The Megyn Kelly Show - Performance of Outrage, and Gwyneth Paltrow Ski Crash Trial, with Jason Whitlock, Mark Geragos, Jonna Spilbor, and Angenette Levy ｜ Ep. 518

00:00:00.000 When I found out my friend got a great deal

00:00:02.160 on a wool coat from Winners,

00:00:03.760 I started wondering,

00:00:05.440 is every fabulous item I see from Winners?

00:00:08.560 Like that woman over there with the designer jeans. 1.00

00:00:11.260 Are those from Winners?

00:00:12.780 Ooh, or those beautiful gold earrings.

00:00:15.260 Did she pay full price?

00:00:16.600 Or that leather tote?

00:00:17.600 Or that cashmere sweater?

00:00:18.500 Or those knee-high boots?

00:00:20.300 That dress?

00:00:21.080 That jacket?

00:00:21.740 Those shoes?

00:00:22.780 Is anyone paying full price for anything?

00:00:25.800 Stop wondering.

00:00:27.000 Start winning.

00:00:27.940 Winners.

00:00:28.520 Find fabulous for less.

00:00:30.620 Welcome to The Megyn Kelly Show.

00:00:32.520 Your home for open, honest, and provocative conversations.

00:00:42.020 Hey everyone, I'm Megyn Kelly.

00:00:43.660 Welcome to The Megyn Kelly Show.

00:00:44.920 Very busy news day as we learn new details

00:00:47.480 about the shooter in Nashville

00:00:48.680 and the heroism of the adults involved.

00:00:51.840 We will also get to the absolutely disgusting displays

00:00:55.900 of anger being lobbed at conservatives 0.70

00:00:58.820 and Christians in the wake of this attack.

00:01:02.880 The victims of the attack.

00:01:07.120 On a lighter note, in our second hour,

00:01:08.880 I have been waiting to take a deep dive

00:01:10.800 into this Gwyneth Paltrow trial.

00:01:12.380 We're going to do that.

00:01:13.700 I'm sorry.

00:01:14.600 I've been watching it every day after the show.

00:01:16.140 I can't get enough of it.

00:01:18.300 There's no one to root for.

00:01:21.060 No one.

00:01:22.180 No one.

00:01:22.980 I'll tell you why.

00:01:24.040 I'll play you all the fun soundbites

00:01:25.580 and we'll have a great legal panel.

00:01:28.060 So we need to laugh a little.

00:01:29.460 And this is just the key to doing that.

00:01:31.380 We'll go there in just a bit.

00:01:33.180 But first, we're going to talk about the state of our nation.

00:01:35.900 It really does appear.

00:01:37.200 It does feel like we're at some sort of crossroads right now.

00:01:40.800 And one of our favorite guests is back to discuss it all.

00:01:44.380 He lives just minutes away from the scene

00:01:46.400 of the Nashville shooting.

00:01:48.060 And wow, does he have some thoughts on this

00:01:49.700 and a number of other topics in the news.

00:01:51.540 Joining me now, Jason Whitlock,

00:01:52.880 host of the Blaze TV's Fearless.

00:01:54.960 With Jason Whitlock, he's also a columnist

00:01:57.060 with the Blaze.

00:01:58.600 Jason, welcome back to the show.

00:01:59.640 Great to have you.

00:02:01.320 Thank you for having me, Megan.

00:02:03.560 It's always good to be here.

00:02:05.340 I'm sorry to hear that you live nearby the shooting.

00:02:08.520 I mean, that just brings a next level of trauma

00:02:11.320 for anybody nearby it.

00:02:13.300 And I saw your tweet the other day saying,

00:02:15.760 you know, say a prayer for our friends at The Daily Wire

00:02:17.820 who are under attack right now by NBC News,

00:02:22.880 a contributor there, blaming them

00:02:25.320 in the wake of this shooting

00:02:27.380 because it was a trans.

00:02:29.460 The way you're supposed to say it is

00:02:31.080 this is a biological female who went trans man 0.99

00:02:33.640 who committed the shooting.

00:02:37.220 And they're just jumping.

00:02:39.060 It wasn't just this NBC guy.

00:02:40.720 Many in the media just jumped right to,

00:02:43.200 oh, then this person's anger

00:02:45.360 that caused her to shoot children 1.00

00:02:48.260 must be attributable to guys

00:02:50.680 like Matt Walsh of The Daily Wire.

00:02:53.120 Therefore, it's their fault.

00:02:54.700 So I agreed.

00:02:56.000 I appreciated your tweet

00:02:57.060 and agreed with it fully.

00:02:59.420 Well, I think the work that Matt Walsh

00:03:02.840 has been doing,

00:03:04.240 starting with what is a woman, 0.95

00:03:05.920 has been very important work,

00:03:08.240 defending a fundamental truth

00:03:09.820 and defending women just in general. 0.97

00:03:12.540 And so I think what Matt has been doing

00:03:15.320 has been very courageous.

00:03:16.400 And I've always felt that he did this

00:03:21.100 knowing that he was going to face

00:03:23.540 some severe blowback, pushback

00:03:26.300 and threats and potentially violence.

00:03:30.280 And so, you know,

00:03:31.420 after thinking about the families involved here

00:03:34.160 that did suffer these consequences,

00:03:36.280 I started thinking about Matt Walsh

00:03:38.980 and Ben Shapiro and Michael Knowles

00:03:41.740 and everybody over at The Daily Wire

00:03:43.480 because, you know, here in Nashville,

00:03:45.860 this is kind of turning into the headquarters

00:03:48.740 or ground zero of a culture war

00:03:51.580 that is centered around gender dysphoria,

00:03:56.480 gender identity, the LGBTQ issues.

00:04:00.940 And I think because of the work that I do,

00:04:05.380 it's ground zero for the discussion about race.

00:04:08.980 And how race is being used to silence people

00:04:12.540 and silence the truth

00:04:13.820 and promote a lot of this gender ideology stuff 0.99

00:04:17.720 that's becoming pervasive.

00:04:20.040 And so I've always known

00:04:22.360 that Matt was taking a real risk.

00:04:24.520 And then when you see this type of violence

00:04:26.940 directed at Christians,

00:04:29.180 directed at believers

00:04:30.180 and perpetrated by someone

00:04:32.860 who clearly had some gender dysphoria

00:04:36.380 and some mental health issues,

00:04:38.980 that America has,

00:04:41.420 American culture has seemingly chosen, 0.96

00:04:43.580 we're going to treat with surgeries

00:04:45.480 and not with therapy and spirituality.

00:04:50.460 And we're just going to chemically castrate people

00:04:53.740 and remove parts.

00:04:56.540 And, you know, Matt, the Daily Wire crew,

00:05:00.440 those of us that are Christian believers,

00:05:02.720 we stand against that.

00:05:04.280 And there's going to be real blowback for that.

00:05:06.820 It's absolutely absurd. 0.98

00:05:08.360 They're acting like a trans person got killed 0.97

00:05:12.540 by a transphobic person. 0.95

00:05:15.300 That's what they're acting like.

00:05:16.540 That's not what happened. 0.99

00:05:18.040 A trans person unleashed hell 1.00

00:05:21.240 on a bunch of nine-year-olds, 0.92

00:05:24.060 took the lives of three nine-year-olds

00:05:26.020 and three adults

00:05:27.000 who devoted their lives to teaching

00:05:29.400 and helping children.

00:05:30.380 That's what happened.

00:05:31.200 The reaction in the media suggests

00:05:33.100 it's the opposite way.

00:05:34.040 I think what the trans people would argue,

00:05:38.340 I would disagree with them,

00:05:39.480 but what they would argue is

00:05:40.900 that that Audrey Hale is angry.

00:05:45.200 No, we don't like to say the names of the shooters.

00:05:47.180 Well, let's not help this person get the infamy

00:05:48.920 she so desperately sought.

00:05:50.820 Well, I think they believe her anger

00:05:54.020 is a byproduct of American culture

00:05:56.980 not being accepting of trans people.

00:06:00.260 And their argument is she wouldn't be angry

00:06:02.920 and she wouldn't have done this kind of violence 0.94

00:06:04.420 if Matt Walsh, Ben Shapiro, Candace Owens,

00:06:08.780 Michael Knowles, Jason Whitlock

00:06:10.220 were more accepting of trans people

00:06:12.940 and normalized this.

00:06:15.100 And listen, I think that her anger

00:06:18.160 and the anger of a lot of people in that crowd

00:06:21.000 is because they don't have a correct understanding

00:06:26.140 of who they actually are.

00:06:28.540 And that would be frustrating for anybody.

00:06:32.380 You know, and so I get their frustration.

00:06:37.080 I think they need therapy, mental help.

00:06:40.520 I think they need a better understanding

00:06:42.320 from my view as a Christian.

00:06:44.620 They need a better understanding of God

00:06:46.320 and that they're image bearers of God

00:06:48.020 and that they're made in God's image.

00:06:50.120 We've had Christian parents

00:06:51.040 and embrace that identity

00:06:53.380 rather than defining themselves

00:06:56.060 by sexuality and other things.

00:06:58.820 Yes, no, I get all that.

00:06:59.460 I get all that.

00:06:59.840 But like, I mean, I will say

00:07:00.740 it sounds like her parents are faithful

00:07:02.200 and that she was put through

00:07:03.280 the same Christian school

00:07:04.380 that she went and shot up.

00:07:05.880 So I don't know that she took to it,

00:07:08.200 but the introduction of faith in her life

00:07:10.260 had been there. 0.86

00:07:11.920 But she was obviously mentally disturbed.

00:07:13.960 And I get the argument, right,

00:07:16.020 that people who are not accepting

00:07:18.540 of gender dysphoria as a thing

00:07:21.240 or of the trans lifestyle,

00:07:22.300 however you want to phrase it,

00:07:23.740 that this is what the left wants to blame.

00:07:25.760 People like Matt or Ben, Michael.

00:07:29.460 But if you want to play that game,

00:07:32.140 you know, you could just as easily play it

00:07:34.020 with the far left activists,

00:07:36.800 trans and otherwise,

00:07:38.480 are ratcheting up the rhetoric

00:07:39.900 for people like this shooter,

00:07:42.700 telling them over and over again, 0.99

00:07:44.200 everyone wants to kill you. 1.00

00:07:45.300 They want to erase you. 1.00

00:07:46.900 They're trying to kill you. 0.99

00:07:48.280 There's this crazy video posted

00:07:49.740 on Libs of TikTok today

00:07:50.980 where there's this trans woman. 0.96

00:07:55.640 I don't know.

00:07:56.680 It's a trans. 0.94

00:07:57.240 It's a biological man, I think.

00:08:00.120 Talking about how when the police

00:08:01.820 come to arrest you for being trans, 1.00

00:08:04.980 you you attack them, you shoot them. 1.00

00:08:07.000 This is a lunatic. 1.00

00:08:08.040 This is a lunatic who shouldn't be 1.00

00:08:09.800 in front of a camera 1.00

00:08:10.520 and doesn't need any more amplification.

00:08:12.900 But that rhetoric's out there

00:08:14.580 are trying to spin up

00:08:16.220 the shooters of this world

00:08:17.760 like this person whose name

00:08:18.900 we're not we're not saying, right?

00:08:20.520 I mean, if you want to blame rhetoric,

00:08:22.300 you could go that way, too.

00:08:24.840 Megan, the rhetoric

00:08:26.580 that's being used

00:08:27.600 to make trigger everyone

00:08:29.240 emotional and violent

00:08:31.320 is across the board.

00:08:33.500 We're in a culture

00:08:34.640 where everybody's a victim.

00:08:36.920 Every day I could turn on the TV

00:08:39.080 or hop on social media

00:08:41.360 and find rhetoric that says, 0.99

00:08:43.940 Jason, you're black. 0.99

00:08:44.980 You're a victim. 1.00

00:08:45.780 This country has exploited you.

00:08:47.340 This country owes you something. 0.99

00:08:48.840 You should be mad as hell. 1.00

00:08:51.300 And if a white person 1.00

00:08:52.800 doesn't pronounce your name properly 0.96

00:08:56.260 or cut you off in traffic

00:08:58.820 or is rude to you at a grocery line,

00:09:01.320 that's a sign of Americans' 0.81

00:09:03.160 white supremacy.

00:09:03.860 And you need to get 0.99

00:09:05.560 in that person's face.

00:09:07.140 Or if the courts

00:09:08.640 make a ruling

00:09:09.880 that you don't like,

00:09:11.180 you need to take to the streets 0.99

00:09:12.660 and burn down buildings 0.98

00:09:13.880 and terrorize people.

00:09:16.100 That messaging

00:09:17.300 is across the board.

00:09:18.940 And so this woman

00:09:20.680 was radicalized

00:09:22.000 the same way I'm seeing

00:09:23.420 a lot of young black kids

00:09:25.300 radicalized

00:09:26.740 by this victim ideology

00:09:29.040 that's being preached

00:09:30.180 and stuffed down

00:09:31.100 everyone's throat.

00:09:32.100 It's people have issues

00:09:36.200 and that's why we have therapists. 0.71

00:09:38.700 That's why we have ministers.

00:09:40.400 And that's why we have parents.

00:09:42.160 We have people to help people

00:09:44.540 work through their issues

00:09:46.240 rather than just blaming everyone else

00:09:49.280 and then turning violent

00:09:51.460 because, you know,

00:09:53.680 we might, people might disagree.

00:09:55.860 I don't see myself as a victim.

00:09:58.680 I don't see America

00:10:00.480 as inherently racist.

00:10:01.900 or irredeemably racist.

00:10:03.400 I don't see America

00:10:05.900 as irredeemably sexist

00:10:07.440 or very,

00:10:10.780 I see America

00:10:12.240 as sympathetic

00:10:12.900 towards trans people,

00:10:14.620 empathetic towards trans people.

00:10:16.660 But there are some,

00:10:18.520 many of us

00:10:19.000 that don't believe

00:10:19.840 that surgery

00:10:21.120 is the right solution

00:10:22.500 for their issues.

00:10:24.640 You know,

00:10:25.220 counseling and mental health

00:10:26.800 are the right solutions.

00:10:28.520 But, you know,

00:10:30.180 everybody,

00:10:31.400 women are being told

00:10:32.540 they're victims

00:10:33.280 and that men

00:10:34.020 have mistreated them

00:10:35.320 for hundreds of years

00:10:36.380 and taken advantage of them.

00:10:38.320 And so everybody

00:10:39.660 is supposed to turn violent

00:10:41.460 in reaction

00:10:42.720 to their mistreatment.

00:10:44.700 And we just see it

00:10:46.380 with so many young people.

00:10:48.060 And that's why,

00:10:49.120 you know,

00:10:49.620 we're at each other's throats

00:10:50.740 right now in this country.

00:10:51.820 It's a sad time.

00:10:54.660 It's so not reflective

00:10:57.160 of the childhood

00:10:58.360 and my first 40 years

00:11:01.980 on this planet.

00:11:03.140 It's only been

00:11:04.060 in the last 10 years

00:11:05.320 where everybody

00:11:07.000 is a victim

00:11:08.420 and everybody

00:11:09.380 is supposed to be angry

00:11:10.880 and social media

00:11:13.080 is drumming up

00:11:14.080 a lot of this.

00:11:15.460 I mean,

00:11:15.660 I have to say

00:11:16.440 it's very rare

00:11:19.540 to have a woman

00:11:20.120 commit a crime like this.

00:11:21.100 Very rare,

00:11:22.320 you know,

00:11:22.560 and this was

00:11:23.640 a trans person,

00:11:24.700 so it's a woman

00:11:25.380 who doesn't identify

00:11:26.220 as a woman.

00:11:28.040 But women, 1.00

00:11:29.900 actual women 1.00

00:11:30.780 are the victims

00:11:31.700 of trans activists

00:11:33.260 who want to take over

00:11:34.520 our sports

00:11:35.240 and our locker rooms

00:11:36.680 and our bathrooms

00:11:37.300 and our private spaces

00:11:38.200 and now our

00:11:38.980 gynecologist offices.

00:11:40.780 We are the victims 1.00

00:11:42.020 of those crazy-ass activists. 0.99

00:11:44.940 And so I do feel like 0.99

00:11:46.280 I'm,

00:11:47.740 but we don't

00:11:48.900 shoot up people. 0.79

00:11:50.140 That is not 0.99

00:11:50.920 how women 1.00

00:11:51.540 tend to handle

00:11:53.520 their upset.

00:11:55.020 And so it's no accident

00:11:56.540 to me that,

00:11:57.220 you know,

00:11:57.340 you find out this woman,

00:11:58.400 this particular woman

00:11:59.120 who resorted to violence

00:12:00.680 was deeply disturbed.

00:12:02.680 The reports out today,

00:12:04.240 the parents phrase it

00:12:05.360 apparently as

00:12:05.880 an emotional disorder

00:12:07.460 that she was being

00:12:08.540 treated for.

00:12:09.540 Turns out the parents,

00:12:11.040 I'm sure they were

00:12:11.980 nice people

00:12:12.580 who were trying

00:12:13.140 to raise a good child,

00:12:14.300 but she was hiding

00:12:16.880 a cache of weapons

00:12:18.720 in her house

00:12:20.960 where she lived

00:12:21.480 with her parents.

00:12:22.820 They did not want

00:12:23.560 her to own guns 0.99

00:12:24.420 because of her

00:12:25.440 emotional disorder.

00:12:26.340 Well,

00:12:26.520 they failed.

00:12:27.420 They failed.

00:12:28.340 I'm sorry,

00:12:28.800 but they did.

00:12:29.180 I didn't have

00:12:30.940 a lot of sympathy

00:12:31.400 for the grandfather

00:12:32.120 out in Uvalde

00:12:32.840 who shrugged

00:12:33.720 his shoulders

00:12:34.200 when he knew

00:12:35.240 he had a potentially

00:12:36.100 violent kid

00:12:36.700 living in his house.

00:12:37.920 Oh,

00:12:38.100 you can't force him

00:12:38.780 to go to school.

00:12:39.440 Oh,

00:12:39.600 well.

00:12:40.480 No,

00:12:41.000 you have the charge

00:12:41.860 of a minor

00:12:42.340 or somebody

00:12:42.880 who's even 18

00:12:43.720 in your house

00:12:44.280 and in this case,

00:12:45.320 not a minor,

00:12:46.020 but somebody

00:12:46.340 who's emotionally

00:12:46.840 disturbed in your kid.

00:12:48.180 For the rest of society,

00:12:49.420 you must make sure

00:12:50.520 you must make sure

00:12:51.700 this person does not

00:12:52.560 have access to the guns.

00:12:54.560 And the reporting

00:12:55.780 is that she had

00:12:56.420 as many as seven

00:12:57.220 legally purchased

00:12:58.740 from various local stores,

00:13:00.480 including three

00:13:01.440 that she used yesterday,

00:13:03.900 the day before yesterday,

00:13:04.840 as she gunned down 1.00

00:13:05.480 the six victims

00:13:06.120 at the Covenant School.

00:13:07.580 So,

00:13:08.040 okay,

00:13:08.420 that's the latest reporting

00:13:09.720 that she was disturbed.

00:13:11.600 The parents knew it.

00:13:12.980 They didn't want her

00:13:13.900 to have the guns,

00:13:14.900 but she had the guns.

00:13:15.780 And on top of that,

00:13:16.440 Jason,

00:13:16.700 the reporting today

00:13:17.280 is that they told police,

00:13:19.080 this is from the Daily Mail,

00:13:20.240 I believe,

00:13:21.920 the parents told police

00:13:22.780 she had a red bag

00:13:23.540 when she was leaving

00:13:24.080 the house ahead

00:13:24.640 of the shooting.

00:13:25.620 They asked her

00:13:26.480 what was in the bag,

00:13:27.800 but ultimately dismissed it,

00:13:29.080 thinking she did not

00:13:29.780 own any weapons.

