00:01:20.000 In the last week, Carrie Lake and Abe Homeday's legal challenges met a certain fate.
00:01:26.000 Now, it's not over.
00:01:27.000 There are appeals that are unfolding.
00:01:30.000 But let's start with Carrie Lake.
00:01:31.000 So last week, right, I think on Christmas Eve or the eve of Christmas Eve, Kerry Lake's lawsuit was dismissed by a judge.
00:01:38.000 I believe this ruling was incorrect, although predictable, given the lack of courage and given the lack of conviction that has unfortunately permeated the American legal community, especially judges.
00:01:51.000 The judge basically said, sure, there's a lot of things that went wrong, but there's very little evidence that this was done intentionally.
00:01:59.000 So it really is this question of incompetence versus malevolence.
00:02:03.000 Effectively, the judge said, yeah, okay, there were long lines and there were machine failures, but can you prove to me that it was done intentionally?
00:02:11.000 Of which that really is an irrelevant question, isn't it?
00:02:15.000 Why does he get to set the standard of intent?
00:02:19.000 It should be the question of impact, not the question of intent.
00:02:24.000 If the question is simply intent, then the practitioner just has to say, well, I didn't mean to do it.
00:02:30.000 I'm just kind of an idiot.
00:02:31.000 And in this case, it is so black and white, it would be as if you run somebody over with your car and there's no such thing as third-degree murder.
00:02:40.000 We're not saying necessarily there has to always be first-degree murder when it comes to elections, but there's no way to hold Maricopa County accountable at all.
00:02:49.000 There's no remedy if they just say, well, I guess I was just being an idiot.
00:02:53.000 I was driving drunk.
00:02:54.000 I didn't mean to do it.
00:02:56.000 That was basically their defense.
00:02:58.000 So Carrie Lake is now appealing to the Arizona Supreme Court.
00:03:04.000 She is appealing to the Division I of the Arizona Court of Appeals, but also seeking, quote, a direct review by the Arizona Supreme Court, either by petition for emergency transfer or by special action.
00:03:16.000 I'm not really sure what that means, maybe to hike it up even further in the courts.
00:03:21.000 Now, interestingly, let's put the Kerry Lake case on pause.
00:03:24.000 This judge ruled incorrectly.
00:03:26.000 I was not shocked by it.
00:03:27.000 Unfortunately, we see time and time again, these judges do the bidding of the feckless and corrupt regime.
00:03:35.000 But let's kind of put that on hold for a second.
00:03:38.000 What is more interesting is the recount that happened in Abraham Homiday's race, the Arizona Attorney General's race.
00:03:47.000 Now, in the Arizona Attorney General's race, a mandatory recount was necessary.
00:03:51.000 Pinal County, which is a Republican county.
00:03:54.000 It's a Republican, very rural county south of Maricopa County, did a recount.
00:04:02.000 And the recount started, and it showed Mays or Hayes or whatever her name is, I think it's Mays Hayes, whatever her name is, up 550 votes.
00:04:13.000 After the recount, it now shows that Abe Homeday trails by 250 votes, effectively eroding 45% of the lead in the Attorney General's race.
00:04:30.000 You think about that.
00:04:31.000 That's just a simple recount in one county.
00:04:35.000 Now, you look at the, it's Chris Mays, by the way.
00:04:39.000 So it's Chris Mays, who was enjoying a 500-vote lead in one county.
00:04:45.000 In one recount, you found a 300-vote discrepancy.
00:04:50.000 What do you think you would find if you did an actual audit of Pima County or Apache County or Navajo County?
00:04:59.000 That is a single county that showed a 300-vote discrepancy that was harming Abraham Homiday.
00:05:09.000 300 votes.
