01:10:45.940 this story yeah so aurora regino her daughter

01:10:49.900 was in the fifth grade she was actually 11

01:10:51.840 years old when an elementary school guidance

01:10:55.080 counselor facilitated the social transition of

01:10:58.340 aurora's daughter from female to male without

01:11:01.000 so much as a phone call to aurora so as a

01:11:05.380 result of this um egregious violation of

01:11:08.320 aurora's parental rights um we filed a lawsuit we

01:11:12.700 filed a lawsuit in federal court and

01:11:14.680 unfortunately the court dismissed the case the

01:11:17.100 court i think just absolutely got it wrong

01:11:20.520 and we that caused us to appeal to the ninth

01:11:24.140 circuit court of appeals we filed that appeal

01:11:26.640 hold on just a second why did they just dismiss

01:11:28.920 it what what was the reason for just not

01:11:31.100 hearing the case just dismissing it

01:11:32.720 they dismissed it because the the court

01:11:35.300 reasoned that there was not a a

01:11:37.940 constitutional right violated so in fact

01:11:42.260 what's really um interesting is the response from the court of appeals

01:11:47.800 so last year we filed um an appeal at the ninth circuit court of appeals

01:11:52.360 when you file that appeal you have a three judge panel

01:11:55.200 that here's the here's the case they came out um just

01:11:59.220 about a week or two ago and uh and gave an opinion and they they said the

01:12:04.940 lower court applied the wrong standard and this is what the standard that the

01:12:09.000 lower court applied they said that

01:12:10.520 we've failed to establish that there was a fundamental right

01:12:14.340 violated because there was an existing precedent that clearly established that

01:12:19.260 fundamental right which is a ludicrous standard

01:12:21.700 yeah i mean doesn't our constitution say if it's not enumerated in the

01:12:25.760 constitution it belongs to the state or the people

01:12:28.400 it does it does so we don't need an enumerated right to

01:12:33.200 have you know uh control of our own family and

01:12:37.100 counsel with our own children right correct correct in fact the the ninth

01:12:43.280 circuit um gave direction to the lower court and said look

01:12:46.140 the standard that you applied is is of course ludicrous the standard that you

01:12:50.900 should apply are is this idea that there's a

01:12:54.660 a fundamental right if something is objectively deeply rooted in the

01:12:58.840 nation's history and tradition and so here the lower court expected us

01:13:03.760 to point to precedent that that that said parents have a right to know and to

01:13:08.980 consent to the social transition of their child in a public school setting

01:13:13.900 well of course there's not case law that says that because this is a new

01:13:17.280 phenomenon that's happening not just in california but in states across the

01:13:21.460 country where these parental secrecy policies are being implemented being

01:13:26.060 applied where schools are really poisoning kids minds at a very young age as

01:13:31.100 early as kindergarten with this idea of transgenderism and changing their their

01:13:35.340 gender and and and it's all on this this basis uh this legal falsehood that

01:13:42.400 kids have a right to privacy from their parents it's it's completely a legal

01:13:47.980 falsehood so we are encouraged we're encouraged that this case has been

01:13:52.020 revived uh by the ninth circuit of all places the

01:13:55.720 ninth circuit is is is getting this issue right whereas we've

01:13:59.480 seen some other circuits across the country get it wrong

01:14:02.200 can i can i ask you something when did the ninth circuit become like

01:14:06.620 like halfway sane well they've always been

01:14:10.380 crazy what happened what happened there i there wasn't like a an announcement it's

01:14:15.200 like we just slipped through a wormhole and all of a sudden they make sense

01:14:18.220 what happened there yeah yeah i mean it is a it's bizarre

01:14:22.440 makes me question everything but anyway go ahead

01:14:27.320 you know i'm not going to argue with it if the ninth circuit wants to revive this

01:14:31.920 really important case i'm happy i'm really happy about it and

01:14:35.500 and glenn i think what i would love to point out is just that

01:14:37.820 last year gavin newsom signed ab 1955 into law in california

01:14:42.940 and he did that in response to conservative parents

01:14:45.740 who ran for the school board they got elected and the first thing that they did

01:14:49.940 was they passed notification policies they said if

01:14:53.420 if a school starts facilitating the social transition of a child

01:14:57.280 they have to at least notify parents not even necessarily get consent from

