00:01:51.480 the forefront of the most subtly brutal campaign in the last 100 years to de-Christianize Western

00:02:02.300 Cardinal Müller recounted before explaining that in his opinion, and I quote,

00:02:43.240 Chinese Catholics for new harsh lockdowns.
00:02:47.160 Supposedly, these lockdowns are necessitated by an apparent resurgence of COVID-19 cases near
00:02:53.740 Beijing.
00:02:54.140 A local priest described the move as being like the times of Emperor Nero.
00:03:00.820 A reported uptick in the positive cases of COVID-19 in Hebei province near Beijing has resulted
00:03:08.440 in the area being put under very stringent lockdown.
00:03:12.520 As of January 6th, more than 22 million people have now been ordered to remain at home.
00:03:18.860 The province's capital also placed its 11 million inhabitants in isolation, with travel in and
00:03:26.220 out of the city banned completely.
00:03:29.120 Posts on social media platforms, Miwi and Weibo, began spreading accusations against Catholics
00:03:37.180 causing the recent cases, as if they were causing them.
00:03:41.240 The rumors also claimed that a number of European and American priests came to participate in
00:03:47.520 the religious ceremonies without taking any preventative measures, bringing the virus with
00:03:53.200 them.
00:03:53.860 And these were then reported by Chinese officials as well.
00:03:59.840 Meanwhile, Duncan Schroeder of Newsbusters reports that last week CNN's Chris Como and
00:04:06.220 commentator Don Lemon spoke about the need to deprogram Americans on the right.

00:04:39.060 The Oath Keepers, the Proud Boys, these other true extremist groups that have membership, that
00:04:45.440 have, you know, these mantras and mottos and these mechanisms for change that is violent.

00:07:39.460 The Trump campaign is the plaintiff in 45 cases.
00:07:42.680 In only nine of them, did judges allow the Trump campaign to present the evidence needed
00:07:48.060 to argue the case fully, according to this database.
00:07:51.460 In more than a dozen cases, judges ruled against Trump either due to technicalities or while
00:07:58.420 siding in favor of ballots that lacked legally mandated information.
00:08:04.120 Another 35 cases were brought by Republicans, individual voters, and non-profits.
00:08:09.600 Nearly half of those remain active.
00:08:12.500 Finally, plaintiffs were able to argue all evidence in only 14% of all tracked cases.
00:08:21.120 I spoke yesterday with an American uniquely suited to dealing with the facts on the election
00:08:27.820 fraud and the court cases themselves.
00:08:32.360 He's a law professor at New Mexico State University.
00:08:36.080 His name is David Clements.
00:08:37.740 He's also a seasoned trial attorney where he tried over 120 cases to a jury and dozens more
00:08:44.520 to a judge.
00:08:45.440 His experience ranges from municipal defense in civil litigation to prosecution of first
00:08:51.520 degree murder and other high profile felony cases.
00:08:54.920 When the university president sent out a message to the university condemning the violence at
00:09:00.540 the Capitol and dismissing those concerned about election fraud, Professor David Clements
00:09:05.760 spoke out publicly, even though as a not yet tenured professor, he puts his own job at risk.
00:09:13.140 He told me he's read most of the cases with regard to election fraud.
00:09:19.680 Here's what he had to say.

00:09:24.600 So tell us, one of the most striking things about your initial testimony, which of course
00:09:30.520 went viral and got you on the Tucker show and all over the place, to my mind, one of
00:09:35.340 the most intriguing parts was where you said that you had read most of the court cases which
00:09:42.320 have been rejected.
00:09:43.080 I think one of the most powerful arguments on the side of those who claim that there was
00:09:47.460 no election fraud whatsoever, basically the media narrative that there's no evidence,
00:09:52.120 no evidence, no evidence, is exactly that, that the court cases were rejected over and
00:09:58.240 over and over again, dozens of times, including by Trump judges.
00:10:02.980 So please tell us what you've got to say for that.
00:10:06.080 What I raised in the video was that the two common objections that we saw in case after
00:10:10.880 case after case was this doctrine of legal standing.
00:10:15.460 And what your viewers need to understand about legal standing, it's effectively a legal fiction.
00:10:21.940 And what do I mean by that?
00:10:24.020 That, for instance, when we had the state of Texas suing the state of Pennsylvania and went
00:10:30.900 to the Supreme Court, it was dismissed on grounds for standing.
