00:01:37.000 Good morning, everyone.
00:01:38.000 Welcome to the Charlie Kirk Show.
00:01:40.000 I'm not Charlie.
00:01:40.000 I'm producer Blake.
00:01:41.000 Charlie did have to step out temporarily.
00:01:45.000 For now, we told you it was going to be bad.
00:01:48.000 And if anything, it is worse.
00:01:50.000 I'm talking, of course, about the Senate border deal, as they like to call it, negotiated by Senator James Lankford of Oklahoma.
00:01:59.000 Negotiating is probably a very generous word to use here.
00:02:03.000 Honestly, it's amazing what Democrats were able to do.
00:02:07.000 They were able to craft a bill that is a huge number of things that they like, and they got a Republican to be the face of it.
00:02:16.000 We've been talking about it for several weeks, but it was all in hushed whispers.
00:02:19.000 Lankford would come out and say, you guys haven't seen the bill yet.
00:02:22.000 We haven't, people are attacking it and they don't know what's in it.
00:02:26.000 Well, last night, the text of the Senate border bill came out.
00:02:31.000 It's over 300 pages long.
00:02:33.000 And as is commonly the case with Congress, they release a bill that is longer than many novels and they want to pass it very quickly.
00:02:42.000 All of us are taking our time to read through the bill.
00:02:45.000 We're going to, I think, find many things wrong with it over the days and weeks to come.
00:02:50.000 But a lot of bad stuff stood out right away.
00:02:53.000 I don't think it's an exaggeration to say this is one of the worst pieces of legislation we have ever seen produced by a Republican.
00:03:01.000 And that's saying a lot.
00:03:02.000 The Republicans have been around for 150 years.
00:03:06.000 Reading through it, and we'll get into all of the details over the course of this hour and in the next hour, but you get the feeling reading this.
00:03:15.000 You can kind of have two interpretations of it.
00:03:17.000 One is that Senator Lankford and his staff, they might have just been, like, Democrats ran circles around them.
00:03:26.000 Like, the Democrats know more about border policy, and so they know what they can insert into the bill that will be helpful to them.
00:03:34.000 And maybe the staff for Senator Lankford or other senators are like, well, this seems like a good idea.
00:03:42.000 And they just do it.
00:03:43.000 But maybe that's just us trying to find a way to cope with this because the alternative is that this is a sinister piece of legislation.
00:03:51.000 And that if they know what they're doing, they are definitely selling out their constituents.
00:03:57.000 They're basically selling out the country.
00:04:00.000 And you just don't want to think, would they deliberately do this?
00:04:03.000 Would a senator from Oklahoma, one of the reddest states, one of the most MAGA states, one of the states that most wants us to secure the border, would their senator just go and do this?
00:04:17.000 It's really jarring.
00:04:18.000 And did you say, do we have Andrew?
00:04:21.000 All right.
00:04:21.000 Awesome.
00:04:22.000 I'm joined by producer Andrew as well.
00:04:25.000 Howdy, everybody.
00:04:26.000 Good to have you.
00:04:27.000 Good morning, Blake.
00:04:29.000 Man, I don't blame Charlie for not being here because I wouldn't want to talk about this either.
00:04:36.000 I'm just going through this bill, the 300 pages of it, what's in it.
00:04:40.000 It's really disturbing to imagine that apparently a majority of Senate Republicans want to pass this.
00:04:47.000 Well, let's go back, Blake, and think about how we got here, right?
00:04:50.000 So we got this leaked bill.
00:04:52.000 There was, what was her name?
00:04:53.000 Penny.
00:04:54.000 She actually came into our show.
00:04:57.000 She's been an immigration activist, really, for 20, 25 years.
00:05:03.000 She gets a leaked copy of this bill from somebody within the negotiation circles, right?
00:05:09.000 So then it gets leaked to Fox.
00:05:11.000 This image, this screen grab goes viral on the internet.
00:05:14.000 We call out Lankford by name multiple times.
00:05:17.000 Charlie does it on Twitter.
00:05:19.000 And then we're told that the bill is, that a lie will get around the world twice before the truth has a chance to put on its pants, right?
00:05:26.000 That wait till we get to see what it is, that this has all been taken out of context, et cetera, et cetera.
