00:30:28.920 This suggests that the money raised was likely eventually fed to Beck through payouts from his publisher.

00:47:58.660 What is happening in Georgia right now?

00:48:03.040 Well, what we have going on, Georgia seems to always be, Georgia's always on my mind, I guess.

00:48:10.640 But what has happened is that the state election board is a five-member board that has one member appointed by the Republicans, one member appointed by the state Democratic Party, one member appointed by the Speaker of the House, one member appointed by the lieutenant governor who's president of the Senate, and the chairman's appointed by the governor.

00:48:35.960 That should be a four-to-one Republican-to-Democrat ratio.

00:48:41.400 However, historically, there have always been these Republicans who vote with the Democrats.

00:48:47.860 And so the idea, it's how many places do we see this, Glenn, every year?

00:48:53.660 Oh, my gosh.

00:48:54.120 It is just so exhausting.

00:48:57.200 The Republicans are such, they're just limp noodles.

00:49:03.280 God, they're bad.

00:49:32.640 And so for the first time, we have a rule of law majority of election board members who are determined to, that the law be implemented, that the Georgia law be implemented.

00:49:45.780 And so they have issued, which is that the, let's just start with one, one of the things the Democrats are going berserk over.

00:49:55.160 A rule that will take effect next week that requires reconciliation of the ballots before and the votes prior to the time when they're certified.

00:50:06.300 And what that means is that at every voting location, before those results are sent to the county, that voting location, the workers must make, they must look at the number of voters who are shown as having been issued ballots.

00:50:24.220 And that number must match the number of ballots, and that number must match the number of votes cast in that precinct.

00:54:55.440 And, you know, 31 years ago, Congress passed a law saying that states must, when it's issued a driver's license, that people must be given the voter registration forms.

00:55:13.700 They must be given those forms at the DMV or if you go to sign up for food stamps or welfare benefits, that wherever people interact with these two types of government agencies, they must be registered to vote.

00:55:30.860 And so that law also requires that states must accept and use the federal voter registration form.

00:55:43.060 Well, that form just has a box to check.

00:55:47.060 Are you a citizen?

00:55:48.500 And we have ample evidence over a number of years where people will check the box, no, I'm not a citizen, and they get sent over and registered to vote anyway.

00:55:58.340 Well, now what you have, and I have had reports, people have seen this all over the country, that when they have been going in, being just normal people, going in to get their driver's license renewed or a tag for their new car, and they see these clusters of people who clearly don't speak English.

00:56:17.820 In Michigan, a fellow sent me something about a group, and this woman had a sign around her neck that said interpreter, and she was taking them in to get their driver's licenses or their ID cards.

00:56:32.760 And I have absolutely no reason to think that they're not automatically being added to the voter rolls because Michigan has a new law that you have to opt out.

00:56:48.080 You have to opt out in Georgia.

00:56:50.320 And these people don't even speak English.

00:56:52.020 How are they even going to know that they've been added to the voter rolls?

00:58:36.240 and then require them to come in and provide proof of citizenship to be able to stay on the rolls and vote.

01:28:34.680 And, you know, you're definitely underestimating yourself, Glenn,

01:28:38.080 but hopefully I can help the audience to understand the case.

01:28:42.380 So, look, obviously this case was filed a while back,

01:28:46.320 and it had, you know, resulted in several important decisions,

01:28:51.660 first of the district court,

01:28:52.840 and then in the D.C. circuit,

01:28:54.360 holding that President Trump was not immune.

01:28:57.060 You know, they tried to laugh that argument out of the lower courts,

01:29:00.000 especially with this ridiculous SEAL Team 6 hypothetical,

01:29:04.820 the idea that President Trump could order SEAL Team 6

01:29:07.900 to assassinate his political rivals,

01:29:10.480 and so the argument goes, you know,

01:29:12.960 because that would not make any sense,

01:29:15.400 therefore he can't have any form of immunity.

01:29:17.840 And I always thought that hypothetical was totally ridiculous

01:29:20.720 when the case eventually reached the Supreme Court

01:29:23.240 in a case called Trump the United States,

01:29:25.740 which was decided by the Supreme Court 6-3, most of it,

01:29:30.000 on July 1st of this year.

01:29:32.680 They gave that argument short shrift, too,

01:29:35.220 and they held consistent with the fact that

01:29:37.560 every other branch of government has some form of immunity,

01:29:40.420 that the President of the United States,

01:29:42.440 and it wasn't just applied to Donald Trump,

01:29:44.280 it was applied to all Presidents of the United States,

01:29:46.720 have to have, you know, a set of immunities.

01:29:49.620 And the immunities they decided that he had it

01:29:51.860 were basically in a trichotomy.

01:29:55.980 So the first tier is that when the President exercises

01:29:59.560 his core executive powers, you know,

01:30:01.680 the things that are at the heart of being President,

01:30:03.900 he is absolutely immune for those, full stop.

