01:16:46.800 he taped that call, but he was never called as a witness, and when investigators went looking for
01:16:53.260 that tape years later, it did not materialize. ABC reported this summer that Lieutenant Aponte
01:17:00.820 walked back his story entirely, saying he doesn't really know what he heard. Modesto police and the
01:17:07.800 prosecution dispute all of this account. They say there are no reports showing anyone from the
01:17:13.880 department was ever in contact with Lieutenant Aponte. In May of 2003, more than a year before
01:17:21.240 the Scott Peterson trial, the videotaped police interviews with burglars Stephen and Donald
01:17:26.520 are marked for destruction. Prosecutors say the burglary was solved. Both men had confessed and
01:17:33.420 the evidence was destroyed as part of routine procedure. Scott Peterson's defense says that in
01:17:39.500 a capital case, evidence potentially connected to an alternate theory should have been preserved.
01:17:46.660 Lacey Peterson was a member of the Neighborhood Watch Group. People who knew her said that if
01:17:52.500 there was somebody untoward in that neighborhood, she would have let them have it. But for any of
01:17:57.620 that to matter, she has to have walked up on the burglary while it was in progress, and no eyewitness
01:18:04.820 can put her there. On Christmas Day, the morning after Lacey Peterson vanishes,
01:18:11.380 a van is found burning in an alleyway a mile and a half from her front door. A Modesto fire
01:18:18.740 investigator works the scene, rules it arson, and hands the case to the Modesto Police Department.
01:18:25.480 In the back is a mattress. A Modesto police evidence technician tests material from that
01:18:32.000 mattress and finds faint evidence of possible blood. His report carries a heading, missing
01:18:39.080 person investigation. Under that, he writes Lacey Peterson's case file number. The potential blood
01:18:46.940 sample goes to the State Department of Justice lab, which finds no blood on the mattress. The
01:18:52.940 fire investigation is closed as a separate case entirely. Scott Peterson's defense says it did not
01:18:59.680 learned the van existed until after the trial. No court has found that this van had anything to do
01:19:06.940 with Lacey Peterson, and no one has established that it was the same van multiple witnesses
01:19:12.140 reported seeing near the Peterson house. As for the Medina burglary, police reject the idea that
01:19:19.440 it had anything to do with Lacey's disappearance, warning, don't put too much stock in vague witness
01:19:25.720 accounts, like the one from the lady rushing home to make her husband a sandwich. Here's
01:19:30.780 Detective John Buehler to me in 2021. Well, it's, you know, it's pretty rare that a guy doing a
01:19:37.440 property crime is going to turn into a, you know, an abductor of a pregnant girl with its walking
01:19:42.120 a dog. I mean, it's if everybody, you know, if Diane Jackson sees a van at 1140 in the morning
01:19:47.880 with three guys in it, but she can't even tell us if it's white, tan or black, it kind of calls
01:19:53.200 into question her, you know, viability as a witness. Bueller says both burglars asked to
01:19:59.680 take a polygraph examination because they knew they were going to jail and didn't want other
01:20:04.840 inmates thinking they had killed a pregnant woman and her baby. Bueller also points to other pregnant
01:20:11.540 women in Lacey's neighborhood. Three of them, in fact. He interviewed two himself, and one of them 0.70
01:20:18.860 looked a lot like Lacey Peterson. She was due in January and she walked a mid-sized dog. 0.98
01:20:26.280 She too was reportedly placed under hypnosis by the police department in an effort to help her
01:20:31.900 remember her exact activities on the days in question. None of these people that came forward
01:20:36.560 and claimed they saw Lacey there actually knew her. They didn't, they never had a barbecue with
01:20:41.780 her. They'd never been to her house. So it's easy to misplace or misidentify somebody, especially
01:20:47.540 with the coverage going on. Bueller doesn't believe Lacey Peterson was out walking that
01:20:52.460 morning at all. On a trip to Disneyland in November, she had spent part of the day in a
01:20:58.280 wheelchair. Her yoga instructor and her doctor had both told her not to walk at the end of the
01:21:04.300 pregnancy. Her own mother did not believe she had gone walking. And to think this girl that
01:21:09.540 couldn't even move a mop bucket, according to Scott, would go down an uneven grade down to a
01:21:16.840 park with a dog tugging at her when she's unstable on her feet and exhausted from everybody's account
01:21:21.580 makes it sound to me like she didn't do that walk. As for that mailman, police interviewed
01:21:27.220 Russell Graybill three days after Lacey disappeared. He cannot remember anything unusual about that
01:21:33.880 morning when he sits with the police, even as he specifically remembers the Peterson's gate being
01:21:39.220 open and Mackenzie the dog not barking. Diane Jackson gives her statement within days and then
01:21:46.160 a second one on January 16th, explaining exactly why she was so sure of the time she saw that van,
01:21:53.660 1140, the morning of Christmas Eve. She can't remember the color. The next day, January 17th,
01:22:00.740 they hypnotize her. Police hypnosis is meant to draw out details a witness cannot otherwise recall.
01:22:07.980 With Diane, investigators want more detail about the men and the van. The defense will later want
01:22:15.060 the same. Diane could make a great defense witness. There's just one problem. In California, 1.00
01:22:21.260 hypnosis doesn't just probe a witness's memory. It can effectively end her usefulness as a witness.
01:22:28.460 The rule goes back to a 1982 California Supreme Court ruling, People v. Shirley. Once a witness 0.92
01:22:34.920 is hypnotized, it can become too difficult to assess the reliability of her memories.
01:22:41.180 In addition, police here used an unqualified hypnotist.

