01:29:25.640 They enact so many regulations that make it so difficult for you to access and enjoy your property that eventually you just can't afford to own it anymore.
01:29:34.060 So you sell it and then they turn it into a wilderness or a conservation area or something.
01:29:38.720 And it's a really pernicious form of tyranny that exists within our public land system.
01:29:44.640 And these poor property owners in Oregon have been fighting the BLM for two years to be able to access a road that they've been accessing since 1906 to go to these cabins.
01:29:56.300 And now the BLM is telling them they're not allowed to do it.
01:29:58.840 They put up a gate.
01:29:59.640 They won't give them a key.
01:30:00.700 And they are being prevented from going to what is essentially their homes.
01:30:03.940 So what is it that they can do?
01:30:08.660 Well, currently, we're putting a lot of pressure on the BLM.
01:30:12.520 They've started an administrative process to see if they can reopen this road.
01:30:18.360 But the reason that I think this needs national attention is because there just needs to be pressure.
01:30:25.840 Congressman Bentz has been helpful in trying to get this done.
01:30:29.040 But as you know, the Republicans were in the minority last Congress.
01:30:33.400 As soon as they're in the majority, I'm hoping there's some congressional scrutiny on the behavior of what's going on at this BLM office.
01:30:39.660 I just I don't think that the BLM should be an agency that can just decide one day that you can't go to your home anymore and they block off a road.

01:30:49.040 I know you agree with me on this.
01:30:51.500 No agency should be able to get up one day and just change the rules.

01:30:58.200 Congress makes the laws.

01:31:02.040 The BLM's own rules say, like, if you go look at their handbook, it says that they cannot deny a property owner access to go and use and enjoy their property.

01:31:14.540 And so but they are willing to play chicken.

01:31:20.320 Like, like, it's just frustrating that that might have to be the outcome, because all you need is for one field manager to change his mind and say they can keep using this road they've been using since 1906.
01:31:33.740 And one thing you should know is I did help them get emergency access to go winterize their cabins one year.
01:31:42.340 There was an early freeze coming.
01:31:44.820 Nobody had turned off their water.
01:31:46.140 This was the first year they couldn't go up.
01:31:48.520 And so we petitioned the BLM, say, can we just go up to turn off the water so we don't break all our pipes and destroy the homes?
01:31:54.520 And they're like, OK, fine, you can do it.
01:31:57.220 So they actually drove up the road that's been allegedly destroyed by an erosion event that happened from a flood.
01:32:03.760 They were able to pass the road is passable.
01:32:06.160 You can still do it in a four wheel drive vehicle.
01:32:08.140 So no work actually needs to be done.
01:32:10.640 But the BLM just won't let them open the gate.
01:32:12.980 They're telling them no.
01:32:13.860 And and the reason is because they're worried that these four wheel drive vehicles will run over fish in the river.

01:33:43.520 That was something that was going around in the 90s.
01:33:46.200 Is there a concerted effort in our in our land management agencies to do these kinds of things?

01:33:56.920 And in the Clinton era, you had what was called the roadless rule, which was one of these rules that the agencies just dreamed up.
01:34:03.580 But I think if we could get it before the Supreme Court again, they'd strike it down after the EPA versus West Virginia case because they just made up the rule out of clean cloth.
01:34:12.300 They have no congressional direction to do it.
01:34:14.980 But my organization, Blue Ribbon Coalition, that's one of the primary things we fight over is roads, because if you can close roads, you can close access.
01:34:23.560 That means we're not using our natural resources.
01:34:26.260 It means people can't access private property.
01:34:29.740 I've helped ranchers in the same case as these folks in Oregon try to get up to their grazing permit permitted lands and their private properties.
01:34:38.380 And so there is a concerted effort to obliterate and decommission roads all across the public land system, because that's how you can turn it into what's called designated wilderness, which is you can only go and walk on it on your own two feet.
01:34:52.800 And you can't do anything, no mechanized anything on a wilderness area.
01:34:59.420 And in some wilderness is OK.
01:35:01.100 I mean, there's some people like for recreation reasons, it's probably OK to have some areas that are kind of set aside for that.
01:35:06.680 But this group that wants to close this all down wants it all.
01:35:10.180 I have to tell you, I have I have I have land up in Idaho that when I bought it, it was a good thing.
01:35:20.480 It's surrounded by BLM and then surrounded by National Forest.

01:36:23.880 The only reason I have any ability to know how to do it is because I had somebody who had been working in the agency for 35 years train me on how to challenge these decisions that come out of these agencies.