00:05:33.000 Well, then we find out that it's all true, that it is as bad, if not worse, than we were led to believe.
00:05:41.000 And that actually the facts that we were leaked were true.
00:05:45.000 Exactly.
00:05:47.000 I saw a tweet from Molly Hemingway last night where she basically, as soon as she saw it, she said, Senator Lankford should resign in disgrace and give Governor Stitt another chance to appoint somebody that actually represents the great state of Oklahoma.
00:06:04.000 And we've had Governor Stitt on the show recently.
00:06:07.000 Great man, great patriot, rock rib conservative.
00:06:10.000 And I think that is totally right.
00:06:12.000 And everybody's like, we should recall Lankford after this.
00:06:15.000 Well, you can't recall a senator, folks.
00:06:17.000 So the guy's in there.
00:06:18.000 And this is exactly the way the game is played.
00:06:20.000 They put Lankford in chart.
00:06:22.000 McConnell put Lankford in the negotiating seat because he's got five years left until he gets reelected.
00:06:30.000 And they're banking on the fact that Oklahomans and Americans have a short memory and they will forget this and they will forgive it and they'll just re-elect him like business as usual.
00:06:39.000 That's exactly the way the game was played.
00:06:42.000 He was chosen on purpose and I want everybody to internalize that, that you have a party that is not an opposition party in D.C. that put their puppet, Lankford, up on this, in this position on purpose because he would tow the party line.
00:06:57.000 He would get the deal for Ukraine and we would be American last all over again.
00:07:01.000 And then he'd have five years to let everybody forgive and forget and move on.
00:07:05.000 Well, I'm sorry, that's not going to happen this time.
00:07:07.000 Yeah.
00:07:08.000 And a friend of mine made the argument when I was talking about this with him that it's more treacherous than it seems at first because so far, Speaker Johnson has, to his credit, said this bill is dead on arrival in the House.
00:07:22.000 And as long as he remains Speaker, then we have no reason to think this will pass.
00:07:26.000 But even if it doesn't pass, the situation we're setting up is if the Senate approves this bill and a bunch of Republicans, McConnell, Lankford, maybe two dozen others, if they sign on to this, they're making it so the border crisis, which has been so bad that even the mainstream press has to cover it, that they'll pass this and then they'll say, well, there's this bipartisan bill in the Senate that Biden says he will sign that's going to fix all of this.
00:07:56.000 But intransigent Republicans in the House are refusing to act.
00:08:00.000 They just want the crisis to continue.
00:08:02.000 And so they're just setting it up.
00:08:04.000 And this is such an obvious outcome that you have to think: is this McConnell?
00:08:11.000 McConnell doesn't like Trump.
00:08:13.000 Is McConnell finding a subtle way to make it so that the Trump presidential campaign will fail?
00:08:19.000 That it'll take away.
00:08:21.000 That will damage his campaign by trying to shift the border crisis so they can bizarrely blame it on Donald Trump, on conservative Republicans, who are the only ones who have been wanting to fix this crisis that has been going on for years on end.
00:08:37.000 Yeah, no, you're exactly right.
00:08:38.000 So what this is, is everything that we have said on this show, everything that Charlie has said on this show about the Uniparty, about controlled opposition, about America last versus America first.
00:08:52.000 This is coming to fruition in this bill.
00:08:56.000 There's no clearer picture that I've ever seen.
00:08:59.000 And so instead of protecting our borders, instead of actually dealing with the crisis at hand, they want to go spend billions abroad so that it's an extortion racket on the American people to get us to spend $60 billion on a quagmire against Putin bad.
00:09:14.000 And yeah, okay, Putin's bad.
00:09:16.000 Let's not forget that.
00:09:17.000 We haven't even gotten to that.
00:09:18.000 This bill spends $20 billion on its various border provisions, which we'll explain later in the hour won't work.
00:09:25.000 But it spends $60 billion on Ukraine.
00:09:28.000 Three times as much.
00:09:30.000 No, absolutely.
00:09:31.000 And here's the deal, though, is now we've got Chuck Schumer going out.
00:09:36.000 We should play this tape if we have time before the break.
00:09:38.000 I think we do.
00:09:39.000 Cut three.
