Former DOJ Special Counsel Robert Herr testified before the House Judiciary Committee yesterday about his investigation into Joe Biden's handling of classified documents. Former Vice President Joe Biden has repeatedly denied that he intentionally kept classified documents as a secret from the American people.

00:00:33.580Hello, everybody. I'm Lou Dobbs. Thanks for being with us on The Great America Show.
00:00:38.700Former Biden Special Counsel Robert Herr on Capitol Hill yesterday testifying before the House Judiciary Committee
00:00:45.740about the investigation that he conducted into the most corrupt president in history.
00:00:50.360Here is the former special counsel telling the American people that Joe Biden knowingly illegally retained classified documents.
00:00:58.940My team and I conducted a thorough, independent investigation.
00:01:03.680We identified evidence that the president willfully retained classified materials after the end of his vice presidency when he was a private citizen.
00:01:11.000This evidence included an audio-recorded conversation during which Mr. Biden told his ghostwriter that he had, quote,
00:01:19.280just found all the classified stuff downstairs, end quote.
00:01:23.480When Mr. Biden said this, he was a private citizen speaking to his ghostwriter in his private rental home in Virginia.
00:01:31.040We also identified other recorded conversations during which Mr. Biden read classified information aloud to his ghostwriter.
00:01:38.180So not only did Herr conclude in his investigation that Biden illegally harbored classified documents,
00:01:45.000but that Biden then shared those documents with his ghostwriter.
00:01:49.040Those are the words of the former special counsel.
00:01:51.620Now listen to Biden last month vehemently and angrily, denying he shared those documents with his ghostwriter.
00:01:58.920I did not share classified information.
00:03:13.540Because what you put in your report was among the places Mr. Biden's lawyers found classified documents in the garage was a damaged open box.
00:03:21.260So here's what I'm what I'm understanding, right?
00:03:23.160As Mr. Armstrong laid out, you find in your report that the elements of a federal criminal violation are met.
00:03:29.340But then you apply this senile cooperator theory that because Joe Biden cooperated and the elevator doesn't go to the top floor, you don't think you get a conviction.
00:03:37.940And I actually think you get to the right answer in that.
00:03:40.920I don't think Biden should have been charged.
00:03:42.340Don't think Trump should have been charged.
00:03:43.400But under like the senile cooperator theory, isn't it frustrating that Biden continues to go out and lie about the basic facts of the report that lay out a federal criminal violation?
00:03:55.960Congressman, I need to disagree with at least one thing that you said, which is that I found that all of the elements were met.
00:04:02.680One of the elements of the relevant mishandling statute is the intent element.
00:04:06.660And what my report reflects is my judgment that based on the evidence, I would not be able to prove beyond a reasonable doubt to a jury that that intent element had been.
00:04:14.980Right. But the reason you have that doubt is that is the senile cooperator theory.
00:04:19.400The fact that Joe Biden is so inept in responding that you can't prove the intent, which, again, I don't quibble with that conclusion.
00:04:26.700But it's frustrating to be like, oh, well, this guy's not getting treated the same way as Trump because the elevator is not going to the top floor.
00:04:33.140Well, at the same time, Biden goes out there at the White House and says, well, you know, he just he just he just blatantly lies.
00:04:39.540And what I'm trying to figure out is whether or not Biden's lying because he's still so senile.
00:04:43.460He hasn't read your report or whether it's a little craftier and a little more devious and perhaps a little more intentional than we might otherwise think.
00:04:51.980The American people deserve answers and we deserve them now.
00:04:54.880If this man's too senile to withstand trial, he's far too senile to be the leader of the free world.
00:05:00.880And House Oversight Committee Chairman James Comer subpoenaed 13 years of Hunter Biden's AT&T phone records.
00:05:08.880In his subpoena to AT&T, Comer said Hunter's user activity could encompass a personal phone line President Biden used during his vice presidency.
00:05:18.880We know from Peter Swiser's new book, Blood Money, that Hunter Biden's business paid for a private phone line that Joe Biden also used when he was vice president.
00:05:28.980It was a $300 a month bill for a global phone that could access somebody anywhere around the world.
00:05:35.840It was Swiser who turned those phone records over to the Oversight Committee.
00:05:41.100And Rhino Congressman Ken Buck is on his way out, set to retire next week, leaving Congress early and Congress is grateful.
00:05:49.300Leaving the Republicans with a razor thin majority of 218 to 213.
00:05:53.720More than 20 House Republicans have announced they're not seeking re-election, mostly rhinos and good riddance.
00:06:01.280Our guest today is Congressman Eli Crane of Arizona, who sits on the House Homeland Security, Veterans Affairs and Small Business Committees and a member of the House Freedom Caucus.
00:06:11.740Crane was one of the eight brave Republicans who voted to oust Speaker McCarthy, and he's paying the price for it.
