00:00:32.500 Good morning, everyone. I'm Megan Kelly.
00:00:34.940 It's Friday, July 10th, 2026, and this is your AM Update.
00:00:39.600 The odds of them actually agreeing to re-hear a recently decided case and then changing their mind are extremely low.
00:00:46.360 President Trump launching a long-shot push to revive his effort to limit birthright citizenship,
00:00:51.800 while an immediate reversal appears unlikely, supporters say the legal fight is far from over.
00:00:58.460 American citizenship is worth far more than $4,000.
00:01:02.560 Texas Governor Greg Abbott launching an investigation into a hospital accused of
00:01:07.120 selling childbirth packages to pregnant women across the border in Mexico. Day four of Tyler
00:01:13.500 Robinson's preliminary hearing bringing out new texts and DNA evidence linking him to the murder
00:01:19.700 weapon and engraved ammunition. And a flying lesson taking a horrifying turn when the instructor
00:01:27.200 allegedly jumps from the plane, leaving his 22-year-old student alone at the controls.
00:01:34.200 All that and more coming up in just a moment on your AM Update.
00:01:41.280 If you are heading into summer without a medical emergency kit, you're taking a risk most people
00:01:45.640 don't even think about until it's too late and you don't have to. Summer colds linger and can
00:01:50.880 turn into sinus infections that last for weeks. Getting sick right before a vacay can derail
00:01:55.640 everything. And when you're traveling, finding a doctor and a pharmacy is stressful, especially if
00:02:00.680 you're overseas. But let me tell you about the medical emergency kit from the wellness company.
00:02:06.260 It's like an urgent care and a pharmacy right at home. It includes essential prescriptions like
00:02:11.180 amoxicillin and generic Z-Pak to treat a wide range of common and serious illnesses. No waiting
00:02:16.880 for your doctor, no hours of urgent care, no pharmacy lines, no co-pays. Just match your
00:02:22.120 symptoms to the right prescription in your guidebook or call their telemedicine doctor
00:02:26.480 standing by. Start on your meds sooner and feel better faster. Order yours online in 10 minutes
00:02:32.780 and then it's shipped to your door. And save 45 bucks with my promo code MK at urgentcarekit.com
00:02:38.980 slash MK, urgentcarekit.com slash MK. Okay. So you go to urgentcarekit.com. And when you check
00:02:46.960 out, make sure you mention MK and that gets you your discount and all good stuff.
00:02:53.620 President Trump launching an uphill effort to revive his push to limit birthright citizenship.
00:02:59.320 The president announcing Wednesday that he will ask the U.S. Supreme Court to reconsider its June
00:03:04.400 decision, striking down his executive order. The order denying automatic citizenship to certain
00:03:10.540 children born in the U.S. whose parents are here illegally or only temporarily. The High Court
00:03:16.640 ruling 6-3 that President Trump's order attempting to limit birthright citizenship was unlawful.
00:03:23.320 A five-justice majority, including conservative Chief Justice John Roberts and Justice Amy Coney
00:03:28.900 Barrett, finding that the 14th Amendment guarantees automatic citizenship to children
00:03:34.200 born in the U.S., even if their parents are here illegally or just temporarily.
00:03:39.740 Conservative Justice Brett Kavanaugh concurring in the judgment, but on different grounds.
00:03:44.860 President Trump pointing to a Fox News report about Mexican billboards advertising Texas
00:03:50.520 birthing packages as evidence the ruling opens American citizenship to abuse.
00:03:55.980 The president posting to Truth Social that signs along the southern border advertise deliveries
00:04:00.880 starting at $4,000, accusing businesses of turning birthright citizenship into a profitable scam.
00:04:07.980 More on that in a minute.
00:04:09.660 Mr. Trump writing, quote, American citizenship is not for sale.
00:04:13.100 In fact, that is a crime, and therefore the Supreme Court's ruling is wrong.
00:04:17.040 I will be asking for a rehearing by the U.S. Supreme Court immediately.
00:04:22.280 Supreme Court rules allow parties to request another hearing after the justices decide
00:04:26.340 a case.
