00:02:26.440 keeping the 19-year-old's 35-year prison sentence intact. Anthony's defense arguing
00:02:31.240 the trial was compromised, pointing to strict courtroom rules, jury instructions,
00:02:35.840 and a, quote, gentleman's agreement with prosecutors limiting what evidence jurors
00:02:39.440 would hear. Anthony had achieved a legal win following his conviction, with original judge
00:02:44.380 John Roach tossed off the case. Roach telling a local outlet that jurors, quote, got it right
00:02:49.700 in convicting Anthony. Legal experts saying the rejection of Anthony's bid for a new trial is not
00:02:54.840 surprising. Here's criminal defense attorney and host of In the Well on the MK True Crime Channel,
00:03:00.420 Mark Garagos on NewsNation. This is not unexpected given what happened earlier this week when the
00:03:07.460 text messages that were released that apparently weren't used during the trial came out and it was
00:03:14.240 not helpful uh to this young man to the accused or now convicted and i think where they're headed
00:03:21.120 with this new legal team is they lost the motion for new trial but it becomes apparent to me
00:03:27.040 they're now going to um probably focus in on ineffective assistance of counsel of the trial
00:03:34.160 lawyer in this case and i think that's the the newest tack that the newest legal team is going
00:03:40.160 going to take. Those texts Garagos is referencing, part of evidence that was not introduced during
00:03:45.120 the trial. The texts were revealed during hearings last week held on Anthony's motion for a new
00:03:49.880 trial. According to CBS News Texas, prosecutors saying Anthony repeatedly threatened to murder
00:03:55.000 his girlfriend in text messages, one of them saying, quote, how many bullets you want coming
00:03:59.360 out of your chest. And in another, quote, when I stab somebody, I'm going to lick their blood off
00:04:04.180 the blade. This is not the end of the road for Anthony. Attorney Mark Reichel describing what's
00:04:09.340 next on NewsNation. Does this officially end the case, Mark, or is there more to learn?
00:04:14.560 No. So when somebody's sentenced to a sentence like that, which was 35 years,
00:04:18.260 almost a life sentence, there'll be plenty of time to relitigate this exact matter.
00:04:23.040 Right away, they brought it up and said, you know, new lawyers said, hey, there was this
00:04:26.320 gentleman's agreement, much to our client's detriment. Shouldn't happen, you know, as bad
00:04:31.040 practice on their part. So they wanted to get in there right away and get a new trial.
00:04:34.960 Look, it's been denied. He's going to go up on appeal. But while that's pending,
00:04:38.500 They can continue to gather evidence, do some research, investigate, get more evidence about this gentleman's agreement, kind of look at the record, determine how it really prejudiced him, refile a motion.

00:11:00.260 her family is now suing the city, arguing her death was preventable.
00:11:04.420 In addition to the city of Charlotte, the lawsuit names Professional Police Services,
00:11:08.340 a private security company contracted by the Charlotte Area Transit System, as a defendant.
00:11:13.240 The lawsuit, alleging the transit system contributed to Zarutska's alleged wrongful death,
00:11:18.420 by failing to provide adequate security on the light rail,
00:11:21.100 hire qualified people, enforce fares, and protect lawful passengers from foreseeable
00:11:26.060 criminal attacks. Her family's attorney, Lauren Newton, tells WCNC those shortcomings matter.

00:14:53.320 And Glenda isn't the only one. According to CBS News, one other patient is also saying they've
00:14:57.940 been left paralyzed by the medical mix-up. As for the two other patients affected, they're
00:15:02.140 reportedly suffering serious complications. The hospital's CEO apologizing to the four patients
00:15:07.080 and their families, saying the facility is providing ongoing care and support.
00:15:11.480 President and CEO of the hospital, Dr. Shibuta Jagesa, releasing a statement reading in part,
00:15:16.720 quote, our hearts are with the four patients and their families impacted by this event.
00:15:21.280 On behalf of our leadership and care teams, I am deeply sorry for the harm caused to our patients.
