00:19:38.460 He was one of the road captains in the Freedom Convoy.

00:19:41.160 Now, I know that a lot of people are concerned about Tamara and Chris, and rightly so.

00:19:51.040 They're trying to give these two 10 years in jail each, fine them thousands and thousands and thousands of dollars.

00:20:09.980 but harold jonker nobody has talked about really i had him on the show once i'm going to say it was

00:20:17.060 two and a half years ago when he was first charged and his trial has finally come up this is from the

00:20:22.600 justice center for constitutional freedom criminal trial proceedings continue for harold jonker

00:20:28.040 trucker from niagara who is by the way very highly respected in his field and in his community

00:20:35.920 he owns a trucking company based in the township of west lincoln in the niagara region of ontario

00:20:41.920 at the beginning of 2022 he was also an elected part-time town counselor for the township

00:20:47.440 on january 15 2022 the government of canada mandated that canadians who would not receive

00:20:52.520 two doses of an approved covid vaccine would not be permitted to travel across the border

00:20:57.760 between canada and the united states i know many of you know all of this but we do have new viewers

00:21:03.480 who are unaware this mandate effectively put unvaccinated truckers out of business

00:21:09.180 in response thousands of truckers and concerned canadians traveled to the nation's capital in

00:21:14.640 january and february three years ago now over three years to protest vaccine mandates mr jonker

00:21:21.400 joined the protest as a route captain for the niagara portion of the freedom convoy arriving

00:21:26.880 in Ottawa January 28th. He stayed in the capital for three weeks. While there, he did not park his

00:21:33.140 truck downtown, parking instead along Coventry Road some distance away. During that time, he was

00:21:38.360 not fined or charged with any criminal offense. On February 14th, the government of Canada declared

00:21:44.980 a public order emergency and invoked the Emergencies Act for the first time in Canadian

00:21:49.420 history. Successor to the War Measures Act, the Emergencies Act grants the federal government

00:21:55.220 unprecedented executive powers to handle threats to the security of Canada. The invocation of the

00:22:01.000 Emergencies Act transformed the peaceful atmosphere of the Freedom Convoy protest into a tactical

00:22:06.140 operation as hundreds of armed officers descended on protesters and passers-by. The police crackdown

00:22:13.140 began in earnest on February the 18th. Within three days, the streets of downtown Ottawa were

00:22:18.860 empty, but social media platforms were full of scenes of brutal police action. More than 400

00:22:24.860 charges were laid during the suppression of the protest. More than 257 bank accounts associated

00:22:30.640 with the Freedom Convoy were also frozen, making it difficult for some Canadians to travel home or

00:22:36.000 meet expenses. Mr. Jonker returned to the Niagara region February 21st, 2022. Several councillors of

00:22:43.160 the township of West Lincoln were openly opposed to the Freedom Convoy and to any protests against

00:22:48.360 the government's response to COVID. On February 28th, 2022, a complaint was filed against Mr.

00:22:55.300 Junker claiming that he had breached the township's code of conduct by attending the Freedom Convoy.

00:23:00.180 The township launched an investigation determining that Freedom Convoy was

00:23:04.140 an illegal protest and that Mr. Junker had violated the code of ethics by joining it.

00:23:08.560 Of course, we all know that it's not illegal. It's never been illegal, no matter what

00:23:13.600 the government has been saying about it. On July the 18th, 2022, the township fined Mr. Junker 30

00:23:21.660 days pay and demanded that he repay the value of any food and gasoline donated to him by Canadians

00:23:26.900 during his involvement with the protest. The integrity commissioner's report relies on many

00:23:32.120 allegations about the Freedom Convoy, none of which have been proven in a court of law, Mr.

00:23:36.040 Junker said at the council meeting. He stated, I went to the protest as a truck driver and as a

00:23:41.300 company owner to support what I believe was a peaceful, lawful demonstration. He was there for

00:23:46.080 three weeks. He should know of anybody. On September 23rd of 2022, the lawyers at JCCF

00:23:53.740 launched a lawsuit on behalf of Mr. Jonker seeking to strike down the township's decision to finally

00:23:58.660 punish him for his participation in the Freedom Convoy. The lawyers argued that their decision

00:24:04.920 is invalid due to procedural irregularities, factual errors, and flawed findings in the

00:24:09.820 investigative report. Notably, the lawyers challenged that the finding that Mr. Jonker

00:24:15.720 had participated in an illegal activity. The lawsuit also claims that the township's decision

00:24:21.020 violated his freedom of expression protected by the Canadian Charter of Rights and Freedoms.

