and he is on defense.

00:01:58.000 Buckle up. 0.96

00:01:59.000 Here we go.

00:02:00.000 Charlie, what you've done is incredible here.

00:02:02.000 Maybe Charlie Kirk is on the college campus.

00:02:04.000 I want you to know we are lucky to have Charlie Kirk.

00:02:07.000 Charlie Kirk's running the White House, folks.

00:02:10.000 I want to thank Charlie.

00:02:11.000 He's an incredible guy.

00:02:12.000 His spirit, his love of this country.

00:02:14.000 He's done an amazing job building one of the most powerful youth organizations ever created.

00:02:19.000 Turning point USA.

00:02:21.000 We will not embrace the ideas that have destroyed countries, destroyed lives, and we are going to fight for freedom on campuses across the country.

00:02:30.000 That's why we are here.

00:02:32.000 Hey, everybody.

00:02:59.000 So Merrick Garland is testifying in front of Congress right now.

00:03:04.000 And not in front of the House, in front of the Senate, though, which is very important.

00:03:08.000 Let's go to Cut 64.

00:03:10.000 Senator Tom Cotton has said what we are all thinking, which is praise God and thank goodness that Merrick Garland is not on the United States Supreme Court.

00:03:21.000 Let's play Cut 64.

00:03:22.000 This is shameful.

00:03:24.000 This testimony, your directive, your performance is shameful.

00:03:27.000 That's not.

00:03:28.000 Thank God you are not on the Supreme Court.

00:03:30.000 You should resign and disgrace Judge.

00:03:33.000 You should resign and disgrace Judge.

00:03:36.000 I'm a big Tom Cotton fan.

00:03:38.000 I think he's terrific, and it's exactly right. 0.96

00:03:42.000 Merrick Garland is one of the most despicable, craven, self-righteous, arrogant, and lowlifes ever to serve as Attorney General of the United States. 0.95

00:03:54.000 And we've had some attorney generals. 0.99

00:03:57.000 Trust me.

00:03:59.000 The fact that Merrick Garland is now doubling and tripling down on the weaponization of the Department of Justice against moms and dads tells you everything you need to know.

00:04:09.000 And I am seeing here, as my friend Senator Marshall Blackburn right now is testifying, is asking questions out of Merrick Garland at the testimony.

00:04:17.000 I'm seeing Republicans start to play offense.

00:04:19.000 They realize that the rule of law has been temporarily put on life support in our country as Merrick Garland and his cartel of muscle mafia people try to put moms and dads in a headlock saying, you better not show up to school board meetings.

00:04:37.000 You better not challenge the orthodoxy.

00:04:40.000 Good old Chuck Grassley.

00:04:42.000 Now, I will say this: I rail against the establishment a lot on this show.

00:04:46.000 I rail against old bulls in the Senate that I think do absolutely nothing.

00:04:49.000 There is one man who is exempt from that: Chuck Grassley.

00:04:52.000 This guy loves his country.

00:04:54.000 He loves the Lord.

00:04:55.000 He fights for Iowa.

00:04:57.000 I'm a big Chuck Grassley fan.

00:04:59.000 And don't get on the wrong side of Chuck Grassley.

00:05:01.000 Play Cut 61.

00:05:01.000 Let me tell you what.

00:05:03.000 A vested interest in how schools educate their children.

00:05:07.000 They are not, as the Biden Justice Department apparently believes them to be, national security threats.

00:05:16.000 What is a national security threat is things like MS-13.

00:05:23.000 What is a national security threat is like our open southern borders.

00:05:29.000 What is a national security threat? 0.88

00:05:31.000 Is the federal government failing to adequately vet individuals from Afghanistan? 0.86

00:05:38.000 And what's a national security threat is the spike in violent crime.

00:05:42.000 Murders are up 30%.

00:05:44.000 That would be a good use of the federal Bureau of Investigation.

00:05:48.000 How about the child sex trafficking happening in our country?

00:05:51.000 But no, instead, they're worried that the true domestic terrorists are the ones showing up to school board meetings.

00:05:56.000 Now, this is a developing story, and I don't want to say this too preemptively.

00:06:01.000 We were planning to go to Eugene, Oregon at a certain event, and we're getting all the information put together, and I don't want to jump the gun here.

00:06:08.000 But it looks like Antifa and left-wing people were intimidating the actual hotel staff workers of where we were about to do our Turning Point USA event.

00:06:19.000 This would be the fourth hotel that would cancel us in Eugene, Oregon.

00:06:22.000 Understand how this works.

00:06:23.000 So we are doing our campus tour at Turning Point USA.

00:06:26.000 We go from Burlington, Vermont, to Waco, Texas, to Mankato to Ann Arbor, Michigan.