00:09:40.000 This is Chuck Schumer basically warning everybody that if we don't do this, actually cut two.
00:09:45.000 If we don't do this, American troops are going to be fighting in a kinetic war in Eastern Europe.
00:09:50.000 Cut two.
00:09:52.000 We're at a turning point in America.
00:09:54.000 This bill is crucial, and history will look back on it and say, did America fail itself?
00:09:59.000 Why is it crucial?
00:10:01.000 Well, if we don't aid Ukraine, Putin will be walk all over Ukraine.
00:10:06.000 We will lose the war, and we could be fighting in Eastern Europe and a NATO ally in a few years.
00:10:11.000 Americans won't like that.
00:10:13.000 If we don't help Israel defend itself against Hamas, that perpetual war will go on and on and on.
00:10:20.000 Extortion.
00:10:21.000 Extortion, extortion.
00:10:23.000 It's such a clear picture.
00:10:25.000 I feel bad.
00:10:26.000 We haven't actually even gotten into all.
00:10:28.000 I have a numbered list here.
00:10:29.000 All the reasons that we found so far that the bill is so bad.
00:10:32.000 We'll be digging into all of that throughout the hour and throughout the show because we just, it has to be emphasized.
00:10:39.000 This is a bad bill.
00:10:40.000 They call it a border security bill.
00:10:42.000 It's a bill to, if anything, secure Biden in the White House in 2024.
00:10:49.000 Hey, everyone, Charlie Kirk here.

00:11:54.000 We're going through the Senate immigration deal, the border deal, as they call it.
00:11:59.000 It is the deal to, I guess, try to help get Biden re-elected this fall because it's certainly not going to secure the border.
00:12:07.000 Well, this is a good point, actually, you're making inadvertently.
00:12:10.000 The fact of the matter is that, you know, we called it the Inflation Reduction Act.
00:12:14.000 If anything, it contributed to inflation and it had nothing to do with inflation.
00:12:19.000 We're calling this the border deal kind of loose terminology.
00:12:22.000 I don't actually know what the real name is.
00:12:24.000 Maybe you do.
00:12:25.000 This should be dubbed either as the Border Betrayal Act or the Invasion Authorization Act.
00:12:31.000 It is.
00:12:31.000 The official title is two bills because it's two things.
00:12:36.000 The first is the National Security Supplemental Appropriations Act.
00:12:39.000 That's the give $60 billion to Ukraine and, you know, a few billion here and there.
00:12:44.000 And then the second half is the Border Security and Combating Fentanyl Supplemental Appropriations Act of 2024.
00:12:53.000 And then Division C is the border act, as they call it.
00:12:56.000 The amount of disdain that you must have for the American people in order to have the gall to call it something like that.
00:13:06.000 It's disdain on two levels.
00:13:08.000 It's the disdain to pass a bill that will not help them and will essentially only help people coming to invade and sponge off and dispossess them.
00:13:20.000 And then also the contempt latent in just putting this forward and essentially thinking we can ram this through.
00:13:28.000 We can lie to you about what's in it and just pass it.
00:13:32.000 And what are you going to do about it?
00:13:34.000 Are you going to remember to primary us in five years?
00:13:36.000 We think you won't.
00:13:37.000 It's a lot of contempt.
00:13:39.000 And, you know, I guess we've been...
00:13:41.000 Let's go through it.
00:13:41.000 Yeah, we've been bashing it, but not everyone's read it.
00:13:45.000 So we've compiled a numbered list about 10 different reasons this is terrible.
00:13:50.000 So let's just start with the basics.
00:13:52.000 The central concept of this bill is it creates an emergency authority for the executive branch, the president, to act on the border if there's a border emergency as they declare it.
00:14:04.000 Now, first of all, there's no requirement to declare it.
00:14:07.000 The president can just, whenever he wants, he doesn't have to declare an emergency.
00:14:11.000 There's never something where he's legally compelled to do it.
00:14:14.000 It's just an option.
00:14:16.000 And as a lot of people have pointed out, the idea that the president needs emergency authority to secure the border is false.
00:14:24.000 The president has already almost total authority to lock down, especially illegal arrivals at the border.
00:14:30.000 We've pointed this out many times.