00:24:26.440 The claim that Mr. Jonker participated in an illegal activity is a suggestion that is not

00:24:30.980 supported by facts. It's also bewildering the integrity commissioner found that Mr. Jonker,

00:24:35.760 who is a trucker was in Ottawa in connection with his duties as a town councillor rather than

00:24:40.360 as a trucker and a Canadian citizen peacefully protesting federal and provincial COVID mandate,

00:24:46.020 stated lawyer Jorge Pineda. The sad truth is that Mr. Jonker has been punished for his political

00:24:52.380 position in the context of an ongoing dispute with other councillors. In Canada, we must tolerate

00:24:58.780 strong differences in political opinion. Elected politicians should not be permitted to weaponize

00:25:03.880 codes of conduct to silence and intimidate their political opponents. They're still doing it,

00:25:08.100 by the way. Just ask Lisa Robinson over in Pickering. The charter is intended to guarantee 0.76

00:25:14.120 free expression. Canadian democratic institutions cannot survive if such guarantees can be easily

00:25:20.740 ignored through these kinds of tactics. 15 months later, after the Freedom Convoy protest in May

00:25:26.340 2023, police charged Mr. Jonker with mischief, counseling mischief, obstructing a roadway,

00:25:31.280 and counseling others to obstruct a roadway.

00:25:34.080 Police allege that Mr. Jonker had been a road captain during the Freedom Convoy,

00:25:38.300 that he led the Niagara contingent from the Niagara region to Ottawa,

00:25:41.640 that he co-owns a trucking company,

00:25:43.240 and that he brought 10 Jonker trucking trucks to Ottawa with him.

00:25:49.780 Why was there such a significant delay in bringing these charges?

00:25:52.600 The Crown did not disclose that reason.

00:25:56.180 Mr. Jonker's 10-day criminal trial is scheduled for, well, right now,

00:26:00.040 until the 26th. At the Ontario Superior Court of Justice in Ottawa, he is chosen to be judged by a

00:26:06.540 jury of his peers. Mr. Jonker's defense will argue that his prosecution is an abusive process due to

00:26:12.440 the lengthy and unexplained pre-charged delay. They will argue that this significant delay is

00:26:17.320 unfairly compromised Mr. Jonker's ability to make a full answer in defense to his charges.

00:26:22.840 Lawyer Chris Fleury stated, Mr. Jonker and I are looking forward to defending these charges at

00:26:27.560 trial and fervently asserting his innocence. We're also looking forward to cross-examining

00:26:32.120 the Crown witnesses and discovering the reason for the significant and unexplained delay in

00:26:37.040 charging Mr. Junker. In May of 2023, Mr. Junker was also named as a defendant in the cases

00:26:43.420 Zexy Lee versus Chris Barber et al. Zexy Lee and other Ottawa residents are suing Mr. Junker

00:26:51.060 and other Freedom Convoy participants for $290 million. I say again, $290 million seeking damages

00:27:03.100 against peaceful protesters for allegedly causing a nuisance through honking or idling of vehicle

00:27:07.760 engines in downtown Ottawa. Yesterday, Monday, May 12th, the judge in the Jonker trial rejected the

00:27:15.440 Crown's last-minute attempt to have a witness testify remotely over vague safety concerns and

00:27:20.040 required the witness to appear in person for full testimony and cross-examination.

00:27:24.560 Defense lawyers also gained key admissions from Crown witnesses, including that emergency

00:27:28.960 routes remained accessible throughout the Freedom Convoy.

00:27:33.280 And again, this trial will continue for the next week or week and a half.

00:27:38.860 So that's something that we'll be following, because there are others that have been on

00:27:44.760 trial outside of Chris and Tamara, and they would be the first ones to tell you that.

00:27:56.840 Alberta court finds WestJet wrongfully terminated unvaxxed employee.

00:28:01.480 Yesterday, the Alberta court of justice awarded severance to a former WestJet employee fired because she declined to take the COVID vaccine.

00:28:08.500 This decision may be the first in Canada to award severance to a non-unionized employee for being terminated rather than being placed on indefinite leave for refusing the vax.

00:28:22.060 Jiang Yi worked for WestJet for 11 years.

00:28:24.820 Before she was fired, she applied to be exempted from WestJet's mandatory COVID vaccination policy on religious grounds.

00:28:31.360 Employers can terminate employees if they're not part of a union, which is a different story, either for cause or without cause.

00:28:37.300 But if they terminate without cause, employees are entitled to notice or to severance in lieu of notice.

00:28:43.720 In this case, WestJet claimed to have fired Yee for cause for violating its vaccination policy.

00:28:50.340 Employers carry the onus of proving just cause.

00:28:53.520 While the court did not find WestJet's vaccination policy to be unreasonable,

00:28:58.680 it did find the company's treatment of Yee's application for exemption to be deficient.

00:29:04.580 Yee said that taking the vaccine would have betrayed her Christian faith.