00:04:27.340 Winning one, however, remains almost unheard of.
00:04:31.100 Legal scholar Stephen Vladek finding the court last granted rehearing in an argued case in
00:04:36.860 1965 and has reversed one of its own decisions after rehearing only once.
00:04:43.160 We spoke with Will Chamberlain, senior counsel at the Article 3 Project, who says it is extremely
00:04:48.880 unlikely that the high court will rehear this case, but argues the ruling may not settle the
00:04:53.840 issue forever. I think it's understandable that President Trump would want to do this. And I think
00:04:58.880 he's actually right on the merits. I think the Supreme Court got this case wrong, but the odds
00:05:03.200 of them actually agreeing to rehear a recently decided case and then changing their mind are
00:05:08.540 extremely low. I mean, it would just be very, very bizarre. Normally, they wouldn't do that.
00:05:12.900 I can only imagine in some case where there's just this massive new set of new facts that
00:05:17.900 indicate that maybe they were
00:05:19.780 premising their decision on something false
00:05:22.020 or misleading, but, you know,
00:05:23.920 there's nothing really changed in the
00:05:26.000 interim, and, I mean, the Supreme Court takes
00:05:27.840 a lot of time and, you know, goes through all the effort
00:05:29.880 of oral argument, briefing,
00:05:31.820 amicus briefs, you name it. I mean,
00:05:33.560 you know, the majority is not,
00:05:35.900 I don't think the majority is about to get up
00:05:37.760 and admit that they got it wrong after doing
00:05:39.720 all this work. It'd be very embarrassing for the court
00:05:41.680 to do so on such
00:05:43.660 short notice. Chamberlain pointing
00:05:45.700 to the narrow ideological divide
00:05:47.860 beneath the 6-3 ruling and what he sees as an unexpectedly strong foundation for a future
00:05:54.020 challenge. The fact that the conventional wisdom in the legal academy said this would be like a
00:05:58.100 9-0, that it was a frivolous issue, and there was no research done, and all of a sudden we're
00:06:03.060 getting four votes in the Supreme Court, that means that, you know, this is actually a pretty
00:06:07.220 persuasive argument that has been marshaled by the people who would say birthright citizenship
00:06:12.000 is more limited than the conventional wisdom would suggest. And if we're already winning
00:06:15.960 four votes, then one or two justices changing on the court, or maybe 10 years of this policy being
00:06:21.740 enforced, will, I think, lead actually, I think we're ultimately going to win. Like, I think
00:06:26.560 ultimately that, you know, this is the case that was wrong when it was decided, and a future
00:06:30.480 Supreme Court is going to reverse it. Chamberlain believes Congress could eventually force a new
00:06:35.260 constitutional test. I could see a world where a future Republican Congress passes a statute that
00:06:40.960 reinterprets birthright citizenship and reinterprets the language subject to the
00:06:44.820 jurisdiction in thereof as providing the basis for a challenge. I don't think, I doubt a future
00:06:49.560 White House will try the same tactic where they try and do it through an executive order,
00:06:53.400 but I could easily see a world where, say, if the Republicans had a little more control of both the
00:06:59.060 House and Senate, that they would try and pass a statute like this, and that would be the basis
00:07:03.520 for another challenge, because obviously, you know, there would be some sort of lawsuit
00:07:07.340 challenging the statute as unconstitutional. Any such law would almost certainly face an
00:07:12.680 immediate constitutional challenge. Texas Governor Greg Abbott, a Republican launching
00:07:18.920 an investigation into a hospital accused of marketing American births directly to pregnant
00:07:25.220 women in Mexico. The governor ordering the Texas Health and Human Services Commission
00:07:29.960 to determine whether Mission Regional Medical Center violated state law or any of its contractual
00:07:36.120 obligations by advertising what it called, quote, birth packages in South Texas. The
00:07:42.220 nonprofit hospital sits in Mission, Texas, just north of the Mexican border. Its Spanish
00:07:47.960 language campaign offering natural deliveries starting at $3,950 and C-sections starting at
00:07:55.780 $5,525, directing prospective patients to a website called havemybabyintexas.com,
00:08:04.060 according to Fox News. The advertisements appearing on two billboards near a border
00:08:09.300 crossing in Mexico, complete with an international telephone number for calling the U.S.
