00:02:31.240 New from overnight, a Rochester jury reaching a late night verdict in the case of a woman
00:02:36.620 accused of calling a little boy a racial slur at a park. Shiloh Hendricks was facing two counts
00:02:41.760 of disorderly conduct. Hannah Flood is in the live center with how this trial ended and what
00:02:46.320 this means going forward. Hi, Hannah. Yeah, good morning. You may remember this case because of
00:02:49.780 that now viral video that started all of it.
00:02:52.320 The video shows Shiloh Hendricks allegedly calling
00:02:54.860 an eight-year-old boy with autism a racial slur
00:02:57.420 while she was out at the playground with her child.
00:02:59.660 It was posted last year and it led to community rallies
00:03:02.320 and an outpouring of support,
00:03:03.920 both for the child and family it featured,
00:03:06.360 but also for the woman, for Hendricks.
00:03:08.760 She was charged with two counts of disorderly conduct
00:03:10.940 and took the case all the way to a jury trial.
00:03:13.340 According to KTTC, late last night,
00:03:15.480 the jury returned a split verdict,
00:03:17.100 finding her guilty of one count, but not guilty of the other count.
00:03:20.760 The count she was found guilty for was not related to the racial slur thrown at the child,
00:03:26.100 but instead conduct against the man who took that viral video.
00:03:30.120 During the trial, the Rochester branch of the NAACP submitted a victim impact statement
00:03:34.820 and asked the judge for the stiffest sentence possible, saying, quote,
00:03:38.740 the words and actions of Ms. Hendricks caused tremendous fear and trauma to a defenseless child.
00:03:43.500 For many members of our community, this was not simply an isolated playground incident.
00:03:48.740 It was a painful reminder that the hatred represented by that word still exists today.
00:03:56.560 So there it is. Hatred is now illegal, by which they mean hatred of non-whites.

00:05:45.360 one of the things that makes it an incoherent verdict, which is also why the NAACP wants to
00:05:49.220 confuse the issue as much as possible. So we're going to go in depth. We're going to analyze the
00:05:54.840 trial of Shiloh Hendricks at some length because it's easily one of the most important criminal
00:05:59.940 cases in memory, even if much of conservative media is ignoring it. The First Amendment protects
00:06:06.560 the most fundamental rights we have. That's why it's the First Amendment. It's what separates the
00:06:11.020 United States from almost every other country on the planet, including countries like the UK and
00:06:15.180 Australia and Canada, which share our common law tradition, or at least supposedly they do.
00:06:20.820 Every other country with any degree of influence has abandoned the right of free expression. So
00:06:25.820 when a court in the United States decides to suspend the First Amendment, which is what they've
00:06:30.920 done, when a court decides to make it illegal to offend black people, especially if they're
00:06:36.300 foreigners, then we have a major existential problem on our hands. This is a problem that 0.89
00:06:41.740 demands an immediate response from the federal government, including civil rights investigations
00:06:46.920 into Minnesota officials and the dramatic acceleration of deportations, especially in
00:06:52.460 the state of Minnesota. Anything less is unacceptable. Anything less, and this will
00:06:57.500 fester until we don't have a constitution anymore. Now, to set the stage, we're going to begin
00:07:03.920 to refresh our memories with the now infamous video of Shiloh Hendricks in the park.
00:07:10.600 Other than the testimony of some barely literate Somali witnesses, this was the only relevant
00:07:16.340 evidence in the case that the jury was allowed to be presented. And so let's go back and watch
00:07:24.660 it again. Here it is. You call him a child? Did you call the child? It is my own business.
00:07:34.680 You call him. OK, why don't you have the boss to say it right now again?
00:07:40.960 All right. That's what you say.
00:07:46.340 that little kid you call him the little child are you about to hit him you chase him here