00:14:32.000 The president could send the guard to the border.
00:14:35.000 He could use the military to secure the United States against invasion.
00:14:39.000 Imagine that.
00:14:40.000 So the basic concept of this is already false from the get-go.
00:14:46.000 And on that point, Blake, I think it's really important to state that one of the big, if we're going to have a silver lining here, it's the fact that this bill admitted from the jump, even when we got the leaked rough outline of this bill, is that it admitted that you could turn the border on and off like a switch, that they could essentially control the inflow of illegals to 5,000 a day, or then if we have a surge, we could then turn it off for a number of days.
00:15:13.000 The power is completely within their ability right now.
00:15:17.000 And actually, you know, kudos to Speaker Mike Johnson.
00:15:20.000 He's actually been very, very good on this.
00:15:21.000 We've been tough on Mike Johnson on this show, but he's been very, very good on the fact that this bill A is dead on arrival, but B, that the president has currently all the authority he's needed, right, to get this done.
00:15:35.000 As a matter of fact, there was about 60 different things that Speaker Mike Johnson has outlined as soon as Biden came into office that he immediately put into place a reverse Trump era policies to start the border invasion.
00:15:50.000 He's the one who created the problem, and he is the one that has the power to stop the problem.
00:15:56.000 And actually, Trump is also, and you just outlined one of the examples here, but there's multiple, and we will go through them.
00:16:04.000 I promise.
00:16:05.000 I will let us go through this list of this very, very bad bill.
00:16:08.000 But the point is that Trump has also come out now this morning and said they are the ones that broke it.
00:16:16.000 They are the ones that need to fix it.
00:16:18.000 They have all the authority they already need in place in the power of the executive branch to fix this bill.
00:16:25.000 All right, let's keep going through it.
00:16:26.000 Exactly.
00:16:26.000 So it's all so much kabuki theater, as the metaphor goes, that they do all of the song and dance about securing the border, emergency authorizations, and it's all elaborate stuff to make it seem like they're really busy.
00:16:40.000 They're trying hard on the border.
00:16:42.000 When, as Stephen Miller has pointed out, it's really simple what you need to do.
00:16:47.000 You could pass a one-page bill to secure the border.
00:16:50.000 It's all of this complexity that allows them to get away with it.
00:16:53.000 And we'll be getting into that into the next segment.
00:16:55.000 But that's like the first thing to start with, is that it creates an emergency authority over the border that is fake.
00:17:01.000 And the only accomplishment of this emergency authority is that it's allowed to kick in when illegal entries are at a rate above 1.8 million per year, which is the record before Biden was president.
00:17:13.000 So it sets the Biden-era flood as like a baseline for immigration.
00:17:21.000 Are you ready to lose weight, but not sure where to start?
00:17:23.000 I understand.
00:17:23.000 I was right where you are two years ago.

00:18:28.000 Dr. Ashley Lucas, great American.
00:18:30.000 Check it out.
00:18:30.000 Myphdweightloss.com.
00:18:34.000 There's some breaking news in the break.
00:18:37.000 The House Republican leadership just released a statement on the Senate immigration bill.
00:18:42.000 And I think it's actually worth reading because it hits some of the, I would say, like three or four buckets of why this bill is so disastrous.
00:18:50.000 Exactly, exactly.
00:18:52.000 So this is released jointly by Speaker Johnson, Leader Scalise, Whip Emmer, and Chairwoman Stefanik.
00:18:59.000 So we have a good assortment of GOP members here all on board.
00:19:02.000 So that's a good thing to see.
00:19:05.000 Quote, House Republicans oppose the Senate immigration bill because it fails in every policy area needed to secure our border and would actually incentivize more illegal immigration.
00:19:17.000 Among its many flaws, the bill expands work authorizations for illegal aliens while failing to include critical asylum reforms.
00:19:25.000 Even worse, its language allows legals to be released from physical custody, which would effectively endorse the Biden catch and release policy.
00:19:35.000 The so-called shutdown authority in the bill is anything but riddled with loopholes that grant far too much power and discretionary authority to Secretary Alejandro Mallorcas, who has proven he will exploit every measure possible in defiance of the law to keep the border open.
