00:09:09.720 is something that the courts have been taking in regards to the efficacy and safety of these
00:09:14.440 covet 19 vaccines for the last couple of years now so they did do some partial retraction of the
00:09:23.160 judicial notice here however as you can see from this story which you can find on children's
00:09:29.240 health defense.ca this is not a court of law this is a disciplinary proceeding through the college
00:09:36.200 of physicians and surgeons so let's bring catherine on right now hello catherine thank
00:09:40.120 you for coming on tonight really appreciate your time um before we get to what you're doing
00:09:47.080 i i wanted to put this on first because i was likely to forget if i if i didn't put it on first
00:09:52.760 what is your take on this uh lifting a partial lifting anyway of the judicial notice in this
00:09:57.240 disciplinary hearing dealing with this because judicial notice is something that should not be
00:10:06.920 used lightly and i was really struggling with our court saying well we're going to take judicial
00:10:13.240 notice because the government said it was true no no that's not what judicial notice is about
00:10:20.680 judicial notice is an undisputed fact such as the sky is blue today right right and
00:10:27.240 for them to say, oh, it's safe and effective because Health Canada says so.
00:10:31.660 Nope.
00:10:32.400 And this tribunal has just said exactly that.
00:10:36.120 You have the Health Canada or the College of Physicians is going to have to prove that it was safe and effective.
00:10:44.780 Well, I would like to see it go further into an actual court because then it would set precedent in the legal world.
00:10:50.060 But it's also very useful for me because I'm dealing with an administrative law angle by dealing with military.
00:11:00.260 So if I've got a whole bunch of grievances sitting on the chief defense staff desk, and if they don't accept the military external review committee's findings,
00:11:13.220 that there was a breach of the charter rights which makes it an unlawful mandate an unlawful
00:11:18.900 order um i can carry this well you can't take judicial notice of safe and effective anymore
00:11:25.000 so do you do you actually think that this will translate into court cases like your own
00:11:30.520 i'm certainly going to use it yes well you're going to try to use it i mean the judge has got
00:11:36.000 to say right and so uh if i i probably would be easier for me to use in what's called a judicial
00:11:42.160 review right so when there's a tribunal decision and you don't agree with it you could ask the
00:11:47.920 court to review that decision and that's where i think it can be made into law is there any
00:11:54.320 mechanism i've asked other lawyers this question and i've gotten this blank stare so i'll ask you
00:12:00.560 when a court when a judge decides he or she is going to take judicial notice and again as you
00:12:05.200 pointed out the grass is green the sky is blue it's just acknowledged as fact and in this case
00:12:09.840 they're acknowledging the fact that the covet 19 vaccines were safe and effective according to
00:12:15.280 health canada and that's good enough for them is there a way once that is implemented in the case
00:12:20.960 to have that looked at and overturned or do you have to start a whole new trial for that
00:12:26.640 i i would suspect you could probably challenge it on appeal here's the problem the decisions
00:12:32.880 that we've had that have now gone up to the appeal courts have been about mootness there's never
00:12:38.800 actually been a case carried forward based on the merits of the case right so we're still in the
00:12:46.340 early early stages of legal action regarding covid mandates and the whole thing uh we're still really
00:12:53.900 new at it we're new at it here so i can see it coming so catherine i mean if they decide because
00:13:00.400 there's this and there's something i talked about the other night and last night on the show as well
00:13:04.000 there's this summit there's a bird flu summit coming up in washington in early october and it
00:13:10.520 sounds strangely like event 201 because that was held in new york city in october of 2019 and then
00:13:16.800 poof six months later we had a worldwide pandemic declared so you know i i don't mean to alarm
00:13:21.420 anybody when i say that and some people out there watching this right now are going to say shadow
00:13:25.320 you're absolutely crazy but i mean the fact that they're even taking the time to have a seminar
00:13:32.940 like this, and it's a three or four day gathering. It's no small thing. And a lot of experts are 0.91
00:13:38.440 going to be talking at this gathering. So let's just say that the bird flu, the avion flu, H5N2,
00:13:44.720 or whatever new concoction they come up with, actually does become a pandemic, a worldwide
00:13:50.800 declared pandemic again, because of all of the mootness rulings we've had in Canada.
00:13:56.680 And that means that they haven't rescinded any of these regulations. Am I correct in saying that,
00:14:01.880 or any of these laws or any of these mandates.

