00:01:15.300 in the 1970s. The hippies were convinced that they'd eventually ascend on board an alien UFO

00:01:20.960 and transform into immortal beings with godlike powers. Members eagerly signed up because after

00:01:27.920 all there wasn't a whole lot of downside risk involved. In the worst case scenario, if the

00:01:32.460 prophecy was wrong, your life would continue as normal. Maybe you'd have to leave your family

00:01:37.060 for a bit, but otherwise no big deal. In the best case scenario, you become omnipotent. So it seems

00:01:41.600 like a win-win. Now fast forward a few decades and Heaven's Gate changed the terms of the bargain

00:01:45.580 a little bit. By the 90s, in order to get those godlike powers, you needed to take your own life.

00:01:51.540 So it was a slight revision in the contractual arrangement. But a lot of Heaven's Gate members

00:01:56.740 went along with it anyway. They had bought into the nonsense that they'd been fed. They were in too

00:02:00.640 deep. They had sunk costs. They weren't about to turn back at the last minute as the Haley-Bopp

00:02:06.520 comet approached. So they took the drugs, died, and that was that. The cult of Heaven's Gate was no more.

00:03:52.580 French resistance fighters circa 1942. All of their friends and social media networks and schools and

00:03:59.480 employers have indulged this delusion. So they naturally expected that the federal government

00:04:04.180 would do so as well. They seriously expect that when they drive their cars directly into law enforcement,

00:04:09.780 officers will simply take the hit and get run over in order to keep the fantasy alive. Or if they shoot,

00:04:18.280 they'll shoot, I don't know, super soakers, water guns. Now, if you were a Democrat political

00:04:23.820 strategist and you weren't ideological, you simply wanted your party to win, this would be a major

00:04:28.920 existential concern. We're not talking about one or two lone wolves or bad actors here. We're talking

00:04:34.060 about a critical mass of Democrat voters who are deranged. They support attacking federal law enforcement,

00:04:39.760 assassinating a conservative podcaster, taking shots at the president of the United States,

00:04:44.880 mowing down an insurance executive, most recently gloating over the cancer-stricken body of a

00:04:51.940 cartoonist who dared to say something negative about a demographic that's sacred to them.

00:04:58.300 These are symptoms of a political movement that has lost touch with reality. And now, like all cults,

00:05:03.940 they're losing touch with human decency as well. They're nearing their moment of ultimate

00:05:08.880 self-destruction. And that became even clearer yesterday during oral arguments at the Supreme

00:05:13.140 Court for two cases, Little v. Hecox and West Virginia v. BPJ. Now, for background, Hecox refers

00:05:22.540 to a man who wanted to join the women's track and cross country teams at Boise State University in

00:05:28.700 Idaho. And meanwhile, BPJ is a 15-year-old high school student, also a male, who's taking cross-sex

00:05:34.300 hormones and other sterilizing medications who wants to join the girls' sports team at school.

00:05:40.920 Now, both Hecox and BPJ were banned from joining the girls' team because of laws passed by their

00:05:46.000 respective states, which prevent males from competing against females. In a moment, we'll talk in some

00:05:51.580 detail about the legal issues that are involved here, but really, this was the highlight.

00:05:56.400 More than three years after my film, What is a Woman?, the lead attorney for one of the trans-identifying

00:06:01.920 athletes was asked a very basic fundamental question by Justice Alito. He wanted to know

00:06:07.660 what it means to be a man or a woman, a boy or a girl. He wanted the attorney, a very highly educated

00:06:13.300 individual, went to Harvard several times to provide some definition of biological sex so that

00:06:20.420 we can distinguish between men and women. And this is and always will be, of course, the fatal

00:06:24.660 question for trans ideology. It's a question they simply cannot answer. They've had

00:06:28.800 years now to come up with some kind of answer. Years. But they haven't been able to. The entire

00:06:36.800 movement hinges on the notion that a man is someone who says he's a man. A woman is someone who says

00:06:40.380 she's a woman. There's no definition they can offer that isn't circular and therefore meaningless.

00:06:44.940 And that's why the attorney is, you know, in an impossible situation that he's put himself in.

00:06:50.380 And so we tried to punt on the question. Listen. If it does that, then is it not necessary for

00:06:58.240 there to be, for equal protection purposes, if that is challenged under the Equal Protection Clause,

00:07:04.380 an understanding of what it means to be a boy or a girl or a man or a woman?

