00:00:29.240 You'll find it there.
00:00:32.820 Good morning, everyone.
00:00:34.120 I'm Megyn Kelly.
00:00:34.860 It's Wednesday, September 30th, 2026, and this is your AM update.
00:00:39.820 You use your ability and the powers of your office to lie to the court, to lie to Congress,
00:00:46.460 to lie to the American people.
00:00:48.080 Former special counsel Jack Smith back on Capitol Hill facing hours of grilling over
00:00:53.060 how deeply his investigations into President Trump intruded into Congress, Republican groups,
00:00:59.060 and even the media. You'll now have one front door for every single question. Everything will
00:01:05.080 be answered easily and quickly. President Trump putting artificial intelligence front and center
00:01:10.200 yesterday, launching a new government website and meeting with tech leaders. A New York Times
00:01:16.060 executive in the middle of an ugly custody battle gunned down in broad daylight. Police say the
00:01:21.920 Suspected killers are the victim's elderly in-laws and remnants of a hurricane that hit
00:01:27.760 Mexico Monday night, now threatening to dump months worth of rain on parts of Southern Colorado
00:01:33.080 as the flood risk spreads into Oklahoma and Texas.
00:01:37.260 All that and more coming up in just a moment on your AM Update.

00:02:24.940 exchange window if the fit is not right and everything is backed by a warranty.

00:02:42.400 And if you see a post-purchase survey, please be sure to mention that you heard about Cozy
00:02:46.360 Earth right here.
00:02:47.400 A fiery hearing on Capitol Hill yesterday, former special counsel Jack Smith taking hours of pointed
00:02:55.380 questioning over his investigations of President Trump. Smith is the Biden-era prosecutor who brought
00:03:01.120 two federal cases against then-former President Trump, one over the 2020 election and its
00:03:06.860 aftermath, the other over classified documents at Mar-a-Lago, neither ever reaching trial.
00:03:13.180 Smith dropping the election case after Mr. Trump won in 2024, while Judge Aileen Cannon had already
00:03:19.300 dismissed the documents case after ruling Smith had been unlawfully appointed. Now Republicans
00:03:25.500 examining how far Smith's investigation reached beyond the president himself. Senate Judiciary
00:03:31.160 Chairman Chuck Grassley used the hearing to lay out newly released records showing Smith's team
00:03:36.340 obtaining and reviewing text messages involving 44 members of Congress, Republicans, and Democrats
00:03:42.440 while collecting communications from 87 phones used by officials in the first Trump White House.
00:03:49.200 Senator Grassley also releasing 197 subpoenas issued by Smith's team,
00:03:54.400 seeking testimony, communications, and records tied to more than 430 Republican individuals
00:04:00.220 and organizations. Those records also sweeping up communications involving nearly 50 journalists
00:04:06.900 at more than a dozen news organizations,
00:04:09.800 including Fox News, CNN, CBS, NBC,
00:04:13.020 The Wall Street Journal, The Washington Post,
00:04:15.200 Reuters, The Federalist, and the Associated Press.
00:04:18.700 Smith rejecting Republicans' accusation
00:04:20.860 that any of it amounted to political targeting,
00:04:24.400 the former special counsel telling senators
00:04:26.220 he still stands behind both prosecutions,
00:04:28.880 insisting politics played no role in his decisions
00:04:31.660 and saying he would bring the same cases today
00:04:34.280 against a former president of either party.
00:04:36.900 The sharpest fight centering on those congressional phone records.
00:04:41.260 Smith arguing his team was not investigating the lawmakers themselves,
00:04:45.220 but trying to establish who President Trump and those whom prosecutors considered his co-conspirators
00:04:50.960 were contacting around January 6th.
00:04:54.300 Republican Senator John Kennedy of Louisiana challenging Smith.
00:04:58.420 You saw just the records of the Republicans.
00:05:02.080 And you knew that violated the speech and debate cause, didn't you?
