00:01:00.160 A jury in Chicago finds Jussie Smollett guilty of orchestrating a fake hate crime against himself

00:01:06.360 in January 2019, convicting Smollett on five of six felony counts after nine hours of deliberation.

00:01:14.760 Put another way, the jury has had the final say in this case, and it is this.

00:01:18.480 Jussie Smollett is a liar, a race hustler, and now a convicted felon.

00:01:24.320 This marks the end of a shameful saga involving the actor and his media and Democrat enablers

00:01:30.720 who rushed to establish their woke bona fides by accepting Jussie's absurd allegations as

00:01:37.260 incontrovertible and as proof of their belief that America is awful.

00:01:42.060 Let's be clear. It was apparent from the start that Smollett's allegations stunk to high heaven.

00:01:49.420 A black gay man, star of the show Empire, but virtually unknown to most Americans, was allegedly

00:01:55.440 recognized on the streets of Chicago at 2 a.m., where he spur of the moment headed out to Subway

00:02:01.560 for a tuna fish sandwich in the middle of the epically cold polar vortex.

00:02:05.840 There, in the middle of deep blue Chicago, Smollett was attacked by two racist, MAGA-loving

00:02:13.140 homophobes. Luckily, he just happened to be on the phone with his manager at the time,

00:02:19.760 who could thus be an earwitness to the attack, in which Smollett was most definitely a very tough

00:02:28.220 and brave guy, as he explained to ABC's Robin Roberts.

00:02:32.580 And while he was on the phone, I heard, as I was crossing the intersection, I heard,

00:02:40.580 Empire. And I don't answer to Empire. My name ain't Empire. And I didn't answer. I kept walking,

00:02:49.660 and then I heard Empire. So I turned around and I said, did you just say to me? I mean, I see

00:02:55.880 the attacker masked. And he said, this MAGA country punches me right in the face. So I punched his ass

00:03:09.060 back. And then we started tussling. You know, it was very icy. And we ended up tussling by the stairs,

00:03:16.020 uh, fighting, fighting, fighting. There was a second person involved who was kicking me in my 0.79

00:03:22.380 back. And, uh, then it just stopped and they ran off. When Smollett regained his composure,

00:03:35.860 he said he looked around and his horror only grew. And I looked down and I see that there's a rope

00:03:42.440 around my neck, which I hadn't noticed it before. No, because it was so fast. You know what I'm

00:03:47.620 saying? It was so fast. How long did this all? It felt like minutes, but it probably was like 30

00:03:52.600 seconds. Honestly, I can't tell you honestly. Um, I noticed the rope around my neck and I started

00:03:59.580 screaming and I said, there's a rope around my neck. Oddly, his first instinct was not to call the

00:04:07.120 police. Why? Because again, he is a very tough and brave guy. Why did you hesitate to want to

00:04:14.420 call the police? You know, there's a level of pride there. We live in a society where

00:04:19.900 as a gay man, you were considered somehow to be weak. And I'm not weak. I'm not weak.

00:04:29.300 And we are, as a people are not weak. So I can accept that there was pride there. There's also

00:04:35.940 privacy. Smollett claims that it was at that point that he realized his attackers, whom he later

00:04:43.180 claimed were white, had poured bleach all over him, too. How it was that two racist, homophobic,

00:04:50.720 MAGA loving attackers just happened to recognize him, hurl racial and gay slurs at him, knowing,

00:04:56.620 of course, his sexuality and be ready to attack him with a noose and bleach at 2 a.m. on the streets 0.85

00:05:01.660 of Chicago remained unclear, as Robin Roberts apparently did not feel the need to ask.

00:05:07.260 It would later become clear that Smollett tightened the alleged noose around his own neck just in time

00:05:14.040 for the arrival of the cops, who his manager called, testifying that it was thrown on him loosely.

00:05:19.600 But pictures later showed it nice and tight around his throat. Wonder how that happened.

00:05:25.360 The Robin Roberts did not confront Smollett with the obvious implausibility of his entire story.

00:05:30.620 She did get him to wax poetic about how hard it is when not everyone believes you.

00:05:38.020 I'm pissed off. What is it that has you so angry? Is it the the attackers?

00:05:45.500 It's the attackers, but it's also the attacks. It's like, you know, at first it was a thing of like,

00:05:52.300 listen, if I tell the truth, then that's it, because it's the truth.

00:05:59.920 Then it became a thing of like, oh, how can you doubt that? Like, how do you how do you not believe

00:06:06.000 that it's the truth? And then it became a thing of like, oh, it's not necessarily that you don't

00:06:12.020 believe that this is the truth. You don't even want to see the truth.

00:06:25.240 racist, homophobic America. You doubt Jussie, you see, and you are hashtag part of the problem.