00:10:35.160 And the argument that was being proposed by the Texas AG was pretty straightforward.
00:10:41.640 By virtue of Pennsylvania not following its own laws, you diminished the vote here in Texas
00:10:48.220 because this is a federal election.
00:10:50.400 And so if you don't run your ship a certain way, then our voters suffer.
00:10:56.360 And so for most people out there, the layperson, they would say, yeah, that makes sense.
00:11:00.660 That's an actual injury.
00:11:02.080 I think that's a particularized injury.
00:11:04.800 Well, the problem is, is in the land of the law, when you're talking about the types of
00:11:11.000 complaints that were lodged here, they don't consider it a particularized injury.
00:11:16.780 They call it a generalized injury.
00:11:19.420 And if it's a generalized injury, they're not going to hear it.
00:11:21.960 And so many of the cases that were filed, there's this confusion because your average
00:11:27.240 everyday voter says, what do you mean there was no harm?
00:11:29.740 I'm a voter.
00:11:30.300 This hurt me.
00:11:32.080 And the law creates this mechanism to where they're not going to even get to the merits
00:11:36.600 of the case.
00:11:37.280 And so that's the primary issue that we saw in lawsuit after lawsuit after lawsuit.
00:11:44.000 There was no opportunity to hear the merits.
00:11:48.640 So that's one example.
00:11:50.300 And what you have to keep in mind is that you have cases that were filed in Georgia.
00:11:54.520 You have cases that were filed in Pennsylvania, Michigan, Wisconsin, Arizona, Texas, Nevada.
00:12:01.400 Many of those cases originated in a state district court.
00:12:06.680 Well, guess what?
00:12:07.720 President Trump does not get to appoint anyone to state district courts.
00:12:12.520 So they're not hearing the cases.
00:12:13.780 And when you look at the figures for Trump appointees in federal district courts, they account for
00:12:19.840 17%.
00:12:20.800 And so people have run with this narrative that somehow every one of these lawsuits have
00:12:26.240 been filed in courtrooms with Trump appointees.
00:12:29.460 And that's just not true.
00:12:31.560 Out of the 54 or 60 cases that I looked at, you only had a handful of judges.
00:12:36.180 And they have to follow the law, too.
00:12:37.580 So they're looking at what the Supreme Court has said about standing, and they're following
00:12:42.240 suit.
00:12:43.520 So the narrative that's been put out there is really easy to spell if you just look at the
00:12:48.660 facts.
00:12:49.040 One of the things you said there is really remarkable.
00:12:52.380 You've looked at over 60 or so cases that have gone on in this election.
00:12:58.400 I think that's probably more than almost anyone else has looked at.
00:13:02.160 So you've seen this, and yet you're convinced that there was indeed fraud.
00:13:06.820 What brings you to that conclusion?
00:13:08.660 Well, you know, what I do as an attorney is I create proof analysis in all my cases.
00:13:13.300 And so as someone who is just following the hearings that happened shortly after the results,
00:13:20.140 I started creating a grid, and I started looking at the challenges.
00:13:24.040 And then I started looking at the evidence.
00:13:25.880 And you can get the court filings themselves.
00:13:27.880 Anything that's been filed in a court of law is public record.
00:13:32.180 And so I started familiarizing myself with the affidavits.
00:13:35.480 In my video, I talked about having access to 574 pages of sworn documents that have proliferated
00:13:43.140 through the courts.
00:13:44.700 That's just a small fraction.
00:13:46.400 In Michigan alone, for example, there are 234 pages of sworn affidavits just out of Wayne
00:13:52.640 County.
00:13:54.220 And so what you have to do as someone who is concerned with finding out what is true and
00:14:00.060 what is not, you have to look at the evidence.
00:14:02.660 You have to listen to the people.
00:14:03.980 And the reason why I'm comfortable with this is as a trial attorney, I've tried thousands
00:14:09.980 or not thousands, but I prosecuted thousands of cases, and I've tried well over 100 cases
00:14:14.580 before a jury.
00:14:16.120 What you do is let them make up their own minds.
00:14:20.160 You let them be the judges of the facts, the judges of credibility.
00:14:25.060 And I approach this the same way.
00:14:28.240 You have to listen to the testimony.
00:14:31.280 You have to listen to it.