00:06:19.080He now has a primary opponent who will presumably be well-funded by none other than Rhino Kevin McCarthy.
00:06:27.620Congressman, it's great to have you with us.
00:06:29.840Let's start with the Robert Herr hearing today and your thoughts about what it amounted to.
00:06:37.860Well, I think it just, once again, shows the American people how dishonest the Commander-in-Chief is, how corrupt he is.
00:06:47.680And, you know, I'm hoping it will, you know, really lead to a blowout victory for President Trump come this November.
00:06:55.660How about for all the Republicans in Congress, too?
00:07:19.180Yeah, you know, part of me would like to see that as well, too, Lou.
00:07:22.260But I will tell you one of the reasons that we were able to at least get some, you know, I would say minor wins this last Congress is because the majority was so thin.
00:07:35.780A lot of people don't realize, Lou, that nobody cares what the conservatives have to say or think when the majority is really big.
00:07:43.020The only time they listen to us is when the majority is razor thin and they need our votes.
00:07:48.280And so it's kind of a weird dichotomy, but it kind of works out that way.
00:08:07.860And you're not wrong to, you know, go along that common sense track like that.
00:08:13.320And that's how I thought about it, too, until some of my friends in the Freedom Caucus told me that they were actually praying for a thin majority,
00:08:20.940because when there's a huge or a large majority on our side of the aisle, the establishment, moderate Republicans,
00:08:29.320they don't care what the members of the Freedom Caucus or the real conservatives in the House think.
00:08:34.820They don't have to because they don't need our votes.
00:08:37.360Well, you know, with Ken Buck leaving the majority and getting out of Congress sooner rather than later,
00:08:45.060in which, by the way, I would I would just hope that the screen door doesn't hit him in the rear end as he exits.
00:08:51.720I mean, I can't even imagine what freak shows like that are doing in Congress to begin with.
00:08:57.200And I just I mean, we're watching people in that U.S. Congress.
00:09:02.640Personally, I wouldn't want them in the neighborhood, let alone in the Congress.
00:09:06.340Well, you know, I just heard about I just heard that Ken was choosing to leave early.
00:09:13.600I haven't had a chance to talk to him about it.
00:09:16.460But, you know, obviously, there's going to be a heavy turnover coming up in this this house.
00:09:22.100I hope like you and many of your listeners that we get the personnel up here that the American people send them to us because we got a lot of work to do, Lou.
00:09:37.840I just want to turn to looking at where we are with the seven point three trillion dollar budget that was handed down as if anybody in their right mind would want to think about that as good sense, good fiscal policy.
00:09:56.580What we're we're watching cooked up on Capitol Hill or handed down from 1600 Pennsylvania.
00:10:03.900It's just it's disgusting to me that we haven't got more common sense, more passion, more fire in the belly in our representatives and what we obviously don't have what we lack.
00:10:21.700And it's one of the most frustrating things about being up here.
00:10:24.460There's really no appetite to quit spending the American people's money that we don't have.
00:10:31.040And it's like I said, it is extremely frustrating.
00:10:33.840This is one of the biggest issues I have with my own party.
00:10:37.540I've tried to be really outspoken about it, you know, though it can be conflicting at times to be on committees with folks and, you know, to be on the same team, if you will.
00:10:47.680But also knowing that, you know, as Republicans, we're supposed to be the ones that stop this out of control nonsense.
00:10:55.200And we don't show any desire to do that.
00:10:58.200We just continue to help manage the decline of this country.
00:11:03.660And, you know, quite honestly, it's it's embarrassing at times.
00:11:08.920Well, it's embarrassing to me to think that this country can't do better than what we're doing.
00:11:15.220Certainly, give give give us a sense, if you will, of what a Republican is supposed to be all about right now, because they're playing with you.
00:11:27.820There's no doubt they hand down from the White House seven point three trillion in a budget and then want to talk about the big four or the big eight, whoever you want to call it.
00:11:38.860And they're just they're nothing more than functionaries without either passion, without conscience, without any kind of any kind of forget moral compass.
00:11:54.000I'd take just a compass in terms of direction politically.
00:11:58.400Yeah, Lou, when you say what what is the Republican Party supposed to be about?
00:12:04.540And I know not everybody up here on my side of the aisle shares my perspective of this, but I would say two words, America first.
00:12:12.620You know, and it makes it really simple when when you boil it down to that, you know, whether you look at that economically, what should that mean?
00:12:19.640It should mean that we should get our own house in order before we start sending money all over the globe.
00:12:25.300When you look at it from a national security perspective, it means that, you know, we should protect our citizens, the communities, the families that send us up here.
00:12:34.660And that starts at the southern border.
00:12:36.200You know, when it comes to Ukraine, you know, we shouldn't be sending, you know, tens of billions of dollars over to one of the most corrupt nations in the world and escalating a war with Vladimir Putin, who has more nuclear weapons than I think anybody on the globe.