00:06:29.000 We're traveling the country.

00:06:30.000 We are not being deterred.

00:06:32.000 We wanted to go to Eugene, Oregon.

00:06:33.000 We're big Ducks fans in our family.

00:06:35.000 My dad, my uncle, my aunt all went to the University of Oregon.

00:06:38.000 And so after repeated cancellations, and we have a very strong chapter at the University of Oregon, we finally found a venue to do it.

00:06:45.000 And this morning, they cancel, and we're getting all the facts and everything put together.

00:06:49.000 But it looks like that the terrorists, and that's right, they're terrorists on the left.

00:06:54.000 And by the way, do you notice that Merrick Garland, there's no special committee to try to investigate them, that they were personally intimidating, harassing, and threatening the workers of the hotel.

00:07:04.000 And the hotel had to pull the plug for the well-being and the safety of the workers.

00:07:08.000 We're still confirming a lot of these details, but we do know that the venue that we were supposed to do, our campus tour stopped tonight at the University of Oregon, Eugene, canceled just like that.

00:07:17.000 And this is how it starts to go.

00:07:19.000 You're not even allowed to step foot in Eugene if you're an outspoken Christian conservative.

00:07:23.000 Not allowed to happen. 0.53

00:07:25.000 From venue after venue after venue.

00:07:27.000 So we are not taking this for an answer.

00:07:29.000 We're not taking no for an answer.

00:07:30.000 We're reaching out to churches.

00:07:32.000 We're going to go.

00:07:33.000 We're going to figure it out.

00:07:34.000 And Antifa, good luck trying to stop us. 0.97

00:07:37.000 These are degenerates. 0.98

00:07:39.000 These are lowlifes.

00:07:40.000 But now I have to hear from Merrick Garland, the Attorney General of the United States, lecture me on who the domestic terrorists are.

00:07:47.000 Meanwhile, these are the people that are going to the maids and the bellhops and the workers, the chefs at the hotel we were going to be hosting the event at, personally threatening, harassing, stalking them, following them home because Turning Point USA wanted to have a student event.

00:08:01.000 If our ideas were so bad, why do they have to try to go to such incredible means and measures to do this?

00:08:07.000 Answer, they're afraid of us.

00:08:09.000 They're so afraid of us that they try to break the back of our movement by going to personal intimidation, threats, and harassment.

00:08:16.000 The very same thing that the Federal Bureau of Investigation says that they're against.

00:08:20.000 And we're not going to back down.

00:08:21.000 That's not the way we do that.

00:08:24.000 We don't play on the terms of their engagement.

00:08:26.000 You know, some people say, well, Charlie, where are you going to go?

00:08:28.000 We'll figure it out.

00:08:30.000 We'll go to the town square and Eugene if we have to.

00:08:34.000 You're not going to let these people win.

00:08:36.000 Let's go to another cut here of Merrick Garland testifying in front of Congress as we have this developing story of where I'm going after this, because we don't really know, because we're here in Idaho, kind of in a holding pattern, obviously doing our show.

00:08:50.000 We don't know if we're going to Eugene or Salem, but we are going to, we're not going to back down.

00:08:55.000 Cut 54, Senator Dick Durbin, who is one of the least impressive people ever to serve in government.

00:09:03.000 Illinois deserves so much better.

00:09:04.000 It really does.

00:09:05.000 Says parents being violent to school boards are the same type of people we saw here on January 6th.

00:09:09.000 You hear that?

00:09:11.000 Dick Durbin trying to make the domestic terror argument.

00:09:14.000 Use the Patriot Act.

00:09:16.000 Let me ask you, Dick Durbin, the death threats we receive as conservatives, is that domestic terrorism?

00:09:21.000 Because we get them.

00:09:23.000 The threats that all of a sudden hotel workers get because they work at a holiday inn or they work at a hotel that we might host an event at?

00:09:32.000 Somehow that isn't domestic terrorism.

00:09:34.000 Play Cut 54.

00:09:36.000 These are not routine people incensed or angry.

00:09:40.000 These are people who are acting out their feelings in a violent manner over and over again.

00:09:45.000 The same people we see on airplanes and other places, same people, some of whom we saw here on January 6th.

00:09:51.000 Yeah, these are not normal people, is what Dick Durbin says.

00:09:55.000 What an unbelievable smear, lie, libel, propaganda line from a United States senator, a U.S. Senator saying, yeah, these are not normal folks.

00:10:07.000 These are moms and dads.

00:10:08.000 These are the most normal people.

00:10:10.000 I'm sorry, Dick Durbin, if not everyone can be a LGBT transgender flag-waving activist.

00:10:18.000 What is a normal person to you, Dick Durbin?

00:10:22.000 He would know a school board uprising if it hit him right on.