00:13:30.980 Now,

00:13:31.160 that in and of itself

00:13:31.880 is suspicious too.

00:13:33.140 What?

00:13:33.940 Who stops the person

00:13:34.960 on the way out of the house

00:13:35.700 and says,

00:13:36.180 what's in your bag?

00:13:37.200 I believe they must have

00:13:38.140 had reason to believe

00:13:39.020 there was something

00:13:39.680 unsafe in there.

00:13:41.480 I'm not blaming this

00:13:42.620 on the parents,

00:13:43.280 but let's face it,

00:13:44.820 parents who look the other way

00:13:45.900 when they have

00:13:46.260 an emotionally disturbed child

00:13:48.000 are part of the problem

00:13:49.900 on these mass shootings.

00:13:50.960 Listen,

00:13:53.980 parents and the destruction

00:13:55.740 of family

00:13:56.400 are certainly at the root

00:13:57.960 of a lot of the chaos

00:13:59.160 we have going on in America.

00:14:01.460 I am sympathetic

00:14:03.980 towards these parents,

00:14:05.480 though,

00:14:06.260 because I don't believe America,

00:14:09.000 I don't think corporate media

00:14:10.180 is allowing us

00:14:11.320 to deal with the fact

00:14:12.880 that Black Lives Matter,

00:14:15.900 a lot of these LGBTQ,

00:14:18.880 transgender movements, 0.96

00:14:20.260 these are terrorist groups 0.98

00:14:22.040 that are radicalizing

00:14:23.260 young people.

00:14:24.560 I saw a comment,

00:14:26.080 I think,

00:14:26.580 that Candace Owens captured

00:14:27.960 where the mother,

00:14:30.080 I think,

00:14:30.520 had said,

00:14:31.020 you know,

00:14:31.340 my child was pretty normal

00:14:32.660 until she went off

00:14:33.640 to college.

00:14:34.620 And again,

00:14:35.600 these college campuses

00:14:37.100 are radicalizing

00:14:39.120 our kids

00:14:40.200 and teaching them hate

00:14:42.340 and teaching them

00:14:44.120 to adopt

00:14:45.240 a victim mentality

00:14:46.860 that says

00:14:47.920 the world owes them something

00:14:49.560 and that the world

00:14:50.320 is completely unfair to them.

00:14:52.240 And so just like we say

00:14:53.500 Al-Qaeda

00:14:54.180 or the Taliban

00:14:55.040 radicalizes people,

00:14:57.160 Black Lives Matter

00:14:57.760 does the same thing.

00:14:59.380 Much of this trans movement 0.99

00:15:01.120 does the exact same thing.

00:15:03.620 They radicalize

00:15:04.620 and program

00:15:05.340 these young people

00:15:06.400 to turn violent

00:15:08.140 and to turn very hateful

00:15:09.860 towards this country,

00:15:11.460 towards Christians,

00:15:13.020 towards traditional thought,

00:15:15.080 towards conservatives.

00:15:16.300 we're all young people

00:15:20.020 in particular

00:15:20.680 are vulnerable to this

00:15:22.600 and a lot of it

00:15:23.760 is over social media.

00:15:26.320 And so I do,

00:15:28.100 Megan,

00:15:28.260 I'm going to disagree.

00:15:28.900 I feel sympathy

00:15:30.360 and I'm sure these parents

00:15:31.420 aren't blameless,

00:15:32.140 no one is,

00:15:33.300 but I feel sympathetic for them.

00:15:35.400 I say it all the time.

00:15:36.320 I don't have kids.

00:15:37.480 I feel sympathy for you

00:15:39.640 as a parent.

00:15:40.740 Like,

00:15:40.860 it's so much harder

00:15:42.160 than when we were growing up.

00:15:44.180 I've been talking

00:15:45.660 about this for years,

00:15:46.880 how much harder it is

00:15:48.000 for a parent's voice

00:15:49.220 to be heard

00:15:50.060 and to have a voice

00:15:51.320 of authority

00:15:51.980 inside a home.

00:15:53.280 When I grew up,

00:15:54.540 Megan,

00:15:55.080 there was one record player

00:15:56.500 in the house,

00:15:57.960 maybe one TV,

00:15:59.120 and my mom

00:16:00.580 could be in her bedroom

00:16:01.960 and know exactly

00:16:03.800 what I was doing

00:16:04.640 in the living room

00:16:05.280 just by sound.

00:16:06.280 And she would shout out,

00:16:07.520 Jason,

00:16:08.540 get out of that refrigerator.

00:16:10.380 Get out the kitchen. 1.00

00:16:12.060 Quit doing that.

00:16:13.020 Leave your brother alone.

00:16:14.720 And now,

00:16:16.260 kids got headphones on.

00:16:18.140 They're off

00:16:18.700 in their own little worlds

00:16:20.080 on their cell phones,

00:16:21.640 on their iPads,

00:16:23.300 in their rooms,

00:16:24.320 listening to God knows what.

00:16:26.140 It's so much harder

00:16:27.580 for you guys as parents

00:16:29.080 and so many other people

00:16:32.640 have access to your kids

00:16:34.540 nonstop.

00:16:36.880 Godspeed to all of you.

00:16:38.020 I don't know

00:16:38.420 how you guys pull it off.

00:16:39.800 I say that in all seriousness.

00:16:41.260 Of course,

00:16:41.720 we always have this

00:16:42.560 where you're more forgiving

00:16:43.960 and I'm less forgiving,

00:16:44.920 I think.

00:16:45.720 But I am less forgiving

00:16:49.380 because I'll give you an example.

00:16:50.720 So there's this great kid.

00:16:54.040 I think of him as a kid.

00:16:55.100 He's a grown-up now.

00:16:55.840 His name is Max Stossel.

00:16:57.400 And he's the child

00:16:58.800 of John Stossel,

00:17:00.160 my old pal from Fox News.

00:17:01.720 And he'd been on ABC News

00:17:02.780 for tons of years.

00:17:04.340 And a great, great guy.

00:17:05.640 He's been on the show.

00:17:06.280 And we're friends with the family.

00:17:08.840 Max has gone on to become

00:17:10.140 one of these,

00:17:11.340 almost like a Tristan Harris

00:17:12.480 who worked inside Facebook

00:17:13.960 and then became a whistleblower

00:17:15.060 about how Facebook manipulates us

00:17:16.760 and our children in particular.

00:17:18.640 He's kind of in that role now

00:17:20.120 and he's going around

00:17:20.720 to various schools

00:17:21.460 and he's talking about social media.

00:17:25.160 And he's great

00:17:25.940 because he's young

00:17:26.540 and he's hip and he's cool.

00:17:27.800 And he talks directly to the kids.

00:17:29.280 It's one thing for me to be like,

00:17:30.460 no social media.

00:17:31.740 It's bad for you.

00:17:32.900 It's quite another,

00:17:33.700 have this young, cool guy

00:17:35.140 stand in front of the kids

00:17:36.560 and say,

00:17:37.140 it's going to mess up your life

00:17:38.580 and here's how.

00:17:39.780 So he's doing that

00:17:40.700 and I love it.

00:17:41.560 And he went to recently

00:17:43.580 some schools in our area

00:17:44.580 and the kids were asked,

00:17:48.220 raise your hand if you're not,

00:17:50.100 these are middle schoolers,

00:17:51.200 raise your hand

00:17:51.580 if you are not on social media.

00:17:53.640 And my kids both raised their hands.

00:17:56.520 My son's 13.

00:17:57.540 My daughter's about to turn 12.

00:17:59.300 And I said,

00:18:00.520 how many people around you

00:18:01.660 also had their hands up?

00:18:03.320 And my son said,

00:18:05.820 I think there were literally

00:18:06.600 like four of us,

00:18:08.280 you know,

00:18:08.500 out of hundreds of kids,

00:18:09.760 like four.

00:18:11.400 And, you know,

00:18:12.540 Doug and I have been telling them

00:18:13.620 all along,

00:18:13.960 you're not,

00:18:14.500 sorry,

00:18:14.940 you're not getting on social media.

00:18:16.380 You know,

00:18:16.660 I've said before,

00:18:17.740 we kind of use the fact

00:18:18.800 that I'm out in the public eye

00:18:19.980 as an excuse,

00:18:21.100 you know,

00:18:21.420 like just,

00:18:22.540 you can't be doing that.

00:18:23.440 But also we tell them the truth,

00:18:24.960 it's bad for you.

00:18:25.880 It's,

00:18:26.120 there's all the studies show

00:18:27.140 it's terrible for you.

00:18:28.560 And there are other ways

00:18:29.400 for you to communicate

00:18:29.960 and maintain friendships.

00:18:31.520 And it was so great

00:18:32.960 to have the backup

00:18:33.560 from this,

00:18:34.320 you know,

00:18:34.540 Max Stossel

00:18:35.280 saying exactly

00:18:35.980 the same stuff to them.

00:18:36.980 And I was really happy

00:18:38.200 that my kids felt like,

00:18:40.400 cool,

00:18:40.920 you know,

00:18:41.280 I've managed to dodge

00:18:42.440 a bullet here.

00:18:43.800 I'm a little safer

00:18:44.860 than I knew.

00:18:45.760 And I'm glad.

00:18:46.700 And even my daughter,

00:18:47.440 there's,

00:18:47.640 there's some dust up

00:18:48.660 with the friends.

00:18:49.400 Somebody said something

00:18:50.160 on some social media.

00:18:51.220 She does,

00:18:51.860 she's not touching it.

00:18:52.760 She has nothing to do with it.

00:18:53.940 She's not going to get called in

00:18:55.020 by the principal

00:18:56.320 or anybody else.

00:18:57.400 She's not even on social.

00:18:58.460 So the parents need to be

00:19:01.440 the bumper alleys,

00:19:03.160 you know,

00:19:03.380 like that we need to make sure

00:19:04.420 the ball stays on the lane.

00:19:05.760 That's what we're there for.

00:19:07.160 And yes,

00:19:07.700 it's hard,

00:19:08.460 but it's our job.

00:19:11.480 It is your job,

00:19:13.680 but I just,

00:19:16.160 technology is turning out

00:19:19.140 to be the ruination

00:19:20.420 of this country.

00:19:21.860 I just,

00:19:22.900 I just believe that.

00:19:24.600 And it's because

00:19:26.060 it's so vindictive

00:19:27.580 and so mean-spirited.

00:19:29.720 And,

00:19:29.820 and so,

00:19:30.800 I mean,

00:19:31.500 look,

00:19:32.060 I'm,

00:19:32.500 I hate to drive us

00:19:34.300 a different direction,

00:19:35.240 but,

00:19:35.420 but it's just on my mind.

00:19:36.760 Look at the woman 1.00

00:19:37.740 in Mississippi,

00:19:39.620 the news anchor

00:19:40.740 for 20 years.

00:19:42.040 She repeats something

00:19:43.580 that's very popular

00:19:44.940 in,

00:19:46.020 in,

00:19:47.140 in the culture

00:19:48.280 and American culture.

00:19:49.640 For shizzle,

00:19:50.240 my nizzle.

00:19:51.620 Snoop Dogg

00:19:52.200 says it all the time.

00:19:53.160 And because of

00:19:54.720 social media,

00:19:55.520 in my opinion,

00:19:56.520 they fired this woman 1.00

00:19:58.060 because her boss

00:19:59.220 is afraid of the

00:20:00.540 social media backlash.

00:20:01.980 And he understands

00:20:03.360 or she understands

00:20:04.860 social media culture

00:20:06.360 that if she doesn't

00:20:07.680 fire this woman 1.00

00:20:08.760 for a harmless joke. 0.97

00:20:11.440 Jason,

00:20:12.080 can I,

00:20:12.320 can I interrupt you

00:20:13.060 just to,

00:20:13.560 I know we have,

00:20:14.260 we have it.

00:20:14.820 So let me play it

00:20:15.560 for the audience

00:20:16.020 so they know

00:20:16.380 what we're talking about.

00:20:17.340 This is WLBT,

00:20:19.080 the NBC affiliate

00:20:19.820 in Jackson,

00:20:20.440 Mississippi.

00:20:21.120 They were having

00:20:21.780 an on-air discussion

00:20:22.560 about,

00:20:23.160 Snoop Dogg wines

00:20:25.160 and a colleague

00:20:26.600 joked about

00:20:27.160 the news anchor

00:20:27.820 and meteorologist

00:20:28.520 Barbie Bassett

00:20:29.300 getting a tattoo

00:20:29.900 of the rapper

00:20:30.480 like Martha Stewart 0.78

00:20:31.460 did in a recent commercial

00:20:32.640 and then she responded

00:20:34.100 as you just said,

00:20:35.140 here is that exchange.

00:20:37.100 He ought to have

00:20:37.820 a collaboration

00:20:38.320 with Julie.

00:20:39.620 No telling

00:20:40.160 what Snoop Dogg

00:20:40.960 and Julie Leavenway

00:20:41.760 could come up with.

00:20:42.660 I think that'd be

00:20:43.160 pretty cool.

00:20:44.080 Well,

00:20:44.260 we know it,

00:20:44.700 she'd have a Snoop Dogg 0.88

00:20:45.900 tattoo on her shoulder.

00:20:47.120 A shizzle,

00:20:47.640 my nizzle.

00:20:48.400 I'm telling you,

00:20:49.400 Julie,

00:20:49.620 what do you think

00:20:50.000 about that?

00:20:51.220 Huh.

00:20:51.760 Huh, she says.

00:20:52.720 So that's the exchange

00:20:56.240 that now has this anchor

00:20:57.280 off the air,

00:20:58.160 off the website.

00:20:58.980 They haven't officially

00:20:59.560 said she's fired,

00:21:00.380 but she appears to be fired.

00:21:01.400 When they take you

00:21:01.980 off the website,

00:21:03.000 you're a goner.

00:21:04.260 So go ahead.

00:21:05.880 Well,

00:21:06.720 so the Julie 0.98

00:21:07.900 who's off camera

00:21:08.960 is more social media savvy

00:21:11.180 than the anchor

00:21:11.980 and that's why Julie goes, 0.97

00:21:13.620 huh, 0.98

00:21:14.140 the black guy 0.94

00:21:15.580 sitting on,

00:21:17.180 standing on the other side,

00:21:18.280 he's more socially aware.

00:21:19.860 That's why he put his head

00:21:20.980 down and said,

00:21:21.480 oh no,

00:21:22.440 social media is going

00:21:23.440 to come for this woman

00:21:24.680 and she's going to

00:21:26.040 possibly lose her job 0.93

00:21:27.700 or be embarrassed.

00:21:29.740 And so this is how

00:21:30.680 social media has normalized.

00:21:32.940 In a normal society,

00:21:34.720 before social media

00:21:35.980 had taken over,

00:21:37.880 people would have laughed

00:21:38.980 at this woman,

00:21:40.220 given her a hard time.

00:21:41.440 Oh,

00:21:41.860 you shouldn't have said that.

00:21:43.320 And that would have been it.

00:21:46.060 But social media

00:21:47.020 has trained us

00:21:48.040 to believe,

00:21:49.060 oh my God,

00:21:49.760 she's done something

00:21:50.600 that's going to cost her a job. 1.00

00:21:52.200 I better not participate.

00:21:54.200 And so their reaction

00:21:55.420 makes it even worse.

00:21:57.360 This is the damage

00:21:58.860 that social media

00:21:59.780 has done

00:22:00.400 to our engagement

00:22:01.460 and communication

00:22:02.580 with each other.

00:22:03.980 It's weaponized

00:22:05.360 everything

00:22:06.140 and turned us

00:22:07.520 all against each other.

00:22:09.100 I know I'm

00:22:09.840 beating a horse

00:22:10.760 that we've somewhat covered

00:22:13.420 and it's my pet project

00:22:17.080 trying to get people

00:22:17.980 to understand

00:22:18.720 what social media

00:22:20.380 has done to us.

00:22:22.300 And we've all turned guns

00:22:25.420 on each other

00:22:26.100 at any time.

00:22:26.620 We're all just content.

00:22:28.560 And how can we exploit

00:22:30.220 each other's content

00:22:31.260 for our own purposes?

00:22:34.160 And to sit here

00:22:35.540 and see this,

00:22:36.280 you know,

00:22:37.940 55-year-old woman

00:22:39.500 that meant no harm,

00:22:40.980 that's put together

00:22:41.740 a great TV career,

00:22:43.540 she's ruined 1.00

00:22:44.340 over a harmless joke

00:22:46.520 and over a word

00:22:49.800 that I'm sure

00:22:50.640 she didn't really

00:22:51.400 even know what it meant.

00:22:52.660 But even if she did,

00:22:54.980 pop culture

00:22:55.620 has normalized.

00:22:56.380 It's in every rap song.

00:22:58.080 Snoop Dogg

00:22:58.540 is in virtually

00:22:59.320 every commercial.

00:23:00.760 He did Super Bowl

00:23:01.480 halftime.

00:23:01.760 I think a lot of us

00:23:02.520 did not realize

00:23:03.220 that you can't say

00:23:04.080 even that N-word.

00:23:06.140 I guess I won't repeat it.

00:23:07.720 I'd never,

00:23:08.680 even I did not understand

00:23:10.020 that this N-I-Z-Z-L-E 1.00

00:23:13.020 is another form

00:23:14.520 of the N-word

00:23:15.940 and it's a Snoop Dogg thing.

00:23:18.780 And even shizzle

00:23:20.020 is supposed to be

00:23:20.860 like another word

00:23:21.920 for S-H-I-T. 0.98

00:23:23.860 See, I'm reigning

00:23:24.480 in the swearing, Mom.

00:23:26.360 So I guarantee you

00:23:27.680 this woman had no idea 0.63

00:23:28.800 she was saying

00:23:29.400 a substitute word

00:23:30.560 for the N-word.

00:23:32.140 But, you know,

00:23:33.120 even if she didn't know,

00:23:35.460 as you probably saw,

00:23:36.640 there's a push right now

00:23:37.960 to not even let

00:23:39.740 a phrase coined 0.91

00:23:41.120 by a black person

00:23:42.660 ever come out 0.98

00:23:44.340 of a white person's mouth. 0.99

00:23:46.800 You can't,

00:23:47.500 the CNN article, right?

00:23:48.500 You can't use 0.99

00:23:49.400 a black person 0.94

00:23:50.320 in a meme. 0.89

00:23:51.180 Digital blackface, yeah. 0.99

00:23:52.660 Right, digital blackface 0.98

00:23:53.800 and this is sort of a form.

00:23:55.380 So, I mean,

00:23:56.060 I don't know why

00:23:56.940 that she's off the way.

00:23:57.600 It could be because

00:23:58.240 of the digital blackface thing.

00:23:59.540 It could be because

00:24:00.240 of the N thing,

00:24:01.340 which I'm sure

00:24:01.780 she didn't know.

00:24:02.240 But, I mean,

00:24:02.760 whatever it is,

00:24:03.320 the standards are so

00:24:04.120 all over the place

00:24:04.820 and now you have

00:24:05.260 a lot of people

00:24:05.720 in the black community

00:24:06.860 even on the left

00:24:07.600 like Whoopi Goldberg

00:24:08.560 attacking this decision

00:24:11.300 by this news organization 0.95

00:24:12.840 saying this is ridiculous.

00:24:15.920 Listen, Megan, 0.99

00:24:17.320 I know you were born

00:24:18.860 in the 1990s,

00:24:20.100 but I was born

00:24:21.020 in 1967.

00:24:22.960 Babe, 70.

00:24:23.540 And I've lived long enough.

00:24:24.860 I've lived long enough,

00:24:26.760 Megan,

00:24:27.300 to remember a time

00:24:29.020 when people could say

00:24:30.500 inappropriate things,

00:24:32.680 slightly and unintentionally,

00:24:34.160 no harm.