00:12:52.940But if you if you put that America first lens in between anything that you're looking at, it really simplifies things that, quite frankly, can often be complicated.
00:13:01.880We're talking with Eli Crane, and we were going to come back and we're going to talk with the congressman about why is the 82nd Airborne and the 101st Airborne and a bunch of other troops sitting over there on the eastern flank.
00:13:48.600We saw what happened in 2020 when we found ourselves dependent on global supply chains.
00:13:53.460We're still dependent on China and other countries for more than 90% of all our pharmaceuticals.
00:13:59.100With clusters of respiratory illnesses popping up around the world and here, we need to be prepared.
00:14:05.160And now is the time to make certain you have what your family needs when the next crisis hits.
00:14:11.060Our good friends, Dr. Peter McCullough and Dr. Drew Penske over at the Wellness Company have put together just what you and I need with the Wellness Company's medical emergency kit.
00:14:20.200And now the Wellness Company's medical kit provides a solution critical to you and your loved ones.
00:14:26.160This emergency kit includes eight life-saving medications including amoxicillin, Z-Pak and ivermectin for you to keep on hand along with a guidebook for safe use.
00:14:36.560From tick bites to biochemical events, every medical scenario is covered.
00:15:12.920And Congressman, the 82nd Airborne, 101st has been over there since almost the beginning of the Russian invasion of Ukraine.
00:15:23.920Why do we have the 82nd Airborne and the 101st Airborne, two elite outfits that are not supposed to be static and standing, but are not only that, they're sitting ducks right in the sight of Vladimir Putin and his troops?
00:15:44.660Well, Lou, this is why many of us have been calling for peace talks.
00:15:52.060As soon as I got up here, that was what I was using my platform for.
00:15:56.040I don't want to see this thing escalated.
00:15:58.200I don't want to see us send any more treasure, you know, overseas to Ukraine, as I just talked to about with you before the break.
00:16:06.740And I definitely don't want to see any soldiers in the in the airborne or any armed service unit for that matter, you know, have their blood spilled over this conflict.
00:19:03.020It to me, it's a crime against this nation on the part of these.
00:19:07.260You know, if Mitch McConnell wants to go see something up close and personal, let him go over and let him stand in front of the the the Russian tanks.
00:19:19.360Let him go on a personal inspection tour in the midst of conflict.
00:19:25.980But to ask our young men to do it is to me just ignorant.
00:19:35.040Where do you know, where do we go with about nine months remaining before the election and then another couple of months after that for the inauguration of a new president?
00:19:50.080Well, you know, like many much wiser and smarter men before me have predicted, Lou, I think this is going to be a very wild year for for many different reasons.
00:20:00.720But I don't I don't believe you're going to see a whole lot change up here in the House of Representatives or the Senate.
00:20:07.400We have the same team taking the field every week.
00:20:10.260Unfortunately, it's not a very conservative team.
00:20:13.140We've showed time and time again that we have no desire to pick a principled fight and be willing to die on that hill, even though, you know, individuals will say that to television cameras.
00:20:25.880And so I think you're going to see more more disappointment from the Congress.
00:20:31.260And I sure as hell hope that President Trump is able to pull out a victory come November, because right now, outside of, you know, God doing something divine in this country,
00:20:43.200I think that President Trump, you know, has the best chance of starting to turn this ship back in a, you know, more reasonable America first, where we focus on our citizens and what's best for our country, what's best for our neighborhoods, our districts and our communities than anybody else out there.
00:23:46.080I interviewed the colonel and the general down there to try and help this private get the opportunity to stay in the Army, move to his next command so he could serve his country.
00:23:56.500But, you know, when I looked at the evidence that they were using to try and separate this young man, Lou, I saw a lot of holes in the story.
00:25:46.780They're focused on social experiments, diversity, equity, and inclusion, and wokeness.
00:25:52.600And even though that stuff has been permeating in our culture for a long time, the military was one spot we hoped it would never touch because nobody on the other side of that battlefield that you're on cares about any of that stuff.
00:26:12.520And so, Lou, what I think you're going to see in the years to come outside of good men and women being forced out of our armed services, I think that the United States of America is going to be humbled.
00:26:23.220I think we're going to get our butts kicked on the battlefield if we don't figure it out and get back to having a focus on lethality, readiness, and being the baddest military on the planet.
00:26:35.800And unfortunately, Congressman, getting our butts kicked is exactly what Joe Biden wants to happen.
00:26:43.520It's exactly what the Marxist Dems want to happen.
00:26:46.700They want this country destroyed and everything it stands for destroyed.
00:26:51.200So I don't know where we go, but I do believe that the future is just as unclear and as dark as you are painting.
00:27:01.000And unfortunately, we're going to have to go through that and come out the other side.
00:27:06.200And hopefully, with Donald Trump as our leader, we'll make it through clear and clean.
00:27:14.000Congressman Eli Crane, thanks for being with us.