00:08:14.640 Governor Abbott accusing the hospital of targeting foreign nationals in an apparent effort
00:08:18.720 to profit from securing American citizenship for their children. The hospital confirming
00:08:23.940 the Spanish-language campaign to Fox News, but maintaining it never intended to promote any
00:08:29.060 illegal activity. A spokesperson saying the hospital removed the billboards and website
00:08:34.360 Monday because of what it called a, quote, unintended misunderstanding, adding, quote,
00:08:40.320 like hospitals across the country and throughout the region, we share information about the
00:08:44.620 healthcare services we provide. We do not support or facilitate any unlawful activity and work to
00:08:51.280 comply with all applicable federal and state laws and regulations. The campaign reportedly
00:08:56.560 beginning in 2021, although the hospital did not disclose when the billboards first went up.
00:09:02.660 Congressman Brandon Gill, Republican from Texas, arguing on Fox News that American citizenship
00:09:07.840 should never become part of a commercial maternity package.
00:09:12.500 Well, it's disgraceful, and I think that it's deeply insulting to every single American.
00:09:17.580 We recognize in America, as American citizens, that American citizenship is worth far more than
00:09:23.700 four thousand dollars that you don't just cross the border and enter magic dirt and have a child
00:09:29.780 and that child become fully american you know our becoming an american citizen means not only that
00:09:35.840 you have constitutional liberties that you have legal and economic protections and social
00:09:40.920 opportunities that nobody else in the world has but it also means that you are a part of the
00:09:46.100 american body politic that you have the rights and responsibilities that come with being an american
00:09:51.480 citizen, meaning you can influence our system of government, our rule of law, how this country
00:09:56.160 functions. And that's not something that we just simply hand out to our geopolitical adversaries
00:10:01.360 or to anybody who just simply crosses the border for the purpose of giving birth.
00:10:06.460 The controversy emerging as the Trump administration intensifies its crackdown
00:10:10.780 on so-called birth tourism operations. Federal rules prohibit foreign nationals from obtaining
00:10:16.580 visitor visas when their primary purpose is traveling to the U.S. to give birth
00:10:21.220 so their child receives American citizenship. The State Department announcing last month
00:10:26.520 that it had revoked hundreds of visas as part of a broader effort to identify the businesses
00:10:31.720 and networks facilitating those trips. Coming up, day four of Tyler Robinson's
00:10:39.180 preliminary hearing revealing forensic evidence tying him to the rifle and ammunition recovered
00:10:44.960 near the scene where Charlie Kirk was killed. And a 22-year-old student forced to complete
00:10:50.620 the ultimate emergency landing after her flight instructor allegedly jumps from the plane midair.
00:11:03.520 Our sponsor, the Electronic Payments Coalition, says Washington politicians are always getting
00:11:08.940 in your wallet, which you know, and now they're messing with your credit card too.
00:11:14.180 They say your credit card and the security it offers are under attack and that Senators
00:11:18.780 Dick Durbin and Roger Marshall want to change the nation's payment system to benefit corporate
00:11:24.180 megastores like Walmart and Target at the expense of everyday Americans.
00:11:29.500 Credit cards can keep your payments secure and provide rewards that families use to
00:11:33.740 help make everyday purchases much more affordable.
00:11:37.120 We all love that.
00:11:38.640 The Electronic Payments Coalition says the Durbin-Marshall mandates would let corporate
00:11:42.800 megastores, cut corners on credit card processing, routing transactions over cheaper, untested
00:11:48.380 networks with weaker security, and fewer protections. Find out more about this whole
00:11:53.440 situation at guardyourcard.com and consider telling Congress to guard your card.
00:12:00.580 Tyler Robinson, the man accused of assassinating Charlie Kirk last September,
00:12:06.000 back in a Utah County courtroom yesterday for day four of his preliminary hearing.