00:24:34.960 And everybody would just

00:24:36.280 let it go

00:24:37.260 and just move on

00:24:38.860 and acknowledge

00:24:40.080 no one was harmed.

00:24:42.360 It was awesome.

00:24:43.500 And America

00:24:45.060 does not promise

00:24:46.460 you that your feelings

00:24:48.140 will never get hurt,

00:24:50.080 that no one

00:24:50.780 will ever say anything

00:24:52.100 that makes you

00:24:53.220 uncomfortable

00:24:53.920 or slightly offended.

00:24:56.260 Social media

00:24:56.980 has recalibrated

00:24:58.240 everything

00:24:58.800 that people

00:24:59.860 are running around

00:25:00.860 pretending like,

00:25:02.420 well,

00:25:02.580 America hasn't lived up

00:25:04.340 for its promise

00:25:04.960 if I hear anything

00:25:06.320 that I disagree with

00:25:08.000 or slightly

00:25:10.260 makes me uncomfortable.

00:25:13.620 That's what America

00:25:14.600 owes me.

00:25:15.280 That's a joke.

00:25:16.220 I don't want to live

00:25:17.060 in that America.

00:25:19.240 Who wants to be

00:25:20.340 that careful?

00:25:21.680 Who wants to...

00:25:23.560 Megan,

00:25:24.020 I'll say this

00:25:24.620 and I'll probably

00:25:25.060 get in trouble for it.

00:25:26.200 If I'm a white person,

00:25:27.760 I would be afraid

00:25:28.880 to engage 1.00

00:25:29.720 with black people. 0.77

00:25:30.520 I would be 0.96

00:25:31.300 because you just

00:25:32.400 never know

00:25:33.060 what will come

00:25:33.740 out of your mouth 0.72

00:25:34.420 that will trigger them

00:25:36.300 or trigger us

00:25:38.480 and you don't know.

00:25:39.860 Am I talking to Jason

00:25:40.800 who I can talk to

00:25:42.280 like a friend

00:25:42.940 or am I talking

00:25:43.960 to someone

00:25:44.420 who's waiting

00:25:44.980 to take me down

00:25:45.880 to build up

00:25:46.400 their own career?

00:25:47.640 But don't you think

00:25:48.080 it's not black people?

00:25:49.220 It's woke people.

00:25:50.400 I don't like to talk

00:25:51.340 to woke people.

00:25:52.580 So I would have no fears

00:25:53.780 about it.

00:25:54.220 I mean,

00:25:54.380 a black woke person,

00:25:55.420 yes.

00:25:55.640 A white woke person,

00:25:56.740 yes.

00:25:56.940 You'd have to be

00:25:57.380 very careful

00:25:57.900 if you didn't want

00:25:59.040 to offend.

00:26:00.020 I mean,

00:26:00.140 I think you're past

00:26:00.760 that point

00:26:01.120 and so am I.

00:26:01.820 But yeah,

00:26:02.920 that's like,

00:26:03.740 it's these wokesters 1.00

00:26:04.940 who are telling 0.98

00:26:06.400 black people 0.96

00:26:07.000 they're victims 1.00

00:26:07.460 they need to be offended

00:26:08.340 and telling,

00:26:09.520 you know,

00:26:10.020 women and telling 1.00

00:26:11.180 trans people,

00:26:11.780 you know,

00:26:12.580 they're the ones

00:26:13.520 with the messaging

00:26:14.040 that we're victims.

00:26:15.260 But I don't,

00:26:15.900 I feel like their messaging

00:26:16.800 is failing.

00:26:19.240 It hasn't failed,

00:26:20.320 but it's not as strong

00:26:21.400 as it was

00:26:22.040 even two years ago.

00:26:23.820 I feel like we're

00:26:24.660 starting to see

00:26:25.680 some promise

00:26:26.880 in the fight

00:26:27.980 against the woke.

00:26:31.640 I think that's true

00:26:33.580 as long as

00:26:35.580 Joe Biden

00:26:36.460 is in office

00:26:37.440 and once he's

00:26:40.060 out of office,

00:26:41.140 they'll just

00:26:41.660 drum up

00:26:43.100 all the same,

00:26:44.280 they'll find

00:26:45.180 a new George Floyd

00:26:46.240 and everybody

00:26:47.860 will be back

00:26:48.900 on television

00:26:50.080 pretending like

00:26:51.520 George Floyd

00:26:52.160 didn't resist arrest

00:26:53.320 or whoever this is

00:26:54.300 isn't resisting arrest

00:26:55.580 and that the cops

00:26:56.760 should just,

00:26:57.980 you know,

00:26:58.600 run around

00:26:59.180 and beg, 0.99

00:26:59.960 hey,

00:27:00.180 would you put

00:27:00.540 these handcuffs

00:27:01.100 on yourself,

00:27:01.740 please?

00:27:02.920 That should be

00:27:03.940 the standard

00:27:04.460 and we should be

00:27:05.120 once,

00:27:06.580 you know,

00:27:06.860 now that Trump's

00:27:07.980 not in office,

00:27:09.460 they're playing

00:27:11.380 a little bit nicer.

00:27:13.720 But it's going to,

00:27:15.620 regardless,

00:27:16.100 once they're out

00:27:16.980 of office,

00:27:17.440 once they're out

00:27:17.940 of power,

00:27:18.500 once,

00:27:19.100 if they ever do

00:27:19.860 get out of power,

00:27:20.640 the way they

00:27:21.080 can control elections,

00:27:22.780 but it's going

00:27:23.960 to go back

00:27:24.580 to the way

00:27:26.340 that it is.

00:27:27.020 I don't,

00:27:27.940 I'm not,

00:27:28.660 look,

00:27:29.120 maybe I'm being

00:27:29.700 too cynical

00:27:30.360 and too negative,

00:27:32.560 but I don't,

00:27:33.640 I don't see it

00:27:34.780 going the other

00:27:35.540 direction.

00:27:35.980 We had a nice

00:27:36.640 little moment

00:27:38.500 with Elon Musk

00:27:39.600 taking over Twitter.

00:27:40.800 That has helped.

00:27:42.560 It is legal 0.53

00:27:44.060 to have some

00:27:45.780 opinions that

00:27:46.740 are conservative

00:27:47.580 now,

00:27:48.500 but didn't I

00:27:49.340 just see,

00:27:50.040 I don't have

00:27:50.860 the details,

00:27:51.340 but I think

00:27:51.640 Michael Knowles

00:27:52.460 just got suspended

00:27:53.780 from Twitter

00:27:54.460 for quoting

00:27:55.900 a Bible verse.

00:27:57.060 And so,

00:27:58.800 I don't know

00:27:59.720 if it's over.

00:28:00.220 The Bible verse

00:28:00.760 was about vengeance,

00:28:01.840 but he wasn't

00:28:02.360 calling for it.

00:28:03.200 He was,

00:28:03.660 as I recall,

00:28:04.540 the Bible verse

00:28:05.020 was basically like,

00:28:05.800 don't seek vengeance,

00:28:06.820 you know,

00:28:06.960 that's up to God.

00:28:08.560 But it's from

00:28:10.080 the Bible.

00:28:11.020 So they took down

00:28:11.780 the,

00:28:12.160 I don't know

00:28:12.520 if this was an attempt,

00:28:13.480 like a failed attempt

00:28:14.920 to be fair and balanced.

00:28:16.300 They took down

00:28:16.960 the trans activist

00:28:18.040 day of violence promo,

00:28:19.800 and this was not

00:28:21.080 the conservative

00:28:21.740 equivalent of that.

00:28:23.180 I think somebody

00:28:23.800 got confused.

00:28:25.040 But you're right,

00:28:25.620 Elon Musk

00:28:26.200 is making a difference.

00:28:27.540 Just yesterday,

00:28:28.120 we talked about

00:28:28.620 the story on how,

00:28:29.440 you know,

00:28:29.680 NPR last week

00:28:31.180 had tweeted out

00:28:31.980 in response

00:28:33.260 to this world organization

00:28:34.520 saying we're not

00:28:35.100 going to let trans women

00:28:35.940 compete against

00:28:36.620 actual women, 0.97

00:28:37.800 biological women 1.00

00:28:38.400 in track and field.

00:28:39.800 They tweeted out

00:28:40.700 the article

00:28:41.120 tsk,

00:28:41.800 tisking the decision

00:28:42.820 saying,

00:28:43.720 despite the fact

00:28:45.200 that there is

00:28:45.660 very little evidence

00:28:46.480 showing that males

00:28:47.260 have a physical

00:28:48.760 advantage over females 0.99

00:28:49.920 males when it comes 1.00

00:28:51.100 to sports.

00:28:52.420 And Elon Musk's

00:28:53.800 new Twitter

00:28:54.440 attached one of

00:28:55.820 their fact checks,

00:28:57.540 you know,

00:28:57.720 that the rest of us

00:28:58.300 have been dealing

00:28:58.900 with from the COVID 0.82

00:28:59.820 lunatics and all 0.99

00:29:00.900 these other lunatics 0.98

00:29:01.540 on Twitter for so long. 0.95

00:29:02.860 Now it's going

00:29:03.460 the other way,

00:29:03.900 and they attached

00:29:04.580 a fact check

00:29:05.820 with all the studies

00:29:07.360 saying, 1.00

00:29:07.840 you're a dumbass, 1.00

00:29:09.320 NPR. 1.00

00:29:10.800 Yes,

00:29:11.400 there are many studies

00:29:12.520 to prove what we

00:29:13.680 already know,

00:29:14.580 all already know.

00:29:15.240 This is so simple.

00:29:16.720 It's not just about

00:29:17.800 men being on average

00:29:20.040 taller and stronger,

00:29:21.400 but just let's deal

00:29:23.600 with this fact.

00:29:24.380 A woman competing

00:29:25.560 in sports has to train

00:29:28.340 while on her menstrual

00:29:30.040 cycle,

00:29:30.920 has to sometimes compete

00:29:33.080 while on her menstrual

00:29:34.920 cycle.

00:29:36.120 Leah Bill Thomas,

00:29:38.100 the Ivy League swimmer,

00:29:39.880 has he ever trained

00:29:41.400 while on his menstrual

00:29:42.560 cycle?

00:29:42.960 Has he ever competed

00:29:44.460 while on his menstrual

00:29:45.620 cycle?

00:29:46.080 I've never had a menstrual

00:29:47.340 cycle,

00:29:47.820 but I would imagine

00:29:48.720 it's harder to train

00:29:49.720 and compete while

00:29:50.800 on a menstrual cycle

00:29:52.020 than when you're not

00:29:53.180 on a menstrual cycle.

00:29:54.600 How can you tell,

00:29:55.860 how can you tell me

00:29:56.760 there's no advantage?

00:29:58.080 Especially in the pool.

00:30:01.780 Anywhere.

00:30:03.140 If playing football

00:30:04.460 or running track

00:30:06.200 or whatever,

00:30:07.400 if you're on the

00:30:08.360 cross-country team

00:30:09.400 and you have to deal

00:30:10.580 with a menstrual cycle

00:30:11.720 and the other person

00:30:13.160 never does,

00:30:14.780 that's an advantage.

00:30:16.600 Yeah.

00:30:17.080 No, you're right.

00:30:17.820 There's all sorts of issues.

00:30:18.920 I mean, from bloating

00:30:20.000 to breast pain

00:30:20.920 to, you know,

00:30:21.560 just feeling uncomfortable

00:30:22.460 and some women 1.00

00:30:22.940 have endometriosis.

00:30:24.080 There's all sorts of things

00:30:24.900 that can cause a lot of pain

00:30:26.040 down south in Rio

00:30:27.480 and all over our bodies.

00:30:28.980 It's part of the joy

00:30:29.760 of womanhood.

00:30:30.600 Overall, still take it

00:30:31.860 rather than leave it.

00:30:32.800 But yeah, there's issues.

00:30:34.460 No question.

00:30:35.220 And you're right.

00:30:35.680 That's on top of

00:30:37.040 the fact that

00:30:38.120 our femurs aren't as long

00:30:39.420 and our bones aren't as strong

00:30:40.400 and our muscles aren't as strong

00:30:41.440 and not to even touch

00:30:42.940 on the testosterone,

00:30:44.080 which, you know,

00:30:44.860 doesn't reduce all the

00:30:45.700 What happens to a woman 1.00

00:30:46.740 with her hormones

00:30:48.680 when she takes birth control pills? 0.83

00:30:51.280 And Leah Bill Thomas

00:30:52.380 never takes birth control pills.

00:30:54.140 How about the old thing

00:30:55.040 about like, you know,

00:30:55.720 the baby?

00:30:56.500 How about the fact that

00:30:57.380 some athletes get pregnant

00:30:58.860 and have to deal with that too?

00:31:01.120 Leah Bill is never going

00:31:02.060 to have to worry about that.

00:31:03.580 Yes.

00:31:04.800 Leah Bill.

00:31:05.540 I'm sorry,

00:31:07.360 but I'm actually growing

00:31:08.480 to kind of loathe Leah Thomas.

00:31:10.260 Like all the stuff

00:31:11.100 I've heard about this person 0.84

00:31:12.080 suggests this is an arrogant, 1.00

00:31:14.780 self-centered, nasty person 0.99

00:31:17.160 who couldn't win as a man, 0.99

00:31:20.200 decided to change over

00:31:21.420 to women's sports.

00:31:22.840 From the look of what I read online,

00:31:24.940 it's because Leah gets off 0.97

00:31:27.120 sexually undressing as a woman. 0.95

00:31:29.700 I don't know that

00:31:30.180 that's gender dysphoria. 1.00

00:31:31.540 A lot of our top trans activists

00:31:32.880 who are reasonable

00:31:33.900 have been saying

00:31:34.620 that's not trans. 1.00

00:31:35.900 That's a sexual fetish. 1.00

00:31:37.700 And then they stuck him 0.99

00:31:38.620 in the pool

00:31:39.000 with all the actual women 0.97

00:31:40.540 where he won, of course,

00:31:41.860 their medals.

00:31:42.780 So I don't have a lot

00:31:43.820 of tolerance for Leah.

00:31:45.480 Something about Leah

00:31:46.620 reminds me of the typical man

00:31:48.720 or the kind of,

00:31:50.480 when I was young, 1.00

00:31:51.460 kind of stupid, 1.00

00:31:52.440 perverted thoughts 1.00

00:31:53.120 you have as a young man.

00:31:54.640 Hey, I get to go into

00:31:56.120 a locker room 0.97

00:31:57.600 and get naked around

00:31:59.360 a bunch of really in shape, 0.84

00:32:00.820 attractive women 1.00

00:32:01.700 while I'm competing.

00:32:03.580 That'd be fun.

00:32:04.780 I would have enjoyed

00:32:05.720 that at 21-22.

00:32:08.640 It's not,

00:32:09.420 I think it's what gets him off,

00:32:11.220 according to the tweets

00:32:12.240 that someone named Leah Thomas

00:32:13.820 in the Daily Wire

00:32:14.420 took a deep dive on this,

00:32:15.820 is liking all over

00:32:16.920 online posts.

00:32:18.700 It's about,

00:32:19.840 he gets off

00:32:20.400 on dressing as a woman.

00:32:22.000 It's himself

00:32:22.900 in the women's clothing

00:32:24.200 that gets him off.

00:32:25.960 So they put this,

00:32:27.500 I guess, 0.69

00:32:28.060 sexually aroused person 0.69

00:32:29.480 in with female athletes 0.89

00:32:32.620 who are just there to win,

00:32:33.980 to compete and win,

00:32:35.420 suffering from none

00:32:36.440 of those other challenges

00:32:38.260 that we just went through.

00:32:39.520 And then they're like,

00:32:40.380 oh, it's amazing.

00:32:41.420 He won in ESPN.

00:32:43.340 ESPN wants to celebrate

00:32:45.320 Leah Bill

00:32:46.080 during Women's History Month.

00:32:49.140 Just the final salt

00:32:50.580 in the wounds

00:32:51.240 for people like Riley Gaines.

00:32:52.420 Megan, I'm not,

00:32:54.760 you've got kids.

00:32:55.560 I don't know

00:32:55.800 if you have a daughter,

00:32:56.820 but again,

00:32:57.420 if you're a parent,

00:32:58.560 is this the world

00:32:59.320 you want to leave your kids?

00:33:00.640 That they got to compete

00:33:01.860 potentially against men?

00:33:03.920 That they have to shower

00:33:05.140 as young women

00:33:06.060 with guys

00:33:07.180 that they don't know

00:33:08.660 and don't have an interest in?

00:33:11.040 And guys that claim

00:33:14.020 they want to be a woman 0.99

00:33:14.980 but want to keep 0.99

00:33:15.760 their bat and balls

00:33:16.960 get to run wild

00:33:19.180 and get trophies

00:33:20.440 and get celebrated?

00:33:21.420 This guy's a fraud 0.87

00:33:23.340 and you're not wrong 0.99

00:33:24.620 for disliking him. 0.98

00:33:26.220 He's a narcissist. 1.00

00:33:27.480 He's fraud. 1.00

00:33:28.500 He's a coward. 1.00

00:33:30.080 He's a, 1.00

00:33:30.360 he doesn't want to compete.

00:33:32.560 He tried competing

00:33:33.620 against men

00:33:34.320 and wasn't good enough

00:33:36.580 and then said,

00:33:37.680 I'm going to go

00:33:37.980 get my rocks off 0.99

00:33:39.040 and go shower with women 1.00

00:33:40.840 and compete 0.73

00:33:41.900 and get attention

00:33:43.160 and become a celebrity

00:33:44.700 on this gimmick.

00:33:46.500 and it's,

00:33:48.740 and I'm jumping around

00:33:51.860 but our values

00:33:52.780 have changed so much.

00:33:54.360 I know Tucker

00:33:54.880 was talking about this

00:33:56.000 last night

00:33:56.860 and we talked about it

00:33:58.600 last week

00:33:59.420 I think on our show

00:34:00.300 that they've got,

00:34:01.320 the Pew Research

00:34:02.040 has done something

00:34:03.040 about how much

00:34:03.660 our values have changed

00:34:04.740 and how much more

00:34:05.660 we value money

00:34:06.640 than we used to

00:34:07.480 and how much less

00:34:08.640 we value religion

00:34:09.720 than we used to.

00:34:10.960 How much less

00:34:11.580 we value family

00:34:12.580 than we used to.

00:34:13.700 Patriotism.

00:34:14.020 Our values have changed.

00:34:15.500 We value attention.

00:34:18.660 It's the greatest thing

00:34:19.960 on the world.

00:34:21.480 This is the selfie

00:34:22.920 narcissistic generation.

00:34:25.560 We're all caught up in it.

00:34:27.060 All of us,

00:34:27.660 this dopamine

00:34:28.480 that comes from

00:34:29.180 social media

00:34:30.220 and comes from

00:34:31.040 just getting attention

00:34:32.280 by any means necessary.

00:34:34.520 China's laughing at us.

00:34:35.940 While we're doing

00:34:36.760 all these TikTok dances

00:34:38.240 and trying to get people

00:34:39.700 to,

00:34:39.980 hey,

00:34:40.160 look at me,

00:34:41.360 we're not building

00:34:43.660 better human beings.

00:34:44.980 We're not building

00:34:45.780 a better society

00:34:46.800 and we've adopted

00:34:48.820 values

00:34:50.280 that just don't lead

00:34:52.120 to long-term success.

00:34:54.260 China doesn't even allow 1.00

00:34:55.080 its Chinese children

00:34:56.140 to go on the Chinese equivalent

00:34:57.980 of TikTok

00:34:58.420 during the day.

00:34:59.260 You're limited,

00:34:59.940 I think,

00:35:00.080 to like 40 minutes

00:35:00.800 or something.

00:35:02.420 So I heard

00:35:03.600 one social media expert

00:35:05.040 say

00:35:05.440 they got us,

00:35:07.720 our kids,

00:35:08.140 all hooked on candy.

