Today on The Matt Walsh Show, starring best-selling children's author Matt Walsh, the Supreme Court.
00:00:04.600
Here's a case that very well could overturn Roe v. Wade during arguments.
00:00:08.960
Justice Sotomayor helpfully demonstrated the scientific and moral vacuousness of the pro-abortion side.
00:00:15.640
Also, my events at SLU went forward yesterday, despite the mob of protesters who stood outside blocking traffic.
00:00:22.720
I tried to go out and talk to them, but they weren't really interested in having a conversation.
00:00:25.700
And the Waukesha mass murderer complains that he's being demonized for plowing his car into a parade and killing six people.
00:00:33.540
Alec Baldwin makes himself the victim in his first interview since he shot and killed a woman on a movie set.
00:00:39.280
And Australia hunts down three teenagers who escaped a quarantine camp.
00:00:43.420
Finally, in our Daily Cancellation, we'll take a look at the worst Christmas comedy of all time, which was just released by HBO.
00:00:50.080
All of that and much more today on The Matt Walsh Show.

00:02:24.860
So we could very well be on the cusp of history, and for once, I mean that actually in a good way.
00:02:29.500
The Supreme Court yesterday heard arguments in the Dobbs v. Jackson Women's Health Organization case,
00:02:34.200
which stems from a law in Mississippi originally passed in 2018 banning abortions after 15 weeks.
00:02:41.760
Setting the marker at 15 weeks, of course, directly challenges intentionally the precedent set by the egregiously terrible and evil Roe decision in 1973,
00:02:49.840
which it's generally agreed requires that abortion be allowed up until viability, whatever exactly viability means.
00:02:58.500
Although the viability concept is ambiguous, most states say that the quote-unquote fetus is viable somewhere between 20 and 24 weeks, not 15 weeks.
00:03:08.420
But again, this whole way of speaking about human children doesn't make a lot of sense, first of all, and is already intentionally dehumanizing.
00:03:17.260
What does it mean to say that a human is viable or not viable?
00:03:23.120
What do you mean when you say that about a human being?
00:03:25.540
Most people would say that viable fetus means a baby who can survive outside the womb.
00:03:31.820
But that's a misnomer, and it also shouldn't matter.
00:03:37.500
All healthy humans can survive given the right environment.
00:03:41.780
Every single human being, because we're mortal creatures, we have certain environmental needs.
00:03:47.900
And if those environmental needs are met, we can survive.
00:03:52.240
For an unborn baby, the environment they require is a womb.
00:03:56.020
Those of us on the outside have different environmental requirements.
00:03:59.160
So in order for a baby in the womb to be viable,
00:04:02.020
it must be able to survive in an environment other than the one that it naturally needs to be in.
00:04:06.960
You might as well say that the only viable adult is the one who can survive on the moon or at the bottom of the sea.
00:04:15.000
Besides, even the viable babies, if they're born early, will be sent up to the NICU, like the twins were.
00:04:22.660
That's what happened with them, because they were born early.
00:04:27.900
and they're put in an environment meant to simulate a womb.
00:04:32.060
So a viable baby is one who is in a simulated womb instead of a natural one?
00:04:43.160
These are the sorts of issues they debated yesterday relating to the Dobbs case.
00:04:47.900
And the upshot is that potentially, as the Mississippi law flies directly in the face of Roe,
00:04:52.980
and rightly so, the justices could come up with an opinion that affirms the Mississippi law and overturns Roe.
00:04:58.700
So we could be living in the last days of Roe, thank God.
00:05:04.260
And the great thing is that even aside from whatever the decision ultimately is,
00:05:10.040
Roe has already been exposed due to how it was defended by the liberal justices yesterday.
00:05:15.980
There's a reason why the left would prefer not to debate this topic at all.
00:05:20.640
I mean, they want to talk about this topic, talk about it as in scream slogans in your face,
00:05:25.340
but they're not interested in a debate because when they debate it,
00:05:29.000
you end up with Justice Sotomayor, who humiliated herself repeatedly yesterday during the deliberations
00:05:34.420
and exposed the pro-abortion side for the vacuous, poisonous nonsense that it is.
00:05:40.120
Case in point, here she is claiming that unborn children are brain dead.
00:05:45.240
Virtually every state defines a brain death as death, yet the literature is filled with episodes
00:05:55.440
of people who are completely and utterly brain dreaded responding to stimuli.
00:06:03.460
There's about 40% of dead people who, if you touch their feet, the foot will recoil.
00:06:10.780
There are spontaneous acts by dead-brained people.