00:10:28.000 I would encourage Senator Dick Durbin to go show up to the District 214 and District 211 meeting.

00:10:33.000 For those of you listening on AM560, the answer in the suburbs of Chicago, go tell me if those are real voters of yours or not, Dick Durbin.

00:10:40.000 No, what's really happening here is the clampdown from the federal government of political dissidents and the allowance of legitimate domestic terrorists like Antifa that we're having to deal with now at Turning Point USA every single day.

00:10:51.000 We're not going to back down, and that's a lesson for all of you right now.

00:10:53.000 You hold the line.

00:10:54.000 You be strong and courageous.

00:10:56.000 Our students are the most courageous students in the country.

00:10:59.000 And we're not going to back down because some basement dwelling degenerates are threatening minimum wage workers at hotels.

00:11:06.000 It's not the way this works.

00:11:10.000 I want you to imagine over 100,000 Americans losing their jobs.

00:11:14.000 You can stop imagining because it's a reality.

00:11:16.000 Since 2015, over 100,000 independent farms and ranches in the United States have shut down completely.

00:11:22.000 Why? 1.00

00:11:23.000 Because foreign meat is stealing their business and robbing you of the quality and flavor you deserve. 1.00

00:11:27.000 That's why Good Ranchers is here. 0.93

00:11:51.000 Did you know the product of USA TAG has been stolen by foreign countries that hate us?

00:11:56.000 They process their meat here and they label it like it came from America.

00:12:00.000 Because of these labeling laws that favor foreign imported meat, over 100,000 independent American farms and ranches have closed since 2015.

00:12:09.000 Good Ranchers is here to put America first at the dinner table and the farmers that worked to raise the meat that we enjoy.

00:12:48.000 Check it out, everybody.

00:12:49.000 They do a wonderful job.

00:12:51.000 Goodranchers.com/slash Charlie.

00:12:56.000 I see on television, Garland, Al-Qaeda continues to present a threat.

00:13:00.000 And then, of course, picture of Lindsey Graham just pops up. 0.75

00:13:03.000 Of course, he's asking the Attorney General about Al-Qaeda.

00:13:06.000 Can we invade Iran this afternoon?

00:13:11.000 Are you willing to say that we can get an authorization to invade the entire region? 0.54

00:13:18.000 No, I'm kidding.

00:13:20.000 Lindsey, he goes both ways with me as far as good and bad.

00:13:25.000 He's just kind of like, I don't know.

00:13:30.000 He's a weather vein.

00:13:31.000 I go good cop, bad cop with Lindsey Graham.

00:13:33.000 Some people go so anti-Lindsay.

00:13:36.000 And that's not what we do here.

00:13:40.000 But I'll tell you, I couldn't disagree more with Lindsey Graham's foreign policy at times.

00:13:44.000 It's just all over the place.

00:13:45.000 All right. 0.62

00:13:47.000 So, well, thank you, Merrick Garland, for admitting Al-Qaeda's still a threat.

00:13:50.000 So are you now equating moms and dads showing up to school board meetings to Al-Qaeda?

00:13:55.000 And by the way, breaking news, I think we have a venue in Oregon.

00:13:58.000 I'm not going to tell you what it is, Antifa, because you degenerates will show up and try to smash the windows there.

00:14:04.000 We've never had an issue like this before where they threaten the maids and the hotel workers when we're thinking of showing up.

00:14:10.000 And I'm not going to tell you what the university is or what the place we're going to is.

00:14:14.000 Okay.

00:14:16.000 Let's go to so many cuts here I want to get to Cut 57.

00:14:21.000 Merrick Garland does not back down from his memorandum, even though the National School Board Association has backed down Cut 57.

00:14:30.000 Presumably, you wrote the memo because of the letter.

00:14:34.000 The letter is disavowed now.

00:14:36.000 So you're going to keep your memo going anyway, right?

00:14:39.000 Is that what you're telling me?

00:14:41.000 Senator, I have the letter from NSBA that you're referring to.

00:14:46.000 It apologizes for language in the letter, but it continues its concern about the safety of school officials and school staff.

00:14:55.000 The language in the letter that they disavow is language was never included in my memo and never would have been.

00:15:02.000 And look, it's more clear than ever that Merrick Garland is just doing the bidding and is doing the work of some staffers within the Department of Justice that want to clamp down on the most exciting grassroots political movement happening in America right now.

00:15:28.000 Let's go to Cut 56, Senator Chuck Grassley asking how Biden has inserted himself in the Department of Justice.

00:15:35.000 Remember, this used to be a huge thing with Trump.

00:15:37.000 Trump is obstructing justice.

00:15:40.000 Bill Barr is his attorney general. 0.75

00:15:42.000 All this nonsense.

