01:12:29.740 And mind you, this guy's got no criminal background.

01:12:36.780 He's walking down the street on February 14th, uh, Valentine's day, day of love.

01:12:42.540 And the bad guy, I'm not going to use his name, comes up behind him, robs him on the

01:12:48.020 street, shoots him twice in the back and runs off.

01:12:51.820 Now, some surveillance cameras, uh, see him that are just on the street, uh, see him going

01:13:00.280 into a particular apartment.

01:13:02.800 Well, fast forward a week, police doing their investigation, trying to figure out what happened.

01:13:07.240 Um, and as a, uh, he goes to a convenience store and the surveillance camera there over

01:13:16.200 the cash register, uh, picks up his face and he goes back, uh, same kind of route to the

01:13:23.120 same apartment.

01:13:23.800 And so they go, Hmm, wonder who lives there.

01:13:27.020 And they run the probation, uh, website from, or the parole website from the department of

01:13:33.960 corrections.

01:13:34.520 And lo and behold, there's a felon there.

01:13:35.920 Uh, then they run, uh, that guy against the, um, excuse me, they get, they grab a facial,

01:13:44.000 uh, freeze frame off of the convenience store footage and run it through Clearview AI.

01:13:49.880 And it's a match.

01:13:51.440 So they say, aha, they go in and get a search warrant from the judge, uh, during the search,

01:13:59.180 they come up with the gun, uh, the, the murder weapon.

01:14:02.820 And so they arrest the guy.

01:14:04.460 Uh, they've got a pretty good case at that point.

01:14:07.140 She goes to court and complains and says, Hey, that facial recognition stuff is not reliable.

01:14:13.980 They say right on there that you can't rely on it and, and don't use it in court.

01:14:19.520 And, um, the judge tosses the results of the, of the search, which means, uh, this guy's

01:14:27.460 going to walk if we don't have the murder weapon or evidence.

01:14:32.160 And he, that he tosses that because the Clearview evidence is what got you the warrant.

01:14:39.300 So anything is fruit of a poison tree, correct?

01:14:43.440 Well, that's what the argument is.

01:14:45.540 Um, but the, the law says that there's a, a longstanding, uh, decades long, uh, good