00:35:08.980 They give their kids broccoli

00:35:09.880 and we just eat it up

00:35:11.800 and say we don't pay

00:35:12.760 any attention

00:35:13.260 that too much candy

00:35:14.920 can cause disease.

00:35:16.420 Too much candy

00:35:17.000 can cause obesity.

00:35:18.360 Too much candy

00:35:18.860 can cause you

00:35:19.340 to get a little

00:35:20.300 fuzzy in the head,

00:35:22.020 not do as well

00:35:22.540 on your exams.

00:35:23.460 It's not really good

00:35:24.100 for you in any way.

00:35:24.880 Broccoli,

00:35:25.220 on the other hand,

00:35:25.740 is a cruciferous vegetable.

00:35:27.080 It can prevent cancer.

00:35:28.360 It's really good for you.

00:35:29.420 It makes your hair nicer,

00:35:30.360 your skin, right?

00:35:31.540 And we just keep

00:35:32.460 shoving in the almond joys

00:35:34.020 like,

00:35:34.480 oh,

00:35:34.640 what could possibly go wrong?

00:35:37.540 I've got to talk to you

00:35:38.460 about Sunny Hostin

00:35:39.260 and The View.

00:35:39.900 I'm going to save that

00:35:40.600 for right after the break.

00:35:41.600 It's the best clip of the day.

00:35:42.980 I don't know if you've seen it,

00:35:43.880 but we have got to spend

00:35:44.640 some time

00:35:45.220 with our friend,

00:35:46.740 Sunny Hostin.

00:35:47.720 Jason Whitlock stays with us.

00:35:49.060 Don't go away.

00:35:53.380 That poll you were mentioning,

00:35:54.740 we talked about it

00:35:55.500 a few days ago too.

00:35:56.300 It was by

00:35:56.840 the Wall Street Journal

00:35:57.640 showing the decrease

00:35:58.740 in our old traditional values

00:36:00.440 like family,

00:36:01.260 like love of country,

00:36:02.780 like love of God,

00:36:04.420 and the increase

00:36:05.340 of love of money.

00:36:07.380 And you're right too,

00:36:09.160 love of self,

00:36:10.500 right?

00:36:10.780 And not in the good way.

00:36:12.180 Not, you know,

00:36:12.680 the love of attention.

00:36:14.060 That's a better way

00:36:14.860 of saying it.

00:36:16.700 So they had a discussion

00:36:18.440 on The View

00:36:19.520 about world superpowers

00:36:22.720 from the sound of it.

00:36:23.340 That's how they got into it.

00:36:24.820 And Sunny Hostin

00:36:27.260 made some comments

00:36:28.160 about patriotism

00:36:29.300 and America

00:36:30.380 and Black America.

00:36:32.920 It's all in there, Jason.

00:36:34.320 I mean,

00:36:34.580 it's all in there.

00:36:35.340 I'm gonna tee it up.

00:36:36.200 It starts with Alyssa Farah,

00:36:37.480 who's supposed to be

00:36:38.380 the, you know,

00:36:38.940 Republican commentator.

00:36:40.700 And then you'll hear

00:36:41.720 Sunny jump in.

00:36:42.920 Listen.

00:36:44.400 If America is not

00:36:45.880 the number one global power,

00:36:47.120 it's not gonna be Denmark.

00:36:48.280 It's going to be

00:36:48.860 communist China,

00:36:49.840 a country that right now

00:36:51.120 the government

00:36:51.620 is imprisoning Uyghur Muslims 1.00

00:36:53.240 in concentration camps. 0.97

00:36:54.640 It is a deeply racist government.

00:36:56.340 It's a human rights 0.81

00:36:57.100 violating government.

00:36:58.100 It is a government

00:36:58.820 that if they are the leader

00:37:00.020 of the free world,

00:37:01.420 we are not a free world

00:37:02.500 the way that we are right now.

00:37:03.520 The notion of patriotism

00:37:05.280 and the notion of America

00:37:07.600 and the American flag

00:37:08.740 has been co-opted

00:37:10.300 by the right

00:37:10.980 as if they are true patriots.

00:37:13.180 But when I listened

00:37:14.200 to Christopher Wray,

00:37:15.580 the head of the FBI,

00:37:17.960 he said white supremacy 0.86

00:37:19.340 is the biggest domestic threat 0.97

00:37:21.480 to this country.

00:37:23.320 And so as a woman of color 0.54

00:37:24.940 with a six foot two black kid

00:37:27.260 in college

00:37:28.220 and a five foot seven,

00:37:29.920 five foot eight black kid

00:37:31.480 in high school, 0.91

00:37:32.360 I don't see that part

00:37:34.500 of American exceptionalism.

00:37:36.160 I'm sorry.

00:37:37.000 I think this country

00:37:38.120 has a lot of problems

00:37:39.500 that could be solved.

00:37:41.680 Yes, maybe they're putting 0.97

00:37:42.860 Muslims in jail 1.00

00:37:44.720 in Afghanistan,

00:37:45.460 I think you mentioned,

00:37:46.580 and China.

00:37:47.380 They're putting a lot of black, 1.00

00:37:48.480 more black people 0.99

00:37:49.140 in jail here. 1.00

00:37:49.740 Oh, my God.

00:37:52.960 I mean, wrong on some.

00:37:54.940 First of all, 0.74

00:37:55.840 those those Muslims 0.99

00:37:56.740 being put in jail 0.96

00:37:57.360 in Afghanistan. 1.00

00:37:58.160 No, you dumbass. 1.00

00:37:59.380 No, it's a genocide 1.00

00:38:00.940 happening right now

00:38:02.020 in China

00:38:02.960 with the Uyghur Muslims.

00:38:03.960 It's been very well covered

00:38:05.120 by your own network, madam.

00:38:06.700 If you would just pay attention

00:38:07.760 to the news

00:38:08.280 that doesn't feature your face,

00:38:09.780 you might actually learn something.

00:38:12.240 So she's actually comparing

00:38:13.940 the concentration camp

00:38:16.220 encampment imprisonment

00:38:18.720 of one million Uyghur Muslims

00:38:20.740 in China to what she thinks

00:38:23.520 is Afghanistan 0.83

00:38:24.080 to black Americans

00:38:26.560 serving time in prison,

00:38:28.280 which the latest stats tell me

00:38:30.180 just by the by the by

00:38:31.860 the numbers are 760,000.

00:38:33.960 So she's even wrong on the math,

00:38:35.760 not to mention

00:38:36.760 all those other things.

00:38:37.620 Can you believe?

00:38:39.760 Yeah, no, I can believe it.

00:38:41.440 I'm just going to circle back

00:38:42.520 to I've got a theme

00:38:44.700 just as it relates

00:38:46.600 to public figures

00:38:47.760 and people on corporate media.

00:38:50.220 Everything they say

00:38:51.780 is tuned towards

00:38:54.240 how's this going to land

00:38:56.160 on Twitter?

00:38:57.600 How's this going to land

00:38:59.020 on social media?

00:39:00.320 They don't care about

00:39:01.840 espousing any truth.

00:39:04.080 And it's just like

00:39:05.380 is Twitter going to like this?

00:39:07.380 And Twitter rewards

00:39:09.220 still even with Elon Musk

00:39:10.820 in control,

00:39:11.720 it rewards comments

00:39:14.220 like this

00:39:15.160 and it's celebrated

00:39:17.040 and the whole

00:39:17.940 again, we're a victim

00:39:20.140 and we can't acknowledge

00:39:21.920 any progress

00:39:23.040 in this country.

00:39:23.800 This woman can't 1.00

00:39:24.980 even acknowledge

00:39:25.580 that she gets paid

00:39:26.860 a ton of money

00:39:27.980 and her kids live

00:39:29.140 a very privileged lifestyle

00:39:30.520 because of the ton

00:39:31.860 of money she makes 1.00

00:39:32.760 for sitting on TV

00:39:34.180 talking about 1.00

00:39:35.340 a lot of shit 1.00

00:39:36.480 she doesn't know 1.00

00:39:37.300 anything about.

00:39:38.200 And I apologize

00:39:40.140 for cursing.

00:39:41.020 I'm trying to do

00:39:41.640 less of it

00:39:42.260 and I do less of it

00:39:43.320 but the woman 0.99

00:39:44.360 has triggered me 1.00

00:39:45.320 because she's an idiot. 1.00

00:39:47.700 She's preaching 1.00

00:39:49.020 to kids

00:39:50.240 a victim mentality

00:39:53.120 that produces

00:39:54.260 negative consequences.

00:39:56.060 If you see yourself

00:39:57.780 as someone

00:39:58.380 who can't make it

00:39:59.800 here in America

00:40:00.780 you're not going

00:40:02.060 to make it here

00:40:03.060 in America. 1.00

00:40:04.520 She's ignorant 1.00

00:40:05.280 of world history 0.98

00:40:07.160 of global

00:40:08.360 world history. 1.00

00:40:10.120 She's ignorant 1.00

00:40:10.840 of virtually everything. 1.00

00:40:13.340 She's just saying

00:40:14.080 something that sounds good.

00:40:15.800 She's supposed to say 0.51

00:40:16.820 the woke people

00:40:18.340 will applaud it.

00:40:19.620 She can go out

00:40:20.280 to dinner tonight

00:40:21.140 in Hollywood

00:40:21.960 with her elite friends

00:40:23.720 and they can sit around

00:40:25.160 and yeah,

00:40:25.680 you really stuck up

00:40:27.060 for the underdog

00:40:28.480 and the little people

00:40:29.480 and you kept her

00:40:30.240 and it's all BS.

00:40:32.720 It's just her

00:40:33.360 trying to say something

00:40:34.300 that she thinks

00:40:34.880 will be popular

00:40:35.620 will trend over Twitter

00:40:37.080 get her back

00:40:37.900 in the news cycle.

00:40:39.160 She doesn't even 0.53

00:40:40.460 believe it.

00:40:42.400 Let me tell you something.

00:40:43.180 This is what gets rewarded. 1.00

00:40:44.680 That kind of stupidity 1.00

00:40:45.660 and if anybody 1.00

00:40:47.120 she's sitting there

00:40:48.120 knowing that

00:40:49.240 if anybody short

00:40:50.300 of Whoopi

00:40:51.080 called her out 1.00

00:40:52.560 on that bullshit 1.00

00:40:53.400 she would then 1.00

00:40:54.660 be able to claim

00:40:55.340 that they're racist

00:40:56.140 and people would go for it

00:40:58.580 and that person

00:40:59.220 would be in trouble

00:40:59.980 and I got to be careful

00:41:03.400 because sometimes

00:41:04.380 I can veer

00:41:05.280 into sexism

00:41:07.780 but again

00:41:10.220 if there's a man

00:41:11.440 a real man

00:41:13.340 sitting on that desk

00:41:14.260 with them

00:41:14.700 a real one

00:41:16.460 he would call her out 1.00

00:41:18.660 for that stupidity. 1.00

00:41:19.620 That's one of the dumbest 1.00

00:41:20.860 effing statements 1.00

00:41:22.020 I ever heard.

00:41:22.840 Do you understand

00:41:23.440 anything about

00:41:24.000 American history? 1.00

00:41:25.020 And then walk her dumb ass 1.00

00:41:26.380 through American history 1.00

00:41:27.480 so that she gets it.

00:41:29.320 But she's sitting there

00:41:31.380 with a bunch of women 0.99

00:41:32.040 they don't want to offend

00:41:32.820 each other

00:41:33.260 they want to make sure

00:41:34.020 they're all friends

00:41:34.600 and go out to you.

00:41:35.320 On behalf of women

00:41:36.040 let me tell you

00:41:36.640 that it wouldn't take a man

00:41:37.680 I could sit out there

00:41:38.640 and handle this just fine.

00:41:40.000 It depends on the woman 1.00

00:41:41.360 and the motivations on set.

00:41:43.060 Those women just want 1.00

00:41:43.680 to be stars.

00:41:44.360 They want to remain

00:41:44.900 under the cleat lights

00:41:46.020 and beloved

00:41:47.040 by the left-leaning

00:41:47.900 view audience

00:41:48.980 so there's only so far

00:41:50.240 they'll go.

00:41:51.020 And Meghan McCain

00:41:51.500 did a good job

00:41:52.120 of calling out

00:41:52.780 Sonny on her BS too

00:41:54.580 when she was there.

00:41:55.540 One of the reasons

00:41:55.940 she left

00:41:56.360 is it was intolerable

00:41:57.460 to sit in that chair.

00:41:59.180 But let me tell you this

00:42:00.260 this is what jumped out at me

00:42:01.260 and you touched on it.

00:42:02.360 Thank you for doing that.

00:42:03.700 She wants to focus

00:42:04.640 when they're talking about

00:42:05.300 whether America's

00:42:05.880 a great country, right?

00:42:06.660 Whether it should remain

00:42:07.380 the world's greatest superpower.

00:42:09.560 She wants to take us down 1.00

00:42:11.060 by saying no

00:42:11.720 white supremacy

00:42:12.740 is dominant in America 0.72

00:42:13.840 just ask Chris Wray.

00:42:14.980 It's our biggest domestic threat.

00:42:16.600 I don't see that part

00:42:17.980 of American exceptionalism.

00:42:19.740 I have a black son.

00:42:21.040 I have a black daughter.

00:42:21.920 I don't see this part

00:42:22.700 of American exceptionalism.

00:42:24.480 This country has a lot of problems.

00:42:26.420 Sonny Hostin

00:42:27.240 went she

00:42:28.860 I think she went

00:42:29.980 to Binghamton undergrad

00:42:31.580 and she went to

00:42:32.220 Notre Dame Law School

00:42:33.240 which is a great law school.

00:42:34.920 Her son right now

00:42:36.100 is at Harvard.

00:42:37.180 That son she wants us to think

00:42:38.560 is sitting there oppressed

00:42:39.460 who she's got to fight

00:42:40.460 on behalf of

00:42:41.080 because America 0.69

00:42:41.660 is so awful to him.

00:42:42.920 They're educating him

00:42:43.820 right now at Harvard University.

00:42:45.780 And Jason,

00:42:46.180 would you take a look at this?

00:42:47.080 Because I want to guess

00:42:47.580 I haven't been to your house

00:42:48.500 down in Tennessee,

00:42:50.000 but I'm going to guess

00:42:50.680 it doesn't look like this.

00:42:51.840 This is Sonny Hostin's home 0.99

00:42:53.140 in this shitty country 1.00

00:42:54.620 that she can't stand 1.00

00:42:55.740 that doesn't treat black people 0.99

00:42:57.340 like Sonny well. 0.95

00:42:58.440 She let People Magazine 0.75

00:43:00.120 feature her home.

00:43:02.380 Look at this dump. 1.00

00:43:03.660 This country sucks. 1.00

00:43:05.960 She went to Notre Dame Law School. 1.00

00:43:07.660 She makes millions on The View.

00:43:08.920 Her son's at Harvard.

00:43:10.060 I'm sure her daughter's

00:43:10.800 at private school

00:43:11.380 on her way to some Ivy League.

00:43:13.060 This is where Sonny lives.

00:43:14.660 And F off America.

00:43:16.140 I can't stand 0.58

00:43:17.120 how you've kept us all in chains.

00:43:18.960 That's her messaging.

00:43:21.760 I'm going to be

00:43:22.560 very politically incorrect.

00:43:24.000 Black, you know,

00:43:25.640 again, 0.59

00:43:27.100 these African Americans 0.95

00:43:29.000 are always out to prove 1.00

00:43:31.240 how black they are. 0.97

00:43:32.540 This woman's half Puerto Rican, 1.00

00:43:34.080 half black.

00:43:35.000 Her grandfather,

00:43:35.960 maternal grandfather's Jewish.

00:43:37.940 She has identity issues.

00:43:40.540 And so she's always

00:43:41.780 in desperate pursuit

00:43:42.960 of trying to prove 0.97

00:43:44.160 just how black she is. 0.99

00:43:45.800 They always do too much. 0.75

00:43:46.980 That's why Colin Kaepernick,

00:43:48.640 raised by the grace of God,

00:43:51.480 by these two awesome parents,

00:43:53.500 two awesome white parents

00:43:55.460 that stood in the gap

00:43:56.460 for his white mama 0.86

00:43:57.640 and black daddy 0.99

00:43:58.500 that didn't want him 0.99

00:43:59.380 and didn't have anything

00:44:00.460 to do with him.

00:44:01.180 And then he turns around 0.76

00:44:02.340 and takes a dump 0.94

00:44:03.300 on these people

00:44:04.580 that saved him

00:44:05.940 from the abyss

00:44:07.180 and comes out

00:44:08.180 and says,

00:44:08.600 they raised me

00:44:09.500 in some problematic racist ways.

00:44:11.600 It's the African American 0.87

00:44:13.780 that is constantly

00:44:15.780 trying to prove 0.99

00:44:17.840 how black they are 1.00

00:44:19.160 and they're idiots 1.00

00:44:21.180 that need to be told 1.00

00:44:22.080 to sit down

00:44:22.820 and go somewhere

00:44:24.060 and mind their own business

00:44:26.200 either.

00:44:28.180 They're not representing 0.74

00:44:30.580 the actual thoughts,

00:44:32.660 conditions,

00:44:33.340 concerns

00:44:33.900 of black people. 0.99

00:44:35.920 They're out trying

00:44:37.040 to work out

00:44:37.700 their identity issues

00:44:39.060 and have their black moment. 0.62

00:44:41.260 It's a joke.

00:44:42.280 It infuriates me.

00:44:43.260 And anybody that knows me,

00:44:45.820 anybody that knows

00:44:46.480 anything about

00:44:47.160 my dating history

00:44:48.260 knows I have no problem

00:44:50.200 with interracial dating.

00:44:51.680 None.

00:44:52.480 Zero.

00:44:53.400 I don't have

00:44:54.720 that kind of bigotry problem.

00:44:56.580 I do have a problem,

00:44:57.860 though,

00:44:58.460 with people

00:44:59.040 that aren't qualified

00:45:00.200 and are trying

00:45:00.920 to work out

00:45:01.360 their personal problems

00:45:03.720 by expressing opinions

00:45:05.600 about this country

00:45:06.640 and about people

00:45:07.660 that are totally inaccurate,

00:45:09.340 they're divisive,

00:45:10.220 they're intended

00:45:10.720 to tear us apart,

00:45:11.720 to sit there

00:45:12.900 and quote this Ray guy

00:45:14.240 and the FBI,

00:45:15.320 oh, 0.99

00:45:15.700 white supremacists, 1.00

00:45:16.920 that's the biggest threat 1.00

00:45:17.960 in the world. 0.95

00:45:18.780 When anybody with a brain

00:45:20.420 has watched these 1.00

00:45:21.500 Black Lives Matter clowns 1.00

00:45:23.320 burn down America, 1.00

00:45:24.920 tear down America, 0.94

00:45:26.680 we see the videos

00:45:28.320 of the violence

00:45:29.180 and where it's coming from.

00:45:32.000 Someone showed me

00:45:33.120 a video of the Proud Boys 0.97

00:45:34.420 doing any damn thing

00:45:35.800 other than standing 0.95

00:45:36.680 around someplace

00:45:37.660 and getting blamed for it.

00:45:39.760 And again,

00:45:40.060 that's not a defense

00:45:40.980 to the Proud Boys,

00:45:42.000 but I got constant videotapes

00:45:44.380 of Antifa

00:45:45.560 and Black Lives Matter

00:45:46.780 doing real violence

00:45:48.240 and Christopher Wray

00:45:50.480 and Joe Biden

00:45:51.660 and none of these 1.00

00:45:52.680 lying idiots 1.00

00:45:53.740 have the balls 1.00

00:45:54.940 to stand up 0.99

00:45:55.780 and call out

00:45:57.000 the left-wing violence

00:45:59.720 and the left-wing racism

00:46:02.500 that is destroying

00:46:04.120 this country.