01:27:05.880 Some nights he hits Scott Peterson, but most he defends him. He does not represent Scott Peterson,
01:27:11.740 not yet. On April 18th, police arrest Scott Peterson. That evening, the state's attorney
01:27:18.040 General announces that the bodies that washed ashore in San Francisco Bay are Lacey Peterson
01:27:23.360 and her son, Connor. That night, Garagos tells Larry King that their bodies washing ashore
01:27:29.360 within two miles of Scott's fishing trip alibi is, quote, devastating. Even still, Garagos
01:27:36.020 criticizes how the case against Scott Peterson is being framed. And at no point does he say
01:27:42.120 Peterson is guilty. 23 years after defending him in court, Mark Garrago spoke with us about his
01:27:49.460 former client. Mark is now the co-host of the show In the Well on our MK True Crime podcast channel.
01:27:56.020 Does he think Scott Peterson is a killer? You know whether somebody is good for it. He's not
01:28:00.800 good for it. I said it then. I've said it consistently with much blowback since in the
01:28:07.280 20-some-odd years since, the guy I met does not have the capability, the wherewithal, the ability
01:28:14.640 to do it. When Garagos was making those rounds on cable news, he had not yet met Scott Peterson.
01:28:20.940 He later says of those appearances, quote, maybe I was one of the media pundits who jumped on a
01:28:26.000 bunch of misleading information and convicted the guy. That's not how Lee and Jackie Peterson saw it.
01:28:32.580 In San Diego, Scott's parents are watching Garagos on TV almost every night.
01:28:37.700 They had retained lawyer Kirk McAllister to represent their son after Lacey went missing.
01:28:43.060 Once Scott is arrested, McAllister tells them that a case of this size is going to get expensive very fast.

01:29:28.260 We began our conversation with Mark Garagos where his relationship with the Peterson family started.
01:29:36.540 On television, talking about Scott, weeks before Mark had met the man he was arguing about.
01:29:42.700 So, before you actually got hired as counsel for Scott Peterson, what did you think of the case, Mark?
01:29:48.620 You know, famously, in fact, because of my smart aleck tendency, I had said on a show,
01:29:56.760 I think it was Larry King who was back on CNN when CNN actually had more than four viewers.
01:30:03.860 I said something to the effect of there are guys in state prison on a lot less evidence than what was facing Scott.
01:30:14.760 And what I meant by that was the sheer coincidence, so to speak, of Blasey and Connor washing up at exactly the location.
01:30:23.500 And it wasn't really exactly, but in the basically the bay for all intents and purposes was enough to get him convicted.
01:30:33.420 And sure enough, at the end of the day, fast forward, I don't want to step over everything else.
01:30:39.220 A couple of the jurors said they never would have convicted but for that fact.
01:30:44.020 So you, before the Petersons called you, were you looking at this saying he did it?