00:14:34.840 And is that possibly why the Crown is fighting so hard in these cases?

00:14:42.680 The difference this time and what I'm hoping will happen is that lawyers will act more quickly
00:14:48.640 and get their butts into court and go for injunctions and bring suits
00:14:53.940 before they can justify withdrawing it suddenly in order to get that mootness ruling.
00:15:00.840 Yeah, so, you know, when we talk about acting more quickly as far as lawyers are concerned,
00:15:06.000 I'm sure there's still a large faction of legal minds in this country
00:15:10.860 who wouldn't want to touch a case like this

00:15:15.860 but let's just say we add another hundred or so lawyers who are willing to take some of these
00:15:21.140 cases on um do you think with everything that's happened in the past three or four years that
00:15:27.780 they'd be able to come up with a more cogent strategy to fight back against these regulations
00:15:33.140 i would hope so so would i but you think they could
00:15:39.060 here's the problem is that canadian lawyers are about 200 years behind our american counterparts
00:15:45.300 on holding our government to account so my tactics and strategy come from american lawyers
00:15:51.220 i hooked up with american lawyers doing uh what i do and a handful of lawyers in canada are doing
00:15:57.720 and i'm using american style tactics our laws might be different or that's what but the tactics
00:16:04.900 are the same because we're all based on the british law system so uh the crown doesn't
00:16:10.720 quite know what to do with me because i'm i'm not fighting fair no actually you are they haven't
00:16:17.920 been fighting fair for a long time so i'm glad to see i'm glad to see that we've got a lawyer in 0.98
00:16:23.620 this country who's willing to roll up her sleeves and get down and dirty with these clowns your 0.85

00:16:58.300 but this is running a really big risk here because how are you ever going to have another case how
00:17:03.420 are you going to keep this reminds me of uh what's that movie with with uh julia roberts
00:17:09.500 oh aaron aaron brokovich that's what this reminds me i have watched some of those clips to remind
00:17:15.020 me of what i have taken on yeah i mean it's a lot i mean do you have any help in this or are you all
00:17:21.420 on your own here so i'm the only lawyer however here's my advantage there's two mass torts they're
00:17:28.460 pretty much the same we filed one in june then i had a bunch of people come forward and the only
00:17:32.940 people who could beat the statute of limitations date which was in october of uh 23 i got 128 more
00:17:40.860 so we have 458 members of the military or veterans who have come forward to bring this mass tort for
00:17:48.540 abuse of power wow here's my magic formula i have 458 of some of the best canada has to offer they're
00:17:57.580 smart they know what they're doing they're motivated i you know give them their orders and
00:18:03.640 they they carry them out so i have a big green battalion behind me helping me do this and they
00:18:12.100 know the system better than the department of justice who is representing the canadian armed
00:18:17.360 forces and the government of canada i'll give you an example i was not related to this case but i
00:18:22.520 was in a courtroom with the Department of Justice lawyer, and I used the acronym of DOAD, which is
00:18:30.100 basically the acronym for the policies of the Canadian Art Forces. Now, the justice on the
00:18:37.280 bench asked me, what do you mean by DOAD? And I wasn't too surprised about that. But I was very
00:18:43.340 surprised when the Crown lawyer said to me, yeah, what's a DOAD? And I'm thinking, you don't even
00:18:50.880 know the acronym for policy for the canadian of course that's when i realized that the department
00:18:56.160 of justice lawyers don't know their own clients wow i have 458 experts behind me they're there
00:19:03.200 that's how we've dug up almost half a million pages of evidence have you they were there they
00:19:08.960 know their own conversations have you sat down with each one of these members or former members
00:19:16.320 and listen to their stories yes i have and what are the ones that stand out to you the most
00:19:23.760 so you can take your take your time with this because we've got lots of time here yeah so the
00:19:29.440 one that uh the the first group of people i asked them when i go on these interviews what's the one
00:19:36.160 story for sure that you always want me to talk about and this is a young soldier was in uh
00:19:43.520 saint jean quebec uh it was january and february of 22 which you remember is right around the
00:19:51.440 trekker convoy era yeah yeah it was better yeah it was bitter it was cold it was a typical quebec
00:19:59.920 winter his uh female commanding officer major hardy ordered him to stand outside in the cold
00:20:09.440 for six weeks he lasted every day in the cold he lost 30 pounds of muscle mass
00:20:17.920 until he finally couldn't do it anymore how we're talking that's physical torture
00:20:25.120 that is and how long per day like we're talking about an eight hour 12 hour uh
00:20:30.720 his whole day he was ordered to to be there before the rest of uh the group would be there
00:20:37.880 for their regular day so that he would have to stand outside the building and everyone would
00:20:42.580 walk past him and taunt him. They'd taunt him through the windows. They'd tell him how stupid
00:20:47.900 he was. They'd post pictures of him on Facebook and make fun of him there. If this CO did this 1.00
00:20:58.420 to a prisoner of war, she'd be in the Hague for a war crime. And she did this to her own