00:06:32.320 As if on cue, Smollett's media and Democratic enablers jumped in, making clear one may not

00:06:38.520 question the hate crime story of a black gay man who is a very tough and brave guy and definitely not 0.52

00:06:44.620 a liar. Example, Ellen Page, now Elliot, who went on with Colbert to express her disgust at those who

00:06:53.020 would question this obviously true story. I have a media that's saying it's a debate whether or not

00:07:00.260 what just happened to Jussie Smollett is a hate crime. It's absurd. This isn't a debate.

00:07:06.000 I agree. Sorry, I'm like, I'm like really fired up tonight. This is how you have to be fired. It

00:07:15.960 feels impossible to not feel this way right now. And those questioning his story, those two also

00:07:23.140 meant those jerks who used qualifiers when describing Smollett's allegations like the

00:07:29.180 bigots at Sweet Little Entertainment Tonight. No, they did not escape their notice. You see,

00:07:37.100 E.T. reported Smollett had been hospitalized after a, quote, possibly homophobic and racially

00:07:44.420 charged attack. Not good enough, people. Enter AOC, who never misses a chance to exploit a thing like

00:07:52.620 this. She tweeted out, quote, there's no such thing as racially charged. This attack was not

00:07:59.920 possibly homophobic. It was a racist and homophobic attack. If you don't like what is happening to our

00:08:07.160 country, then work to change it. It is no one's job to water down or sugarcoat the rise of hate crimes.

00:08:15.780 AOC was not the only one unwilling to wait for the facts to play out. Kamala Harris immediately

00:08:23.580 called it a modern day lynching, adding no one should have to fear for their life because of

00:08:28.280 their sexuality or the color of their skin. We must confront this hate. Joe Biden tweeted that this

00:08:35.860 kind of attack, quote, must never be tolerated in this country. We must stand up and demand that we no

00:08:41.380 longer give this hate safe harbor. Bernie Sanders weighed in, calling the attack on Smollett, quote,

00:08:48.280 a horrific instance of the surging hostility toward minorities around the country. Never to be outdone

00:08:56.360 on racial hysterics, Joy Reid tweeted out, nooses never really disappeared as messages of a very specific

00:09:03.580 kind of terror. But every time they're used, my God, it's chilling. Praying for Jussie's full recovery.

00:09:11.380 And for us all. Rashida Tlaib added, when one of the most famous black and gay men in America is

00:09:18.300 not safe, the message is clearer than it has ever been. The dangerous lies spewing from the right wing

00:09:25.300 is killing. Subject verb disagreement is on her part, is killing and hurting our people. 1.00

00:09:32.060 That was the politicians. The politicians, we expect them to be biased and stupid and to jump

00:09:37.820 to conclusions that they think will help them win votes. Except for Joy Reid. She's part of the media.

00:09:49.200 display from Grabian. And remember, we in the media used to try not to assume facts until they had been

00:10:33.340 Speaker of the House Nancy Pelosi tweeting the racist, homophobic attack on Jussie Smollett

00:10:40.040 And Senator Cory Booker said the vicious attack on actor Jussie was an attempted modern day lynching.

00:10:45.680 Kamala Harris calling the attack an attempted modern day lynching.

00:12:28.840 It's been two weeks since that night left actor Jussie Smollett bruised but not broken.

00:12:34.860 And he's still processing the raw emotions.

00:12:40.060 If you watch this later on YouTube, he's got the tissue and the tears as you hear the track from Robin.

00:12:45.880 Now we know, of course, that that was acting.

00:12:48.620 Fake tears.

00:12:49.400 Fake heroism.

00:12:50.500 An Emmy-award-worthy performance.

00:12:52.980 He made the entire thing up.

00:12:55.000 And it was obvious to anyone not blinded by ideology from the start.

00:13:00.740 The story was absurd, yes.

00:13:02.700 But we also heard reports that Jussie early on refused to give police his cell phone.

00:13:08.020 Why would that be?

00:13:08.900 As it turns out, he had very good reason not to give it to them.

00:13:11.880 His phone records showed that he had exchanged at least five calls, 40 text messages and several Instagram DMs with one of the two men he hired to attack him in the days before said attack.

00:13:22.460 By the way, those two men, Nigerian brothers, were black.

00:13:27.360 Jussie needs to learn a thing or two about fake hate crimes and how they're perpetrated. 0.94

00:13:31.520 Smollett would not provide his medical records to the police because he didn't want cops to know he had not been seriously injured.

00:13:38.440 When the police identified the two brothers as the perpetrators, was Jussie relieved?

00:13:48.820 In fact, he didn't even want to file charges against these brothers.

00:14:30.580 He didn't want these brothers to be found or arrested because he knew that they would give up the fact that he hired them.

