00:10:43.800But there is the Justice Center for Constitutional Freedoms has been advocating for me.
00:10:52.460Just to set the record, back in 2020, 2021, leading up to the convoy, I was charged 25 times by the Ontario government, the Conservative Ontario government, for the audacity of being outside, meeting with people, meeting and greeting with them, hugging them, shaking hands, and opposing COVID mandates.
00:11:20.680And each one of those charges came with a $100,000 fine maximum and up to a year in jail.
00:11:31.000And the JCCF were instrumental in backstopping me in my challenges to COVID and the mandates.
00:11:40.800And so they've been my advocates on those charges.
00:11:46.640I am representing myself on the criminal charges out of the Freedom Convoy, the Truckers Convoy in Ottawa.
00:11:56.200But that's a different story for a different night.
00:11:57.880Tonight, I'm on top of the world because the JCCF and their powerful arguments and advocacy has resulted in the very first victory, constitutional victory in our courts in Canada over the COVID mandates and lockdowns.
00:12:21.460Can you take us through this, Randy? I mean, like from from the beginning, because this, you know, there have been, as you point out, other constitutional challenges that have failed, which shocks me, considering the fact that the Charter of Rights and Freedoms, you know, in times of trouble, that's why it's there.
00:12:38.080and you know i think we talked before about section one having to be completely removed
00:12:42.620from the charter for the charter to mean anything at all uh but the oaks test comes into play here
00:12:48.680so many other different variables in the arguments that you guys were making and then you you got
00:12:55.500defeated in a lower court in ontario and then you know the appeals court says oh no no or was
00:13:01.820it the appeals court that got overturned by the supreme court you see this is where i go ahead
00:13:07.080Okay. So in this case, let's go. So I had 25 charges. The crowns in 20 of those jurisdictions
00:13:17.320eventually came to their senses and withdrew or stayed the charges. But there was five remaining
00:13:26.020who would not budge. They wanted their pound of flesh from me, Shadow. And I was not going to
00:13:34.920budge i was not going to plead out i was not going to uh it was withdraw or piss off okay um and um
00:13:45.180so and that was my whole intention back in november 2020 november 2020 when i was first charged
00:13:52.620was i wanted to get this in the courts and have a court rule on the constitutionality of this
00:13:58.800We finally had the matter heard in 2023 in the Ontario Superior Court.
00:14:08.080So it's not a low court, it was a superior court.
00:14:11.420And Justice Callaghan, who I might add, was a longtime lawyer for one of the largest legal firms in Ontario, whose firm profited greatly during COVID.
00:14:28.800but was named to the bench, heard my first case, and he dismissed it and said, there's no merit here.
00:14:38.240We appealed to a higher court, the Interior Court of Appeals, and the three judges, Carnot, Lauer, and Pomerantz,
00:14:50.000all agreed unanimously that the government overstepped their authorities
00:14:59.580and they did not do it in a demonstrably justified fashion.
00:15:13.640And people should take a bit of a big breath of fresh air here.
00:15:18.280I know a lot of people have been very, how should we say, discouraged and disenfranchised with some of the cases that have been before the courts.
00:15:33.740But this time, these three judges, and they weren't, I can say they weren't predisposed to ruling in my favor at the beginning of the arguments, but they did so at the end.
00:15:49.920How could you tell? Did they have scowls on their faces when they were looking at you? Like, what was the tell there?
00:15:57.020Well, you can tell by the questions that they ask
00:16:23.800they were uh intelligent uh and they at the end of the day they were irrefutable so unlike
00:16:31.820you know one of the other big constitutional challenges was one put forward by peckford
00:16:38.140and others uh on the vaccine travel mandates um where the court ruled it was moot my cases were
00:16:46.600still live in front of the court so uh because i would not budge on them um you know a lot of
00:16:53.840i i guess i should say this you know when you're when you're fighting this legal machine this
00:17:00.400goddamn bloody legal monster um there is it's all about process and you need to
00:17:07.960really make sure you don't screw yourself in the process um so those matters were still live
00:17:16.440The court couldn't rule a moot, and then the arguments were, like I said, intelligent, reasonable, and they were irrefutable, and this will be of benefit.