00:15:43.000 Play Cut 56.

00:15:44.000 President Biden has politicized and inserted himself into the Department policymaking, notably directing the end of compulsory process for reporter records and criminal leak investigations,

00:16:01.000 and most recently, inserting himself when he said the department should prosecute anyone who defies compulsory process from the January 6th committee.

00:16:16.000 So, is Joe Biden inserting himself into the Department of Justice?

00:16:21.000 Remember, we learned under Obama that Loretta Lynch and Lois Lerner and Eric Holder were always in constant collusion with the Obama White House.

00:16:31.000 That Obama used the Department of Justice as a political enforcement tool of the Democrat Party.

00:16:40.000 Remember the Internal Revenue Service, the IRS scandal where they targeted conservative and Christian groups, held their nonprofit status in jeopardy, audited them unnecessarily.

00:16:50.000 The weaponization of the centralization of government through this autocratic, tyrannical worldview is more present than ever under this current regime.

00:17:03.000 What is the difference between Obama and Biden?

00:17:06.000 We've talked about this before.

00:17:07.000 Is the regime moving too fast?

00:17:10.000 And why has this regime and the Biden group, why have they been so impatient?

00:17:16.000 And they're starting to get serious backlash against this.

00:17:20.000 That they realize that any sort of coalition that they put together is collapsing underneath them.

00:17:25.000 Meanwhile, I have to be lectured by this 14-year-old named John Ossif, who shouldn't be a U.S. Senator at all, never held public office prior to U.S. Senate bid.

00:17:36.000 That whole thing was because of Zuckerberg, mail-in balloting, signature verification, and bad candidates that we ran up against John Ossif.

00:17:45.000 Never should have been a U.S. Senator.

00:17:46.000 It makes me sick to my stomach that that's the case.

00:17:50.000 Did you know that if you shop at Nike, they turn around and give your hard-earned dollars to pro-abortion groups like Planned Parenthood and the Population Council?

00:17:58.000 Did you know that Airbnb gave $500,000 to the Marxist Black Lives Matter organization? 0.59

00:18:04.000 Your first vote is at the ballot box, but that isn't enough to defend our traditional Judeo-Christian values.

00:18:09.000 Left-wing corporations are subverting our democracy by taking money from conservative customers and giving it to radical organizations that support abortion, gun control, and critical race theory.

00:18:21.000 You have another vote, a second vote at the checkout line.

00:19:23.000 The education issue is one Democrats used to own, and we've been very involved in the education issue from Turning Point USA for quite some time.

00:19:32.000 This is how the regime will be best challenged.

00:19:38.000 You look at Merrick Garland, you look at all the people testifying, you look at the Virginia governor's race, you look what's happening.

00:19:43.000 They don't know how to handle a reignition of involvement and concern from moms and dads and parents that, by the way, otherwise they might not have actually been the biggest Trump fans in the world.

00:19:54.000 That's what's so interesting, is that the activation of the suburban woman voter against this regime is a stunning turn of events.

00:20:01.000 And it's just starting, by the way.

00:20:04.000 And Merrick Garland and Senator Ted Cruz, God bless him, cross-examining it, I think, had the line of the day where he said to Merrick Garland, if I would have, as a lawkirk for Rehnquist, put what you put in the memo as Attorney General of the United States, I would have been laughed at and I would have been thrown out of the room.

00:20:22.000 Escalation and violence.

00:20:24.000 We actually read the National School Board Association memo.

00:20:27.000 We're listed in the National School Board Association memo, turning point USA school board watch list.

00:20:33.000 And we saw very early on, we weren't the only ones, and credit to Tucker Carlson and so many other people, school board, school board, school boards, front lines for the fight for liberty.

00:20:42.000 Always peaceful, obviously, always being very respectful of the laws and the regulations.

00:20:49.000 But you better believe you're going to complain.

00:20:50.000 You're going to make some noise.

00:20:52.000 You're going to use protected, the First Amendment protected rights you have given to you by God, not by government, to speak your voice, to speak out.

00:21:01.000 In Virginia, the governor's race is super tight.

00:21:03.000 I want all of you to know next Tuesday, this coming Tuesday's election night in Virginia, we will be streaming live from the Charlie Kirk show.

00:21:10.000 I will be traveling.

00:21:11.000 I'll be in South Carolina.

00:21:12.000 We're going to have a whole setup at the Charlie Kirk show, Mission Control.

00:21:15.000 You guys can count on us for Virginia election night coverage.

00:21:18.000 Let's play Cut 53 of Yunkin's response to Biden.

00:21:21.000 So let's go actually first 52.

00:21:24.000 Biden says that extremism can come in a smile and a fleece vest going after Yunkin.

00:21:30.000 Look, Biden and this whole group, this whole coalition right now that is running the country, they don't know how to push back.