00:46:05.400 And so,

00:46:05.880 great,

00:46:06.620 Sonny Halston

00:46:07.560 can repeat

00:46:08.320 some Democratic

00:46:09.180 talking point

00:46:10.120 that's been fed

00:46:11.580 to her by the FBI

00:46:12.740 and Joe Biden,

00:46:13.940 but she don't know 0.94

00:46:15.300 what she's talking about.

00:46:16.780 Hmm.

00:46:17.560 I know.

00:46:18.160 I was thinking about it

00:46:18.840 yesterday when we saw

00:46:19.560 those cops go into 0.78

00:46:20.580 that school.

00:46:21.780 Speaking of fearless,

00:46:23.180 you know,

00:46:23.360 they went in there

00:46:24.120 and did their duty

00:46:26.180 and they knew

00:46:26.880 at any moment

00:46:27.400 they could be shot, 0.99

00:46:28.140 they could be killed, 0.99

00:46:28.760 they could never go home

00:46:29.440 to their families,

00:46:30.060 but they did it.

00:46:30.700 The same cops

00:46:31.520 that we're told 1.00

00:46:32.600 are racist bastards 1.00

00:46:34.480 who are struggling now 1.00

00:46:35.980 to refill the ranks

00:46:37.080 that who retired

00:46:37.780 after the beatings

00:46:39.000 they all took

00:46:39.480 in the wake of George Floyd.

00:46:40.900 Those same cops,

00:46:41.780 those are the ones

00:46:42.340 who saved

00:46:43.060 who knows how many lives

00:46:44.060 yesterday,

00:46:45.140 who,

00:46:45.680 you know,

00:46:45.860 Sonny Halston,

00:46:46.700 she was one of the ones

00:46:47.440 who held up the

00:46:48.160 hands up,

00:46:49.200 don't shoot,

00:46:50.660 fake news sign

00:46:51.760 on CNN,

00:46:52.780 never apologized for it.

00:46:54.440 Where's her mea culpa? 1.00

00:46:55.880 She just wants to say

00:46:56.980 she's America's

00:46:57.980 smartest commentator.

00:46:59.160 Guess what?

00:46:59.660 The facts show us otherwise.

00:47:01.160 It's Jason Whitlock.

00:47:02.800 All right,

00:47:03.100 speaking of Jason

00:47:03.940 and what he's got going on,

00:47:05.240 I want to tell you

00:47:05.780 before we end,

00:47:06.760 he is hosting

00:47:07.380 the Fearless Army

00:47:09.000 Roll Call Conference

00:47:10.000 on April 15th

00:47:10.800 in Nashville,

00:47:11.700 encouraging men

00:47:12.400 to put on the full armor

00:47:13.920 of God

00:47:14.920 and to reaffirm

00:47:16.100 America's core values.

00:47:18.080 Give me one line

00:47:18.720 on that, Jason.

00:47:19.380 Who are you looking for?

00:47:20.400 What are you looking to do?

00:47:21.940 Well,

00:47:22.320 I'm looking to inspire men

00:47:23.940 to bear witness

00:47:24.840 to the power,

00:47:25.840 grace,

00:47:26.120 and mercy

00:47:26.480 of Jesus Christ.

00:47:27.880 Bearing witness

00:47:28.380 requires courage,

00:47:29.760 not perfection.

00:47:30.560 I'm a very flawed person,

00:47:32.020 as you just heard me talk,

00:47:34.160 and if you've heard me

00:47:35.200 talk about my past

00:47:36.440 and the struggles I've had,

00:47:38.800 you know I'm a flawed person,

00:47:40.560 but I'm not going to allow

00:47:42.060 my sin

00:47:43.080 to silence me

00:47:44.080 from a truth

00:47:45.140 that America

00:47:46.560 needs to hear

00:47:47.420 and needs to

00:47:48.820 adhere to

00:47:50.340 and obey,

00:47:52.380 and we need to

00:47:53.300 legalize the truth again

00:47:55.440 so we can move

00:47:56.400 this country forward.

00:47:57.760 I love it.

00:47:58.160 And for me,

00:47:58.580 all foundational truth

00:47:59.800 begins in the Bible.

00:48:01.160 I love that you said

00:48:01.820 I'm not going to allow

00:48:02.280 my sin to silence me.

00:48:03.620 Good,

00:48:03.920 something to meditate on.

00:48:05.480 Thank you, my friend.

00:48:06.140 Great to see you.

00:48:07.080 Thank you.

00:48:07.580 Thank you.

00:48:11.620 The trial of actress

00:48:13.920 and entrepreneur

00:48:14.740 Gwyneth Paltrow

00:48:15.840 continues this week

00:48:16.900 over a 2016 ski crash

00:48:19.420 at Deer Valley Resort

00:48:21.260 in Utah.

00:48:22.080 I was just there

00:48:22.600 three weeks ago.

00:48:23.260 A retired optometrist

00:48:25.600 is suing Paltrow

00:48:27.480 over the crash,

00:48:28.360 claiming that she

00:48:29.300 crashed into him

00:48:30.840 and that he was

00:48:31.520 the downhill skier

00:48:32.340 when she did it,

00:48:33.460 alleging that he sustained

00:48:34.640 a brain injury

00:48:36.080 for broken ribs

00:48:37.300 and emotional distress.

00:48:39.280 He was seeking

00:48:39.780 $3 million originally.

00:48:41.180 The court threw out

00:48:41.780 part of his claim

00:48:42.400 and now it's down

00:48:42.960 to $300,000 in damages.

00:48:45.500 Paltrow claims

00:48:46.320 she was the downhill skier 1.00

00:48:48.120 and she was the one

00:48:49.600 who was hit from behind

00:48:51.000 by Sanderson

00:48:52.180 and sustained

00:48:53.380 a full-body blow 0.66

00:48:55.260 that was his fault.

00:48:56.780 She is countersuing

00:48:57.580 for $1 in damages

00:48:59.920 and the repayment

00:49:00.740 of her legal fees.

00:49:02.240 The celebrity trial

00:49:02.980 has brought no shortage

00:49:03.820 of interesting moments

00:49:05.040 from the cast

00:49:05.940 of characters involved.

00:49:06.980 It's amazing.

00:49:07.780 It's so good

00:49:08.520 in so many weird ways,

00:49:10.680 including, of course,

00:49:11.460 Gwyneth Paltrow herself.

00:49:12.760 Here to discuss it

00:49:13.540 is correspondent

00:49:14.260 and law and crime host

00:49:16.040 Anjanette Levy,

00:49:17.260 who's been covering

00:49:17.980 the trial for our pals

00:49:19.460 over at Law & Crime.

00:49:21.500 Anjanette,

00:49:21.780 great to have you on.

00:49:23.360 Well, thanks for having me, Megan.

00:49:24.640 I appreciate it.

00:49:25.960 All right.

00:49:26.280 So are you as glued

00:49:27.400 to this at night as I am?

00:49:28.840 I don't remember.

00:49:30.440 Like, since Johnny Depp,

00:49:31.480 I don't remember, like,

00:49:32.180 just typing in

00:49:32.920 Gwyneth Paltrow trial.

00:49:34.240 And I don't care

00:49:34.880 who the witness is,

00:49:35.520 I'll watch it.

00:49:36.080 It doesn't have to be her.

00:49:37.320 Whatever.

00:49:37.800 She's interesting, too.

00:49:38.560 But are you into this

00:49:40.240 or what?

00:49:41.060 I think that she,

00:49:42.680 I want the camera

00:49:43.700 to be on her more

00:49:44.580 so I can see more

00:49:45.420 of the facial expressions,

00:49:46.560 the, you know,

00:49:47.920 the pout,

00:49:48.580 the, like,

00:49:49.980 when she doesn't get something,

00:49:51.220 when she doesn't feel

00:49:51.780 like she's getting her way,

00:49:52.960 or, you know,

00:49:54.220 just the attorneys,

00:49:56.000 the lead attorney,

00:49:57.600 Kristen,

00:49:58.160 for the defense

00:49:59.120 last weekend

00:50:00.220 or last Friday

00:50:01.160 when Gwyneth

00:50:01.980 was on the stand,

00:50:02.760 I was amazed

00:50:04.220 and amused

00:50:04.880 at the discussion

00:50:05.660 about high heels

00:50:06.980 and liking the high heels

00:50:08.380 and, oh, my gosh,

00:50:09.260 you're 5'10",

00:50:10.000 I'm 5'5",

00:50:11.040 but I have to wear

00:50:11.620 four-inch heels.

00:50:12.880 It's a little bit absurd,

00:50:14.040 but amusing

00:50:14.940 at the same time

00:50:15.820 and there's a certain

00:50:16.820 bit of stagecraft.

00:50:17.780 I think everybody

00:50:18.360 involved in this trial

00:50:19.580 gets the stagecraft

00:50:21.000 aspect of this,

00:50:22.560 so it's hard

00:50:23.720 to turn away from.

00:50:25.280 That lawyer

00:50:25.900 you just mentioned

00:50:26.660 is the star

00:50:27.520 of the whole show.

00:50:28.660 I personally think

00:50:29.420 she's absolutely terrible,

00:50:30.920 but that's what

00:50:31.440 I love about her.

00:50:32.280 I can't get enough of her.

00:50:34.260 I would never hire this person.

00:50:35.520 What is she going

00:50:35.980 to say next?

00:50:36.940 What kind of amazing,

00:50:38.760 crazy thing

00:50:39.300 is going to come

00:50:39.900 out of her mouth next? 0.98

00:50:41.260 I know.

00:50:42.040 I would never hire her,

00:50:42.960 but I would never hire

00:50:43.740 Gwyneth's lawyer either

00:50:44.660 who, I've got to tell you,

00:50:46.940 like 100%,

00:50:47.760 I'll play the clip

00:50:48.360 in a minute,

00:50:49.040 reminds me of the stuttering

00:50:50.420 lawyer in My Cousin Vinny.

00:50:52.240 Remember that guy?

00:50:54.460 Cannot look at him.

00:50:55.360 That's a good comparison.

00:50:56.180 Yeah.

00:50:56.560 On the first day,

00:50:57.560 I thought to myself,

00:50:58.820 could this guy

00:50:59.360 be any more rude?

00:51:00.820 I mean,

00:51:01.140 you're supposed to kind of

00:51:02.420 want the jury

00:51:03.420 to maybe relate to you, 0.66

00:51:05.020 but you're the meanest guy 0.69

00:51:06.280 I think I've ever met. 0.92

00:51:07.740 Yes, honestly,

00:51:08.540 and the way he's got

00:51:09.420 some hideous cold

00:51:10.680 and like he is snotting

00:51:12.340 all over the microphone,

00:51:13.400 all over the lectern,

00:51:14.280 all over his papers

00:51:15.060 and every,

00:51:15.600 and sometimes he does

00:51:16.380 have his tissue,

00:51:17.000 sometimes he doesn't.

00:51:17.720 If he doesn't have his tissue,

00:51:18.660 he just uses his finger

00:51:19.700 to get the snot

00:51:20.340 coming out of his nose,

00:51:21.300 which is also something

00:51:22.320 the stuttering guy

00:51:23.080 and My Cousin Vinny did.

00:51:24.240 I got a lot of thoughts

00:51:25.020 on this whole thing,

00:51:25.720 and Jeanette, 1.00

00:51:26.020 but before we get to the fun,

00:51:27.720 let's talk about

00:51:28.580 the substance of the trial.

00:51:29.960 So I outlined

00:51:30.700 the dueling claims

00:51:32.180 in the intro.

00:51:33.520 It really is a he said,

00:51:34.820 she said,

00:51:36.040 and let me just ask you

00:51:36.860 this as a procedural matter

00:51:37.920 before we get started.

00:51:38.620 Do you know why Gwyneth Paltrow

00:51:40.760 was one of the first people

00:51:41.860 to testify?

00:51:43.180 And she appeared to me

00:51:44.140 to be testifying

00:51:44.800 as part of the plaintiff's case

00:51:47.780 as opposed to waiting

00:51:49.160 until it was her chance

00:51:50.160 to present her defense,

00:51:51.920 which would be the normal time

00:51:52.800 you'd call her.

00:51:54.260 I am unsure of that,

00:51:55.340 and I found that to be very odd

00:51:57.580 that the plaintiff called her

00:51:59.220 during his case,

00:52:01.540 and apparently,

00:52:02.420 obviously,

00:52:02.860 that is allowed

00:52:03.660 in this type of trial

00:52:05.360 in Utah,

00:52:06.560 but I found it to be very odd

00:52:08.300 because maybe they're

00:52:09.640 trying to show,

00:52:10.980 oh, look,

00:52:11.920 here she is.

00:52:13.360 She's a celebrity.

00:52:14.500 She wants to get out of this.

00:52:16.260 And then they have

00:52:17.340 Sanderson,

00:52:18.200 Terry Sanderson,

00:52:18.920 the plaintiff,

00:52:19.540 maybe come up later

00:52:20.700 in the game

00:52:21.360 to show,

00:52:22.320 oh, look,

00:52:22.720 she's not going to accept

00:52:23.740 any responsibility

00:52:24.500 for this at all.

00:52:25.480 And then they put him up

00:52:26.480 as the older,

00:52:28.000 elderly gentleman,

00:52:29.600 76 years old,

00:52:30.620 who suffered

00:52:31.200 all of these grave injuries

00:52:32.700 and a TBI

00:52:34.020 and things of that nature,

00:52:35.320 and it's really

00:52:36.180 impacted his life.

00:52:37.140 So I'm wondering

00:52:38.140 if there was a strategy,

00:52:39.420 a strategic decision here.

00:52:40.860 You've got all of the daughters

00:52:41.980 coming up,

00:52:42.680 the ex-girlfriend first

00:52:43.940 before them,

00:52:44.980 and now,

00:52:46.120 you know,

00:52:46.700 you get to Gwyneth,

00:52:47.960 you leave with her

00:52:48.680 on a Friday

00:52:49.240 with letting the jury

00:52:50.220 kind of ruminate

00:52:51.520 and think about

00:52:52.020 what she said

00:52:52.640 over the weekend,

00:52:53.240 and then you get

00:52:54.460 to Sanderson

00:52:55.380 to begin the week.

00:52:56.560 So I'm wondering

00:52:57.360 if there was

00:52:57.720 a strategic decision

00:52:59.200 there with that.

00:53:00.440 You know,

00:53:01.060 when I was back

00:53:02.080 practicing law,

00:53:02.980 I tried a case

00:53:04.140 in my hometown,

00:53:05.140 Albany, New York,

00:53:06.260 and I was young

00:53:08.180 and I was wearing

00:53:09.340 my nice suits,

00:53:10.540 you know,

00:53:10.800 that I had just gotten

00:53:11.640 with my new lawyer money,

00:53:13.920 and we had a,

00:53:15.840 what we thought

00:53:16.240 was a winning case,

00:53:17.040 but we did not have

00:53:17.800 a good star witness.

00:53:19.000 And I remember

00:53:19.860 before we went to trial,

00:53:21.360 you know,

00:53:21.580 the judge always tried

00:53:22.280 to push the sides,

00:53:23.620 could you settle it

00:53:24.280 before you try the case?

00:53:25.460 And I remember

00:53:26.000 the judge asking us,

00:53:27.920 because we were like,

00:53:28.440 look at all the evidence

00:53:29.400 we have,

00:53:29.700 and he was like,

00:53:30.880 how's your star witness?

00:53:32.560 And he knew

00:53:33.320 our star witness

00:53:34.500 was not that good.

00:53:35.660 He just wasn't good.

00:53:36.740 He wasn't going to be

00:53:37.300 liked by the jury.

00:53:38.540 And I'm seeing

00:53:39.500 both of these issues

00:53:40.240 in this case.

00:53:41.160 Gwyneth,

00:53:41.820 I don't think

00:53:42.400 she's that likable. 0.73

00:53:43.700 She may be telling the truth,

00:53:45.060 I don't think

00:53:45.560 she's that likable,

00:53:46.400 and I think that's

00:53:47.040 a handicap for her side.

00:53:50.200 And Terry Sanderson,

00:53:51.680 the star witness

00:53:52.320 for the plaintiffs,

00:53:53.740 he's the plaintiff,

00:53:54.860 is also very tough

00:53:56.140 to believe.

00:53:56.780 So both of these sides

00:53:57.780 have an Achilles heel

00:53:58.700 in their lead witnesses,

00:54:00.400 and she's also got

00:54:01.340 the extra Achilles heel,

00:54:02.520 which I did not see

00:54:03.400 in my own sparkly outfits.

00:54:05.980 They did not cost

00:54:07.200 anything near

00:54:08.180 what Gwyneth's outfits

00:54:09.520 are costing.

00:54:10.240 They're talking about

00:54:10.740 like a $65,000 bill

00:54:12.240 for her necklaces alone.

00:54:14.100 The internet looks

00:54:14.660 this stuff up.

00:54:16.480 But that's not smart.

00:54:18.080 I learned too

00:54:18.740 in front of that jury.

00:54:19.420 By the way,

00:54:19.680 we lost that case

00:54:20.340 in front of the jury

00:54:20.820 and then we got it

00:54:21.240 reversed on appeal.

00:54:22.020 But, you know,

00:54:23.360 these are factors

00:54:24.360 you have to worry about.

00:54:25.320 How are you coming across?

00:54:27.660 I think,

00:54:28.040 and I think

00:54:28.740 she started out

00:54:29.620 very poorly

00:54:30.660 the first couple of days.

00:54:32.780 The first day

00:54:33.540 and people,

00:54:34.120 I got a lot of grief

00:54:34.920 for this on Twitter

00:54:35.740 that I commented

00:54:36.840 on her clothes,

00:54:37.760 but it's part

00:54:38.740 of the presentation

00:54:39.960 in a high-profile case,

00:54:41.500 especially when you're

00:54:42.260 dealing with celebrities

00:54:43.020 who are paying

00:54:43.740 somebody to style them.

00:54:45.580 You know,

00:54:45.980 presentation is everything

00:54:47.320 and you have to show

00:54:48.120 a little bit of respect

00:54:48.860 for the court.

00:54:49.760 When she showed up

00:54:50.460 the first day

00:54:51.060 in that sweater,

00:54:51.740 I thought it was,

00:54:52.400 it was a pretty sweater,

00:54:53.540 but it was a little casual.

00:54:54.780 Things got better

00:54:55.420 as the week went on.

00:54:57.180 This is later.

00:54:57.880 But I think that it matters

00:54:59.480 and how you convey yourself

00:55:00.840 to the jury matters.

00:55:02.040 And when she was sitting there

00:55:03.060 looking like,

00:55:03.820 oh,

00:55:04.120 this is so,

00:55:04.840 I'm so inconvenienced

00:55:06.220 by this,

00:55:07.300 you know,

00:55:07.840 the pouting,

00:55:08.840 the faces,

00:55:10.780 I don't think

00:55:11.640 that that plays well.

00:55:12.660 Now,

00:55:12.800 maybe the jury there

00:55:13.660 in Park City,

00:55:15.300 Deer Valley,

00:55:15.860 will be okay with this,

00:55:17.320 but I don't think

00:55:18.460 it was a good look

00:55:19.200 for her.

00:55:20.180 I thought she was

00:55:21.040 a little bit amusing

00:55:21.700 on the stand at times.

00:55:22.960 She kind of politely

00:55:23.780 threw it back

00:55:24.460 at Kristen,

00:55:25.060 the lawyer.

00:55:25.980 But at the same time,

00:55:26.960 I think she started off

00:55:28.140 on the wrong foot

00:55:28.880 during this trial.

00:55:29.800 And anytime you're sitting

00:55:30.600 there chuckling at things,

00:55:31.960 I think that's a risky

00:55:33.300 game to play.

00:55:34.800 And I mean,

00:55:35.340 she's a stunning,

00:55:36.360 beautiful woman.