00:17:36.200You know, I was doing this to make sure that my grandchildren, my children have a free country to live in, Shadow.
00:17:51.520I was also doing it because, and I think there will be benefit for those who are still before the courts,
00:17:58.580those who had been previously convicted and have paid significant and onerous penalties.
00:18:06.200um an opportunity that they too may now get their convictions overturned and those people
00:18:15.480that are still before the courts that they will come across the crowns who will say
00:18:21.980well the hillier's won this one it's time for us to put this to bed and and go away
00:18:28.460did you get the sense that the crown might try to appeal this all the way to the supreme court
00:18:35.140I don't you know they may well unlike other decisions like decisions from a divisional or
00:18:44.960provincial superior court where the crown has an automatic right of appeal that's not the case in
00:18:53.880the appeals court because this was ruled by three judges not a singular judge and it was a unanimous
00:19:00.800decision as well which is important to point out huge there was no dissenting views here
00:19:05.560so the crown if they want they can seek leave to appeal to the supreme court of canada
00:19:15.080but it is a high bar for them to get over and i don't think on reading this decision
00:19:24.700i think it will be very very difficult for them to get over that bar
00:19:30.180how much is this taken out of you and i'm not talking about financially here i'm talking about
00:19:36.280just your day-to-day it has it consumed you with worry i mean and you don't come across as a guy
00:19:42.760randy who worries about a lot of things you're you know you've got a very jovial attitude uh very
00:19:48.860relaxed very uncle randy type kind of guy um but you know going through everything that you've been
00:19:57.040through. This must be a hell of a weight off your back. Well, listen, I guess I'll start with this.
00:20:09.240You know, the greatest weight I ever felt was those first few months of COVID when hundreds
00:20:18.860And hundreds of my constituents were calling me all day long, all night long, full of despair, full of anxiety, full of fear and uncertainty about what the government was doing to them with these mandates during COVID and listening to their stories of anguish.
00:20:43.140um uh and you know we i knew we uh we had to do something um uh you know that was that was a heavy
00:20:54.400burden um but um you know it was in the in the last five years has not been easy for a great
00:21:05.540great many people in Canada like um like it is this last five years have ripped apart
00:21:13.680our families ripped apart and shredded our uh relationships with friends and uh and it's also
00:21:22.020killed uh these mandates have killed our friends and family members so
00:21:28.540So, you know, this has been a burden, the legal burden.
00:21:35.920This one has been going on for just over four years.
00:21:41.180I still have one more to go, but I'm going to beat that one as well.
00:21:45.580um and uh and i breathe easy and i uh and i'm happy uh that uh my children my grandchildren
00:21:56.420and others uh uh have a charter of rights now that has some purpose and some meaning in that
00:22:07.460they will uh uh hopefully always be able to gather freely without fear um to oppose and dissent
00:22:17.700government opinions so yeah it's been a bit of it's been a battle but it's a battle that's
00:22:24.020worth every inch of the ground that we've had to fight for thank you thank you thank you for doing
00:22:33.140that there's many that wouldn't have there's many that would have backed down or never even
00:22:38.080gotten to first base with this um so the legal machine is not an easy one to fight
00:22:46.740no it's huge and it's perpetual and it's bottomless and yeah you know and i think if
00:22:55.020there's one message that people should take um from covid is um you may not have an interest in
00:23:01.740law and you may not have an interest in politics but they have an interest in you and in the laws
00:23:10.000that we pass in our legislatures in our parliaments affect your lives and and i'm not suggesting that
00:23:18.800for a moment that anybody should be uh that everybody has to go to law school you know i'm
00:23:24.480a grade 12 uh high school graduate from reedle high school in ottawa ontario i'm an electrician
00:23:31.060by trade you know you can learn what is necessary for and what is important to defend yourself
00:23:43.240in our courts and and you and you're better because it's this machine is is still going
00:23:50.080we haven't been able to to take it down to the size that it should be interesting that they
