00:00:19.000 Russian missiles, rockets, and bombs still pummeling Ukraine.
00:00:23.600 11 days of hell raining down on Ukraine's people and their cities.
00:00:27.700 Almost a million and a half Ukrainians have fled their country,
00:00:32.000 the largest number of refugees since World War II.
00:00:35.900 And the war goes on.
00:00:37.700 One U.S. defense report that the Russians have fired 600 missiles already into Ukraine,
00:00:44.260 and almost all of the Russian forces that had been held in reserve on the border with Ukraine
00:00:49.940 have now joined the fighting and are very much in the Russian war against Ukraine.
00:00:56.200 The total of all Russian troops that were positioned in Russia, Belarus, and Moldova
00:01:02.260 numbered 100,000 to 150,000 when that invasion began 12 days ago.
00:01:08.580 Putin has thrown almost all into his war against Ukraine.
00:01:13.300 The Ukrainian military and resistance forces continue to fight hard,
00:01:18.040 despite being outnumbered and facing far superior firepower.
00:01:21.760 And Russia controls the skies, although Ukraine is reporting success in shooting down
00:01:27.700 some enemy aircraft, as many as eight yesterday.
00:01:32.160 The Europeans and the United States have now built up the flow of arms, ammunition,
00:01:37.120 food, and supplies into Ukraine, as well as the anti-tank and anti-aircraft missiles
00:01:43.020 that they need so much.
00:01:44.900 President Zelensky wants more, of course, including jet fighters,
00:01:48.580 which the White House and Poland have reportedly approved.
00:01:53.160 Putin's reaction to that report was to order more missile strikes against airports.
00:01:58.660 And President Biden, who has said that he wouldn't sanction Russian oil,
00:02:02.780 is now under tremendous pressure from Capitol Hill to do so.
00:02:07.680 Putin has already said Western sanctions are like an act of war.
00:02:12.060 It's only reasonable to expect that he will react.
00:02:15.400 I understand those political pressures on the White House,
00:02:19.120 and I seldom agree with President Biden on his policies or decisions.
00:02:24.220 But in this instance, I do.
00:02:26.540 I obviously don't know his reasons or motivation for not banning Russian oil.
00:02:31.800 But I do know the risk of the boycott is not trivial.
00:02:35.760 And I believe those calling for the ban, the boycott,
00:02:39.100 are doing so out of an anger that we all share,
00:02:42.380 or their own political reasons, which obviously I don't share.
00:02:47.420 This is a time for President Biden to explain to the nation clearly his reasons for not banning Russian oil.
00:02:55.420 And if he were to change his mind,
00:02:58.240 to tell us what that ban will do to us and the world economy.
00:03:03.120 I'll go first.
00:03:04.520 And here's my thinking.
00:03:05.560 President Biden would be making a mistake to sanction Russian oil
00:03:10.040 because it would have only a negligible impact, in my opinion,
00:03:14.100 on Putin's ability to wage war, and then only over time.
00:03:19.280 Such a ban would have a major impact, however, on our economy.
00:03:24.360 We already have gasoline prices at more than $4 a gallon.
00:03:28.460 The ban would add, I would guess, anywhere from $1 to $3 within a matter of days.
00:03:34.640 Those price increases would ripple through our economy within a matter of a week to 10 days at most,
00:03:41.900 adding to the already high runaway inflation rate,
00:03:45.800 unsettling already volatile markets, and hitting our most vulnerable citizens hardest.
00:03:51.320 The impact on the global economy and the markets would be just as damaging.
00:03:57.260 And importantly, sanctions against Russia have not worked.
00:04:02.060 Not once.
00:04:03.800 Not ever.
00:04:05.360 Yet here we are.
00:04:07.060 Putin's Russia is at war with Ukraine, and perhaps Europe is next.
00:04:11.760 And we're talking about sanctions instead of how to stop Putin and his military.
00:04:18.040 And whatever the answer is, I truly believe it won't be as easy as simply sanctioning Russian oil.
00:04:25.780 All the other answers are hard, and most of them unthinkably so.
00:04:31.320 In times of rising global tensions and even the possibility of war, Americans once put their partisan politics aside and came together as Americans.
00:04:41.680 We did that for a short while, but that ended with Iraq and Afghanistan, and not likely, in my opinion, at all, any chance of coming together.
00:04:55.440 We're coming off a presidential election that half the country believes was rigged.
00:05:10.060 We have a president who ran as an avuncular moderate, but is leading like a Marxist bomb thrower.
00:05:17.000 And the Dems are driving partisan factionalism intensity higher with their January 6th committee and their obvious abuse of power.
00:05:26.280 We'll take that up with one of the leading attorneys defending and helping many of the defendant demonstrators who are accused of rioting in the Capitol.