00:12:11.180 Prosecutors continuing their effort to persuade Judge Tony Graff
00:12:14.360 they have enough evidence to take Robinson to trial on seven charges,
00:12:18.900 including aggravated murder.
00:12:20.900 The morning session focusing on Robinson's former roommate
00:12:24.100 and so-called transgender furry lover, Lance Twiggs.
00:12:28.920 The court playing portions of a recorded interview Twiggs gave investigators.
00:12:33.420 In the video, Twiggs telling them that roughly one month before the shooting,
00:12:37.260 Robinson asked to borrow a Dremel tool to engrave bullets, claiming they were intended for a
00:12:43.920 hunting trip. The court then turning to text messages Robinson allegedly sent twigs after
00:12:49.380 the shooting. In those messages, Robinson confessing to killing Kirk, explaining why he
00:12:54.780 targeted the Turning Point USA founder and father of two, discussing efforts to recover and conceal
00:13:00.700 the suspected murder weapon. The afternoon session bringing Utah State Bureau of Investigation
00:13:06.160 Sergeant Jennifer Famoina back to the stand. Famoina, who led the evidence response team,
00:13:12.400 first describing what investigators found inside the rifle recovered in the wooded area
00:13:17.500 near where Charlie was killed. So when we rendered the gun safe, we found in it,
00:13:22.380 when we removed the bolt back, we found one 30-06 cartridge case, or a safe, a fired
00:13:30.640 cartridge case, and we also found three unfired cartridges, all with engravings on them.
00:13:37.280 Prosecutors then displaying the rounds one by one as Falmoina read each engraving for the court.
00:13:43.620 Do you notice an inscription or an etching on this cartridge case? Yes, I do. Will you read the
00:13:50.060 markings here? Hey, fascist. And page three. Catch. And page four. Up arrow, right arrow, 0.98
00:13:58.800 down arrow down arrow down arrow all right let's go to exhibit 21 and was this another round that
00:14:05.060 was found in the gun yes will you read the inscription here old bella chow page two chow
00:14:13.000 chow all right let's go to exhibit 22 another round that was found from the gun correct yes
00:14:19.540 will you please read the letters here if you read page two this comma you are page three
00:14:29.320 Gay.
00:14:30.420 And page four. 0.98
00:14:32.320 LMAO.
00:14:34.080 Falmoina testifying that investigators found overwhelming DNA evidence linking Robinson
00:14:39.260 to several of the items, including the buttons of the Dremel tool.
00:14:43.920 Calculation number one, it mentions here Exhibit 15.1.
00:14:48.440 Do you know where that swab is from?
00:14:50.640 Yep, it is swabs of the buttons of the Dremel tool.
00:14:55.920 And we read paragraph D.
00:14:58.460 Yes. The DNA profile is at least one trillion times more likely if it originated from Tyler
00:15:03.460 Robinson as a contributor to the major component in two unrelated, unknown individuals than if
00:15:10.320 it originated from three unrelated, unknown individuals. We also read paragraph E.
00:15:16.060 The probability of an unrelated individual in the population who has not contributed
00:15:20.500 DNA to this sample yielding this level of support is less than one in one trillion.
00:15:27.140 Investigators finding similarly strong DNA evidence on multiple parts of the rifle and scope,
00:15:33.160 as well as the engraved cartridges, the Dremel's cord, and two of its metal bits.
00:15:38.720 Prosecutors resting their case after four days of testimony,
00:15:42.040 the hearing later shifting to another dispute over public access to the evidence.
00:15:46.920 An attorney for the Kirk family asking Judge Graff to publicly play an enhanced compilation
00:15:51.920 of surveillance footage gathered from Utah Valley University.
00:15:56.160 arguing that all evidence admitted during the hearing should be shown in open court.
00:16:00.500 Robinson defense attorney Michael Burt responding with a pointed and totally unfounded attack on Erica Kirk.
00:16:08.680 As the court knows, we have witness availability problems.
00:16:12.140 We spent the bulk of today and yesterday arguing about nothing to do with the evidence in the case,
00:16:20.060 but with rights of third parties.