00:06:16.340
So I don't think that a response to, by a fetus, necessarily proves that there's a sensation of pain
00:06:33.780
Dead-brained people is how she describes a child in the womb.
00:06:39.080
The problem is that the word dead means literally no longer alive.
00:06:51.840
Death is the stage you enter into after your life is over.
00:06:57.400
If Sotomayor is suggesting that unborn children are dead from conception,
00:07:03.180
then, well, they cannot be dead because they were never alive, according to her.
00:07:06.960
By definition, a thing which has never been alive cannot be dead.
00:07:11.980
The point is that if she believes that the unborn child has never been alive,
00:07:15.520
then she cannot say that it's dead by definition.
00:07:20.000
This, of course, leaves her with the major problem of figuring out what sort of state a person can be in
00:07:27.280
Now we're in the realm of, I don't know, vampires and zombies, I suppose.
00:07:30.520
The other point is that if unborn children are dead, why do you need the abortion?
00:07:36.980
The abortion is procured precisely to cause the living child to become a dead child.
00:07:42.080
If he's already a dead child, what role does the abortionist play?
00:07:48.760
And by the way, how do we distinguish between like a miscarriage and a healthy child if they're all dead?
00:07:53.160
When a pregnant woman goes in for her appointments, you know, throughout the pregnancy to get sonograms
00:07:59.420
and check on the child, check on his health, what are they looking for?
00:08:03.240
How can they assess the health of a dead creature?
00:08:07.760
And yet this is a Supreme Court justice saying this.
00:08:11.600
Here's one other difference between an unborn child and a dead person.
00:08:19.080
Now, I can't believe I have to explain this to a Supreme Court justice, but I do.
00:08:21.740
So a dead person is always going to be dead, at least from a physical perspective in this life.
00:08:31.100
Dead people don't grow or develop into living people.
00:08:38.960
Yet whatever you think of the unborn child in the womb, there is no question that if he is healthy
00:08:43.680
and left alone in that environment, he will be born and become the sort of person
00:08:48.300
that even Justice Sotomayor would affirm as living.
00:08:51.740
Justice Sotomayor is a living person right now herself.
00:08:56.240
Despite all appearances, she is not technically brain dead, though maybe perhaps close to it.
00:09:01.740
And yet Justice Sotomayor was at one point an unborn child.
00:09:05.260
If I were to trace the chain of Sotomayor and follow her back in time, eventually I would
00:09:10.480
get to the point where Sotomayor was a baby in the womb.
00:09:14.000
So there's an unbroken chain of selfhood connecting the Sotomayor of today to the Sotomayor in the womb.
00:09:21.500
If she's a living person now, she must have been a living person then, because dead people don't become living people.
00:09:28.380
It makes no logical or scientific sense to say that any living person today was, at one point in their past, a dead person.
00:09:35.540
She also makes the claim that the unborn child isn't conscious.
00:09:41.180
Now, she can't actually know if that's true, of course.
00:09:43.040
We don't understand almost anything about consciousness, what it is, where it comes from.
00:09:46.480
And in any case, why should life and consciousness be conflated?
00:09:51.520
Who says that all living things must be conscious?
00:09:57.100
I mean, technically, we don't even know if non-living things are unconscious.
00:10:02.400
There's a whole branch of philosophy, I mean, a fringe branch, granted, and silly, but still,
00:10:07.500
called panpsychism, which claims that consciousness is a fundamental fact of reality,
00:10:12.040
and that all matter has some amount of consciousness.
00:10:16.140
Now, that, of course, is almost certainly not true.
00:10:17.840
My point is just that consciousness is a philosophical discussion, first of all.
00:10:23.580
Not something the Supreme Court needs to rule on, but also mysterious.
00:10:31.280
You can't use it to justify killing babies or anybody.
00:10:36.260
If consciousness is simply self-awareness, though, the awareness that you are a self,
00:10:41.100
the experience of being a self, if that's what consciousness is,
00:10:43.980
then perhaps the unborn child has not yet developed that capacity.
00:10:49.980
But then again, the infant outside of the womb doesn't have that capacity either.
00:10:55.260
Whatever the case, however much consciousness they do or don't have,
00:10:58.560
what we know for sure is that it's a temporary situation.
00:11:01.160
Humans grow in self-awareness as they get older and develop.
00:11:04.120
Are we saying that it's permissible to kill temporarily unconscious people?
00:11:07.760
Well, that ought to make you pretty uncomfortable when you go to sleep at night
00:11:11.500
and lapse into a state of temporary unconsciousness.