00:05:38.260 The upcoming January 6th hearings will be a partisan clash like we haven't seen since, oh, well, the days following November 8, 2000, or the second impeachment attempted by the radical Dems.
00:05:52.560 These midterm elections will be critical to both parties, and historically, the party not in the White House picks up on average 26 seats in Congress, four seats in the Senate.
00:06:03.740 And we have with us today, one of the candidates who has his eye on one of those Senate seats.

00:06:18.240 And he's now, for the first time in his life, a politician who's running for the Senate seat in Georgia that's now held by a Democrat, Senator Raphael Warnock, described by many as a socialist.

00:06:42.600 You had to have some trepidation about doing this, as fearless as you are.
00:06:49.380 What's it been like for you to be a politician?
00:06:54.860 Well, I'm going to say something to you, and I probably wouldn't have said this a month ago.
00:06:58.460 Well, I feel this is the best thing I've ever done in my life, and that's over winning the Heisman, being on the Olympic team.
00:07:06.280 It's the best thing I've ever done.
00:07:08.320 And let me tell you the reason why.
00:07:09.980 I got a chance, as I said, when I decided to run.
00:07:12.780 I was wanting to go around the country, the state of Georgia, and listen to the people.
00:07:17.720 And by me going around and listening to the people, I sort of give them hope.

00:07:23.020 And, you know, being a Christian, you know, that's all I ever wanted to do is, you know, it's not about Herschel Walker.

00:09:59.400 But I met a young man from Ukraine, and he was on one of my listening sessions.

00:10:05.560 But what's wild about it is he was arrested in his country for being a Christian.

00:10:13.160 And he's a chaplain for the police department.
00:10:16.000 Well, what's interesting, he said, you know, in my country, I would have to pay someone to

00:10:21.780 And he said, I have to bribe someone.
00:10:24.340 He said, I was shocked that I can go to college here and I got an engineering degree.
00:10:27.720 And he also said, he said, you know, in my country, he said, you know, the government
00:10:32.940 can go into the school and use different kind of, use our kids for test projects, meaning
00:10:39.140 they can give them the vaccine shots for test projects and testing on our kids without the
00:10:43.580 parents' consent.
00:10:45.360 And by my wife telling me, Hirsch, you got to educate people.
00:10:48.360 And I said, guys, people are looking at the grass being green on the other side.
00:10:52.140 And I'm here to tell you, it's not.
00:10:53.860 I'm not here to tell you that I'm trying to win this seat, just win this seat.

00:11:55.460 And that's what I say to my opponent is, guys, I want to bring you guys.

00:13:03.060 First of all, I'm shocked that he's a pastor.
00:13:05.100 You know, he's a pastor in Martin Luther King's church.

00:13:08.140 Who believes that, you know, what Martin Luther King thought about some of the things he seemed to be going against.
00:13:13.600 You know, one of the first things that shocked me is his way of saying that, you know, he believes in abortion.
00:13:18.660 And he talks about there's no room for a doctor, a mother, and the government in the hospital.
00:13:27.160 But what about the unborn child?

00:13:31.980 And in the Bible, I told someone, I said, do anyone want to think about the Ten Commandments anymore?

00:13:45.560 And, you know, every man should be treated fairly.

00:13:51.320 And the things this senator Warnock voted for, now he's got a record.

00:15:06.840 But we have our leaders, the president of the United States, saying, if you don't agree with me, you're a racist.

00:16:53.440 And I have never understood why the African-American community leaders would put up with that for one doggone second.

00:18:28.480 I know Warnock is reputedly a socialist, but I did not know that Joe Biden was a Marxist, an authoritarian.

00:18:43.540 I grew up in the ages of Scoop Jackson where he was a moderate Democrat.
00:18:47.920 There is no such thing, as far as I can see, in the Democratic Party any longer.

00:18:56.900 We've become a situation where we have, if you're a Democrat, you're a Republican, you can't get along.

