00:01:42.000 Well, it's actually McLaughlin, but the Newsmax is the headline.
00:01:46.000 McLaughlin poll, Trump beats Biden in electoral landslide.
00:01:50.000 After George's indictment of Donald Trump, our new national poll shows he is not only beating Biden, but he would defeat the current president in an electoral landslide.
00:02:00.000 The McLaughlin National Survey finds Trump leads Biden 47 to 43, up two points this month alone.
00:02:06.000 But wait, there's more.
00:02:08.000 This poll is really something else.
00:02:10.000 So here's what's really interesting about this.
00:02:13.000 Now, I brought this up with producer Blake, and he is, for those of you who know him or have seen him on this show, he's a contrarian.
00:02:22.000 And I said, Blake, this poll is probably completely garbage.
00:02:26.000 And yeah, he had some critiques of it, but he was like, actually, you know, the national polls lately have been looking really solid for Trump.
00:02:32.000 Now, I'm not saying this isn't an outlier, but this is one of the few indications that we have post-Georgia indictment, post-mugshot that went mega viral, post-Trump-Tucker interview that broke the internet.
00:02:48.000 That this is one of the few indications that we have of a national level.
00:02:51.000 But what's more, and perhaps what's most important, is the key battleground states and how those are broken down in this poll.
00:02:58.000 So if you just look at key battleground states, we're talking Pennsylvania, Wisconsin, Michigan, Arizona, Georgia.
00:03:06.000 Trump is leading.
00:03:08.000 Get this.
00:03:08.000 And I think this is where McLaughlin and Newsmax get this headline of this electoral landslide, which I want to caution you on.
00:03:15.000 We always want to play like we're 10 points down, always, always full stop.
00:03:22.000 They own the institutions, they own the media, they own the universities, they own Hollywood.
00:03:26.000 And frankly, Joe Biden is using the federal government as a get-out-the-vote campaign apparatus.
00:03:32.000 Okay, so we're up against tremendous institutionalized power here that the Democrats have amassed and that we need to destroy.
00:03:40.000 But nevertheless, key battleground states in this poll.
00:03:44.000 Trump leads Biden by a whopping 49 to 41%.
00:03:52.000 49 to 41%.
00:03:55.000 That means it's an electoral landslide.
00:03:57.000 Now, some of you will remember that Turning Point Action.
00:04:00.000 So it's the C4 arm of TPUSA.
00:04:03.000 Charlie started.
00:04:04.000 Tyler Boyer, who comes on the show a lot, is the COO, doing a phenomenal job running that, raising funds to chase votes all across the country.
00:04:13.000 Some of you might remember our three key states are Georgia, Wisconsin, Arizona.
00:04:18.000 We think that the entire election pivots on those.
00:04:21.000 Now, so I have some good news and I have some bad news.
00:04:25.000 First is a fairly telling sign, right?
00:04:29.000 Georgia, Trump is still the favorite in Georgia.
00:04:33.000 And I think we have a graphic for that.
00:04:35.000 Trump is still a favorite in Georgia by a mile in the primary in Georgia, despite the Fulton County indictment for which he just pled not guilty this morning.
00:04:48.000 So this is, and this is from the AGC, the Atlanta Journal Constitution of the University of Georgia.
00:04:54.000 For those who don't know, the AGJC is a complete communist rag.
00:04:59.000 We're not going to get any favorable polling.
00:05:00.000 They're not going to be tilting it in our favor.
00:05:03.000 Wisconsin is the dog right now.
00:05:06.000 Not going to lie.
00:05:08.000 But one caveat to that, I will say, is that Wisconsin has not been polled recently.
00:05:15.000 All right.
00:05:16.000 So it looks like the last poll we have of Wisconsin was June 14th through the 28th from Prime Group.
00:05:23.000 And Biden was leading Trump 53 to 47.
00:05:26.000 Marquette University, June 8th through the 13th.
00:05:30.000 Biden was leading 49 to 47.
00:05:34.000 So we don't really know.
00:05:36.000 We don't really know how Wisconsin is going to go, but turning point action, we've already pledged $5 million to the state of Wisconsin and chasing ballots.
00:05:44.000 But we can see signs of this shift in those battleground states and elsewhere.
00:05:49.000 Yeah, okay.
00:05:50.000 So getting a piece of info here.
00:05:52.000 The most recent Georgia poll from a Democrat group called Citizens to Save Our Republic has Trump up four over Biden.