01:31:14.160 and then back then it was people magazine and if you got into that kind of axis um you were done

01:31:26.920 machine would soon come for garagos by friday may 2nd 2003 garagos had now signed on as scott
01:31:35.280 peterson's lawyer and walks out of the stanislaus county courthouse to face the cameras reporters
01:31:40.800 immediately ask about what looks like a change of heart garagos waves it off saying i think i
01:31:47.920 succumbed to the media buzz mark's telling starts with scott's mother jackie peterson scott's mom
01:31:55.880 uh reached out to me and said she wanted to see me and i think came in initially at least just
01:32:02.660 to try to correct the record so to speak and and make sure that i understood that she believed
01:32:08.940 fervently that he was innocent i met with her and we had a long talk and i was so taken with her
01:32:13.760 She asked me to go meet with him. I met with him. I was convinced of his innocence after meeting him in Modesto. I went to the Modesto Stanislaus County Jail and that I took the case.
01:32:28.120 I will tell you, virtually everybody, virtually everybody, including lawyers in my office, lawyers who ended up working on the case, told me, do not take this.
01:32:38.700 I was coming off of basically a seven-year streak of not losing a case.
01:32:44.020 I had won back-to-back Susan McDougall on both coasts, not guilty against kind of all odds.
01:32:50.120 I had had an incredible streak, and everybody said, look, if you win the case, you're a pariah, a la Johnny Cochran.
01:33:00.020 You know, Johnny, people forget.
01:33:01.840 After OJ, Johnny didn't want to do another criminal case again.
01:33:07.060 He was kind of verboten.
01:33:08.940 Johnny used to sit at jury selection.
01:33:11.040 He would rent himself out to mass tort lawyers and to PI lawyers because jurors would raise their hand and say, I can't be fair because Johnny Cochran is the lawyer.
01:33:21.620 He was that he was that much hated.
01:33:24.240 Here's what Pat Harris, a colleague of Mark's, tells him.

01:33:41.040 One voice, however, calls Mark with a very different perspective.
01:33:44.740 My father, who was my mentor, partner and hero, he said to me, look, if you're not going to take this case because of the absolute blowback you're going to get, and he knew there would be blowback, then you should be selling oranges on the side of the freeway.

01:34:08.400 And that scene outside of the Stanislaus County Sheriff's Station, when they had arrested Scott, brought him in, and people were surrounding the sheriff's station with placards asking that he'd be hung, man or monster, and all that stuff, that kind of roiled me to the point where I said, okay, I'm going to jump in.
01:34:28.360 Garagos takes the case with Scott's reputation already in tatters.
01:34:32.640 Scott has just wrapped an ill-advised interview spree,
01:34:35.920 which includes a train wreck sit-down with Diane Sawyer.

01:35:16.400 what convinced Garagos that Scott was actually innocent?
01:35:20.640 I'm kind of the Malcolm Gladwell 10,000 reps, 10,000 hours.
01:35:24.780 I talk about this with Carole all the time, too.
01:35:28.000 You get a sense, you know, you have, I mean, you're not infallible when it comes to that,
01:35:33.840 but you know, nothing in his background shows that he could have done it.
01:35:38.460 You have to understand, it's the only time that I can think of in any case,
01:35:42.620 and I've tried hundreds of cases, I stopped counting to 300,
01:35:45.400 that I've ever called a nun onto the stand as a character witness.
01:35:50.620 And even she talked about, she had grown up or watched him grow up
01:35:55.480 and said he had no violence in his background.
01:35:59.160 He had no indication whatsoever that he could ever hurt anybody.
01:36:03.160 In fact, it was quite the contrary.
01:36:05.120 He was the most docile kind of laid-back kid.
01:36:10.400 Garagos maintains it's not the evidence against Scott
01:36:12.900 that has convinced most people he's guilty, but something else.
01:36:17.140 I do know why this thing has fascination, in my humble opinion.

01:37:33.860 arm around the masseuse therapist from fresno california who fits the archetype of many a wife
01:37:41.940 and you can't get past that for a certain demographic or a certain constituency
01:37:47.620 There is also the matter of Scott Peterson standing in a Modesto park on New Year's Eve at a vigil for his missing wife, three blocks from his own home, telling his lover, Amber Fry, that he is in Paris celebrating New Year's with a huge French crowd.