00:05:11.000 And so what we need now is a hand recount in every single county across Arizona, but that's probably not going to happen.
00:05:21.000 Right now, we have an attorney general's race that is within 250 votes out of 2 million votes, and they are rushing.
00:05:30.000 They are running to get this done by January 2nd.
00:05:34.000 Now, the Kerry Lake situation is critical, but it is even more egregious what is happening with Abraham Homiday.
00:05:41.000 And in many different ways, what's happening at Abraham Homiday is impacting the Kerry Lake race, where you have a 45% difference in counting votes, 45% change in the margin.
00:05:54.000 And you're trying to tell me we shouldn't go to a hand recount in every single county?
00:05:58.000 What are these judges looking at exactly?
00:06:01.000 If you're a judge, you say, oh, wow, one county, 40, one county impacted the statewide margin by 45%.
00:06:09.000 If I was a judge, I would order a recount in every single county in Cochise, in Yavapai, in La Paz, in Gila, and yes, of course, in Maricopa, but especially in the most corrupt Democrat county in Pima.
00:06:26.000 And then why not Coconino, which is another corrupt Democrat county in Arizona.
00:06:31.000 So you now have an Attorney General's race separated by a couple hundred votes.
00:06:37.000 The Pinal County recount discrepancy is shocking, according to experts in Arizona elections.
00:06:45.000 You look at this right here: the tabulation and administration issues have affected the attorney general's race.
00:06:52.000 It is now only 200 votes, more or less, that are going to impact the future of the entire attorney general's race in Arizona.
00:07:01.000 That was 500 until a single county recounts and they say, oh, sorry, now we're at 200.
00:07:06.000 And these are just recounts done with machines.
00:07:07.000 This is not a hand recount.
00:07:10.000 Abraham Homiday should be suing immediately, demanding a hand recount.
00:07:15.000 But the forces that are behind the scenes, the power, if you will, the administrators of the Arizona elections want to ram this through.
00:07:26.000 They want to jam this through.
00:07:29.000 And who is the person that is overseeing all of this?
00:07:33.000 Katie Hobbs.
00:07:34.000 Now, we said the entire time that Katie Hobbs should not be allowed to administer her own election, that Katie Hobbs should not be able to be the referee of her own Super Bowl game.
00:07:46.000 She should not be able to be the umpire of her own World Series game.
00:07:50.000 She should not be able to be the impartial mediator of a game that she is personally invested in.
00:07:58.000 Abraham Hamaday has tweeted, quote, Katie Hobbs had the results of the recount illegally sent to her office for reconciliation and accuracy when it should have gone from the counties directly to the court.
00:08:11.000 This is how Democrats operate.
00:08:12.000 They openly violate the law.
00:08:16.000 It is maddening.
00:08:17.000 And I know this creates a fair amount of cynicism, a fair amount of disgust and anger because when we break the law, when we don't even break the law, when we're suspected of breaking the law, our side goes to jail in record numbers.
00:08:33.000 When the government breaks the law, they get promoted to governor.
00:08:37.000 Katie Hobbs breaks the law.
00:08:38.000 Maricopa County breaks the law.
00:08:40.000 Stephen Richard breaks the law.
00:08:41.000 Bill Gates breaks the law.
00:08:43.000 And all they have to say is, well, I didn't mean to do it.
00:08:46.000 I didn't mean to rob the bank.
00:08:48.000 I didn't mean to run the person over.
00:08:50.000 I didn't mean to burn the house down.
00:08:53.000 Oh.
00:08:54.000 Is that a defense in criminal court?
00:08:57.000 The answer is no.
00:08:58.000 It might lower the threshold of what the state is able to prosecute you for, third-degree murder versus first-degree murder.