00:06:02.000 And by the way, Biden is beating DeSantis 49 to 47 in that same poll.
00:06:07.000 So taken collectively, and here's Arizona.
00:06:11.000 We have some newer numbers from Arizona.
00:06:12.000 Maybe I can get these graphics for you guys.
00:06:15.000 The newest Arizona poll is very encouraging.
00:06:20.000 Emerson College has Trump up one over Biden.
00:06:25.000 That's August 2 through the 4th.
00:06:29.000 And then we also have public opinion strategies from July 22nd to the 24th.
00:06:34.000 Trump tied with Biden in Arizona.
00:06:37.000 So it looks, Georgia's looking strong.
00:06:39.000 Arizona's looking strong.
00:06:40.000 We don't have new polling from Wisconsin, but we're seeing in the landscape that the Trump mugshot, the indictment in Fulton County, this parallel weaponization of the DOJ is having a profound impact on the psyche of the country.

00:06:59.000 And this McLaughlin poll is frankly incredible.

00:08:39.000 Trump tied with Biden, and that's from July 22nd to 24.
00:08:43.000 So we see a slight increase in his support there.

00:08:47.000 We don't even have to just stay fixated on the turning point action core three, which again is Georgia, Wisconsin, Arizona.

00:08:57.000 Let's go to Michigan right here.
00:08:59.000 We have Trump basically tied in Michigan.
00:09:02.000 Now, Michigan's going to be a slog, right?
00:09:03.000 Emerson College, however, August 1st to 2nd has Trump up slightly, 43 to 41, and essentially tied in the epic MRA poll.

00:09:16.000 Actually, that was Michigan and Pennsylvania.

00:09:19.000 That's the one I want.
00:09:20.000 Pennsylvania.
00:09:21.000 Let's go to Pennsylvania, which I think is 150, I believe.
00:09:26.000 Franklin and Marshall College essentially tied August 9th through the 20th, 4240.

00:09:34.000 Now, Biden's up two in that poll, but the prime group had them tied.
00:09:40.000 And back from June 22nd to 22nd, the Quinnipiak University, very good poller, had Trump up one.

00:09:48.000 So the trend is our friend, folks.

00:09:54.000 You would think conventional wisdom, and perhaps this is what led the Democrats to pursue this policy, which is absolutely coordinated, a vast left-wing conspiracy to indict the president.
00:10:06.000 We know it's coordinated.
00:10:08.000 We see it at the state AG level with these alternate electors in Michigan and Georgia.
00:10:12.000 We've heard rumors they're going to go after him in Arizona and other states.
00:10:16.000 We know it's coordinated.
00:10:17.000 We had that clip from Newt Gingrich on this show talking about how DC called Fannie Willis, rushed her to indict Trump to cover up for the Weiss screw-up.
00:10:28.000 And you would think that all of this, and maybe this is the conventional wisdom driving the Democrats, that Biden would be peaking and Trump would be collapsing.
00:10:40.000 He's indicted four times.
00:10:42.000 You know, he hasn't even had a chance to defend himself in court.
00:10:46.000 All we're seeing is the negative news coverage, the mainstream news media covering these indictments wall to wall.
00:10:54.000 They're not covering Joe Biden's corruption at all.
00:10:59.000 And yet, Trump in the trends is surging.
00:11:03.000 Now, I want to go back to this McLaughlin poll.
00:11:06.000 One detail that I want to call out.
00:11:11.000 So, this is what's interesting about the poll.
00:11:14.000 This is directly from that Newsmax article.
00:11:17.000 Even more remarkable with our voter model for this poll, we assigned four more points of Biden 2020 voters than Trump 2020 voters.
00:11:28.000 Four more points.
00:11:29.000 So we've got a four-point edge.
00:11:31.000 This means looking to 2024, there has been an eight-point turnaround in favor of Trump from the 2020 election.
00:11:40.000 Biden voters, independents are switching to Trump.
00:11:46.000 So, this again is a first in the nation.
00:11:48.000 Reason this is noteworthy is simply because this is our newest poll post indictment post Fulton County post.
00:11:59.000 All you know the 18 co-conspirators getting indicted.
00:12:02.000 This is a tremendous sign.
00:12:06.000 So what will this even look like?
00:12:08.000 Think about this.
00:12:09.000 All this news is is very current, these indictments it's weighing down Trump's.
00:12:15.000 You would think it would be weighing down Trump's, but it's not here's.
00:12:18.000 So the question is, what will happen next year when the news of these criminal cases has become stale?

00:12:27.000 Biden's even older.
00:12:29.000 He's making even more flubs.
00:12:31.000 We don't know.
00:12:33.000 But the truth is, is that these have absolutely this shows that the mugshot seen around the world has absolutely backfired on the Biden administration.

00:12:53.000 Again, I said this before, but I'm going to say it again because it bears repeating time and time again.

