00:02:32.940 New York Attorney General Letitia James indicted by a federal grand jury on charges of bank fraud and false statements to a financial institution the Justice Department announced last night. 0.78
00:02:44.380 Lindsay Halligan, U.S. Attorney for the Eastern District of Virginia, said in a statement, quote,
00:02:49.040 No one is above the law.
00:02:50.780 The charges, as alleged in this case, represent intentional criminal acts and tremendous breaches of the public's trust.
00:02:57.560 The facts and the law in this case are clear, and we will continue following them to ensure that justice is served.
00:03:04.560 James releasing a video statement on social media.
00:03:07.480 This is nothing more than a continuation of the president's desperate weaponization of our justice system.
00:03:14.180 He is forcing federal law enforcement agencies to do his bidding, all because I did my job as the New York State Attorney General.
00:03:22.720 These charges are baseless, and the president's own public statements make clear that his only goal is political retribution at any cost.
00:03:32.000 The indictment alleges James, in 2020, signed documents that required her to occupy and use a three-bedroom home in Norfolk, Virginia, as her secondary residence.
00:03:43.460 She was also prohibited from renting the property. 0.95
00:03:46.220 These pledges allowed her to obtain favorable loan terms not available to rental properties.
00:03:53.020 But according to the DOJ, James did, in fact, rent out the home to a family of three.
00:03:59.100 From the indictment, quote,
00:04:00.500 The scheme involved falsely representing the property as a secondary residence to obtain favorable mortgage terms while using it as an investment property with no intended or actual personal occupancy or use by her.
00:04:13.740 The case, brought by Halligan, who was sworn in after her predecessor, Eric Siebert, left his post, reportedly over calls to bring charges against James and former FBI Director James Comey.
00:04:27.260 Democrats condemning the indictment, New York Governor Kathy Hochul posting to social media, quote,
00:04:32.180 What we're seeing today is nothing less than the weaponization of the Justice Department to punish those who hold the powerful accountable.
00:04:40.400 Former political director for Mitch McConnell, Scott Jennings, on CNN, saying Democrat arguments about selective prosecution will not fly.
00:04:49.400 If Democrats like Slotkin are going to come out today and whine about selective prosecutions over Tish James, her entire career is built on the selective prosecution of one man. 0.99
00:05:02.600 Now, I also believe what Elliott said. There's a process here. Everybody gets their day in court.
00:05:08.060 Obviously, a grand jury saw enough evidence to bring charges. We don't know what they are, but a grand jury looked at this and says, OK, there's something here.
00:05:16.240 She gets to go to court just like Comey, just like anyone else. 0.89
00:05:19.680 But to me, it's just not going to fly to boo-hoo over selective prosecutions on this particular person who promised in her campaigns, who went after him on things, as Jonah said, that had no business, no business ever happening, if not but for the man's last name being Trump.
00:05:38.580 The case is reportedly assigned to Biden-appointed U.S. District Judge Jamar K. Walker.
00:05:45.020 President Trump holding his eighth cabinet meeting of the year yesterday morning.
00:05:51.340 The president kicking off the meeting with more details on the historic agreement between Israel and Hamas to release the remaining hostages in Gaza.
00:06:00.120 We secured the release of all of the remaining hostages, and they should be released on Monday or Tuesday.
00:06:06.240 Getting them is a complicated process. I'd rather not tell you what they have to do to get them.
00:06:10.540 There are places you don't want to be, but we are getting the hostages back on Tuesday, Monday or Tuesday, and that'll be a day of joy.
00:06:22.160 I'm going to try and make a trip over. We're going to try and get over there.
00:06:26.320 We're working on the timing, the exact timing.
00:06:29.400 We're going to go to Egypt where we'll have a signing, an additional signing.
00:06:33.660 We've already had a signing representing me, but we're going to have an official signing.
00:06:38.520 Later today, the Nobel Prize Committee is set to announce the winner of the prestigious Peace Prize,
00:06:44.660 the Norwegian committee granting the award to the person or organization who has done, quote,
00:06:49.580 the most or best work for fraternity between the nations and the abolition or reduction of standing armies.
00:06:56.580 Several world leaders, including Israeli Prime Minister Benjamin Netanyahu, nominating President Trump this year for the prize.
00:07:03.440 Mr. Trump asked about the award yesterday afternoon.
00:07:06.240 How do you rate your chances of winning the Nobel Prize tomorrow?
00:07:10.420 I don't know what they're going to do, really.
00:07:12.440 But I know this, that nobody in history has solved eight wars in a period of nine months.
00:07:20.100 And I've stopped eight wars. So that's never happened before.
00:07:23.500 But they'll have to do what they do. Whatever they do is fine.
00:07:26.900 I know this. I didn't do it for that. I did it because I saved a lot of lives.
00:07:31.740 And that's the thing that bothers me so much about the Russia, Ukraine.
00:07:35.140 Seven thousand people are dying a week. Young soldiers are almost all soldiers of Ukraine and Russia. 0.82
00:07:41.520 So in theory, it doesn't affect us. No, but it's a terrible thing.