00:05:06.320 That is incorrect. We sought to comply with that.
00:05:09.540 Did you take con law?
00:05:11.120 I'm sorry, Senator.
00:05:12.240 Were you in the quad playing frisbee during con law at Harvard Law School?
00:05:19.100 I did take constitutional law, yes.
00:05:21.320 Well, then you had to know it violated the speech and debate clause.
00:05:24.520 In fact, when you went to Judge Boasberg, you didn't even tell him you were seeking the phone records of members of Congress, did you?
00:05:33.820 Because you knew he wouldn't agree.
00:05:35.480 He would say, hey, counselor, anybody who knows a law book from a J.Crew catalog knows that this violates the Constitution.
00:05:44.800 But you didn't tell him, did you?
00:05:47.100 We sought nondisclosure orders from the court.
00:05:49.900 You didn't tell him, did you?
00:05:51.620 In seeking nondisclosure orders, we did not disclose.
00:05:54.200 You didn't tell him, but you're unbiased.
00:05:56.460 You have no personal feelings.
00:05:59.820 You make me want to throw up in my mouth.
00:06:02.200 Then came one of the morning's more embarrassing moments.
00:06:04.940 Republican Senator Eric Schmidt of Missouri confronting Smith over what he suggested was
00:06:09.920 evidence placing the special counsel in Atlanta in February of 2024, at the time Fulton County
00:06:16.480 DA Fannie Willis was separately prosecuting Mr. Trump. Did you go to an NBA game between the
00:06:22.480 Golden State Warriors and the Atlanta Hawks on February 3rd, 2024? What city would that be in?
00:06:28.260 Atlanta. No. So your testimony today is that you did not go to a Hawks game on February 3rd,
00:06:34.820 2024. Is that correct? I have no recollection. Okay. Did you ever meet Nathan Wade or Fannie
00:06:40.560 Willis in your time in your time at special counsel? No. What would you say if I had a
00:06:45.440 series of text messages from your team that said you were in Atlanta at a Warrior Hawks game on
00:06:50.760 February 3rd, 2024, the day after Willis and Wade announced their affair? I don't think you know
00:06:55.880 that we have this stuff. So I'll give you a second to process it so you don't, you know, perjure
00:07:00.780 yourself. You just took it down really quick. If I could look at that again. Democrat Senator Amy
00:07:06.380 Klobuchar of Minnesota then jumping in. We need a copy of the actual text. Can you give the witness
00:07:15.880 the courtesy of giving him a copy of that? Mr. Smith, please address it. Just very briefly. And
00:07:21.160 if this is the correct basketball game, I recall going to a University of Maryland basketball game
00:07:28.840 where Kaitlin Clark was playing right around that time,
00:07:32.600 and the marshal service was there with me.
00:07:34.680 You could check if that was the exact date.
00:07:36.840 It was Maryland playing Iowa, I think, February of 2024.
00:07:42.320 But again, you could check that out if that's what we're talking about.
00:07:46.400 Could it then be that University of Iowa's the Hawkeyes?
00:07:50.040 Could that be it?
00:07:50.760 If he was at an Iowa game, is that correct?
00:07:53.600 It was because Kaitlin Clark was coming to Maryland to play.
00:07:56.600 I know, but that might be the confusion over the names of the team, but perhaps you should
00:08:02.640 have looked at it more carefully. Klobuchar adding on X later, glad one of us knew the
00:08:08.020 difference between the Atlanta Hawks and the Iowa Hawkeyes. Yes, if only that same one of you knew
00:08:14.120 the difference between a man and a woman when it comes to sports. But the truth is, while Eric
00:08:19.300 Schmidt has reliably stood up for girls and women's rights against the trans lobby, Amy Klobuchar
00:08:24.960 has made clear she's fine with boys co-opting girl sports in Minnesota. Save your sanctimony,
00:08:31.280 madam. One confrontation on the Hill turning personal. Republican Senator Darlene Graham of
00:08:36.600 South Carolina pressing Smith over investigators obtaining the phone records of her late brother,
00:08:41.880 Senator Lindsey Graham, and questioning how his office justified keeping the subpoena secret.