00:19:58.200 Like if I disagree with something that I think is going to hurt the Georgians or it's going to hurt this country, I'm going to really look into it and just say, no, I don't think that is great for what we need to be doing.

00:20:15.080 Oh, the Democrat policies are killing Georgia right now.
00:20:17.880 You know, you look at the crime rate and, you know, people get sad when I say this, but it's the truth.

00:20:24.740 Most Democratic cities that's ran now by Democratic leaders, crime is picked up.

00:21:08.980 They talked about things that has nothing to do with the infrastructure, things that if people stop and look at it, we have some of the cleanest air, cleanest water of any country out there.
00:21:18.940 So, guys, we need to look at this and take note of it that we can't continue to spend money we don't have.
00:21:24.620 And I said, you go to the Olympics, one of the most proudest moments of my life.
00:21:29.420 Yet we had Speaker Ms. Pelosi warning our athletes not to talk against this regime in China.
00:21:39.060 And I stopped for a moment and I said, it is so amazing that you warned our athletes right before the opening ceremony.

00:21:49.420 Are you putting them in harm?
00:21:51.060 Because here in America, we have the right to speak out whatever we want to do.

00:22:34.780 They have this pandemic, which has hurt the whole world.

00:27:04.260 If you would give us an update on the number of folks you're representing who were arrested
00:27:11.320 or charged for activities that day, and the current number of people, as you understand
00:27:17.960 it, being held in custody either in the D.C. jail or elsewhere.

