00:12:11.580 sure to be a multiple day sentencing hearing for convicted mischief makers and freedom convoy
00:12:16.280 trucker protest organizers tamara leach and chris barber follow this thread for my typical detailed
00:12:21.820 reporting from inside the courtroom. Let's clear a few major things up right away. First, today will
00:12:27.700 not be the sentencing in a case as complicated as this, where the trial spanned over 40 days. The
00:12:33.300 sentencing will take some time, and during the sentencing hearing, we'll hear the Crown and the
00:12:39.360 defense teams legally, question mark, argue about what punishment Tamara and Chris will get. We'll
00:12:44.100 also get to hear any victim impact statements, and as is required by the criminal code, both Tamara
00:12:49.060 and Chris will be given an opportunity to speak, but they don't have to. The sentencing decision
00:12:55.900 itself won't be until next month at the earliest. Sometimes sentencing happens much faster.
00:13:01.280 Probably not this time. Chris Barber is not in Ottawa. Now, the left-wing corporate media
00:13:06.040 made the mistake today of publishing a story that said one of Chris's parents had died,
00:13:11.620 and that's why he was not in the courtroom in person that is absolutely untrue chris posted
00:13:19.100 a video about about that earlier today the lead crown prosecutor's father died not chris's father
00:13:27.680 so that's why the lead crown prosecutor was not in the courtroom today chris is not there because
00:13:32.340 travel expenses because he's got work to do and he's already spent thousands and thousands and
00:13:39.520 thousands of dollars going back and forth to ottawa paying for hotels paying for gasoline
00:13:44.800 it's a lot to ask not to mention the legal fees so he asked the court a couple of weeks ago if
00:13:52.400 he could attend through zoom and he was allowed to do that so chris is not in ottawa for the
00:13:59.000 sentencing he is appearing remotely from his home in saskatchewan his council team is in ottawa led
00:14:04.540 by the studious Diane Magus and the wonderful Ms. Younes.
00:14:08.500 Both convicted mischief-makers had the option to appear remotely.
00:14:12.160 Tamara is in Ottawa in person, looking confident and calm as always.

00:14:19.920 in an attempt to somehow justify their extremely off-base
00:14:23.640 and heavy-handed sentencing request.

00:14:34.040 Shockingly, like I just mentioned, the Crown wants seven years for Tamara,
00:14:37.800 eight years for Chris Barber, both convicted of one count of mischief
00:14:41.580 and then Chris got one for counseling others to disobey a court order.
00:14:47.300 Wright and Len says, my jaw would be permanently stuck on the floor
00:14:50.300 if they got the seven and eight years.
00:14:52.980 One would think binding authority in the Superior Court of Justice,
00:14:56.000 Ontario's highest trial court, would prevent the judge in this lower court
00:15:00.260 from imposing such a sentence.
00:15:01.700 That's because another convoy organizer, Pat King, was sentenced to a combined one-year jail sentence,
00:15:06.680 including nine months of pretrial credit and three months house arrest for his five convictions versus Chris's two and Tamara's one.

00:15:21.860 he says he'd be shocked if the judge was leaning towards such a harsh sentence in the first place.

00:16:01.180 case suffered a sudden death in the family and is unable to attend the sentencing hearing the
00:16:05.780 judge informed the court she sent him condolences this morning number four it should be noted that
00:16:10.360 this uh that for the vast majority of this case the media bench was extremely thin except for a
00:16:15.920 single reporter from cbc and one from the canadian press and right blend of course today the body of
00:16:21.240 The court is full of supporters and media, goes on to say maybe a few detractors.
00:16:26.800 The Crown says they aim to be finished by lunch, heavily relying on their written submissions,
00:16:31.960 of which the defense is going to be making most of theirs orally.
00:16:35.840 The judge asked to start with impact statements.
00:16:38.160 The Crown said they won't be reading any into the record, and instead they'll be in their
00:16:42.080 written submissions.

00:16:51.240 Magus said no. That's Chris's attorney, Diane Magus. Greenspawn, this is Tamara's attorney,

00:17:02.820 but rather what they would say. The judge remarked that having impact statements where material is
00:17:07.120 not necessarily based on fact available to the public, it could create confusion. Fifth part
00:17:12.860 here, the Crown says their job is to represent the public. She says no case has any comparison
00:17:18.700 into the incredible mischief here the crown says it acknowledges an extraordinary sentence but
00:17:24.420 says leach and barber are responsible for incredible harm which is why they're seeking
00:17:29.200 so much jail time number six the crown is quoting hackland on how sentencing about deterrence and
00:17:35.500 he sentenced king to one year for five convictions versus one and two convictions here can't wait for
00:17:40.760 the defense i believe serranos is the other case the crown says that after reviewing their materials
00:17:47.820 They both anticipate defense will say Tamara and Barbara attended with the best intentions, the judge says.
00:17:53.000 And that was your submission. Right. And it is.
00:17:56.440 And we anticipate they will say they had the right to protest and they did from the beginning.
00:18:00.840 The Crown has said this is not about politics, but about the means to protest employed.