00:07:46.200 And we'll get that solved, too. But nobody has ever done eight wars.
00:07:49.920 Nobody's done eight wars in 30 years, let alone nine months.
00:07:53.920 Coming up, the race for attorney general of Virginia in a dead heat after texts from the Democrat candidate resurface.
00:08:03.540 And the Trump administration defending the National Guard's deployment to Portland in front of an appeals court
00:08:09.200 as the surge in Memphis delivers impressive early results.
00:08:12.520 You know, all those fad diets. Half of Americans do it.
00:08:20.600 And if you do it enough, you could be at risk of diabetes, liver damage, heart attack and stroke.
00:08:25.580 Weight cycling is when you lose 10 or more pounds, but then you put the pounds back on plus a couple more.
00:08:32.100 That puts tremendous strain on your organs and can lead to serious health issues.
00:08:36.640 Bottom line, most people need help to stop weight cycling.
00:08:38.920 And this is why I want to tell you about non-prescription lean created by doctors.
00:08:45.020 Lean is an oral supplement, not a GLP-1 injectable.
00:08:49.320 It uses studied ingredients, which lean says target weight loss in three powerful ways.
00:08:54.240 Maintaining healthy blood sugar, helping control appetite and cravings, burning fat by converting it to energy.
00:09:00.480 And burning fat helps keep the weight off.
00:09:02.280 If you want to lose meaningful weight at a healthy pace and keep it off, consider adding lean to your diet and exercise lifestyle.
00:09:09.960 Get 20% off when you enter MK at TakeLean.com.
00:09:13.800 That's code MK at TakeLean.com.
00:09:19.380 Virginia Democrat Attorney General candidate Jay Jones slipping in the polls after 2022 text messages recently made public
00:09:27.320 show him fantasizing about shooting the former Republican state House Speaker and wishing death upon the Speaker's children,
00:09:35.720 despite corporate media's near-total silence.
00:09:39.160 The text surfacing last Friday in a report by the National Review's Audrey Fallberg,
00:09:43.760 but the news has mostly been ignored by mainstream outlets.
00:09:47.100 Newsbusters, a media watchdog, reporting that from Friday, October 3rd,
00:09:51.200 to the morning of Tuesday, October 7th, the story receiving just 63 seconds of coverage from ABC, CBS, NBC, and PBS combined.
00:10:01.200 In fact, NBC is the only network to have covered the story in that time frame,
00:10:05.280 when it was brought up by a former Donald Trump staffer on Meet the Press.
00:10:10.500 Since the text went public, Axios reporting Republican candidate Jason Miar is launching a $1.5 million ad buy,
00:10:17.880 blanketing the airwaves with Jones' text messages.
00:10:21.800 Democrats and Republicans are condemning old text messages that emerge from Democratic candidate Jay Jones.
00:10:27.480 Jay Jones, the Democratic nominee for Virginia Attorney General,
00:10:31.040 is accused of sending a former legislative colleague text suggesting he would like to shoot the Speaker of the House of Delegates. 0.75
00:10:38.880 Quote, Gilbert gets two bullets to the head.
00:10:41.360 Quote, he wished Gilbert's wife could watch her own child die in her arms so that Gilbert might reconsider his political views.
00:10:50.340 Jay Jones wished violence on the children of a colleague.
00:10:53.520 How can Virginians trust a man who said something so horrific, so callously?
00:10:58.740 Isn't that type of rhetoric disqualifying for someone who's seeking statewide office here in Virginia?
00:11:03.760 I wish that I hadn't done it. I wish I hadn't said it.
00:11:06.020 It is disgusting and unbecoming of a public official.
00:11:09.220 Jones is facing calls now to step down from the race.
00:11:13.140 Some say he's not fit to serve as Attorney General.
00:11:17.060 While Democrats have condemned the text messages,
00:11:20.160 Jones is not facing mounting pressure from within his party to withdraw from the race.
00:11:25.100 The Washington Post calling or emailing 100 Democrat candidates for the Virginia House of Delegates.
00:11:31.220 Most did not respond or declined to speak to the Post.
00:11:34.200 Only one Democrat candidate in Virginia said Jones should drop his campaign.
00:11:39.920 Despite the near-news blackout, the story appears to be damaging Jones in the polls.
00:11:45.360 Two polls conducted just prior to the text going public showing Jones leading by six points at each.
00:11:50.660 Now an internal poll by Hart Research reportedly conducted for Jones shortly after the texts leaked,
00:11:57.220 The Jones-Miaras race remains highly competitive with Jay still holding a slight 46% to 45% advantage.
00:12:06.160 That polling memo made public by the Virginia Scopes' Brandon Jarvis.
00:12:11.220 However, the poll also finding Jones slightly trailing Miaras among independents at 41% to 42%.
00:12:17.720 A poll conducted by the Republican Attorneys General Association showing Miaras taking the lead by about two points at 45.8% to 43.7%.
