00:27:51.800 I'll put my money in U.S. savings bonds or treasury bonds because they're the safest thing out there.

00:46:35.480 He died in the spring of 2015, which was right in the middle when Devin Archer had his business dealings with Hunter Biden.

00:46:55.500 The witness testified that over his 10-year relationship with Hunter Biden, there may be approximately 20 times when in one of those conversations, Hunter Biden would put his father at a dinner, not at a business meeting, at a dinner that he was having if he happened to get a hold of his father, and would ask his father to say hello to whoever was at the table.

00:47:19.320 It was unclear, and the witness testified, this is not me saying that, the witness testified that a lot of times, most of the time, Joe didn't even know who the people were at the dinner table.

00:48:23.720 He calls him, and then a week later, shockingly, for no apparent reason, he gets Shokin fired by withholding money in foreign aid from the United States government.
00:48:39.640 But that was, he just left the room for just a second, just for a second, to grieve with his dad.

00:49:01.200 We would love to understand, Alan, what exactly is Donald Trump being charged with in this latest indictment?
00:49:14.120 The basic charge is that he personally knew he had lost the election.
00:49:20.980 He believed that he had actually lost the election fair and square, and he engaged in all these actions with a corrupt motive.
00:49:30.140 I don't think the government's going to be able to prove that.
00:49:34.040 First of all, let me tell you something.
00:49:38.720 I talked to Donald Trump probably about two weeks before January 6th.
00:49:44.580 There is no way he believed he lost that election.
00:49:49.100 There's still, today, he does not believe he lost that election.
00:49:54.500 I can guarantee it.
00:49:56.000 You know him well enough to know that.
00:49:57.800 He believes he won the election, and he believes it was stolen from him.
00:50:03.620 I think he's wrong.
00:50:05.220 Many people told him he was wrong.
00:50:07.680 Many people are quoted in the indictment telling him he was wrong, but that doesn't make the crime.
00:50:13.100 Crime requires, beyond a reasonable doubt, that he himself actually knew and believed it and acted with a corrupt motive.
00:50:20.720 I don't think the government's going to be able to prove that.
00:50:23.800 But to state a broader point, when the Attorney General of the United States authorizes an indictment, as was done here, against the man running against the incumbent president, who is now tied 44-44 in the New York Times poll,
00:50:37.620 that indictment better be the strongest indictment in American history.
00:50:42.260 There should be a smoking gun, fingerprints, a videotape, and a confession.
00:50:46.320 This document is so flawed, is so filled with speculation.
00:50:51.760 Jack Smith's famous for bringing speculative cases and then being smacked down by appellate courts.
00:50:57.820 This just doesn't satisfy the Banana Republic test.
00:51:02.980 In Banana Republics, presidents prosecute their political opponents.
00:51:07.880 And the stronger their political opponents are in the polls, the more likely they are to be prosecuted.
00:51:13.360 And we don't want that to happen in the United States.
00:51:17.080 And I think this indictment doesn't meet what I call the Nixon standard.
00:51:22.460 The Nixon standard is Nixon's crimes were so obvious that even his political supporters favored his being impeached or being prosecuted.
00:51:31.820 That's not the case here.
00:51:33.860 Right now, the only people who seem to support this indictment are partisans who are anti-Trump.
00:51:39.300 And that's just not enough to heal the divisions in this country.
00:51:43.140 So this indictment will further the divisions, especially if it's ultimately reversed on appeal.
00:51:48.300 Look, the indictment is brought in the District of Columbia.
00:51:50.560 The District of Columbia jury will convict anybody named Trump for anything.
00:51:55.220 And that's why the case should be moved to Virginia.
00:51:59.000 It will be subject to a motion to change the venue to Virginia where you have a level playing field.
00:52:05.420 It's a purple state.
00:52:06.360 This case should be tried in a purple state, not in a bright, bright, bright, bright, bright democratic state.
00:52:14.220 And that's where it's being tried, in the most Democratic district in the United States of America, the most anti-Trump district in the entire United States.
00:52:24.140 That's where the trial is scheduled to be held by a judge who has a very questionable background.
00:52:31.660 She worked for years for a firm that's highly questionable, the David Boyce firm, very, very Democratic-oriented.
00:52:42.320 They represented Hunter Biden.
00:52:43.320 She was working, right, and Burisma, and she was working there at the time of all of that stuff.
00:52:49.740 Not saying that she was involved in it, but...
00:52:51.660 Right. David Boyce and his firm have been charged with more cases of corruption and disbarbable conduct than any law firm in modern American history.
00:53:05.740 And it's well known for its being subject to so many charges.
00:53:13.440 And she was part of that firm.
00:53:15.140 And that's not something I would brag about.
00:53:17.540 I got that firm disqualified in a case because of a conflict of interest.
00:53:22.020 And they've been charged over and over again with conflict and other kinds of things.
00:53:26.160 And she spent most of her career in that firm.
00:53:28.820 So if I'm Donald Trump, I don't want to be tried in front of her.
00:53:32.340 I want to be tried in front of a judge who has a fairer and better background.
00:53:37.480 And I want to be tried in front of a jury that isn't 90-something percent anti-Trump voters.
00:53:44.820 Can he get that done?
00:53:46.160 He can try.
00:53:47.900 And if he loses, it will be subject to appeal.
00:53:51.320 And that might be the kind of thing that could be appealed immediately as well.
00:53:55.460 There's some dispute about that.
00:53:57.180 But change of venue motions can sometimes be subject to what are called interlocutory appeals.
00:54:03.860 So there's a lot that will happen before he stands trial in the District of Columbia in front of this judge.
00:54:10.380 This judge also is the January 6th hanging judge.
00:54:16.080 There hasn't been a single case that has come before her that she hasn't given tougher sentences than even the government was asking for.
00:54:24.880 Well, I mean, you need to have, in this case, when you're trying the man who's running against the incumbent president, it has to be Caesar's wife.
00:54:36.260 It has to be clearer and cleaner than anything.
00:54:39.560 And having the trial in the District of Columbia in front of this judge on the basis of an indictment of this kind is going to just sow greater divisions in this country.
00:54:48.960 People are not going to be satisfied that this is fair, objective justice.
00:54:53.800 You know, the Bible, the Torah says, lo takir ponim to judges, don't recognize faces, don't do justice based on who the person is, do justice based on the law and the facts.
00:55:05.520 And the law and the facts don't support this indictment.
00:55:09.360 I don't know how you feel about Jonathan Turley.
00:55:12.860 I generally like him because he's kind of like the Constitution.
00:55:17.440 He doesn't always fall my way.
00:55:19.480 And so he said yesterday that this is the first criminal indictment of alleged disinformation.
00:55:28.900 If you take a red pin to all the material presumptively protected by the First Amendment, you can reduce much of the indictment to haiku.
00:55:36.380 I felt the Mar-a-Lago indictment was strong.
00:55:39.380 This is the inverse.
00:55:40.500 In fact, it's unfair at points.
00:55:43.040 It quotes Trump in his speech about encouraging people to go to the Capitol.
00:55:47.400 But like the January 6th committee, it omits where he says you should go peacefully.

00:58:51.200 And this indictment takes us down the road toward criminalizing free speech.
00:58:58.740 And, you know, what is true and what is not true is often in the eye of the beholder, particularly in the political context.
00:59:04.500 Remember, Chief Justice Rehnquist, a conservative chief justice, said the First Amendment doesn't recognize a false opinion.
00:59:12.100 False opinions and true opinions have the same status under the First Amendment.
00:59:17.360 And this is a case criminalizing false opinions, what people believe are false opinions, what I believe is a false opinion.
