00:16:38.980 Joe Biden welcomes Trump to the White House, shakes his hands so warmly.
00:16:42.820 I still believe it's like 50-50 that Joe Biden voted for Donald Trump because of outrage of

00:16:49.960 But in any event, not only did he basically hug him and warmly welcome him, he said, whatever
00:16:54.920 you need, Mr. President-elect, to smooth the transition, your transition back to power,

00:17:49.200 And they are now, I mean, I think they're days away from doing another Trump call in because
00:17:54.620 Trump will allow anyone to humiliate themselves before him and then he'll give out little crumbs

00:20:02.540 op-ed pages of the New York Times, the Washington Post.

00:20:10.340 And so you really feel like you're part of this powerful movement where you're claiming

00:20:18.360 Like, you're really at the front lines of the resistance.
00:20:21.820 And then the American people go to vote and they vote for, overwhelmingly, the exact person
00:20:28.280 that you've been claiming and telling them is the greatest threat to America and American

00:20:33.860 And not only do people go and elect him, but as you just showed in that clip, he's a racist,
00:20:38.220 he's a white supremacist.
00:20:39.160 And you have this huge migration, historic migration of non-white voters, Latino voters,
00:20:44.820 black voters, all non-white voters away from the Democratic Party to Trump.

00:20:54.220 And of course, part of it is, how do we get back our ratings so our network doesn't collapse

00:21:02.440 But a lot of it is a psychological internalization that, as you said, nobody gives a shit at all

00:21:09.520 The only people who listen to them are people who already are convinced by them.

00:21:17.300 And so they're desperate to say, how do we worm our way, weasel our way back into power?

00:21:31.240 And as long as they keep doing it, I do think he'll throw them some crumbs.
00:21:34.180 But the idea that they're going to be these influential figures ever after they've betrayed
00:21:38.200 every cause they profess to believe in, betrayed every faction of which they ever said they were

00:47:57.760 course, you're not going to want anybody in there who's anathema to the way things are

00:48:02.860 But that isn't the person who if Kamala Harris had been elected, she would have appointed people
00:48:07.920 they love, people who seem like they're, quote unquote, serious appointees who come out of
00:48:12.520 the ethos of these institutions who want to protect it and just reform it on the margins.

