00:03:11.760 Clancy murder trial after roughly 17 hours of deliberations over three days. Clancy is charged
00:03:18.560 in the January 2023 deaths of her three children at the family's Duxbury, Massachusetts home.
00:03:25.600 She has pleaded not guilty with the defense arguing she lacked criminal responsibility
00:03:30.060 because of severe mental illness. The jury now set to return this morning to continue weighing
00:03:35.920 a five-week trial that included competing expert assessments of Clancy's mental state along with
00:03:41.520 hundreds of exhibits, and extensive medical records. Two female jurors reportedly wearing
00:03:47.780 pink as they deliberated Monday, the same color worn by many of Clancy's supporters
00:03:52.980 waiting outside the courthouse each day. It is unclear if the outfit choice had anything to do
00:03:58.920 with support for Clancy. Judge William Sullivan dismissing the panel yesterday afternoon,
00:04:04.240 again reminding jurors to avoid coverage of the case and not discuss it outside the jury room.
00:04:10.080 We spoke with the MK True Crime Show co-host Dave Ehrenberg,
00:04:13.980 a former prosecutor who says the length of deliberations is not surprising in a case like this.
00:04:19.400 I'm not surprised it's taken this long because it was a lengthy trial.
00:04:24.480 The country is split on this and the jurors reflect the country.
00:04:29.460 And that's why I would have been surprised if it was a quick verdict.
00:04:32.800 But if it was a quick verdict, it would have been not guilty
00:04:35.040 because the prosecution is going to have a hard time proving that top charge
00:04:39.680 of first-degree murder or even second-degree murder.
00:04:42.920 If jurors cannot reach a decision, Ehrenberg says,
00:04:45.500 the judge does have steps to take before declaring a mistrial.
00:04:49.300 The judge will order the jurors to go back in and continue deliberating.
00:04:54.480 And then if they are hopelessly deadlocked, he'll then declare a mistrial.
00:04:58.160 But the judge will twist their arms a little bit and say,
00:05:01.500 you know, there's a certain charge you get,
00:05:03.480 which is keep deliberating, and then eventually they'll give in.
00:05:10.160 But there's still a long way to go.
00:05:12.520 Ehrenberg arguing that the manslaughter option could give jurors a middle ground
00:05:16.620 between a murder conviction and finding Clancy not criminally responsible.
00:05:21.640 In a case like this, where I think the prosecution overcharged with first-degree murder,
00:05:26.180 this allows jurors to compromise.
00:05:29.140 And even though involuntary manslaughter is not a perfect charge here as far as if she had a severe mental incapacity to know the difference between right and wrong and could not control her behavior, then she should not be found guilty of either of the crimes of either murder or manslaughter.
00:05:54.940 She should just be found not guilty by reason of insanity.
00:05:57.140 But the jurors are likely going to feel that the crime was so horrific that perhaps there should be something more than a not guilty verdict.
00:06:06.380 And if that's the case, then involuntary manslaughter is a good compromise.
00:06:10.980 And for the prosecutors, even though it's not the charge that they had wanted, it could get Lindsay Clancy up to 60 years in prison.
00:06:19.640 A mistrial would not necessarily end the case.
00:06:22.640 Ehrenberg says prosecutors would likely assess the jury's split before deciding whether and on which charges to try Clancy again.
00:06:30.080 The prosecutors will look at the vote and they'll say, is it 6-6? Is it 11-1 against us, 11-1 for us?
00:06:38.800 And then make a decision. If the vote comes back 11-1 against the murder counts and 6-6 on the manslaughter counts, then I think they would try it again just on manslaughter.
00:06:52.100 I don't think they want to just enter a losing race the next time around.
00:06:56.580 They want to do something where they think they can win.
00:06:59.020 And in this case, if they just get a hung jury, that is not necessarily the worst verdict in the world for prosecutors who for, I mean, at least for a couple of weeks, seem to be on the wrong side of this, at least on court public opinion, because it did seem like the defense lawyer had gotten the best of them until the closing arguments.
00:07:22.100 As for those reports of jurors wearing pink,
00:07:25.100 Ehrenberg cautions against drawing a firm conclusion from one day's clothing.
00:07:29.940 You're not supposed to be wearing things that show where your mind's at in the trial
00:07:35.440 or try to persuade people by what you're wearing.
00:07:39.380 At the same time, it could just be an innocent explanation,
00:07:43.480 and we'll see what they wear the next time.

00:09:16.420 Some of these canyon walls, they tower over 4,500 feet, especially near Bright Angel and
00:09:21.640 the phantom creek areas where the flooding occurred this weekend so that water if it
00:09:26.040 actually falls on the rim of the grand canyon that has to go somewhere and it eventually makes its
00:09:31.320 way down towards the colorado river and it can flood those rivers and the tributaries very easily
00:09:35.800 especially when we see around an inch of rain in about a 30 minute period that is what really
00:09:41.300 occurred on saturday there were four waves of rain that came through across the grand canyon
00:09:45.740 but it was that last fourth and final wave that really was the nail in the coffin because that
00:09:50.500 put the rush of water, picked up the debris flow from a nearby burn scar, and that allowed for all
00:09:57.260 of this debris to just wash downstream. Remember, the topography, very steep. And when you are in
00:10:02.760 the Grand Canyon or hiking in these areas, you see debris flows like this. This is when you need to
00:10:07.280 escape to higher ground. The problem is it's so steep that it's tough to get up those canyon walls.
00:10:12.460 Survivors recounting a desperate escape from the floodwaters, two evacuees, David Gregory to CBS
00:10:18.260 News and Erica Viola to ABC7, describing what they saw as the water tore through the canyon.

00:11:07.960 came through the campground and phantom ranch and just wiped out all the bridges. The devastation is
00:11:14.940 now making the search harder. Nearly every footbridge across Bright Angel Creek has been
00:11:20.200 destroyed, according to the Park Service, cutting off hiker access through the area.
00:11:25.080 The flood also reportedly destroying about 40 percent of the Trans Canyon waterline,
00:11:30.220 the system supplying water to the park. That damage leaving the park with limited reserves
00:11:35.160 and forcing major water conservation measures as search and recovery efforts continue.

00:16:08.120 in a position in the United States where as strong as we have ever been, we're only going to get
00:16:12.060 stronger under the president's leadership. We certainly saw under the Biden administration
00:16:15.960 that the military was underinvested in and underresourced. We're fixing that every day.

00:16:39.720 the Strait of Hormuz on Sunday after CENTCOM says members of Iran's Revolutionary Guard were
00:16:45.180 observed preparing to launch rockets and deploy sea mines into the critical shipping lane.
00:16:50.760 The U.S. describing the strike as a, quote, limited, precise action, Iran later saying
00:16:55.760 it launched missiles toward U.S. sites in Jordan. President Trump then weighing in with a very

00:21:34.740 It really tries to block a specific mutation in the tumor and therefore tends to have less side effects, better quality of life, and as you noted, really has helped people live longer who are on the trial compared to chemotherapy.
00:21:48.300 Acting FDA Commissioner Kyle Diamantis calling Wednesday's approval a, quote, groundbreaking milestone.
00:21:55.100 More than 2,000 patients reportedly already receiving RasenQ through an expanded access program Revolution Medicines launched in May.
