00:01:23.720 The National School Boards Association wrote a letter to the White House
00:01:26.840 complaining about loud parents whom they suggested might be treated as criminals and domestic terrorists
00:01:33.140 after many failed to comply with various protocols at school board meetings.
00:01:37.700 Parents understandably upset about CRT lesson plans shaming children for their race,
00:01:45.000 about radical trans ideology being shoved down the throats of children as young as single digits,
00:01:50.840 mask mandates everywhere despite the CDC's own comprehensive study of 90,000 children showing they do nothing,
00:01:58.940 vaccine mandates for children irrespective of medical risks,
00:02:03.040 X-rated books in school libraries that literally celebrate child rape, and on and on it goes.
00:02:10.260 So, yes, parents are especially concerned right now, and to their credit, they're voicing it.
00:02:16.040 Well, after that National School Boards Association letter, which we now know was coordinated in advance
00:02:22.500 with a White House that is clearly cognizant of the political damage these clips of angry parents
00:02:28.140 could do to the president and Democrats nationwide, the DOJ immediately set to work,
00:02:33.840 affirmatively declaring, without investigating at all, that, quote,
00:02:39.900 there has been a disturbing spike in harassment, intimidation, and threats of violence against school board administrators,
00:02:48.980 board members, teachers, and staff.
00:02:50.740 Yes, they are the victims here.
00:02:53.620 Attorney General Merrick Garland warned parents nationwide that he would, quote,
00:02:57.160 use the DOJ's authority and resources to discourage these threats,
00:03:01.780 identify them, and prosecute them when appropriate.
00:03:05.980 In other words, he'll sick the FBI on you if you get out of line.
00:03:09.600 That was October 4th.
00:03:11.380 Since then, outrage has spread across this country and across political lines.
00:03:16.640 A recent poll showed only 19% of Americans support the FBI monitoring and investigating parents in this way.
00:03:24.460 Some 57% oppose, including the vast majority of Republicans and 63% of independents.
00:03:30.740 Ultimately, school boards began bailing from the NSBA,
00:03:35.200 and the group was forced to apologize for its incendiary letter and withdraw it,
00:03:40.020 leading to demands that Attorney General Garland,
00:03:43.160 who again admitted that the DOJ's involvement was based on that NSBA letter, stand down.
00:03:48.980 Yesterday, he refused.
00:03:51.440 What does the National Security Division have to do with parents at school boards?
00:03:54.860 This is not, again, about parents at school boards.
00:03:58.020 This is about threats of violence.
00:03:59.940 Okay, let me turn to that, because you've said that phrase repeatedly throughout the morning.
00:04:04.620 Threats or violence and threats of violence.
00:04:07.160 Violence and threats of violence.
00:04:08.520 They said that they were facing violence and threats of violence,
00:04:11.460 and when I saw on the news media reports,
00:04:14.260 this memorandum is aimed at violence and threats of violence.