00:55:37.700 She's a movie star. 1.00

00:55:39.640 A lot of these people

00:55:40.520 may know who she is,

00:55:41.720 the jury,

00:55:42.680 but you have to conduct

00:55:43.700 yourself in a way

00:55:45.460 that's a little more

00:55:46.460 gracious,

00:55:47.000 I think,

00:55:47.780 inside the courtroom.

00:55:48.240 Maureen Callahan,

00:55:49.500 writing for Daily Mail,

00:55:50.400 did what only Maureen

00:55:51.660 can do.

00:55:52.020 My God,

00:55:52.420 I love reading her.

00:55:53.440 She's like the best read.

00:55:55.340 And she says,

00:55:56.540 she goes,

00:55:58.020 oh,

00:55:58.220 the pouting,

00:55:59.100 the puckering,

00:56:00.080 the $1,600 Celine bag

00:56:01.740 and the $425 wide leg pants,

00:56:04.460 but whisper it

00:56:05.140 in the case of

00:56:05.680 Ice Cold Actress 0.55

00:56:06.580 versus the little people.

00:56:08.360 Here's why

00:56:08.700 Haughty Gwynny

00:56:09.480 might just win.

00:56:11.000 And we'll get to that.

00:56:12.020 But she also goes on

00:56:12.880 to talk about how

00:56:13.800 nothing says relatable

00:56:15.780 like your $65,000 jewelry

00:56:18.960 or what she said,

00:56:20.400 nothing says relatable

00:56:22.080 like wearing the equivalent

00:56:23.140 of a down payment

00:56:23.940 on a house.

00:56:26.340 Yeah,

00:56:26.800 I think I would have

00:56:27.640 advised her

00:56:28.180 to tone it down

00:56:28.900 just a little bit.

00:56:29.720 Be yourself,

00:56:30.780 but we don't need

00:56:31.620 to go over the top

00:56:33.100 with the clothes.

00:56:33.840 We get it.

00:56:34.360 You're rich

00:56:34.880 and you're successful

00:56:35.900 and there may be designers

00:56:37.680 handing their clothes

00:56:38.800 to her

00:56:39.340 and saying,

00:56:40.000 wear this to court.

00:56:41.020 You never know

00:56:41.460 what's going on

00:56:42.060 behind the scenes.

00:56:43.300 But I think you do

00:56:44.040 have to,

00:56:45.380 you have to be cognizant

00:56:46.540 of these things.

00:56:47.520 I mean,

00:56:47.920 I remember,

00:56:48.740 you know,

00:56:49.080 somebody mentioned this

00:56:50.300 during the Depp

00:56:51.040 Heard trial.

00:56:52.320 I thought some of

00:56:53.240 Johnny Depp's suits

00:56:54.120 were just meh.

00:56:55.100 I kind of said that

00:56:55.740 on Twitter.

00:56:56.760 And some of his suits

00:56:58.460 were,

00:56:59.520 they looked great.

00:57:00.480 He dressed for court

00:57:01.280 every day,

00:57:01.920 showed respect

00:57:02.460 for the court.

00:57:03.560 And I thought

00:57:04.240 Amber's outfits,

00:57:05.620 I think she could have

00:57:06.440 used a little bit

00:57:07.180 of help.

00:57:07.600 Like the Colonel Sanders

00:57:08.540 outfit was not flattering.

00:57:10.260 So I think,

00:57:11.840 but I think when you're

00:57:12.720 saying to your audience,

00:57:15.020 to your jury,

00:57:15.680 and they are your audience,

00:57:17.260 that I am not at fault here.

00:57:19.080 I didn't do anything wrong.

00:57:20.720 I'm being magman,

00:57:21.820 magmanimous

00:57:22.700 and trying to make a point

00:57:23.920 by just asking for a dollar

00:57:25.680 plus my legal fees.

00:57:26.840 I'm not countersuing

00:57:27.980 this gentleman

00:57:28.580 for an outrageous amount

00:57:30.300 of money

00:57:30.700 other than my legal fees.

00:57:32.800 You have to keep in mind

00:57:34.240 that how you act

00:57:35.700 and how you dress

00:57:36.880 matters.

00:57:38.200 And,

00:57:38.220 but maybe the jurors

00:57:39.480 expect this.

00:57:40.260 Oh,

00:57:40.400 she's a celebrity.

00:57:41.180 She's going to be

00:57:41.840 dressed to the nines

00:57:42.780 and wearing very expensive

00:57:43.920 jewelry and clothing.

00:57:45.800 I don't know.

00:57:46.180 You're right though,

00:57:46.700 because the part of

00:57:47.800 what was distracting

00:57:48.480 to me when she was

00:57:49.560 on the stand

00:57:50.040 was the,

00:57:50.760 I'll see if my Botox

00:57:51.620 Botox allows me to do it.

00:57:53.100 But the,

00:57:53.680 with the like,

00:57:56.440 the eyebrows up.

00:57:58.120 Yeah,

00:57:58.720 I might be able to do it.

00:57:59.880 I'm overdue for,

00:58:00.720 for Botox.

00:58:01.540 I'm getting some pretty

00:58:02.540 good movements.

00:58:02.880 Raising the eyebrows.

00:58:03.580 Yes.

00:58:05.280 So she's definitely like 0.83

00:58:06.480 her facial expressions

00:58:07.440 are so affected.

00:58:08.720 It's a turnoff.

00:58:10.700 But then we got to meet

00:58:12.760 the plaintiff.

00:58:14.120 This is a whole host

00:58:15.520 of crazy coming from 0.55

00:58:16.580 his side of the aisle,

00:58:17.760 which we'll talk about.

00:58:18.800 So let's just set it up

00:58:20.260 still on the substance.

00:58:21.500 He's saying she hit him

00:58:23.340 and his injuries

00:58:26.160 from this crash

00:58:27.200 on the beginning

00:58:28.340 of a beginner ski run

00:58:30.340 were catastrophic.

00:58:31.760 And there's been

00:58:33.280 expert testimony

00:58:34.220 about just how bad

00:58:35.140 he says he broke

00:58:35.760 four ribs,

00:58:36.580 two entirely severed,

00:58:39.140 a traumatic brain injury

00:58:40.500 from being,

00:58:41.260 quote,

00:58:41.340 knocked out by her

00:58:43.040 after she slammed 0.98

00:58:43.820 into him.

00:58:44.680 And all this testimony

00:58:45.780 and how he's just

00:58:46.420 like a different man,

00:58:48.280 teary,

00:58:48.860 crying,

00:58:49.460 the daughter.

00:58:50.840 That to me,

00:58:51.760 like,

00:58:52.000 how do you think

00:58:52.640 that's playing?

00:58:53.520 Because it seems to me

00:58:54.480 like an overreach.

00:58:55.540 I think a little bit

00:58:58.140 of it is over the top.

00:59:00.460 I mean,

00:59:00.660 maybe he did

00:59:01.760 suffer some broken ribs,

00:59:04.020 but there had also

00:59:05.040 been some discussion

00:59:05.960 about him suffering

00:59:06.880 head injuries

00:59:07.560 prior to this.

00:59:09.140 Maybe this exacerbated that.

00:59:11.200 But it didn't sound like

00:59:12.540 he was all that great

00:59:13.560 of a guy

00:59:13.940 before this happened.

00:59:15.180 It didn't sound like

00:59:16.460 he, you know,

00:59:17.480 his daughter,

00:59:18.240 he and his daughters

00:59:18.840 had this fabulous relationship.

00:59:20.860 I mean,

00:59:21.020 maybe he's just kind of

00:59:21.980 a grumbly,

00:59:23.080 disgruntled guy,

00:59:24.000 generally speaking.

00:59:25.620 So I don't know.

00:59:26.860 It might be a little bit

00:59:27.680 over the top

00:59:28.280 on his part.

00:59:30.660 Yeah,

00:59:31.240 76 years old,

00:59:32.340 retired optometrist.

00:59:34.700 The accident happened in 16.

00:59:36.860 He filed the lawsuit in 19.

00:59:39.160 They have one eyewitness

00:59:41.100 and one eyewitness

00:59:42.800 who is his friend

00:59:44.480 who says it happened

00:59:46.000 the way Terry Sanderson said

00:59:47.540 that Gwen hit him.

00:59:49.200 She's got a witness

00:59:50.940 who she was paying

00:59:52.440 her son's ski instructor

00:59:54.840 who works for

00:59:55.760 Deer Valley Mountain

00:59:56.600 who it seems to me

00:59:58.800 he's not claiming

00:59:59.660 to have seen it,

01:00:00.680 but he is somehow saying

01:00:03.000 it was Terry Sanderson's fault

01:00:05.000 and not Gwyneth's.

01:00:06.920 And that's what it made.

01:00:07.620 He made it kind of sound

01:00:08.600 like it was indeed

01:00:09.600 Terry Sanderson's fault,

01:00:11.280 even though he didn't

01:00:12.400 directly see it.

01:00:13.720 He came upon this

01:00:14.840 after the fact.

01:00:15.940 It was interesting,

01:00:17.200 though,

01:00:17.480 because his friend,

01:00:18.740 Mr. Ramon,

01:00:19.860 there were apparently

01:00:20.520 some messages

01:00:21.320 from before the lawsuit

01:00:23.180 was filed in which

01:00:24.220 he was talking about

01:00:25.180 this crash with other people.

01:00:26.500 Let me pause you on that.

01:00:27.780 Wait, wait, wait.

01:00:28.180 Let me just pause you there

01:00:28.820 because this is a great

01:00:29.440 piece of the story.

01:00:30.600 So just first set up

01:00:31.380 what Ramon,

01:00:32.160 Terry's friend,

01:00:33.540 said that was helpful

01:00:34.900 to Terry

01:00:35.440 and then tell us

01:00:36.420 a little bit about

01:00:36.960 how the cross

01:00:37.580 of this eyewitness,

01:00:38.580 the only guy to see

01:00:39.260 the crash,

01:00:39.860 went.

01:00:41.560 Well,

01:00:41.980 there were these

01:00:42.580 messages discovered

01:00:43.660 in which he discussed

01:00:45.160 this and said that,

01:00:46.400 oh, Gwyneth Paltrow

01:00:47.780 hit Terry 0.51

01:00:48.820 and he was going

01:00:50.160 back and forth

01:00:50.780 with other people

01:00:51.420 about what he said

01:00:52.620 happened.

01:00:53.700 And it was interesting,

01:00:54.840 though,

01:00:55.020 because the cross

01:00:55.840 examination of this witness,

01:00:57.000 it seemed a little bit

01:00:58.480 combative.

01:00:59.060 He was a little bit

01:00:59.780 standoffish at times,

01:01:01.060 not wanting to acknowledge

01:01:02.100 things that he had said

01:01:03.160 in his deposition,

01:01:04.900 whether or not Gwyneth

01:01:06.140 was wearing goggles

01:01:07.080 or a helmet.

01:01:08.380 She's wearing goggles

01:01:09.260 and a helmet

01:01:09.760 and she's,

01:01:11.140 you're so many feet away

01:01:12.380 and, you know,

01:01:13.700 everybody's dressed

01:01:14.800 similarly.

01:01:15.780 How are you going

01:01:16.320 to know who hit who

01:01:17.320 unless you really

01:01:18.060 had your eyes

01:01:18.820 on somebody

01:01:19.920 and these people

01:01:20.620 could have collided

01:01:21.420 and, you know,

01:01:22.480 tumbling around

01:01:23.240 and everybody's

01:01:23.860 entangled with one another.

01:01:25.380 So they went

01:01:26.280 through his deposition,

01:01:28.200 you know,

01:01:28.500 point by point

01:01:29.380 and kind of

01:01:30.600 poked some holes

01:01:31.440 in what he said.

01:01:32.480 But these messages

01:01:33.300 that came to light,

01:01:34.480 I thought were

01:01:35.300 pretty interesting

01:01:36.020 because they were

01:01:36.820 prior to the lawsuit

01:01:38.060 being filed.

01:01:39.200 And I guess

01:01:40.140 you could say

01:01:40.940 maybe he was in cahoots

01:01:42.000 with his friend,

01:01:42.760 who knows,

01:01:43.340 but he was,

01:01:45.080 you know,

01:01:45.740 saying things

01:01:47.140 that were different

01:01:47.720 on the stand

01:01:48.440 than what he said

01:01:49.240 in his deposition

01:01:50.120 prior to the trial.

01:01:52.780 So here he is.

01:01:53.640 His name is Craig Ramone.

01:01:54.680 This is Terry Sanderson,

01:01:55.880 the plaintiff's friend

01:01:57.000 and the only eyewitness

01:01:58.040 to the crash

01:01:58.860 in Sade 18.

01:01:59.900 I looked over

01:02:02.200 and then about,

01:02:03.920 you know,

01:02:04.220 maybe one or two seconds

01:02:05.580 and then I heard

01:02:07.900 this scream

01:02:08.400 and then I see

01:02:10.460 this skier

01:02:11.760 just slam

01:02:13.160 into the back of Terry.

01:02:14.860 And she just slammed him. 1.00

01:02:17.020 And so Terry,

01:02:18.400 she hits him 0.70

01:02:19.240 right directly

01:02:19.960 in the back.

01:02:21.240 And so then,

01:02:22.220 then his skis

01:02:24.760 are like,

01:02:25.200 when you're skiing

01:02:25.800 or skiing like this,

01:02:27.620 his skis,

01:02:28.360 his skis actually,

01:02:29.580 the tips go out

01:02:30.580 like this

01:02:31.340 and he falls

01:02:32.780 face down.

01:02:34.540 So he's,

01:02:35.120 he's kind of,

01:02:35.840 he's kind of spread eagle

01:02:37.100 and he goes face down

01:02:38.880 and Gwyneth's

01:02:39.680 on the top of him

01:02:40.500 and they go down

01:02:42.020 like this

01:02:42.800 and then Gwyneth

01:02:43.920 hits him

01:02:44.560 and then bounces off 0.92

01:02:45.860 and slides to the right

01:02:46.860 about five or ten feet.

01:02:48.120 So that's the friend.

01:02:50.840 And then on cross-examination,

01:02:52.380 he was asked about

01:02:53.340 what he said

01:02:53.760 at his deposition,

01:02:54.740 which didn't totally

01:02:55.640 line up with his

01:02:56.380 on the stand testimony

01:02:57.620 as you point out,

01:02:58.820 saying,

01:02:59.400 first of all,

01:03:00.600 Gwyneth's lawyer points out,

01:03:01.860 when I took your deposition,

01:03:03.520 you claimed

01:03:04.320 that Terry had his helmet on

01:03:06.160 but the person he collided with

01:03:07.240 was not wearing a helmet.

01:03:09.120 Didn't you tell me

01:03:09.980 that the person,

01:03:11.060 that she was not wearing

01:03:12.080 a helmet?

01:03:12.740 And Ramon said,

01:03:13.800 I don't remember

01:03:14.560 what she was wearing

01:03:15.360 because it is

01:03:17.320 somewhat implausible

01:03:18.720 to think that Gwyneth Paltrow

01:03:19.980 was on this mountain.

01:03:21.460 It's me, Gwyneth Paltrow.

01:03:23.600 Hey, everyone.

01:03:24.420 Here I am.

01:03:25.460 Without her helmet

01:03:26.580 and her goggles.

01:03:27.260 She said she tries to like

01:03:28.000 blend in with everybody else

01:03:29.520 so she won't be recognized.

01:03:31.280 Of course.

01:03:31.940 And honestly,

01:03:32.520 she was skiing.

01:03:33.400 That's when you have your helmet.

01:03:34.600 I mean, like,

01:03:35.020 it's absurd to think

01:03:36.000 she didn't have it.

01:03:36.060 It would be like a daredevil

01:03:37.120 going down a slope

01:03:38.240 of any kind

01:03:38.880 without a helmet on.

01:03:40.300 And she was kind of

01:03:41.100 a beginner skier too.

01:03:42.380 So, I mean,

01:03:42.760 there just doesn't make sense

01:03:43.820 that she wouldn't have

01:03:44.620 had the helmet on.

01:03:45.640 So it does suggest

01:03:46.420 he was lying

01:03:47.060 at the depot

01:03:47.620 when he said,

01:03:48.500 oh, I knew she hit him

01:03:49.560 because I could see her.

01:03:50.440 I could see the blonde hair

01:03:51.240 and I knew she was the one.

01:03:52.260 So they got him a bit

01:03:53.220 on that uncrossed,

01:03:54.120 suggested he was a liar.

01:03:55.400 They also got him

01:03:56.160 to admit that

01:03:57.080 Terry said

01:03:58.800 that he was okay.

01:04:00.560 That Terry,

01:04:01.100 right after the accident,

01:04:02.200 the victim,

01:04:03.060 alleged victim,

01:04:04.180 said he was okay.

01:04:05.840 And the lawyer got up

01:04:06.900 and said,

01:04:07.200 didn't you say that?

01:04:07.980 You said that five years ago

01:04:09.020 and I took your deposition.

01:04:10.100 And he responded,

01:04:10.820 well, if I did,

01:04:11.320 I probably didn't understand

01:04:12.120 your question.

01:04:13.080 I think you're taking

01:04:13.660 this stuff out of context

01:04:15.020 because I never said

01:04:16.220 he was okay.

01:04:17.260 But then,

01:04:18.300 then this interesting twist

01:04:20.100 happens that you talk about

01:04:21.300 where there's some online app

01:04:24.460 called the Meetup app

01:04:25.720 where people chat.

01:04:27.300 And Craig Ramone,

01:04:28.660 that witness,

01:04:29.420 was in there

01:04:30.420 and one of the viewers

01:04:31.200 went in there

01:04:31.600 and found an exchange

01:04:32.800 by Craig

01:04:33.780 that really helps

01:04:35.280 Terry Sanderson.

01:04:35.940 and it was well

01:04:36.680 before Terry filed

01:04:37.760 the lawsuit,

01:04:38.700 Anjanette.

01:04:39.220 Right.

01:04:39.860 Yes.

01:04:41.140 Yes.

01:04:41.440 And he was basically

01:04:42.260 saying things,

01:04:43.240 answering questions

01:04:44.100 from people in this app

01:04:45.600 about the accident

01:04:46.840 prior to the suit

01:04:47.960 being filed,

01:04:48.460 as you said.

01:04:49.620 And the things he said

01:04:50.520 in there did make it sound

01:04:51.580 like he was adamant

01:04:52.560 in there that

01:04:53.340 Gwyneth hit Terry 0.97

01:04:54.700 and that he was hurt.

01:04:57.380 So these did contradict,

01:05:00.580 these did counter

01:05:01.960 Gwyneth's claims

01:05:03.180 that she was the one

01:05:04.420 who was hit.

01:05:05.360 So what is the truth?

01:05:07.160 Is it the deposition?

01:05:08.340 Is it the messages

01:05:09.120 prior to the lawsuit

01:05:10.740 being filed?

01:05:11.440 Is it what he's saying

01:05:12.180 on the stand?

01:05:13.440 The truth shouldn't change.

01:05:14.800 The truth should be the truth.

01:05:16.000 So those answers

01:05:17.020 should be consistent.

01:05:18.960 Mm-hmm.

01:05:19.680 So do you have any

01:05:21.120 back-of-the-envelope

01:05:22.080 guess on how this is going?

01:05:24.120 Now, having watched,

01:05:25.280 the plaintiff took the stand,

01:05:26.620 Gwyneth took the stand.

01:05:28.040 This week they read testimony

01:05:29.480 from depositions

01:05:30.360 from her two children

01:05:31.340 who didn't witness the accident

01:05:33.340 but heard her down 0.88

01:05:34.300 in the lodge afterwards 1.00

01:05:35.120 saying some asshole 1.00

01:05:36.740 hit me, you know? 1.00

01:05:38.240 So even to her kids,

01:05:40.900 she was maintaining

01:05:41.800 the story of

01:05:42.640 I was the one

01:05:43.320 who got hit.