00:16:22.480 and it's appropriate for the court to consider that but at some point
00:16:26.280 I think the court has to return to the purpose of these hearings
00:16:29.840 which is to expeditiously hear the evidence and then determine probable cause
00:16:36.640 and I want to point out to the court Ms. Kirk has been very adept at holding
00:16:40.900 press conferences at which she has revealed evidence
00:16:44.440 she has represented that the state is her attorney
00:16:49.540 She has access to all the evidence that the state has publicized and that the media and her own lawyer argues is already in the public domain.
00:17:01.080 So they're perfectly free to go outside this courtroom under the court's protective order.
00:17:07.400 They're free to go out and hold press conferences and announce to the world outside the courtroom what they think the evidence is.
00:17:14.780 Kirk family attorney Jeffrey Nyman firing back.
00:17:18.040 the family has not seen this video it hasn't it doesn't have access to the evidence the state has
00:17:22.560 the state is the state and mrs kirk and the family are have their representatives that there's a
00:17:27.080 completely distortion of reality that was just put forth um and this is about educating anybody
00:17:32.980 anybody about anything this is about allowing the family to see the evidence that's been gathered
00:17:37.640 after a 10-month investigation in which a father a husband was assassinated that's what this is
00:17:45.700 about. So we ask you to please allow the family to view the video like the court has viewed
00:17:51.700 in order to allow the family to process this moment. Judge Graff declining to rule immediately,
00:17:59.380 today expected to mark the final day of the preliminary hearing with one witness remaining.
00:18:04.180 Prosecutors had hoped to move directly into closing arguments and receive an immediate
00:18:07.880 ruling on whether Robinson will stand trial. The defense asking to submit written briefs,
00:18:13.380 setting up another round of filings before closing arguments.
00:18:17.160 Judge Graff granting that request, pushing oral arguments to September 1st,
00:18:21.940 meaning the likely trial will be delayed even further.
00:18:26.700 A flying lesson in Argentina taking an unimaginable turn.
00:18:31.200 The instructor reportedly jumping out of the plane mid-flight,
00:18:35.700 leaving his 22-year-old student alone and at the controls.
00:18:39.000 The bizarre and tragic incident unfolding Saturday over the central province of Cordoba.
00:18:45.880 According to Argentine outlet TN, flight instructor Leandro Bertazzo, 42 years old,
00:18:52.360 and a student named Rosario were flying in a two-seat Cessna when Bertazzo suddenly removed
00:18:58.520 his headset, unbuckled his seatbelt, and opened the aircraft door. His final instruction to
00:19:04.580 Rosario, quote, You know what you have to do. Carry on. Bertazzo then jumping from the plane
00:19:10.860 to his death. Rosario radioing the Flying Parrot Flight School for help, following emergency
00:19:17.360 instructions to fly the aircraft back to the airfield, landing safely without damaging the
00:19:22.460 plane. Flight school director Eduardo Alvarez praising the young pilot, telling Tien, quote,
00:19:28.700 She was very shaken, but with complete professionalism, she piloted the plane to
00:19:33.480 the airfield and landed perfectly. Alvarez joining the search for Bertazzo, spotting his body in a
00:19:40.560 rural field roughly 15 minutes after the jump, authorities pronouncing the instructor dead at
00:19:45.800 the scene. Bertazzo was an experienced pilot with several advanced licenses and had completed
00:19:51.980 another lesson earlier that same day. Alvarez telling Tien that no one at the flight school
00:19:57.240 detected any warning that Bertazzo might take his own life. Quote,
00:20:00.860 There's a very close student-instructor relationship in a professional sense,
00:20:05.580 but none of those who flew with him, nor those of us who saw him,
00:20:08.840 could detect that he was going to make that decision to jump out of an aircraft.
00:20:13.160 Obviously, something was up.
00:20:15.480 His relatives later revealing that he had recently sought mental health treatment
00:20:19.260 without telling his colleagues.
00:20:21.520 Prosecutors now investigating the circumstances surrounding his death.