00:23:57.200don't teach the charter of rights and freedoms in high school because they maybe don't want us to
00:24:02.800know them well they teach you what's important like the bloody goddamn rainbow agenda and that
00:24:09.500the world's going to end because of uh you're driving a car that uses uh gas uh and and all
00:24:18.200kinds of other bullshit um you know uh people better people need to wake up and say you know
00:24:25.920what is really important uh and and you better become knowledgeable about what is really important
00:24:33.460because it's gonna it's gonna hurt you if you don't have the knowledge to fight back
00:24:39.500i want to go back and look at this from the other side of things had you gotten that ruling this
00:24:47.220morning that said you had lost what would that have meant before we get to the good stuff let's
00:24:55.120talk about because this could have gone the other way i'm sure uh yeah you know when we talk about
00:25:01.240precedent here yeah so it was the you know i prayed last night um you know i i got word that
00:25:09.100the decision was coming out last night and uh and although i was uh had been full of confidence for
00:25:16.560the last seven months because that's how long the decision has taken to get um it was um i i prayed
00:25:24.620last night that because the alternative for me would be fighting not only the nine criminal
00:25:34.740charges in the criminal courts, but I'd also be now fighting five more battles in different
00:25:47.720courts a court in cornwall ontario the court uh the court in brockville in in perth in belleville
00:25:55.820and peterborough and um you know um and and you know it is you know i'll give you an example i
00:26:06.520just filed a motion with the court of appeal today to to uh discontinue the crown's action
00:26:13.100against me on the nine criminal charges um that motion will be heard in may
00:26:20.260and it'll probably take two hours maybe three hours to hear that motion but i spent the entire
00:26:28.520last week uh putting that motion together um and i took a lot of other time before that um
00:26:37.460So, you know, that two hours in court on May 6th, for me, you know, somebody else who's more skillful at this could do it much faster, I'm sure.
00:26:53.800But for me, it took, you know, an entire week.
00:26:58.840um so for me to fight on all these multiple fronts would have been um impossible i mean
00:27:10.700yeah i would have done it but i i would not have been able to do it well
00:27:15.400wow that's a lot to ask so this obviously sets a precedent now and we talked on the phone this
00:27:24.620afternoon about what the remedy is when it's been found by the courts that the province or the
00:27:31.140government federal provincial whatever has in fact infringed the charter of rights and freedoms
00:27:36.900what's the remedy what's to be done about it aside from making motions to drop all of the other
00:27:42.360ridiculous cases it sets a precedent obviously are other people in ontario now going to be able to use
00:27:49.800the ruling that you got here uh in their own defense well we'll see where we end up i'm uh
00:27:57.280and i don't want to you know jump uh what's that old jump the gun you don't want to jump the gun
00:28:03.940jump the gun or jump the shark or whatever jumping it is uh but um um the crown is likely
00:28:13.100to try to put, so the judges are faced with this.
00:28:42.420uh as if it never existed um the other part is to what's called read into the law so the i suspect
00:28:55.520this is what the crown will attempt they will read in that the law would be valid if instead
00:29:03.680of a complete prohibition on uh peaceful gatherings um well maybe we should have made it 10
00:29:10.480or maybe we should have said 20 or 50 or 100 they'll come up with some bs arbitrary number
00:29:18.560pulling out of you know where but this is not based in science and that's the other thing you
00:29:24.520know that's what john carpe was saying today when when the jccf released this i mean none of this
00:29:29.440was based in science whether it was 50 people two people 15 people 100 people right i mean you know
00:29:35.600manitoba came up with ridiculous regulations that said 300 people yeah yeah what like so you could
00:29:43.580yesterday it was five people and today it's 300 people can you explain why yeah no and we've seen
00:29:51.420the the hearings in the u.s congress and the usa congressional final report on the covid pandemic
00:29:59.000I said none of this, none of it was based in science, that whether we go the PCR test was hocus-pocus, the social distancing was hocus-pocus, the mask wearing was hocus-pocus, the vaccines were neither safe nor effective, and they did cause significant injuries, the lockdowns were injurious and harmful.