00:21:40.000 Here you got Maisie Hirono, who's probably arguing for a highway to Hawaii or something, the abolition of airplanes, or what? 1.00

00:21:46.000 Men just have to sit down and shut up. 1.00

00:21:48.000 That's Maisie Hirono. 0.99

00:21:49.000 She's now testifying.

00:21:50.000 I'm going to spare you all of that.

00:21:53.000 But for the first time in the 10 years I've been doing this, I have seen the Democrats unable to mount a counter response to a successful Republican culture war.

00:22:07.000 I want you to think about that.

00:22:08.000 Usually when we get good at one of these things, it's like they mount a counteroffensive.

00:22:13.000 The more they attack, the stronger this movement gets.

00:22:16.000 Children are the line parents will not allow to be crossed.

00:22:19.000 But Joe Biden says, well, they could be an extremist.

00:22:21.000 Cut 52.

00:22:22.000 Extremism can come in many forms.

00:22:26.000 It can come in the rage of a mob driven to assault, driven to assault the Capitol.

00:22:31.000 It can come in a smile and a fleece vest.

00:22:38.000 Either way, the big lie is still a big lie.

00:22:43.000 All they have is that one line.

00:22:47.000 That's it.

00:22:48.000 Youngkin has responded for the now battleground state of Virginia, used to be a comfortably blue state.

00:22:53.000 Education has changed that.

00:22:54.000 And we see that playing out in real time with Merrick Garland's testimony.

00:22:57.000 Play Cut 53.

00:22:59.000 Well, I just take this as the standard rhetoric from a failing campaign.

00:23:05.000 And what they're not focused on is what's really happening in Virginia.

00:23:08.000 I mean, we have parents trying to stand up for their children in school boards all over Virginia.

00:23:14.000 I mean, we saw students walking out of the classroom yesterday trying to actually just please ask school boards across Virginia to look out for their safety. 1.00

00:23:23.000 I mean, this is what this race is about.

00:23:25.000 And Terry McAuliffe can't talk about any of these things because he's on the wrong side of every issue.

00:23:30.000 Virginia, legitimate battleground state, all because of the issue of parent rights, sovereignty, choice in education.

00:23:39.000 And Merrick Garland is not backing down from this.

00:23:42.000 He says, oh, it's all because of threats of violence towards school board members.

00:23:46.000 He didn't even read the memo.

00:23:47.000 Cruz exposed that.

00:23:49.000 He believes that the greatest threat that deserves federal involvement and surveillance is parents.

00:23:56.000 And yeah, you better believe that's going to animate parents to vote against this current power structure. 0.97

00:24:01.000 And here's what is so amazing to see in real time, how imprudent this has been for them.

00:24:07.000 Let me just put this more simply and bluntly. 0.96

00:24:10.000 This has been one of the dumbest calculations I've seen by the Democrat Party in my 10 years of doing this. 0.94

00:24:18.000 They control every single chamber institution. 0.94

00:24:21.000 Now you're going to go declare war on the one constituency you guys were actually doing better with?

00:24:25.000 Be our guest.

00:24:26.000 It's backfiring and it's not going back anytime soon.

00:24:28.000 They're doubling down into oblivion.

00:25:28.000 Josh Hawley is grilling Merrick Garland.

00:25:31.000 You cannot miss this.

00:25:32.000 Cut to that if you can.

00:25:33.000 For the District of Montana.

00:25:35.000 I have not seen a memo from the District of Montana.

00:25:38.000 Not high enough priority for you?

00:25:40.000 That's not the question.

00:25:41.000 It is the question.

00:25:41.000 I don't.

00:25:42.000 Answer my question.

00:25:43.000 Is it not a high enough priority for you when you're threatening parents with 13 different federal crimes?

00:25:49.000 These aren't crimes of violence.

00:25:51.000 You've testified today you're focused on violence.

00:25:53.000 That's not what your U.S. attorneys, they work for you. 0.74

00:25:56.000 That's not what they're saying.

00:25:58.000 You haven't seen it because it's not a high enough priority or what?

00:26:01.000 Question of priority.

00:26:02.000 No one has sent me that memo, so I haven't seen it.

00:26:04.000 What do you mean no one has sent you the memo?

00:26:05.000 You run the United States Department of Justice, do you not?

00:26:08.000 There are 115,000 employees of the Department of Justice.

00:26:13.000 Indeed, and you are in charge of every one of them.

00:26:15.000 And this was a sufficiently important case that you issued a memo.

00:26:19.000 You, over your signature, issued a memo involving the FBI and the Department of Justice in local school boards, local school districts.

00:26:28.000 Your U.S. attorneys are now threatening prosecution with 13 different crimes, but it's not a high enough priority for you.