00:19:54.000 The bill also fails to adequately stop the president's abuse of parole authority and provides for taxpayer funds to fly and house illegal immigrants in hotels through the FEMA Shelter and Services Program.
00:20:09.000 It goes on for a little bit and then it ends.
00:20:11.000 America's sovereignty is at stake.
00:20:14.000 Any consideration of this Senate bill in its current form is a waste of time.
00:20:19.000 It is dead on arrival in the House.
00:20:21.000 They put dead in all caps.
00:20:23.000 We encourage the U.S. Senate to reject it.
00:20:27.000 So that's a very good thing to see.
00:20:29.000 I don't, I'm hoping that this means this isn't going to become law.
00:20:32.000 There's still the danger that the press will use this to just sabotage the 2024 election, boost the Biden administration, but that's not as bad as this actual bill becoming law.
00:20:44.000 But, you know, they'll still try to pass it.
00:20:46.000 There's, we have a narrow majority in the House.
00:20:48.000 There's always a chance something comes to pass.
00:20:51.000 There's, yeah, there's always a chance something can happen.
00:20:53.000 And just so that the audience is clear, this does need to get 60 votes in the Senate, right?
00:20:57.000 So 41 senators can basically cause this to not go forward, right?
00:21:04.000 But when you have Schumer, Lankford, you know, maybe Thune, some of McConnell's closest allies getting behind this bill, I mean, it's going to get close, certainly.
00:21:17.000 We've seen Mike Lee, we've seen some others kind of stand up against this.
00:21:23.000 I think Rand Paul is a no.
00:21:25.000 We've got, I'm just looking at the list here.
00:21:28.000 We've got Mike Lee.
00:21:29.000 Danes came out against it, which is quite something.
00:21:33.000 We've got Schmidt.
00:21:37.000 I'm assuming Rubio is going to be a no.
00:21:39.000 We've got Rick Scott.
00:21:42.000 There's a number of these guys that are going to hold the line.
00:21:44.000 Whether or not it gets through the Senate, I think is an interesting question.
00:21:49.000 But it's not going to pass the House.
00:21:50.000 And I feel pretty certain about that.
00:21:53.000 When Charlie had an offline conversation with Speaker Johnson a week and a half ago, it was basically a no already then.
00:22:00.000 It was dead on arrival then.
00:22:02.000 I do think, though, that these buckets that they've laid out in this, I guess, you know, joint statement are really good.
00:22:12.000 It essentially gives work authorization.
00:22:15.000 So if you come over the border, remember, they don't process you immediately.
00:22:19.000 It takes some time to process you.
00:22:21.000 In the midst of your processing, which could be several years, you get an immediate work authorization, right?
00:22:28.000 We have to bring these people out of the shadows.
00:22:30.000 But what that is, is the magnet to draw even more people here because they know that the system's gamed.
00:22:35.000 Stephen Miller made a great point on Twitter I saw, and I think it's worth reiterating here that complexity is the ally of the lawyers and the open borders advocates.
00:22:52.000 Complexity can be gamed.
00:22:54.000 And when you add complexity to a lot of authority to Alejandro Mallorcas and discretionary authority, you're asking for a situation where they not only have the discretion, but they have the complexity to game the system even further.
00:23:12.000 So, and then contrarily, simplicity is the friend of secure borders and sovereignty and deportation.
00:23:20.000 Exactly.
00:23:21.000 If you wanted to secure the border, you just pass a bill and you say, even if you want to have some asylum, you just say, okay, once you hit the asylum threshold, that's it for the year.
00:23:30.000 Everyone gets turned around.
00:23:31.000 You could do that in two pages.
00:23:33.000 But instead, we have this 350-page bill, which makes it easy for people who understand the process best, which I think probably is the left more than the right overall.
00:23:44.000 And they're able to insert all this stuff that can be used to effectively keep the border open no matter what it says.
00:23:51.000 And I just want to rattle through this list quickly.
00:23:53.000 It won't take long.
00:23:54.000 This is just what stands out in the bill that we've seen so far.
00:23:58.000 So we mentioned the emergency authority, which is fake, but even its emergency authority, if it's to exist, it kicks in when you have people entering the country at a rate of about 1.8 million a year, which is already that was essentially the record high when Biden took over.