00:30:25.000um not uh they've gone farther a little bit farther than um the alberta health service uh
00:30:32.380the alberta government's covet 19 pandemic but they've come up with similar um uh findings that
00:30:39.620the covet 19 vaccine should not be uh mandated um should not be administered and that the
00:30:48.680lockdowns were harmful that the covet and the social distancing and the mask and that was all
00:30:54.100oh hocus pocus nonsense and we knew that shadow we like i knew that and i know that the government
00:31:03.660knew that in april and may of 2020 um yep now we only recently found that out so when you're
00:31:12.720arguing a case like this that goes back to what 2022 or 2021 even these cases today that were
00:31:19.920dealt with were from 2021 okay so we're going four years so four years so the the courts could
00:31:26.960say and and this is why i'm a little bit befuddled here because when when the judges come out and say
00:31:32.880well there was absolutely no reason to suspend that right of the charter of rights and freedoms
00:31:37.980the freedom of gathering i've heard judges rule against that in the past based upon the fact that
00:31:44.560There was this major pandemic going on, and at the time, they say,
00:31:48.920we didn't know how deadly it was, how it spread, blah, blah, blah,
00:31:53.360all of those BS arguments that we've heard for years now.
00:31:57.040But in this case, they didn't say that, and that befuddles me a little bit.
00:32:03.680Well, because it was a complete prohibition.
00:32:06.100There was no minimal impairment to impugning the charter right.
00:32:15.680This was a complete and absolute prohibition.
00:32:19.140But also, you know, and this comes up in my next case, the Crown Prosecution Manual puts an obligation on the Crown prosecutor to always be objectively evaluating the merits of the prosecution.
00:32:40.480so as new evidence becomes available the crown prosecutor has a bloody obligation
00:32:49.040to look at that new evidence and to determine if the prosecution should continue and they haven't
00:32:55.680done that uh just like in in the leach and barber case uh they uh were with the mosley decision i
00:33:03.280think between the mosley decision and this decision today uh everybody in ottawa uh yeah
00:33:11.180will have a pretty much a free pass uh to acquittal uh or an or appeal um there's
00:33:21.640um because the crown does have that obligation that duty and this is one of the things that
00:33:29.580has somewhat annoyed me over the last four years shadow is nobody that i've seen other than myself
00:33:39.120has raised this matter with the courts of the crown's obligation to re-evaluate the evidence
00:33:47.700before them so you know i can say yeah okay uh you know you were inundated back in march and
00:33:55.880april of 2020 with uh with with the fear story okay um and you may have may have acted irrationally
00:34:06.020or or based on that uh high degree of pseudoscience uh that was presented as science
00:34:15.960but you know as time went on the evidence was overwhelming and beyond a reasonable doubt
00:34:26.740that all these mandates were indeed harmful in killing people yeah and and i think you know
00:34:35.920i have to you know i'm i was very fortunate that i got good legal assistance from uh the jccf
00:34:43.580in this uh on this case uh but i look around at the entirety of our of these cases over covid and
00:34:53.440you know um i don't think the canadian public was served well by the legal community
00:35:03.120that many in the legal community had forgotten their own obligations in how to
00:35:12.580that all these crown prosecutors they have rules that govern them as well and we sort of just
00:35:19.820left them off the hook well i mean we could say the legal profession we could say the police we
00:35:26.500could say the medical professionals we could say the politicians the media like all of them
00:35:32.140didn't that's true Canadian public well that's true and it was just kind of one big vicious circle
00:35:38.440right like this guy says this and i'm just doing my job and next thing you know you're arrested
00:35:44.28025 times and you've got all of these cases that you have to fight against against this
00:35:49.760mammoth beast with endless money and this taxpayer money and so what what happened today was
00:35:56.640absolutely amazing were have you butted up against judicial notice in any of your cases thus far
00:36:03.220In the nine criminal cases in Ottawa, before it was stayed by Justice McVeigh for my Jordan application, the Crown initially identified that they were going to bring judicial notice in my case.
