00:54:04.960 therefore, you can't be

00:54:06.340 prosecuted for doing it.

00:54:07.660 This is now the accepted

00:54:08.980 consensus view in America

00:54:10.480 to the point that most

00:54:11.320 conservatives would react

00:54:12.800 with abject horror if you

00:54:14.400 told them that you think

00:54:15.400 flag burning should be 0.88

00:54:16.580 outlawed.

00:54:17.080 But this was not always

00:54:20.620 the mainstream position.

00:54:21.860 It wasn't until 1989 in a

00:54:23.820 5-4 decision in the case

00:54:25.140 Texas v. 0.99

00:54:26.440 Johnson that the Supreme

00:54:28.060 Court determined in its

00:54:29.160 infinite wisdom that flag

00:54:30.440 burning is in fact protected

00:54:31.680 political speech.

00:54:32.500 They struck down a Texas law

00:54:33.740 banning flag burning.

00:54:35.500 Prior to that ruling, 48 of

00:54:37.760 the 50 states had laws against

00:54:39.940 desecrating a flag on the

00:54:41.380 books.

00:54:48.200 Pretty much everyone in the

00:54:54.060 was decided by the narrowest

00:54:55.280 possible Supreme Court

00:54:56.120 majority, the president,

00:54:57.740 George H.W. Bush, declared

00:54:58.840 that flag burning was dead

00:55:00.160 wrong.

00:55:01.280 It was a major issue that

00:55:02.180 galvanized the entire

00:55:03.040 country.

00:55:03.480 Congress immediately passed a

00:55:04.580 federal law banning flag

00:55:05.800 burning.

00:55:06.100 A year later, again, by a

00:55:07.220 5-4 vote, the Supreme Court

00:55:08.580 struck down that federal law

00:55:10.100 also, in other words, in an

00:55:12.340 instant, the Supreme Court

00:55:13.200 overruled the judgment of the

00:55:14.900 vast majority of Americans.

00:55:16.920 And in the years since that

00:55:18.260 ruling among the political

00:55:19.420 right, the Supreme Court's

00:55:20.660 ruling has become gospel.

00:55:23.060 No one has really questioned

00:55:24.120 it for decades, unlike, say,

00:55:25.440 Roe v. Wade.

00:55:26.680 Conservatives haven't tried to

00:55:27.820 get Texas v. Johnson

00:55:29.040 overturned.

00:55:30.400 It's been taken for granted

00:55:31.840 that contrary to what

00:55:32.980 everybody thought just a few

00:55:33.940 decades ago, flag burning is

00:55:35.680 now protected political

00:55:41.180 executive order that

00:55:42.100 effectively outlaws flag

00:56:19.160 And as you know, through a

00:56:21.300 very sad court, I guess there

00:56:23.560 was a five to four decision.

00:56:25.460 They called it freedom of

00:56:26.600 speech.

00:56:27.060 But there's another reason,

00:56:28.320 which is perhaps much more

00:56:30.040 important.

00:56:30.420 It's called death.

00:56:31.680 Because what happens when you

00:56:33.640 burn a flag is the area

00:56:35.680 goes crazy.

00:56:36.880 But when you burn the

00:56:37.920 American flag, it incites

00:56:39.900 riots at levels that we've

00:56:42.480 never seen before.

00:56:43.440 People go crazy.

00:56:44.680 What the penalty is going to

00:56:46.120 be, if you burn a flag, you

00:56:48.340 get one year in jail, no

00:56:50.980 early exits, no nothing.

00:56:54.040 Specifically, the order states

00:56:55.340 that, quote, in cases where

00:56:56.640 the Department of Justice or

00:56:57.660 another executive department or

00:56:59.100 agency determines that an

00:57:00.260 instance of American flag

00:57:01.560 desecration may violate an

00:57:02.700 applicable state or local law,

00:57:04.320 such as open burning

00:57:05.160 restrictions, disorderly conduct

00:57:06.580 laws, or destruction of

00:57:07.840 property laws, the agency

00:57:09.620 shall refer the matter to

00:57:10.980 the appropriate state or

00:57:11.960 local authority for

00:57:13.080 potential action.

00:57:14.220 And to the maximum extent

00:57:15.040 permitted by the

00:57:15.620 Constitution, the Attorney

00:57:16.380 General shall vigorously

00:57:17.700 prosecute those who violate

00:57:18.980 our laws in ways that

00:57:20.000 involve desecrating the

00:57:21.100 American flag.

00:57:26.360 visas, residence, permits,

00:57:28.060 naturalization proceedings,

00:57:29.020 and other immigration

00:57:33.080 appropriate determination

00:57:43.080 Now, as you could probably

00:57:44.340 tell, the order was written to

00:57:45.900 comply with the Supreme Court's

00:57:47.220 ruling as much as possible.

00:57:48.540 The idea is that in the eyes of

00:57:49.620 the Trump administration,

00:57:50.600 they're not outlawing flag

00:57:51.980 burning per se, so much as

00:57:53.380 disorderly conduct that results

00:57:54.920 from flag burning.

00:57:56.280 This is obviously a novel

00:57:57.660 approach.

00:57:58.860 And if we're being honest, it

00:58:00.000 probably doesn't work in the

00:58:02.580 current framework that has been

00:58:04.240 given to us by the Supreme

00:58:06.960 But the real question is,

00:58:08.560 why should that framework

00:58:10.920 exist?

00:58:15.860 It's pretty much impossible to

00:58:29.120 FIRE, the free speech group,

00:58:30.620 and watch.