00:24:16.000 So we're locking in that as a baseline.
00:24:18.000 The Biden wave is the minimum before we think an emergency is happening.
00:24:23.000 But on top of that, the emergency authority can, it only exists for three years, then it sunsets, it would have to be renewed.
00:24:29.000 And there's a cap on how often the president can use it.
00:24:32.000 And it goes down by about a month or two every year until by year three, three years out from now, you could only use the emergency authority for 180 days.
00:24:41.000 That's about six months.
00:24:43.000 And then you just can't.
00:24:44.000 Even if the emergency would immediately resume, you just can't resume it.
00:24:47.000 Sorry, time's up.
00:24:49.000 But that's if the Biden administration were to bother to use this authority.
00:24:53.000 There's no requirement that they do it.
00:24:54.000 They could just ignore it.
00:24:55.000 They could say, don't need it.
00:24:57.000 We're fine.
00:24:58.000 Nothing forces them to use it.
00:25:00.000 Even under this emergency authority, Chris Murphy, the Democrat co-author of this, he's bragging.
00:25:06.000 He's trying to explain why this is such a great deal for Democrats.
00:25:09.000 He points out, even under emergency authority, the Border Patrol has to process 1,400 people a day.
00:25:15.000 That's 500,000 people a year.
00:25:18.000 In his own words, quote, the border never closes.
00:25:22.000 The border never closes.
00:25:25.000 Even under an emergency, even when we're being invaded, we just don't close it ever.
00:25:31.000 There's major loopholes in this.
00:25:33.000 Unaccompanied alien children, UACs as they call them.
00:25:36.000 These are the unaccompanied minors or alleged minors who show up at the border.
00:25:40.000 That's anyone who's under 18 with no guardian, no parent, or anyone who says they're under 18.
00:25:46.000 How do you check?
00:25:48.000 No way to prove it.
00:25:49.000 They're all exempted from this emergency authority.
00:25:51.000 They get let in, same rate, no matter what.
00:25:55.000 More than 100,000 of these people are coming in every year.
00:25:57.000 They're not even counted under this system.
00:26:00.000 Even though this emergency authority only lasts three years, it expands the amount of legal immigration we get for at least five years.
00:26:08.000 So we're giving away things to Democrats that last far longer than the supposed concession that we're getting.
00:26:15.000 For at least five years, we add an additional 50,000 new legal immigrant visas.
00:26:22.000 Just new additional legal immigrants, totally unrelated to the illegal immigrant crisis at the border.
00:26:27.000 We just have more legal immigration.
00:26:29.000 It creates new pathways to citizenship for the children of H-1B visa holders and for people who came here from Afghanistan.
00:26:37.000 So new ways to become a citizen.
00:26:39.000 It creates a new right to an attorney for all illegal immigrants for their hearings.
00:26:45.000 You just get one paid for by the taxpayers to argue for why you should be let in.
00:26:51.000 But perhaps the most important thing of all in this is all of this is theater because within the bill, it explicitly says that an immigration officer with the approval of a higher-up can just decide to exempt a person from these requirements if they believe the, quote, totality of the circumstances warrants it.
00:27:16.000 So if the totality of the circumstances, and it gives some lists of possible justifications like humanitarian concerns or whatever, they can just decide law doesn't apply.
00:27:27.000 We're overriding it in this special case.
00:27:29.000 So you're just saying, well, the immigration authorities who are overseen by Alejandro Mayorkas, who we are currently impeaching because he has decided to ignore the laws that we already have, he's just allowed now explicitly to just ignore immigration requirements when he thinks it's a good idea.
00:27:46.000 And what's the limiting principle of this?
00:27:49.000 Well, the only limiting principle we would have is the courts.
00:27:52.000 But they took care of that.
00:27:54.000 Because another provision of this bill is that any challenge to this bill, its constitutionality or how to interpret its provisions, has to be heard by the federal district court for Washington, D.C.
00:27:54.000 No worries.
00:28:09.000 So we have different federal courts.
00:28:11.000 Repeat that because it's a big, it's a most liberal court in the land, save maybe New York City.
00:28:18.000 And don't forget the Ninth Circuit.
00:28:20.000 Ninth Circuit is the Ninth Circuit for a reason.