00:26:34.000 It got lost in the mix.

00:26:36.000 I'll send again.

00:26:37.000 I've never seen that memo.

00:26:39.000 That's what concerns me, General Garland.

00:26:42.000 Well, it wasn't sent to me.

00:26:43.000 I hope you will assure your constituents that what we are concerned about here is violence and threats of violence.

00:26:49.000 That only leads me to conclude.

00:26:51.000 General Garland, all I can conclude from this is either that you're not in control of your own department or that more likely what I think to be the case is that you knew full well that this is exactly the kind of thing that would happen.

00:27:05.000 When you issued your memo, when you involved the Department of Justice and all of its resources and the FBI and all of its resources in local school boards and local school districts, you knew that federal prosecutors would start collecting crimes that they could use against parents.

00:27:24.000 You knew they would advise state and local officials that these are all the ways parents might be prosecuted.

00:27:31.000 You knew that that was the likely outcome.

00:27:34.000 And that's exactly what's happened.

00:27:36.000 And we're talking about parents like Scott Smith, who's behind me over my shoulder.

00:27:39.000 This is a father from Loudoun County, Virginia.

00:27:42.000 Here he is at a school board meeting.

00:27:44.000 He was forcibly restrained.

00:27:45.000 He was assaulted.

00:27:46.000 He was arrested.

00:27:47.000 Why?

00:27:48.000 Because he went to an elected school board meeting.

00:27:51.000 He's a voter, by the way.

00:27:52.000 He went to an elected school board meeting to raise the fact that his daughter was assaulted, sexually assaulted in a girl's restroom by a boy.

00:28:01.000 This is what happened to him.

00:28:03.000 Now, you testified last week before the House that you didn't know anything about this case.

00:28:07.000 I find that extraordinary because the letter that you put so much weight on, the letter that's now been retracted, it cites this case.

00:28:14.000 It cites Mr. Scott's case directly.

00:28:17.000 There's a news article cited in the letter.

00:28:19.000 It's discussed in the letter, but you testified you just couldn't remember it.

00:28:23.000 Maybe this will refresh your memory.

00:28:24.000 Do you think people like Scott Smith, do you think parents who show up to complain about their children being assaulted ought to be treated like this man right here?

00:28:32.000 Parents who show up to complain about school boards are protected by the First Amendment.

00:28:37.000 Do you think that they ought to be prosecuted in the different ways that your U.S. attorneys are identifying?

00:28:42.000 If what they're doing is complaining about what the school board is doing, policies, curriculum, anything else that they want to, as long as they're not committing threats of violence, then they should not be prosecuted, and they can't be.

00:28:54.000 Let me ask you about this.

00:28:55.000 Several of my Democrat colleagues have today, just today in this hearing, multiple times have compared parents who show up at school board meetings, like Mr. Smith here, have compared them to criminal rioters.

00:29:05.000 You think that's right?

00:29:06.000 You think that a parent who shows up at a school board meeting who has a complaint, who wants to voice that complaint, and maybe she doesn't use exactly the right grammar, you think they're akin to criminal rioters?

00:29:14.000 Do you agree with that?

00:29:15.000 I do not, and I do not remember any senator here making that comparison.

00:29:20.000 These people are just like the folks who came here on January 6th in the riot at the Capitol?

00:29:20.000 Oh, really?

00:29:26.000 I don't think they were referring to the picture that you're showing there.

00:29:30.000 Well, I certainly would hope not.

00:29:31.000 They were referring to parents who go to school board meetings.

00:29:33.000 Mr. Smith is a parent who went to a school board meeting.

00:29:36.000 I'll leave it at this, General Garland.

00:29:38.000 You have weaponized the FBI and the Department of Justice.

00:29:42.000 Your U.S. attorneys are now collecting and cataloging all the ways that they might prosecute parents like Mr. Smith because they want to be involved in their children's education and they want to have a say in their elected officials.

00:29:54.000 It's wrong.

00:29:55.000 It is unprecedented, to my knowledge, in the history of this country.

00:29:58.000 And I call on you to resign.

00:30:00.000 Thank you, Mr. Chairman.

00:30:02.000 Senator Cruz.

00:30:06.000 Thank you, Mr. Chairman.

00:30:09.000 For eight years under Barack Obama, the Department of Justice was politicized and weaponized.

00:30:16.000 When you came before this committee in your confirmation hearing, you promised things would be different.

00:30:21.000 I asked you specifically: quote, will you commit to this committee that under your leadership, the Department of Justice will not target the political opponents of this administration?

00:30:30.000 Here was your answer: quote, absolutely.

00:30:33.000 It's totally inappropriate for the Department to target any individual because of their politics or their position in a campaign.