00:13:00.000 We play like we are 10 points down at all times.

00:14:13.000 Maybe it's not, but we're seeing similar bumps at the state level.

00:14:20.000 Wisconsin, we don't have new polling out.

00:14:27.000 And we still haven't even seen a lot of polling from those states post-indictment, but McLaughlin sort of shows that the trend is our friend, as you said.

00:14:41.000 And I really want to dive into this with you because, you know, you sent me this on a text.
00:14:46.000 I think it's super fascinating.
00:14:48.000 This show had a direct impact in New Hampshire.
00:14:51.000 We flooded the switchboards, Scanlon's office.
00:14:54.000 Now he's backing away saying, I'm not really going to, I'm not taking Trump off the ballot.
00:14:58.000 Trump this morning, the update for our audience is he has pleaded not guilty.
00:15:02.000 Let's start there, Mike.
00:15:03.000 Mike Davis, Article 3 project.
00:15:05.000 He has pleaded not guilty in Fulton County.
00:15:08.000 What does that mean?
00:15:09.000 What are the implications?
00:15:10.000 Timelines, everything.
00:15:11.000 The floor is yours.

00:15:15.000 And President Trump waived his arraignment down in Fulton County, Georgia with Fannie Willis with her bogus racketeering indictment against him.
00:15:26.000 He pled not guilty.
00:15:27.000 The arraignments where you bring the defendant in and the judge makes sure that the defendant understands the charges against him, how much jail time he faces, make sure that he has an attorney.
00:15:39.000 You can waive that.
00:15:40.000 It's pretty routine.
00:15:41.000 So President Trump waived that.
00:15:43.000 Fanny Willis, who's a total buffoon, is going to try to have her trial before the election like the rest of these Democrat prosecutors with their election interference.
00:15:53.000 We have, you know, this is lawfare on many different fronts.
00:15:57.000 We have Alvin Bragg charging President Trump for the non-crime of settling a nuisance claim.
00:16:03.000 Somehow that turned into a campaign finance violation.
00:16:07.000 The Soros funded Manhattan DA.
00:16:09.000 Then we have Jack Smith charging President Trump for the non-crime of a former president having his presidential records, which is allowed by the Presidential Records Act.
00:16:19.000 Then we have Jack Smith and now Fannie Willis charging President Trump for the non-crime of objecting to a presidential election, which is allowed by the Electoral Count Act of 1887, twisting arms politically as allowed by the First Amendment.
00:16:32.000 We have New York Attorney General Tish James bringing a civil fraud lawsuit against Trump for the non-fraud of a businessman paying back sophisticated Wall Street banks in full with interest.
00:16:43.000 You have Gene Carroll bring in a lawsuit.
00:16:46.000 All these Democrat operatives, Democrat politicians fear they cannot beat President Trump on November 5th, 2024.
00:16:53.000 And as you just discussed, Andrew, they should fear that because President Trump is going to beat Biden like a drum.
00:16:59.000 They tried to take out President Trump with two impeachments, four indictments, several lawsuits.
00:17:05.000 They've turned him into Tupac, right?
00:17:07.000 He's becoming a legend bigger than life, and they can't take him out.
00:17:12.000 So the next play that they're trying to do is what you talked about, which is disqualification under Section 3 of the 14th Amendment, which is just an absurd legal theory.
00:17:25.000 During this, after the Civil War, the Republic almost fell apart.
00:17:31.000 You had the Confederate rebellion, insurrectionists trying to go to war against the Union.
00:17:37.000 And after the Civil War, what was happening is you had these Confederate sympathizers, including Confederate soldiers, who were getting elected to office, including the House of Representatives.
00:17:48.000 And so as part of the Civil War amendments, the 13th Amendment to outlaw slavery, the 14th Amendment, and the 15th Amendment to provide due process and equal rights to the freed slaves, they passed Section 3, which disqualified these Confederate sympathizers from holding office if they took up arms against the United States, insurrection or rebellion.
00:18:12.000 But under Section 5 of the 14th Amendment, these are not self-executing provisions.
00:18:18.000 Under Section 5, the Congress has to pass a statute, a criminal statute.
00:18:25.000 So you have evidence and a trial with a judge and a jury, and it's subject to appeal before you can disqualify someone from federal office under Section 3.
00:18:36.000 So Congress has passed the statute and the Rebellion and Insurrection Statute, and that's on the books.
00:18:45.000 They're not charging President Trump with rebellion or insurrection under the statute.
00:18:49.000 So you can't disqualify him unless you charge him under that federal criminal statute.