00:10:04.060 response to the defense's motion to dismiss the case. In her denial of a motion to dismiss,
00:10:09.120 Judge Daly states that personally directed inherently abusive language likely to provoke
00:10:14.360 an immediate violent reaction falls outside First Amendment protection. This is known as the
00:10:20.680 fighting words doctrine. Supreme Court hasn't upheld a conviction based on this doctrine in
00:10:27.120 80 years, and that's for good reason. It's nonsense. There are no words in the English
00:10:32.960 language that justify the use of violence in response. Saying that the N-word is likely to
00:10:39.620 provoke an immediate violent reaction would seem to be more of a statement about the group that
00:10:46.600 claims to find the word offensive than it is a statement about the word itself. Okay, because
00:10:53.160 there are a lot of bad words in the English language. There are a lot of slurs of various
00:10:57.600 kinds. Why would that one particular word be so likely to provoke an immediate violent reaction?
00:11:06.700 Why is that? Is it because the offended group is statistically more likely to be violent in general?
00:11:14.460 If that's the case, and it is, then the answer is not to throw the book at somebody saying the word,
00:11:20.040 but rather to throw it at anybody responding violently to it.
00:11:24.800 But even if we pretend that the fighting words doctrine makes sense,
00:11:29.400 Shiloh's behavior doesn't qualify.
00:11:32.060 In her ruling, the judge states that, quote,
00:11:34.180 the defendant directed an extreme racial epithet at both adults and a child
00:11:38.400 and chased a child in a confrontational manner.
00:11:40.780 This is targeted face-to-face verbal abuse coupled with aggressive physical conduct,
00:11:46.720 language that is inherently likely to provoke an immediate breach of the peace,
00:11:51.620 particularly when directed at a vulnerable minor and accompanied by pursuit.
00:11:57.660 Now, the problem here is obvious.
00:12:00.000 I mean, there are many of them.
00:12:01.580 There is no evidence that Shiloh chased a child or pursued a child.
00:12:06.280 And even if she had, it would obviously be reasonable because the child just stole from her.
00:12:11.040 She wanted to get her stuff back.
00:12:12.300 that's presumably why she was acquitted of committing any crime with respect to the child
00:12:17.420 therefore there is precisely zero additional conduct by shiloh beyond the racial slur
00:12:24.200 that the judge can point to as evidence that there was aggressive physical conduct or anything along
00:12:30.220 those lines now nevertheless the judge continues by stating that the direct face-to-face use of
00:12:35.920 highly inflammatory language in a confrontational setting together with circumstances indicating
00:12:40.260 a foreseeable risk of immediate escalation create a situation where Shiloh Hendricks was
00:12:45.600 using fighting words. So she loses all of her First Amendment protections because of these 1.00
00:12:51.760 alleged aggravating circumstances. Nowhere in the ruling does the judge explain what these
00:12:57.540 aggravating circumstances are with respect to the Somali adult. You know, under the fighting words 0.96
00:13:05.340 doctrine, even under that doctrine, this prosecution is unconstitutional. And so is the
00:13:11.660 verdict. I mean, you can't convict somebody of using fighting words against an adult man simply
00:13:17.320 because she directed a racial slur at him upon his request. And the latter fact there should 1.00
00:13:24.960 have been enough on its own to shoot down any notion of charging Shiloh with any crime at all.
00:13:29.460 the Somali guy dared Shiloh to say it. He coaxed it out of her explicitly. He literally asked for 0.98
00:13:37.900 it. How can somebody be the victim of fighting words when they are the ones who prompted those
00:13:45.480 words? But Judge Daly and her jury instructions continued to push this theory, and she did so in
00:13:52.380 a way that misled the jury and violated the Constitution. That's the theme here. For one
00:13:57.680 thing, the judge made sure that the jury instructions did not contain any mention of the
00:14:03.060 First Amendment whatsoever over the objections of the defense. The defense wanted the jury's
00:14:08.160 instruction to read, quote, the First Amendment to the United States Constitution limits what
00:14:12.260 speech may constitutionally be punished. Speech alone cannot constitute disorderly conduct unless
00:14:18.500 the state proves beyond a reasonable doubt that the words used were fighting words.
00:14:23.600 Now, that's obviously a correct judgment, a correct statement of the law, but the judge refused to provide that jury instruction.
00:14:33.780 Even though the jury instructions were 11 pages long, the First Amendment was not mentioned a single time.
00:14:43.900 I mean, this entire case revolves around that question.
00:14:47.960 Was she within her free speech rights or not?
00:14:50.620 And the jury was never told.
00:14:53.600 in the instructions. Instead, the judge simply asked jurors whether, quote, the defendant engaged
00:14:59.220 in offensive, obscene, abusive, boisterous, or noisy conduct, or in offensive, obscene, or
00:15:04.740 abusive language, tending reasonably to arouse alarm, anger, or resentment in others.
00:15:12.880 Now, specifically, the judge told the jurors, quote, if you find the defendant's conduct
00:15:17.640 consisted only of offensive, obscene, or abusive language, then to convict, you must also find
00:15:22.840 that the words used were fighting words.

00:16:50.540 But again, as Powell points out, that would not rise to the level of criminal conduct.
00:16:56.340 So you know this case is a farce and a disgrace when it requires the jury to parse terms like boisterous and fighting words.

00:17:11.040 They are adjectives that are entirely subjective and have no objective meaning whatsoever.
00:17:18.160 However, how does one differentiate criminal boisterousness from regular boisterousness?
00:17:25.080 How does one separate criminal fighting words from just regular mean but not fighting words?