00:14:57.440 They turned on him just as soon as the Chicago PD got their hands on those two guys.

00:15:01.900 The Chicago PD, which had put all hands on deck to solve this horrific crime and spent $130,000 of taxpayer money.

00:15:12.080 They figured out that Smollett was a liar fairly easily on, fairly early on in the case and fairly easily.

00:15:18.780 They were most unhappy with the wild goose chase he put them on, as we heard directly from the police commissioner.

00:15:25.520 Jesse Smollett took advantage of the pain and anger of racism to promote his career.

00:15:36.680 Why would anyone, especially an African-American man, use the symbolism of a noose to make false accusations? 0.95

00:15:47.140 How could someone look at the hatred and suffering associated with that symbol and see an opportunity to manipulate that symbol to further his own public profile?

00:15:59.700 How can an individual who's been embraced by the city of Chicago turn around and slap everyone in this city in the face by making these false claims?

00:16:14.520 Contrast that message with the George Soros backed Chicago D.A., Kim Fox, who tried to dump the whole case and tried to let Smollett off the hook scot-free.

00:16:28.320 Thankfully, a judge wouldn't allow it and appointed a special prosecutor instead. 0.96

00:16:35.620 Webb is a no nonsense prosecutor.

00:16:38.760 And he appeared to agree with at least one piece of Smollett's sentiments as expressed so eloquently to Robin Roberts.

00:16:51.520 I respect too much the people who I am now one of those people who have been attacked in any way.

00:17:08.540 Hate crimes are horrific things, but the truth is they are a negligible portion of total crime in this country.

00:17:16.480 Peter Kersenow, a black member of the U.S. Commission on Civil Rights, laid out the facts in National Review in 2019 after this whole incident,

00:17:23.780 reporting that in 2015 there were 1.2 million murders, rapes, aggravated assaults and robberies in America.

00:17:32.040 Of those, 821 or .00067 percent were classified as hate crimes for an entire year.

00:17:42.920 Kersenow went on to point out that an average of 550 Americans are struck by lightning each year, most in a six or seven month period.

00:17:49.740 In other words, the odds of being the victim of a hate crime are roughly the same as being struck by lightning.

00:17:56.460 Those stats warrant some skepticism when someone tells you there's a rash of hate crimes in America and even some skepticism when one alleges it has happened to him.

00:18:08.200 And especially skepticism when you're a member of the media and it's your business to be skeptical.

00:18:13.660 And that skepticism is there for very good reasons, right?

00:18:18.180 For those reasons, these cases should not play out on Twitter or in newsrooms, but on dockets and in courtrooms where, as the New York State courthouse, where I tried my very first case as a young lawyer,

00:18:30.760 proclaims in marble on its exterior above the big pillars shown on law and order episodes.

00:18:37.500 The true administration of justice is the firmest pillar of good government.

00:18:44.000 Jussie Smollett might even agree.

00:18:47.000 I still want to believe with everything that has happened that there's something called justice.

00:19:42.660 So and it's a great day for it, obviously, because this is I mean, when you hear it laid out, right,

00:19:47.380 like you go back and you listen to that GMA interview he did and his acting and he played every card.

00:19:53.160 I mean, it's infuriating, right, because what he's essentially done is made the road 10 times harder

00:20:00.840 for any person who actually is the legitimate victim of a hate crime.

00:20:06.280 And the numbers are low.

00:20:07.380 They're not non-existent.

00:20:08.460 They're low.

00:20:09.120 But it doesn't mean it never happens.

00:20:11.020 And thanks to him, thanks to him, people are less likely to believe the next person when they come along.

00:20:17.420 Well, Megan, I'm always suspicious of those reports.

00:20:20.920 I don't know what the stats are, but of the ones that the media covers, most of them turn out to be hoaxes.

00:20:30.100 They turn out to be ridiculous.

00:20:32.220 And the timing of his hate crime hoax coincided with a narrative that the Democrats were pushing about lynchings

00:20:40.600 lynchings and about all these horrible things that Trump supporters had brought back to America as far as white supremacy.

00:20:48.460 So there's a reason why they defended him.

00:20:51.400 He was feeding and providing support for a narrative that they had out there in Congress.

00:20:57.060 And so I think that if you go back and look at the conversation that was taking place in the context of his hopes,

00:21:03.700 you will see that it fits in perfectly.

00:21:05.900 And I would also argue that real white supremacy and violence against blacks has declined to the point

00:21:14.360 that people that want to keep the racism narrative alive, they actually have to invent a lot of this stuff.

00:21:21.040 And so there's a reason it's almost become like when a man reports his wife missing,

00:21:25.880 the husband becomes the suspect when a person, especially, you know, a racial and ethnic minority 0.99

00:21:33.620 reports a hate crime.