00:14:32.860 And so a lot of these witnesses were foreclosed from having a date in court, but we still had
00:14:37.920 public hearings.
00:14:38.760 And what's important about these witnesses is that they filled out affidavits where they
00:14:46.300 risk 10 to 15 years for committing perjury if they're caught lying.
00:14:52.700 And what I found, just like in Wayne County, whether it was Fulton County, Antrim County,
00:15:00.700 DeKalb County, Floyd County, Fayette County, all of these counties, I was able to look at
00:15:05.760 these affidavits and also watch them during these public hearings.
00:15:10.260 And the evidence was compelling.
00:15:12.260 And that's born out of my experience as a trial attorney.
00:15:15.040 I know good witnesses when they take the stand.
00:15:17.280 I know coached witnesses.
00:15:18.660 I know witnesses that don't know what they're talking about.
00:15:22.080 What I want to push back against is everyone says, well, how could there be a conspiracy of
00:15:27.220 a bunch of judges making sure that Trump isn't elected to office?
00:15:33.500 And I think you can raise that, but you also have to equally raise the prospect of why would
00:15:40.420 tens of thousands of people that aren't in positions of power lie about what they saw
00:15:47.480 during the election?
00:15:49.600 So who's the greater conspirator?
00:15:53.300 And so basically what I tell people is you don't have to take my word for it.
00:15:57.320 Look at the court filings themselves.
00:15:59.760 Look at the witnesses' testimony.
00:16:01.760 Look at the forensic reports.
00:16:03.260 Look at the statistical data.
00:16:05.440 And either it's going to meet a certain burden of proof for you, the juror, or it's not.
00:16:11.540 I think when you look at the preponderance of evidence standard, which is the standard used
00:16:16.460 in civil courts, all you have to prove is that what is being asserted is more likely than not.
00:16:23.060 51%.
00:16:23.540 That burden has been met here easily.
00:16:27.860 It's been met sufficiently to at least have a trial on the merits.
00:16:32.680 But based on my observation, you basically had a lot of political or judicial cowardice.
00:16:38.840 Everyone was punting the ball in a different direction because they didn't want to suffer
00:16:44.340 the political blowback by rendering a decision that could potentially disenfranchise millions
00:16:50.780 of Biden voters.
00:16:52.660 And so everyone was playing this game to ensure that they weren't the one that was going to
00:16:58.120 peel back this corruption.
00:17:01.340 A couple of things you said there that are very eyebrow raising.
00:17:05.900 One of them, you said that they could stand to suffer 10 to 15 years in prison for lying
00:17:13.660 on an affidavit.
00:17:14.840 Explain that a little bit.
00:17:16.080 Well, it depends on the state, right?
00:17:17.960 And you also have to keep in mind that we live in a federalist system.
00:17:21.680 So we have state laws that govern perjury.
00:17:24.000 We have federal laws that govern perjury.
00:17:26.440 So based on a kind of a common law perspective of how perjury works, if you lie under oath
00:17:33.860 and an affidavit is a sworn statement that basically says that I'm competent, I'm of sound
00:17:40.040 mind, I'm over a certain age, everything that I'm saying here is the truth.
00:17:44.620 And if you find out that I'm lying, I'm going to be subject to all the penalties of perjury.
00:17:49.740 And those penalties carry sufficient or not sufficient, but potentially large sentences.
00:17:56.540 So you can go to prison for lying on these affidavits.
00:18:00.660 And you also mentioned that there was tens of thousands.
00:18:04.280 Are there tens of thousands of these sworn affidavits or what we're referring to there
00:18:08.700 when you mentioned tens of thousands?
00:18:10.020 You look at it this way.
00:18:11.000 If you look at Wayne County, the Ellis Trump team was able to procure 234 sworn affidavits
00:18:21.100 in that county alone.
00:18:23.160 And so what you have here are hundreds and hundreds of affidavits coming from each of
00:18:28.880 these counties.
00:18:30.700 And so on average, within the five to seven states with dueling electors, in each of those
00:18:37.960 counties, like Maricopa County, hundreds of affidavits.
00:18:41.820 In Pennsylvania, hundreds of affidavits.
00:18:44.300 In Georgia, I think there might be more than any place because that's the place with the
00:18:47.220 video where election officials sent people home under this false narrative that there
00:18:55.780 was a major water leak in, I think, the state farm building.
