00:08:21.240this your lawsuit one that you worked on for what a year three years so three three years i'm sorry
00:08:28.380yeah thrown out for for being vexatious last week and not living up to the facts can you go over
00:08:36.060exactly what happened for us please yeah so um the crown brought a motion to dismiss the lawsuit
00:08:43.060i'm basically trying to stop it in its tracks they were successful at this stage um and we
00:08:49.800have over 600 000 pages of evidence to prove what we're saying in our statement of claim
00:08:54.760But, of course, the motion to strike is not the time that you bring all of your evidence in.
00:09:02.460The assumption is that if anything in the statement of claim is assumed to be true, and if it's valid enough, then you get to proceed with your case.
00:09:14.320In our brief for this motion to dismiss, we brought 0.1% of our evidence, 6,000 pages of evidence, to support what we were saying.
00:09:26.280And yet, within two months, we got a decision saying that we had no evidence to support our claims and that the language that we used was offensive to the court, basically.

00:11:11.000this anonymous person's uh result from the final authority claimed it was one of my clients one of
00:11:19.280the plaintiffs and it was not one of my plaintiffs but the justice says it was there's her first
00:11:25.500mistake uh and then said well look it works because the chief of defense staff says there's
00:11:31.020no charter breaches and that his order was perfectly fine well not only was his order not
00:11:36.580perfectly fine but he doesn't actually have the authority under law to decide on whether something
00:11:42.700is it is a charter breach or not so way outside his his playground there from a law point of view
00:11:51.540and it seems like the judge is way out of her playground also i mean it like she's making stuff
00:11:57.380up she's doing things out of order as you describe which sets a new precedent doesn't it well it does

00:12:09.940postal workers who also because they're unionized they have a grievance system but it's a very
00:12:15.300different grievance system than the one that the members of canadian armed forces follow because

00:12:54.280and it did dives into her history as a department of justice lawyer um and uh she's was a loyal
00:13:03.080soldier for uh the trudeau liberal government uh and and was rewarded with it by being appointed
00:13:09.420to the bench essentially like if you want to talk about bringing vexatious cases to trial
00:13:14.660you know um well the term vexatious is meant to make my clients uh shut up and go away in my
00:13:21.760opinion um it's not much worse you can call somebody in a court of law right i mean like

00:17:19.500said oh no we released you on december 15th you can't file these grievances now you're no longer
00:17:26.240a member of the forces the court says that's okay the grievance system is working just fine
00:17:33.380forgive my sarcasm shadow it just you know how did this member not know he or she was released
00:17:43.080i mean did they not provide notice of this like well we sent you an email nothing he didn't know
00:17:49.060until he went to hand in that paperwork and he's a senior officer he was he was about to be promoted
00:17:53.940to command that unit if they hadn't kicked him out so this is the guy who would know his p's and
00:18:02.540cues. You would think so. And do administrative measures. They wonder about the state of our
00:18:09.140armed forces with this kind of nonsense going on. So this big Zoom meeting last week, I mean,1.00
00:18:14.860these people are all on the hook for $5,000 in court costs. Are they willing to accept that? I
00:18:20.180mean, you said they were angry. What's the next step here? Yeah, so it works out to about $16 a
00:18:25.380person. So it's not a huge amount of money, but that has to be paid before we can do something
00:18:32.240like bring an appeal. And we have been thoroughly going over, my team and myself have been thoroughly
00:18:39.180going over that judgment. We believe we have found errors in law and we have found errors in fact,
00:18:45.320a lot of errors in fact. And so we will, it looks like my clients are voting on it right now. We'll
00:18:52.220know later this week uh that looks like we may be heading to the court of appeal so if you do go to
00:19:01.120the court of appeal this is going to cost a lot more money obviously and a lot more time but you've
00:19:06.620already got your case built so there's not really much else to do is there uh no just that the court
00:19:12.520of appeal is more of a formal process requires more of the what are the legal cases what's the
00:19:19.780precedent uh that kind of thing and interestingly enough we've had a couple of cases come down
00:19:24.920from the supreme court of canada recently that actually support what we're doing so uh i tend to
00:19:31.940pull those out one came out in july and another one came out just a couple of weeks ago so
00:19:36.600i'm gonna i'm pulling out the top gun cases that i can find you said the judge made some mistakes
00:19:44.480so far in what you've been going through would that help you yes because an appeal is not an
00:19:51.420automatic thing a lot of people assume that if you don't like a decision you can appeal it that's
00:19:55.980not how it works at all you have to convince the court of appeal that there's been an error in law
00:20:02.340by the justice there's been an error in fact by the justice or combination of the two
00:20:06.620and then they decide if they will hear uh the case based on what you've uh what you've said
00:20:13.900so is this is this a situation where you you have to go in there and sit in front of like six
00:20:18.780judges and argue your case three yeah and it's like the most intense oral law exam a lawyer can
00:20:26.260go through very few lawyers are willing to walk into a court of appeal i've been there they're
00:20:31.040asking questions constantly of you right like you better know your stuff oh yeah yeah it's a rapid
00:20:36.460fire very high level uh one uh but my clients want to do this and uh i'm willing to do it so
00:20:45.900away we go i put on my robes and one more kick at the can so how long would we have to wait
00:20:53.080how long would we have to wait catherine before we hear before we hear whether they are going to
00:20:58.660accept the case or not a few months uh no we have to file our notice to appeal by december 13th
00:21:04.400And then we'll hear soon after the courts will be closing for a couple of
00:21:09.100weeks for Christmas, which might delay getting an answer.