00:09:10.000 It's impossible, nearly impossible to prove intent 35 days after an election or 40 days after an election when they're able to burn documents and hold, withhold evidence.

00:10:36.000 The person who is suspected of murdering the four Idaho college students, which was on the verge of becoming a cold case, has been arrested.
00:10:47.000 It is Brian Christopher Koberger, 28 years old of Scranton, Pennsylvania, and is the suspect in the Idaho massacre.
00:10:57.000 Reportedly, a, again, this is all allegedly, reportedly a PhD student in criminology at Washington State University in nearby Pullman, Washington.
00:11:11.000 If we can get the picture up on screen, you'll see that the eyes are the windows to the soul.
00:11:17.000 And there's something that doesn't exactly sit right when you look at a picture of this guy allegedly murdering four college kids.
00:11:28.000 Not sure I would be thrilled to see that guy walking down the street at 3 a.m.

00:11:38.000 And it's a very sick story, by the way.
00:11:40.000 I don't know how familiar you are with that, but four murders with a knife.
00:11:46.000 And it seems to, we don't know if this guy has any connection or why he was in Scranton, Pennsylvania.
00:11:52.000 People that do a lot of damage tend to come from Scranton, Pennsylvania.
00:11:55.000 And I'm not talking about Michael Scott.

00:12:22.000 How on earth are you going to prove intent in a matter of a couple weeks when you are an outside plaintiff against the government?
00:12:32.000 All they have to do is say, well, you know, we didn't mean to do it.
00:12:36.000 All we have to say is, yeah, I mean, you know, we're just incompetent.
00:12:40.000 We're not really good at our job.
00:12:42.000 If intent is the threshold, then they just never have to admit that they were trying to ambush or sabotage this election, of which the question that needs to be answered, of which the government avoided and the judge did not do a good enough job of pinning down is: okay, why is it that the machines passed the test the night before?
00:13:11.000 Why is it the machines were working perfectly and working swimmingly?
00:13:15.000 Why is it the machines were working so well?
00:13:18.000 And then after the machines were working great the night before, 52% of them crash on election day.
00:13:28.000 Why is that?
00:13:29.000 What caused that to happen?
00:13:31.000 That was all by mistake?
00:13:33.000 That was incompetence?
00:13:35.000 No, that is too widespread to attribute to incompetence.
00:13:41.000 And what is so unfair and what is so deeply unjust is that you have an outside candidate, a citizen of Cary Lake, that is doing her best to prove this case against the government.
00:13:56.000 And the government just hides documents, withholds testimony, says, oh, yeah, this is perfectly normal.
00:14:04.000 Stephen Richard, who comes on a Zoom call on vacation.
00:14:08.000 I mean, come on, everything just worked just fine.
00:14:11.000 And that is the standard?
00:14:14.000 No, the standard should be that you had four-hour waiting lines in Anthem.
00:14:19.000 The standard should be that we have in our email inbox people that were unable to vote.
00:14:26.000 Somebody said right here, Charlie, I'm so tired of hearing about Arizona.
00:14:30.000 It's a waste of time.
00:14:32.000 I'm sorry you feel that way.
00:14:33.000 I'm going to say this as nicely as I can.

00:14:36.000 This is the future of the entire republic.

00:14:44.000 What they did in Arizona will only multiply into your neighborhood into more places and previously red states.

00:15:31.000 I hope the dog catching race in Corvallis, Oregon goes well.

00:15:35.000 I hope that a strong constitutional conservative becomes dog catcher in Corvallis, Oregon.
00:15:40.000 But I'm worried about whether or not the Republic is going to fall apart because it all goes through the railhead, the red line of state 48.

00:17:03.000 Let's go to Cut 15, Carrie Lake on the Great Steve Bannon's program about sanctions against her for Katie Hobbes lawyers.
00:17:11.000 So the question is: should now Carrie Lake's lawyers be sanctioned?
00:17:14.000 I'll be very honest.
00:17:15.000 I'm largely uninterested in this question.
00:17:18.000 I'm more interested in whether or not there will be justice to the election, but I think it's important for one minor reason: that they want to punish anybody that dares bring an election integrity lawsuit and challenges the outright injustice of what our elections have become.