00:04:21.200 That's why he got involved.
00:04:23.020 First of all, this is a misrepresentation of what the NSBA alleged in its letter.
00:04:28.360 The NSBA cited 26 alleged problematic incidents that it said warranted the DOJ's attention,
00:04:34.460 the vast majority of which involved items like parents refusing to put masks on
00:04:38.940 or cede their microphones when ordered to do so,
00:04:41.780 not threats of violence, nor any incidents of actual violence,
00:04:45.600 as Mr. Garland now falsely claims.
00:04:48.240 The only real allegation of this kind had to do with what happened in Loudoun County, Virginia,
00:04:54.540 when the cops decided to arrest Scott Smith, a man we now know was upset because his superintendent
00:05:01.280 was there lying about there never having been a rape in a school bathroom
00:05:05.480 when Mr. Smith's ninth grade daughter had just been raped a week or two earlier,
00:05:09.680 a crime for which the defendant boy has now been convicted.
00:05:13.240 Other than that, there was one incident of alleged threats in Worthington, New York,
00:05:20.060 in which a letter sent to the board there said, quote,
00:05:23.120 we are coming after you and all the members of the board.
00:05:26.580 You all should be tried for treason, end quote.
00:05:30.380 This is not the stuff of federal law enforcement.
00:05:34.780 For one thing, it's not illegal.
00:05:36.840 For another, it is not within the jurisdiction of the Department of Justice.
00:05:40.360 As Merrick Garland well knows, the DOJ cannot investigate or prosecute parents for alleged
00:05:46.480 threats, threats of violence, or as he claimed in his October 4th letter, quote,
00:05:53.040 efforts to intimidate individuals based on their point of view, are free speech, protected
00:05:59.800 by the Constitution.
00:06:00.660 Incitement is speech that law enforcement can potentially attack as unlawful, but the bar
00:06:08.780 for that is extremely high.
00:06:12.580 In America, you are allowed to say things like, I could kill you, or you should be afraid,
00:06:18.380 or we are coming after you.
00:06:20.860 The law recognizes that in the vast majority of those cases, those are expressions of upset
00:06:26.880 that are not legally actionable.
00:06:30.220 In order to cross a legal line, the speech must, one, unambiguously, two, call for the
00:06:38.220 use of force, three, that the speaker clearly intends, four, under circumstances in which the
00:06:45.860 likelihood of violence is both real and imminent.
00:06:50.680 Not even arguably the case here.
00:06:55.580 And there's no allegation that any of these alleged threats were ever acted upon.
00:07:01.440 Same goes for Garland's other focus in his statement, efforts to intimidate someone's
00:07:06.520 point of view.
00:07:07.660 By the way, that's what he's doing.
00:07:09.980 That's protected by the First Amendment as well.
00:07:12.640 Even if any of the examples at issue here rose to the level of, quote, incitement, the DOJ
00:07:18.640 would have no business inserting itself.
00:07:20.640 None.
00:07:21.680 The feds have no general police power.
00:07:24.060 That is left to the states and local authorities.
00:07:27.160 Even an actual attack on a school board member or a parent at a meeting would be handled by
00:07:32.440 the local cops, not the FBI.
00:07:35.260 That is what happened in Loudoun County, though Scott Smith did nothing wrong.
00:07:39.500 Former prosecutor Andy McCarthy recently had a column in National Review outlining all of
00:07:45.000 this and pointing out that this is an incredibly politicized DOJ, just like the one under the
00:07:51.280 Obama-Biden administration, which is Andy Nodes, quote, made the process the penalty.
00:07:57.660 The investigation process, coupled with the threat of federal criminality, you're going
00:08:02.280 to have the FBI in your business.
00:08:04.140 That's the deterrent.
00:08:06.200 How the case comes out is irrelevant.
00:08:07.940 They did it with the IRS scandal, threatening conservative groups with the loss of their
00:08:13.420 tax-exempt status, with the threatened takeovers of police departments that Ben A.G.
00:08:18.540 Eric Holder deemed problematic, with the Dear Colleague letter they used to scare universities
00:08:24.360 into eliminating due process for young men accused of sexual assault, and on and on.
00:08:30.700 The end result is to silence and control those who could undermine this president's agenda.
00:08:36.780 And that is why Merrick Garland is standing by his threats of investigation and prosecution.
00:08:43.960 He doesn't want to punish lawbreakers.
00:08:46.500 He and his pals at the White House want to stop the debate altogether.

