00:02:10.060 Times wanted to do a feature story on me, a human interest story about how devastated I was and how it's destroying my family, all that.

00:02:17.120 I said, I don't know where you're getting that.

00:02:19.180 We're in the middle of a fight of our lifetime to decide whether freedom is going to survive in this country or not.

00:02:26.160 And for whatever reason, I've been cast in a leading role on the front lines of that fight.

00:02:30.020 I can't imagine anything more important for me to be doing.

00:02:33.460 And it's precisely because I've got the academic and political credentials, the legal credentials to fight against this, perhaps as well as anybody in the country, that they're going after me so hard.

00:02:45.160 So it's a little bit like my old professor said, if you're not catching incoming flack, you're not over the target.

00:02:50.640 I guess I'm not only right over the target, but I've got weapons that they're very afraid of.

00:02:56.740 Well, the truth in this instance has been ignored for what is now nine years when it comes to President Trump and the political persecution of a presidential candidate, a president, and then a former president.

00:04:48.760 And anyone that is trying to talk about it or talk about the subsequent scandal of the illegality in the 2020 election, they're the ones that are going that people are going after like me.

00:04:59.120 And, you know, there's an old an old ad in English common law of seditious libel is called if you criticize the government, you could be prosecuted.

00:05:08.780 And truth was not a defense, because if what you were saying about the government was true, that was more harmful.

00:05:18.460 Our First Amendment was written in large part to prevent that.

00:06:27.440 You know, give us every bit of evidence you have for every speech you made, for every media interview you did, for every line and every brief you filed.

00:06:34.840 And I did. I gave them tens of thousands of pages of documents supporting and they filed the charges anyway.

00:06:41.320 And then we went through the most expensive and longest bar disciplinary proceeding in history.

00:06:45.520 Lasted over 10 weeks, cost me upwards of three quarters of a million dollars.

00:06:49.560 But it was the first time that the evidence had actually been placed in a court record.

00:06:55.540 And then they ignore it.

00:06:56.820 And they doctored, by the way, the attorneys going against me, doctored a quotation from a court decision to make the decision appear as if it said something dealing with the Electoral Count Act's constitutionality.

00:07:10.260 This was a critical part of my legal analysis.

00:07:13.200 And they said the court the day before I was making these claims, the court had already ruled the Electoral Count Act was constitutional.

00:07:19.720 They doctored that quotation.

00:07:21.160 It did not say the Electoral Count Act.

00:07:23.080 That was not even at issue in the case.

00:07:25.020 It was state statutes delegating authority to governors to certify elections.

00:07:30.040 And they doctored it and they submitted it to the court in a in a formal pleading, an overt misrepresentation of the court.

00:07:36.920 The very kind of thing they are falsely accusing me of having done.

00:07:40.680 And they do it right there.

00:07:42.040 And instead of chastising them or calling them out on it, the judge repeats the doctored quotation in the opinion.

00:07:48.560 Did you point that out to her, that she was not only was she dealing with a doctored quotation citation, she was also repeating the lie.

00:08:02.580 We pointed out the doctored quotation in a filing.

00:08:05.900 We have not yet had a chance to point out to the appellate court that she then repeated the doctored quotation.

00:08:12.000 But that will come in short order.

00:08:14.820 The Bar Association has to know what a calamity this decision to persecute you is.

00:08:23.100 They have to understand that if they have anything resembling an IQ.

00:08:29.640 Well, even even lawyers on the left side of the aisle have been contacting my my attorneys expressing outrage for for two things.

00:08:41.420 This is a very serious threat to the rule of law and the ability of controversial clients, controversial in the minds of the elite, that is, to have actual representation.

00:08:51.100 But more importantly, they spent millions of dollars bringing this prosecution against me.

00:08:57.060 And now they're petitioning to raise their fees because they need more money.

00:10:53.080 We're back now with John Eastman who faces extraordinary evil forces, I'll put it that way, in the state of California, seeking to disbar him, to remove his livelihood, and to deny him due process in any fashion, resembling something that should be fundamental to the American way of life and our judicial system.

00:11:22.300 It is the opposite.

00:11:23.960 This looks like the Soviet judicial system circa 1982, just to pick a year.

00:11:31.580 I mean, John, the frustration, aside from the grievances that you have in terms of money and your time, this has got to be almost beyond your own belief that you're going through this.

00:11:47.040 It is certainly surreal.

00:11:48.200 You know, lawyers have an ethical obligation to zealously represent the entrance of their client.

00:11:56.640 We have an ethical obligation to pursue every lawful avenue.

00:12:02.300 And, you know, you look at Thurgood Marshall, for example, when he pursued getting rid of separate but equal segregation in public schools.

00:12:09.820 That was contrary to longstanding, controlling Supreme Court precedent.

00:12:16.300 But the standard for lawyers is to push back against even bad precedent if you think you've got a reasonable or colorful argument to be made for changing the law.

00:12:26.380 The things I was advising on, there was no law interpreting the constitutional provisions we were dealing with.

00:12:33.000 So it wasn't like I was seeking to overturn something.

00:12:35.440 I was giving an interpretation of the Constitution that I remain of the view was correct.

00:12:40.560 But it was certainly an open question.

00:12:42.460 And it would have been unethical for me not to pursue those avenues on behalf of my client.

00:12:47.140 So for doing that, I'm now being charged with, what's the phrase they like to use, moral turpitude.

00:12:55.420 I mean, it's just stunning.