01:05:45.540 You know,

01:05:46.560 both plaintiff,

01:05:47.660 the plaintiff

01:05:48.120 and the defendant

01:05:48.660 are both kind of odd

01:05:49.880 slash unrelatable

01:05:51.880 or unlikable.

01:05:53.100 You know,

01:05:53.340 how do you handicap

01:05:54.020 this one so far?

01:05:55.660 I don't know.

01:05:56.620 A lot of,

01:05:57.020 it's hard for me to tell

01:05:58.300 because there have been times

01:05:59.540 where I thought

01:06:00.060 Gwyneth was winning.

01:06:02.760 But then you've got

01:06:03.720 these other times

01:06:04.740 where there seem to be

01:06:06.040 things playing

01:06:06.700 in Terry's favor.

01:06:07.960 But part of me thinks,

01:06:09.060 is Terry embellishing?

01:06:10.760 Is there something

01:06:11.660 more going on here?

01:06:13.280 I know that,

01:06:14.100 you know,

01:06:14.380 they were saying

01:06:15.000 from the get-go

01:06:15.800 that Gwyneth was saying

01:06:17.140 she was hit.

01:06:18.220 Is it possible

01:06:18.940 that they both think

01:06:20.000 the other hit the other?

01:06:21.380 I have no idea.

01:06:22.700 I guess that's possible.

01:06:25.100 But it just seems to me

01:06:26.080 either one person

01:06:27.060 is up the hill,

01:06:28.420 one person's down.

01:06:29.940 These things

01:06:30.460 should not be that,

01:06:32.400 there shouldn't be

01:06:33.080 that much confusion

01:06:33.980 over who was

01:06:35.000 going down the hill,

01:06:36.600 who was farther down,

01:06:38.000 who had the right of way,

01:06:39.340 who was supposed to yield.

01:06:41.260 So I don't know.

01:06:42.000 It could end up being a wash.

01:06:44.040 I don't know.

01:06:45.040 But by all accounts,

01:06:46.180 it seems like the jury

01:06:47.260 is kind of enthralled by this

01:06:49.240 and whether or not

01:06:50.260 they are going to believe

01:06:51.620 Gwyneth over Terry.

01:06:53.760 We'll just have to wait and see.

01:06:55.120 I don't think it was

01:06:55.900 a good look for him

01:06:56.800 to not be in the courtroom

01:06:59.080 during a lot of the testimony.

01:07:01.060 I guess he wanted his daughters

01:07:02.200 to be able to speak freely

01:07:03.460 and not feel pressured,

01:07:04.640 but they're your daughters.

01:07:06.200 They should be able

01:07:07.240 to sit there

01:07:07.820 and tell the story

01:07:08.800 or what they experienced

01:07:10.440 from their vantage point

01:07:12.340 without feeling pressured by dad.

01:07:14.320 So it just seemed like

01:07:15.100 a very strange dynamic.

01:07:17.540 Yeah, he claimed

01:07:18.960 they were going to give testimony

01:07:20.540 about how bad he is now,

01:07:23.260 like how much brain function

01:07:25.180 he's lost.

01:07:26.620 And, you know,

01:07:27.560 the lawyers represented,

01:07:29.040 oh, you know,

01:07:29.720 Mr. Sanderson doesn't want,

01:07:31.660 the daughters don't want 1.00

01:07:32.940 the dad to hear that.

01:07:34.020 So he's going to be outside

01:07:34.960 of the courthouse,

01:07:36.020 courtroom for their testimony.

01:07:37.340 We'll see.

01:07:38.820 It gets,

01:07:39.560 does the jury

01:07:40.120 get the case tomorrow?

01:07:42.080 I heard it's wrapping up Thursday.

01:07:44.760 Yeah, it could be tomorrow.

01:07:46.060 It sounds like it could be tomorrow.

01:07:47.720 It was supposed to last eight days.

01:07:49.740 So so we'll see.

01:07:50.940 It sounds like things

01:07:51.720 are winding down

01:07:53.260 and wrapping up

01:07:54.120 and we'll be keeping

01:07:55.200 an eye on it, of course.

01:07:56.880 How much more could there be?

01:07:58.140 A law and crime network.

01:07:59.200 Love it.

01:07:59.800 Right.

01:08:00.180 I mean, how many more witnesses

01:08:00.940 could we get on there?

01:08:03.040 Love your coverage,

01:08:04.060 Jan Jeanette,

01:08:04.360 not just of this case,

01:08:05.180 but of all of them.

01:08:06.320 Well worth the follow

01:08:07.000 on Twitter as well.

01:08:07.860 Great to see you.

01:08:09.100 You too.

01:08:09.660 Thanks for having me.

01:08:11.100 All right.

01:08:11.340 We're not done.

01:08:12.180 We're going to be right back

01:08:12.880 with Mark Garagos

01:08:13.620 and John Spilboer,

01:08:14.500 who've been watching this trial,

01:08:15.500 and we're going to play you

01:08:16.200 all the soundbites

01:08:17.260 in this next segment

01:08:18.240 and talk about

01:08:19.320 why the Internet

01:08:20.040 is comparing Gwyneth Paltrow

01:08:21.660 to Jeffrey Dahmer.

01:08:25.580 Sometimes the Internet

01:08:26.480 is a force for good,

01:08:27.580 notwithstanding that discussion

01:08:28.640 in hour one.

01:08:33.160 Here to continue our coverage

01:08:34.360 of the Gwyneth Paltrow

01:08:35.140 ski crash trial

01:08:36.200 is Mark Garagos,

01:08:37.680 trial lawyer and managing partner

01:08:38.980 at Garagos and Garagos

01:08:40.140 and John Spilboer,

01:08:41.580 criminal defense attorney

01:08:42.460 and founding attorney

01:08:43.520 at John Spilboer Law.

01:08:46.180 OK, so back to Maureen Callahan,

01:08:48.040 who I just absolutely adore.

01:08:49.520 She goes into

01:08:50.420 like her observations

01:08:51.820 on this trial

01:08:52.480 and she says,

01:08:53.500 there's Gwyneth,

01:08:54.240 typical Gwyneth,

01:08:55.400 with her sipping green juice,

01:08:57.840 hiding her face

01:08:58.620 from the non-existing paparazzi,

01:09:00.420 holding her face

01:09:03.540 behind her $250

01:09:05.020 monogram Smithson notebook,

01:09:08.060 which she loves so much

01:09:09.380 because it has no lines,

01:09:11.740 pouting, puckering,

01:09:13.160 wan expressions of boredom,

01:09:15.260 her barely concealed texting

01:09:16.900 during testimony.

01:09:18.460 It's quintessential Gwyneth

01:09:19.560 who once said,

01:09:20.400 I am who I am.

01:09:22.000 I can't pretend to be somebody

01:09:23.580 who makes $25,000 a year.

01:09:26.080 I love Maureen.

01:09:28.780 This is one of the reasons

01:09:30.300 why most celebrities

01:09:31.580 would not go to trial.

01:09:33.340 The closer look we get at them,

01:09:35.580 the less we tend to like them.

01:09:37.060 And let's face it,

01:09:37.820 we don't tend to be rooting for them

01:09:39.240 going into it, do we, Mark?

01:09:41.600 No, we don't.

01:09:43.420 You know, you and I discussed before

01:09:45.460 Depp and Heard

01:09:46.960 that who wants to air that.

01:09:49.080 I actually think in some ways

01:09:51.920 Johnny came out of that

01:09:53.360 much better than I ever expected.

01:09:56.060 But this has been this.

01:09:57.660 I was telling your producer, Megan,

01:09:59.200 I'm more fascinated by this case

01:10:01.700 than Depp and Heard

01:10:03.080 for a variety of reasons.

01:10:05.560 I, the lawyering in this case,

01:10:07.920 nothing gets me more excited

01:10:09.920 than watching the lawyering 0.67

01:10:11.500 in this case.

01:10:12.920 It's amazing.

01:10:14.440 We've got to kick it off, guys,

01:10:15.940 with the lawyer,

01:10:17.020 Kristen Van Orman.

01:10:18.720 I'm sorry.

01:10:19.320 I have a love-hate relationship with her.

01:10:21.100 I do not want to be like her.

01:10:22.380 I don't want to be,

01:10:23.000 I do not want to be just like her,

01:10:24.620 but I can't take my eyes off of her.

01:10:26.840 Here is the highlight

01:10:27.700 or, depending on your view,

01:10:29.160 low-light reel of her.

01:10:31.940 And I'm assuming,

01:10:33.720 and you're under oath here,

01:10:35.460 that you're a good tipper.

01:10:37.760 Yes.

01:10:38.480 Okay.

01:10:39.060 Fantastic.

01:10:39.700 I wouldn't expect anything less.

01:10:41.400 I'm a mom, right?

01:10:42.460 I've got a couple kids.

01:10:44.360 Actually, about your age.

01:10:45.620 I'm one of them.

01:10:46.460 Not your age. 0.92

01:10:47.620 Your daughter's age.

01:10:49.020 Sorry.

01:10:49.680 I'm not that old.

01:10:51.320 May I ask how tall you are?

01:10:53.140 I'm just under 5'10".

01:10:56.020 Okay.

01:10:56.500 I am so jealous.

01:10:57.740 I think I'm shrinking, though.

01:10:59.400 You and me both.

01:11:00.180 I have to wear four-inch heels

01:11:01.820 just to make it to 5'5".

01:11:03.140 Wow.

01:11:03.460 They're very nice.

01:11:04.200 Thank you.

01:11:05.020 We're about the same height?

01:11:07.260 About 5'5"?

01:11:08.320 With heels? 0.94

01:11:10.320 Roughly.

01:11:10.940 Oh, tell me I'm taller, please.

01:11:12.840 I was yelling at him.

01:11:14.520 Pretty loud.

01:11:16.020 Pretty forceful.

01:11:16.660 I was pretty upset.

01:11:18.440 Right?

01:11:18.900 You're small but mighty.

01:11:19.900 Actually, you're not that small.

01:11:23.560 You were wearing goggles and helmet.

01:11:25.860 Yes.

01:11:26.280 Okay.

01:11:26.440 Kind of looked like everybody else on the slope.

01:11:28.880 That's always my intention.

01:11:30.440 Okay.

01:11:31.660 Probably had a better ski outfit, though, I bet.

01:11:34.460 I still have the same one.

01:11:37.280 My God, Jonna.

01:11:38.400 Is it over?

01:11:39.400 Did it stop?

01:11:40.200 It's just...

01:11:40.500 It's never going to be over.

01:11:44.880 Never going to be over.

01:11:46.220 You know, this whole fangirl thing that she had going on is literally cringeworthy. 0.92

01:11:53.780 And if I were her client, I'd be a little ticked off because the message that sends to

01:11:59.820 the jury is even I like her, you know, and I have to cross-examine her because she did

01:12:04.740 my client wrong.

01:12:05.880 Like, it was just really, really horrible.

01:12:08.660 And she was trying too hard.

01:12:10.040 And I'm going to have nightmares about, you know, that whole...

01:12:13.080 When she made the comment about, you're not that small, I just wish I could have got inside

01:12:18.520 Gwyneth Paltrow's head at that very moment.

01:12:22.420 I see.

01:12:22.840 I have a different interpretation of the motivation behind those moments.

01:12:27.080 Mark, but let me tell you, I don't see her as trying to ingratiate herself with Gwyneth

01:12:30.460 Paltrow.

01:12:30.920 I think that's her.

01:12:32.260 I'm just like you, members of the jury.

01:12:33.920 I'm poor, not rich.

01:12:35.940 I'm short, not tall.

01:12:37.920 I don't have a fancy ski outfit.

01:12:39.280 I recognize how unrelatable Gwyneth Paltrow is, and I'm just making a big joke out of

01:12:43.280 it all that only we, the Utahns watching this, get.

01:12:48.500 Well, so you took the thought right out of my head.

01:12:52.080 I said, what I was going to say is, one of the reasons I don't do state court outside

01:12:57.580 of California is because the peculiar culture is something you just can't tap into that quickly.

01:13:04.360 And if, if this is effective in that Utah state court, then that proves my point because

01:13:12.280 it's cringeworthy.

01:13:15.640 But it's Utah and doesn't sound right.

01:13:17.980 My viewers in Utah need to tell me how to say that.

01:13:20.360 You, you, you, you townsian.

01:13:21.740 I don't know how we refer to our, our friends in Utah.

01:13:24.840 Um, I know they're not all like this cause I know a lot of folks who live there.

01:13:28.220 Um, this, so I think she is making a miscalculated attempt to ingratiate herself with the jury. 1.00

01:13:33.680 I don't think it's going to play.

01:13:36.240 Um, but the, the lawyer representing Gwyneth Paltrow in his own way is equally annoying. 0.98

01:13:43.900 So he's been kind of a jerk at various times. 0.99

01:13:48.460 And he's also a little bit of a stutterer. 1.00

01:13:51.300 Like he doesn't have a stutterer.

01:13:52.700 He just like, he trips on his words a fair amount.

01:13:55.620 And the thing that's driving me crazy is this massive head cold that he appears to have

01:13:59.800 where he is snotting all over every trial exhibit, his hands, his nose.

01:14:04.220 He's got like the tissue.

01:14:05.040 He's shoving the tissue up his nostrils with every other question.

01:14:08.860 Take a Sudafed for the love of God.

01:14:10.920 It's distracting.

01:14:11.740 It's gross.

01:14:12.580 He's really sticking it up the nostril.

01:14:14.500 Here we go.

01:14:15.320 I'm real.

01:14:16.460 And I'm sorry.

01:14:17.420 Megan, do you have, has the thought or Jonna, has the thought crossed your mind?

01:14:22.380 Isn't this guy reminiscent of the public defender in My Cousin Vinny?

01:14:26.440 Oh my God, I said that.

01:14:28.720 I, not only did I say that, I have it queued up for you, Mark Garagos.

01:14:33.600 Here's the man.

01:14:34.860 Here he is.

01:14:35.340 Nobody told me, but.

01:14:36.860 January 4th of this year, my client did indeed visit the Sack of Suds.

01:14:46.840 Um, um, um, um, um, um, um, convenience store, but, but, he didn't, um, cure anyone.

01:15:03.600 He, he, uh, um.

01:15:07.980 Mark.

01:15:08.660 I cannot watch this without thinking of that scene, without thinking of the opening statement.

01:15:17.180 It just, I never, that's why I said this to me is infinitely more intriguing than Defty

01:15:23.480 Heard.

01:15:24.200 Megan, I have a phrase for him.

01:15:26.880 He is purposely unpolished, is the phrase I have for her attorney.

01:15:32.680 And if you keep showing My Cousin Vinny clips, I'm going to do my best Marissa Tomei impersonation. 0.99

01:15:37.560 It's phenomenal.

01:15:39.020 I usually save it for after I've had a cocktail, but I'll do it for you.

01:15:42.580 If you want me to, we can talk about it later.

01:15:44.840 Hell yes.

01:15:45.460 Who cares about the trial?

01:15:46.540 Let's see it.

01:15:48.260 All right.

01:15:48.720 Well, I have to say, I'm going to, I can say any word I want, right?

01:15:51.580 Yeah.

01:15:51.820 Yeah.

01:15:51.980 Ms. Vito.

01:15:52.720 Yes.

01:15:53.020 Ms. Vito.

01:15:53.560 We want to hear from you.

01:15:54.800 This is the line.

01:15:56.620 It's called disclosure. 1.00

01:15:58.360 You dickhead. 0.99

01:16:00.140 Not bad. 1.00

01:16:01.400 Not bad.

01:16:03.400 Very good.

01:16:04.460 There's so many classic moments from that movie, right? 1.00

01:16:06.440 And she's like, imagine you're a deer in the whole scene in your fucking head. 1.00

01:16:12.260 Sorry. 1.00

01:16:12.600 Okay.

01:16:12.860 That was an unnecessary swear.

01:16:14.760 All right.

01:16:15.320 So here's what Gwyneth Paltrow said happened to her.

01:16:18.800 She claims she was the innocent victim, minding her own business. 0.99

01:16:21.580 And what she thought was a perverted dude came from behind between her legs with his skis 1.00

01:16:26.120 and whammo, they're down in the snow. 0.99

01:16:28.000 Watch.

01:16:28.240 I was skiing and looking downhill, as you do, and I was skied directly into by Mr. Sanderson.

01:16:37.320 I didn't know if it was an intentional assault of a sexual nature.

01:16:41.480 Right.

01:16:42.160 Okay.

01:16:43.880 Was he grinding and thrusting or something or just the noises?

01:16:48.560 What made you think it was a sexual assault?

01:16:52.560 So that was a quick thought that went through my head when I was trying to reconcile what

01:16:57.620 was happening.

01:16:58.660 I was skiing and two skis came between my skis, forcing my legs apart. 0.91

01:17:04.260 And then there was a body pressing against me and there was a very strange grunting noise.

01:17:10.820 So my brain was trying to make sense of what was happening.

01:17:14.400 I thought, am I, is this a practical joke?

01:17:18.060 Is someone like doing something perverted?

01:17:20.700 This is really, really strange.

01:17:22.540 My mind was going very, very quickly and I was trying to ascertain what was happening.

01:17:26.740 He was still on the ground, right?

01:17:28.600 Yes.

01:17:29.020 When you said, what are you doing?

01:17:31.100 Yes.

01:17:31.620 Okay.

01:17:32.200 Like, why did you do that?

01:17:33.880 Yes.

01:17:34.400 And he said, I think you skied into me.

01:17:37.020 Yes.

01:17:37.500 And that's when you were furious and said, you skied directly into my effing back at the

01:17:44.720 top of your lungs.

01:17:45.640 Yes, I did.

01:17:46.680 Okay.

01:17:47.040 I apologize for my bad language.

01:17:49.580 After you were screaming to him, isn't that when Mr. Sanderson said, I'm sorry, I'm sorry.

01:17:56.580 That I thought it was very minor on the day.

01:17:59.400 And you didn't stick around long enough to find that out.

01:18:02.440 I stuck around long enough for him to say he was okay to stand up, that he told Mr. Christensen

01:18:09.760 he was okay.

01:18:11.820 All right.

01:18:12.440 So before we play the plaintiffs, what did you make of Harry Mark?

01:18:14.960 I made that, I'm going to make a bold prediction on your show that this is the subject, that

01:18:22.120 clip will be the subject of a Saturday Night Live skit this week.

01:18:26.120 I have no doubt because the amount of comedic material that was just there.

01:18:32.480 And by the way, this, can you imagine, Megan, go back to when you were trying cases.

01:18:37.460 Because most of the judges I know would have gone ballistic on me if I had even tried any

01:18:44.200 of this stuff.

01:18:45.600 I mean, there was the one moment where the woman cross-examining her, who we talked about,

01:18:49.960 the lawyer, tried to get Gwyneth to come down off the stand and do a reenactment with the 0.99

01:18:55.540 lawyer on whose legs went into who she was going to, I guess, come from behind and do the grunting. 1.00

01:19:00.240 I have no idea.

01:19:00.980 Thank God.

01:19:01.840 There was an objection which was sustained.

01:19:03.920 No one needed to see that.

01:19:05.240 All right, so that was fine.

01:19:07.700 That was her, I mean, I will say I didn't, like her little Jonna, you know, like, I'm

01:19:12.620 sorry, forgive me for swearing, you know, like, come on, right? 0.59

01:19:16.440 She's so fake.

01:19:18.460 Yeah, that, that was a little fake.

01:19:20.120 I also thought it was odd.

01:19:21.420 I mean, she lost some points with me because I can think of a lot of situations where she

01:19:25.820 might feel that somebody was sexually assaulting her, but going, I don't know, 20 miles an hour

01:19:31.460 down a ski slope, really, that just didn't add up for me.