00:09:00.460 It was incredibly outrageous and disingenuous of that A.G. yesterday to keep looking at those
00:09:06.240 lawmakers and act like this is about the violence and threats of violence that these school board
00:09:12.160 members are receiving.
00:09:13.880 Totally untrue and unfounded.
00:09:16.800 This is thuggish behavior.
00:09:19.000 This is mob behavior.
00:09:20.500 Merrick Garland is like a meek, mild-mannered, diminutive Al Capone in the way that he's speaking.
00:09:26.820 One, there's the corruption.
00:09:28.900 The corruption is that Merrick Garland's son-in-law runs a company that peddles critical race theory
00:09:34.120 in school.
00:09:34.740 So there's a huge conflict of interest here.
00:09:36.880 Senator Cruz absolutely nailed Garland on this point.
00:09:40.040 He said, did you ask for an ethics opinion?
00:09:42.140 You clearly have a conflict of interest.
00:09:44.080 Garland refused to answer the question because he knows that Cruz had him dead to rights.
00:09:48.560 But then even more thuggish, you have the only threat, the only real threat in this entire
00:09:54.500 scenario is the threat coming from the DOJ.
00:09:57.300 And the threat is, if you speak out in any way, if you question the radical racial and
00:10:03.940 sexual theories that are being peddled in these schools, we're going to come after you.
00:10:07.840 Just as you said, Megan, the FBI is going to come knock on your door.
00:10:11.440 The DOJ is going to call you a domestic terrorist.
00:10:14.460 And so this is now beyond the scope of politics.
00:10:17.160 It's actually the difference between political debate and what is sometimes called the regime,
00:10:23.540 the things that are off limits.
00:10:25.660 Sure, we can debate raising taxes or lowering taxes, right?
00:10:30.140 That's up for arms.
00:10:31.220 But we are not permitted any longer to debate the radical racial and sexual theories in schools.
00:10:37.240 And if you do, the DOJ is going to investigate you and possibly prosecute you.
00:10:41.240 Yes, the White House has weaponized the DOJ against parents who have every right to speak
00:10:48.760 out about what is being done to their children.
00:10:52.140 It's outrageous.
00:10:53.760 And let's just spend a minute on the conflict of interest that Merrick Garland has in this.
00:10:58.120 So his son-in-law, the man married to Merrick Garland's daughter, has a company that pushes
00:11:04.420 CRT in schools.
00:11:06.420 Our research says his company made $27 million last year doing exactly this, getting CRT programs
00:11:15.140 shoved into these schools.
00:11:16.580 That, folks, importantly, is very much part of what those parents are complaining about
00:11:22.580 and are arguing about, and all those incendiary clips that Merrick Garland is so upset about.
00:11:28.280 So it's very much an issue here.
00:11:30.440 Ted Cruz, as you point out, goes after Merrick Garland, pushing him on, did you run that by
00:11:35.840 the ethics group within the DOJ?
00:11:38.480 Did you have somebody advise you on this before you decided to start threatening those parents
00:11:44.240 speaking out about programs like your son's?
00:11:47.540 Here's that exchange.

00:12:33.620 What's happened is you've threatened the parents who are objecting to the programs your son-in-law
00:12:39.220 is making millions off of.
00:12:41.460 It absolutely does have to do with that.
00:12:44.340 And let me just tell you, Michael, because I looked it up.
00:12:46.520 I went and actually looked up the ethics requirements.
00:12:49.880 And I didn't even look at the ones for a judge, which he is.
00:12:51.900 So now he's AG.
00:12:52.800 So we'll go with that.
00:12:53.540 At the Department of Justice, every employee of the DOJ, including Merrick Garland, one,
00:12:58.940 shall endeavor to avoid any actions or creating the appearance that they are violating the
00:13:07.100 ethical standards set forth in this section.
00:13:11.180 OK, you can't even have the appearance that you're violating one of the ethical standards
00:13:15.380 here.
00:13:15.880 And here is one of the many ethical standards that applies to him under misuse of official
00:13:20.600 position.
00:13:21.040 You may not use your public office for the gain of persons with which you are associated
00:13:29.360 personally.
00:13:31.100 So if there is even an appearance that that Merrick Garland letter threatening parents
00:13:36.640 was potentially advantageous financially to his son, not only did he need an ethics opinion,
00:13:43.000 he knew right off the bat he shouldn't do it.
00:13:45.540 He had no business doing it.
00:13:47.120 The fact that not more is being made out of this by the mainstream press is yet another
00:13:51.980 disgrace.
00:13:52.880 Well, after that exchange, I was tempted to call the DOJ myself to report a murder because
00:13:57.640 I think Senator Cruz absolutely nailed him.
00:14:00.640 And you can tell Merrick Garland is a pretty clever politician because he won't answer the
00:14:04.740 question.
00:14:05.320 It's a very simple question.
00:14:06.680 Senator Cruz was not asking him, is this an ethics violation?
00:14:09.760 Do you think this rises to that?
00:14:11.220 The question was simply, did you ask for an opinion or not?
00:14:14.600 And Garland didn't do it.
00:14:16.140 He certainly should have, but that's beside the point.
00:14:18.260 He didn't do it and he doesn't want to give him the answer.
00:14:20.580 As you point out quite aptly, Megan, this is not some small little company.
00:14:25.840 It's not some mom and pop shop that the mom and pop CRT shop that is going into one or
00:14:30.640 two schools.
00:14:31.280 This is a company that's bringing in tens of millions of dollars.
00:14:35.000 So this kind of national policy is going to have an effect on the company.
00:14:40.200 But then the layers of deception go even deeper because I don't know about you, Megan, I'm
00:14:45.160 old enough to remember, oh, two months ago when the left in this country and the elected
00:14:52.040 Democrat officials told us that critical race theory is not being taught in schools.
00:14:56.620 Do you remember that?
00:14:57.700 Critical race theory is simply being taught in certain law schools.
00:15:01.740 It has nothing to do with K through 12.
00:15:03.880 You people are delusional.
00:15:05.080 Now what we're being told is critical race theory absolutely is being taught in schools
00:15:09.240 and it's a very good thing.
00:15:10.920 And actually the government should enforce it and stop people from questioning that being
00:15:15.140 taught in schools.
00:15:16.040 So it's a complete moving of the goalposts.
00:15:18.900 I think that Republicans are right over and conservatives and even just ordinary moderate
00:15:23.520 people are right over the target here.
00:15:25.580 They're sick of it.