00:30:41.000 That was your promise just a few months ago.

00:30:44.000 I'm sorry to say you have broken that promise.

00:30:48.000 There is a difference between law and politics.

00:30:51.000 And General Garland, you know the difference between law and politics.

00:30:55.000 Law is based on facts.

00:30:57.000 It is impartial.

00:30:59.000 It is not used as a tool of political retribution.

00:31:02.000 This memo was not law.

00:31:07.000 This memo was politics.

00:31:12.000 On Wednesday, September 29th, the National School Board Association wrote a letter to the president Asking the president to use the Department of Justice to target parents that were upset at critical race theory, that were upset at mask mandates in schools, to target them as domestic terrorists.

00:31:33.000 On the face of the letter, the letter was in repeated consultation with the White House, in explicit political consultation with the White House.

00:31:40.000 That was on Wednesday, September 29th, five days later, on Monday, so right after the weekend, boom, you pop out a memo giving them exactly what they want.

00:31:53.000 Now, by the way, I understand that.

00:31:54.000 In politics, that happens all the time.

00:31:56.000 An important special interest wants something?

00:31:59.000 Sir, yes, sir.

00:32:00.000 We're going to listen to them.

00:32:02.000 Let me ask you something, General Garland.

00:32:05.000 In the letter, which you told the House of Representatives was the basis for this abusive memo targeting parents, how many incidents are cited in that memo?

00:32:18.000 I have to look back through the memo.

00:32:19.000 I can count it.

00:32:20.000 How many of them are violent?

00:32:20.000 You don't know.

00:32:22.000 Again, the general report.

00:32:25.000 How many of them were violent?

00:32:26.000 Do you know?

00:32:26.000 I don't know.

00:32:27.000 You don't know.

00:32:28.000 And there's a reason you don't know.

00:32:31.000 Because you didn't care, and nobody in your office cared to find out.

00:32:36.000 I did a quick count just sitting here during this hearing.

00:32:39.000 I counted 20 incidents cited.

00:32:42.000 Of the 20, 15 on their face are nonviolent.

00:32:46.000 They involve things like insults.

00:32:48.000 They involve a Nazi salute. 0.50

00:32:49.000 That's one of the examples.

00:32:51.000 My God, a parent did a Nazi salute at a school board because they thought the policies were oppressive.

00:32:57.000 General Garland is doing a Nazi salute at an elected official.

00:33:00.000 Is that protected by the First Amendment?

00:33:02.000 Yes, it is.

00:33:02.000 Okay.

00:33:03.000 15 of the 20 on the face of it are not violent.

00:33:07.000 They're not threats of violence.

00:33:09.000 They're parents who are unhappy.

00:33:11.000 Yet, miraculously, when you write a memo, the opening line of your memo, in recent months, there has been a disturbing spike in harassment, intimidation, and threats of violence.

00:33:23.000 You know what?

00:33:24.000 You didn't look, and nobody on your staff looked.

00:33:27.000 Did you even look up the 20 instances?

00:33:30.000 As I testified, the decision to make send the memo is for an assessment.

00:33:36.000 Did you look up the 20 instances?

00:33:38.000 I did not read them.

00:33:39.000 Did anyone on your staff look them up?

00:33:40.000 I don't know the answer, but it's but of course you don't.

00:33:43.000 In general, there's a reason.

00:33:44.000 Look, you started your career as a law clerk to Justice Brennan.

00:33:48.000 You've had many law clerks during the year, during your time as a judge.

00:33:54.000 I was a clerk to Chief Justice Rehnquist.

00:33:56.000 I'll tell you what, if I drafted an opinion for the Chief Justice and walked in and it said there's a disturbing pattern of violence, well, Ted, how do you know that?

00:34:05.000 Well, I got an abicus brief here who claims it.

00:34:09.000 You would fire a law clerk who did that.

00:34:11.000 You're the Attorney General of the United States.

00:34:14.000 This was not a tweet you sent.

00:34:17.000 This is a memo to the Federal Bureau of Investigations saying go investigate parents as domestic terrorists.

00:34:26.000 That is not what the memo says at all.

00:34:28.000 It doesn't.

00:34:29.000 Is it what the letter says?

00:34:30.000 That is not what the letter says.

00:34:33.000 I don't care what the letter says.

00:34:34.000 You don't care.

00:34:35.000 You said it was the basis of your memo.

00:34:36.000 You testified under oath before the House of Representatives.

00:34:39.000 The letter was the basis of your memo.

00:34:41.000 Now you don't care about the letter?

00:34:42.000 The letter and public reports of violence and threats of violence.

00:34:46.000 My memo says nothing about domestic terrorism, says nothing about parents committing any such things.

