00:01:18.040 Okay, so the biggest news of the day is this D.C. Circuit Court of Appeals ruling,

00:01:23.200 which is not good for Trump.

00:01:25.160 It was a unanimous decision by all three judges.

00:01:28.380 Two had been appointed by Biden.

00:01:31.540 One had been appointed by H.W. Bush.

00:01:34.560 And they found unanimously that a sitting president does not have immunity

00:01:39.780 to charges, criminal charges,

00:01:43.740 based on what he does while he's in office once he's left the office.

00:01:48.080 So somebody like Trump, who's post his term,

00:01:51.260 can indeed be charged if he broke the law while the sitting president.

00:01:56.940 And now he's probably going to ask the full circuit,

00:02:00.760 full D.C. Circuit Court of Appeals,

00:02:02.240 to reconsider that three judge panel's ruling.

00:02:05.240 That's par for the course when you lose.

00:02:07.480 In nine cases out of ten, they will reject you.

00:02:10.380 And I have a feeling they're going to reject this here.

00:02:13.320 Like, the judges don't want any part of this.

00:02:16.520 The fewer that have to weigh in on it, the better, I'm sure.

00:02:20.420 And then he's going to appeal to the U.S. Supreme Court.

00:02:22.820 And they may not take it either.

00:02:24.080 We've had ongoing debates on the show about

00:02:25.660 just how likely they will be to take it.

00:02:27.800 We don't know.

00:02:28.900 So overall, net-net, the odds are very bad

00:02:32.080 for Trump winning this case, Matt.

00:02:33.900 But delay, delay works in his favor

00:02:37.200 because this thing was supposed to get started at the trial court on March 6th.

00:02:41.820 Yeah, I mean, in every one of these cases,

00:02:44.580 it always comes down to, or usually comes down to,

00:02:48.260 there's a bad moment of lawyering for Trump,

00:02:51.040 and then there's a pretty bad moment of clienting.

00:02:53.460 And both of those things happen under cross-examination

00:02:56.600 when they were sort of given hypothetical scenarios

00:02:58.620 about the horrible things a president might do.

00:03:01.940 They basically said, yeah, that's what we should do.

00:03:05.160 And then Trump goes out and through social

00:03:06.540 and starts talking about absolute immunity in all caps.

00:03:09.120 So this is not a surprise at all.

00:03:12.860 I'm very curious to see whether the Supreme Court takes it

00:03:15.540 because they're going to have some Trump on their hands

00:03:17.120 in the year 2024.

00:03:19.240 And I imagine that they want to have

00:03:21.100 the least amount of Trump possible

00:03:23.020 or at least keep their powder dry politically.

00:03:26.460 And we all know that John Roberts

00:03:27.560 is a very politically attuned chief justice.

00:03:31.560 It's going to be hard to imagine any judge

00:03:34.380 looking at this one particular case about immunity

00:03:36.740 and say, you know, I think the Trump and his legal team

00:03:40.000 has a point here.

00:03:41.560 But then, as you say, and rightly points out,

00:03:44.540 I don't know how many of these trials

00:03:45.740 are going to get going before the election.

00:03:48.600 And if it's just the one in New York,

00:03:50.520 that's not going to make Trump's candidacy any worse.

00:03:54.840 It'll probably make it better.

00:03:57.160 But this could go pretty quickly at this point, Liz.

00:04:00.200 I mean, Trump's going to appeal the full D.C. circuit

00:04:03.880 en banc for an en banc hearing, as they call it,

00:04:38.140 The other thing that I think will be interesting is

00:04:40.080 if the Supreme Court does decide to take this case,

00:04:43.620 say they do, and say they decide to rule against Trump,

00:04:47.740 okay, we might be in a situation where somehow

00:04:50.280 the Supreme Court has basically made an enemy of Trump,

00:04:53.880 which is totally fine by me.

00:04:55.500 But the thing I'm always curious about is,

00:04:57.260 okay, well, all of the liberals who have been

00:04:59.040 beliaking this entire time about how,

00:05:00.920 oh, the Supreme Court is totally in bed with Trump,

00:05:04.080 completely doing his bidding.

00:05:05.160 They're so Republican.

00:05:06.860 Will any of them actually alter their political beliefs,

00:05:10.480 their belief that the Supreme Court's integrity

00:05:13.000 is so compromised?

00:05:14.120 Will any of them actually sort of look at this

00:05:16.620 and see it for what it is,

00:05:17.700 which is the Supreme Court's attempt to legitimately

00:05:20.380 be safeguards of our justice system?

00:05:23.120 I don't think they will.

00:05:24.200 And so I really see our politics getting even more toxic

00:05:26.380 as a result of this,

00:05:27.640 because that would be the honorable thing to do, right?

00:05:29.660 That would be the sort of fair and balanced thing to do.

00:05:31.680 And I don't really think that that's what they're going to do.

00:05:33.880 And keep in mind also that the Supreme Court

00:05:35.600 is likely to be taking up at some point

00:05:37.880 one of these, I think,

00:05:39.520 kind of legally obscure challenges

00:05:41.460 to Trump's ballot access on primary elections

00:05:44.700 based on a unique reading of the 14th Amendment.

00:05:48.780 And I would presume that if that gets to the Supreme Court level,

00:05:52.640 that they're going to rule in Trump's favor.

00:05:54.720 So it's going to be a lot of people being inconsistent,

00:05:57.360 let's say, about their treatment politically of the Supreme Court.

00:06:00.380 And it's worth pointing out,

00:06:01.420 I mean, the 14th Amendment argument is like a,

00:06:04.080 you know, in my opinion, a very legally weak one.

00:06:06.760 I think it is important for Trump to have ballot access here,

00:06:08.960 despite not being any sort of fan of his.

00:06:10.620 But it is really astonishing how,

00:06:12.620 even if the Supreme Court does decide to rule in that manner,

00:06:15.000 I don't know what type of difference

00:06:16.860 this will actually make in our politics overall.

00:06:20.440 No one's going to,

00:06:21.480 everyone will just use it to confirm their priors.

00:06:24.080 But yeah, he'll win the,

00:06:26.400 should he be banned from state ballots

00:06:28.800 because he caused an insurrection

00:06:30.880 and therefore is barred under the 14th Amendment.

00:06:33.600 He's going to win that with SCOTUS.

00:06:35.680 And I don't think they're going to take this case,

00:06:37.980 but if they do,

00:06:38.620 I think he's going to lose.

00:06:40.520 Delay does work in his favor.

00:06:42.000 He wants this case to be pushed to after the November election,
