00:09:33.820 aggravated sexual battery against a minor under 13, end quote.
00:09:39.720 He was also charged with felony indecent liberties with a minor.
00:09:43.640 The charges were later dropped after the alleged victim and her mother ceased cooperating with
00:09:48.160 authorities, though it was left in a legal status that allows the charges to be reopened if and when
00:09:54.380 the victim chooses to proceed.
00:09:56.080 D.H.S. releasing further information on the man, saying he illegally entered the country three times

00:11:48.200 In Virginia last week, Loudoun County Public Schools suspending two boys from Stonebridge High School
00:11:54.560 because they dared to question why a girl, pretending to be a boy, was allowed in their locker room.

00:12:01.980 Loudoun County Public Schools reportedly began investigating three boys back in May
00:12:07.320 after the girl secretly recorded the boys in their locker room, a violation of school policy,
00:12:13.700 talking amongst themselves about how they were uncomfortable with her being in their private space.

00:12:23.080 The female student turns on her camera and walks into the boys' locker room at Stonebridge High School.
00:12:28.620 Most of the video is dark, but you can hear locker room sounds and boys' voices.
00:12:37.960 This is the moment some of the boys in the locker room realize the female student is there.
00:12:43.100 Thirty seconds later, you hear this.
00:12:45.280 That's when the female student appears to take the phone out of her pocket and aims the camera at the boys in the locker room.
00:12:59.280 Despite rules against taking video in a locker room, it appears the female student received no disciplinary action.
00:13:06.000 Loudoun County School Board policy allows students to use bathrooms and locker rooms according to so-called gender identity,
00:13:13.500 regardless of biological reality, a policy in conflict with President Trump's executive order on Title IX protections.
00:13:21.140 Boys and girls should not be subjected to this under the law.
00:13:24.300 The school board opened an investigation into the three actual boys, two Christian and one Muslim,
00:13:31.400 over whether they committed sexual harassment for questioning why the girl was in the boys' locker room.
00:13:38.220 In June, the investigation against the Muslim boy was dropped, finding his conduct did not constitute sexual harassment.
00:13:45.280 But the two Christian boys were charged with sex-based discrimination against the girl.
00:13:50.860 The group representing the boys, the founding Freedoms Law Center, writing in a statement,

00:13:56.200 While we celebrate the dismissal of our Muslim client from Loudoun County's Title IX sexual harassment investigation,
00:14:03.700 there is absolutely no basis for keeping this going against the two Christian boys.
00:14:08.060 The same facts were alleged against them all, yet the only difference is their faith.
00:14:12.780 On Friday, the school issuing a 10-day suspension to the two boys and a no-contact order with the female student,
00:14:19.400 including not being able to share any classes with her.
00:14:23.220 This is ridiculous.
00:14:25.540 The father of one of the boys speaking out Wednesday on Fox Business.

00:14:59.400 The suspension now paused following an appeal by the boys' attorney,
00:15:03.860 arguing they are being unfairly punished, the case now in limbo.
00:15:08.480 Last night, a protest was held outside of a Loudoun County public school board meeting
00:15:13.520 at which the transgender bathroom policy was discussed.
00:15:17.480 There, a white woman in support of the policy had a message for Republican Lieutenant Governor
00:15:22.980 Winsome Sears, who is running for governor against Democrat Abigail Spamburger.
00:15:28.600 Hey, Winsome, the sign read.
00:15:30.700 If trans can't share your bathroom, then blacks can't share my water fountain.
00:15:36.300 Lieutenant Governor Sears is black.

00:15:40.320 We spoke with senior fellow at the American Culture Project,
00:15:44.340 a nonprofit fighting to dismantle America's teachers' unions, Corey DeAngelis,
00:15:48.820 who notes this case flips the script on typical Title IX complaints.
00:15:52.480 A lot of people don't want to have sympathy for boys just because they're boys.
00:15:56.260 But it's the same problem as when you have a boy in the girls' locker room.

00:16:04.040 which has a huge impact on the beginning of their school year.
00:16:06.900 That's 10 school days, and it's going to have a lasting impact on the rest of their life,

00:16:20.680 The ruling or decision on the part of the school district basically slaps Title IX on its face.

00:16:31.660 Title IX is a federal law that's supposed to protect people from sexual harassment.
00:16:38.260 And they're basically arguing that the boys are in the wrong here,
00:16:42.600 whereas they're in their own private space and the girl is in the boys' locker room.
00:16:47.740 And this isn't rocket science.
00:16:49.760 Virginia Attorney General Jason Meares opening an investigation into this incident at the state level,

00:16:56.240 a disturbing misuse of authority by Loudoun County Public Schools,
00:17:00.360 referring the matter to the Department of Education's Office for Civil Rights
00:17:03.420 and the DOJ's Civil Rights Division.
00:17:06.160 Loudoun County Public Schools stating, quote,
00:17:08.280 We would not investigate or discipline students based on their personal opinions, thoughts, or beliefs.
00:17:13.620 We reject any characterization that implies our schools are unsafe
00:17:17.360 or that we fail to protect the rights of all students.
00:17:20.980 DeAngelis calls the response gaslighting,
00:17:23.020 Noting, Loudoun County has been down this road before with devastating consequences.
00:17:27.880 This is the same school district that basically covered up a rape in a girl's bathroom
00:17:33.900 that was committed by a biological male.
00:17:37.080 And, you know, there was an investigation and everything.
00:17:39.540 The boy was found guilty of raping the girl in the restroom.
00:17:43.700 This is when the father actually showed up at the school board meeting
00:17:47.200 to protest this same policy that allows this girl today into the boy's locker room.
00:17:53.300 It's their policy 80-40 in Loudoun County Public Schools allows students to choose their locker rooms
00:18:00.500 and their bathrooms regardless of their biological sex,
00:18:04.220 which is a huge red flag.
00:18:06.740 And it arguably could have contributed to the rape in the bathroom.
00:18:10.340 The parent was upset about this, obviously.
00:18:13.140 He got drug out.
00:18:14.440 Well, it turned out later on that that father was in the right.
00:18:18.120 He was rightly upset about this policy leading to real damage,
00:18:22.740 leading to real harm and sharing his experience with what happened to his daughter.
00:18:28.580 That victim later filing a $30 million lawsuit against the school board
00:18:33.320 whose superintendent had openly lied to parents
00:18:36.800 about whether there had been a rape in the Loudoun County school bathrooms