00:30:01.420 it's therefore reasonable to consider that you are philosophically personally opposed to mandatory

00:30:06.840 vaccine which means you are seeking accommodation for secular reasons not religious the court found

00:30:12.500 that west jet's refusal to grant the plaintiff an exemption even though it accepted the sincerity

00:30:17.880 of her religious beliefs was not reasonable the defendant's evidence did not explain why the

00:30:22.920 plaintiff his plaintiff's information was insufficient why her safety concerns overrode

00:30:27.460 her religious objections or what she could have done to qualify for an exemption. But the most

00:30:34.040 intriguing aspect of the decision was the court's finding that Yee's termination was unjustified,

00:30:39.000 even absent the request for religious accommodation. At the time of her dismissal,

00:30:43.900 Yee had already been working at home for months. There was no evidence that her refusal to

00:30:48.380 vaccinate would have affected the operation of her department or WestJet's other employees.

00:34:00.920 Minister Mark Carney on unwinding the mountain of destructive legislation and policies that have

00:34:06.660 ravaged our provincial and national economies this past decade,

00:34:13.460 Alberta will be taking steps to better protect ourselves from Ottawa.

00:45:53.740 under justin trudeau was responsible for immigration and then housing two files he

00:45:59.100 spectacularly failed at if we want to know how bad frazier was in those jobs we need only look

00:46:04.580 to carney's election platform he said the last time we faced a housing crisis at such a broad

00:46:10.720 scale was after the second world war read the platform this crisis has left younger generations

00:46:17.700 facing rents down payments and mortgage payments so high that it turned housing into a barrier to

00:46:23.080 opportunity instead of a cornerstone to opportunity sean fraser i did that and now he's the the attorney

00:46:31.460 general what about fraser's record of immigration according to the liberal platform the trudeau

00:46:37.300 government let immigration grow at a rapid and unsustainable pace. In December, when liberal

00:46:42.360 fortunes were in the toilet, Fraser announced that for family reasons he was quitting politics,

00:46:47.460 and strangely, after the party witnessed a reversal in the polls, he announced that he was

00:46:52.300 returning. In Carney's eyes, Fraser's blundering on two key files qualifies him to be justice

00:46:59.740 minister. The only thing worse than Fraser as a cabinet minister may be Carney's judgment.

00:47:04.260 But don't take this guy's word for it, or mine.

00:47:58.760 Chrystia Freeland, who as finance minister hiked capital gains tax and carbon taxes and massively grew our debt to the point where we now spend a billion dollars a week on interest, stays in the cabinet.

00:48:12.360 Then there's Gary, Anna de Sangheri, the new minister of public safety, who said the actual crimes, the actual issues around bail are quite sound and they are embedded in, codified in law right now.

00:48:25.300 as in to say that there's nothing wrong with the system.

00:48:28.240 Well, in fact, there's everything wrong, as we see from the growing crime wave on our streets.

00:48:32.920 Then there's François-Philippe Champagne, Trudeau's minister of everything,

00:48:46.620 So he goes on to roast this new Liberal cabinet.

00:48:51.260 But at the beginning of that press conference, something I didn't show you

00:48:53.980 is that Polyev came out, spoke in French for the first 10 minutes and then started speaking in

00:48:59.120 English. And he said, we are not going to instinctively oppose everything the liberals

00:49:05.120 do. We're going to give them time. We're going to give some breathing room to see if in fact,

00:49:09.280 Mark Carney is true to his word and that he does change certain liberal policies that are

00:49:13.400 absolutely reprehensible to many millions of Canadians. And then he started roasting the

00:49:19.000 cabinet. The CBC didn't like that too much. Here they are talking about Pierre's reaction

00:49:24.720 to the Carney cabinet. And talking about how he would not be opposing the government reflexively,

00:49:32.640 that he would do things in the best interest of the country and support the government in those

00:49:38.120 issues, and that he says he wants the country to succeed. He then spent the next 15 minutes

00:49:44.100 talking about all the ministers who were there previously and the things they did to ruin the

00:49:50.700 country, naming particularly Sean Fraser and Stephen Guilbeau, taking some questions about

00:49:57.580 how he will approach things inside the House of Commons. But overall, you know, it started out

00:50:06.340 in one tone and finished in another. That's all I'll say, because he leaned into attacking the

00:50:12.720 people that he thinks still represent, don't represent change, are still more of the Trudeau

00:50:18.500 government, and particularly don't represent the things that he thinks Canadians want right now.

00:52:22.540 a whole bunch of layers and effects of that. But, you know, wanting to fight the same political

00:52:27.840 battles we've just endured during the five weeks of the campaign and for the two years leading up

00:52:31.340 to that well he should be fighting these same political battles that he's been fighting for

00:52:39.340 the past two years because it's the same people in these jobs and his job is to be the leader of

00:52:49.040 the opposition and he did say at the beginning of his press conference like i pointed out

00:52:53.980 he did say look at we're not going to react instinctively we're not going to oppose

00:52:58.100 ideologically we're going to listen to everything the government says if we don't agree with it of

00:53:03.140 course we'll stand up and oppose it but poly have said we want canada to do well and we are rooting
