00:02:42.760 weigh in because the office he holds hasn't been created by Congress and his appointment violates the

00:02:49.020 appointments clause of the Constitution itself. The brief also states that Attorney General Merrick

00:02:54.800 Garland improperly appointed Smith to that office, an office that does not exist, with authority that

00:03:59.300 for the Jan Sixers and for our country, it's also a little bit melancholy this time of year, brother.

00:04:24.240 Of course. Well, it's very complicated. The main reason is because the Department of Justice

00:04:32.540 does not want my story out in the public. My arrest from January 6th stems from a very particular

00:04:41.040 scenario, one of the most violent areas of the Capitol, the West Terrace Tunnel, and inside that

00:04:48.820 tunnel, a woman was murdered, a 34-year-old woman from Georgia named Roseanne Boylan. She was killed by

00:04:55.560 the Capitol Police in my arms, Lou. She was bludgeoned to death with batons. She was chemically asphyxiated 1.00

00:05:03.800 with pepper spray and even trampled. And during that very insane scenario, I tried to save Roseanne

00:05:13.020 Boylan's life. I was not able to. She died. And I was able to move over my efforts because I couldn't

00:05:19.220 help her to a young black man named Philip Anderson. And that was caught on video. I actually

00:05:24.500 dragged his lifeless body. He was unconscious out of that dog pile and to safety. And he's done a

00:05:30.800 court sworn affidavit claiming I saved his life. So they do not want that murder of an unarmed

00:05:36.460 American woman that they covered up at the Capitol to be broadcasted to the world at my trial.

00:05:42.020 That's the main core reason I have not been afforded my right to a fair jury trial in a normal amount of

00:05:48.840 time, not three years. We're talking three years without trial. You're in solitary confinement. Is that

00:05:58.060 correct? Yeah, because, you know, we we've been so blessed to have a large voice for the Gen 6

00:06:04.140 community. The prisons that I've been at, they've shuffled me around to 13 different prisons, Lou,

00:06:09.600 diesel therapy, torture, and they've stuck me in solitary confinement most everywhere I've been.

00:10:39.020 to aim basically or defend against the Capitol Police attacks. I mean, after they killed Roseanne Boylan is when

00:10:48.920 I had to pick up defensive positioning at the Capitol. They were going to kill more women and more unarmed,

00:10:55.860 innocent Americans. I'm a young man. I'm not a coward. By God's grace, I was able to stand up and defend

00:11:02.560 those defenseless people. And many of my J6 brothers have. We kind of formed a wall of men around the

00:11:10.060 elderly people that were there. There's a lot of elderly veterans there, women there. And some of them

00:11:15.500 became horrible victims of police brutality, even unto death. So I've been, you know, alleged to have used

00:11:22.900 a riot shield and a baseball bat that materialized in the crowd. Basically, they were using metal

00:11:30.680 batons and they cracked me in the skull. I had a huge, huge blood raining down off me and they had

00:11:37.380 riot shields, too. So, I mean, you know, we were unarmed there. Nobody brought weapons. So things that

00:11:43.240 we found on the ground, we had to use, God forbid, to defend our lives, defend the people around us and

00:11:49.180 defend this country from a communist coup d'etat. So that's my allegations. And, you know, I stand by

00:11:54.560 what I did on January 6th. As a man, I'll always stand up and protect the innocent and the women

00:11:59.720 around me. And if it means sitting in prison because of it, well, I believe I did the right

00:12:05.360 thing, Lou, in God's eyes. Defending others and yourself is understandable and appropriate.

00:12:28.560 melee, I don't know how anyone possibly could have expected anything other than chaos and some

00:13:50.620 attorney, Stephen Metcalf, a great friend of mine from New York. He's been steadfast in his approach,

00:14:00.680 two and a half years ago. They tried giving me nine years in prison on a one day plea deal.

00:14:04.840 A man like myself who has no criminal record, never been in any real trouble before. And I'm

00:14:11.600 facing down nine years in federal prison for saving a life at the Capitol and standing up

00:14:16.620 for my country and our Constitution. It was unconscionable to me and to my legal team.

00:14:21.960 And so we refuse that. And we've been paying the price. They've had a target on my back ever since

00:14:27.580 trying to silence me. I've had to do hunger strikes for 12 days before because they took my phone

00:14:33.440 rights and access to my attorney and my family away from me. I lost 25 pounds during that hunger

00:14:39.660 strike. And finally, they coalesced and they gave me my phone rights back to speak to the people I

00:14:45.700 love and the American people. And so this has been a grueling journey. And I've been grateful to have

00:14:50.920 such a strong support structure around me with my family, my beautiful fiancee, Rachel, on the phone with

00:14:56.780 me, my attorney and the church of our Lord Jesus has been those have been my my my my pillars of my

00:15:04.180 life. Well, God bless you. You've been moved to 13 different prisons, denied bond, as you say,

00:15:12.240 because you have no criminal record. Well, you know, we've appealed to the courts. We've appealed

00:15:18.160 to the appellate federal appellate court. We've been struck down both times. I've tried to go for

00:15:22.920 bond three times. But it's not really what I did, because if I did that in the name of Antifa or Black

00:15:28.520 Lives Matter, Maxine Waters and Alexandria Ocasio-Cortez would be, you know, lauding my my

00:15:34.980 conduct as, you know, freedom fighter and all this stuff. But it's who we support and the values that

00:15:41.120 we represent as conservative constitutionalists and as Trump supporters. That's really put me and all

00:15:47.260 the Jant Fixers at a severe disadvantage in Washington, D.C. The federal judges, the federal

00:15:52.800 prosecutors and the D.C. jury, they're all corrupt and biased and they hate what we represent, godly

00:15:59.960 Christian nation. And so they don't want to bond us out. They don't want to give us a fair shot at 1.00

00:16:05.980 proving these allegations to be false and our actions to be justified, because this is a two tier

00:16:12.180 justice system that has developed in America. And I truly believe that the American people have had

00:16:19.160 enough and it's disenfranchised people to such a great extent that people really need to stand up

00:18:47.220 to take up your appeal on 5012C and to give it a, one hopes, a fair and impartial consideration?

00:19:00.700 Well, I believe that just like most Americans, we've been completely disenfranchised by the

00:19:06.280 justice system, seeing the January Sixers railroaded and mistreated, overcharged, and

00:19:12.080 selectively prosecuted for years now. Pretty much, we've been completely eroded in our faith and trust

00:19:17.760 in Lady Justice in America. And this is that the Supreme Court has now decided to pick up our appeal for

00:19:23.900 the 1512 obstruction of Congress charge that 327 Japan Sixers, including myself and President Donald

00:19:32.340 Trump, have been charged with, is a glimmer of hope in a restoration period of our faith in this most

00:19:39.500 sacred institution of ours, the justice system. So we're praying, we're appealing to our Father God in

00:19:46.560 heaven and crying out to him that he continues to turn the heart of the justices to make the right

00:19:52.380 decision. Now that they've agreed to hear this case, now they need to make the decision and come

00:19:57.240 down in our favor and totally scratch this weaponized charge, obstruction of Congress,

00:20:02.660 a blanket political charge, schemed up by George Soros' prosecutors to hem up hundreds of Americans

00:20:09.640 and Donald Trump. That charge needs to be taken off the books. It's been misapplied and over broadly

00:22:17.820 rug like we don't exist. But I think that the will of the American people to see the Jan 6ers free 1.00

00:23:05.400 they will find that the January 6ers were not the aggressors, and that there was actually

00:23:09.740 federal agents in the crowd that incited the violence that day, including the Capitol Police