00:15:27.000 And the left is getting desperate.
00:15:29.140 The entire basis for Merrick Garland injecting himself into this situation has evaporated.
00:15:35.380 The school boards group is falling apart day by day.
00:15:39.060 More and more school boards across the country are withdrawing from this group for getting
00:15:42.300 so overtly political.
00:15:43.940 And you can see in that poll the reason why 57 percent of Americans are against this.
00:15:48.260 They don't want the DOJ or the FBI investigating parents who are upset for understandable reasons.
00:15:53.800 And so the school board association letter has fallen apart.
00:15:57.100 They've withdrawn withdrawn it.

00:15:59.720 And yet that was the basis for Merrick Garland getting involved.

00:16:07.740 Yesterday when questioned, Merrick Garland said, well, I was responding not just to the
00:16:13.560 letter, but public reports of violence and threats of violence.

00:16:35.660 So I read the letter and we have been seeing over time threats.

00:16:46.380 And then his addendum was and the newspapers, the news.
00:16:50.540 So when he says yesterday, oh, public report, also public reports of violence, he's talking

00:17:00.080 Because you would think that the National School Board Association would have the best

00:17:05.400 And I already walked the audience through the fact that of the 20 plus examples in there,
00:17:09.860 the vast majority were about people not wearing masks or seating their mics.
00:17:14.200 There was one, one alleged incidence of violence.
00:17:17.520 It involves Scott Smith.
00:17:18.960 He got arrested because when a woman questioned whether his daughter was in fact raped, he called
00:17:24.360 her a bitch and then the police put their hands on him in a scuffle between Smith and
00:17:28.700 the police ensued.
00:17:29.960 That's the only alleged violence.
00:17:32.400 Merrick Garland is making this up.
00:17:35.220 Of course.
00:17:36.120 And by the way, if if Scott Smith were brought to trial for this, if he were put in front
00:17:40.960 of a jury and the jury were told what happened, what led up to that incident, not a jury in
00:17:47.040 the land would convict him because the real story here and it's another story that Merrick
00:17:51.060 Garland doesn't want to talk about.
00:17:52.780 And it's a story coincidentally that the Daily Wire happened to break because the mainstream
00:17:56.280 media didn't didn't want to investigate it is that this girl was raped by a man who wears
00:18:03.360 girls clothing in the girls bathroom and the school covered it up and they covered it up
00:18:08.020 because it raises questions about their radical transgender policy questions that now parents
00:18:13.140 not just in Loudoun County, but around the country are asking.
00:18:16.460 In the case of Scott Smith, he had this horrible personal experience with his own daughter, but
00:18:21.760 parents around the country are absolutely right to question this.
00:18:25.660 And what we are what we're seeing play out in real time is a cover up.
00:18:29.420 One new piece of information on that and two thoughts.
00:18:31.860 They are now reporting.
00:18:33.920 I think it was in The Washington Post that this young rape victim was assaulted by a boy she
00:18:41.400 knew and that she, according to The Washington Post, had voluntarily met up with in the bathroom
00:18:46.580 two times prior for some sort of fooling around.
00:18:49.280 The third time is when they met.
00:18:52.140 She didn't wish to fool around and he did forcibly rape her as he's now been found guilty of doing
00:18:57.520 people.
00:18:58.360 It's disgusting to me because now you've got some in the left wing press trying to diminish
00:19:02.340 this claim of rape because two times prior she had been with him voluntarily.