00:21:36.300 I think they are automatically suspect because too many of them have turned out to be hoaxes.

00:21:42.620 There have been a lot, you know, it's like the whole Bubba Wallace thing with the noose and the NASCAR.

00:21:47.640 And it was like, no, it actually wasn't.

00:21:49.700 I mean, who does nooses?

00:21:50.820 I mean, nooses.

00:21:53.600 Who throws a Clorox on someone?

00:21:55.600 It was ridiculous from the very beginning.

00:22:02.920 And I think, again, that racism in America has declined to the point that you really have to

00:22:11.380 And too often the person who reports it is actually the person who, you know, is putting

00:22:18.700 Unfortunately, they usually don't pay any real penalties for that.

00:22:22.980 And if he appeals his conviction, he may still walk because for the most part, the people

00:22:31.580 in the past that have reported hate crime hoaxes, it's just been dismissed because the

00:22:37.560 left says that if it didn't happen in that particular case, it happened to someone somewhere

00:22:43.180 at some time in history.

00:22:44.720 Yeah, that's right.

00:22:46.140 That's basically the BLM statement.

00:22:48.520 Black Lives Matter issued a statement yesterday before the verdict.

00:22:51.100 They haven't updated it, but they don't need to because it foresaw this because we all

00:22:54.840 predicted he was going to get convicted.

00:22:57.140 This is what they say in part, BLM, to your point.

00:22:59.400 As abolitionists, they call themselves abolitionists, we approach situations of injustice with love

00:23:05.420 and align ourselves with our community because we got us.

00:23:10.120 They say this is not about a trial or a verdict decided in a white supremacist charade.

00:23:16.020 In an abolitionist society, this trial would not be taking place and our communities would

00:23:20.760 not have to fight and suffer to prove our worth.

00:23:25.800 We can never believe police, especially the Chicago Police Department, over Jussie Smollett, 0.55

00:23:30.480 a black man who has been courageously present, visible and vocal in the struggle for black

00:23:35.920 Can we believe the two black Nigerian brothers who testified and said Jussie's a liar?

00:23:41.580 Can we believe the black police commissioner who said Jussie's a liar and made this whole

00:23:45.500 thing up to the detriment of black people who actually do get attacked?

00:23:48.300 They go on to say police lie in Chicago.

00:23:51.460 Jussie Smollett lies, too.

00:23:54.460 That's me.

00:23:55.240 Black Lives Matter, they finish, will continue to work toward the abolition of police and

00:24:01.000 So, OK, we don't care about verdicts because the whole system is white supremacist.

00:24:06.760 I mean, this whole thing about Black Lives Matter, I'm talking about the slogan and the

00:24:11.360 organization.

00:24:12.180 For one thing, the slogan is a fact statement.

00:24:14.360 But the organization, if they really cared about black lives, they'd be out there fighting

00:24:20.120 the abortion clinics and they would be fighting. 0.95

00:24:24.140 They would be out there doing something about the violence in Chicago.

00:24:28.540 The crime rate has skyrocketed since they appeared on the scene.

00:24:34.320 And the defunding of police only hurts black people.

00:24:37.520 And so they don't care about black lives.

00:24:41.140 I mean, they care about pushing a Marxist agenda.

00:24:44.220 They've been very clear about that.

00:24:46.680 And Smollett was trying to help them with their agenda, their white supremacy narrative.

00:24:53.220 The dangers that we face today is because white people are not holding black people and other 0.98

00:25:00.040 minorities to the same standards.

00:25:02.260 And there cannot be any equality in our nation until all citizens are held to the same standards

00:25:08.980 of conduct.

00:25:11.160 Yeah, it's it's crazy to actually read, you know, how they just don't care about the facts

00:25:16.380 Well, I mean, at least they admit it.

00:25:17.780 Um, in the meantime, let's talk about what's likely to happen to him, because he hasn't

00:25:23.920 yet been sentenced.

00:25:25.040 That'll happen in the coming weeks.

00:25:27.700 But normally somebody who makes up something like this might expect to get probation and

00:25:33.280 a fine.

00:25:34.620 These are felony counts.

00:25:36.060 He's been convicted of five out of six.

00:25:37.760 It was basically all you lied to this cop by saying you were the victim of a fake hoax and

00:25:42.620 you lied to this cop and you lied to this person again.

00:25:44.500 And basically, they weren't sure about whether he lied to the sixth cop, which is why he got

00:25:48.920 convicted on five out of six instead of six out of six.

00:25:51.440 Now, he's facing potentially up to 18 years in prison because it's three possible years

00:25:56.660 per count that that won't happen and it shouldn't happen.

00:26:00.720 But I do believe he should face jail time because of the damage he's done to the legitimate