00:08:47.940 Mr. Smith, do you really believe that Lindsey was going to destroy evidence that was not even
00:08:54.400 in his possession? No. I believe your brother was a patriotic public servant. Then why does the
00:09:01.800 gag order say that disclosure of the subpoena would result in destruction of or tampering with
00:09:08.220 evidence? Because disclosure of that subpoena could result in Donald Trump attempting to
00:09:14.660 intimidate witnesses as he had before and after. We had an ample basis for that. The evidence in
00:09:20.900 question belonged to Lindsey and was in the possession of Verizon. It makes absolutely no
00:09:28.080 sense that anyone would be able to destroy the evidence you are seeking. Do you know what I
00:09:35.980 think? I think you're just trying to bully my brother and other allies of President Trump.
00:09:42.440 You caused my brother and a lot of other senators a lot of stress, and that makes me sick.
00:09:49.600 Kalshi putting the chance of Jack Smith actually being charged with a federal crime this year at
00:09:54.520 16%. Give Kalshi, our sponsor, a try by using code MEGANKELLY or by clicking the link in the
00:10:01.640 description. All new users get $25 free when they trade $25. President Trump devoting much
00:10:09.460 of yesterday to artificial intelligence, launching a new government website, and sitting down at the
00:10:14.880 White House with some of the biggest names in tech. The day beginning with the unveiling of
00:10:19.420 America.gov, an AI-powered portal designed to become a single front door for Americans
00:10:24.860 trying to navigate federal government services. Mr. Trump describing it this way.
00:10:30.200 For our entire lives, we've become used to a government so big it makes the citizen feel very,
00:10:37.160 very small. Instead of forcing citizens to search through the endless maze of tens of thousands of
00:10:44.420 terrible government websites and rules and more than 10,000 forms. You have over 10,000 forms to
00:10:50.960 do basic acts. You'll now have one front door for every single question. Everything will be answered
00:10:57.700 easily and quickly. A digital home built around your time and your life. You'll save hours and
00:11:04.200 hours, many hours, hundreds of hours, perhaps a year. The administration planning to greatly
00:11:09.240 expand what Americans can actually do on the site next year. Airbnb co-founder and U.S.
00:11:14.960 Chief Design Officer Joe Jebbia saying that beginning in 2027, users are expected to be
00:11:20.860 able to complete forms and track applications for a number of services directly through America.gov.
00:11:27.060 Secretary of State Marco Rubio announcing Americans will also be able to use the site to apply for
00:11:32.140 their first U.S. passport, a major hassle which you cannot currently do online, beginning next year.
00:11:39.240 From there, the focus shifting from how the government uses AI to what Washington should
00:11:44.540 do about the companies building it. Mr. Trump and House Speaker Mike Johnson hosting a White House
00:11:49.540 lunch attended by a who's who of the tech industry. They were all there. The gathering
00:11:55.040 coming as some of the executives developing the most advanced AI systems are calling for
00:12:00.400 stronger safeguards. Somebody save us from ourselves. While the president has repeatedly
00:12:05.640 warned against regulations he believes could slow American development and allow China to catch up.
00:12:11.460 The closed-door discussion reportedly lasting more than two hours, the president making clear
00:12:15.960 he remains opposed to heavy-handed government regulation of the industry, President Trump
00:12:20.700 saying the discussion also focused on how much responsibility the companies themselves should
00:12:25.460 bear for policing the technology. Well, there's a belief that there should be tremendous self-regulation,
00:12:30.960 And we automatically have regulation with the Department of Justice, the FBI, all of that.
00:12:37.120 But the self-regulation is very important.
00:12:40.040 There's something else that was discussed, and that's local communities.
00:12:43.580 This is a group that loves local communities.
00:12:45.500 They love our country.