00:28:22.000 But it might be a good thing.
00:28:23.000 So we have different federal circuits.
00:28:25.000 There's the Fifth Circuit, Fourth Circuit, and they govern different states.
00:28:28.000 A lot of good rulings on immigration have come from federal judges in the Texas Circuit.
00:28:34.000 I can't remember what the number is, but that area.
00:28:36.000 Yeah, we have the Fifth Circuit.
00:28:36.000 Fifth Circuit.
00:28:38.000 So we have more conservative circuits, more liberal ones.
00:28:40.000 This one is saying it's got to be the D.C. circuit, which is a relatively liberal circuit and relatively more deferential to federal authority in this way.
00:28:50.000 And you've got to use it.
00:28:51.000 That's the circuit you have to use.
00:28:52.000 So they're just saying we're disabling all of these court rulings that have slowed down the Biden immigration policy.
00:29:00.000 They're nixing that.
00:29:01.000 They're taking it out.
00:29:02.000 And that will never go away, even after this emergency authority sunsets.
00:29:07.000 So we're giving away years of privileges in return for basically nothing.
00:29:15.000 Hey, everybody, Charlie Kirk here.

00:30:11.000 Go to mypillow.com, promo code Kirk.
00:30:18.000 You know, I'm really in awe of this.
00:30:20.000 We spent so much time talking about the bad parts of the border half of this bill that it's worth remembering there's also the negotiation was apparently supposed to be that Republicans get concessions on border security and in return, you know, the Biden administration gets money for various conflicts abroad.
00:30:43.000 And yet really, it's just both of these things favor Democrats.
00:30:46.000 They get a border revision that empowers my orchestration, that institutionalizes the Biden flood.
00:30:52.000 And on top of that, they get a ton of money for Ukraine.
00:30:56.000 They get $60 billion.
00:30:58.000 Charlie had a tweet last night that this border bill mentions deportation or deportable, some variant of the word deport, 10 times over the course of 300 some pages.
00:31:10.000 And this mentions Ukraine 74 times.
00:31:13.000 So they get three times as much money as the border and more than seven times as many mentions in the supposed border deal.
00:31:20.000 That's not all.
00:31:23.000 They also get 400% more tax money for foreign countries than for our own.
00:31:28.000 Exactly, exactly.
00:31:29.000 We have $5 billion for East Asia, Taiwan.
00:31:32.000 There's $14 billion for Israel.
00:31:34.000 There's a huge amount of deficit spending, borrowed money that will go out of this country.
00:31:41.000 And then we're not stopping the intake into this country.
00:31:44.000 It's just, it's, it is, you need to be a special type of D.C. person to believe that this is a good deal or that this is a good law in any capacity.
00:31:56.000 I'm just a special type of DC person.
00:31:58.000 That must have been the nicest way you could have put that, I think.
00:32:01.000 A special type of DC idiot.
00:32:05.000 I'll add some player.
00:32:07.000 It's unbelievable.
00:32:09.000 Luckily, I'm happy that so far the House has held firm.
00:32:13.000 You know, we've had our disappointments with the GOP House, but so far they're not letting us down on this.
00:32:18.000 And I think we'll see a lot of the unity against this really fray or the unity for this fray apart as they see what the reaction is.
00:32:28.000 We can only hope.
00:32:30.000 Let's play cut number one.
00:32:32.000 The bill that you passed didn't get a single Democratic vote in the House or the Senate.
00:32:36.000 How are you going to get anything done?
00:32:38.000 Or do you just want to make a speech as you admittedly say the border is, you say the border is in chaos?
00:32:43.000 Do something about it.
00:32:45.000 Don't just politically posture.
00:32:47.000 That line, do something, stands out to me.
00:32:50.000 I was speaking with someone off the record, but there were someone who's been meeting with Republicans in Congress.
00:32:58.000 And this is a sentiment that he said exists that they admit the bill isn't that good.
00:33:04.000 Some of them also say they don't think Biden will use the emergency authority.
00:33:08.000 So the key thing that is in this bill, they think won't happen, but they still want to pass this.
00:33:14.000 And the argument apparently was someone literally said that they had to do something.
00:33:19.000 Do something.
00:33:20.000 Just do it.