00:18:54.000 And you can't just have some Yahoo Secretary of State somewhere just unilaterally decide, hey, we're in a swing state like New Hampshire.
00:19:02.000 We're just going to take President Trump off the ballot so Biden wins by default.
00:19:07.000 So let's, yeah, and you're going into the guts of this article.
00:19:07.000 All right.
00:19:11.000 And so this is from Reason.
00:19:13.000 Professor Michael McConnell responding about the 14th Amendment insurrection and Trump.
00:19:18.000 He says, we must not forget that we are talking about empowering partisan politicians, such as state secretaries of state, to disqualify their political opponents from the ballot, depriving voters of the ability to elect candidates of their choice if abused.
00:19:33.000 This is profoundly anti-democratic.
00:19:36.000 Now, this is similar to what we've heard from Alan Dershowitz.
00:19:40.000 He said that this is basically the end of democracy as we know it if these laws or if this legal theory rather is pursued in any real form.
00:19:49.000 Now, we heard about California's considering doing this.
00:19:52.000 Okay, fine.
00:19:53.000 We don't win any electoral, you know, we don't win the state of California anyways, but New Hampshire is potentially a battleground state.
00:20:02.000 I haven't seen the polling out of there recently.
00:20:04.000 But tell us about this professor, Michael McConnell.
00:20:07.000 You know, this person.
00:20:09.000 He's no Trump fan, right?
00:20:10.000 And here he is defending.
00:20:12.000 Yeah, he's a Stanford law professor.
00:20:14.000 He was a former judge on the 10th Circuit Court of Appeals.
00:20:18.000 And when I clerked for then Judge Gorsuch the first time on the 10th Circuit, he was Judge Gorsuch, one of Judge Gorsuch's colleagues.
00:20:25.000 He's a good guy.
00:20:26.000 He's a very smart, conservative guy, conservative slash libertarian.
00:20:30.000 He's definitely not a Trump fan.
00:20:32.000 So this is not some Trump shill putting out this theory to debunk this bogus theory by the Democrats.
00:20:39.000 This is a very well-respected former federal circuit judge and Stanford law professor who's putting out serious academic research, put out serious opinions on the 10th Circuit.
00:20:53.000 And there's one case that we've only had one case that addressed this provision of the 14th Amendment, and it was more than 150 years ago.
00:21:03.000 And it's the controlling case on point that validates what Judge, well, I guess Professor McConnell is saying now, which is that under the 14th Amendment, it's not self-executing.
00:21:15.000 You can't just say, okay, well, we think that Donald Trump incited an insurrection, and so therefore we're going to take him off the ballot in New Hampshire or Michigan or one of these other states that could decide the election.
00:21:28.000 Again, you have to charge President Trump with insurrection or rebellion under a specific federal criminal statute that was specifically passed to implement Section 3 of the 14th Amendment.
00:21:44.000 It was passed by Congress pursuant to their power under Section 5 of the 14th Amendment.
00:21:49.000 Got it.
00:21:50.000 So Section 5 essentially defangs this from being a unilateral move by partisan actors in various states.
00:21:58.000 Is that essentially the assertion here by McConnell and yourself?
00:22:05.000 Yeah, I mean, it's, yeah, that you can't just have someone unilaterally say that there's an insurrection or a rebellion and we're going to take someone off the ballot.
00:22:12.000 Frankly, if you look at Fannie Willis's racketeering theory down in Georgia, which is a bogus theory, but if Democrats want to use that theory, I would say to a Republican attorney general or a Republican DA, if Democrats pursue this disqualification theory under the 14th Amendment, I think that a Republican Attorney General or Republican DA should charge them with racketeering.

00:22:35.000 But Mike, you're kind of exposing something that we rail on on this show a lot, which is the fact that we have not seen any sort of similar counter moves by AGs or even DAs in red states.

00:22:51.000 I mean, Charlie brought up, just randomly picked one of the red states, South Carolina, Attorney General.
00:22:56.000 We get a message back within like 10 minutes saying, hey, I'm not taking anybody off the ballot.
00:23:02.000 We're like, okay, okay, guys.
00:23:04.000 Like, we're not saying you have to.
00:23:05.000 We're saying counter move.
00:23:07.000 Where's the aggression?
00:23:08.000 Where's the offensive?
00:23:10.000 Why are we not seeing that from red states, attorneys general, and DAs?
00:23:16.000 I would say that Republicans, particularly Republican attorneys, and also Republican white male politicians, are the biggest cowards on the planet.
00:23:30.000 They think that we're just going to return to norms after president.
00:23:33.000 This is what they actually think.
00:23:35.000 They think that if Trump goes away, we just go back to our norms.