00:12:46.880 And they're going to work with local communities for the data centers in particular.
00:12:51.260 And they're going to work to make the community happy.
00:12:55.140 That might be supplying oil and gas.
00:12:58.740 It might be supplying education.
00:13:00.960 It may be helping teachers along financially, helping people along financially.
00:13:05.920 The executives agreeing to a voluntary framework calling for advanced AI systems to undergo
00:13:11.060 internal and outside review as lawmakers continue debating how much oversight the
00:13:16.320 rapidly developing tech actually needs. Later in the afternoon, President Trump and the tech
00:13:21.220 execs speaking with reporters outside the White House met a CEO Mark Zuckerberg describing the
00:13:27.020 safety framework. I think what we can all agree on is that the American public and our customers
00:13:32.820 want to know that what we're building is working in the way that we all intend. So we drafted a
00:13:37.640 set of principles and commitments around building robust internal controls and detecting if there
00:13:44.260 are any issues with the technology, coupled with multiple layers of auditing and controls,
00:13:51.340 starting with internal risk review, external auditors and evaluators,
00:13:56.460 and agreeing that we're going to have all of our boards of directors independently
00:13:59.900 review the reports that come from the auditors. I think these are good steps forward.
00:14:05.340 Anthropic co-founder Dario Amadei, one of the leading voices for an AI slowdown,
00:14:10.660 sounding cautiously optimistic. AI has incredible benefits. I've talked about the medical benefits
00:14:16.900 to the technology. As the president has said, you know, whoever wins AI wins. I think that's
00:14:22.280 very important. But I think the technology has very real risks. And, you know, the mechanism,
00:14:28.140 how we address those risks is still under discussion. But we all need to work. We all
00:14:33.260 need to work together to make sure that we can win and we can win safely. If we do this right,
00:14:38.440 if we work with the president and everyone here, we can win safely.
00:14:41.540 Coming up, a couple of married 77-year-olds now in custody,
00:14:48.680 accused of gunning down their daughter's spouse, who worked for the New York Times,
00:14:52.480 in broad daylight. And a hurricane hitting Mexico Monday night,
00:14:57.200 now sending a flood threat north from Colorado down to Texas.
00:15:01.000 everyone's talking about weight loss injections because the results can be so dramatic
00:15:12.160 they work by lowering blood sugar and reducing appetite but what if you're looking to lose weight
00:15:17.440 but are not interested in painful weekly injections especially when you hear about
00:15:21.620 some of those intense side effects that's why doctors created a weight loss supplement called
00:15:26.720 lean and the results could be remarkable lean says the studied ingredients in their product

00:16:01.280 That's promo code MK at TakeLean.com. A New York Times executive gunned down in broad daylight over
00:16:09.660 the weekend in the parking lot of a Northern California sports complex. Police say the
00:16:14.720 suspected killers are the executive's 77-year-old in-laws. 40-year-old Jonathan McKenzie found
00:16:20.960 shortly after 3 p.m. Saturday in the middle of the parking lot at Dublin Sports Grounds,
00:16:26.480 suffering from multiple gunshot wounds. Jonathan McKenzie pronounced dead at the scene.
00:16:32.080 A Dublin police sergeant happening upon the shooting while driving near the complex
00:16:35.940 as dispatchers reportedly began receiving multiple 911 calls. Witnesses helping officers locate
00:16:42.760 Shoyang Zhang and Shi Li Chen nearby within minutes. The married couple identified by police
00:16:49.320 as Jonathan McKenzie's in-laws, both arrested on suspicion of murder and booked into Santa Rita
00:16:55.500 Jail. Witnesses telling the New York Post two masked attackers approached McKenzie in the
00:17:00.760 parking lot before reportedly taking turns firing. McKenzie, with the New York Times since 2023,
00:17:07.640 most recently serving as director of engineering for their games division.
