00:02:08.600 refugees. The boat sank, the mother drowned, and Gonzalez was rescued by the Coast Guard. His father

00:02:14.260 wanted him to return to Cuba. His relatives in Miami, though, refused, and thus began an infinite stream of

00:02:20.040 weepy cable news segments about this child and how Americans should care deeply about his fate for

00:02:25.820 some unknown reason. Eventually, after several months of this nonsense, the Clinton administration

00:02:30.480 ended the standoff. Janet Reno sent in heavily armed agents who seized the child at gunpoint,

00:02:35.340 threw him on an airplane, and transported him out of the country. It was, beyond any doubt,

00:02:39.920 the single best decision the Clinton administration made in their eight years in office.

00:03:35.280 Cuba. Now, fast forward a quarter century, and pretty much every aspect of this story is now being

00:03:40.820 repeated, except it's all completely inverted. This time around, of course, Democrats are universally

00:03:47.000 opposed to deportation in every imaginable scenario. Republicans, including Rudy Giuliani, are much more

00:03:54.760 interested in enforcing immigration law and defending law enforcement. And instead of a sympathetic young

00:04:00.620 child whose boat capsized, the main subject of everybody's attention, against our will, is a 30-year-old

00:04:07.400 illegal alien, suspected human trafficker, and alleged wife-beater and gangster by the name of

00:04:12.680 Kilmar Abrego Garcia. This is someone who simply will not go away, no matter how annoying he may be.

00:04:20.600 Democrats are intent on keeping him in the news cycle. He is the new Ilian Gonzalez. Now, right away,

00:04:26.720 that doesn't bode well for Democrats. I mean, it's one thing to use a six-year-old child to garner sympathy

00:04:31.380 for your platform, whatever it may be. But in this case, they're using one of the least sympathetic,

00:04:38.500 most grotesque foreign nationals that they possibly could have picked. They couldn't find, say, a

00:04:44.640 teenager who was deported while seeking cancer treatment or something like that. Instead, they're

00:04:50.580 trying to force-feed us a narrative about Kilmar Abrego Garcia, someone no rational person would want

00:04:55.660 living anywhere near them. There's a mountain of evidence, which was reviewed by several judges,

00:05:00.320 that he's a member of MS-13. Police think he was involved in human trafficking. His own wife says

00:05:05.800 he physically abused her. And that's not all. Let's put this up on the screen from a recent DOJ filing,

00:05:11.860 quote, one of the most troubling facts that the government learned in its investigation was how

00:05:15.720 the defendant got into MS-13. According to a co-conspirator, the defendant stated that he

00:05:21.040 participated in the murder of a rival gang member's mother in El Salvador, specifically the mother of

00:05:25.760 an 18th Street gang member. Later, as part of his immigration proceedings in the United States,

00:05:30.320 the defendant claimed that he could not return to El Salvador because he was in fear of retribution

00:05:33.960 from the 18th Street gang. While partially true, the defendant, according to the information received

00:05:38.960 by the government, was in fear of retaliation of the 18th Street gang. The underlying reason for

00:05:42.840 the retaliation was the defendant's own actions in participating in the murder of a rival 18th Street

00:05:47.780 gang member's mother, close quote.

00:05:51.040 Yes, according to the DOJ, Kilmar Abrego Garcia is worried about going back to El Salvador

00:05:55.640 because he helped murder the mother of a rival gang member. He wants asylum in this country

00:06:02.200 because he killed a woman and he's afraid that, you know, the relatives of that woman might be upset

00:06:07.900 about it. So we've come a long way from Ilion Gonzalez, but this is what they're going with.

00:06:31.360 with Immigration and Customs Enforcement in Baltimore. Back in March, Abrego Garcia was mistakenly

00:06:37.080 deported to his native El Salvador and held in the notorious Sicot prison for months. Under judges'

00:06:43.040 orders, he was returned to the U.S. in June, then immediately jailed by federal officials on human

00:06:48.580 smuggling charges. Three days ago, he was released again under judges' orders. And this morning,

00:06:54.880 complying with the conditions of his release, he reported to an immigration check-in in Baltimore

00:06:59.520 and was again arrested by ICE. Before his arrest, Abrego Garcia spoke to a crowd of supporters.

00:53:15.360 those laws changed very

00:53:16.500 abruptly in the mid-1980s.

00:53:18.240 Up until around 1985,

00:53:20.240 it was perfectly legal for

00:53:21.160 police officers to shoot

00:53:22.300 fleeing suspects in the

00:53:23.580 back, even when those

00:53:24.500 suspects were unarmed and

00:53:25.680 posed no imminent threat

00:53:26.540 to anybody.

00:53:27.380 This is something that's

00:53:28.260 obviously unthinkable now,

00:53:29.540 but for most of this

00:53:30.300 country's history, believe

00:53:31.040 it or not, it was

00:53:31.720 completely normal.

00:53:33.140 But one day, 1985, six

00:53:34.580 justices on the U.S.

00:53:35.340 Supreme Court decided to

00:53:36.920 change the rules.

00:53:37.920 And from that moment

00:53:38.460 forward, unless there was

00:53:39.400 some clear imminent threat

00:53:41.100 to somebody, police

00:53:42.280 officers could no longer

00:53:43.280 shoot unarmed suspects as

00:53:44.920 they ran away.