00:07:10.460 And what is that definition? For equal protection purposes, what does it mean to be a boy or a girl

00:07:18.520 Sorry, I misunderstood your question. I think that the underlying enactment, whatever it was,

00:07:22.020 the policy, the law, we'd have to have an understanding of how the state or the government

00:07:27.060 was understanding that term to figure out whether or not someone was excluded. We do not have a

00:07:33.060 So let's put the transcript up on the screen so it's clear what was said. Quote,

00:07:39.520 what does it mean to be a boy or a girl or a man or woman? And then after some stammering,

00:07:44.020 the response from the Harvard-educated lawyer before the Supreme Court is,

00:07:48.020 we do not have a definition for the court. That's the answer that the left's attorney gave

00:07:53.800 in a case that's supposedly about how trans-identifying individuals are being discriminated

00:07:57.460 against on the basis of their biological sex. Well, they can't define the words they're supposed

00:08:02.580 to even be arguing about. So this is yet another Hindenburg moment for the modern left. It was

00:08:07.760 just over a year ago that the ACLU admitted before the Supreme Court that there's no evidence

00:08:12.840 that butchering and sterilizing children actually prevents suicides. In fact, as you'd expect,

00:08:17.040 there's a lot of evidence to the contrary. And now, when asked point blank to define the concept

00:08:20.760 of biological sex, the attorney for the trans-identifying plaintiff says simply, eh, pass.

00:08:28.220 Now, in a casual debate among friends, this would be embarrassing enough.

00:08:32.580 It's a concession that you've lost. But in an oral argument before the Supreme Court,

00:08:36.760 it's something else entirely. The lawyer is saying that one of the most fundamental concepts in all

00:08:42.140 of human biology, the distinction between sexes, is null and void. The entire concept of biological

00:08:47.120 sex has no meaning. And if that's the case, if we're really supposed to disregard a category

00:08:51.500 that's easily definable and pretend we can't define it at all, then, of course, nothing is real

00:08:56.460 anymore. If chromosomes and human biology suddenly mean nothing at all, then

00:08:59.560 nothing means anything. Then who's to say that ICE isn't the Gestapo, or that Charlie Kirk wasn't a

00:09:05.480 Nazi, or that Scott Adams wasn't a racist who had it coming, or any of the other left's propositions?

00:09:11.320 All of it is, who's to say they're wrong? As long as we're making everything up, there are no

00:09:16.720 boundaries. The delusions can run rampant, and that's exactly what's happening for Democrats at a

00:09:21.360 large scale. Take, for example, this moment that took place outside the Supreme Court. The Daily

00:09:25.580 Wire interviewed a left-wing activist, and it went, you know, kind of how you would expect. Here's how

00:09:30.780 that was.

00:09:32.140 Why are you splitting up sports? Like, I'm pretty sure a woman could play basketball as well as a man if she

00:09:38.500 practiced. I'm pretty sure a woman could play basketball as well as a man if she practiced.

00:09:47.340 That's all it takes. A little more practice. This is the mainstream view of the average leftist in

00:09:54.220 2026. Yesterday, NPR ran a whole segment about studies that supposedly showed that men don't have a

00:10:00.960 biological advantage over women in sports. You have to wonder why these people aren't outside the

00:10:06.120 headquarters of the NBA and NFL right now, demanding that every team signs a female athlete, just like

00:10:12.100 they have female referees now. It's not like the NBA and NFL are right-wing institutions. They'd

00:10:17.340 be receptive to whatever the activists have to say, and it wouldn't be hard to make the change

00:10:22.420 either. You could just incorporate the WNBA into the NBA overnight. How many games do you think

00:10:28.680 they'd win? Maybe the better question is, how many fatalities would there be before the police had

00:10:33.640 to shut down the entire league? Now, in fairness to the left-wing side of the argument, the ACLU made a

00:10:38.860 slightly different case before the Supreme Court. This is a section from the ACLU's brief, which was flagged by

00:10:44.340 Kristen Wagoner at ADF Legal. Quote,

00:10:47.620 The medical understanding of biological sex encompasses several biological attributes,

00:10:51.780 including chromosomes, genes, gonads, hormone levels, internal and external genitalia,

00:10:56.480 and other secondary sex characteristics. Transgender women may possess some of these

00:11:00.700 biological attributes typical of women. The act's definition of biological sex excludes the key

00:11:05.100 criterion circulating testosterone levels that would have allowed certain transgender women

00:11:10.220 to play on women's sports. So, the ACLU is taking issue with Idaho's definition of biological sex,

00:11:16.940 which includes three criteria, reproductive anatomy, genetic makeup, or normal endogenously produced

00:11:22.360 testosterone levels. So, according to ACLU, anatomy and genetics aren't the key criterion.

00:11:29.420 The really important metric, in their view, is the level of testosterone in your system. This is another

00:11:33.620 way of arguing that sex has no real meaning because anyone can change it at any time. All you need to do is

00:11:38.820 take some hormones and that's it. Now, at the moment, it doesn't look like the Supreme Court is going to

00:11:43.620 side with the ACLU in this. The laws banning men from competing against women, laws that never should

00:11:48.540 have been necessary in the first place in a sane society, will probably be upheld. And that means

00:11:53.740 that contrary to what the ACLU is arguing, these bans don't violate the 14th Amendment or Title IX.

