00:03:02.440 An emotional hearing wrapping up in Austin, Texas, centering on the future of Camp Mystic,
00:03:08.320 a private Christian girls summer camp in the Texas Hill Country after a catastrophic flood
00:03:13.620 killed 27 campers and counselors, plus a co-owner there last summer. The three-day evidentiary
00:03:20.520 hearing stemming from a wrongful death lawsuit filed by the family of eight-year-old Cecilia
00:03:26.300 Seal Stewart, the only camper whose body has not been recovered. Seal's family asking a judge to
00:03:33.160 block the camp from rebuilding or reopening, arguing that key physical evidence, including
00:03:38.760 cabins, floodwater markings, and communication systems, must be preserved as the case moves
00:03:44.720 forward. Camp Mystic is planning to reopen in less than two months at a separate, higher-elevation
00:03:50.220 campground, with more than 800 girls set to attend. The hearing, focusing on what happened
00:03:56.100 in the early morning hours of July 4th, 2025, when intense overnight rainfall caused the
00:04:02.340 Guadalupe River to rise rapidly, sending floodwaters through the camp. Testimony this week
00:04:09.060 laying out the camp's emergency response, or lack thereof. Camp director Edward Eastland,
00:04:15.220 son of co-owner Richard Dick Eastland, disputing claims the camp lacked an evacuation plan
00:04:21.240 required under state law, but telling the court he was unable to locate or produce that plan.
00:04:27.760 Eastland testifying he and other staff were signed up for emergency alert systems,
00:04:32.520 but did not see warnings issued by the National Weather Service and Texas emergency officials.
00:04:38.520 Eastland also testifying that staff members did not use loudspeakers to tell campers to
00:04:43.800 evacuate their cabins to higher ground. The call to evacuate not coming until about 3 a.m.,
00:04:50.100 well after the flooding had begun. On Tuesday, Eastland questioned about what more he could
00:04:56.240 have done to save the campers. You failed her, did you not, Mr. Eastland? I wish we had more
00:05:03.360 information. All the information was there for your entire family to see and utilize if y'all
00:05:13.320 had just stayed awake and looked. Did you want a trooper to come knock on your door and tell you
00:05:20.060 to do your job? No, sir. What should the state have done? Should they have showed up and said,
00:05:25.580 Wake up. Go save these kids. 0.98
00:05:28.120 I think it should have been a more urgent alert. 0.87
00:05:32.560 Yesterday afternoon, Judge Maya Garagamble issuing a new order
00:05:36.280 keeping the property available to law enforcement for investigation,
00:05:40.160 blocking the flood-damaged site's use as a camp,
00:05:43.160 and ordering the structures remain unaltered, per the local Fox affiliate.
00:05:48.160 Camp Mystic currently facing five separate lawsuits,
00:05:50.940 the first one tentatively set to begin May 2027.
00:05:55.580 A group of Catholic nuns who run a palliative care home in Hawthorne, New York, dedicated to caring for poor cancer patients in their final days free of charge, now suing the state of New York over its LGBTQ long-term care facility residence bill of rights.
00:06:13.020 the Dominican Sisters of Hawthorne, operating Rosary Hill Home for more than a century,
00:06:19.040 a 42-bed facility where they say they provide care to all patients without discrimination
00:06:24.260 and regardless of race, religion, sex, or background.
00:06:27.740 The law, signed by Democratic Governor Kathy Hochul in 2023 and taking effect in 2024,
00:06:34.180 prohibits long-term care facilities from discriminating based on sexual orientation,
00:06:38.920 gender identity or expression, or HIV status.
00:06:43.020 The sisters say that the mandate requires them to assign rooms based on gender identity
00:06:48.080 rather than biological sex, allow access to bathrooms based on gender identity, use
00:06:54.240 patients' preferred pronouns, and require staff to undergo training aligned with the
00:06:59.500 state's standards.
00:07:00.240 The law also protects what it describes as a resident's right to associate with others,
00:07:05.960 including, quote, consensual expressions of intimacy or sexual relations, unless restrictions
00:07:11.720 are applied equally to all residents. Failure to comply could result in fines, loss of licensing,
00:07:19.100 and even jail time. Earlier this month, the Dominican sisters filing a federal lawsuit
00:07:24.780 arguing the law violates their First Amendment rights to religious freedom and free speech,
00:07:30.120 as well as equal protection under the 14th Amendment. The state declining to comment on
00:07:35.500 the pending litigation, but releasing a statement indicating it is, quote,
00:07:39.500 committed to following state law, which provides nursing home residents certain rights
00:07:44.760 protecting against discrimination, including, but not limited to, gender identity or expression.