00:17:40.000 And the fact that they want to say I had no merit with this lawsuit, I am standing up for the people of this state, the people who were done wrong on election day.
00:17:50.000 People of Arizona want me to stand up for them and get some answers as to what happened in our election.
00:17:55.000 We really should have our elected officials doing that.
00:17:58.000 And now they're trying to sanction me to pay for their lawyers.
00:18:02.000 This is outrageous.
00:18:03.000 The judge, by the mere fact that he allowed this case to go forward, he looked at our lawsuit, he allowed two of the counts to go forward, shows that it had merit.
00:18:13.000 So, look, this is important in this regard, okay, is that the sanctions could potentially prevent us from doing other lawsuits in the future.
00:18:27.000 For example, it creates an obligation to not be frivolous and it could create other potential bad precedents.
00:18:36.000 And so, where we are at right now is that the Abe Homiday margin was changed by 45%.
00:18:48.000 45%.
00:18:50.000 And we are likely not going to get a hand recount, even though we demand and deserve one.
00:18:55.000 Who cares if we demand one, right?
00:18:57.000 We deserve a hand recount.
00:19:03.000 You have just one county, Pinal County, which is a Republican county that miscounted their ballots by 300 votes.
00:19:12.000 Now, you might say, well, Charlie, didn't the whole state just do a recount?
00:19:14.000 No, they did a machine recount.
00:19:16.000 They just put the same ballots to the same machines the same way they did.
00:19:20.000 And it just so happens Pinal County caught that there were 300 vote.
00:19:24.000 There was a 300-vote discrepancy.
00:19:26.000 What do you think that discrepancy is in Pima County?
00:19:29.000 I would guess at least 5,000 to 6,000 votes.
00:19:31.000 How about signature verification?
00:19:33.000 And this is one of the issues of the era of mass mail-in voting.
00:19:38.000 And Mark Elias knows this.
00:19:40.000 Mark Elias has been suing and suing and suing to relax the signature verification threshold.
00:19:46.000 So, what is a signature verification?
00:19:48.000 Signature verification is: okay, let's just say my signature looks a certain way.
00:19:53.000 If I scribble, it'll get accepted even if it's remotely close.
00:19:57.000 Or there's almost no signature verification.
00:20:00.000 And so, if you have mass mail-in voting, which I can't stand mail-in voting, I think it should all be sunsetted and put out to pasture and should be taken out behind the barn, whatever sort of metaphor you want to use to get rid of something.
00:20:17.000 However, if you have mail-in voting, the only way that it could sort of work is if you have robust, stringent, and heavily enforced signature verification thresholds.
00:20:34.000 That you reject a lot of ballots, you are going to have to reject a fair amount of ballots.
00:20:41.000 If you don't do that, then you do not have any integrity in your elections at all whatsoever.
00:20:47.000 And that is exactly what we are living through right now in Arizona.
00:20:53.000 Now, by the way, the judge ruled in Kerry Lake's favor about sanctions.
00:20:57.000 She did not have to pay $200,000 to $300,000 in sanctions, but was hit with $30,000 in witness fees.
00:21:06.000 Now, mind you, Kerry Lake is still appealing through the Division I of the Arizona Court of Appeals, right?
00:21:13.000 So, look, I just want to manage expectations.
00:21:15.000 I did this throughout the first Kerry Lake challenge.
00:21:18.000 It is unlikely that this challenge will bear any fruit.
00:21:23.000 That is a tragedy.
00:21:24.000 I don't like it.
00:21:25.000 I wish it would.
00:21:27.000 But I want to make sure all of your expectations at home are properly managed and that you do not unnecessarily get your hopes up.
00:21:34.000 And you say, Charlie, you spent all this time getting my hopes up and then we just crash and burn.
00:21:39.000 I have too much respect for you and your time to do that.
00:21:42.000 But let me tell you what should happen.
00:21:45.000 What should happen is a judge should order a new election.
00:21:49.000 That's unfortunately very unlikely.
00:21:51.000 Okay, let's shift gears here.