00:36:25.620And I said, okay, you do that, and I'm going to bring judicial notice as well.
00:36:32.220And I prepared an entire document for the court to consider as my request for judicial notice.
00:36:44.240And that was to recognize that in December of 2021, before the truckers convoy, the government of Canada recognized that there had already been 300 deaths from the vaccine dose.
00:36:58.260and i and i listened point by point everything that we knew before february of 2022
00:37:06.160and i said okay i want the court to recognize this judicial notice that's incredibly smart
00:37:16.580by the way that because you know what i mean how can you have judicial notice and what i'm
00:37:22.500When I'm talking about you guys watching judicial notice is that when a judge decides that he or she is going to take something as absolute fact, like the grass is green, water is wet, vaccines are safe and effective.
00:37:36.920So Randy decides, well, no, I want you guys to take judicial notice of the fact that this thing has killed 300 Canadians as recognized by the federal government.
00:37:46.500and they couldn't do both right they couldn't say safe and effective on one hand but it's killed
00:37:51.200300 people on the other yeah that would be impossible and there was a whole raft of these
00:37:56.880things uh like so that's you know that was the numbers from july like it was published in december
00:38:03.040but that was numbers from july of 2021 only just a few months after the release of the vaccine
00:38:09.200But I also put in the stuff about the requirement in the Pfizer document that Canada must incorporate a vaccine injury support program before they would supply the vaccine to Canada.
00:38:26.740So there was a whole host of relevant and important facts.
00:38:33.440and i said crown if you i am not going to accept your uh deference uh your judicial notice unless
00:38:41.320you're going to accept mine um otherwise we're going to bloody well argue it out yeah which is
00:38:47.820which is what should have happened the whole time because when judicial notice is taken
00:38:51.980you can bring in experts and they will not be listened to as a matter of fact those witnesses

00:40:23.960But you have, as a backbench MP, MPP, you are faced with, and your party is faced with thousands, thousands of competing and conflicting interests at your doorstep all the day long.

00:43:38.360organizations um so i you know uh i will take a little bit of this with a grain of salt that
00:43:47.940he's on the right track and he's just trying to keep the uh the alligators in the swamp until he
00:43:55.220can kill the alligators that are in the swamp that's interesting that's interesting what about
00:44:00.280and let's you know what let's move a little bit to this current election campaign that's going on
00:44:04.620you and i had a bit of a disagreement on x a couple of weeks ago but it was all in good fun

00:44:16.160about this and i was so happy that we can sit down and have a rational conversation with opposing
00:44:23.060points of view and come out at the end of it and say well you know what we agree to disagree here
00:44:28.000but it doesn't mean that you're a bad guy you know and it doesn't mean that i'm a bad guy it
00:44:33.120just means that we don't agree on what's going on i think it's more like this we don't agree on
00:44:38.180who's right uh but we can agree to be uh civil a professional courteous and i can understand that
00:44:47.140you know not everybody is right right and so can i so you were telling me a story about
00:44:55.100you know when you were an mpp and you did have relationships with liberals because you were a
00:45:01.640conservative mp a progressive conservative mp you had relationships with liberal mps and
00:45:06.960and ndp yeah and at ndp and and back then and i'm going back like 20 years now it wasn't necessarily
00:45:15.740a bad thing for you to be seen outside having a smoke with an ndp mpp or a liberal one right i
00:45:23.080I mean, maybe those guys were a little bit more concerned, but you didn't care.

00:58:11.860has been very injurious uh so i i you know um i think if carney uh uh under carney and uh pierre
00:58:23.360because they in my view they have a very there's very little daylight difference between them uh
00:58:28.940or between them uh shadow um i think um this this fraudulent trade war that they want to get into
00:58:38.600with Trump is going to amplify the problems in our country. It's going to amplify the economic
00:58:49.960hardship of the people in our country. And I can tell you, Donald Trump is not going to allow
00:58:58.760a hostile globalist nation on his northern border.