00:17:34.780 So let's start here while we're on the subject.
00:17:38.240 what circumstances could you imagine under this instruction might transform speech into fighting
00:17:47.940 words the attorney andrew bronca on his show has come up with a few examples based on minnesota law
00:17:54.260 and previous cases uh one example might be if shia hendrix had clenched her fists and run
00:18:00.300 towards the somali while dropping the n-bomb that might make a reasonable person think he's about to
00:18:05.700 hit or maybe if she had assembled a mob to surround the guy or if she was trespassing or if she kept
00:18:12.180 berating him for an hour, that could qualify. But there has to be something beyond the N-bomb 0.77
00:18:19.360 itself. There's no getting around it. And of course, in any of those cases, you wouldn't need 0.99
00:18:24.520 this ridiculous fighting words doctrine anyway, because the crime would be in the additional
00:18:30.000 conduct. Like, charging at somebody with clenched fists is already a sign that you mean to assault
00:18:36.160 them, even if you say nothing. So the words she used along with that conduct, if she engaged in
00:18:42.680 it, which she didn't, would be basically irrelevant. But once you abandon the idea that Shiloh Hendricks
00:18:48.120 chased anybody, which the jury did, then it's game over. I mean, there's no constitutional basis for
00:18:54.600 convicting Shiloh for disorderly conduct with respect to anybody. And yet they did anybody 0.91
00:19:00.700 anyway. Now, there have been decades of federal court rulings on the topic, which FIRE, which is
00:19:08.100 the free speech organization, has assembled on their website. All of the cases show the same
00:19:12.480 thing, which is that slurs alone don't qualify. And we should mention FIRE, by the way, was missing
00:19:20.280 in action on this case. They were obviously aware of it. Tom Hennessey posted emails in which a case
00:19:26.100 number was opened with fire, but they didn't actually support the defense. They posted an
00:19:29.840 article criticizing the verdict after the fact, but they did not actually do anything to support 0.92
00:19:35.220 Shiloh or defend the First Amendment in this case, which is yet another sign that the right
00:19:40.540 needs its own ACLU. We need an actual, well-funded, serious organization that's focused on protecting
00:19:47.960 freedom of speech and has the balls to jump into the fray on a case like this, where there's a 0.52
00:19:53.920 risk that they might be called racist, God forbid. But if they can't defend the First Amendment in a
00:19:59.800 case like this, then they're completely useless, period. Which means that, yes, most conservative
00:20:08.180 organizations are useless because they didn't say anything about this. They're terrified of it. 0.80
00:20:14.160 as you saw from that video the Somalis response to hearing the n-word was to beg the woman to
00:20:22.360 say it 10 more times so that he could get her fired from her job that's typically what happens
00:20:27.180 in these scenarios probably because every rap song uses the same kind of language it's absurd
00:20:33.780 to try to make the case under these circumstances that Shiloh's words would inherently
00:20:38.020 provoke violence in an ordinary person. There are no words at all that inherently provoke violence.
00:20:46.980 Think about that. The word inherent means existing naturally, a sort of inseparable part
00:20:55.080 of something. Something is inherent to a thing. It is inseparably part of it.
00:21:00.460 so to say that the n-word inherently provokes violence is to say that it possesses actual
00:21:07.720 mystical power to conjure violence causing the person who hears the word to be violent
00:21:15.900 against his own will like some sort of sorcerer's curse it is to suggest quite explicitly that a
00:21:22.940 black person who hears this word literally has no choice but to respond with violence 0.73
00:21:29.360 it triggers like an instinct, like a bull charging a red flag.
00:21:33.900 I mean, that's the apparent legal theory that we're hearing here.
00:21:38.500 And the judge went out of her way to sell this particular theory to the jury in a few different
00:21:42.780 ways. For example, while she didn't instruct the jury about the First Amendment, Judge Daley
00:21:47.620 had a lot to say about the concept of implicit bias. And in case you're not familiar, implicit
00:21:53.820 bias is a communist pseudoscience, the idea that everybody is racist against black people,
00:21:59.800 whether they're aware of it or not. It's a way to just justify various anti-white programs and
00:22:04.800 policies. It has no place being taught in schools, much less in courtrooms. In this case, though,
00:22:11.980 Judge Daly provided the following instruction to the jury, quote, at the opening of this case,
00:22:17.380 I instructed you regarding implicit bias. I trust you have kept that instruction in mind as we have
00:22:22.920 conducted this trial. I would like to take this opportunity now to remind you of that instruction.
00:22:27.600 We all have feelings, assumptions, perceptions, fears, and stereotypes about others. Some biases
00:22:32.280 we are aware of and others we might not be fully aware of, which is why they are called implicit
00:22:37.180 or unconscious biases. No matter how unbiased we think we are, our brains are hardwired to make
00:22:43.460 unconscious decisions. We look at others and filter what they say through the lens of our
00:22:48.960 own personal experience and background. Because we all do this, we often see life and evaluate
00:22:53.260 evidence in a way that tends to favor people who are like ourselves or who have life experiences
00:22:58.360 like our own. We can also have biases about people like ourselves. So she can't mention
00:23:05.680 the First Amendment. She won't mention it, which is foundational to the Constitution.