00:12:27.700 More critically, the poll finding Jones' unfavorability numbers skyrocketing from 19% in September to 43.5% now.
00:12:37.920 Election Day is November 4th.
00:12:39.480 The Ninth Circuit Court of Appeals on Thursday appears poised to side with the Trump administration over Oregon's lawsuit challenging the National Guard deployment to Portland.
00:12:51.000 President Trump authorizing the mobilization of 200 National Guard troops in late September under federal control for at least 60 days to protect ICE agents and federal property from riotous protesters.
00:13:02.640 Since June, protesters holding daily demonstrations outside the Portland ICE facility, at times getting violent, leading to more than a dozen arrests.
00:13:12.760 In yesterday's cabinet meeting, Homeland Security Secretary Kristi Noem describing a recent trip to Portland checking in on ICE operations.
00:13:20.040 I asked the mayor about himself.
00:13:22.980 He said that Portland was perfectly safe, a beautiful city, no problems.
00:13:27.360 And I said, well, why did you clear the streets for me today then and build out a four-block radius to make sure I could get in and out of here and these people on the street screaming death to ICE?
00:13:36.980 There's graffiti that says Molotovs melt ice.
00:13:40.400 We have the guillotines.
00:13:41.780 We're going to use them.
00:13:43.220 The things that...
00:13:43.620 Portland's the most different.
00:13:44.200 It's like anarchists.
00:13:45.160 It is.
00:13:45.540 It really is.
00:13:45.860 You know, it's really different than a lot of the others.
00:13:47.640 This is a sick situation.
00:13:50.280 But those are anarchists.
00:13:51.540 Those are people that want to overthrow government. 0.98
00:13:53.740 They're really degenerates.
00:13:55.700 Oregon and Portland quickly filing a lawsuit seeking a temporary restraining order, or TRO, to block the deployment.
00:14:03.540 A federal judge over the weekend issuing the TRO blocking Oregon National Guard troops from deploying to Portland.
00:14:09.120 The Trump administration then moving to send troops from the California National Guard in response.
00:14:15.560 The judge issuing a second order expanding the TRO to block any troops from deploying to Portland.
00:14:21.560 Both sides arguing their case in front of the three-judge panel yesterday morning.
00:14:27.040 For the DOJ, Deputy Attorney General Eric McArthur arguing Portland's unrest meets the legal threshold for federal mobilization.
00:14:35.300 An active threat of rebellion and the feds are unable to enforce the law without assistance from the National Guard.
00:14:41.400 It's not yet clear when a decision is expected.
00:14:44.060 Over in Memphis, Tennessee, the federal crime crackdown making significant progress in less than two weeks.
00:14:52.120 In this case, Republican Governor of Tennessee Bill Lee welcoming more than a dozen agencies and the National Guard to clamp down on crime in one of America's most dangerous cities.
00:15:03.100 Attorney General Pam Bondi delivering a progress report in yesterday's cabinet meeting.
00:15:08.440 Secretary Hegseth and I were recently in Memphis.
00:15:10.880 We had 1,100 law enforcement officers in one room with us.
00:15:16.500 The Memphis PD, they were the happiest to see us.
00:15:19.840 We've been making arrests left and right so far.
00:15:22.380 We've made 562 arrests and seized 144 illegal guns.
00:15:28.260 Just in the short time we've been in Memphis.
00:15:30.580 Last night alone, we made 91 arrests, 19 firearms off the streets, and one was a warrant for a homicide, and four sex offenders who had active warrants.
00:15:43.740 One was a sex offender on a child.
00:15:47.320 Everything we did in Memphis was worth it, in my opinion, for that one arrest.
00:15:51.480 Think about that.
00:15:52.260 We got a child rapist off the streets, but yet we've made 562 arrests and still going strong in Memphis.
00:15:58.840 DHS Secretary Noem encouraging other Democrat-run cities like Memphis to follow their lead.
00:16:05.580 While we fight litigation and work with Pam on that, we're going to send more of our resources and men and women out there to keep everybody safe. 0.99
00:16:12.460 So no worries.
00:16:13.900 What we see in D.C. and what we see in Memphis for benefits for people in the safety and security, we'll see that in Chicago and Portland.
00:16:21.420 The numbers in Memphis, it's only a week, but the numbers have been amazing, I understand.
00:16:26.120 That's exactly right.
00:16:26.760 The crime numbers are way down.
00:16:28.520 Fantastic.
00:16:29.020 And it shows what a partnership can be between local law enforcement and the federal government.
00:16:33.420 And if we have to do it the hard way in Portland and Chicago, we will.
00:16:37.260 But the people demand the safety.
00:16:39.360 That'll do it for your AM update.
00:16:43.920 I'm Emily Jashinsky, host of After Party.

00:17:11.320 Mm, now you're cooking.
00:17:12.820 If you're hungry, deli brings the heat.

00:17:18.520 So does Martinique.
00:17:19.940 Mm, and that French cuisine?
00:17:21.960 Book it.
