00:03:49.320 separation of church and state and how they relate, or don't relate, to our Constitution.

00:03:56.380 Pretty much every American has been told, at one point or another, at many points, about the so-called separation of church and state.

00:04:07.120 You're told that it's a fundamental tenet of American government, the critical guardrail that prevents us from descending into theocratic fascism.

00:04:16.000 And you're led to believe that since the dawn of this country, students have learned about the separation of church and state, just as students have supposedly always learned about the Trail of Tears, for example.

00:04:28.340 But that's not true. At all. Just like the Trail of Tears, the concept of the separation of church and state, as we know it today, was actually an invention of the mid-20th century.

00:04:41.640 For the vast majority of our country's history, if you mention the separation of church and state to the average American,

00:04:47.940 they'd have no idea what you're talking about.

00:04:49.880 The words appear nowhere in the Constitution, and the phrase conveys the impression

00:04:54.840 that religion should have no impact on government, which most people wouldn't agree with.

00:05:01.780 Of course, people were familiar with the First Amendment and the idea that the federal government should not establish a state religion,

00:05:08.260 as opposed to, say, the Church of England.

00:05:10.520 But the notion that religion should be totally distinct from governance in every way, as

00:05:15.160 implied by the phrase separation of church and state, would have seemed very strange

00:05:20.300 to most people.

00:05:22.620 But everything began to change in the mid-20th century.

00:05:26.000 This was the period in American history when leftists went rummaging through the history

00:05:30.940 books and began redefining our past so they could indoctrinate generations of schoolchildren

00:05:35.560 and bring about radical, transformative change to our country. And maybe their most urgent

00:05:42.060 objective, which continues to this day, of course, was eradicating Christianity from 0.98

00:05:47.920 American society. This is the goal of leftists everywhere. It's why Canada had the whole mass

00:05:52.640 graves hoax, which led very deliberately to a wave of church burnings. Christianity is incompatible 1.00

00:05:59.860 with communism because under communism, the government is the highest authority. When people 0.67

00:06:04.280 believe in God, they become much harder to control. Now, as part of this effort, the First

00:06:10.720 Amendment needed to be redefined, and to that end, a progressive Supreme Court justice named Hugo

00:06:15.680 Black wrote an opinion in 1947 that cited a letter written by Thomas Jefferson in 1802.

00:06:23.460 And in that letter, which he sent to a Baptist association in Connecticut, the Danbury Baptists,

00:06:28.840 as a courtesy. Jefferson wrote, quote, I contemplate with sovereign reverence that act of the whole

00:06:36.480 American people which declared that their legislature should make no law respecting an

00:06:40.900 establishment of religion or prohibiting the free exercise thereof, thus building a wall of

00:06:46.160 separation between church and state. Now, at the time, no one paid much attention to this letter.

00:06:54.240 it was seen as unremarkable. He was basically just restating the First Amendment. And again,

00:07:00.880 it was a courtesy letter, not a statement of policy or anything like that. He wasn't signing

00:07:05.960 an executive order or signing legislation. Jefferson certainly didn't intend to be

00:07:11.160 describing some grand new legal principle. But then Justice Hugo Black came along, and this was

00:07:19.040 more than a century later. And here's what he wrote in an opinion in a First Amendment case.

00:07:24.880 Quote, in the words of Jefferson, the clause against establishment of religion by law was

00:07:30.140 intended to erect a wall of separation between church and state. The First Amendment has erected

00:07:34.980 a wall between church and state. That wall must be kept high and impregnable. We could not approach

00:07:40.300 the slight, we could not approve the slightest breach. Yes, the separation of church and state

00:07:46.720 must be high and impregnable. Even the slightest breach in this wall must be prohibited by the

00:07:53.820 courts. So you could probably spot the sleight of hand here. In his letter, Jefferson was simply

00:07:59.800 saying, we have a First Amendment, which bans the government from establishing a state religion.

00:08:05.300 This is how he understood the wall of separation between church and state. It was a metaphor to

00:08:11.440 describe what was already in the language of the amendment. And he was, by the way, in that letter

00:08:18.100 more concerned about the effect of the government on religion than religion on government.

00:08:25.760 But by the 1940s, Hugo Black was interpreting the wall of separation as something very different.

00:08:30.900 He was presenting it as a much broader concept, as an absolute ban on any interaction whatsoever

00:08:37.740 between church and state. Instead of simply banning the government from establishing a state religion,

00:08:43.360 Hugo Black was interpreting the First Amendment as banning any relationship between religion and

00:08:48.340 government at all. This was a very strict prohibition in his view. Although I should note

00:08:54.260 that in this particular case, Black was hesitant to actually apply the principle. It wasn't until

00:08:58.600 a few years later that courts started to take the idea seriously. So within a few years,

00:09:02.500 things picked up in the 1960s, and the phrase separation of church and state

00:09:06.780 was suddenly everywhere. So take a look at this chart from Google's Engram, which

00:09:13.240 I think kind of illustrates it. It tracks all mentions of the phrase separation of church and

00:09:18.400 state in books and periodicals going back to the 1800s. And as you can see, pretty much no one was

00:09:25.440 using the phrase until about the 1960s. Very similar trajectory to the Trail of Tears, which

00:09:32.080 also became a household name very suddenly in the same decade. The effect on day-to-day American

00:09:38.820 life was immediate. This was not simply a semantic change. By convincing the public that the founders

00:09:44.060 wanted a total separation of church and state, the left was able to launch an all-out war on

00:09:48.560 Christianity in every aspect of society. In the span of just a few years, the Supreme Court banned

00:09:54.300 daily prayer in New York public schools, which were almost exclusively Christian prayers. The

00:09:59.040 court also struck down a law in Pennsylvania that required public school students to recite the

00:10:03.720 Lord's Prayer and read and read 10 Bible verses at the start of every school day. Kentucky and

00:10:09.080 every other state was banned from putting the Ten Commandments in public school classrooms.