00:12:58.680 That sounds like it could cover a lot of ground, doesn't it?

00:13:01.100 Well, it certainly covers the conduct of the people that are bringing these charges against me.

00:13:05.180 But the problem is, they don't fear the shoe ever being on the other foot.

00:13:11.740 And that means you can abuse power without consequence.

00:13:15.140 And that's a huge problem for the ongoing rule of law in this country.

00:13:19.500 You know, I see people right now in the Republican Party wrestling with sort of like responses to the evil that has been done by the Marxist Dems Party.

00:13:35.140 Whether it is Mark Elias and his lawsuits and all of the stratagems that he's pursued that some would say were just outrageously corrupt and utterly wrong.

00:13:50.480 But whatever you think of him, he's been effective.

00:13:53.760 Now we see the Republicans arguing over early voting.

00:13:57.860 And we know that that goes beyond what was envisioned by the Constitution.

00:14:02.720 It goes beyond anything that I'm aware of that's codified in state election law, or at least up until COVID-19, certainly.

00:14:14.880 We are, and the Republican Party means to go out and get as many early votes as they can because it is the battleground upon which they find themselves fighting.

00:14:26.260 I see it as just wrong.

00:14:28.800 Why not move to the right?

00:14:30.780 And by that I mean go to the law and let it prevail, because therein lies our ultimate protection, whether we're Republican or Democrat, liberal or conservative.

00:14:44.060 The Constitution actually requires election day, not election month or election month and a half.

00:14:49.840 This notion that we can have early voting, we can have mail-in voting, we can have people without any of the guardrail checks on fraud, you know, just gathering as many ballots as they can.

00:15:02.240 All of that throws out the window, the notion that the end result actually reflects the consent of the governed.

00:15:10.020 This is bigger than just losing or winning a single election.

00:15:13.800 This is about whether we're going to remain a Republican form of government rooted in the consent of the governed.

00:15:19.380 Because if we don't control our elections, if they are not fair, if they're not honest, we cease to be citizens in a free republic and we become serfs, slaves in an increasingly tyrannical government.

00:15:33.060 These are the stakes.

00:15:34.880 You know, people say, why don't you just give up and, you know, they'll leave you alone.

00:15:40.060 You know, I'm not going to hand a tyrannical government or my kids and grandkids have to live under.

00:15:45.760 I happen to have been cast in this role on the forefront to be able to fight against it.

00:15:50.520 And I'm going to fight against it.

00:15:51.700 This is this is the fight for our time and for our freedom.

00:15:56.020 And anybody that doesn't understand that, get out of the way so the rest of us can engage in this fight.

00:16:02.760 And unfortunately, we have to say that to the Republican National Committee that has decided to advance early voting and to take the battle to the streets rather than to the courts.

00:16:14.260 And I have to say, I am very disappointed in Laura Trump, the co-chair.

00:16:21.760 The new leadership of the RNC is making a tremendous mistake because those of us who love this country, who are America first, we are MAGA to the bone and we support Donald Trump.

00:16:37.760 I can't support an unconstitutional act like early voting, whether it comes from the RNC or the DNC.

00:16:45.260 Well, and the other thing they forget is it's not just early voting, it's early fraudulent voting that the Democrats engaged in.

00:16:52.900 And, you know, in 2018 in North Carolina, a former Democrat operative was hired by a Republican and he engaged in illegal ballot harvesting.

00:17:01.340 And so it's now the Republican did it and he was prosecuted and the and the candidate had to withdraw.

00:17:06.200 So so so if if we engage in it in the way they do, which is illegally, our guys will be prosecuted.

00:18:41.680 Well, when when we supervise the election in Iraq.

00:18:47.120 People came in on a day.

00:18:50.100 They were put an indelible ink on their thumb so they couldn't come back later and vote again.

00:18:54.340 We don't have anything remotely like those checks.

00:18:58.220 We don't even in most places check your I.D. to make sure the person you're claiming is actually the person counting the ballot.

00:19:05.840 In Wisconsin in 2020, they have a law that says you have to have a witness who knows you that signs under oath that the person submitting the ballot is the person they claim they are.

00:19:15.700 And you have to put in your name and address if you're the witness under oath.

00:19:19.200 That wasn't done in thousands of ballots.

00:19:21.820 And the county clerks were directed to Google the names and try and doctor the evidence and put in ballots.

00:19:28.880 I mean, that was a check against fraud that they just blew through.

00:19:33.280 This this has been happening for far too long.

00:19:35.800 And we will lose our ability to control the direction of our government if we don't get a handle on it.

00:19:41.040 John, do you believe that we can get this corrected in time for the 2024 election?

00:19:46.560 And because the RNC seems hell bent on doing it.

00:19:51.640 And I I wish that every Republican would tell they go call into the RNC, their congressional delegations and tell them, hell, no, we're not going down that path.

00:20:38.800 You know, the mean tweet thing, the superior view of Trump is is these Lilliputians are condescend to the giant of our time politically is hilarious to watch. 0.99

00:21:49.700 They do not understand the dynamic of the war, literally war that we were in internally in this country and and and and in either sitting on the sidelines or in joining forces with the left in order to stop this MAGA movement, the outgrowth of the Tea Party movement.

00:22:08.720 I mean, it was the Republicans in Washington that saw the Tea Party rather than the Marxist takeover, the Democrat Party as the bigger threat to this country.

00:22:17.320 And and, you know, and and they know they don't they don't run the party anymore. 0.99
