00:00:00.000 I'm Lou Dobbs with this Great America Show midday update.
00:00:04.000 President Biden's $39 billion student loan forgiveness plan faces a new lawsuit.
00:00:10.360 The Cato Institute, a new civil liberties alliance,
00:00:13.360 suing the Biden regime today to cancel the $39 billion Biden wants for 800,000 borrowers.
00:00:21.420 The organizations accuse the Biden regime of abuse of power,
00:00:25.440 asking a federal court to block the plan.
00:00:27.640 The Marxist-run Department of Education called the lawsuit, quote,
00:00:31.520 a desperate attempt from right-wing special interests to keep hundreds of thousands of borrowers in debt, end quote.
00:00:39.200 And a federal judge has dealt a humiliating blow to Marxist-Dem Special Counsel Jack Smith.
00:00:46.040 Judge Eileen Cannon, the judge presiding over the Trump Mar-a-Lago documents case,
00:00:50.840 issued a brief today slapping down multiple requests from the junkyard Marxist-Dem Special Counsel.
00:00:58.280 Judge Cannon denied the DOJ's request for sealed filings, striking two from the record.
00:01:04.520 Cannon also requested additional information from the prosecutors
00:01:08.240 regarding their continued use of an out-of-state grand jury for the Special Counsel,
00:01:14.300 which he used to investigate the case and bring charges.
00:01:18.120 Cannon wrote this in her brief, quote,
00:01:20.420 The Special Counsel states in conclusory terms
00:01:24.020 that the supplement should be sealed from public view to comport with grand jury secrecy.
00:01:30.280 But the motion for leave and the supplement plainly fail
00:01:34.280 to satisfy the burden of establishing a sufficient legal or factual basis
00:01:39.980 to warrant sealing the motion and supplement.
00:01:43.020 The slapdown for Smith comes as Trump awaits his fourth criminal indictment
00:01:48.660 from Marxist-Dem Fulton County District Attorney Fannie Willis.
00:01:53.000 That could come as early as this week.
00:01:55.300 President Trump's attorney, Alina Habba, reacted to the looming indictment on Fox News this morning.
00:02:01.580 I think that we can expect it.
00:02:03.120 I think that it's sad when you know how to expect the game they're playing
00:02:06.560 because their games are so obvious and so predictable.
00:02:10.040 Fannie Willis has been making this quite the PR play for herself,
00:02:13.780 which is ironic given the motion that Jack Smith filed on Friday.
00:02:17.900 She has been waiting for years for an opportunity to have her moment, as I would call it.
00:02:23.120 And I think we see that a lot with corrupt DAs and AGs.
00:02:25.700 It's no longer about the law.
00:02:27.080 It's no longer about punishing criminals that are actually doing crimes.
00:02:30.300 It's about people getting a headline.
00:02:31.940 And there's no better way to get a headline than to go after Donald Trump.
00:02:35.500 It's about the indictment.
00:02:36.620 It's not really about the fairness or if he's going to get out.
00:02:39.220 And I think Fannie's lining up and waiting just long enough to have a press cycle pass
00:02:43.560 so that she has her own single Georgia moment.

00:02:52.180 He says President Trump will be acquitted from the special counsel witch hunt
00:02:56.340 because the documents he had at Mar-a-Lago were legally the president's.
00:03:01.840 Mike says the latest January 6th indictment is moot
00:03:05.020 because it's lawful for President Trump to object to presidential elections.
00:03:09.600 It's allowed by the Electoral Count Act of 1887.
00:03:13.520 There's as well a First Amendment right to object, a statutory right to object.