00:17:12.160 Police have not announced a motive, but the killing comes amid an ugly divorce and custody
00:17:16.600 battle between McKinsey and Candace Jang, the accused killer couple's daughter. The New York
00:17:22.180 Times reporting Jang and McKinsey each sought domestic violence restraining orders against the
00:17:26.540 other last year, Candace Jang accusing husband McKinsey in court filings of physical abuse,
00:17:32.380 including an incident Jang says left her with a fractured vertebra. A separate police report
00:17:37.720 shows Jang also accused McKinsey of striking the couple's six-year-old child in the face.
00:17:43.600 Police responding to that complaint
00:17:45.600 reportedly found the couple's two-year-old alone
00:17:48.560 in an upstairs bedroom after dad McKenzie
00:17:51.260 had gone shopping for more than an hour, 1.00
00:17:53.700 all of which resulted in McKenzie being charged
00:17:56.100 with two misdemeanor counts of child abuse,
00:17:59.160 McKenzie pleading not guilty
00:18:00.640 and being released on the condition
00:18:02.200 that parenting classes be completed.
00:18:05.040 A pretrial hearing had been scheduled for next month.
00:18:08.260 McKenzie filed for divorce in December, 1.00
00:18:10.480 seeking a separate restraining order
00:18:12.100 against wife Jang. That filing revealing, guess what, McKinsey was actually a woman, 0.96
00:18:17.960 but had undergone surgical procedures in order to appear male. McKinsey previously accusing
00:18:23.520 wife Jang and Jang's parents of abuse, tied to McKinsey's so-called gender identity.
00:18:30.620 McKinsey alleging the mother-in-law called McKinsey a, quote, monster after McKinsey's
00:18:34.880 young son began wearing his sister's dresses and accusing the father-in-law of punching McKinsey
00:18:40.420 in the chest during recovery from double mastectomy surgery in 2010. According to booking
00:18:46.740 records, Zhang and Chen now facing charges including first-degree murder, felony conspiracy,
00:18:52.200 willful discharge of a firearm with gross negligence, and child endangerment. They are
00:18:57.260 set to be arraigned later today. Hurricane Polo's tropical moisture driving a serious flood threat
00:19:04.120 from the Rockies into the plains after the storm made landfall in Mexico's Baja California Sur
00:19:09.900 region Monday night. About 28 million people were under flood watches as of yesterday,
00:19:15.360 according to the Washington Post. By early this morning, what is left of Polo reaching
00:19:19.820 eastern Colorado, where a separate weather system could pull it toward the mountains
00:19:24.020 and keep it spinning over the region for much of the day. The National Weather Service in Pueblo,
00:19:29.540 Colorado, warning wildfire burn scars are especially vulnerable to flash flooding,
00:19:34.620 The danger spreading farther into the plains today and tomorrow.
00:19:38.960 The post identifying heightened flood risks along I-80 from Nebraska through Des Moines and into eastern Iowa,
00:19:45.560 and along the corridor from Kansas City through Wichita, Oklahoma City, and Dallas into the Texas Hill Country.
00:19:52.620 Fox weather meteorologist Britta Merwin explaining why the first real drenching after a long, hot, dry stretch could be a problem.
00:20:00.060 All of this mess in the southwest will continue to push farther east as we work our way through the middle part of the work week.
00:20:07.880 And this is a huge threat to states like Oklahoma and Texas who find themselves in a level three out of four flash flood potential on Wednesday and Thursday.
00:20:17.100 Part of the problem here, folks, is the summer that we've had in the central plains.
00:20:22.440 No rain, triple digit heat for more than two months.
00:20:26.220 And in fact, we haven't had more than a hundredth of an inch of rain in months.
00:20:31.520 And the first real drenching rain that we're going to get is way too much.
00:20:36.520 We're talking about over half a foot of rain in two days.
00:20:40.180 So this is going to cause big problems.
00:20:42.200 Again, similar to the Southwest story, this is fueled by tropical moisture.
00:20:47.240 In Texas, rainfall totals could reportedly reach double digits by the end of the week,