00:19:01.160 So there were a bunch of people there that filled out affidavits.
00:19:04.080 And when you tally them up, yes, they are in the thousands.
00:19:07.160 A couple of other things.
00:19:08.520 You are an attorney, a law professor.
00:19:12.000 Now, there were tons of really good lawyers working for the Trump team.
00:19:18.320 When they're preparing for their cases, wouldn't they have known these procedural hurdles that
00:19:22.860 they'd have to battle?
00:19:24.080 Wouldn't they have known the kind of standing that they would need to get?
00:19:28.280 Wouldn't they have known these things?
00:19:29.400 How could they have flubbed so badly?
00:19:31.420 What happened here?
00:19:32.500 I don't think they flubbed, John.
00:19:34.460 I think this is the reason why you have to assert your claims is because they had no
00:19:40.860 choice.
00:19:41.280 You have to.
00:19:42.920 Everyone acts like on November 5th, they should have just had perfectly completed lawsuits
00:19:48.820 ready to be filed.
00:19:50.300 Well, no one knew what occurred was going to occur.
00:19:53.280 And so it takes time to assemble lawsuits.
00:19:57.540 And while they were trying to assemble the lawsuits and acquire the evidence that demonstrates
00:20:01.400 it, of course, I mean, you have to keep in mind the fraud was perpetrated on or about
00:20:05.960 November 4th.
00:20:07.300 And then you have to have your lawsuits heard, filed.
00:20:11.560 And you also have to understand that there were certain dates that they had to kind of beat
00:20:16.640 the clock.
00:20:17.300 For instance, in certain states by November 20th, just 15 days after the election, the
00:20:24.200 Secretary of State, in many cases, has to certify the results.
00:20:27.880 A couple of weeks after that, the state legislatures have to certify the results.
00:20:33.000 And so there was this clock that was ticking at all times to get this information out there.
00:20:39.600 And most of the politicians and judges were able to work against the clock and effectively
00:20:45.660 protect themselves.
00:20:46.960 There was always an argument like this.
00:20:48.880 Well, there's not much we can do now because the Secretary of State certified the results.
00:20:53.880 So what do you want us to do?
00:20:55.180 And it was only the persistent anger of the voters that allowed folks to keep these lawsuits
00:21:01.740 going.
00:21:02.260 So a lot of the doors that were shut were kind of baked into these timelines that you
00:21:08.580 had to meet.
00:21:09.600 And they came swiftly.
00:21:12.000 So I don't think it was, I don't think there was a poor lawsuit that was filed.
00:21:16.660 Everyone was raising different challenges.
00:21:19.800 The Ellis-Trump team were filing lawsuits basically saying that, look, your states deviated from your
00:21:26.940 election rules, for instance.
00:21:28.580 You've got the Secretary of State modifying how we're doing the rules with respect to mail-in
00:21:34.820 ballots.
00:21:35.460 That's unconstitutional because the only people that can change the rules is your legislature.
00:21:39.880 So they filed lawsuits saying this is unconstitutional.
00:21:44.380 You had other lawsuits followed by Sidney Powell, who talked about the Dominion machines and voting
00:21:49.620 software.
00:21:50.120 And so in some ways, I just think that the media narrative, you know, mind you, from day
00:21:57.620 one, as soon as the media certified the results of the election, they said there was no fraud.
00:22:03.860 They said that these were the most secure elections in history.
00:22:07.560 So who are you going to believe?
00:22:09.440 Someone that comes out and says that right out the gate?
00:22:12.980 Or are you going to let people have the opportunity to process these lawsuits?
00:22:17.820 And that just didn't happen.
00:22:20.180 The Sidney Powell phenomenon, I guess you'd call it, was very disconcerting for a lot of
00:22:26.740 people because she talked about releasing the Kraken.
00:22:29.620 And there seemed to be initially a lot of hope that something was going to happen.
00:22:32.700 And then it seemed to putter out and go nowhere.
00:22:36.520 What do you make of that and of her claims?
00:22:39.440 I think that either Sidney Powell is the attorney that we all believed her to be for 30 plus
00:22:46.960 years.
00:22:47.700 She was considered one of the best of the best.
00:22:52.540 She cultivated her reputation where she did not make claims unless she could back them up.
00:22:58.220 And either she is that person or you have to come to the conclusion that she's
00:23:02.660 crazy.