00:11:58.600 Alas, there is no constitutional right for men to pummel women in every available sport. Who would have

00:12:03.960 thought? But just to give you an idea of how absurd these arguments have been, at the lower

00:12:08.340 court level, an appeals court in San Francisco ruled that the laws amounted to sex discrimination

00:12:13.340 because, quote, athletes on girls' and women's sports, but not on boys' and men's teams, are subject

00:12:18.920 to invasive sex verification procedures to implement the law. In other words, the schools were checking

00:12:25.220 to make sure that no males were trying to sneak into the girls' team, but they weren't checking to

00:12:29.540 ensure that females didn't try to sneak onto the men's team. And in the eyes of a federal appeals court

00:12:35.360 in San Francisco, that amounted to unconstitutional sex discrimination. But really, it's common

00:12:38.600 sense. I mean, obviously, you don't have to check to see if girls are sneaking their way

00:12:42.300 onto the boys' team because the girls would have no incentive to do that. They would get

00:12:47.220 absolutely demolished if they tried, and no team would want to pick them up. So even if you

00:12:52.820 pretend that the female athlete could somehow pass as a male, which has never happened in human

00:12:57.420 history, the fact that they'd be completely smoked on the field would be a pretty big clue.

00:13:02.920 Now, separately, this is a line of argument from the left and the ACLU that if a particular

00:13:08.740 male trans-identifying athlete can demonstrate that he specifically has no biological advantage

00:13:14.200 over women, then he should be able to play with women, even though he's a male. So in other words,

00:13:19.960 if a boy has been chemically castrated from a young age and destroyed his muscles and bone

00:13:24.160 growth to the point that he can prove he's as weak as the average female athlete, then he should

00:13:29.780 be allowed onto the girls' team. That's called an as-applied challenge to the Idaho law. This is

00:13:35.360 how far the movement has sunk, by the way. You know, they're trying to argue in court that they

00:13:41.420 should be considered females if they do enough irreversible damage to their bodies. According

00:13:45.220 to this argument, a female is nothing but a severely diminished male. And that brings us to this clip of

00:13:53.700 Ketanji Brown-Jackson, where she brings up as-applied challenges, and she does it as only Ketanji Brown-Jackson

00:14:01.200 can. See if you can decipher whatever this is.

00:14:06.420 To the extent that you have an individual who says what is happening in this law is that it is

00:14:15.960 treating someone who is transgender, but who does not have, because of the medical interventions and

00:14:24.520 the things that have been done, who does not have the same threat to physical competition and safety and

00:14:35.120 all of the reasons that the state puts forward, that's actually a different class, says this

00:14:41.920 individual. So you're not treating the class the same, and you're not... how do you respond to that?

00:14:47.580 In other words, the as-applied challenge essentially redefines the class, or one could think of it

00:14:52.560 as that. And so what's wrong with that, number one, and how do you square that with our holdings in

00:15:00.520 Kaban, which Lair later described in this way? In other words, Lair suggested that Kaban was

00:15:08.740 establishing that as-applied challenges of this nature do exist.

00:15:13.820 Certainly the... I'll take the second question first.

00:15:25.320 but simply reading Kaban, it does not say that.

00:16:06.460 Ketanja Brown-Jackson is a perfect illustration of the black woman privilege we've discussed on the show this week.

00:16:16.340 because the most mediocre among them, black women who can barely read or speak,

00:16:20.140 like Ketanja Brown-Jackson, are elevated to the most prestigious positions solely because they are black women.

00:16:27.420 Ketanja Brown-Jackson is not qualified to be like a high school principal, let alone a Supreme Court justice.

00:16:33.780 And for what it's worth, this wasn't the only word salad from Jackson during yesterday's argument.

00:16:37.800 Here's another moment where she stumbled a bit as she tried to define what a woman is.

00:16:43.580 You have the overarching classification, you know, everybody has to be, um, uh, uh, play on the team that is the same as their sex at birth.

00:16:57.020 Um, but then you have a gender identity definition that is operating within that, meaning, a distinction,

00:17:04.600 meaning that, um, for, uh, cisgender girls,

00:17:09.420 they can play consistent with their gender identity.

00:17:12.460 For transgender girls, they can't.

00:17:15.200 So I think that, okay, you're, as to the part about your ability to pass over from boy to girl,

00:17:24.660 I want to be clear that BPJ is not challenging that specific classification.

00:17:30.560 But I think, if anything, that's useful evidence as to the lack of a transgender-based discrimination,

00:18:06.000 and we're saying only people who were, um, girl assigned at birth qualify.

00:18:12.140 Now, putting aside the nonsense at the beginning of that clip,

00:18:16.960 she's outraged that we're limiting our definition of girls to girls who were assigned female at birth.

00:18:23.080 And first of all, of course, anyone using the phrase sex assigned at birth

00:18:25.900 is someone who, as we know, should never be taken seriously for any reason,

00:18:30.120 because for the millionth time, doctors don't assign your sex any more than they assign your height or your weight.