01:19:35.420 Like, it's more plausible that you're just going to bump into somebody and fall down.

01:19:38.900 It's not plausible that somebody's going to come at you 20 miles an hour and try to cop

01:19:43.140 a feel.

01:19:43.660 So that didn't make any sense.

01:19:45.760 That's such a good point.

01:19:47.160 Why didn't I think of that before this moment? 0.72

01:19:49.360 I mean, one time I was in Italy, there was a guy jerking off on a bike as he went by me.

01:19:53.280 That was actually very, I mean, that was, that was impressive.

01:19:56.200 It was nimble.

01:19:57.260 It was, it was nimble.

01:19:58.860 So, but like in a ski mountain, you're all in your gear.

01:20:03.760 That's an extreme, extreme.

01:20:07.560 Fell flat, fell flat on me when she said that.

01:20:10.160 This is why you're a brilliant lawyer, because you think of, you get, you get the really sensible

01:20:13.680 takes on things.

01:20:15.160 All right, so let's wait no longer.

01:20:16.760 Here's Terry Sanderson, the plaintiff in this case, trying to reenact what he says happened

01:20:21.420 in his eyes.

01:20:22.740 This is SOT 14.

01:20:24.680 There was nothing, nothing in front of me.

01:20:27.940 And so I came around that corner and it was, it takes my breath away to think I, this is

01:20:35.240 hard because I don't like going through this scene.

01:20:38.580 I, I just remember everything was great.

01:20:43.700 And then I heard something I've never heard at a ski resort.

01:20:47.800 And that was a blood curdling scream.

01:20:51.420 Just, I can't do it.

01:20:53.260 It was, and then boom.

01:20:58.440 And it was like somebody was out of control and going to hit a tree and was going to die.

01:21:06.480 And that's what I had until I was hit.

01:21:11.700 You know, I got hit in my back so hard and it, I, I'm right at my shoulder blades and it

01:21:18.360 felt like, and it was perfectly centered.

01:21:20.960 And the fists and the poles were right there at the bottom of my shoulder blades. 1.00

01:21:26.380 Serious, serious smack. 0.71

01:21:28.400 Never been hit that hard.

01:21:30.160 And I'm flying.

01:21:30.840 I'm absolutely flying.

01:21:33.560 Now, you're not airborne.

01:21:35.780 Well, it, all I saw was a whole lot of snow and I didn't see the sky, but I was flying in that sense.

01:21:47.120 Did the person who struck you land on top of you?

01:21:50.580 I wouldn't know that.

01:21:53.000 I absolutely would not know that.

01:21:54.880 I was just surprised.

01:21:55.840 I had no upper body strength enough to be able to catch myself.

01:22:00.460 I had no idea.

01:22:01.940 Do you remember hitting your head on the ground?

01:22:04.840 No, that part, no, that's all gone.

01:22:10.500 Okay.

01:22:10.860 Before we react to that, I'm just going to give you a flavor of how cross-examination went,

01:22:15.440 because we cannot discuss Terry without discussing moments like this one, SOT 16.

01:22:24.800 Do you recall saying that you agreed that saying I'm famous was a crazy thing to say?

01:22:32.820 Agree?

01:22:33.300 Absolutely, it's not me.

01:22:36.800 Don't buy into that.

01:22:38.280 But it was you, right?

01:22:40.100 Just to be clear.

01:22:41.200 When you say it wasn't me, it was, in fact, you.

01:22:44.620 It's the other personality that's inhabiting my body right now.

01:22:49.080 And you blame Gwyneth Paltrow for that?

01:22:51.700 Yes.

01:22:52.920 No question.

01:22:56.720 Who would like to start on that one?

01:22:59.400 I once had a preliminary hearing, Megan, where the woman who was the accuser against my client admitted on cross-examination that she had multiple personalities and that one personality had been the victim of my client.

01:23:16.340 And this apparently, you know, that woman was actually diagnosed with a psychiatric illness.

01:23:23.720 I don't understand what this guy is doing.

01:23:27.100 I don't understand why his lawyer thought this was a good road to go down.

01:23:32.340 They had coming attractions.

01:23:34.340 They knew from the deposition that he was going to say these things.

01:23:37.820 And he's going to blame Gwyneth for his split personalities.

01:23:42.040 Yes.

01:23:42.400 That's what happened, John.

01:23:43.500 What we were seeing there on cross for the audience is he had tweeted to his daughter, sorry, texted to his daughters after the accident.

01:23:50.960 I'm famous because he was in the news for having collided with Gwyneth Paltrow.

01:23:56.720 And there was testimony by one of his daughters that he'd been Googling himself and kind of getting off on seeing his name out there linked to Gwyneth as like, I'm a star.

01:24:05.840 And he admitted at his deposition, you know, that he did do that.

01:24:11.200 And now the lawyer is trying to rub it in his face.

01:24:12.920 And he's saying it was his his split personality caused by this brain injury that he the normal Terry would never have celebrated his fame.

01:24:22.820 Right. You know why?

01:24:24.020 Because the normal Terry didn't just have multiple personalities.

01:24:27.120 The normal Terry must have had multiple bodies because he used to be able to multitask by driving down the road and reading at the same time.

01:24:36.580 And part of his damages is he's no longer able to do that.

01:24:40.520 Thank the Lord.

01:24:42.060 So I thought I thought it was kind of funny that his damages are actually one of his daughters said part of his damages are damage to his personality because his personality has changed.

01:24:54.560 Not that that happens anyway, when you're, you know, maybe getting up in years.

01:24:58.640 And how do you prove damage to a personality?

01:25:01.720 So this guy, you know, this adds credence to the theory that he is only here because it is Gwyneth Paltrow.

01:25:09.720 And if it were John Q public, we never would have heard of Terry Sanderson.

01:25:14.560 I know the thing that the feeling you get, Mark, that he may be lying about his damages undermines his entire claim.

01:25:22.000 I agree.

01:25:22.800 He comes off as a grifter and this does not help the cause at all.

01:25:29.560 But by the way, it's kind of a battle of who do you who do you want or detest more on this case?

01:25:37.240 Because it really is when one side does something, the other side says, oh, yeah, well, I'm going to one up you.

01:25:43.680 It's just the that's why it's so fascinating and intriguing.

01:25:47.580 It's true.

01:25:48.020 Well, she found the perfect lawyer for her because, you know, she's off. 0.61

01:25:51.100 She is off socially like I mean that just the stuff I was quoting from Maureen Callahan, you know, like I can't act like and she she got she was in the news, according to Maureen for she was on some Vespa and almost like cut off a school bus full of children.

01:26:04.540 And like she's just a little flighty and a little out there and not somebody you can really relate to very well if you're sitting in that jury box.

01:26:10.960 And and yet he appears to be lying.

01:26:14.060 So but he's got the witness.

01:26:16.380 He's got the friend.

01:26:18.360 Give her lawyer credit. 1.00

01:26:20.340 He kind of dismantled this guy with that.

01:26:23.740 Oh, shucks, cross examination of his.

01:26:26.080 I don't know how he recovers from that, especially because he's got the burden of proof.

01:26:31.540 Unless, like I said, unless this plays well in Utah, I've tried cases in Utah.

01:26:36.460 I just don't find that to be true.

01:26:38.120 But he but he's got the friend who's the eyewitness.

01:26:41.360 And not only does the friend, of course, it's his friend.

01:26:43.260 I get it.

01:26:43.760 The friend wants to support Terry.

01:26:46.080 But as we were talking about with Anjanette, they they found messages that the friend posted online.

01:26:51.660 I'm trying to find the exact ones earlier before this case was ever here.

01:26:55.940 They are ever filed in which he said things like the following.

01:26:59.260 She took her plane at a millionaire airport.

01:27:05.060 What makes me mad is Gwyneth took out Terry and then took off.

01:27:09.100 Another one reads Terry was not doing the man thing.

01:27:12.060 He had a bad hit to the head. 1.00

01:27:13.740 You do not get taken down the hill by ski patrol if you were hit on the ass. 1.00

01:27:17.660 He's saying like he didn't just stand up and say he's fine. 0.99

01:27:20.260 He might have said in the moment that he I'm OK.

01:27:22.280 But the way the witness testified about it, it was just like, oh, yeah, I'm OK.

01:27:26.340 You know, like he didn't know what had happened to him yet.

01:27:28.420 And then he writes on what you did not see was Terry was knocked out cold.

01:27:33.160 I did see the hit.

01:27:34.620 Terry did not know his name.

01:27:36.380 I asked him and he did not know.

01:27:38.720 And goes on to say, you're trying to make light of it.

01:27:40.340 You guys didn't see what I did see.

01:27:42.160 So that's pretty helpful.

01:27:44.620 How do you get around that, John, as as Gwyneth's lawyer?

01:27:49.020 I'll tell you how.

01:27:50.120 First of all, Gwyneth Paltrow is the size of a straw.

01:27:54.120 These two collided.

01:27:55.740 She basically hurt her knee and had to go get a massage.

01:27:58.420 He's claiming traumatic brain injury.

01:28:01.740 That doesn't add up, Megan.

01:28:03.900 Now, you know, granted, I know sometimes you could have a car accident.

01:28:06.500 Right.

01:28:06.700 That's a slow moving car accident.

01:28:08.160 One person can get very hurt.

01:28:09.180 The other person doesn't.

01:28:10.520 But when you're person to person like that, it just doesn't make sense for him to be that

01:28:14.580 injured.

01:28:14.860 And don't forget, her camp brought in some experts.

01:28:19.480 And I think there was an expert on the stand earlier today talking about examining his brain

01:28:24.700 scans.

01:28:25.320 And he was his brain was the same as now as it was before the ski accident.

01:28:30.020 So he's got the science isn't on his side.

01:28:33.100 Let's put it that way.

01:28:34.360 You know, in addition to that, not only is the science not on his side, if you watch him

01:28:38.940 on direct, which the jurors will and then watch him on cross, he clearly is changing or he's

01:28:44.940 got that kind of facile ability to change his memory, to change his recall and to change

01:28:50.780 kind of the the appearance of how he's acting.

01:28:54.260 That's not somebody who's had TBI.

01:28:56.300 And they're even talking about in that his lawyers are talking about.

01:29:00.880 Confabulation.

01:29:01.640 I mean, it seems a little crazy under cross examination of the University of Utah's director

01:29:07.320 of stroke rehab, which who got up there.

01:29:10.680 Terry, the plaintiffs got to cross him.

01:29:12.920 He was Gwyneth's lawyer.

01:29:14.640 And this guy had said this guy, if he probably didn't have a loss of consciousness, I don't

01:29:19.420 think he did.

01:29:19.920 And if so, he can't be called a concussion.

01:29:22.040 He had preexisting anxiety and depression.

01:29:24.220 He has a history of drug seeking prior to this collision and goes on.

01:29:28.140 And then on the cross, Sanderson's team asked him this witness about the phenomenon of confabulation

01:29:33.920 in which a person invents experiences that never happened while earnestly believing that

01:29:39.100 they did suggest in being any inconsistent testimony by Mr.

01:29:42.060 Sanderson was the result of his brain injury.

01:29:45.020 Well, that's convenient.

01:29:45.780 Mark is, isn't it?

01:29:47.860 I just I just actually you could take that and shove it right back at them because that

01:29:53.280 he could have had confabulation prior to this.

01:29:56.520 And that would and it really would have been supported by some of this testimony.

01:30:00.680 So I don't understand what they're doing.

01:30:03.340 I don't even understand why this case is being tried.

01:30:06.080 The insurance companies, I would have thought, would have said no to this nonsense.

01:30:09.800 Well, a lot of people think that she is in the right and they believe her because she's

01:30:13.980 a celebrity, Jonna, and they think, why would a celebrity put herself through this?

01:30:17.160 Three hundred thousand dollars is not that much for someone who's flying out to Deer

01:30:20.420 Valley on a private jet and has sixty five thousand dollar necklace on while not to mention

01:30:24.400 the two thousand dollar shoes and so on while she's out in this court and subjecting her 1.00

01:30:27.820 children to taking depositions, her husband like she's in it.

01:30:31.700 She is in it to win it.

01:30:33.760 You know, I thought the same thing.

01:30:35.360 And similar to what you said, Mark, like, why didn't this settle?

01:30:38.520 And the only thing I can think of is one of them had to be unreasonable.

01:30:43.520 Right.

01:30:43.920 So either her camp said, we're not going to pay it.

01:30:45.980 We're not even going to pay nuisance value to make this go away.

01:30:49.520 Or the other side said, we're not going to settle for nuisance value.

01:30:52.860 And I'm more inclined to think because of the celebrity factor, it would be, you know,

01:30:57.640 the plaintiff side claiming I might as well go all the way.

01:31:00.840 I got nothing to lose.

01:31:01.660 I get to spend, you know, five days sitting next to Gwyneth Paltrow in a courtroom while

01:31:06.500 she looks like she'd rather be eating ground glass.

01:31:09.120 And that's going to be my claim to fame.

01:31:11.340 No, not ground glass.

01:31:12.540 You're so right.

01:31:14.200 There was a judge here in L.A. who once said he was head of the mediation practice in L.A.

01:31:18.780 Spirit Court. 1.00

01:31:19.500 And he once said that a trial is basically to determine who the asshole is. 1.00

01:31:25.840 That's so many choices. 1.00

01:31:27.140 That's right with your theory.

01:31:28.860 So Gwyneth, we've talked a little bit about her fashion.

01:31:31.660 She made news at the top of the trial, which was my favorite news of the week, I have to

01:31:35.060 say, where they she wore these glasses, which I love when the Internet does this. 1.00

01:31:41.300 Somebody remembers what this look reminds them of.

01:31:44.260 And they're spot on.

01:31:45.500 What it reminded them of was serial killer and cannibal Jeffrey Dahmer.

01:31:52.360 It's spot on.

01:31:55.840 The two of them.

01:31:56.980 We got to do the side by side where you can see them together.

01:31:59.840 It was perfection.

01:32:01.660 I absolutely loved it.

01:32:02.560 She did.

01:32:03.540 I think that was a mistake with those glasses and that look.

01:32:06.560 But Jonna, one of the reasons why people don't like Gwyneth and why it wasn't cut glass.

01:32:11.900 She was thinking about eating, making those faces.

01:32:13.700 It was her normal diet of bone broth is because of sound bites like this, which hit the Internet

01:32:17.800 just last week.

01:32:18.520 Her sharing her wellness routine on the art of being well podcast.

01:32:23.560 Listen to this.

01:32:24.300 What's your wellness routine looks like now?

01:32:28.300 I eat dinner early in the evening.

01:32:29.820 I do a nice intermittent fast.

01:32:31.820 I usually eat something about 12 and in the morning I'll have some things that won't spike

01:32:38.720 my blood sugar.

01:32:39.880 Right.

01:32:39.980 So I have coffee, but I really like soup for lunch.

01:32:43.600 I have bone broth for lunch a lot of the days.

01:32:46.520 Try to do one hour of movement.

01:32:48.360 So I'll either take a walk or I'll do Pilates or I'll do my Tracy Anderson.

01:32:54.340 And then I get in the sauna.

01:32:55.580 I dry brush and I get in the sauna.

01:32:57.200 So I do my infrared sauna for 30 minutes.

01:32:59.440 And then for dinner, I try to eat, you know, according to paleo.

01:33:02.420 So lots of vegetables.

01:33:04.820 It's really important for me to support my detox.

01:33:10.940 It's like looking in the mirror.

01:33:12.180 No, that's your, isn't that your routine?

01:33:14.400 Yeah.

01:33:14.920 You know, I do that.

01:33:16.000 I do that every day when I'm not a nurse in a hangover.

01:33:19.160 She's just so, she's just so, think about it. 0.99

01:33:22.380 She created a candle that she said was vagina scented. 1.00

01:33:25.840 Okay. 0.96

01:33:26.120 So why should we really want to emulate her daily routine?

01:33:32.320 It's like, oh, you know, I get up every morning.

01:33:34.320 I do a little yoga and then I eat air.

01:33:35.800 Then I do some more yoga.

01:33:36.680 Then I dry brush and I get a massage.

01:33:38.400 How nice of you.

01:33:39.440 Some of us have to work.

01:33:41.180 That's all I got to say about it. 1.00

01:33:42.440 Did I smell my vagina? 1.00

01:33:44.120 No. 1.00

01:33:44.640 Mark, Mark, I'm going to do something else. 0.99

01:33:50.320 How did you get a sandwich beat between you two and talk about vagina scented? 1.00

01:33:55.640 We'll send you the candle. 0.99

01:33:57.520 I can send you the candle.

01:33:59.540 Okay.

01:34:00.340 So she did have a moment of being out of touch or so it would seem.

01:34:04.360 So it sounded to many when she talked about why she's suing for $1.

01:34:08.840 Why is she suing at all? 1.00

01:34:09.800 Really?

01:34:09.960 Why does she have a counterclaim? 1.00

01:34:11.040 And here she was talking about that.

01:34:14.720 The true that you feel it's unfair that Mr.

01:34:18.240 Sanderson has brought this case against you.

01:34:20.940 I do.

01:34:22.300 And he has deterred you from enjoying the rest of what was a very expensive vacation.

01:34:29.200 Well, I lost half a day of skiing.

01:34:33.680 Right.

01:34:34.720 Okay.

01:34:35.160 And I think that's, that's what your counsel has argued as well, that you lost, you had

01:34:43.820 a full day pass, but you can only ski a half a day.

01:34:47.360 Yes.

01:34:47.700 I went back down after lunch.

01:34:50.120 Okay.

01:34:50.360 Right.

01:34:50.680 And that's when you had lunch and you got a massage.

01:34:53.500 Yes.

01:34:54.140 Okay.

01:34:55.500 Oh, a single tear.

01:34:58.480 Ooh.

01:34:59.640 Lost half a day of skiing and had to get a massage.

01:35:01.920 I mean, she's trying to justify her $1 claim. 1.00

01:35:05.280 I get it, but this is her problem.

01:35:07.560 That, that kind of sums up her problem with this jury.

01:35:10.180 Um, all right, before we go quickly predictions on how it's going to come out, Mark.

01:35:14.940 I just think it's got to be a pox on both their houses, which would be maybe award each

01:35:20.820 side, one buck. 0.90

01:35:22.340 He wins, but not much money.

01:35:24.240 Jonna, what do you think?

01:35:25.440 I think it's going to be a wash.

01:35:27.460 Yeah.

01:35:27.880 I think they're not going to, they're going to not believe either one of them and it's going

01:35:30.620 to be a wash.

01:35:31.920 Hmm.

01:35:32.900 I think he wins, but they give him almost nothing.

01:35:35.760 I don't know.

01:35:36.680 I like, I'm not sure he's going to win.

01:35:37.820 He's been such a hot mess, but she's also not likable. 0.66

01:35:40.520 So she could definitely walk away with a victory.

01:35:42.260 It's not one of those cases where I feel like, oh, 100% is going to go this way or the other.

01:35:45.920 But I just feel like there's zero chance he's getting $300,000.

01:35:48.520 Anyway, love it.

01:35:49.860 We'll update you on it.

01:35:51.180 And, uh, thanks for all the laughs guys.

01:35:53.220 See ya.

01:35:54.320 Thank you.

01:35:55.860 Thanks to you, the audience as well.

01:35:57.440 We're going to be back tomorrow.

01:35:58.360 Oh, with some dying to do this case.

01:36:00.860 Family Annihilators, Murdoch, the Chris Watts case, and this other case that I've been obsessed

01:36:07.180 with.

01:36:07.340 I'm going to walk you through all of it.

01:36:08.300 That's tomorrow.

01:36:10.860 Thanks for listening to the Megyn Kelly show. 0.94

01:36:12.760 No BS, no agenda, and no fear.

01:36:15.520 Thank you.

01:36:25.220 Bye.

01:36:25.800 Bye.