01:30:06.960 Then second, for anything else that he does,

01:30:09.740 which is not within his core powers,

01:30:11.360 so that would include things like speaking,

01:30:13.140 using the President's bully pulpit,

01:30:14.760 that he is immune out to the outer boundaries

01:30:18.080 of his office, as long as it has a nexus

01:30:20.680 to his official duties, which a lot of things do,

01:30:24.900 and that there he has presumptive immunity.

01:30:28.080 And in order to overcome it,

01:30:29.420 you'd have to show that it would really make

01:30:31.300 no impingement or inroads into the executive power,

01:30:35.440 you know, to be able to pierce that immunity.

01:30:39.440 So that's also a very strong form of immunity.

01:30:42.080 But that would be something like,

01:30:43.260 that would be something like he's, you know,

01:30:45.000 saying, you know, WWE is real,

01:30:47.340 and somebody sues him and says, it's not real.

01:30:50.380 It has nothing to do with the presidency, right?

01:30:53.640 Exactly, right.

01:30:54.740 And so, you know, it certainly, to my mind,

01:30:58.940 let's take the speech that he gave,

01:31:00.840 you know, outside the White House on the ellipse

01:31:05.200 on January 6th,

01:31:06.780 he was clearly talking about matters of public concern,

01:31:09.640 which the President can express himself on.

01:31:12.040 And I think that that is presumptively immune.

01:31:14.840 And I think to tell a President

01:31:16.240 that he could not set out his views about an election

01:31:19.460 would be an inroads into the presidency.

01:31:22.220 And therefore, he would also be immune for that.

01:31:25.060 So the last category in the trichotomy

01:31:27.720 is a category for which a President

01:31:29.420 would not be immune, Glenn.

01:31:30.840 That's the category of an unofficial act,

01:31:35.080 an act in a private capacity.

01:31:37.440 And so after the Supreme Court's decision on July 1st,

01:31:43.500 you know, it kind of goes down each step.

01:31:45.640 It steps down to the Court of Appeals level,

01:31:47.620 and they were manded back to the district court

01:31:49.460 to Judge Chutkin,

01:31:50.380 and then Judge Chutkin started to set proceedings,

01:31:54.860 more on that in a minute.

01:31:56.700 And then what's ultimately come

01:31:58.800 once she now has jurisdiction back of the case 1.00

01:32:01.380 is that Jack Smith was off to the side

01:32:03.440 working with an entirely different grand jury,

01:32:06.580 and he got this superseding indictment

01:32:08.800 that came out yesterday.

01:32:09.840 And in a phrase, what that indictment is,

01:32:14.180 you know, new indictment, you know, meet the old indictment.

01:32:18.440 You know, it's just the same as that old indictment.

01:32:21.740 He's just reformulated it to try to make it consistent with

01:32:26.280 and fit everything into the third box,

01:32:28.600 the box of everything President Trump did

01:32:30.860 that he had indicted for the first time

01:32:33.520 is actually a set of private acts

01:32:36.300 as opposed to a set of official acts.

01:32:38.560 And therefore, Jack Smith argues he's not immune.

01:32:42.240 So are they doing this to smear him yet again

01:32:46.860 so late in the campaign?

01:32:49.160 Or is this a plan just in case he wins?

01:32:52.680 They think this will keep him out of office.

01:32:54.540 I think, Glenn, that they're doing it

01:32:59.360 for all of those reasons, right?

01:33:00.920 They absolutely want to block him any way they can.

01:33:06.300 There's no way that you should be issuing

01:33:18.140 And then, look, it also shows me

01:33:20.920 that this was being concealed.

01:33:23.080 So what happens is that the court was told,

01:33:29.120 because it was ready to go

01:33:30.580 and start trying to set deadlines and the like

01:33:32.600 to try to march back toward a trial,

01:33:34.860 and Jack Smith made a filing

01:33:36.340 in the last couple weeks that said,

01:33:38.300 no, no, no, hold on, slow down.

01:33:44.200 Well, I'm sure they were doing consultations

01:33:47.480 but that's not the real reason.

01:33:52.560 in secret grand jury proceedings

01:33:54.880 getting this superseding indictment.

01:34:00.420 the media has been all over

01:34:01.880 watching the D.C. courthouse.

01:34:04.440 back in the real height of this a year ago,

01:34:08.380 you know, no one could walk into the courthouse,

01:34:10.500 even if it was for an entirely different reason,

01:34:17.360 they must be going to the grand jury,

01:34:19.460 or there was, you know,

01:34:20.340 speculation amundo.

01:34:22.080 But for this proceeding,

01:34:23.340 somehow, like, it surprised everyone.

01:34:25.320 All of the mainstream media

01:34:26.960 purported to say,

01:34:28.840 well, Jack Smith's just consulting

01:34:30.380 inside the Justice Department.

01:34:31.780 I think that that was essentially

01:34:32.980 running a cover story

01:34:35.840 they were conveniently not watching,

01:34:37.600 or purporting not to watch the courthouse,

01:34:47.360 on that until the surprise of yesterday.