00:21:58.000 We have one here where someone says that it was Kerry Lake's lawyer's fault that they did not do a good enough job.
00:22:05.000 Okay, I thought they did fine.
00:22:07.000 I watched a fair amount of it.
00:22:09.000 That's a tough position to be in.
00:22:10.000 We are getting a fair amount of emails of people saying they did not like the arguments that were made.
00:22:17.000 And just to be clear, and I said this from the outset, the likelihood of winning an election challenge from the beginning was very, very low.
00:22:30.000 And we did say that, and that's important because judges are unlikely to do something bold and dramatic.
00:22:38.000 Judges almost always go with what the status quo is when it comes in elections, unless, of course, it's Mark Elias suing on behalf of black disenfranchisement.
00:22:51.000 Okay, let's get to Santos.
00:22:53.000 Okay, so this is a very important story because right now, Kevin McCarthy is trying to become Speaker of the House.
00:22:58.000 Republicans are enjoying a four-seat majority.
00:23:01.000 And the New York Times decided to come out with a series of articles investigating and exposing this guy, George Santos.
00:23:13.000 So let me just be very clear.
00:23:15.000 I never heard the name George Santos before the last couple of weeks.
00:23:20.000 Yes, I know I probably should have known him.
00:23:21.000 He ran in Long Island.
00:23:22.000 He was one of the swing seats.
00:23:24.000 Not exactly a candidate I was super enthusiastic about, definitely more on the moderate spectrum.
00:23:30.000 And that's fine.
00:23:31.000 Okay, but the investigations into this guy by the media have been rather extraordinary.
00:23:38.000 And so Santos ran as first and foremost, allegedly being a gay candidate.
00:23:46.000 So that's just like the first part of it.
00:23:47.000 And we'll get into that.
00:23:48.000 So look, Santos is the newly elected representative of the New York redrawn third district, which covers portion of Queens and Long Island.
00:23:57.000 He won the race by about eight points.
00:23:59.000 Pretty amazing.
00:24:00.000 It was rated as a slightly Democrat-leaning seat beforehand.
00:24:04.000 So this was a little bit of an upset.
00:24:05.000 Santos had actually ran for this seat in 2020, but he lost.
00:24:10.000 Otherwise, nothing remarkable, but lost, but otherwise nothing remarkable really happened.
00:24:15.000 But then suddenly after he won, it comes out that almost everything in his biography is a fabrication.
00:24:22.000 So Santos claimed to be Jewish and that his maternal grandparents fled the Holocaust to come to America.
00:24:28.000 But research has shown that both of his maternal grandparents were born in Brazil.
00:24:35.000 Yeah, I don't think that's where Auschwitz was.
00:24:37.000 Incredibly, Santos told the New York Post they never claimed to be Jewish, but only Jew, hyphen-ish.
00:24:46.000 That claim is probably the only authentically Jewish thing about Santos.
00:24:51.000 It sounds like a Seinfeld joke of like, yeah, I'm sort of Jew-ish.
00:24:55.000 I'm Jewish in spirit.
00:24:58.000 But it's not just his religious background.
00:25:00.000 Santos then claimed to work in finance for government SACS and for Citigroup.
00:25:07.000 But the companies have no record of him doing so during the time he claimed to be working in the financial sector.
00:25:15.000 There's evidence that he was working as a customer service agent instead for the Dish Network.
00:25:20.000 Santos also said he got a degree in finance from Baruch College or Barak College in 2010.
00:25:26.000 But there's no record of him attending there.
00:25:29.000 And now Santos admits that he never graduated college.

00:26:24.000 There's also evidence that Santos held a fundraiser in 2017 that charged $50 admission, but then didn't forward any money to the supposed beneficiary.
00:26:34.000 Now, this is not a lie per se, but Santos has an outstanding check fraud and charge in Brazil.