00:21:41.340 to even get in a courtroom with covid so it was like okay everybody's telling me these stories
00:21:47.120 and there's just one after another and i'm thinking i have to do something about this
00:21:50.960 i can't i can't live with myself if i tell them to go away and can't do anything
00:21:55.840 so then i thought well i've been watching the forces i've been watching them for years and
00:22:01.420 All of the sexual misconduct stuff, all the racial stuff, that is all abuse of power.
00:22:09.040 It all boils down to people feeling comfortable with abusing the power they hold over those in the ranks below.
00:22:15.980 So everybody comes to me with, like, there were thousands of stories, and it boiled down to hundreds willing to put their name on the paper.
00:22:25.660 But I thought, wait a minute, General Eyre just handed me an abuse of power lawsuit on a silver platter.
00:22:34.880 Because this isn't one or two people, a disgruntled veteran or a bad apple.
00:22:39.380 This is hundreds of people who were abused by their commanding officers and the chain of command.
00:22:47.220 You can't just count that many people.
00:22:49.360 And we're talking people with not a single blemish on their records.
00:22:53.460 There was one woman, she was only a few months away from a full retirement after 36 years of service.
00:23:00.920 She had deployed, left her family behind.
00:23:04.160 Her husband was terminally ill with cancer in the private married quarters on Wainwright where she was posted.
00:23:12.840 And they gave her a 5F release.
00:23:16.600 She should have been a medical release for injuries, but came after her pension.

00:23:26.320 so then because she's being released
00:23:28.400 she can't stay in military

00:24:08.740 long one then i guess huh yeah we ever go to trial we're looking at months months okay so what is the
00:24:15.620 status then of your case right now i mean has the government come to you and said all right look
00:24:21.520 Catherine, maybe you'd consider something other than going to trial.

00:24:36.760 For one thing, he doesn't understand what the lawsuit's about.

00:24:46.040 no, there's claims here that can't be handled by the grievance system.

00:24:54.760 So right from the moment I filed, I got a letter that said, there's nothing here.
00:25:01.140 I'm bringing a motion to dismiss your case.
00:25:05.280 This is going to go away, and it's going to cost your clients, unfortunately.