00:23:03.060 And what is that based on?
00:23:04.640 If you do a Google search of her name, she's been disparaged in unbelievable ways.
00:23:09.880 So the question that you're really asking someone like myself is, has she earned the
00:23:14.500 benefit of the doubt more so than the media?
00:23:17.900 And I would say, yes, she's a competent attorney.
00:23:20.740 I believe that she has established more than enough evidence.
00:23:24.700 And the evidence that I've reviewed in her case is reliable.
00:23:27.380 It would meet any standard in a court of law if we didn't have cowards acting as the
00:23:32.400 gatekeepers.
00:23:33.680 So Sidney Powell, you know, when you look at some of the cases in her history as a prosecutor,
00:23:40.500 she's amazing and she's heroic.
00:23:43.020 And she, the reason why she's having problems is that she's taking on the deep state.
00:23:49.000 She's taking on the heart of the issue.
00:23:51.740 And so opposition to her trying to get to the truth has been galvanized and they're trying
00:23:59.100 to destroy her.
00:24:00.340 They're not letting us see her evidence because they're scared of what it will reveal.
00:24:05.240 And this isn't a partisan issue.
00:24:06.620 It's not about Trump.
00:24:07.520 It's not about Republicans.
00:24:08.520 It's not about Democrats.
00:24:09.620 If we saw the evidence that I've seen that she's put out there, you would lose faith in
00:24:15.420 so many of our politicians.
00:24:17.400 OK, so where is America right now?
00:24:20.660 Where are we able to go as a nation?
00:24:23.200 Do we have a free electoral system anymore?
00:24:25.840 Or do you see this election fraud perpetuating itself?
00:24:30.180 Well, if we don't stand up and get angry, but that anger has got to be purposed towards
00:24:35.620 something.
00:24:36.060 So I'm not saying don't vote because by voting, you can keep your eyes on what's going on at
00:24:42.360 election sites.
00:24:43.020 So we need people to vote to keep an eye and fight for every little bit of integrity that's
00:24:47.480 left in the system.

00:26:19.480 I can tell you that it didn't really start with my letter or my video response on the 10th of January.

00:26:29.380 I've been a silent observer as someone who's a faculty senator, as someone who has taught classes,

00:26:36.400 And I reached my breaking point because honestly, I was heart sick on what I was hearing from
00:26:45.320 students, faculty members, and just there's a bully culture from a minority of faculty members
00:26:54.880 that they are the most vocal, and they go out of their way to politicize everything.
00:27:01.320 And so I had the gall to step up and ask for civility back in November.
00:27:06.400 And when I did that, there were a few faculty members that went out of their way to just
00:27:10.620 try to destroy my name, and they still continue to do that.
00:27:13.660 So right now, in my email, there are emails to faculty with titles like this,
00:27:20.580 David Clements lies on national TV, David Clements terrorism and social media lies.
00:27:27.460 And so this is cooked in.
00:27:29.620 And every day, I'm getting basically an eyeful of these bullies at work.
00:27:37.660 And just to underscore the point, John, one of the particular professors that has been most vocal
00:27:43.540 going after me, he's the co-chair of our faculty grievance board.
00:27:49.100 So the person that we go to when we have grievances as a faculty is one of the people that's leading
00:27:54.960 the charge to call me a liar, to go after me.
00:27:59.260 In fact, I've had some faculty members that rushed to my defense and committed the grievous
00:28:04.760 sin of having a typo.
00:28:07.320 And this co-chair went out of his way to make fun of them for having typos.
00:28:12.640 This is the person we go to when we are agreed.
00:28:17.200 And then I have another faculty member that I had to quote this because it's so disgusting
00:28:21.820 that not only equated Trump voters to white nationalists, white supremacists, and racists,
00:28:30.260 he said this in one of his emails, we must see them as the enemies of decency that they are
00:28:36.500 and deal with them unsparingly.
00:28:38.980 They deserve neither respect nor compromise.
00:28:42.640 So when I talk about what I said in the video, I've only scratched the surface of just how
00:28:47.480 nasty it is in academia, but that's where we're at.
00:28:51.580 So the pushback has been nasty, but overwhelmingly positive for every nasty email or message that
00:29:01.480 I get from what I call the Marxist group of faculty members.
00:29:06.420 I've had thousands of emails and messages from people supporting me.