01:15:01.300 parents at least call them let them know that this is happening

01:15:04.560 so in response to that the attorney general of california rob bonta

01:15:10.760 actually sued uh the chino uh valley unified school district

01:15:16.220 um and and and others as well to to have those policies declared

01:15:21.680 unconstitutionally had some success doing that

01:15:23.940 but they they filed they they signed this law gavin signed this law

01:15:27.760 ab 1955 that would strip uh school districts of the ability to even

01:15:34.120 pass and implement such notification policies they want to do all of this

01:15:39.880 to kids behind closed doors and and not let parents know but aurora's case

01:15:45.780 is important because whereas ab 1955 is a state law

01:15:49.760 aurora's case is a federal civil rights issue right it is a it is arises under the

01:15:56.280 constitution under the 14th amendment

01:15:57.980 and so if aurora's case is ultimately successful um it can

01:16:04.040 pretty much gut 1955 in california and i think set a a precedent that will be

01:16:11.480 um very persuasive across the country so we're looking at the decision that will

01:16:16.560 come out is either that children have rights and can make decisions that are

01:16:23.220 unrestricted or nearly unrestricted or parents uh their power of their children

01:16:31.640 is nearly unlimited right yes and and also another third actor in there is

01:16:38.520 really the role of government-run schools right this idea that government-run

01:16:43.940 schools know better than parents um what's what's in the best interest of

01:16:49.040 of their children and so it's it's almost like this presumption that that parents

01:16:53.720 are nefarious and they're not going to support their children in a in a in a

01:16:58.000 transition wherever people stand and there are strong beliefs on both sides of

01:17:03.340 this issue in the country but you know aurora regino we we we certainly make this

01:17:08.460 point in the papers we filed with the court aurora regino um

01:17:12.980 stated she would have been supportive of her of her daughter's transition

01:17:18.620 but she was taken out of the equation altogether she wasn't even given the

01:17:22.760 opportunity to be part of it and if she thought that this was actually

01:17:26.360 inspired uh she thought that this was this was actually originating from her

01:17:30.340 daughter and not being pushed upon her by the school you know would be a little

01:17:34.740 bit different so in fact um the first case this is not the first case we've

01:17:38.860 handled um with this set of facts the first case we handled was the case of

01:17:43.340 jessica conan in salinas california jessica's daughter was in the sixth grade

01:17:48.500 when teachers invited her to an equality club that met during the lunch hour and

01:17:54.880 it was the only extracurricular that that wasn't after school you know if if clubs

01:17:59.100 meet after school parents have to arrange for pickup but if it's in the lunch hour

01:18:02.680 during recess um these things can be kept secret from parents and that case

01:18:08.660 resulted in a in a settlement we recovered uh damages for for jessica um but i think

01:18:16.160 what has to continue to happen is when when parents see this happening they have to go

01:18:21.040 to the school board they have to shout them down i mean they really have to give it to

01:18:26.960 them if they're implementing these policies that violate parental rights if they're being

01:18:31.980 adversarial to parents in the way that they desire to raise their children um and and

01:18:37.960 they have to run for school board they have to win they have to pass these notification

01:18:41.960 policies they have to stand up they have to file these lawsuits they have to fight back

01:18:45.960 and we're seeing this groundswell across the country uh and as someone who's a parent myself

01:18:51.760 and um really really um obviously because of the work that we do interested in preserving these

01:19:01.300 rights it's really encouraging to see not only the um the movement uh toward parental rights but

01:19:08.280 also seeing that even courts in california are starting to starting to get it right and come

01:19:14.220 around to this this idea that of course this is a fundamental right i mean when when was it that a

01:19:20.720 a a parent didn't have the right to name their child right like if the the ninth circuit court of

01:19:26.220 appeal says that a fundamental right is deeply rooted in the history and tradition of a nation

01:19:30.720 parents have always had the right to give their child a name and that right extends beyond the

01:19:37.540 formation of the united states and this is really across the spectrum of humanity parents have

01:19:41.780 always given their their children a name well now schools are giving kids a new name a new identity

01:19:49.400 new pronouns all without so much as calling parents that phenomenon has to stop and the center for

01:19:56.980 american liberty is dedicated to to ending it wow i never thought of the i never thought of it that way