00:42:34.760new christmas lights bylaw yeah oh kingsville i'm sorry a family in kingsville ontario has
00:42:42.560decided to pull up stakes and move after the city council passed a bylaw there that would
00:42:46.440restrict the family's christmas light show colton williams began putting together his
00:42:54.160Christmas light show a decade ago at the behest of his grandma, who was inspired by light shows
00:42:59.040she had seen on TV. I'm like, yeah, sure, you know, we can try, he explained, recounting the
00:43:04.480story. So we bought a controller. We had some lights on her house flashing, going to the sounds
00:43:08.640for a couple of years. Williams said that over a dozen cars would stop by each night to see
00:43:14.020grandma's display. She passed away a few years later after a battle with cancer, and the show
00:43:19.400moved to the Williams family home on Marshwoods Boulevard in Kingsville, which by the way is a
00:43:24.820community of about 20,000 people or so. After a decade, this display morphed with over 60,000
00:43:34.600lights that takes 500 man hours to put together. That's just physically outside, like putting up
00:43:42.460controllers, you know, running cables, all that kind of stuff. Nevermind all the behind the scenes
00:43:46.620work a three-minute song takes me about 30 40 hours of programming which is all done you know
00:43:51.900way earlier in the summer in the off months he said in a normal year the williams clan would
00:43:57.020put on three shows a night with a fourth included on friday and saturday and by the way they never

00:44:59.300this thing every single year, but he did it for the neighborhood. He did it for the kids. He did
00:45:03.880for the families, for a 25-year-old guy that would come by and see the show and see the lights
00:45:10.980because he saw them when he was a little kid. And it brought back such amazing memories. That's why
00:45:17.760he did it. That's why these people do these kinds of things. It's not about money.
00:45:25.940People would contribute, but what did these people do? They would just give it to the
00:45:30.340Cancer Society or some other charity. But then trouble started brewing in Kingsville after
00:45:37.640several neighbors lodged complaints about their street being crowded with cars for six weeks every
00:45:42.760year. That led to a meeting between City Council and the Williams family last year as they searched
00:45:47.920for a solution. Town staff were directed to survey those who lived in the area to get their thoughts
00:45:53.720on the display. Basically, the families who lived in the area after all these years decided we don't
00:46:00.700want this anymore and they shut it down. I don't buy that story, not one bit. What I do buy is a
00:46:07.160woke city council trying to get rid of Christmas. What they did was they said you can only do 10
00:46:12.100hours a week now. And so you take away all of that tradition, all of that memory, all of that
00:46:21.980togetherness in the community with some stupid bylaw in a town of 20,000 people.
00:46:31.320That's what these woke city councils are all about, man. It's not about
00:46:35.720heeding the complaints of the neighbors who've been dealing with this for years and years and
00:46:42.620years now. It's about how can we break up Western society? How can we disrupt it? How can we