01:38:48.960 I watched him while waiting for bar results.
01:38:51.080 He had three murder cases pending, and I watched all three trials while waiting for them back to back to back.
01:38:56.740 I've handled, I can't tell you how many murder cases.
01:38:59.980 I don't know that it's a skill set that anybody wants to brag about,
01:39:05.400 but i will tell you i know who is capable of this i know who's got it in them and i can also tell
01:39:13.640 you just from working with somebody what triggered it um i had at one point in fact it's how i got
01:39:21.880 susan mcdougall's case i had at one point four women on what we called murderers row in the old 0.99
01:39:28.280 Sybil Brand Jail. Sybil Brand Jail was this notorious women's prison, jail, not a prison, 1.00
01:39:35.180 in LA. And those I've never had before since four women charged with murder. But I will tell you, 0.98
01:39:43.800 all four of them I knew had committed the act. All four had killed another human being in various
01:39:51.260 ways. But all four were ultimately not convicted of murder because there was a backstory to it.
01:39:59.720 And I knew that. And I did not have to reinvent the facts, so to speak. Scott, I never had that.
01:40:08.140 Despite Mark's gut feelings on Peterson, the jury that decided the case did look at the evidence.
01:40:14.480 Well, the jurors, two of the jurors who sat on the case, gave an interview to Netflix for their
01:40:20.780 most recent special and they were pointing to not the affair both of those guys said the affair
01:40:28.820 did not move us we understood that men cheat um it was they said the tapes amber's tapes of scott
01:40:37.480 and what he was saying to her while people were searching for lacy obviously he's trying to keep
01:40:45.540 this woman on the line. And they, I think, couldn't get past how cold he was about the fact
01:40:53.860 that his wife was, quote, missing during those tapes. Jurors Mike Belmessieri and Mark Baratlas
01:41:01.200 described the impact of those recorded phone calls to Netflix in 2024.
01:41:06.180 A lot of people believe that the affair was a big deal. I didn't see it as a big deal,
01:41:12.640 And I don't think anybody on a jury did either.
01:41:14.940 What we did see as a big deal is what he said and what he did.
01:41:19.860 It was damning.

01:41:22.960 And not only the phone calls, but the lies.

01:41:28.180 Garagos says his co-counsel, Pat Harris, understood the danger of those tapes immediately.
01:41:33.300 And in trying to explain Scott's behavior, they kept coming back to another disappearance
01:41:38.060 that had consumed Modesto, California only a few years earlier

01:42:12.860 When Pat first heard those tapes, because he was deep into the case and the prep of it,

01:42:23.040 And he says, even though I know why he did it, there's no way we can capture that or present that to the jury.
01:42:31.060 And I explained to him what I was going to try to do, and we were not, I think, entirely successful.
01:42:39.300 Two or three years before Lacey went missing, in Modesto, there was a congressman.
01:42:46.480 His name was Gary Condit.
01:42:48.400 Gary Condit was a client of mine, and so I was very familiar with that case.
01:42:54.720 Gary was admitted to having an affair with Chandra Levy.
01:42:59.300 Chandra Levy was from the Modesto area.
01:43:02.540 Chandra Levy went missing and Gary conned it as soon as they discovered the affair
01:43:08.140 and Gary had disclosed it to the investigators.

01:43:13.100 The investigators didn't care about any other lead.
01:43:16.820 They were focused like a laser on Gary.
01:43:19.500 And because the prosecutors were so fixated on Gary, they lost all kinds of opportunities.

01:51:22.280 abandoned that. They agreed and he argued in closing, it doesn't matter because I think we
01:51:28.220 had definitively proved it. The cross-examination of the forensic expert showed that she had logged
01:51:35.560 in to her computer on the morning of the 24th. Their whole search warrant affidavit that said
01:51:44.180 Martha Stewart had not been on the 24th, but on the 23rd, when Scott told her that was debunked,