00:19:07.480 That's not how it works, as the left damn well knows.
00:19:10.560 Number two, they're sort of saying, well, the fact that he had a skirt on is irrelevant
00:19:14.880 since she had met him voluntarily twice before and he was her boyfriend.
00:19:18.740 That's it's not about whether this kid's transgender or not.
00:19:21.540 It's about why did he put the skirt on as far?
00:19:24.600 It could be because he didn't want anybody to bother him when he was going into the girls
00:19:27.600 room for this intro.

00:19:29.860 But the point is not really so much about whether trans people are going into the bathroom
00:19:34.340 or not.
00:19:36.000 The point is that there had been a rape inside of the school bathroom two weeks earlier,
00:19:39.740 and this superintendent stood up and told everyone not to worry about the transgender
00:19:44.320 policy because these bathrooms are safe and they're not.
00:19:48.140 A rape had just been committed by a guy wearing a skirt.
00:19:50.640 I don't really give a damn what his motivation was.
00:19:52.760 And he went on to rape again, according to the authorities.
00:19:55.480 The refusal to acknowledge facts and to downplay the genuine concerns of parents in these circumstances,
00:20:04.180 Michael, I think is what's driving things like the now dead heat between McAuliffe and
00:20:08.120 Youngkin in Virginia.
00:20:09.940 Yes.
00:20:10.320 Well, I think that you've hit on it.
00:20:11.840 This is the really important part of the story, which is not whether the kid is transgender
00:20:15.860 or whatever crazy gender he thinks that he is.
00:20:18.600 It's about the schools protecting the transgender policy.
00:20:22.340 So right now, the media are actually victim blaming because they're saying because this
00:20:27.300 girl had had a relationship with this guy before and she explicitly said, I do not want
00:20:31.620 to perform this particular act.
00:20:33.000 I don't want to do this.
00:20:33.960 And then he violently raped her.
00:20:35.580 They're saying, oh, well, basically she was asking for it.
00:20:37.940 But the schools here, regardless of the motivations for the incident or even the particulars
00:20:42.780 of it, why do you think the schools covered it up?
00:20:45.020 Obviously, they're covering it up because there's this controversial policy and the action has
00:20:50.720 a certain association with that policy.
00:20:53.380 And it might throw the gubernatorial race in Virginia.
00:20:56.520 You're 100 percent right.
00:20:57.940 That's the reason that they covered it up, because this policy was under debate and their
00:21:02.940 sort of woke ideology didn't want them, didn't allow them to offer any facts that might be
00:21:08.900 used by the other side.
00:21:10.720 That's how they see this.
00:21:11.780 They're not thinking about the rights of children, young girls to be safe.
00:21:16.380 And this guy was a predator because he went on to the very next school and did it again,
00:21:20.640 according to the authorities there.
00:21:22.380 And by the way, they didn't tell the new school that he had just been arrested for doing this
00:21:28.200 to a girl in his previous school.
00:21:29.700 So parents' rights are out the window, as are children's rights.
00:21:33.320 And by the way, now, today, there's a report about a woman seeing a Homeland Security vehicle
00:21:41.980 and officials out in front of her school.
00:21:44.100 So Merrick Garland means what he says.
00:21:46.160 The feds are not backing off.
00:21:47.880 We're going to pick it up there and also get into the latest COVID madness.
00:21:52.620 Now your kid, as young as five, has said, you know, he can get a vaccination, right?
00:21:57.980 But already we're seeing reports of schools mandating it.