00:27:48.840 They are criminal defendants in D.C.
00:27:51.860 District Court.
00:27:53.280 I am working now in concert also with John Kiannaga.
00:27:58.840 John Kiannaga is an attorney out of the D.C.
00:28:02.460 area.
00:28:03.580 He's also an ex-Army Ranger.
00:28:06.780 John has five defendants as well.
00:28:11.600 So together between John and I, we represent 10 people jointly.
00:28:17.300 I will second seat some of John's trials.
00:28:20.680 He will second seat some of mine.
00:28:22.560 We're sharing information in terms of a co-defense or joint defense agreement, which enables us
00:28:28.220 to work as a unit and pull together resources.
00:28:30.520 So that is a good thing.
00:28:33.900 In terms of people who are locked up, the number rises every day.
00:28:38.100 I think right now, approximately in the D.C.
00:28:41.960 Gulag, there is somewhere around 45 people.
00:28:45.860 And the number across the United States seems to be increasing.
00:28:50.800 And it's certainly increased since the last time that we spoke.
00:28:54.280 I know there's at least 15 or 20 more people who have been arrested and who are currently
00:28:59.580 awaiting various bail hearings.
00:29:02.600 So there's probably another 60 or so people, if not more, scattered across the country.
00:29:07.700 And that number, the expectation is that number will go up as well.
00:29:11.620 So, you know, it's interesting that that number is rising.
00:29:16.900 And I suppose we don't have any idea, really, at this point in aggregate, how many people
00:29:24.480 have had charges against them dropped.
00:29:26.460 I assume there would be a certain number of those as well.
00:29:30.500 Is there any way to get to that number?
00:29:34.200 Because we're looking at the number of people charged.
00:29:36.900 And surely some of them have had charges dropped because they were just sort of ensnared in
00:29:42.420 a vast net that day.
00:29:45.500 That's a great question, Lou.
00:29:47.480 And I think the best answer is this.
00:29:50.860 In terms of people who have actually been charged and then subsequently indicted, to my knowledge,
00:29:57.300 none of those charges have been dropped.
00:29:59.420 There are over 700 people who have been charged at this point.
00:30:03.140 And they haven't let go of a single case.
00:30:05.960 In terms of people who were looked at and investigated and then not charged, there is certainly
00:30:13.660 a fair number of those people.
00:30:16.960 I want to say it's probably somewhere between 50 and 100, if not more.
00:30:21.980 But those people are persons of interest to the defense bar, for the January 6th defense
00:30:29.560 bar, we'll call it.
00:30:30.460 For instance, there are several civilians or people who we don't know if they are civilians,
00:30:37.160 Ray Epps being one of them, who participated in the events of January 6th in a much more
00:30:45.500 meaningful way or nefarious way than any of my guys have.
00:30:49.860 But despite that reality, they have not been charged.
00:30:53.140 The FBI has cleared them to any wrongdoing.
00:30:56.320 And, you know, there's a big asterisk next to that and then parentheses on what the hell
00:31:00.540 is going on here.
00:31:02.000 So, you know, we have some serious questions about the people who have not been charged.
00:31:07.080 But with regard to those who have been charged and indicted, the government hasn't let go of
00:31:11.480 a single one.
00:31:12.220 Uh, and your clients, uh, are all of them, uh, out of, uh, out of jail right now?
00:31:20.380 Are they free on, uh, bond?
00:31:22.620 Uh, no, Lou, uh, Christopher Quaglin is currently incarcerated, uh, or detained, I should say,
00:31:29.640 in Northern Neck Regional Jail.
00:31:32.000 And, uh, Ryan Nichols is currently being held in what we're calling D.C. Guantanamo Bay or
00:31:38.900 the D.C. Gulag.
00:31:40.440 Uh, they have both been in jail for a very long time.
00:31:43.860 Ryan has been there for over a year at this point.
00:31:46.780 Oh, my God.
00:31:47.400 And Chris is, uh, is suffering badly in, in, in, uh, in jail as well.
00:31:52.980 The, the, the, the Northern Neck Regional Jail has, has not honored the fact that he's
00:31:57.800 had celiac disease.
00:31:59.180 And we spoke about this last time and he's, he's suffering a great deal.
00:32:03.040 And because these guys have been held under these egregious conditions for this long, because
00:32:08.420 Ryan has PTSD and, uh, is being psychologically abused.
00:32:12.680 And because Christopher has celiac disease and he's being denied proper medical treatment,
00:32:17.580 we are going to be filing habeas motions in both of their cases, which amongst other
00:32:24.220 things challenge the late, the legality of their detention in terms of time conditions
00:32:29.440 and duration, and also raise awareness to the fact that, Hey, you're allowed to detain
00:32:34.820 these guys and hold them for safekeeping, but you're not allowed to punish them.
00:32:38.560 We only punish convicted persons in this country.
00:32:40.580 And if you punish somebody pre-conviction, well, that's a violation of their rights of
00:32:45.480 due process.
00:32:46.120 And because of that, they should be released from jail.