00:53:46.700 Now there are a lot of

00:53:47.520 cases like this, as it

00:53:48.860 turns out, and unless you

00:53:51.080 were paying attention in

00:53:51.880 the 1980s, you might not

00:53:53.840 be aware of them.

00:53:55.800 the laws concerning flag

00:53:57.240 burning.

00:53:58.560 In recent decades, you've

00:53:59.540 probably been told that

00:54:00.380 flag burning is protected

00:54:01.600 by the First Amendment.

00:54:02.620 It's supposedly an act of

00:54:03.560 political expression, and

00:54:04.960 therefore, you can't be

00:54:06.340 prosecuted for doing it.

00:54:07.660 This is now the accepted

00:54:08.980 consensus view in America

00:54:10.480 to the point that most

00:54:11.320 conservatives would react

00:54:12.800 with abject horror if you

00:54:14.400 told them that you think

00:54:15.400 flag burning should be

00:54:16.580 outlawed.

00:54:17.080 But this was not always

00:54:20.620 the mainstream position.

00:54:21.860 It wasn't until 1989 in a

00:54:23.820 5-4 decision in the case

00:54:25.140 Texas v.

00:54:26.440 Johnson that the Supreme

00:54:28.060 Court determined in its

00:54:29.160 infinite wisdom that flag

00:54:30.440 burning is in fact protected

00:54:31.680 political speech.

00:54:32.500 They struck down a Texas law

00:54:33.740 banning flag burning.

00:54:35.500 Prior to that ruling, 48 of

00:54:37.760 the 50 states had laws against

00:54:39.940 desecrating a flag on the

00:54:41.380 books.

00:54:41.620 Yes, 48 of 50 states up

00:54:45.580 until 1989 had outlawed

00:54:47.380 flag burning.

00:54:48.200 Pretty much everyone in the

00:54:49.300 country thought it should be

00:54:50.400 illegal.

00:54:51.740 So when that Supreme Court

00:54:52.920 ruling came down, which again

00:54:54.060 was decided by the narrowest

00:54:55.280 possible Supreme Court

00:54:56.120 majority, the president,

00:54:57.740 George H.W. Bush, declared

00:54:58.840 that flag burning was dead

00:55:00.160 wrong.

00:55:01.280 It was a major issue that

00:55:02.180 galvanized the entire

00:55:03.040 country.

00:55:03.480 Congress immediately passed a

00:55:04.580 federal law banning flag

00:55:05.800 burning.

00:55:06.100 A year later, again, by a

00:55:07.220 5-4 vote, the Supreme Court

00:55:08.580 struck down that federal law

00:55:10.100 also, in other words, in an

00:55:12.340 instant, the Supreme Court

00:55:13.200 overruled the judgment of the

00:55:14.900 vast majority of Americans.

00:55:16.920 And in the years since that

00:55:18.260 ruling among the political

00:55:19.420 right, the Supreme Court's

00:55:20.660 ruling has become gospel.

00:55:23.060 No one has really questioned

00:55:24.120 it for decades, unlike, say,

00:55:25.440 Roe v. Wade.

00:55:26.680 Conservatives haven't tried to

00:55:27.820 get Texas v. Johnson

00:55:29.040 overturned.

00:55:30.400 It's been taken for granted

00:55:31.840 that contrary to what

00:55:32.980 everybody thought just a few

00:55:33.940 decades ago, flag burning is

00:55:35.680 now protected political

00:55:36.740 speech.

00:55:37.880 Well, that is now changing.

00:55:39.060 Donald Trump, as you may have

00:55:39.880 seen, just signed an

00:55:41.180 executive order that

00:55:42.100 effectively outlaws flag

00:55:43.860 burning.

00:55:44.480 Watch.

00:55:45.440 So the president today

00:55:46.620 signing an executive order

00:55:48.240 requiring the Justice

00:55:49.960 Department to investigate and

00:55:51.920 prosecute people for burning

00:55:53.680 the American flag.

00:55:54.860 It's an activity that the U.S.

00:55:56.820 Supreme Court has ruled is

00:55:58.180 legitimate political

00:55:59.580 expression protected by the

00:56:02.160 U.S.

00:56:02.580 Constitution, protected by the

00:56:05.140 First Amendment here.

00:56:06.060 So if you didn't catch this

00:56:07.280 earlier today, this was the

00:56:08.580 moment, President Trump

00:56:10.060 brought this up in the

00:56:11.280 Oval Office.

00:56:12.220 Let's watch this.

00:56:13.420 All over the country,

00:56:14.600 they're burning flags.

00:56:16.320 All over the world, they

00:56:17.280 burn the American flag.

00:56:19.160 And as you know, through a

00:56:21.300 very sad court, I guess there

00:56:23.560 was a five to four decision.

00:56:25.460 They called it freedom of

00:56:26.600 speech.

00:56:27.060 But there's another reason,

00:56:28.320 which is perhaps much more

00:56:30.040 important.

00:56:30.420 It's called death.

00:56:31.680 Because what happens when you

00:56:33.640 burn a flag is the area

00:56:35.680 goes crazy.

00:56:36.880 But when you burn the

00:56:37.920 American flag, it incites

00:56:39.900 riots at levels that we've

00:56:42.480 never seen before.

00:56:43.440 People go crazy.

00:56:44.680 What the penalty is going to

00:56:46.120 be, if you burn a flag, you

00:56:48.340 get one year in jail, no

00:56:50.980 early exits, no nothing.