01:53:14.500 of testimony, the state calls Detective Al Brocchini. He will spend much of the next week
01:53:19.520 on the stand. While he is testifying, the jury loses one of its members. A courthouse camera
01:53:25.660 catches juror number five, Justin Falconer, speaking with Lacey's brother near the security
01:53:31.360 checkpoint. Judge DeLucchi looks into it and decides the conversation was harmless. But after
01:53:37.380 the incident draws media attention, Falconer admits that he discussed the coverage with his
01:53:42.460 girlfriend, despite the judge's orders to stay away from the news and not discuss the case.
01:53:47.860 Two days later, DeLuki removes him from the jury. Falconer walks out of the courthouse and directly
01:53:53.360 into the arms of reporters. They ask him the question everyone wants answered. After what
01:53:58.780 he has heard so far, does he think Scott Peterson is guilty? Well, the prosecution hasn't given me
01:54:03.660 any reason to believe that he is. All the prosecution witnesses have pretty much been
01:54:07.200 just as good a witness for the defense as they were for the prosecution, if not in some cases
01:54:11.720 better for the defense. And I haven't heard any testimony whatsoever that would lead me to believe
01:54:16.800 that he was guilty. Asked how he would vote if he had to decide the case that day, Falconer says
01:54:22.060 not guilty. So far, Garagos isn't doing too badly. Garagos, meanwhile, has been fighting over
01:54:28.860 discovery almost from the day he took over the Peterson case, arguing that prosecutors are
01:54:34.140 consistently turning over evidence late or only after repeated requests. And he is convincing
01:54:40.540 the judge. I will tell you that I think in real time, not now, but in real time, I knew the facts
01:54:48.360 better than anybody. I knew the discovery better than anybody. It's one of the reasons during that
01:54:53.660 trial, we had not one, not two, three separate recesses. And the late, great Al DeLuki, who was
01:55:02.060 the judge, had excoriated the prosecution for their discovery compliance, for not turning over
01:55:10.160 discovery, for not following up on exculpatory leads. And I was bellyaching about that every
01:55:17.940 single day, making motions for mistrials, the whole bit. Journalist Catherine Cryer covered 1.00
01:55:24.200 the trial from inside the courtroom and writes that Judge DeLucchi took to chastising prosecutors
01:55:29.560 in open court about discovery issues. But while Garagos may be scoring points,
01:55:35.680 there are facts that will prove insurmountable for him let me ask you the my the things that
01:55:42.980 convinced me he did it um the tapes with amber are bad for sure correct i accept your i accept
01:55:50.920 that there is an explanation for them there is a version of him doing that stuff with amber that
01:55:55.340 doesn't have scott as a murderer however the fact that he bought that boat after the affair began

01:56:37.640 they found what looked like the molds for four concrete anchors. His boat had some concrete
01:56:43.940 remnants on the inside of it, and it matched the little picture that the detectives found on that
01:56:50.160 boat perfectly and yet those anchors were never found and to me that is absolutely devastating