00:07:51.240 We spoke with attorney L. Martin Nussbaum, who is representing the sisters. He tells us the
00:07:57.260 sisters first sought an exemption before filing suit. We wrote a five-page letter to the New York
00:08:04.120 Department of Health. We explained who the sisters were, what their Catholic values were.
00:08:09.740 We explained what the New York mandates required them to do, that that was squarely contrary to
00:08:15.600 their Catholic values. We pointed out to them that they've given a religious exemption already
00:08:20.420 to the Christian scientists and requested it as required by the federal constitution,
00:08:27.280 both the free speech clause and the free exercise clause.
00:08:32.040 And we heard nothing, no response.
00:08:34.300 We asked them to respond in 15 days.
00:08:36.580 We gave them three weeks before we filed,
00:08:40.420 and then we proceeded with filing the lawsuit,
00:08:43.140 and we've not heard a peep from them since.
00:08:45.980 Nassbaum says the state's decision to grant an exemption to Christian scientists,
00:08:50.800 while denying one to the sisters, only strengthens their case. 0.59
00:08:54.060 We have nothing against the Christian Science Church of Christ scientists, but for the state to give an exemption to that group means, one, they recognize that there's serious moral issues around this mandate and that they can accommodate those religious conscientious objection by the Christian scientists.
00:09:16.680 And the fact that they would not do that for similar Catholic groups, which have even more nursing homes and long-term care facilities, it's wrong and it's contrary to the Constitution of the United States.
00:09:29.960 Nussbaum describing the legal arguments underlying the sister's case.
00:09:34.320 When the state discriminates in favor of Christian scientists and against Catholics, that would squarely violate the Equal Protection Clause.
00:09:44.320 This mandate also requires certain types of speech by the sisters. 0.60
00:09:50.180 They have to train their employees, including their own nuns, in gender ideology.
00:09:55.680 They have to use certain speech that's false regarding pronouns. 0.95
00:10:00.780 They can't have a compelling interest to impose this mandate on the Catholics 0.86
00:10:05.540 when they don't impose it on the Christian scientists.
00:10:08.260 And most importantly, how the sisters do their ministry, they have a sacred calling to serve the indigent who are dying of cancer.
00:10:20.980 And that's ministry for them. It's the healing ministry of Christ.
00:10:24.520 And the government can't get in the business of dictating how nuns engage in such a ministry.
00:10:31.600 Nussbaum says the law presents catastrophic consequences for the sisters
00:10:35.540 if they do not violate their sincerely held religious beliefs.
00:10:39.020 The sanctions for violating this law create an existential threat to the sisters and their apostolate,
00:10:46.980 which is called Rosary Hill Home.
00:10:49.640 The government has the choice of imposing fines up to $5,000 per violation.
00:10:57.080 They can revoke the licenses of the staff, including the nuns who work, and people would
00:11:03.820 lose their ability to make a living, and they can revoke the license of the Rosary Hill
00:11:09.520 Home itself, which would stupidly shut down this ministry that's been doing this good
00:11:16.640 work for 125 years. 0.80
00:11:18.780 They could even send some of the leaders of the group to prison for up to one year.
00:11:24.440 It's breathtaking.
00:11:26.500 Coming up, the DOJ probing the NFL as its multi-billion dollar media machine faces widespread scrutiny over rising costs to watch the games.
00:11:37.140 And Katy Perry under investigation in Australia after actress Ruby Rose claims she was sexually assaulted by the pop star.
00:11:50.320 You've been hearing me talk about Pure Talk a lot lately.
00:11:53.180 Well, Pure Talk is veteran-led, so helping veterans is their North Star, first of all.
00:11:58.280 They've donated over half a million dollars to America's Warrior Partnership, a fantastic
00:12:02.980 organization that's on the front lines of preventing veteran suicide.
00:12:07.080 And Pure Talk's creating American jobs with a U.S.-only workforce.
00:12:10.980 Yes, it'd be a lot cheaper to send jobs overseas like other companies do, but they are committed
00:12:15.040 to delivering the best experience possible for their customers.
00:12:19.440 Pure Talk's service, they give you the same towers, same networks, same 5G coverage as one of the big guys, but for a fraction of the price.
00:12:27.040 Pure Talk supports veterans every single day and creates American jobs.
00:12:30.920 If you want to give it a shot, dial pound 250 and say Megan Kelly to switch at Pure Talk.
00:12:36.760 That's pound 250 and then just say Megan Kelly to switch to Pure Talk, America's wireless company.
