00:14:17.540 out of six charges. Tamara beat five of the six charges against her being found guilty only of 0.99
00:14:22.480 the mischief and Chris Barber beat five of the seven against him being found guilty of the
00:14:26.480 mischief and the counseling disobey court order or disobey court order one of the two. It's crazy
00:14:31.900 and when you look at the other charges you look at the intimidation which they were not found
00:14:36.040 guilty of when the judge explained the reason for not finding them guilty of that she said
00:14:39.100 I felt like I'm having a deja vu moment here when I'm going through the evidence.
00:14:43.140 The Crown's arguments for this charge are the same as the mischief. Intimidation is not the
00:14:46.800 same it becomes duplicity that's not what this is intimidation has very set parameters it's
00:14:52.520 there has to be a menacing there has to be violence and she said there is no menacing or violence
00:14:56.340 in freedom convoy which is huge and we've heard that time and time again she concluded the decision
00:15:00.960 of his majesty the king versus pat king where in that decision justice hacklin said that the freedom
00:15:06.380 convoy was not there to intimidate people and that the government of canada is not a person for the
00:15:10.740 sake of being intimidated under the criminal code right their goal of the freedom convoy was a legal
00:15:15.560 goal to advocate for ending of the mandates that's my opinion i don't exactly i believe it was said
00:15:22.440 that the express purpose of the cowboy itself to end mandates or advocate for the end of mandates
00:15:27.000 it's not illegal we have a right to do that that was our redress people tried calling mpps people
00:15:31.800 tried calling mlas people tried talking to mps they were laughed at they were told to go away
00:15:36.760 they got the cops called on them people and kids skating on hockey rings were tackled to the ground

00:15:43.640 And thank the Lord that the Freedom Convoy rolled through the dark to take the Ottawa

00:16:07.380 And that's what the Crown's case was predicated on, aiding as a principal or party or an aider or better to any of the offences or counselling thereof for any of the offences.
00:16:16.120 And you might ask if you read my summary of the charges and the convictions, what does counselling not committed mean?
00:16:22.760 Basically not committed is the Crown's going to say somebody said something and the thing that they said had an unreasonable risk, as the law would call it, of someone else hearing that and acting upon it to commit a crime.
00:16:33.440 You're basically inciting them to do that, and you're going to be held responsible for it, as if you did it yourself.
00:16:39.220 And the not committed part is the Crown doesn't have to say,
00:16:42.680 this person, Tommy, heard these words and did that.
00:16:46.240 Not committed means you're still going to be held accountable as if someone did it,
00:16:49.160 but we can't find anyone specifically to say they did those things.
00:16:52.280 That's what that is. And it's in the criminal code. They could do that.
00:16:55.440 It was thorough. The judge spoke extensively about the case law.
00:16:58.780 I mentioned Polovsky in Alberta, how the judge over there found him, the mischief defense, the statutory mischief defense,
00:17:05.420 that if you go to have a communicative purpose for something that would be for the purpose of communication that would otherwise be a mischief,
00:17:13.800 you could be defended from it.
00:17:15.280 In fact, Mr. Greenspan, who was a lawyer for Tamara Litch, argued that in the front of the Court of Appeal for Ontario in R.V. Trombley 2010, I believe,
00:17:23.300 where the statutory defense for mischief in the criminal code actually came to be litigated there
00:17:30.440 and to be understood to protect messages that would otherwise be mischievous for the purpose of communication.
00:17:35.440 Now, the judge ultimately disagreed with the defense's position for the statutory defense of mischief,
00:17:40.040 finding the accused guilty of mischief, but they were not guilty of the counseling mischief.
00:17:45.160 And I really, I kind of skipped the justification for that,
00:17:49.380 But it sounded like the Crown requested that that that counseling charge for counseling others committed mischief, not committed, would be stayed on the condition that the people were found guilty.
00:18:01.440 He accused Chris Tamera found guilty of a substantive charge of actual mischief.
00:18:04.980 So in that case, that's why I think that was count one was stayed the other.
00:18:08.940 So that's another 12 minutes.