00:32:48.900 So those are some of the things we're going to be talking about in these motions.
00:32:52.760 And what are their, the charges against them?
00:32:56.300 Well, most of these guys at this point who are in have been charged with, uh, assaulting
00:33:03.620 officers, uh, at one point or another and, or disrupting the, the governmental proceeding
00:33:09.860 and namely the certification vote that was taking place that day.
00:33:13.240 And then a bunch of in-between crimes, disorderly conduct, picketing, parading, you name it.
00:33:19.000 They, they, they throw the kitchen sink, but the real big ones are the disrupting the electoral
00:33:24.800 proceeding and the assault on officers.
00:33:28.300 Now, sometimes when people hear the assault on officers charged, they get really uncomfortable.
00:33:33.580 They're like, well, gee, if, you know, if these guys assaulted officers, maybe they should
00:33:38.400 be held.
00:33:39.680 And I understand that reaction.
00:33:43.200 Um, but, um, you know, we touched on this a little bit last time as well, but I'll say it
00:33:48.500 again, if, uh, if Tom, the, the, the, the, the, the postal guy and John, the school teacher
00:33:55.040 and Joe, the lawyer and Cindy, the doctor all showed up to January 6th at the Capitol that
00:34:01.900 day, having no prior contacts with the criminal justice system.
00:34:05.640 And then all of a sudden for the first time in their 50, 60 or 40 something years of life,
00:34:10.580 they're being charged with assaulting officers.
00:34:13.480 You have to ask yourself, why did that happen?
00:34:15.580 And the answer is clear is because in many situations, not in all situations, I'm not
00:34:21.100 saying all Capitol police or metropolitan police, but a significant number of them that
00:34:25.520 day attacked civilians.
00:34:27.940 The attacks were brutal.
00:34:29.020 They were unprovoked.
00:34:30.260 Um, and they often, uh, resulted in serious injury and then by instances all resulted in
00:34:36.420 death.
00:34:36.860 So these people stepped up in defense of those other people because what they were seeing
00:34:41.360 shocked them to the extent that they needed to involve themselves.
00:34:44.600 Do you have video evidence, uh, for your clients, uh, of their, of the event or incidents,
00:34:51.820 uh, incident that occurred, uh, uh, that they're charged with?
00:34:58.760 Uh, yes, we have, uh, we have video evidence of all of it.
00:35:03.040 So, um, yeah, there, there are, uh, there's serious video evidence.
00:35:08.000 So, so this could be adjudicated rather quickly if only, uh, you could get to trial and if you
00:35:15.020 could get them, uh, well, I would, you know, you're talking about habeas corpus, uh, it seems
00:35:21.920 outrageous that if you've got exculpatory evidence that is clear and forthright, or at least even
00:35:29.880 just mitigating, uh, it would seem like this is something that would be in the interest
00:35:34.380 of the judicial system, uh, the legal system, but the penal system for crying out loud to
00:35:41.240 move these people out of there.
00:35:42.740 And certainly in the name of justice, someone should have already handled this in the course
00:35:48.460 of the past year.
00:35:49.520 Am I, am I just simply wrong?
00:35:51.860 No, you're, you're, you're on the, you're on the right track and your, your, your instincts
00:35:55.940 are, are, are, are great.
00:35:57.260 Uh, the, this is the situation, uh, COVID-19 was used as a pretext to delay everything.
00:36:03.720 Um, and because COVID-19 was used as a pretext to delay everything, uh, the government was
00:36:10.560 able to drag their feet and drag its feet.
00:36:13.160 And in terms of turning over discovery, um, it turned it over incrementally and it's still
00:36:18.440 turning it over.
00:36:19.280 And then very recently they dumped a tremendous amount of information all on us at one time.
00:36:24.960 Now the government has had over a year to sit with this material, to monopolize it, to edit
00:36:30.900 it, to disseminate it to us in a way that serves them and not our clients.
00:36:35.520 And we have to, um, build, um, all of this from the ground up, search through it, parse
00:36:41.280 through it, see what's advantageous, what's disadvantageous, what's innocuous, so on and
00:36:45.580 so forth.
00:36:46.040 That takes time, but because the government is now saying, oh, we've turned over all the
00:36:51.300 information in this case, we're now ready for trial.
00:36:54.720 The judges are pushing us out to trial.
00:36:57.160 And many of us have said, Hey, listen, judge, wait a minute here.
00:37:00.180 Uh, we need some time to go through this information because you just dumped eight months worth of
00:37:05.280 information on us.
00:37:06.320 It is sad that, uh, Christopher Quaglin is inside and it is sad that Ryan Nichols is
00:37:12.320 inside and they shouldn't be, uh, but they are, but I have gotten each of those clients
00:37:17.600 to, to, to, to, to, to agree to the fact that we need to process this information in the
00:37:22.140 most intelligent way possible.
00:37:23.800 So please don't rush us.
00:37:25.580 Give us the time that we need and let us tell you when we're ready at this point that,