00:10:13.220 The mere presence of the Ten Commandments, according to the Supreme Court, was an affront

00:10:16.460 on this brand new principle requiring the strict separation of church and state. Meanwhile, many

00:10:22.780 government buildings were banned from displaying nativity scenes or hanging banners that read

00:10:27.520 glory to God in the highest. Additionally, federal courts ruled a 43-foot Christian cross had to be

00:10:32.480 removed from a public park in San Diego. It had been on display for decades, but under this new

00:10:37.360 rule, which was made up on the spot, the cross was actually illegal now. And on top of that,

00:10:43.840 schools in Alabama and all over the country are banned from scheduling a short period of time

00:10:48.340 every day for students to engage in meditation or voluntary prayer on the theory that most of

00:10:53.880 the students would use the opportunity to say Christian prayers, God forbid. At graduation

00:10:59.240 ceremonies, members of the clergy were banned from leading the student body in prayer, and on and on

00:11:05.840 and on. These cases, and many more like them, have helped the left accomplish one of its primary

00:11:10.800 objectives, which is to eradicate Christianity specifically from public life. Now, conservative

00:11:19.620 judges realized what was happening, but by this point, they were outnumbered. Justice Rehnquist,

00:11:23.940 for example, wrote that, quote, the wall of separation between church and state is a metaphor

00:11:28.200 based upon bad history, a metaphor which has proved useless as a guide to judging. It should

00:11:34.860 be frankly and explicitly abandoned. But it wasn't abandoned. It became a de facto constitutional

00:11:42.060 amendment, even though the original language of the amendment was actually very clear. It's not

00:11:46.700 ambiguous at all. The only thing it was meant to prohibit is the legislature from establishing a

00:11:53.420 state religion. Anything outside of that is fine. If a public school teacher wants to say a prayer

00:12:01.840 or even put the Ten Commandments in the classroom, that is not the legislature establishing a state

00:12:08.520 religion. And so there's nothing in the language of the amendment that would prohibit that.

00:12:13.240 instead you have to introduce new language that was never in uh any governing document to begin

00:12:20.580 with now think about how remarkable this is for nearly 200 years everyone understood that america

00:12:27.900 was a christian nation no one interpreted the first amendment as banning displays of christianity

00:12:34.540 in public places no one thought it made sense to ban government buildings and schools from even

00:12:39.440 mentioning Christianity. The whole idea would have been absurd. The first Congress had a

00:12:44.320 congressional chaplain paid with taxpayer money to open legislative sessions with a prayer.

00:12:49.820 In presidential proclamations, George Washington and John Adams established national days of prayer

00:12:53.960 and Thanksgiving. The Northwest Ordinance of 1787, which was passed by the Confederation

00:12:58.360 Congress and then endorsed by the first Congress, stated that, quote, religion, morality, and

00:13:02.520 knowledge being necessary to good government and the happiness of mankind, schools and the means

00:13:06.980 of education shall forever be encouraged. Not to mention, most crucially, the entire philosophical

00:13:13.580 basis for the concept of human rights, which lies at the foundation of this country, is rooted

00:13:20.260 inextricably in Christianity. It is a religious concept. The whole idea is that our rights are

00:13:26.980 not given to us by the government, but are merely, or should be merely, recognized and codified by

00:13:33.120 the government. You know, the rights themselves exist apart from that recognition because they

00:13:38.220 are, as the Declaration of Independence says, endowed by the creator. If you remove the

00:13:43.960 creator from the equation, if you remove, in fact, the particular Christian conception of a creator

00:13:49.520 God, then there's no basis for human rights as any kind of existential reality. In other words,

00:13:57.760 religion is fundamental to the identity of our country and the functioning of our government

00:14:03.860 and schools should include religious instruction. This is how everybody understood the First

00:14:12.460 Amendment for many, many years and the practice of religion in the United States. This is how

00:14:17.540 it was understood. And then very abruptly, a handful of unelected judges completely rewrote

00:14:22.380 the Constitution. Did their rulings almost exclusively target Christians and displays

00:14:28.020 of Christianity? Yes. But the left-wing judges and the politicians and teachers and academics 0.94

00:14:33.560 and the media all assured us that Christians weren't being targeted specifically. Instead,

00:14:38.560 they claimed the judges were simply following the true meaning of the Constitution that no one had

00:14:42.940 seen for like a century, but they came along and saw it, and that's all it was. And they were just

00:14:47.780 trying to ensure that no religion received any kind of special treatment from the government

00:14:52.360 even though there's nothing in the first amendment that actually forbids a religion namely christianity

00:14:57.740 from receiving special treatment but that's all they wanted to make sure and they insisted they

00:15:01.880 would ply their strict standards impartially to prohibit any attempt to inject any religion

00:15:07.420 whether christianity or some other faith into public life and that was never actually their

00:15:13.180 intention as we'll discuss in a moment but we also need to acknowledge that as a practical matter

00:15:18.420 eliminating religion from public life is not possible. Anyway, it's contrary to human nature. 0.95