00:34:52.000 My memo is an attempt to get an assessment of whether there is a problem out there that the federal government needs to re-says the actions of the apparents could be the equivalent to a form of domestic terrorism and asks the president to use the Patriot Act in regards to domestic terrorism directed at parents.

00:35:13.000 This was the basis of your memo.

00:35:15.000 My memo.

00:35:16.000 The Department of Justice, when you're directing the FBI to engage in law enforcement, you're not behaving as a political operative because a political ally of the president says, hey, go attack these parents because we don't like what they're saying.

00:35:33.000 Department of Justice, you did no independent research on what was happening, did you?

00:35:39.000 The memo has nothing to do with partnerships.

00:35:41.000 Did you do independent research?

00:35:43.000 Did you do independent research?

00:35:44.000 The memo has nothing to do with ethics.

00:35:49.000 You've testified you know nothing about the violent sexual assault that happened in Loudoun County, even though it's one of the bases in this letter.

00:35:57.000 I read about it since then.

00:35:59.000 Okay.

00:35:59.000 You told the House last week you knew nothing about it.

00:36:02.000 I did not know at the time.

00:36:03.000 This week, the court concluded that a 14-year-old girl was violently raped by a boy wearing a skirt in the girls' restroom.

00:36:03.000 Okay.

00:36:14.000 The school district covered it up, released the boy, sent him to another school where he violently raped another girl.

00:36:24.000 The father, who Mr. Hawley just showed you, was the father of the first girl. 0.98

00:36:28.000 He was understandably.

00:36:29.000 Do you understand why a parent would be upset when your daughter is raped at school?

00:36:35.000 The school board covers it up and then lies to you to apologize and retract what you did.

00:36:40.000 Let me ask you something else.

00:36:42.000 A big part of this letter is that they're upset about parents not wanting critical race theory taught.

00:36:49.000 Your son-in-law makes a very substantial sum of money from a company involved in the teaching of critical race theory.

00:36:59.000 Did you seek and receive a decision from an ethics advisor at the Department of Justice before you've carried out an action that would have a predictable financial benefit to your son-in-law?

00:37:11.000 This memorandum is aimed at violence and threats.

00:37:14.000 Did you seek an ethics?

00:37:14.000 I just asked a question.

00:37:15.000 It has no predictable effect.

00:37:17.000 Did you seek an ethics opinion?

00:37:18.000 It has no predictable opinion.

00:37:19.000 Did you seek an ethics opinion?

00:37:20.000 Judge, you know how to ask questions and answer them.

00:37:22.000 Did you seek an ethics opinion?

00:37:24.000 You asked me whether I sought an ethics opinion about something that would have a predictable effect on something.

00:37:29.000 This has no predictable effect in the way that you're talking about it.

00:37:32.000 So if critical race theory is taught in more schools, does your son-in-law make more money?

00:37:36.000 If critical race theory is taught in more schools, does your son-in-law make more money?

00:37:40.000 Yes or no?

00:37:41.000 This memorandum has nothing to do with critical race theory.

00:37:44.000 Will you answer if you sought it ethics?

00:37:46.000 Will you answer if you sought an ethics opinion?

00:37:47.000 I am answering the best I can.

00:37:49.000 Yes or no?

00:37:50.000 Did you seek an ethics opinion?

00:37:51.000 This memorandum has no idea.

00:37:53.000 Did you seek an ethics opinion?

00:37:54.000 This memorandum has nothing to do with critics.

00:37:56.000 General, are you refusing to answer if you sought an ethics opinion?

00:37:59.000 I'm telling you that there's no possible concern.

00:38:01.000 So you're saying no.

00:38:02.000 Just answer it directly.

00:38:04.000 You know how to answer a question directly.

00:38:06.000 Did you seek an ethics opinion?

00:38:09.000 I'm telling you that if I thought there was any reason to believe there was a conflict of interest, I would do that.

00:38:15.000 But I cannot.

00:38:15.000 Why do you refuse to answer the question?

00:38:17.000 Why won't you just say no?

00:38:19.000 I'm sorry.

00:38:20.000 You're not going to answer the question?

00:38:21.000 I'm sorry.

00:38:22.000 Ask the question again.

00:38:23.000 Did you seek an ethics opinion?

00:38:25.000 I'm saying again, I would seek an ethics opinion in any way.

00:38:28.000 So no is the answer, correct?

00:38:30.000 There was a comment.

00:38:31.000 Senator, your time is up.

00:38:33.000 At the record, reflect the Attorney General refuses to answer whether he sought an ethics opinion.

00:38:38.000 And apparently, ethics are not a terribly high priority in the Biden Justice Department.

00:38:42.000 I don't think that's a fair reflection of what I said.

00:38:44.000 Then answer the question.

00:38:46.000 Thanks so much for listening, everybody.