00:11:15.960
It's all absurd. It only gets worse from there.
00:11:17.880
Later, Sotomayor makes the claim that the pro-life position is entirely a religious position.
00:11:23.940
How is your interest anything but a religious view?
00:11:29.820
The issue of when life begins has been hotly debated by philosophers since the beginning of time.
00:11:41.540
So when you say this is the only right that takes away from the state the ability to protect a life,
00:12:15.620
I think there might be more than one question, and I'll do my very best, Justice Sotomayor.
00:12:19.660
I think this court in Gonzales pretty clearly recognized that before viability,
00:12:23.480
we are talking with unborn life with a human organism.
00:12:27.000
And I think the philosophical questions Your Honor mentioned,
00:12:29.980
all those reasons that they're hard, they've been debated, they're important,
00:12:33.900
those are all reasons to return this to the people,
00:12:36.360
because the people should get to debate these hard issues.
00:12:38.860
When does the life of a woman, and putting her at risk, enter the calculus?
00:12:46.660
Meaning, right now, forcing women who are poor, and that's 75% of the population,
00:12:55.380
and much higher percentage of those women in Mississippi,
00:13:04.080
they are put at a tremendously greater risk of medical complications and ending their life.
00:13:11.780
14 times greater to give birth to a child full term than it is to have an abortion before viability.
00:13:21.120
On second thought, she really is doing quite a lot to prove that a person can be alive but brain dead at the same time.
00:13:29.500
I mean, these arguments that she's putting forward are about as sophisticated as the kind of thing I read from leftists in my YouTube comments,
00:13:38.820
So, she's building a rhetorical castle of wrongness, brick by brick,
00:13:44.560
one wrong statement after another, on top of each other.
00:13:47.720
She says that the view that fetuses are living is religious.
00:13:54.240
The definition of life is literally the condition that distinguishes animals and plants from inorganic matter,
00:13:59.240
including the capacity for growth, reproduction, functional activity, and continual change preceding death.
00:14:11.200
Is it on the level of a rock or a chair or a clump of dirt?
00:14:18.640
And yet, if I go back far enough in my own timeline, in the timeline of my physical existence,
00:14:25.320
So, was there a time in my physical life when I was not living?
00:14:29.820
Was there a stage of my life in which I did not have life?
00:14:35.620
That's not only scientifically illiterate, but it's logically incomprehensible.
00:14:40.960
And besides, if the view that life begins in the womb is religious,
00:14:45.100
what about the view that life does not begin in the womb?
00:14:49.260
This is the bait and switch you always get from these people.
00:14:51.640
They claim that the abortion discussion is a religious discussion,
00:14:55.200
and yet, somehow, their own position within that discussion is not religious, somehow.
00:15:05.420
Which means that our assurance that it begins in the womb is a matter of faith, they say.
00:15:10.900
And yet, their assurance that it does not begin in the womb is not faith?
00:15:14.900
And anyway, if we don't know when life begins, right, because that's their way around this.
00:15:22.260
They're saying, no, I'm not taking a religious stance on this, but we don't know.
00:15:33.320
Okay, so, if we don't know when life begins, as she says,
00:15:37.300
isn't that all the more reason not to kill children in the womb?
00:15:41.560
She says, we don't know, but what that actually means is, I don't know, right?
00:15:49.140
She can't speak for what other people know or don't know.
00:15:55.380
And so, she admits that she doesn't know if life begins in the womb.
00:16:02.040
Even though there is, according to her, by her own confession,
00:16:07.760
So, she's willing to say, yeah, 60 million kids have been aborted since Roe v. Wade.
00:16:14.420
According to her, there's at least a chance that all 60 million were human beings
00:16:18.780
and that we have committed a genocide of 60 million babies.
00:16:25.620
So, isn't that like throwing a grenade into a dark room,
00:16:30.800
hoping and assuming the room is empty, but not knowing for sure?
00:16:33.580
If you kill someone in the process of doing that,
00:16:38.400
even if you didn't know there was someone in the room,
00:16:42.380
and you threw it anyway, are you guilty of murder?
00:16:47.960
See, it's the pro-abortion side which truly acts on faith here.
00:16:53.800
Roe v. Wade was a decision which imposed the leftist religious view
00:16:57.360
with abortion as its highest sacrament onto the entire nation.
00:17:08.700
just the demonic fury that will erupt from these people
00:17:15.420
And that is a spectacle that we will all get to witness very soon.
00:17:36.560
and that won't look like I came up with it at the last minute.