00:12:44.120 Pure Talk. Check it out. 0.97
00:12:45.700 FCC Chair Brendan Carr weighing in on a new DOJ investigation into the NFL
00:12:53.480 over concerns the league's media deals may be driving up costs for fans and limiting competition.
00:13:00.760 Here's Carr Tuesday on CNBC.
00:13:03.260 I think long term there's been a great partnership between broadcasters and Sports League.
00:13:07.180 It's helped them to grow their fan base and that experience has become frustrating
00:13:11.220 for lots of Americans over the years.
00:13:12.980 They feel like they're paying more out of pocket.
00:13:14.320 they're having to sign up for different streaming services. There's been reports that DOJ is looking
00:13:18.600 at this from an antitrust perspective. There is a Sports Broadcasting Act, which gives NFL and
00:13:24.140 others a unique antitrust exemption. There's a question of whether are they extending beyond
00:13:28.720 the scope of that antitrust exemption if they move too many games behind a paywall.
00:13:34.280 The DOJ investigation first reported last week by the Wall Street Journal.
00:13:37.820 The exact scope of the probe currently unclear. The legal basis of the issue is the Sports
00:13:43.540 Broadcasting Act of 1961, which allows the NFL to combine the TV rights from all 32 teams
00:13:50.200 and negotiate as one seller, something most competing businesses are barred from doing
00:13:56.100 under antitrust law. That law written in an era when fans could watch games for free
00:14:01.140 on broadcast television. Today's media landscape looking much different, and its effect on NFL
00:14:07.140 broadcasting raising concern among consumers, regulators, and some lawmakers. The NFL now
00:14:14.160 offering exclusive game packages to streaming giants like Amazon, Netflix, and Peacock on top
00:14:21.020 of its traditional broadcast deals. As a result, dedicated football fans now need multiple streaming
00:14:27.440 subscriptions to watch all games, running about $1,000 per season, according to Republican Senator
00:14:33.700 Mike Lee of Utah, all while the media corporations stand to make a fortune. The agreements between
00:14:40.020 the NFL and streamers including Disney, Paramount, Fox Corporation, NBCUniversal, NFL Network,
00:14:46.200 Amazon, Google, and Netflix are expected to rake in more than $100 billion in sports rights fees
00:14:53.400 under their current contracts, according to the New York Post. The NFL pushing back on criticism,
00:14:58.760 calling its distribution model, quote, the most fan and broadcaster friendly in the entire sports
00:15:04.760 and entertainment industry, stating that over 87% of games air for free on broadcast, quote,
00:15:11.440 including 100% of games in the markets of the competing teams. Legal scholar Jonathan Turley
00:15:17.860 responding in a thread on X, quote, if you need any more proof of the NFL's contempt for its fans,
00:15:24.120 It can be found in its antitrust statement.
00:15:27.360 Roger Goodell and the NFL are about as popular as gum disease with fans.
00:15:32.280 They fleece fans continually as they make record profits.
00:15:37.580 Australian police now reportedly investigating pop star Katy Perry over sexual assault allegations made by actress Ruby Rose.
00:15:46.320 The Orange is the New Black actress earlier this week posting on the social media platform Threads, quote,
00:15:51.420 Katie Perry sexually assaulted me at Spice Market Nightclub in Melbourne.
00:15:56.640 Rose later elaborating on the alleged incident in a series of reply posts,
00:16:01.140 quote,
00:16:01.840 I was only in my early 20s. I'm now 40.
00:16:04.580 It has taken almost two decades to say this publicly.
00:16:07.840 Rose alleging that in 2010, at the now-closed nightclub,
00:16:11.440 Perry forced her private parts onto Rose's face without consent, causing Rose to vomit.
00:16:17.280 A former manager of the club telling Rolling Stone both women,
00:16:20.680 who arrived and left the club together that night, quote, had way too much to drink, but he was not aware of any assault that night.
00:16:27.860 The Melbourne Sexual Offenses and Child Abuse Investigation Team confirming Wednesday that an investigation into a historical incident is now underway, but declining further comment.
00:16:38.280 Perry denying the allegations through a spokesperson, quote,
00:16:41.500 The allegations are not only categorically false, they are dangerous, reckless lies.
00:16:47.320 Ms. Rose has a well-documented history of making serious public allegations on social
00:16:51.960 media against various individuals, claims that have repeatedly been denied by those
00:16:56.640 named.
00:16:57.620 Rose has previously made a range of allegations on social media, including claims of rape
00:17:02.840 by unnamed individuals and workplace misconduct tied to her time on the show Batwoman, all
00:17:08.760 of which have been denied.
00:17:12.440 That'll do it for your AM update.