00:26:16.620 And the whole point of liberal education is to tamp that down and become a free person.

00:26:51.780 So I think what we need to do is go back in there and reimpose some standards.

00:26:58.760 They're saying, hold on, you're telling me I'm going to send my kid to an institution for
00:27:02.100 eight hours a day for, what, 12, 13 years, more than that now, because there's pre-K and

00:27:09.320 So you're telling me I've got to send my kid to your institution for most of his life.
00:27:13.860 And I don't have any say in what he learns there, the way he's brought up spiritually,
00:27:18.860 physically, intellectually, and all of the above.

00:27:22.020 If parents don't have the right to educate their kids, then they don't have any parental

00:27:26.580 So you've got, as we mentioned before the break, this very fight leading to a dead heat
00:27:33.200 in the Virginia gubernatorial race, which is now being seen as potential bellwether on
00:27:38.460 where our politics are as a nation.

00:27:42.000 This should be an easy win for the Democrat McAuliffe, who's already been governor of Virginia.

00:32:06.060 There was one issue that Joe Biden was holding on to, and that was covid.

00:32:13.540 So they're completely bereft of ideas.

00:39:26.380 An FDA panel of 17 people has unanimously advised the FDA to recommend that they regulate or that
00:39:34.740 they authorize the Pfizer vaccine for five to 11 year olds.
00:39:38.360 So it hasn't officially been authorized even on an emergency use basis yet, but it's coming.

00:39:46.580 So it's basically just as soon as they do it.
00:39:49.060 And that's where my friends were picking up their schools in New York already sending out
00:39:53.820 notices saying as soon as the FDA gives us a thumbs up, it's mandatory and you have no choice.

00:40:06.800 I mean, you can't raise a medical or religious exemption, you know, objection to sticking

00:40:21.260 I'm not anti-vax at all.

00:40:23.200 It's not just people like me who are questioning the mandates.
00:40:26.220 It's even people who have been pushing mandates when it comes to adults.

00:42:04.640 But there are plenty of good reasons to avoid it as well.

00:43:30.680 or death from the virus in kids, is there any risk in taking the vaccine?
00:43:35.180 And although this FDA panel voted unanimously to approve the vaccine for kids, one of the
00:43:41.380 members of the panel came out when asked about the safety of it, and he said the only way
00:43:45.540 to know if it's safe is to test it on the kids.

00:44:56.900 And in the face of that, it's quite clear that Harvey Risha's advice from Yale is pretty
00:45:02.660 good advice, that you really shouldn't give in to this sort of thing.

00:49:17.300 association has withdrawn its letter because you wrote a beautiful column recently about
00:49:25.040 the dangers here and how, as the DOJ continues to crack down, parents are scared.
00:49:32.420 You know, a lot of them, we should we highlight the ones who speak up, but a lot of them are
00:49:35.460 scared and it's getting harder and harder for parents to find the temerity to do it.
00:49:40.540 I mean, who wants to face a federal investigation?

00:49:46.300 And you write, this is how it begins in part.
00:49:50.960 The lanky man in Norman Rockwell's painting, Freedom of Speech, was produced in 1943 and

00:50:01.920 Others might get that Norman Rockwell feeling, that craving for the glow of nostalgia that
00:50:06.540 encourages people to crave for what they think were simpler times.

00:50:15.600 And you went on to say, in the midst of all of this, all the chaos and the turmoil at that

00:50:34.020 We welcomed Americans speaking their minds, even protesting without dropping the federal

00:50:59.780 So what was important to you about her situation and the country's situation behind this column?
00:51:06.080 Liberty, liberty, freedom, the ability to advocate for your own children with government now occupied
00:51:17.300 by the left, reaching ever increasingly into our lives and into the lives of our children.

00:51:35.000 And I found her comments to be heroic and moving.