00:33:22.000 No, and can I make a point here, Blake, about why that's such a bad idea?
00:33:26.000 You have this CBS poll, and I think we have the clip of it somewhere.
00:33:32.000 I think Ryan pulled it.
00:33:33.000 But you have this poll coming out that shows that Trump is up.
00:33:40.000 They've polled Trump v. Biden 16 times.
00:33:43.000 Actually, it might be NBC.
00:33:44.000 It's NBC.
00:33:45.000 I apologize.
00:33:46.000 They've polled them side by side 16 times.
00:33:49.000 In November, Trump took his first lead ever by two points, still within the margin of error.
00:33:55.000 Today, this weekend, they came out with a new poll has Trump up by five points.
00:34:01.000 That's outside of the margin of error, and it's going the wrong direction for Biden.
00:34:05.000 There's other polls from ABC that show that only 18% of Americans approve of Joe Biden's border policy.
00:34:14.000 If there is ever such a thing as leverage, we have it.
00:34:18.000 This is a bad, bad, bad situation for the Biden regime, and they know it.
00:34:24.000 And so what they're going to try and do is put some sloppy junk garbage bill up on the table, and then they're going to try and, we're going to say, no, it's a bad bill.
00:34:32.000 We're not going to sign it.
00:34:33.000 And they're going to try and pin this on the Republicans for inaction, not willing to do anything.
00:34:38.000 Exactly.
00:34:39.000 So Biden has all the authority that he needs right now to do it.
00:34:41.000 And then secondarily, this is what would happen.
00:34:45.000 If you pass this bad bill into law and Trump does get elected, which he is the odds on favorite to do right now, despite all the shenanigans, despite everything, he's up big in all the swing states, all the battleground states that really matter.
00:34:59.000 If you pass this into law, what you are then doing is you are creating, you are hamstringing the president when he does get into office.
00:35:06.000 All of that authority will then now be filtered through this law, this bad, bad bill, and he will not be able to institute a deportation force on day one.
00:35:16.000 He will not be able to close down the border on day one because he's going to have these provisions that say you have to let in 5,000 a day.
00:35:22.000 So you are literally cutting your knees out from under you in the future if you allow this bad bill to pass.
00:35:29.000 When right now the laws on the books are plenty good enough and plenty strong enough to get exactly what we need to accomplish, which is to secure the border.
00:35:36.000 That's the key thing.
00:35:37.000 That is the ultimate myth that has to be busted is the idea that we need new laws to secure the border.
00:35:44.000 The president's powers over immigration, over security are enormous.
00:35:49.000 He is the commander in chief of the U.S. military.
00:35:51.000 His obligations include defending the United States from enemies.
00:35:56.000 And when you have this total unrestricted flow of, as we like to say, military-age males from China, from literally anywhere on planet Earth, it is very easy to classify that as an incursion into the United States that is against the United States' interests.
00:36:14.000 The president can act against that.
00:36:16.000 And they use all of this kabuki theater, all these complex laws to obscure that fact.
00:36:22.000 And like we say, this bill doesn't force the president to do deportations.
00:36:27.000 It doesn't force him to secure the border.
00:36:29.000 But what it does do is it has various provisions that set the Biden flood as the baseline, as the bare minimum, as the natural amount of illegal inflow to a country.
00:36:41.000 It's a new normal.
00:36:42.000 An unprecedented amount, not just in American history, in any country's history, in the history of the world, is now set as the natural organic baseline for how this country is supposed to operate.
00:36:55.000 And we have to call that out as insane.
00:36:57.000 And it's been pointed out that this is polling well for us.
00:37:01.000 But we should make the point.
00:37:02.000 If this were a real border security bill that would secure the border, that would deport people, even if it would take the issue away from us for the election, we should pass it because it's good for the country.
00:37:12.000 But this is not a bill that is good for the country.
00:37:15.000 It is not good for the American people.
00:37:16.000 It is not good for the border.
00:37:18.000 It's not good for anyone except Joe Biden, Democrats in D.C., and every business in the country and every political group that wants unlimited open borders forever.
00:37:29.000 Cheap labor.
00:37:31.000 Thanks, everybody, for tuning in.
00:37:33.000 We appreciate you listening.