01:57:03.780 first point because the that was the one where you you he bought this boat after the affair began
01:57:09.180 and didn't tell anybody didn't know about right um during the trial they put on the lead detective
01:57:14.940 Al Brocchini, guess what? And mind you, I had spent one week doing mitochondrial in California
01:57:22.120 at the time. This shows you how long ago this was. Mitochondrial DNA was not admissible in
01:57:27.440 California. In order to have the prosecution be able to introduce mitochondrial DNA, which is
01:57:34.540 DNA that is linked to the maternal lineage. And they had a hair and they wanted to show that the
01:57:41.140 hair was in the boat. So, aha, Lacey was in the boat. Lacey didn't know about the boat. Your 1.00
01:57:46.240 kind of aha moment. Well, guess what happened during the cross-examination of Al Brocchini?
01:57:51.580 I had, they didn't realize Al Brocchini had whited out a paragraph in his report. I had him
01:57:59.660 produce the original report. What he had whited out was Al Brocchini himself had interviewed
01:58:06.700 a witness at the warehouse who saw lacy in the boat actually saw her in the boat he had whited
01:58:13.920 it out so i spent a week contesting mitochondrial dna so that we could get it admitted when all
01:58:22.260 along modesto pd knew that she was in the boat and they had a witness who was at the warehouse
01:58:27.660 stop there because what mark just said leaves out an important part of what happened
01:58:33.180 The witness is a woman named Peggy O'Donnell, who runs a business a few doors down from Scott
01:58:38.140 in the same warehouse complex. Peggy tells police that Lacey had come by the warehouse complex
01:58:44.260 and asked to use her bathroom a few days before she disappeared. This happens on either December
01:58:50.240 20th or December 23rd. Peggy isn't sure which date. If true, that places Lacey at the warehouse
01:58:57.600 complex, not in Scott's boat. But Garagos is right about one important part of this.
01:59:04.960 Burkini had removed witness information about Peggy O'Donnell from his report.
01:59:10.780 One sentence has been removed. It is about O'Donnell's claim that Lacey visited the
01:59:16.400 warehouse complex on either December 20th or December 23rd and asked to use O'Donnell's
01:59:22.980 bathroom. On cross-examination, Garagos produces a page of Brokini's notes, which include a line
01:59:30.060 that reads, quote, Lacey used restroom on 12-23, Peggy, end quote. Garagos then asks the detective,
01:59:39.660 can you tell me how that particular piece of information got excised out of your police
01:59:44.340 report? I excised it, Brokini answers. You did it? Yes, I did. The reaction in the courtroom
01:59:52.160 is immediate. Garagos asks the judge whether they might stop for the weekend and let that exchange
01:59:58.200 sit with the jury for three days. But Burkini has an explanation, and after the weekend,
02:00:04.900 the jury hears it. Prosecutors ask him about the missing sentence, and Burkini says the information
02:00:10.700 had not disappeared from the case, that another detective named Dennis Holmes included Peggy's
02:00:17.260 account in his report from that day, and that unlike Brickini, Holmes had interviewed Peggy
02:00:23.300 O'Donnell directly. In 2024, Brickini explained his reasoning to Netflix and conceded the optics
02:00:30.600 in court. What happened was on this one day, after I dictated, turn it in, now we all sit down
02:00:36.800 together and I tell all the detectives what I heard. And Detective Dennis Holmes, he said,
02:00:42.840 whoa, I interviewed Peggy. So he could testify to what Peggy said. Mine was through the grapevine.
02:00:51.820 And so I deleted that sentence because it was in his report. Could look wrong to the jury. It could
02:00:58.540 look wrong to the, you know, roaches. Burkini's explanation does not end the argument. Garagos
02:01:04.300 still sees the missing sentence as part of a larger pattern. Evidence, he says, was mishandled,
02:01:09.500 minimized or disclosed too late but when i pressed him on what that evidence actually proved
02:01:15.700 the argument quickly moved back to the boat he whited it out because another detective
02:01:21.680 put it in his report and had interviewed this person that's how we found it and he whited it
02:01:27.020 out so it wouldn't be wouldn't get to the defense but it was in the public record because another
02:01:31.880 cop put it in his report that's how we found that's how we found it he had yes so i mean
02:01:36.420 How is it nefarious for Brocchini to have taken it out when he understood his report was hearsay, but he had the actual cop who had interviewed the woman because he was doing it in an affidavit.

02:19:17.280 The forensic pathologist who examined Lacey's body did testify that it had been in the water
02:19:23.460 for, quote, months. His name is Dr. Brian Peterson, no relation to the defendant. Dr. Peterson also
02:19:30.040 testifies that there were no tool marks on Lacey's joints. Dr. Galloway, the forensic anthropologist,
02:19:38.160 examined Lacey's body as well. She offers a more specific timeline in court, three to six months
02:19:44.700 in the water. Galloway found barnacles on one of Lacey's exposed bones. Galloway testifies that 1.00
02:19:52.980 decomposition alone could explain how Lacey's limbs separated from her body. She found no
02:19:59.360 evidence to the contrary. According to Catherine Cryer, the medical examiner who performed Lacey's
02:20:05.420 sealed autopsy suggests the limbs were either cut with surgical precision or they were weighted down
02:20:12.780 and pulled apart by the currents of the bay. Prosecutor Dave Harris asks pathologist Dr.
02:20:19.560 Peterson about the weights directly on the stand. Dr. Peterson says either natural decomposition
02:20:25.900 or weights on the limbs could explain how Lacey's body came apart. Her remains were consistent
02:20:32.480 with both explanations. Finally, Dr. Peterson confirms that Lacey's body showed no evidence
02:20:39.320 of a vaginal birth. There was a rip in her abdominal wall big enough that Connor's body

02:21:51.420 and this idea that he was a bad, bad man that needed to be punished.