00:18:39.720 didn't agree with them. Uh, sorry, this is the defense speaking municipalities and provinces
00:18:44.700 criminalized protests for years and trudeau acting more like a scorned king than a leader denied any
00:18:50.440 communication or redress the judge stops the court because two members of the media have been
00:18:55.600 approved to observe on zoom including alex zoltan of true north the judge asks him to turn on his
00:19:01.540 camera and identify himself and he does number seven we're on recess because of the technical
00:19:07.060 issue that's creating a buzzing noise interfering with the court reporter man this is even more
00:19:11.760 detailed than usual for right blend but while we wait i want to mention the strange warning given
00:19:16.940 to the court this morning it was very different from the warnings i've heard so far and instead
00:19:21.580 of warning explicitly against recording the proceedings this warning said that racism or
00:19:26.340 other abuse will not be tolerated and the police will be notified what it also said observers must
00:19:35.620 be in person the judge said the warning was changed by the ontario court of justice due to
00:19:41.160 issues in other courts. Not here. I've seen anonymous Zoom observers flood the court,
00:19:48.040 feed with explicit pornographic material, and other noisy and disgusting nonsense. I think 0.98
00:19:55.600 this is a common tactic in activist circles when their comrades are in court, so I'm not surprised
00:20:01.320 to see Ontario crack down on Zoom court abuse if they follow through. Justice Perkins McVeigh
00:20:07.440 has not permitted the public to observe on Zoom for the long duration of this trial.

00:24:17.360 I can't believe they actually threw that into the court. That's incredible. Mr. Barber was upset
00:24:23.080 after finding out about the war memorial. Crown responds, this all occurred in context of the
00:24:28.780 protest. The judge says there was evidence they knew what was happening at large. They did not
00:24:33.360 condone the discretion of the memorial or others the crown more or less ignoring that says they
00:24:38.240 advocated against violence the judge and hacklin found in king crown that it was mitigating but at
00:24:44.080 the same time they were party to the mischief impacting businesses whether or not they knew
00:24:49.400 everything happening so how does that make them guilty if they knew about it
00:24:53.900 and the government of canada systemically abused citizens who disagreed with them for years
00:25:01.660 The Crown wants the judge to remember that the rules made by police were not followed by truckers.
00:25:06.480 She mentions food stations, noise, fumes, disruption to transportation and public streets.

00:26:46.720 crown didn't clearly answer but instead they had started but then had to shut down and they had

00:26:56.640 mandates the crowd goes on to talk about the shelters that were affected during the protest
00:27:01.740 including the shepherds of good hope and how their clients and staff felt unsafe and unable to access
00:27:06.780 services and that the noise worsened mental health conditions the homeless were well taken care of
00:27:11.400 during the convoy everybody was fed and they were given hand warmers etc the crowd talks sorry the
00:27:17.000 crown talks about business issues due to political blockades the crown said they weren't going to
00:27:22.360 read impact statements again they submitted them in writing number 14 now a claim of how the whole
00:27:27.640 city felt under siege right blend lives there he says i didn't feel under siege i felt liberated

00:43:21.060 Litch and Barber were two of the organizers of the convoy that rolled into Ottawa at the end of
00:43:25.820 January in 2022. It rocked the nation's capital for three weeks and eventually ended with the
00:43:32.500 Emergencies Act being invoked, with police dragging folks off, and with Barber and Litch
00:43:38.800 being charged and then eventually convicted with mischief. That's it, mischief. But the Crown in
00:43:45.660 this case has put forward sentencing recommendations of seven years for Litch and eight years for
00:43:51.020 Barber. If you didn't think that this was already a politically motivated prosecution, well think
00:43:56.780 again. Now, I have to point out that nobody gets seven and eight years for mischief. This is a
00:44:02.640 ridiculous request by the Crown Attorney's Office that wouldn't be going forward without the
00:44:07.220 permission or perhaps even the encouragement, maybe the demand, of Crown Attorney Dallas Mack.

00:45:29.600 millions upon millions of dollars for this prosecution, that's probably enough. This