00:25:12.600 So then we filed the second one.
00:25:15.280 That made him even crankier.
00:25:17.200 So then he kept threatening with motion to dismiss.
00:25:20.060 I just kept going. I followed the rules of court. He eventually filed a defense. I filed a reply.
00:25:28.520 Then I started sending an affidavit of documents, which is a list of our evidence. He didn't send
00:25:35.640 me his. I said, well, where is it? He ignored me. I brought a motion in the court because I can do
00:25:41.160 that to force him to give it to me. We ended up in case management. I thought, well, this is
00:25:46.600 good because case management justice can give us decisions faster and it's always the same one so
00:25:52.360 they get to know the file really well uh so away we go into case management and uh he starts off
00:25:59.840 with uh well the crown is bringing a motion to dismiss we this needs to happen and i said my
00:26:06.000 reaction was great he keeps threatening me with it if he wants to do it let's get it over with
00:26:10.680 let's do it and the justice said to her reaction was fantastic she looked and said i agree let's
00:26:18.260 get this done uh and then the crown lawyer said well we need you know the courts are closed for
00:26:23.940 july and august we're going to be going into the fall so we should set this for next year
00:26:29.060 and the sometimes you don't get in the way when your enemies make a mistake so right the uh judge
00:26:38.840 She just lifts her head on the screen and goes, we aren't closed in July and August.
00:26:44.340 There's a couple of weeks where it's the judges take off so that we get some time off.
00:26:50.560 But we're not closed for the summer.
00:26:53.340 I have August 20th open on my calendar, counsel.

00:28:13.180 a regular everyday canadian citizen case when it comes to charter breaches or is it much the same
00:28:18.420 for charter breaches is exactly the same just because they wear a uniform doesn't mean they
00:28:23.060 gave up their charter rights yeah because that that's something that people have actually asked
00:28:27.880 me about and i've never really looked into is when you are a member of the canadian armed forces
00:28:34.000 i think somebody told me a couple of years ago you waive your rights because there are in fact
00:28:39.020 mandatory vaccine regulations for members who are deployed overseas into certain countries am i
00:28:44.780 correct ah no there's where you're getting into something that i really enjoy explaining to people
00:28:50.160 okay section 126 of the national defense act a chief defense staff can order mandatory
00:28:57.300 vaccination and if you don't want to take the vaccination you are allowed a court-martial
00:29:04.500 you're charged by a formal charge you go to court-martial and if you have a reasonable excuse
00:29:09.780 for not taking it you are acquitted this happened in the kipling case with the anthrax vaccine
00:29:17.140 for a rack at the end of the 90s but here's the catch the mandate did not use section 126
00:29:24.420 of the national defense act i think because they knew they couldn't survive a challenge
00:29:29.300 a religious exemption etc they would never survive that challenge and then you set up a precedent
00:29:34.400 you've got 3 000 people winning against your mandate um so and and the let's face it the jag
00:29:43.380 office is too small to do 3 000 courts martial right so they did it as an administrative measure
00:29:50.540 and they just screwed it up royally uh they ended up with three different directives uh or four
00:29:58.420 different directives in the end uh because every time they issue a new one i'd have a zoom meeting
00:30:04.360 and then they'd realize what mistakes they'd made and they try to fix it but they messed up badly
00:30:10.440 so they can't they can't use the well i have the authority to order it no no you don't and
00:30:17.900 And the other issue is there's policy that says you cannot vaccinate a pregnant woman in the military with anything.
00:30:28.120 There's also policy from the Kipling case that says you can't use military members for experimental drugs.
00:30:37.820 Okay, so this is where you're going to have to try and get around that judicial notice by saying,
00:30:44.860 no no this is experimental because if you don't you're never going to be able to use experimental
00:30:49.500 drugs in court proceedings judicial notice would just stop all over you right right yeah so this
00:30:56.000 is where this uh hoff decision where this tribunal said well no we can't say judicial notice of safe
00:31:03.960 and effective because health canada says it's safe and effective right we can say they approved it
00:31:10.340 but that doesn't mean it's safe and effective yeah they've also approved all kinds of junk food
00:31:15.420 you can buy in stores that have all kinds of cancer causing agents in them so i mean health
00:31:20.100 canada's approval means nothing yeah they approved thalidomide too right right we know what
00:31:26.080 thalidomide was all about back in the 50s in the early 1960s so this is a charter case then you're
00:31:32.640 not necessarily making this about covid19 or the vaccine am i right no the covid uh the covid
00:31:39.080 mandate is an example of an abuse of power because i to bring an abuse of power lawsuit against the

00:38:16.300 absolutely exemplary careers from the rank of private to lieutenant colonel and the navy 0.55