02:23:32.020 14-foot aluminum fishing boat, which was introduced as evidence, has been stored down there for the
02:23:38.160 length of the trial. Judge Alfred DeLucchi comes to in a suit instead of his robes. Scott Peterson
02:23:44.820 walks down in his suit, unshackled. Juror number one asks the judge for permission to come aboard
02:23:51.680 the boat. DeLuki says yes, but reminds the juror the boat is on a trailer and not on a cruise in
02:23:58.400 San Francisco Bay. The foreman climbs in behind juror number one, and the two of them start
02:24:03.900 shifting their weight from side to side, seeing how much it would take to tip it. Scott's attorney
02:24:09.080 Mark Garagos, objects that they're running an out-of-court experiment, and Judge DeLuki puts
02:24:14.800 a stop to it. Garagos moves for a mistrial, which the judge denies. Juror number one is Greg Baratlas,
02:24:23.060 an engineer for the power company who coaches youth football on weekends. Five months of
02:24:28.520 testimony have told him Scott Peterson is a man who puts coasters under everything. He is meticulous
02:24:35.080 with his equipment. What Greg notices sitting in the boat is a pair of pliers going rusty
02:24:41.460 and standing water in the boat. Greg thinks this does not fit. It's as if the boat was never going
02:24:49.440 to be a long-term hobby, but only purchased for one purpose. Four days later, 12 jurors convict
02:24:57.640 Scott Peterson of two murders. But they are not the same 12 people who went down to that underground
02:25:03.720 garage. Two of the jurors standing around that boat leave the case, including the foreman who

02:41:37.900 beliefs were so strong that she could never vote for death, regardless of the evidence or the
02:41:43.060 judge's instructions. To that, she answered no. In other words, she was telling the court that
02:41:48.320 she opposed the death penalty personally, but that she could still follow the law and impose it in a
02:41:53.880 case where the evidence called for it. That answer should have led to more questions in court, but it
02:41:59.820 didn't. Judge DeLuke excused her without asking a single follow-up question, and the judge did
02:42:06.720 essentially the same thing with more than a dozen other prospective jurors. 16 years later,
02:42:12.960 Judge DeLuki's handling of those prospective jurors would wind up sparing Scott Peterson's life.

02:48:20.800 Nise later explained her thinking to A&E. When I was filling out this questionnaire,
02:48:25.880 that case of mine never came into my thoughts because it was a dropped case. It never went
02:48:33.660 anywhere. And it was nothing. So I never thought about that case. In 2022, Rochelle returns to a
02:48:41.780 Redwood City courtroom for the court-ordered hearing on her juror questionnaire. For five
02:48:46.900 days under a grant of immunity, she answers questions about the form she filled out 18 years
02:48:52.340 earlier. She cries on the stand and her lawyer tells the court she regrets ever writing the
02:48:57.920 letters to Scott. On December 20th, the judge rules that some of Niece's answers on the
02:49:03.980 questionnaire were false, but finds that Rochelle had misunderstood the questions,
02:49:09.220 not that she lied out of bias against Scott Peterson. Peterson's request for a new trial
02:49:15.140 is denied. Prosecutors could have impaneled a new jury to retry the penalty phase of the trial
02:49:22.060 if they wanted to seek the death penalty again.

02:49:59.040 In 2024, the Los Angeles Innocence Project takes Scott's case and asks the court for two things.

02:50:09.600 Scott's legal team wants to retest material from the mattress found inside the van that was discovered burning in a Modesto alley the morning after Lacey disappeared.
02:50:19.920 The state lab tested material from that mattress at the time and found no blood.
02:50:26.020 In 2019, a private lab examined some of the fabric and reported trace amounts of what might be male DNA, undermining unsupported claims that the mattress might be stained with Lacey Peterson's blood.

02:51:41.280 mostly involving evidence they say prosecutors destroyed or never gave to the defense.
02:51:46.740 In April of this year, a San Mateo County judge rejects all of those arguments and declines to hold a hearing on any of them.
02:51:54.920 The Innocence Project says it will appeal that ruling, along with the judge's earlier refusal to grant Scott a new trial over juror number seven, a.k.a. Rochelle Neese, and her juror questionnaire.
