00:11:07.640Trump administration unlawfully stripped legal status from tens of thousands of migrants who
00:11:13.020entered the U.S. using the Biden-era CBP1 app. Obama appointed Judge Allison D. Burroughs of
00:11:20.160the federal district court in Massachusetts ordering the administration to reinstate the
00:11:24.960lawful parole status pending asylum hearing for migrants who had such status revoked through an
00:11:30.840April 2025 mass termination email. The order applying to those who used the app between
00:11:36.480May 2023 and January 2025 and who remain in the U.S. The CBP-1 app created under the Biden
00:11:44.360administration was meant to manage what had become a full-blown surge at the southern border
00:11:49.180with thousands of migrants arriving daily, overwhelming both border agents and ports of
00:11:54.380entry. Facing mounting pressure to get a handle on the chaos, the administration rolling out the
00:11:59.380CBP-1 app, directing migrants seeking asylum to schedule appointments at legal ports of entry
00:12:05.120instead of crossing illegally. At its peak, the program processing roughly 1,450 migrants per day
00:12:11.980through scheduled app-based entry, according to the New York Times. Those approved, typically
00:12:17.820receiving two years of temporary parole, allowing them to live in the U.S. without being deported,
00:12:23.360many even granted work permits. Roughly 900,000 people gaining legal status in the U.S.
00:12:29.300through the controversial program. One of President Trump's first actions upon returning
00:12:34.020to office was shutting down the CBP-1 system, later repurposing it into the CBP Home app,
00:12:41.320aimed at encouraging voluntary self-deportation. In April 2025, the administration sending a
00:12:47.660mass message to many CBP-1 users, informing them their parole was terminated, telling
00:12:53.520recipients, quote, it's time for you to leave the U.S. Unless it expires sooner, your parole
00:12:58.780will terminate seven days from the date of this notice. Do not attempt to remain in the
00:13:03.260United States. The federal government will find you. That move prompting a lawsuit from
00:13:08.540migrants from Venezuela, Cuba, and Haiti, arguing the action violated the Administrative Procedure
00:13:14.400Act, a federal law requiring agencies to follow process and to justify their actions. The Trump
00:13:20.260administration arguing it had broad authority to terminate parole and was simply exercising
00:13:25.180its discretion to end a Biden-era program it viewed as unlawful. Ultimately, Judge Burroughs
00:13:31.300siding with the plaintiffs, ruling that while the administration does have the authority to
00:13:35.920terminate parole, it did not follow its own procedures in doing so here. Quote,
00:13:41.320When defendants terminated the impacted non-citizens' parole without observing the
00:13:46.120process mandated by statute and by their own regulations, they took action that was not
00:13:51.600in accordance with law. DHS blasting the ruling in a statement to AM Update,
00:13:56.760We disagree with this blatant judicial activism undermining the president's Article 2 authority
00:14:02.040to determine who remains in this country. We spoke with CEO and co-founder of The Federalist,
00:14:07.880Sean Davis, who says this ruling amounts to legislating from the bench.
00:14:12.600The judge in Boston effectively created her own law in order to justify her decision.
00:14:18.180Under the law, with the attorney general, can allow people into the U.S. on a case-by-case
00:14:23.640basis on temporary parole while their claims of asylum are investigated, and that when
00:14:30.840the attorney general feels that that parole is no longer necessary, he or she has the
00:14:35.820sole discretion to terminate the parole, send the individual back to the country he or she came from.
00:14:41.760What the judge in this case decided was, well, yeah, it says that the AG has discretion to grant
00:14:49.600parole, but we think the judiciary has the authority to determine whether the parole should
00:14:57.720have been terminated. And it is a complete inversion of the law. This judge out of nowhere
00:15:03.440created a right to judicial review that simply does not exist in the law.
00:15:08.920Dave is calling this the latest example of a broader pattern of judicial overreach.
00:15:13.520The real tragedy of these types of lawless decisions from unelected, low-level district
00:15:20.280judges around the country is what they are effectively doing is they are crippling the
00:15:25.080administration of justice and the execution of the laws which solely belong to the president.
00:15:29.260And it may be some small comfort to people to know that, oh, in a year or two or maybe three or maybe even after Trump is gone, that eventually the law will prevail and these lawless judges will be smacked down.
00:15:43.820But the problem is you can't get that time back.
00:15:46.440And it is a perfect example of why you cannot have a nation that is basically ruled by hundreds of unelected district judges.
00:15:55.080If the founders had wanted the president to have to get unanimous consent from unelected inferior judges, they would have put that in the Constitution.
00:16:05.600And so I view these types of decisions as just a total abomination and a lawless takeover of power that was never actually granted to the judiciary.