00:54:35.800 Because the Washington Post drops this exclusive about an alleged sexual assault,
00:54:42.500 you know, or rape.
00:54:45.900 And they're very excited about this piece against Pete Hegseth.
00:54:50.200 Let me just start with a lead.
00:54:51.200 The police investigated.
00:54:53.720 No charges were ever brought.
00:54:55.860 Pete has denied it.
00:54:57.740 And the woman came back asking for cash.
00:55:01.440 And she was married, and I believe is still married,
00:55:05.740 at the time she had this sexual encounter with Pete,
00:55:09.180 which now she claims was non-consensual.
00:55:11.440 And he says exactly the opposite, that that's not true.
00:55:15.700 But here are the facts as alleged.
00:55:17.760 So what's happened is a woman, a friend of the woman,
00:55:21.800 went to the Trump transition team, according to WAPO,
00:55:25.700 and presented them with a memo detailing these alleged claims by her friend against Pete.
00:55:31.780 And then Pete's lawyer, and then the memo got leaked to the Washington Post.
00:55:37.680 And now Pete's lawyer has gone on the record with the Washington Post to offer his side of the story.
00:55:42.200 It boils down to the following.
00:55:43.340 They say, Glenn, that in 2017, October 7th, 2017, he was asked to go out to Monterey, California,
00:55:51.120 and to speak with a group of conservative women, and that he did so,
00:55:56.620 and after the fact was having drinks in the bar.
00:55:58.840 They claim he had a couple of women there toward the end of their night of drinking,
00:56:04.180 and they allegedly texted his handler, who was part of the conservative women's group,
00:56:09.720 that he was getting sort of pushy in his request that they go back to his room with him.
00:56:17.520 At the time, the Post reports he was between marriages.
00:56:21.900 He's on his third marriage, and he was, I think, between number one and number two.
00:56:26.860 Anyway, the point is he wasn't cheating at this point.
00:56:29.260 But they say that this young handler came to the bar to sort of collect him as though he were her charge.
00:56:38.600 I mean, he's 44 now.
00:56:40.560 This was seven years ago, so he was a grown man still.
00:56:44.600 I don't know how to do the math.
00:56:45.420 37.
00:56:47.640 But apparently believed to need an escort back to his room.
00:56:51.620 Anyway, this woman comes back.
00:56:52.680 Now, this woman you should know who works for the California Federation of Republican Women
00:56:56.320 also had her husband and children in the hotel in a different room with whom she was staying.
00:57:01.360 Her husband and her children.
00:57:03.560 So they allege that she then took Pete Hegseth back to his room.
00:57:07.760 There is videotape, according to Hegseth's lawyer,
00:57:10.240 showing them arm in arm on the way to his room with the woman smiling and Hegseth drunk.
00:57:16.240 Apparently, the reports are that he was visibly drunk.
00:57:19.440 She got him away from these other two women.
00:57:21.440 They left, and then she was allegedly seen on the videotape delivering him to his room.
00:57:28.280 She definitely went into the room with him, and the two agree that a sexual encounter took place.
00:57:34.260 Whether it was consensual, they don't agree.
00:57:36.860 This is from the Washington Post.
00:57:38.660 This accuser did not remember anything until she was in Hegseth's hotel room
00:57:43.360 and then stumbling to find her hotel room.
00:57:46.520 So she blacked out the whole night.
00:57:48.040 Her memo says her memory of six to nine hours, quote, was very hazy,
00:57:52.940 and that her husband was searching for her, I'll bet, and was relieved when she finally showed up.
00:57:58.580 The following day, the woman returned home and, quote, had a memory of hazy,
00:58:02.680 a hazy memory of being raped the night before and had a panic attack.
00:58:09.140 She then went to the emergency room, they allege, in this memo of hers,
00:58:14.780 where she received a rape kit examination that was positive for semen.
00:58:18.160 She gave county authorities a statement about what happened.
00:58:22.060 They initiated an investigation.
00:58:23.860 The police did.
00:58:24.560 No charges were filed.
00:58:25.740 And they say that she, there was no evidence that contact was non-consensual.
00:58:35.060 According to Pete's lawyer, the medical examination of the woman produced no evidence
00:58:38.740 that the sexual encounter was non-consensual.
00:58:42.440 And a police investigation found no evidence to support charging Hegseth.
00:58:46.520 The lawyer says the woman was the aggressor, not Hegseth.
00:58:51.440 I will point out on the subject of whether there are injuries, Gabe Sherman.
00:58:56.620 I know, but Gabe Sherman, for what it's worth, is reporting that he has seen the police report
00:59:00.760 and that it alleges a bruise on her thigh.
00:59:03.820 But that did not make it into the Washington Post,
00:59:06.680 which has a stricter screening process than Gabe Sherman.
00:59:10.620 I don't know whether it's true or it's not.
00:59:12.800 That then the cops investigated that they chose not to pursue it.
00:59:17.800 And also this, according to Hegseth's lawyer, once the two were in his hotel room,
00:59:25.700 the woman did not leave.
00:59:26.940 She was the aggressor.
00:59:28.320 And after the encounter, she, quote, expressed concern because she had not gone back to her room
00:59:32.460 where her husband and children were.
00:59:34.860 And that Hegseth told the cops she planned to tell her husband
00:59:38.680 she had fallen asleep on the couch in another guest's room, according to the statement.
00:59:44.860 Sometime after the incident, when the cops said they weren't going to do anything about it,
00:59:48.940 they didn't think that there were grounds for charges,
00:59:50.460 the woman and her husband hired a lawyer to, quote,
00:59:52.760 ensure he did not get off without punishment.
00:59:55.060 And three years later, in February of 2020, they hired a lawyer.
00:59:59.680 They entered into negotiations with Hegseth's lawyer,
01:00:03.240 now says Pete felt we're blackmail,
01:00:07.000 and that he was innocent collateral damage in a lie
01:00:09.540 that the complainant was holding onto to keep her marriage intact.
01:00:13.520 But knowing it was the height of the Me Too movement,
01:00:16.380 he paid her a settlement, the amount of which is not included.
01:00:20.380 What do you make of this?
01:00:24.200 Here's my view on these issues generally.
01:00:27.180 It actually applies to the back age situation as well,
01:00:29.480 which I presume we're going to talk about.
01:00:31.020 But just to apply the rule generally,
01:00:33.860 if the police investigate an alleged crime
01:00:36.540 and conclude that there's no evidence even to charge the person,
01:00:40.820 let alone capable of convicting them,
01:00:43.280 which, of course, is the judgment when you decide
01:00:45.240 whether or not you're going to charge the person or indict,
01:00:47.460 I think the person is entitled to a presumption of innocence
01:00:50.660 about whether they committed a crime.
01:00:52.320 That said, in all these situations,
01:00:58.080 it's kind of impossible to know.
01:00:59.800 It's one person's word against the other.
01:01:02.780 And it is true that sometimes when there's sexual assault
01:01:09.260 or sexual harassment,
01:01:10.560 that there are all kinds of reasons
01:01:11.460 why the woman might not want to yell it at the moment.
01:01:15.760 But at the same time,
01:01:17.500 especially when you're dealing with a public figure like he is,
01:01:20.260 there's also motivations that someone might have
01:01:23.620 or even psychological motivations
01:01:25.200 to come and say that the person
01:01:27.240 had sex with them in a non-consensual way
01:01:30.600 in order to get money,
01:01:31.960 in order to justify to themselves what happened,
01:01:34.120 in order to justify their friends and family what happened.
01:01:36.800 And I think skepticism is required.
01:01:38.660 I mean, and when it all emerges
01:01:40.680 at the most politically opportune time,
01:01:43.260 this is always my issue with the Brett Kavanaugh allegations
01:01:45.480 from like 40 years earlier,
01:01:47.680 then suddenly he's a Supreme Court nominee
01:01:49.200 and Christine Bozzi-Ford and others come forward
01:01:51.500 is that you have to have skepticism.
01:01:55.480 The person is entitled to the benefit of the doubt.
01:01:57.460 I do not think we should be in a position
01:01:59.280 where we assume accusations to be true,
01:02:02.100 even if there was a payment made,
01:02:03.980 because even false accusations,
01:02:06.620 if brought in a lawsuit,
01:02:08.060 can destroy somebody's reputation
01:02:09.720 and someone might pay a person to avoid that,
01:02:11.880 even though they did nothing wrong,
01:02:13.540 because they know that even false accusations
01:02:15.760 can ruin them forever.
01:02:17.560 So we'll never know for certain what happened here
01:02:20.140 if the woman continues to persist in these allegations.
01:02:23.980 But for me, the presumption of innocence is very important.
01:02:27.960 And when the police go and investigate allegations,
01:02:31.720 like happened to Matt Gaetz with the Justice Department
01:02:33.580 or happened here with Pete Hegseth
01:02:36.260 and decide not even to bring charges
01:02:39.040 because there's no evidence,
01:02:40.040 that has to play a significant role
01:02:42.020 in how you assess these things.
01:02:43.420 I have so many questions about this story.
01:02:48.600 Number one, if she went the next day for a rape kit,
01:02:52.980 they would have done a drug test.

01:02:56.400 She seems to be suggesting she was given some sort of a drug.