00:37:30.140 you know, in order for us to proceed to trial, because we need to process this information
00:37:33.580 in the right way.
00:37:34.340 The judges don't care.
00:37:36.680 They've just said, hire more people.
00:37:38.100 You're going to go to trial next month or in two months or whatever.
00:37:40.660 They don't care.
00:37:41.580 They haven't shown us an ounce of mercy.
00:37:44.100 And this is, this is tactical.
00:37:45.700 The government knew exactly what it was doing.
00:37:47.660 Delayed, delayed, delayed until the COVID restrictions were, were, were, were alleviated.
00:37:52.620 Dump all the information on them at one time, crush the defense guys under the information
00:37:57.160 because the judges are going to send them out to trial.
00:37:59.480 And that's exactly what's happening.
00:38:00.620 Do you, do you have unedited video that we could see on this broadcast?
00:38:06.780 Uh, uh, so, uh, the answer is, is, is, is yes.
00:38:12.240 Uh, and no.
00:38:13.760 So the way it works, Joe, you, with answers like that, you're going to make me think I'm
00:38:19.860 talking with a leading attorney.
00:38:21.320 The answer is, do I have the video in my possession?
00:38:26.360 The answer is yes.
00:38:27.700 Here, here, here's the issue.
00:38:29.640 Um, because the government knows that the video hurts them, the government has filed for
00:38:37.180 protective orders and all of the, what it has labeled as highly sensitive material.
00:38:44.200 So that has to do with closed captioned, uh, body cams, so on and so forth.
00:38:49.500 And because they've labeled it highly sensitive, they made it impossible for us to crowdsource
00:38:55.080 the investigation process, meaning that I could release 20 videos to the public and appeal
00:39:00.660 to the public and say, Hey, if you guys want to help with January 6th related stuff, investigate
00:39:05.200 these, look for these suspicious persons, help us parse through this video.
00:39:08.440 And we can get that done in a week, but, um, in order to prevent us from doing that and
00:39:13.440 prevent the media from seeing the truth, they have filed for these protective orders.
00:39:17.340 And every time I want to show somebody like you, Lou, a video, I have to get permission
00:39:22.300 from the court.
00:39:23.380 Um, and I have been successful in getting some of these things overturned and, and, and,
00:39:28.540 but anytime I want to show you that's anything new, I can't do it without the court's permission
00:39:32.660 and without tipping off the prosecution, which is, you know, it's ridiculous.
00:39:36.280 It's straightforwardly, what I wanted to do was to look at it and then be able to share
00:39:39.960 with the audience of this podcast, what I had seen, uh, and, uh, it, we're going to
00:39:47.160 be adding video as a component to this podcast very soon, but in the interim, uh, just to
00:39:53.860 describe it, uh, is important.
00:39:55.840 Uh, so I, I'm going to, uh, but anyway, so I understand exactly what you're saying.
00:40:01.220 I'm sure the audience does as well.
00:40:02.720 This is a very difficult situation.
00:40:04.580 It's an unfair situation, both to, uh, your clients, uh, to you and to all of us who, uh,
00:40:10.960 as Americans, we not only ask for justice, we demand justice and we're not getting it.
00:40:16.620 Uh, I happened, uh, you know, I, I talked with a number of the Congress people, congressmen
00:40:22.180 and women who have gone down to the DC jail.
00:40:24.940 What they report back to us is just, uh, harrowing, uh, the treatment of people.
00:40:30.100 It's resulted in the head of, uh, the prisons, uh, being replaced.
00:40:34.960 I'm not, I'm not sure about the quality of the people who replaced them.
00:40:38.400 Uh, we also know that they have a huge staff, uh, uh, shortage, uh, and it is a nightmare
00:40:45.400 what these people are going through.
00:40:47.480 Now, some of them may be guilty, but they're still American citizens have rights and should
00:40:51.320 be treated as Americans, uh, irrespective of their, uh, guilt or innocence.
00:40:57.940 But the innocent, my God, they should be out of there now.
00:41:02.600 Uh, it's, it's, it's true.
00:41:04.320 And under the meaning of the bail reform act, even if you are not quote unquote innocent,
00:41:09.780 right, you're still entitled to, the government has to prove each element of every crime charge
00:41:14.360 beyond a reasonable doubt in court in front of a jury of your peers by the rule book.
00:41:19.260 It's, uh, you know, they, they, they have a tall order that they have to accomplish to
00:41:23.400 prove somebody guilty of a crime in this country.
00:41:25.720 And that is a good thing.
00:41:27.580 Um, but unless you are an out and out of flight risk or an actual danger to society, you should
00:41:33.880 be able to fight these cases from the comfort of your home.
00:41:36.700 And they have taken that away, um, to, from these individuals and they are constitutionally
00:41:41.980 entitled to do that.
00:41:43.140 You know, let me ask you this, Joe, I'm sorry to interrupt, but, uh, it occurs to me what
00:41:50.020 percentage, uh, is best you can estimate.
00:41:53.320 I'm not going to ask you about your clients per se, but I'm of the people who have been