00:27:36.700 Shair Jamali, had lied on the stand. Now, first, the prosecution hid the name of the father for as
00:27:42.760 long as they could, presumably in order to prevent the defense's investigators from
00:27:46.880 looking into his background. And then when the investigator found evidence that the father was
00:27:50.840 lying on the witness stand, which would be relevant in a trial, the judge didn't let the
00:27:56.920 defense present the evidence that he was lying. Now, this is not some trivial detail. If a witness
00:28:02.560 to the case has a financial incentive to present a certain narrative, then the jury should know
00:28:08.780 about that. And certainly if the witness denies having any financial incentive and there's
00:28:12.960 evidence to the contrary, irrefutable evidence, by the way, there's no reason to hide that
00:28:18.900 information from the jury. Yes, Shiloh Hendricks raised hundreds of thousands of dollars with a
00:28:24.260 give send go, but she didn't testify in the case as a witness and her fundraiser was not a secret
00:28:30.040 in any event. What this Somali did, according to the defense attorney, is very different

00:29:43.220 journalist I mentioned earlier, was paying attention, and he shot this photograph after
00:29:47.700 the second day of the trial when both of the prosecutors appeared outside the courthouse with
00:29:52.180 Shair Jamali, who was their star witness. And as you can see, he apparently has no problem
00:30:00.100 talking to the prosecutors without a translator, much less two translators, which he supposedly
00:30:05.000 needed during the trial. It's miraculous. So this Somali was somehow magically infused with

00:35:48.160 reporting that he was right. Oops. Watch. One issue Corrales repeatedly pointed to
00:35:55.700 involved Rule 901 of the Minnesota Rules of Evidence, which deals with introducing evidence
00:36:00.160 at trial. Judge said Rule 901 of the Rules of Evidence only applies to prosecutors. You were
00:36:05.820 there. I mean, come on. Come on. Look it up. You're not going to do the research. You're not
00:36:12.140 going to look up Rule 901. So we decided to look up Rule 901 and clarify whether it does apply to
00:36:17.420 both sides with defense attorney Peter Martin, who has known Corrales for years and says he was
00:36:21.860 in contact with him throughout portions of the trial. So Rule 9 requires the prosecution to
00:36:27.600 turn over stuff. And if they didn't turn it over, that's a clear violation of Ms. Hendricks's rights
00:36:33.980 in this case. Now, if you're confused by this, here's the explanation we received from Tom
00:36:41.100 Hennessey. In Minnesota, Rule 901 governs the standards for the admissibility of certain
00:36:46.180 evidence. The rule states that evidence, at a minimum, must be sufficient to support a finding
00:36:50.980 that the matter in question is what it is purported to be. It's very lax standard, and it applies to
00:36:56.000 both the prosecution and defense. For example, at one point during the trial, the prosecution
00:36:59.200 introduced a Google Maps depiction of the park where this incident occurred, and the judge had
00:37:03.720 no problem with that. There's no question as to whether the Google Maps page was faked somehow.
00:37:08.100 The assumption was that it's real, and the burden shifts to the other side to dispute it
00:37:12.020 with some evidence of their own
00:37:13.760 if they choose to do so.
00:37:15.320 But when the defense team questioned Shire Jamali
00:37:18.680 and he kept denying that he was running a fundraiser,
00:37:23.420 the judge would not allow the defense

00:37:55.780 evidence of this GoFundMe, but the judge stated incorrectly that Rule 901 only works for the
00:38:00.280 benefit of the prosecution. She applied a higher standard to the defense. Again, it's as corrupt
00:38:06.520 as a trial could possibly be. I mean, if anything, it's the exact opposite of how trials are supposed
00:38:10.340 to work. You don't, you don't, since when is that how it works in a trial? There's a higher standard
00:38:15.000 for the defense. Now, isn't, isn't the onus on the prosecution to prove their case? Don't we
00:38:23.020 generally put the higher standard on them, if anything? And, uh, you know, of course the moment
00:38:30.200 the news stations looked into it, they found that the lawyer was correct. Now you'd think that these
00:38:35.260 local news stations would report on the judge's rulings on their own without the defense lawyer
00:38:39.700 shaming them into it. If they were actual journalists, they'd tell their audience what
00:38:44.480 the judge was doing inside that courtroom. They'd let their audience know that the whole trial was
00:38:50.120 a farce. But as we all know, most of these outlets are aligned with the Democrat establishment in
00:38:54.120 Minnesota. They're also completely incompetent. So we're left with extremely inadequate coverage 0.96