00:41:57.760 charged with, uh, serious offenses.
00:42:01.020 Um, what percent of them would you say have, uh, uh, uh, history, uh, a rap sheet, uh, a record,
00:42:10.260 uh, of, uh, previous offenses?
00:42:12.660 I'd say, uh, conservatively less than 2% and at the most, probably less than 10%.
00:42:22.700 Wow.
00:42:24.080 Yeah.
00:42:26.120 These guys, these people should not be in there.
00:42:28.160 There is, there is no question about it.
00:42:31.380 Um, they know that these people are not familiar with the criminal justice system and they are
00:42:37.720 betting that these guys are going to take pleas that are unfair to them in order to wrap this up,
00:42:43.200 uh, most expediently as possible because they simply don't want to be there, um, any, anymore,
00:42:48.880 but that, that's how the coverup happens and that's how justice is averted.
00:42:52.140 Um, and that, that's not what should be happening.
00:42:55.000 They, they shouldn't be leveraging the pretrial, pretrial detention and torturing these guys,
00:42:59.220 um, while, while they're there so that they'll take a bad plea deal.
00:43:02.980 It's ridiculous.
00:43:03.760 And, you know, when you have somebody like Ryan Nichols, who, um, is a, is a decorated veteran,
00:43:09.180 uh, honorably discharged from the Marine Corps, spends 75 to 80 days a year doing search and
00:43:15.220 rescue work, rescuing people from storms and tornadoes and floods, runs a business in Texas where
00:43:20.980 he employs second chancers.
00:43:23.260 These are people who are former addicts or former felons, um, and has two young kids at
00:43:27.900 home.
00:43:28.720 He, he shouldn't be there.
00:43:30.280 And not only is he there, they've taken away the ability for his family to see him and they've
00:43:35.540 taken away the ability in person and they've taken away the ability for him to even see
00:43:40.580 his family on a video call.
00:43:42.380 Every other section of the jail, all of the detainees can see their families on a regular
00:43:48.820 basis, either in person or via video conference, Ryan Nichols and Christopher Quaglin haven't
00:43:53.880 been able to see their family in over a year.
00:43:56.160 What is that about?
00:43:57.540 Why is it?
00:43:58.480 They're trying to break the blue.
00:44:00.780 They're trying to break them.
00:44:02.640 Uh, you know, this, this would be one thing of this jail.
00:44:05.840 We're in Tehran it's in Washington, DC, or it's in, uh, other places, uh, Virginia or
00:44:14.220 wherever.
00:44:15.260 But, uh, if this is what we've got going, uh, and I want to give you just pause here for
00:44:20.340 a moment.
00:44:21.100 And the last numbers I saw were from, uh, NPR on this 140 federal prosecutors working on
00:44:29.440 the investigation of these people, 725 people that had been arrested initially, 165 pleaded
00:44:36.480 guilty, most misdemeanors.
00:44:38.860 And by the way, uh, when Joe talked about interrupting the U S Congress or disrupting
00:44:44.380 it in business, that is a felony, by the way, it is an absolute felony.
00:44:49.720 Uh, and I'm sure that not a person among them knew understood that, uh, when they were
00:44:56.520 there, but 70 people have been sentenced only about 70.
00:45:00.840 You may be able to update that, uh, Joe, but, and 30 have received prison time and others
00:45:05.920 with probation.
00:45:07.100 Uh, this is, this is justice at a snail's pace that, as you said from the outset is that
00:45:15.600 incarceration time is punishment.
00:45:18.340 Uh, and they haven't been found guilty in any one of those cases of anything.
00:45:23.560 Uh, this is outrageous and I don't understand why the Republican party is not standing on
00:45:31.020 the throats, uh, of those, uh, who are in charge of the, of the, uh, penal system there
00:45:36.900 in DC, uh, are throughout the Bureau of Prisons demanding that they act like this is a constitutional
00:45:45.420 republic.
00:45:46.020 Well, they're not doing it because these people, um, are objectively, uh, the January
00:45:54.000 6th cohort, they're all, it's, it's the MAGA crowd, they're Trump supporters.
00:45:58.140 And you obviously, you have people on the left who hate president Trump, and then you
00:46:02.160 have a whole lot of people on the right who hate him, um, as well.
00:46:06.360 And the idea is that if you stick up for these people, you are somehow by extension sticking
00:46:10.960 up for president Trump as well, and they won't touch it with a hundred foot pole because they
00:46:16.500 want nothing.
00:46:17.360 Uh, their biggest fear, um, in the entire universe is, uh, is, is the return, uh, of president
00:46:24.700 Trump in 2024.
00:46:26.300 And nobody wants to be associated with that.
00:46:29.900 Well, you know what?
00:46:30.280 They shouldn't want to be associated with the democratic party either.
00:46:33.160 They shouldn't want to be associated, uh, with, uh, president Obama, president Biden,
00:46:38.100 uh, Kamala Harris, uh, Joe Biden is, uh, now president, but also was vice president, shouldn't
00:46:45.640 be one to be associated with the FBI, the justice department, because they are rank corrupted
00:46:51.700 agencies.
00:46:52.720 And there is no question about it.
00:46:54.800 They've spied on a president.
